UFC-Que Choisir is demanding that the labels stop releasing such CDs because, it claims, they penalise the consumer. It is also taking action against two leading French retailers, FNAC and Auchan, in an attempt to pile the pressure on record compa- nies. In a filing to a Paris law court, UFC-Que Choisir argues that France's 1994 copyright law estab- lishes the right for users to make home copies of recorded music and that copy -protected CDs infringes the consumer's rights. Hearings against EMI will be heard at the end of this month. PARIS - French consumer bodyUFC-Que Choisir is taking legalaction against the French affiliatesof Warner Music and EMI RecordedMusic over their production of copy -protected CDs.

The US has concluded yet another round of investigationsinto media deregulation, and this time radio shouldn't bequite as affected as it was in 1996-probably becausethere isn't much left to deregulate.

The new rules, announced by the US Federal Commu-nications Commission (FCC) last week (see story below),will have a greater effect on TV than radio, with the FCClifting most of the cross -ownership regulation that onceprevented media groups from owning TV channels, radiostations and newspapers in a single market.

Despite strong lobbying from radio groups, the FCChas opted not to make major changes to the ownershipcaps affecting radio, instead it is simply redefiningthem, sometimes in a more restrictive way than in the1996 ruling.

What is interesting from a European perspective is theprocess that the FCC has initiated to review media own-ership rules, engaging in a vast consultation of the variousinterested parties. Media groups have spent a fortune lob-

bying the FCC, and the opponents of increasing deregula-tion got their voices heard too. In the rim -up to the FCC'sdecision, in was difficult to avoid the advertising cam-paign in the US newspapers launched by online activistgroup MoveOn.org, which portrayed Rupert Murdoch as"the man who wants to control news in America" andaccusing the FCC of wanting to "help him".

One claim that did not stand up was when radiogroups, especially market leader Clear Channel, voicedthe view that deregulation has benefited consumers inproviding greater diversity. Evidence of this so-called ben-efit is thin, and the FCC rightly refused to embark inanother deregulation scheme which would have set nolimits to radio ownership. The new rules, or the lack ofchanges to the old rules, proves thatthe FCC is conscious that the 1996deregulation probably went a step toofar. This will come as a blow to ClearChannel, although keeping the currentcaps prevents the arrival of a potentialcompetitor.

As European governments considerfurther media deregulation, the US sit-uation merits a closer look. There aresome clear lessons to be learned.

US congress aims to reverse FCC proposalsby Frank Saxe

NEW YORK - Just days after the USFederal Communications Commission(FCC) approved sweepingnew media ownership rulesthat will significantly liber-alise the amount of mediaholdings a single companymay own, members of theUS Congress began movesto change the laws allowingfurther consolidation.

While senators statedtheir aim was to re -regu-late the American media,some analysts believestricter regulations, partic-ularly in radio, could merely send UScorporations including Clear Channeland Viacom into Europe, notably theUK. "There would have to be some com-pelling reason of why [investing inEurope] was the best thing for us to dowith our cash. Right now I don't think itis, but circumstances could change,"

said Clear Channel CFO Randall Mays(pictured) during a media conference inNew York on June 2.

Among the key FCC provisions,which followed a 20 monthinvestigation, were chang-es in cross -ownershiprules. In all but the small-est markets, the FCC willallow a single company toown radio, TV and news-papers in the same city. Inthe largest markets, acompany could own asmany as three TV stationsand four radio stations, inaddition to a newspaper.

The government alsodecided to begin factoring in non-com-mercial radio stations into the numberof signals in a market. By adding thosestations, it could allow commercialbroadcasters to own even more stationsin some cities.

While these changes appear toloosen media rules, FCC chairman

Michael Powell says the radio rule isactually more restricting than the pre-vious provisions. By changing the waythe government defines what a marketis, it sharply reduces the number of sta-tions a company can own in some mar-kets. It is an attempt to do away withthe "anomalies" of the old system thatcreated instances like Minot, NorthDakota, where Clear Channel owns allthe commercial stations. The FCC saidit would not force a break-up of anyexisting operations, but it ruled thatover -the -limit situations could not bepassed along if the stations were sold.

Several dozen congressmen havespoken against the changes, and acommittee that has FCC oversight saidit might look at re -imposing tighterownership restrictions. "I think weought to find several ways to try toundo what the FCC has done because Ithink it is destructive," said one sena-tor. Beyond Congress, it is widelyexpected that the changes will facecourt challenges as well.

Eight vie for two Danish FM frequenciesby Charles Ferro

COPENHAGEN - Eight contenders areset to battle it out for two Danish FMfrequencies at an auction, to be held atthe Bruun-Rasmussen art auction houseon June 18. One frequency-dubbed the"fifth"-will have near national cover-age, while the so-called "sixth" willreach around half the population.

The eight bidders are: Modern TimesGroup, NRJ, Radio 2, Radioselskabet,SBS, Sky and Talpa. The groups all sub-mitted preliminary paperwork by the 2June deadline and were approved bythe Culture Ministry.

One scenario that could arise is thatTV2, the state-owned company behind.Radioselskabet, outbids the others tocreate a more attractive package for aproposed privatisation plan. The otherseven would most likely be thinkingonly about the profitability of the fre-

quency and would bid accordingly."It's vital to break [public broadcast-

er Danmarks Radio] monopoly onnationwide radio," says culture ministerBrian Mikkelsen. "The creation of a newTV channel [around 15 years ago] gen-erated greatly better programming forboth channels. We hope listeners willrealise the same benefits when they getalternatives to the fine DR radio chan-nels," he adds. DR is not eligible for thefrequencies.

Prospective bidders were required tosubmit applications stating ownershipconditions, budgetsand other informationtwo days prior to theauction and provethere is no collusionbetween bidders, sincenone may take bothfrequencies. The bid-ders also needed to put

up a bank guarantee for DKr 5.0 million(euros 667,000) to be paid to the state ifa frequency is won. A ministryspokesman says the frequencies may bere -sold, but the buyer must be approvedby the central broadcasting regulator.

When in operation, the fifth frequen-cy must have 1000 hours of news andtalk per year, and one hour news andtalk daily, excluding commercials. Thismay be broken into four 15 -minuteblocks. The other main requirementcalls for 30% Scandinavian music. Thesixth frequency has few requirements.

Greek locals defeat broadcast billby Maria Paravantes

ATHENS - The Greek govern-ment has caved in to lobby-ing by local radio stationsand withdrawn a bill whichwould have allowed commer-cial stations in Athens to airnationwide.

Local stations outside thecapital were up in arms,claiming the plan wouldhave drastically reduced analready shrinking advertis-ing market; disadvantageregional broadcasting; andlead to the shutdown of sta-tions and consequently joblosses.

"Some 1,200 local servicesemploying over 9,000 peoplewere facing exctinction," saysAntonis Grigoropoulos, presi-dent of the Pan -Hellenic

Union of Commercial RadioOwners.

However, Evangelos Zer-vas, general secretary of theUnion of Commercial AthensRadio Owners, says theselocal services are illegal."Only Athens stations are onthe air legally," he claims(regional radio stations aswell as all TV channels inGreece are currently operat-ing without a licence).

"When we opened back inthe early '90s, we wereawarded two-year licences.Once these expired the gov-ernment said they wouldcontinue to be valid until alicensing competition wasannounced," Grigoropouloscounters. "We're still wait-ing."

In the meantime, commer-

cial stations outside Athenshave been airing "awarenessspots" outlining what theyclaim would be the conse-quences for local radio if sucha bill become law. "If this bill[went] through the frequencymap [would] change," Grig-oropoulos explains. "It'wouldmean that out of the seven tonine frequencies slated foreach district, we [the localstations] would end up get-ting three to five."

Greek media ministerChristos Protopappas hassaid he will table the billagain later this summer, butsources say that reactionswithin the ruling Socialistgovernment-as well as fromthe opposition-will probablybe enough to shelve the billaltogether.

Row threatens to scupper Spain's Kissby Howell Llewellyn

MADRID - Uncertainty sur-rounds the future of Spain'snew Soft AC network KissFM following a legal wranglebetween the project's twopartners-Radio Blanca andOnda Cero Radio (OCR)-arising from the phenomenaland unexpected success of thenetwork.

Kiss FM has stunned theSpanish radio scene by notch-ing up over a million daily lis-teners since coming on air inApril 2002. Official EGM fig-ures covering January -March2003 confirm that Kiss FM isnow Spain's third biggestmusic radio network.

Under an agreementstruck between the two radiogroups in 2001, Radio Blancaowns the local licences thatKiss FM broadcasts on, andalso supplies the network's

programming. The biggerOCR group provides the net-work's studios and technicalfacilities around the country,and sells Kiss FM's airtimethrough its sales house.

The agreement struck in2001 meant OCR would payRadio Blanca euros 20.4 perKiss FM listener in return forkeeping all the station's air-time sales revenue. That dealwas based on forecasts thatKiss FM's daily audiencewould be around the 200,000mark (OCR's now defunctOnda Cero Musica network,which had a similar Soft ACformat, had around 100,000daily listeners).

According to Radio Blanca,

Kiss FM's ratings successmeans that OCR owes iteuros 24.5 million for 2003,or about 25% of OCR's totalincome for the year. If Kiss isable to retain its currentaudience, OCR could end upowing Radio Blanca someeuros 200 million for theeight years remaining on thecontract.

Kiss FM MD Marc Vicenssays if no agreement can bereached, "Kiss FM could carryon [without OCR], as itbelongs to Radio Blancawhich operated without prob-lems before the deal withOCR, but I cannot say anymore as the matter is in thehands of lawyers."

The row also threatens toaffect the sale of Spanish tele-com giant Telefonica's mediadivision Admira, of whichOCR is a part, to publishingcompany Planeta.

More artists join music lobby's VAT campaignby Leo Cendrowicz

BRUSSELS - The musicindustry launched a new bidon June 3 to persuade theEuropean Union (EU) toslash VAT on recorded music,taking advantage of the addi-tion of yet more star playersto the on -going campaign toreduce the tax.

More than 1,200 artists,from Elton John and ErosRamazzotti to Texas and TomJones, put their names to apetition appealing for a cut inthe taxes on CDs, whichrange from 15% to 25%.

Alex Callier of the Belgiangroup Hooverphonic said at apress launch that the EU ruleswere unfair, as standard VATrates were slapped on recorded

music, while other culturalproducts like books and cine-ma tickets were grantedreduced rates. "It's quite weirdthat recorded music pays thishigh rate," he said. "Whensomeone buys a biography ofJacques Brel in Belgium hepays a VAT rate of 6%, but if hebuys a CD of his music he hasto pay a rate of 21% VAT. Thismakes no sense."

Other high profile nameslending their support includeColdcut, Charles Aznavour,Zucchero, Axelle Red, NanaMouskouri, Andrea Bocelli,Laura Pausini and JohnnyHallyday. The campaign wasinitiated by a Europeanmusic coalition operatingunder the moniker "FiveMusic A Break."

The petition was sent tothe 20 members of the Euro-pean Commission-the EU'sexecutive-which is expectedto decide whether to recom-mend a change in the list ofgoods that are grantedexemptions to the EU's VATdirective.

The music industry hasresigned itself to an unsym-pathetic approach from theCommission. "The Commis-sion has always made it clearthat it is reluctant to changethe proposal," says IFPI'sregional director for Europedirector Frances Moore. "Ourbest hope lies with the EU'scouncil of ministers, wherewe expect a fierce battle. Weremain hopeful, but we knowwe're up against it."

ON THE BEATUK'S ANDY'S RECORDS GOES INTO ADMINISTRATIONLONDON - UK independent music retail chain Andy'sRecords, once the country's largest, has gone intoadministration. In a statement, MD/founder AndyGray said: "Due to the depressed and uncertain stateof the music business and the failure of certain partiesto help in the restructure, my family interests are nolonger prepared to help finically to underwrite thebusiness and the directors have asked the bank toappoint [accountants Robson Rhodes as] administra-tors." Founded in 1975, at its trading peak in 1998Andy's Records enjoyed annual sales of £29 million(euros 40.2m) and accounted for 2% of the UK record-ed music market.

DEAL ALLOWS GREEK KIOSKS TO SELL CDsATHENs - Minos -EMI has signed a unique deal withdistribution agency Argos providing street kiosks sell-ing CDs in an attempt to penetrate remote areas inthe mainland as well as on the Greek islands, wherethere are no record shops. "It started out as anattempt to tackle piracy, which is rampant in isolatedparts of the country," Minos -EMI marketing directorGeorgia Valavani says. "It's been warmly received bythe locals, who finally get to see what a real CD lookslike." Minos -EMI launched the project with sevenmajor releases by major domestic artists includingGeorge Dalaras, Marinella and Yiannis Parios.

VMM CAMPAIGN PROMOTES 0 -MUSIC'S IMAGEBRUSSELS - VMM, which owns TVand radio broadcasters in Belgiumincluding the Top Radio network, haslaunched a campaign to emphasise themusic -intensive offering of its Flan-ders -wide Hot AC station Q -Music.With the tagline "Minimum Talk, Max-imum Music", the campaign, being run

on VMM's TV channels, highlights Q -Music's determi-nation to reduce its speech output during the day infavour of more music for its 18 -44 -year -old targetaudience. HESSEN AWARDS FREQUENCIES TO HARMONY.FM

COLOGNE - The licensing authority for Hessen hasawarded a basket of frequencies covering seven medi-um-sized towns in the state to harmony.fm, aSchlager/Gold station directed at the over -forties,which until now has only been available on satellite.It beat a wide range of applicants for the frequencies,including RTL Radio and the Turkish stationMetropol. Harmony.fm is owned by state-wide marketleader Hit -Radio FFH, which also owns a youth sta-tion, Planet Radio. The licence award was made pos-sible by a change in the state law in December 2000,allowing a state-wide mass -appeal station like FFH toown up to two so-called "niche" stations, directed atspecific demographic segments.

Raids silence Irish pirate radioby Ann Scott

DUBLIN - Thousands ofalternative radio listenersin the Irish capital havebeen deprived of theirfavourite stations followinga series of raids on unli-censed broadcasters acrossthe city on May 27.

Dubbed the "Black Tues-day" raids, up to 20 stationswere silenced by localpolice, the telecoms regula-tor, the Commission forCommunications Regula-tion (ComReg) and assistedby the Electricity SupplyBoard. The raids sawequipment seized andpower cut-off at locationsaround Dublin.

Indie rock station Phan-tom FM, regarded as themost successful pirate,

claimed it had a marketshare of 4% before it volun-tarily closed in the midst ofthe raids last week.

Twice shortlisted for aSpecial Interest RadioLicence from the Broad-casting Commission of Ire-land (BCI), a spokespersonfor the station said: `We

believe that the BCI hasconsistently failed tounderstand the value anddiversity of the type of pro-gramming we offer and itspopularity amongst 15-34

year -old Dublin listeners."Chairperson of ComReg,

French community radio funding reinstatedby Lisa Pasold

PARIS - Fears thatFrance's community radionetwork would face poten-tially devastating budgetcuts have proved unfoundedfollowing the "discovery" ofmillions of euros which arenow available for funding.

Gilbert Andruccioli,president of communityradio federation CNRL wasrelieved-though puzzled-that nearly euros 5.5m hadbeen overlooked and wouldnow be made available.

The news followed anApril 17 announcementfrom the FSER, the fundingbody which supports non-profit making radio sta-tions across France, thatcommunity stations would

have their financial supportcut by 15%.

According to the FSER'sstatement, there was notenough money available tokeep government subsidiesto community radio net-works at their currentlevel, despite some commu-nity stations depending onthese subsidies for up to90% of their budget.

"I'm calling it the mira-cle of Saint Dominique,"says CNRL's Andruccioli. "Ihave to suspect that, con-sidering the social climatein France at the moment,there might have been atemptation to move fundsallocated to us into a moredemanding sector. Somemight say that our deter-mined protest had an

impact on this suddenmiraculous 'discovery' offunds. However, it's alsopossible that the moneywas simply temporarilymisplaced, that someonedidn't their job correctly,and now the problem hasbeen solved."

News that funding was tobe cut had been met byprotests from listeners, theCNRL, Ferarock-whichrepresents rock communityradio stations-and theCNRA, yet another commu-nity radio representativebody. On May 20, the FSERannounced the Finance Min-istry had uncovered euros5.5 million-in an accountpreviously believed to beempty-waiting to be allo-cated to community radio.

Tommy Boy resurfaces in Europeby Olaf Furniss

BERLIN - US independentlabel Tommy Boy (TB) hasappointed former UniversalMusic Germany internationalmarketing director OrnelaTomas to head its new -lookEuropean operation, whichTB founder Tom Silverman(pictured) has opted to basein Berlin.

Tomas will coordinate thecompany's releases across thecontinent, liaise with distrib-utors in 10 territories andseek out potential signings.

The company's return toEurope follows its founderTom Silverman buying backthe company from WarnerMusic in 2001-it had been inpartnership with the major-leaving the latter with back

catalogue material includingHouse Of Pain, De La Souland Queen Latifah, while Sil-verman retained the TommyBoy name.

Explaining his decision tosituate the label in Germany,Silverman says: "In last 10years Germany has been oneof the biggest hip -hop mar-kets, it is close to EasternEurope which has big poten-

tial and it is good for manu-facturing and distribution."

Edel will distribute thelabel in Germany, while in theUK Gut Records will overseemarketing and Pinnacle willhandle distribution. Wagramwill be responsible for bothareas in France, similarlyPlayground in Scandinavia.Further deals are due to fol-low in another six territories.

Press and radio promotionwill outsourced to indepen-dent pluggers. "The peoplewho work an act have to like itand understand it," saysTomas. "Tommy Boy servesniche tastes and targets musiclovers." She adds that theworking with Silverman andhis new roster were the twodeciding factors when it cameto accepting the position.

ON THE BEATGERMANY GETS FIRST GAY/LESBIAN RADIO STATION

COLOGNE - BluRadio, Germany's first station aimed atgays and lesbians, has been awarded a licence in Berlin,sharing its frequency with three others. The licencinglocal authority chose the four following a competition inMarch, when existing urban station Jam FM was movedto a better frequency. Its old frequency has now been relo-cated and improved. BluRadio will air Friday to Sundayevening from 20.00 to 02.00; Russkij Radio, providing aservice for the city's Russian -speaking community, willhave 07.00-13.00 daily; London -based international radiorebroadcaster World Radio Network will have nights andafternoons, and the Berlin community radio Open Chan-nel will have the rest.

JAZZ FM GETS THE ALL -CLEAR FROM RADIO AUTHORITY

LONDON - Following complaints about itsmusic output (M&M, May 3), Jazz FM hasbeen cleared of any breach of its agreed pro-gramming format by UK regulator theRadio Authority (RA). After its takeover byGMG Radio last year, Jazz upped theamount of vocal soul music played during

daytime on its two stations-based in London and Man-chester-but increased the amount of specialist pro-grammes it airs off-peak. Living after midnight, 30 years onLast month, RTL's GeorgesLang celebrated threedecades presenting late -night rock show Les

Nocturnes on nationalFrench full -service stationRTL. Lisa Pasold spoke tohim about his longevity, hisenthusiasm for radio andhis musical passions.

For 30 years, Georges Lang hasbeen working late. His rock showLes Nocturnes debuted on RTLan May 22, 1973 and since then,Lang has been at the micro-

phone from midnight to 03.00 fromMonday to Thursday (on Fridays andSaturdays, he hosts WRTL Countryand Saga, in a similar timeslot).

At the beginning, Les Nocturneswas devoted to newly -released rockmusic, although over the decades keyartists such as the Eagles and theRolling Stones have shifted intoClassic Rock territory. "The musicI've spent my life defending hasevolved: it began as a new sound,then it became embedded in everydayculture, and now it's a bit more dar-ing, more marginal again," says Lang."There are new artists like Goldfrapp,Coldplay, the White Stripes, with allthe qualities that first thrilled meback in the '70s."

Lang first discovered the Anglo-Saxon rock sound as a kid in hishometown of Metz. The town had sev-

eral foreign army bases. "I wouldbabysit for these American andCanadian families, and I had achalice to listen to records at theirhouses. I heard music by FatsDomino, Paul Anka, Ray Charles, allthis jazz that I loved."

Then, at a Metz military exhibition,he discovered rock: "In the Americanstand, there was a little podium withthree GIs playing electric guitar. I wasfascinated, I even bought an electricguitar. I wasn't a very good musician,but I found myself in the records ofothers. And that's when I started tothink that I could be a DJ."

Hidden aspectLang found a position in 1971 withRTL, which-prior to the legalisationof commercial radio in France-wasthen broadcasting as an AM stationfrom Luxembourg. "The hiddenaspect of radio appealed to me, thisidea of making radio from anunknown secret place. At RTL, wewent on and said 'Hello, you're listen-ing to RTL' and only a few peopleknew that we were really 400 kmfrom Paris. I was delighted to do anight-time show from such a hiddenplace." Lang says it reminded him ofbeing a child and listening to his tran-sistor radio in bed, when he was sup-posed to be asleep.

Soon after Lang's arrival, RTLbegan broadcasting all night, whichgave Lang and colleague Bernard Shua chance to develop a five -hour, all

night long programme. "Bernard andI decided to have two parts, midnightto three and three to five, but weweren't sure what to call it. We decid-ed on Louvigny 1 and Louvigny 2,because we were broadcasting fromthe fanrous Villa Louvigny with allthe international studios. But thename didn't thrill the Paris directors,so we came up with Les Nocturnes asthe logical title."

Simple formulaA simple name for a show based on asimple formula of rock tracks, inter-views and concert clips. "I let themusic talk," says Lang. "For a longtime, I considered myself more of aprogrammer than a presenter, really."He credits his frequent trips to theUS as a formative influence on hisradio style, especially in introducingjingles to the show (one of the mostfamous featured Wolfman Jack).

Indeed, some of his original jinglesare now collectors' items.

Over the years, Lang has met vir-tually every big name in the business,Bob Dylan the only notable absenteefrom his impressive list of artist inter-views. And Les Nocturnes has consis-tently given space to music thatwouldn't normally get onto main-stream radio. "Georges offers accessto indie music, partly because he's onat night so the station has given himspace to develop, to be eclectic," saysAlexandre Sap, general manager ofRecall Records.

Lang's calmly optimistic signaturehas become so beloved in France thatin 2000, when RTL tried to pull theplug on Les Nocturnes in a wide-rang-ing station revamp, the public outcrydemanded that the show be reinstat-ed. In cutting Lang and daytime talkshow presenter Philippe Bouvard,RTL lost almost two million listeners.Lang was not told in advance that hisshow was being axed, and discoveredthe news through the press. "I wasextremely surprised, but I decided toleave calmly, and a date was chosenin December when I would stop. Fine.But all through the autumn, therewas intense reaction from the pressand from my listeners, who sent let-ters and emails by the thousand!"

Management changesFollowing the disaster of the RTL pro-gramming changes, a managementshake-up was inevitable, and RTL's

new managing director Robin Leprouximmediately brought back LesNocturnes. The only compromiseinvolved Lang moving the show fromLuxembourg to Paris, a move thathasn't changed the tone of the show:"The creation of the show, its atmos-phere, came from the specific mood inLuxembourg, the wonderful col-leagues in the building, and our dis-tance from Paris. But after all theseyears, I don't need a view of the parkin Luxembourg to feel good, I justhave to close my eyes to recreate thatatmosphere," says Lang.

He's happy to talk about his rela-tionship with the station now: "It'sthe first time in all my years at RTLthat the management-not the musicmanagement, which has always beensupportive, but the head of the sta-tion-completely believes in me.We're celebrating Les Nocturnes' 30thanniversary because of RobinLeproux's enthusiasm."

To mark the anniversary, Warnerhas just released Trente Ans desNocturnes, a 36 -track double CDincluding titles from the likes of RayCharles, James Taylor and CarlySimon. Lang only regrets not beingable to include his all-time favouriteartist Jackson Browne on the compila-tion, because of rights issues (see boxfor Lang's list of personal favourites).

And the secret to his success as abroadcaster? Lang is characteristical-ly modest, claiming he learned a lotfrom his frequent trips to the US. "Italk quietly. We don't talk without rea-son and if we don't like a certain song,we just don't play it. Easy. We playwhat we like, that's it. What's changedover the years is strictly technical-though of course the voice has gottenriper as the guy has gotten older!"

Evanescence set Europe simmeringby Christopher Barrett

Last week's European Top 100 Albums wastopped by a band few knew about only sixmonths ago. Today, US rock act Evanescenceare this year's biggest new attraction.

Despite having already sold over a mil-lion copies of their debut album Fallen(Epic) in the US since its March 3 release,the beguiling rock quartet who hail, appro-priately, from Little Rock, Arkansas havenot proved shy when it comes to their inter-national responsibilities; an attitude thathas already paid dividends.

"Evanescence are a worldwide phenome-non, but I think the breakthrough camewhen they visited Europe the day before theIraq war started," says New York -basedDaniel Levy, VP marketing, Sony MusicInternational.

"Internationally, Fallen [released April 28in the UK] has just reached 700,000 in fourweeks," reports Levy. "So it's huge."

Indeed. The album has gone gold in Spain,and the UK has seen 160,000 copies sold in justthree weeks. In Germany it has sold over100,000 in the same period.

Despite having been together since the early'90s, Evanescence-who centre on the songwrit-ing skills of vocalist Amy Lee and guitarist BenMoody-shot into the public eye via their high -profile inclusion on the soundtrack to theaction -fantasy movie Daredevil. "There weretwo Evanescence tracks on the Daredevil sound-track and the music was really key in the movie,"explains Levy. "Internationally we sold around300,000 copies, but it was really a springboard

for Evanescence and we always thought about itas such."

With many radio presenters, such as JoWhiley at UK national public service stationBBC Radio 1 (CHR), playing the single BringMe To Life before it was released on May 19, andterritories such as Spain and Asia picking up onthe album as soon as it was serviced in January,the signs have looked good for Evanescencefrom the outset.

Bring Me To Life has already enjoyed a suc-cessful run on European radio and is currentlybeing playlisted by stations as widespread asRadio 105 (CHR) in Milan, YLEX (CHR/alterna-tive) in Helsinki and VRT Studio Brussels

(alternative). "Bring Me To Life begins as apiano ballad before building into an epic anddramatic song," says Gerrit Kerremans, headof music at VRT Studio Brussels. "It's a newrock-rap-goth hybrid in contemporary musicand it's certainly a significant single."

Perhaps partly due to the band's imageand Lee's striking appearance, Evanescencehave been given an equally warm welcomeby television, featuring on MTV, Top Of ThePops in the UK and Italian show FestivalBar.

On the live front, Evanescence havealready toured Spain, Germany, Hollandand France earlier this year, and are back inEurope in June for a mixture of promotionand gigs when they headline clubs in Spain,Germany, UK, the Netherlands, Italy,Sweden and Switzerland-as well as a vari-ety of festivals such as Festimad in Madridand Germany's Rock Am Ring and Rock ImPark.

The next phase comes in September whenEvanescence return to Europe for more promo-tion and a tour supporting the second single,slated to be Going Under, before coming backagain in November. "It's really about repeatedvisits-despite their huge amount of success inthe US-Fallen contains many good tracks andwe are in for a campaign of about a year and ahalf," explains Levy. "They have a good under-standing of the international market and espe-cially, how Europe works. That obviously helps,but the reason they are doing so well is becausethere is just nothing like Evanescence at themoment. Both musically and emotionally theyhave taken rock to another level."

Stereophonics snuggle up closer to radioby Gareth Thomas

UK rock band The Stereophonics are using localradio as an integral part of the campaign behindtheir latest album, You Gotta Go There To ComeBack, released on UK indie V2 on June 2.

The Welsh three-piece are embarking on aEuropean tour which will see them work closelywith local radio stations, which will be involvedin tickets giveaways and competitions.

"We're are looking at doubling sales on thelast album, [Just Enough Education ToPerform, which sold 2.4m worldwide]," says V2international product manager Julia Connolly."And radio and live performance are a big partof that."

The UK part of the tour began on May 27 inBristol, where the local GWR station were thepartner, before going on to Bradford (Emap),Glasgow, (Scottish Radio Holdings), London(Xfm/Capital) and ending in Cardiff on June 1(Red Dragon/Capital).

The band, meanwhile, has literally grownsince the last album, adding four members in itslive line-up to its core trio of Kelly Jones(vocals/guitar), Richard Jones (bass) and StuartCable (drums). And creatively too, the sound isa more mature one, with the band mining rock'sbluesy roots.

The band's lead-off single for the UK,Madame Helga, was released on May 19. Therest off Europe will go with Maybe Tomorrow,out on June 16 (apart from eastern Europe,where it will be released on July 14). "MadameHelga is a real rock track," explains Connolly."Whereas Maybe Tomorrow is much less rocky,much more in line with continental Europeanradio formats."

James Curran is head of music at rock sta-tion Virgin Radio in London. The Stereophonicsperformed the station's recent 10th anniversaryparty. "Madame Helga is a great summertrack," says Curran. "I know some stations findthe track a bit heavy, but we think it's a greatrocker. The more you live with it the more yourealise what a great song it is."

The follow-up single in the UK will be thecontinental European choice, Maybe Tomorrow."There'll be no such problems with MaybeTomorrow, which is a prefect guitar band radiotrack," says Curran. "A lot of stations whopassed on Madam Helga have already beenadding Maybe Tomorrow."

The continental European leg of the tourkicks off on June 7, and sees the band perform-

ing at festivals including Germany's Rock AmRing and Rock Im Park, Holland's Music In MyHead, and Belgium's Werchter. Again the tripwill see the band hooking up with radio for tick-et giveaways and competitions. V2 have beentalking to, among others, France's Oui FM,Holland's 3FM and public broadcaster alterna-tive station Radio 21 and VRT's Studio Brusselsin Belgium.

As far as media support in continentalEurope goes, Connolly says: "It's a really posi-tive reaction. The national stations are on boardeven though we're still some time away from acommercial release."

The act will also be supporting the RollingStones on their three French dates, as well asperforming at the Montreux jazz Festival, atFestival Bar in Italy and at German trade fairPopkomm, before heading out to Australia andJapan.

Although a diverse collection of material, thenew album does have a fuller and coarser soundto their previous work. "We wanted to capturethat live sound we have," says the band's leadsinger and songwriter Kelly Jones. "Anotherinnovation is the use of strings on the album.We've never done that before. But the songskind of dictated that." Jones highlights MaybeTomorrow and Climbing The Walls as being rep-resentative of where the band are at now.

After 1997's What Gets Around, which shift-ed one million copies worldwide and 900,000 inEurope, and 1999's Performance And Cocktails(2.2m worldwide, 2m in Europe), V2 are hopingto continue the upward trend with You Gotta GoThere To Come Back. "They have been so con-sistent with their albums and this is great-very, very strong," concludes Virgin's Curran.

of Europe. Originally recorded by The Doors in1967, Young's version is a mellow, jazzy take onthe original. An ideal sound for both AC andCHR stations, Light My Fire is an airy, popsong with its Latin -style percussion and withYoung's almost feminine -sounding voicecarrying jazz inflections. It has been buildingmomentum in Europe since its release to radioand has been particularly popular in Italy.Dutch national hot AC station Noordzee FM isone of those playing the single. "It's alwayshard to cover a classic," says head of music RobEsther. "But this is a light, fresh version of thesong. It's almost a different song." Esther adds:"And it's much better than Unchained Melodyby Gareth Gates-that was terrible." The trackfits well into Noordzee's format which Estherdescribes as "happy songs" for a mainstreamaudience. Hollywood, Madonna'ssecond single off her newalbum, has a more uptempo,positive feel about it thanAmerican Life-her first

single off the album of the same name. It startswith the twittering of birds and a plucked acousticguitar before being driven forward with a certainmomentum by fast, electronic beats. Madonna'srecognisably clear, strong vocals add their weightto the time. Following hot on the heels of AmericanLife, which was a radio and sales hit, Hollywoodhas already been programmed by many EuropeanAC and CHR stations, even though it is notreleased for while yet. It was recently added to theB list on Emap's Big City Network-the UK radiogroup's CHR stations-where it is being playedevery two hours or so. "Hollywood was really thetrack we were waiting for [from the album]," saysAndy Roberts, group radio programming directorfor Emap. "It's kind of a more mature approach. Ithink the fans will love it, but you kind of wonderwho it will appeal to." The single, like the album,was produced by Madonna and French keyboardplayer and producer Mirwais Ahmadzai. Whiledifferent to her previous work, Hollywood is a"single with a good melodic style," notes Roberts.

Room 5 featuring Oliver Cheatham's Make Luv(Noise Traxx) remains at the top of EuropeanDance Traxx for the sixth week running, makingit the most successful number one dance charttrack ever to emerge from the Benelux countries. It currently ranks on two thirds of all con-tributing national dance charts and remains thebiggest seller at dance retail.

Saffron Hill featuring Ben Onono's My LoveIs Always There (Illustrious) is up to three fromnumber four this week, after registering thebiggest gain in terms of dance retail. It debutson dance charts in Sweden, Belgium, Finland,Hungary and Poland.

There is only one new entry in the top 10 thisissue. It is by Danish act Junior Senior withtheir infectious Move Your Feet (Crunchy Frog).The 11 to six jump is partially due to debuts onlocal dance charts in Germany and Italy, but ismainly based on upward movement on chartswhere the track is already present.

Outside the top 10, German act CultureBeat's Mr. Vain Recall (Abfahrt) rises from 17 tonumber 13 this week, and is breaking out of itshomeland, Germany, and debuting on nationaldance charts in Austria and Belgium.

Meanwhile Roadrunner -signed Dutch DJJunkie XL rockets up from number 24 to 15 withCatch Up 7b My Step. The single just debuted onan additional dance chart in Germany andmakes its first appearance in Denmark. Whilethe track is rising high in the UK, it has not yetcharted in the artist's homeland, theNetherlands. Speaking of Dutch signings, Dutchact Marco V's C:\DEL*.mp3 1 Solarize (ID&T)climbs from number 46 to 18 this week.

There are twelve new entries and three re-entries to the top 100 this week. The highest ofthese, at number 20, is Junior Jack's E Samba(PIAS). The track is the biggest mover thisweek. Junior Jack is the alter ego for Belgian -based Italian Vito Lucente, who, incidentally,also uses Room 5 as another of his tags.

Finally, Sean Paul's Get Busy (2 Hard) entersat number 41, after rankings on dance charts inthe UK, Germany, Sweden, Norway andHungary.

Robbie Williams stays at the top of EuropeanRadio Top 50 chart this week with Come Undone(EMI), after overtaking Madonna last week.

]]i- We may end up withtwo Madonna (pictured)singles in the top tensoon: her American Life isat number two this week,while radio programmershave leapt on her new sin-gle, Hollywood(Maverick), which is thehighest new entry thisweek at number 18.

Irish Hot AC stationTipp FM in County Tipperary is playing the track,although it isn't playlisted. The station uses a textmessage system to gauge audience taste, andMadonna is one of the most -requested tunes.

"Between six and seven [in the evening] it's ourtext -request hour," says the station's head ofmusic, John Keane. "Hollywood is on our text -request list and is really popular. It will probablybe by bumped up to our B list next week "

Further down the chart, I'm Glad (Epic) byJennifer Lopez moves up six places to numbernine, while Melanie C's On. The Horizon (Virgin) isjust below her, up seven at number ten.

Tipp FM is playing both tracks. But Keane ismore excited by Free Me (19/Universal), the newsingle by another ex -Spice Girl, Emma Bunton."It's flying with our listeners and I'm plugging itconstantly, because I think it's a great radiosong," says Keane, adding: "And ,she's lookinggood lately."

A new entry this week at number 33 is BeyonceKnowles with Crazy In Love (Music World), whichalso features US rapper Jay -Z. One place belowthat, at number 34, are US rockers GoodCharlotte with their Girls And Boys (Epic)-upseven places this week.

Up nine places at number 40 is Celine Dionwith One Heart (Epic), it's on Tipp FM's text -request list. "It's not a bad song," says Keane. "Itcould go up to our B list."

Although it's slippeddown the European chartto number 43 this week,50 Cent's (pictured) In. DaClub (Interscope) is still abig track with Tipp FMlisteners. As well as hisjob as head of music,Keane also deejays at anightclub in Waterford,which helps him gaugewhat dance tunes are pop-

French consumers take action over CDsHerve Rony, who emphasises that itis only partially the responsibility ofthe record companies: "We're work-ing at fixing any problem that theconsumer encounters. But the recordcompanies are being victimised;really the responsibility should fallon the equipment manufacturers.After all, these problems are isolated[and] not all car stereos have experi-enced problems."

Independent labels' organisationUPFI says it supports the use of pro-tection systems "providing theydon't prevent the use of CDs on allplatforms, including computers andcar stereos," but would oppose mea-

sures making home copying impossi-ble or very difficult on the groundsthat "such a measure would be neg-atively experienced by most con-sumers and risks penalising thewhole music industry". But theUPFI says in statement that "itwould not be acceptable that byopposing any protection device,UFC-Que Choisir became, thoughinvoluntarily, the objective ally ofpirates".

For the moment, labels are usingdifferent copy -protection technolo-gies, such as the one developed byMacrovision, but there is no indus-try -recognised standard for protect-

ing CDs. The question of private CDis a much more serious

aspect of the court case. UFC-QueChoisir argues that the consumerhas the legally -enshrined right tocopy a CD.

But record companies feel unfair-ly attacked. "What's unacceptable isthat the UFC is using this as a plat-form to argue that CDs shouldn't beprotected. This is ridiculous," saysRony. "The law is very clear thatthe consumer's right to privatecopying is a limited exception. Obvi-ously, if a consumer buys a CD andmakes 10 or more copies of it,they're doing this not because they

have 10 different personal uses forthis CD, they're doing it to sell thecopies. And this tramples on theidea of authors' rights." Rony addsthat the new European CopyrightDirective authorises the use of tech-nological measures to preventmusic piracy.

The UFC's Bazot agrees that pira-cy is a huge problem. "But," he says,"the irony of the protected CD rightnow is that the record companies arepenalising the legitimate paying cus-tomers. Piracy is a massive under-ground industry; the small amount ofillegitimate copying made by payingconsumers is not the real problem."

Metallicaon Elektra in North America/Japanand Universal's Mercury in the restof the world), was brought forward inorder not to give undue exposure tothe rippers.

Universal Music released thealbum in its territories on June 5after keeping a tight rein on therecording. "We took the albumaround the world for one-to-one lis-tenings with retail heads," says Mer-cury Record's director, internationalmarketing, Sian Thomas. "It was abit hectic."

In the wake of the band's much -publicised anti-Napster/file-sharingstance, using the Internet legally forpromotion has become an importantpart of the cam-paign. Buyers ofthe album-andthe single of thesame name-willfind an individualcode on the CDsthat, when typedinto the website,will enable them toaccess live videofootage of the band.

It will be aquestion of waitingto see whether theMetallica fans-some 317,000 ofthem-who found their Napsteraccounts frozen following legal actionby the band will be ready, literally, tobuy into the new set. Could Metalli-ca, through these actions, have alien-ated its core fanbase?

"No-quite the opposite, in fact,"says Thomas, unsurprisingly. "With-out exception, it's justified and pas-sionate acts like this that the fanshave come to expect and respect."

What is for sure is that whilemainstream radio has been typicallyhesitant, Europe's press and especial-ly music television-including Viva,ZTV and MTV-have come fully onboard.

"MTV Europe has shown greatfaith in the release," says Thomas.MTV screened a Metallica Iconseries, which features other artistsplaying cover versions of Metallicahits. The channel also declared June8 Metallica Day on across Europe,with 24 hours devoted to interviews,videos and concert footage of theband. In the evening there was also a

live link -up to the Rock Am Ring fes-tival in Germany, which Metallicaheadlined. Indeed, as far as Euro-pean territories go, Germany plays abig part in the campaign. "It is ahuge market for the band," saysThomas. "They sell well acrossEurope, but Germany is their secondbiggest territory, after the US."

The album itself is as immense,intense and brutal as one mightexpect, and leaves the distinctimpression that metal is Metallica'strue calling. It is also the product ofhard times. Frontman James Het -field recently checked himself intorehab, whilst bassist Jason Newsteadchecked

On the live front, the band recent-ly played a surprise-although much -rumoured and then denied-appear-ance at the UK's Download Festivalon June 1 and performed at the RockIm Park and Rock Am ring festivalsin Germany on June 6 and 7.

They will continue on the festivalcircuit through June, appearing atItaly's Heineken Jammin' festival,Spain's Doctor Music Day, Denmark'sRoskilde, among others, and endingperforming up at Belgium's Werchterfestival on June 28. In between, theband will play three shows in one dayin Paris on June 11 (at 13.00, 18.00and 22.00). July sees the band return-ing to the US for further dates.

10FM rescue bid failsFM was set to disappear from the air-waves on "Zero Base" day of Sunday,June 1, enabling 10 FM to continueits 15 -year tenure on the terrestrialairwaves, albeit on different frequen-cies.

However, following the collapse ofthe deal on June 5, Skyimmediately pulled Radio10 FM from its frequen-cies, replacing it with amusic -only version of theGold service it had suc-cessfully proposed in thefrequency awards, 103 FM- de Gouwe Ouwe Zender.

having told upset listenersjust four days earlier that,thanks to a deal with Sky,it would be staying on theair after all. "It feels like we havebeen robbed," says Radio 10 FM pro-gramme director Tom Mulder (pic-tured). The station will, for themoment at least, continue to broad-cast on cable, Internet and satelliteplatforms, but as Mulder acknowl-edges, "this is not a solution foreverybody. Radio 10 FM belongs onthe [terrestrial] airwaves and we willcontinue our fight to return there.The overwhelming support we arereceiving from our listeners is heart-warming, and gives us the strengthto carry on."

The main reason for the initial col-lapse of the deal with Sky was TRI'sdecision to press ahead with its courtcase against the Dutch governmentconcerning 10FM's licence loss, evenif it subsequently sold the station toSky. Furthermore, part of TRI's legalcase is that Soft AC station Sky,which broadcasts wall-to-wall musicwithout presenters, lacks the "exper-tise" to create an oldies station, andit argues the fact that Sky tried tobuy 10 FM after winning the Goldlicence proves this. At presstime,however, TRI decided to postpone-but not drop-its first court hearing,which had been due to take place onthe afternoon of June 5.

Earlier in the day, speaking onDutch TV to announce the collapse ofthe deal with 10 FM, Sky Radio MDTon Lathouwers said: "We were hap-py for both the listeners and Radio 10staff that we could continue the sta-

tion, but when TRI decided it wouldtry to win back its frequencies byarguing that we took over Radio 10FM because we couldn't do [Goldradio] ourselves, it made us decide`we'll prove them wrong and we willdo it ourselves'." Lathouwers added

that all current Radio 10FM employees were invit-ed to apply for jobs at 103FM - de Gouwe OuweZender.

TRI's radio directorErik de Zwart had reactedfuriously to the apparentcollapse of the deal, andaccused Sky Radio ofbreach of contract. DeZwart insists Sky Radioknew all along that TRIwas going to try to winback the Gold frequency

package through the courts, but sug-gests that Lathouwers might havebeen surprised by how fast TRI man-aged to bring their case to court.

Prior to the last-minute cancella-tion of the court hearing, De Zwarthad confirmed the line that TRI wouldbe using in court: "They don't havethis expertise. Lathouwers wanted tochange our plea. He always wants todominate the world. But we will nowsue Sky for breach of contract."

Meanwhile, over on the AM band,offshore pirate radio veteran RuudPoeze has unexpectedly ended upwith seven out of the 12 available AMfrequency packages. Poeze will redi-rect the transmitter on 1008 MHZ tocover the east of the UK, and thatfrequency will carry either RadioLondon or Smooth AM, both playingoldies and targeting the UK market.Poeze will use three of his other fre-quencies to create a new oldies sta-tion for the Dutch market.

Arrow Classic Rock, which failedin its attempt to secure an FM pack-age, is currently broadcasting on theAM frequency won by Music Country,although both entities are controlledby radio and music industry veteranWillem van Kooten. Arrow MD AdOssendrijver insists this is a tempo-rary arrangement between two com-panies. "We want to be on FM andthere still is one package available,"he notes, referring to the FM packagethat was originally earmarked for aclassical music format.

Candidates won't be officially announced until July,but Hotline hears that 20 competitors have appliedfor the Munich FM frequency vacated by FAZ Busi-ness Radio. The licence advertised is for a speech -based information station, but that hasn't stoppedthe usual suspects such as Rock Antenne andGalaxy from applying, plus Christian satellite sta-tion Radio Horeb, which has asked listeners topray for success...

At the company's sales presentation onJune 5 it was announced that Tim Bowen(pictured), chairman BMG UK/Ireland, isalso to become chairman of Jive UK.

Once merger contenders, EMI Groupin now suing BMG's parent, Bertels-mann, for alleged copyright infringementover the latter's Napster connections.
