Money has to be deposited by the quotationer through the following payment mode as per

Memorandum of Finance Department vide No. 3975-F(Y) dated 28th July, 2016 (Refer

“Annexure-I” in Bidders Guideline).

i) Net banking (any of the banks listed in the ICICI Bank Payment gateway) in case of

payment through ICICI bank payment gateway.

ii) RTGS/NEFT in case of offline payment through bank account in any bank.

The lowest quotationer has to deposit additional Earnest Money Deposit, if required,

amounting to the value of difference between E.M.D @ 2% of the quoted amount and

actual E.M.D deposited by the lowest quotationer, in the shape of Demand Draft / Pay

order in favour of the Executive Engineer, P.W.D., Kolkata North Health Division, payable

at Kolkata, before issuance of Letter of Acceptance.

Three Government of West Bengal Enterprises viz. “Mackintosh Burn Limited”, “Westinghouse

Saxby Farmer Limited” and “Britannia Engineering Limited”, are exempted from earnest

money for participation in quotation vide Order No. 430(3)-W(C)/1M-208/15 dated

31.08.2015 of The Joint Secretary, P.W. Department, Works Branch, Govt. of West Bengal

subject to the condition that they will furnish Security Deposit if selected in the quotation.

2. Both statutory cover (Technical Bid and Financial Bid) and non-statutory cover are to be submitted

concurrently duly digitally signed in the website http://etender.wb.nic.in.(Online)

3. The Technical Bid and Financial Bid have to be submitted online on or before 26/12/2020

upto 11.00 A.M. (Online).

4. The FINANCIAL OFFER of the prospective quotationer will be considered only if the TECHNICAL BID

of the quotationer found qualified by the Bid Evaluation Committee formed vide order no. 45-W

(C)/1M-23/15 dated 13.02.2015 of the Principal Secretary to the Govt. of West Bengal, P.W.D. The

decision of the Bid Evaluation Committee will be final and absolute in this respect. The list of

Qualified Quotationer will be displayed in the website and also in the Notice Board of the office of the

Superintending Engineer, Kolkata Health Circle, P.W.Dte. and Chairperson & Conveyor - Bid

Evaluation Committee on scheduled date and time.

5. Eligibility criteria for participation in the e-quotation :-

i) (a) The intending quotationer should have credential of a similar nature of completed single work

having minimum value of Rs. 14.00 Lac (Rupees fourteen Lac) only in any year during the last

5(five) years prior to the date of issue of this e-Quotation.

(b) The intending quotationer should have an Annual Turnover of Rs. 50.00 Lac (Rupees fifty lac)

only in any year during the last 5(five) years. Balance Sheet and Profit & Loss Account and all the

Schedules forming the part of Balance Sheet and Profit & Loss Account in favour of the

quotationer, audited by the Chartered Accountant, should be uploaded in support of the annual

turnover.

N. B. :-

1. The credential certificate(s) for completed work(s) should contain:- (a) Name of the work, (b) Name

of the Client, (c) Amount put to tender, (d) Schedule month and year of commencement and

completion as per work order, (e) Actual month and year of completion, (f) Gross bill amount of the

completed work / executed value of running work and detail communicational address of client must

be indicated in the Credential Certificate.

2. Credential certificate issued by the Executive Engineer or equivalent competent authority of a State/

Central Government, State /Central Government undertaking, Statutory/ autonomous bodies

constituted under the Central/State statute/ Local body of State Govt. /Prestigious work of similar

nature, on the executed value of completed / running work will be taken as credential.

ii) The authorized company dealers should upload the dealership certificate of

the concerned company.

iii) The prospective quotationer shall have in their full time engagement experienced technical

personnel, the minimum being one Diploma Engineer. (Authenticated documents in

respect of qualification and engagement shall be furnished for Technical Evaluation.). [Non

Statutory Documents]

iv) Joint venture will not be allowed to participate in the above NIe-Q.

v) Technical documents must be accompanied with (a) Income Tax Return, (b) Either

Professional Tax Clearance Certificate or Professional Tax Deposit Challan (atleast for F.Y.

2018-19), (c) Pan Card, (d) GST Registration Certificate, (e) Trade License (atleast for F.Y.

2018-19). [Non statutory Documents].

vi) The prospective quotationer or any of their constituent partner shall neither have

abandoned any work nor any of their contract have been rescinded during the last 5 (five)

years. Such abandonment or rescission will be considered as disqualification towards

eligibility. (A declaration in this respect has to be furnished by the prospective quotationer

as described in Section-B, FORM - VII without which the Technical Bid shall be treated as

non- responsive

vii) In case of Proprietorship, Partnership Firms and the Company, Tax Audit Report are to be

furnished alongwith the Balance Sheet and Profit & Loss Account and all the Schedules

forming the part of Balance Sheet and Profit & Loss Account in favour of the quotationer

(consecutive five financial years). No other name except quotationer’s name, in such

encloser will be entertained.

viii) The prospective quotationer should own or arrange through lease hold registered agreement

the required plant and machineries. Conclusive proof of ownership in favour of owner or

leaser of plant and machineries in working condition shall have to be submitted alongwith

the application. (Ref. Section – B, FORM - IV).

ix) Registered Partnership Deed (for Partnership Firm only) alongwith Power of Attorney

to be submitted alongwith the application.

x) Declaration regarding Structure of the Organization, duly signed by the applicant to be

submitted alongwith the application (Ref. Section – B, FORM - III).

xi) Registered Unemployed Engineers’ Co-operative Societies / Labour Co-operative Societies

are required to furnish valid Bye Law, Current Audit Report, Current N.O.C. from A.R.C.S. and

Minutes of last A.G.M. The Engineers Co-operative also has to submit documents of the

society consists at least 10 (ten) members out of which at least 60% should hold degree or

diploma in any branch in Engineering as per Memo. No. 44-A/4M-11/2002 dt. 09.01.2004 of

Deputy Secretary-III, P.W.D.

xii) The prospective quotationer shall be allowed to participate in a single job either in the

capacity of individual or as a partner of a firm. If found to have applied severally in a single

job, his all applications will be rejected for that job.

xiii) Prevailing safety norms has to be followed so that LTI (Loss of time due to injury) is zero.

xiv) Any intending quotationer who have failed to execute any works contract under any

Directorate of this department and was terminated by any sub-rule under Clause-3 of

Tender Form No. 2911 or terminated under any Clause of standard bidding document by

Engineer-in-Charge/ Employer during last 05(five) years will not be eligible to participate in

any quotation under any Directorate under this department.

xv) The bidders should quote their rates inclusive of GST and Labour Welfare Cess.

xvi) The work shall have to be carried out as per Order No. 1M-21/2017/167-R/W(N) dated

11.12.2018 of the Joint Secretary to the Govt. of W.B (Projects & Coordination), P.W.

Department, regarding taking necessary preventive measures to control pollution.

6. Where an individual person holds a digital certificate in his own name duly issued to him against the

company or the firm of which he happens to be a director or partner, such individual person shall,

while uploading any quotation for and on behalf of such company or firm, invariably upload a copy of

registered power of attorney showing clear authorization in his favour, by the rest of the directors of

such company or the partners of such firm, to upload such quotation. The power of attorney shall

have to be registered in accordance with the provisions of the Registration Act, 1908.

7. Running payment for the work may be made to the executing agency as per availability of fund. The

executing agency may not get a running payment unless the gross amount of running bill will be 50

(fifty) lakh or 30% of the quoted amount whichever is less. Provisions in Clause(s) 7, 8 & 9 contained

in W.B. Form No. 2911(ii) so far as they relate to quantum and frequency of payment is to be treated

as superseded.

8. Adjustment of price (increase or decrease) vide Notification No. 23-CRC/2M-61/2008 dated

13.03.2009 and Notification No. 38-CRC/2M-61/2008 dated 20.04.2009 shall not be applicable. Since

B.O.Q for the works under this NIe-Q is based upon the schedule of rates of Public Works & Public

Works (Roads) Directorate with up-to-date Addenda & Corrigendum, the quotationer shall quote

their rate (percentage above/below/ at par) accordingly considering that no escalation and / or price

adjustment will be allowed by the department thereto under any circumstances.

9. No mobilization /secured advance will be allowed.

10. Agencies shall have to arrange land for erection of Plant & Machineries, storing of materials, labour

shed, laboratory etc. at their own cost and responsibility.

11. All materials such as cement, steel which are required for the proposed scheme as mentioned

including cement, steel shall be of specified grade and approved brand in conformity with

relevant code of practice (latest revision) and manufactured accordingly and shall be procured

and supply by the agency at their own cost including all taxes . Authenticated evidence for

purchase of cement and steel are to be submitted alongwith challan and test certificates. In the

event of further testing opted by the E-I-C then such testing from any Govt. approved testing

laboratory shall have to be conducted by the agency at their own cost. (Specific permission is to

be required from the quotation inviting authority.

12. Steel materials procure & supply by the contractor shall be of TOR steel rod / HYSD / TMT Bar of

Fe415. Fe500, Fe550/550D grade (The grade to be decided by the E-I-C or as per instruction reflect

on the approved drawing of this department or as stipulated in the departmental schedule of rates.

13. Cement procure and supply by the contractor shall be of Ordinary Portland Cement 53 grade, 43 grade

conforming (IS 8112) or PPC/PSC (The grade to be decided by the E-I-C or as per instruction reflect

on the approved drawing of this department or as stipulated in the departmental schedule of rates.

14. The Contractors shall also abide by the provision of the child labour (Prohibition and regulation

Act.1986) . No labour below the specified age (as per G.O.) shall be employed on the work.

15. Constructional Labour Welfare Cess @ 1(one) % of cost of construction will be deducted from

every Bill of the selected agency.

16. In connection with the work, Arbitration will not be allowed. The Clause No. 25 of 2911(ii) is to be

considered as deleted clause vide gazzatte notification no 558/SPW dated 13th December,

2011 of the Secretary, P.W. Department.

17. Quotation shall remain valid for a period not less than 120 (One hundred twenty) days after the

dead line date for Financial Bid Submission. Quotation valid for a shorter period shall be rejected by

the Bid Evaluation Committee as non-responsive. If the quotationer withdraws the quotation

during the validity period of quotation, the earnest money as deposited will be forfeited forthwith

without assigning any reason thereof.

20. lf the contractor or his workmen or servant or authorized representatives shall break, deface, injure

or destroy any part of the building, in which they may be working or any building, road, road curbs,

fence, enclosure, water pipes, cables, drains, electric or telephones posts or wires tress, grass or

grassland or cultivated ground contiguous to the premises on which the work or any part of it is

being executed, or if any damage shall happen to the work from any cause whatsoever or any

imperfections become apparent in it at any time whether during its execution or within a period of

three months or one year or three years or five years, as the case may be (depending upon the

nature of the work as described in the explanation appended hereto ) hereinafter referred to

as the Defect Liability Period, from the actual date of completion of work as per completion

certificate issued by the Engineer-in-Charge, the contractor shall make the same good at his own

expense, or in default, Engineer-in-Charge may cause the same to be made good by other workmen

and deduct the expense (of which the certificate of the Engineer–in-Charge shall be final and binding

on all concerned) from any sums, whether under this contract or otherwise, that may be then, or at

any time thereafter become due to contractor from the Government or from his security deposit,

either full, or of a sufficient portion therefore and if the cost, in the opinion of the Engineer-in-Charge

(which opinion shall be final and conclusive against the contractor), of making such damage or

imperfection good shall exceed the amount of such security deposit and/ or such sum, it shall be

lawful for the Government to recover the excess cost from the contractor in accordance with the

procedure prescribed by any law for the time being in force.

Provided further that the Engineer-in-Charge shall pass the “Final Bill” and certify thereon, within a

period of thirty days with effect from the date of submission of the final bill in acceptable form from

by the contractor, the amount payable to the contractor under this contract and shall also issue a

separate completion certificate mentioning the actual date of completion of the work to the

contractor within the said period of thirty days. The certificate of the Engineer-in-Charge whether

in respect of the amount payable to the contractor against the “Final Bill” or in respect of completion

of work shall be final and conclusive against the contractor. However, the security of Clause 1 hereof

shall be refundable to the contractor in the manner provided here under:-

(a) For work with three months Defect Liability Period :

(i) Full security deposit shall be refunded to the contractor on expiry of three months from the actual date of completion of the work.

(b) For work with one year Defect Liability Period :

(i) Full security deposit shall be refunded to the contractor on expiry of one year from the actual date of completion of the work.

(c ) For work with three year Defect Liability Period :

(i) 30% of the security deposit shall be refunded to the contractor on expiry of two years from the actual date of completion of the work.

(ii) The balance 70% of the security deposit shall be refunded to the contractor on expiry of three years from the actual date of completion of the work.

(d ) For work with five year Defect Liability Period :

(i) No security deposit shall be refunded to contractor for 1st 3 year from the actual date of completion of the work;

(ii) 30% of the security deposit shall be refunded to the contractor on expiry of four years from the actual date of completion of the work;

(iii) The balance 70% of the security deposit shall be refunded to the contractor on expiry of five years from the actual date of completion of the work.

Explanation:

The word ‘work’ means and includes road work, bridge work, building work, sanitary and plumbing work, electrical work and / or any other work contemplated within the scope and ambit of this contract. For

(i) The work of patch repair or patch maintenance in nature or a combination thereof, the Defect Liability Period of the work shall be three months from the actual date of completion of the work.

(ii) Thorough Bituminous surfacing work with bituminous thickness less than 40 mm, Repair & Rehabilitation of any road/bridge/ culvert/ building / Sanitary & Plumbing work, the Defect Liability Period of the work shall be one year from the actual date of completion of the work.

(iii) Extension of building / bridge / culvert, Construction of new flexible pavement up to bituminous level which has been designed for a period of 3 years or more, Widening and Strengthening of flexible pavement designed for a period of 3 years or more, Improvement of riding quality / Strengthening of flexible pavement designed for a period of 3 years or more; Providing only mastic asphalt layer over existing bituminous surface without providing bituminous profiles corrective course/ bituminous base course, the Defect Liability Period of the work shall be three years from the actual date of completion of the work;

(iv) Construction of new building / new bridge / new culvert, Reconstruction of building / bridge / culvert including construction of approach roads for bridge/ culvert, Construction of rigid pavement, Reconstruction of rigid pavement, Construction of new flexible pavement covered by mastic work which has been designed for a period 5 years or more, widening and strengthening of flexible pavement covered by mastic work which has been designed for a period of 5 year or more, Improvement of riding quality / Strengthening of flexible pavement covered by mastic work which has been designed for a period of 5 years or more, the Defect Liability Period of the work shall be five years from the actual date of completion of the work;

As per G.O. No. 5784-PW/L&A/2M-175/2017 dated 12.09.2017 of Principal Secretary, Public Works

Department , Government of West Bengal.

No interest would be paid on the Performance Security Deposit

21. All quotationer are requested to be present in the office of the of Superintending Engineer, Kolkata

Health Circle, P.W.Dte. at schedule time and date during opening the financial bid. Superintending

Engineer, Kolkata Health Circle, P.W.Dte. may call Open Bid/Seal Bid after opening of the said bid to

obtain the suitable rate further, if required. No objections in this respect will be entertained raised by

any quotationer who will present during opening of the quotation, or from any quotationer who will

absent at the time of opening of Financial Bid. No informal quotation will be entertained in the

quotation further.

22. Site of work and necessary drawings may be handed over to the agency phase wise. No claim in this

regards will be entertained.

23. Price preference will not be allowed in this NIe-Q.

24. The quotationer, at his own responsibility and risk is encouraged to visit and examine the site of

works and its surroundings and obtain all information that may be necessary for preparing the

quotation and entering into a contract for the work as mentioned in the NIe-Q before submitting offer

with full satisfaction. The cost of visiting the site shall be at his own expense.

25. The intending quotationer shall clearly understand that whatever may be the outcome of the present

invitation of quotation, no cost of Bidding shall be reimbursable by the Department. The

Superintending Engineer, Kolkata Health Circle, P.W.Dte. reserves the right to reject any application

and to accept or reject any offer without assigning any reason whatsoever and is not liable for any

cost that might have incurred by any quotationer at the stage of Bidding.

26. Refund of EMD : The Earnest Money of all the unsuccessful quotationer, deposited online, shall be

refunded in accordance with the Memorandum of the Finance Department vide No. 3975-F(Y)

dated 28th July, 2016. (Refer “Annexure-I” in Bidders Guideline).

27. Prospective applicants are advised to note carefully the minimum qualification criteria as

mentioned in ‘Instructions to Bidders’ in Section – ‘B’ before submission of quotation.

28. Conditional/ Incomplete quotation will not be accepted.

29. The intending quotationer are required to quote the rate on line.

30. Contractor shall have to comply with the provisions of (a) the Contract Labour (Regulation Abolition)

Act. 1970, (b) Apprentice Act. 1961 and (c) Minimum Wages Act. 1948 of the notification thereof or

any other laws relating thereto and the rules made and order issued there under from time to time.

31. Guiding schedule of rates: Current Schedule of Rates of Public Works Department for “Building

Works”, “Sanitary & Plumbing Works” and “Road & Bridge Works” with effect from 01.11.2017

alongwith up-to-date corrigendum and addendum to be applicable herein.

32. During scrutiny, if it comes to the notice of quotation inviting authority at any point of time that the

credential or any other papers found incorrect/manufactured/fabricated/ tempered/ forged that

quotationer will not be allowed to participate in the quotation and that quotation will be out

rightly rejected without any prejudice with forfeiture of earnest money and the quotation

inviting authority reserves the right to take legal action as deems fit and debarment/ suspension of

contractor shall be made as per Public Works Department’s Memorandum bearing no. 547-

W(C)/1M-387/15 dt. 16.11.2015.

33. The Superintending Engineer, Kolkata Health Circle, P.W.Dte. and the Chairperson & Conveyor - Bid

Evaluation Committee reserves the right to cancel the NIe-Q due to unavoidable circumstances and

no claim in this respect will be entertained.

34. In case if there be any objection regarding prequalifying, the quotationer should lodge to the

Chairperson & Conveyor - Bid Evaluation Committee within 02 Days (48 Hours) from the date of

publication of list of qualified agencies and beyond that time schedule no objection will be

entertained by the Bid Evaluation Committee.

35. Before issuance of the WORK ORDER, the quotation inviting authority may verify the credential and

other documents of the lowest quotationer (L1), if necessary. After verification if it is found that the

documents submitted by the lowest quotationer either manufactured or false, in that case work order

will not be issued in favour of the said quotationer under any circumstances.

36. If any discrepancy arises between two similar clauses on different notification, the clause as stated in

later notification will supersede former one in following sequence.

(1) Form No. 2911(ii), (2) NIe-Q, (3) Special terms & conditions, (4) Technical Specification,

(5) Financial Bid.

37. Qualification criteria.

The quotation inviting and accepting authority, through a Bid Evaluation Committee, will determine

the eligibility of each quotationer. The bidders shall have to meet all the minimum regarding:-

a) Financial Capacity.

b) Technical Capability comprising of personnel and equipment capability.

c) Experience/Credential

The eligibility of a quotationer will be ascertained on the basis of the digitally signed documents in

support of the minimum criteria as mentioned in (a), (b) and (c) above and the declaration executed

through prescribed affidavit in non-judicial stamp paper of appropriate value duly notarized. If any

document, submitted by a quotationer, is either manufacture or false, in such cases the eligibility of

the quotationer will be out rightly rejected at any stage without any prejudice.

38. The Contractor has to submit the work programme i.e. Bar Chart at the time of making formal

agreement.

39. The contractor undertakes to have the site clean, free from all surplus materials, rubbish etc. upto the

satisfaction of the Engineer-in-Charge. All surplus materials, rubbish, etc. will have to be removed to

the places fixed by the Engineer-in-Charge and nothing extra will be paid upto a lead of 75 mtr. from

the work site.

40. The VAT / Sales tax shall be read as GST (Goods & Service Tax) in tender online e-Procurement

System of Govt. of West Bengal or wherever applicable.
