meeting for the first time. Elected Members also welcomed and felicitated the new PCB Brig. Abhijit Chandra, SM and Hon’ble MP Shri. A. Revanth Reddy. Brig. Abhijit Chandra took oath as PCB and Shri. M. V. Bhoopal Reddy, Rep. of DM, took the oath on becoming the Nominated Member of the Board.

[ 01 ] To consider and approve the Annual Medical indent for the year 2019-2020 of the Cantonment dispensaries & Cantonment General Hospital.

Resolution:- Considered and resolved that the trade licenses be approved subject to usual terms and conditions. The Elected Members appreciated the efforts of the office to bring in more commercial establishments under the net of trade licenses which would increase the revenue of Board. The Board resolves to authorise CEO to issue Trade Licenses for all other properties where trade licenses have not yet been issued and to renew those licenses which have already been issued in the past. CEO may incur any expenditure for employment of additional resources to ensure the same.

Further resolved that the said trade license is only for the purpose of

running trade as per norms and does not amount to regularisation of illegal and unauthorised constructions or encroachments or change of purpose or any act done in violation of any other rule in force. The Board further resolved that in case it comes to the notice of the CEO that trade licence has been secured by the holder through misrepresentation or fraud, the CEO is authorised in terms of Section 335 of the Cantonments Act, to suspend or revoke the said license at any time without further reference to the Board. In any case, the license shall be revoked if the trade is found contrary to the law or rules or offensive to public health and convenience.

The building plans are in accordance with the building byelaws and FSI restrictions. The site in each case is situated outside notified civil area classified as B-2 land as per the GLR maintained by the DEO, AP Circle, Secunderabad. The layout of these colonies was sanctioned after 1974 and the societies have handed over 40% open area for civic and other amenities to the Cantonment Board, Secunderabad by a way of Registered Gift Deed as per the bye-laws. As per the decision of the Board in its meeting held on 04th November 1997, No Objection Certificate from Airport Authority of India has not been insisted in such cases where construction of only Ground Floor is involved.

The Board resolved to approve the building applications under section

235 of the Cantonments Act, 2006 subject to condition that the plan will be released only after Rain Water Harvest Pits are made in the plots and if no objection with regards to involvement of defence land or State Govt. property or disputed property is received within one week. Cantonments Act wherein Security Clearance should be sought from the LMA before sanctioning building plans in the Cantonment. Further it was informed that the MoD direction for seeking NOC from LMA are not for constructions inside the Cantonment as expressly stated therein. Shri Kesava Reddy informed that the Board has been sanctioning building plans in these colonies for a long time and a large number of buildings had already come up in the said layouts. The CEO further apprised that the Hon’ble High Court in similar cases of interference from LMA in building permission has held that provisions of Cantonments Act or the byelaws framed there under do not envisage any NOC to be obtained from the local military authorities and therefore no such arrangement can be insisted by the Board while sanctioning the applications. As regards the inspection of each and every file/plot of land by the members of the Board, it was noted that the technical scrutiny of the plans is carried out by the technical and designated staff and plans are placed before the Board only after all the statutory and technical requirements are met. It is therefore resolved that individual scrutiny and inspection is not feasible or practical and in case of specific objection in the interest of the Board in any particular case, the same can be conveyed to the Chief Executive Officer anytime before the Board meeting for taking necessary action as per rules.

The layout of these colonies was sanctioned after 1974 and the societies have NOT handed over 40% open area for civic and other amenities to the Cantonment Board, Secunderabad by a way of Registered Gift Deed as per the byelaws. As per the decision of the Board in its meeting held on 04th November 1997, No Objection Certificate from Airport Authority of India has not been insisted in such cases where construction of only Ground Floor is involved.

The Board resolved to approve the building application under section 235 of the Cantonments Act, 2006 subject to condition that the plan will be released only after Rain Water Harvest Pits are made in the plots and if no objection with regards to involvement of defence land or State Govt. property or disputed property is received within one week. CEO shall release the plinth sanction only as resolved under CBR No. 12 dated 07th August 2013. On satisfactory completion of plinth, rest of the building plans will be cleared.

The above mentioned applications were considered by the Board who resolved vide CBR No. 22 dated 02.01.2019 as under: “Elected Members Shri. J. Maheshwar Reddy, Shri. Keshava Reddy, Smt. Anitha Prabhakar & Shri. P. Bhagyasree, have informed that the applicants of building permission have appealed to them that justice have not been done to them since 2015 and requested to sanction the said building plans. The Board however notes that pursuant to the orders of the Hon’ble High Court in WP. No. 26035/2018 dated 21.07.2018 the office had written to the applicants vide letters no. SCB/EB/OP./SY. NO. 75(P)/ Thokatta(V)/B’Pally/2458, dated 23.10.2018 & letters no. SCB/EB/OP./SY. NO. 75(P)/ Thokatta (V)/B’Pally/2459 dated 23.10.2018 seeking certain clarify seeking certain clarifications with regard to, amongst others, the status quo order passed on the subject land by the Hon’ble High Court in WP No. 21538/2012 which was pointed out by the representative of the District Collector in Board Meeting dated 31.05.2018 and also referred to in the Hon’ble High Court Order dated 21.07.2018 mentioned above. It is noted that no clarifications on the same have been given by the applicants till date and it is resolved that the issue would be considered on submission of the requisite information by the applicants.”

Now vide letters no. 09/BP/SCB/RN/July/2019, 09/BP/SCB/RN/July/ 2019, dated 01.07.2019 the applicants have made certain submissions in response to this office letters no. SCB/EB/OP./SY. NO.75(P)/Thokatta(V) /B’Pally/2458 and No, SCB/EB/OP./SY.NO.75(P)/Thokatta(V)/B’Pally/ 2459 dated 23.10.2018.

All the documents and file are placed on table. The Board may consider

the same and resolve appropriately. Resolution:- Considered and discussed the matter in detail. CEO apprised the Board about the background of the case as given on the agenda side. The Board noted that building application submitted by the applicants in Sy No 75(P), Thokatta Village Bowenpally, Secunderabad Cantonment was pended by the Board in its previous meetings held on 18.2.2018, 31.5.2018 and 2.1.2019 as State Govt authorities have not conveyed their views/NOC on the reference made by the Board to the NOC Committee. In the meeting held on 8.2.2018, the nominee of District Magistrate informed that the Endowment Department of the State Govt has a claim on the land in question and that there are some court cases pending on the issue. While expressing concern over the inordinate delay on the part of State Govt in conveying their views on the reference made by the Board, the Board resolved vide CBR No 12 dated 8.2.2018 to pend and take up the matter again if no concrete evidence/documentation is produced by the revenue authorities within three weeks from the said date of meeting. The Board further resolved that in all future cases if nothing is heard from the revenue authorities within 3 weeks of the date of communication to them with regard to NOC for construction on any land, it will be deemed that there is no

objection from their side and the plans would be taken up in the following Board meetings without any further reference to the revenue authorities.

Subsequently, the building application was again considered by the Board vide CBR No.16 dated 31.5.2018 and the same was pended to obtain clarifications on the intimation given by the nominee of the District Magistrate that the NOC was rejected by the Committee due to the claim of Endowment Dept. Aggrieved by the pendency of building application, the applicant approached the High Court of Telangana in WP No 26035 of 2018 seeking direction to the Respondent Board to consider and approve the Building Applications dated 12.03.2015 submitted by him without insisting or relying on the No Objections from Land point of view issued by the State Government Revenue Authorities pending disposal of the said Writ Petition. The Hon’ble High Court by order dated 31.07.2018 was pleased to grant interim direction as prayed for and ordered however, if any stay is there by any other Court in respect of subject property it is open for the Respondent Board to consider the said aspect and pass appropriate order in accordance with law. The matter was again considered by the Board vide CBR No 22 dated 2.1.2019 and resolved that the issue would be considered on submission of the requisite information by the applicantsas sought by the office pursuant to the Court orders. On receipt of clarifications from the applicants, the issue is now considered by the Board.

The DRO, rep of District Magistrate has again stated that the

Endowment Department of the State Govt has a claim on the land in question and that there are some court cases pending on the issue. The Court case referred by the DRO has been perused. It is noticed that the applicants are not a party to the legal proceedings in WP No 21538 of 2012 and restraining orders were issued against specific individuals who are a party to the said WP. The applicant has submitted clarifications on the sale deeds and informed that he is not a party to the court case mentioned by the Endowment Dept. The Board notes that despite lapse of 4 years from the date of application and its consideration by the Board from time to time, the State Govt has not produced any concrete proceedings or evidence of title except conveying the interest from time to time. In the absence of any contrary evidence to the sale deeds and title submitted by the applicant, the Board being a municipal body cannot investigate or enquire into the title. The Board further notes that the matter was pended on several occasions and reasonable opportunity was given to the State Govt to advance documentary evidence resulting in avoidable litigation to the Board. There is no enabling statutory provision to reject the application on this ground of dispute when the application is otherwise in accordance with the rules in force. Further, no proceedings of the State Government or Endowment Dept in particular against the applicant have been brought on record before the Board. The Endowment Dept has been requesting the Cantonment Board to reject the application on the ground that it has a claim on the said property.

The applicant has approached the Hon’ble High Court and the High Court has directed the Board to consider the application in accordance with law.

All the elected members have opposed the practice of seeking the NOC/views of the State Govt in the absence of any such statutory requirement as it is causing harassment to the residents of Cantonment in obtaining building permissions. Under the circumstances, the Board resolved to sanction the building application and it is noted that in the event of any adverse orders of the Court on the title of the applicant, the concerned Dept will take over the said property along with the structures. The Cantonment Board being a municipal body cannot address the title disputes and the Hon’ble High Court in a similar case in WP No 11091 of 2006 has ruled that the assumption of the Cantonment Board that the protection of lands of the State Government is its burden is an assumption which has no basis in law and is misconceived. The Hon’ble High Court directed to consider the building application without insisting on clearance from State Govt. In the appeal filed by the Board before the Hon’ble Supreme Court in SLP Civil No 4476 of 2009, the Hon’ble Apex Court while upholding the order of the High Court, has held that there is no hindrance to the Board to issue approval if otherwise found to be eligible, with an endorsement that the approval shall not be treated as approval or acceptance of title. Accordingly, the Board resolved to accord the sanction on the usual terms and conditions.

REVISED LAYOUT PLAN IN SY.NO.123, MACHA BOLLARUM, SECUNDERABAD CANTONMENT

Ref:- CBR No. 20 dated 02.01.2019

[ 29 ] To consider the revised layout plan submitted by Shri Cheela Vijay Kumar & 5 others in the name of Vijaya Vani Enclave in Sy.No.123, Macha Bolarum, Secunderabad Cantonment. As per the records, the applicants earlier submitted a layout plan on 28-12-2005 consisting of 17 plots to an extent of 5978.86 Sq.Yrds. The DEO, AP Circle and Mandal Revenue Officer, Trimulgherry have given NOC from land point of view. Subsequently, certain information was obtained from the Divisional Engineer, ECIL, Moulali, Hyderabad District regarding HT Lines passing over the proposed plots.

The applicants have resubmitted the layout application on 10.09.2007 by leaving 20 ft. width from the HT lines and stated that the space is only proposed for parking purpose. The SEMO has given NOC from Health and Sanitation Point of view subject to certain conditions. Thereafter, applicants once again resubmitted the application on 05.11.2008 without any changes in the layout boundaries and plot no’s except that the total area of land is reduced as per the sale deeds as 5808.96 sq.yds. NOCs were once again obtained from DEO and concerned MRO on the revised application. The Board considered and approved and further resolved that the proposal be forwarded to GOC-In-C, SC, Pune for concurrence vide CBR No. 14, Dt.24.02.2009. In the

meanwhile Shri Vijaya Kumar & Others have submitted (revised) proposal layout on 12.10.2011 stating that they have mentioned wrong dimensions of the site in the plan submitted on 05.11.2008, which were rectified in the revised proposed layout. Site inspection on the revised layout revealed certain discrepancies in the area. The applicants submitted a fresh layout application on 12.03.2018 with details as under:

Lokanatham, have informed that total number of plots reduced from 17 to 12 compared to the earlier proposal and that a few more clarifications would be needed. It is resolved that the matter may be pended for the next Board Meeting.”

Resolution:- The Board considered and approved the proposed revised layout and resolved to forward the case to PD, DE, Southern Command, Pune for sanction as per the layout bye-laws. The CEO further stated that the additional conditions of arrangement of water harvesting and garbage disposal will also be imposed on developers and the Board has approved accordingly.

The Board also considered the complaint made by Shri. G. Vittal Reddy in this regard requesting that the Board should not approve the said layout as the place has electrical infrastructure like high voltage transmission tower lines and sufficient open spaces have not been left around the said infrastructure.

The Board however notes that sufficient open spaces have been left around the electrical infrastructure. However as the matter of abundant precaution it is resolved that the subject layout stands sanctioned as per regular norms subject to inspection report of the Garrison Engineer (South). Resolution:- Considered and resolved to approve the lowest rates quoted by the qualifying L1 contractor Sri. S. Raju. Further it is resolved that until finalisation of new tenders the existing contract will be continued as per the prevailing rates. This shall hold good for all contracts of the Cantonment Board.

The Board notes the excellent work done by the Spurthi School over the years and resolves that CEO is authorised to take all measures to ensure that the School caters to additional requirement of built up space, equipment and other resources for benefiting and providing better facilities to the children already enrolled and those who are in the waiting.

Resolution:- Considered and resolved that the trade licenses be approved subject to usual terms and conditions. Action as per resolution to agenda item no. 21 above be taken by Chief Executive Officer to expedite trade license approvals. Further resolved that the said trade license is only for the purpose of running trade as per norms and does not amount to regularisation of illegal and unauthorised constructions or encroachments or any act done in violation of any other rule in force. The Board further resolved that in case it comes to the notice of the CEO that trade licence has been secured by the holder through misrepresentation or fraud, the CEO is authorised in terms of Section 335 of the Cantonments Act, to suspend or revoke the said license at any time without further reference to the Board. In any case, the license shall be revoked if the trade is found contrary to the law or rules or offensive to public health and convenience.

[37] Elected members requested that due to excess rainfall causing damage to several infrastructural assets like roads and drains some more estimates for maintenance of the same need to be approved by the Board which can be taken up through local area development funds of MLA / MP / Finance Commission grants or from own funds or grants received whenever available. The Board resolves that the Chief Executive Officer is authorised to sanction the said estimates and carry out repair and maintenance works pertaining to basic civic infrastructure damaged by incessant rains.

FUNDS/GRANTS UNDER THE HEAD OF CREATION OF CAPITAL ASSETS

[ 38 ] The CEO informed that the Board may send proposals under Creation of Capital assets head for civic infrastructural purposes in addition to the grants being sought. Considering the financial situation of the Board, the said proposal may be considered by the Board.

Resolution:- The matter has been considered and the Board notes that the financial position of the Board is very delicate and several projects of urgent importance for improving the basic civic infrastructure could not be taken up due to paucity of funds. The local sources of revenue are limited and are almost exhausted. Under these circumstances, it is imperative to seek assistance in the form of funds for creation of capital assets. The Board resolves to approve the proposal for seeking funds/grants under the head for creation of capital assets. The CEO is authorized to send the proposals to the competent authority for their sanction. [ 39 ] The Vice President informed that the Sanitary Overseers and other executive staff need to be given allowance for using their personal vehicles in discharge of additional duties. It was informed that the proposal is already under the consideration of the competent authority. The Elected Board Members requested that pending sanction, the CEO should release any allowances for which the employees are entitled as per rules. The Board resolves that the CEO may consider the same on a case to case basis. [ 40 ] The Vice President Shri. J. Ramakrishna, Elected Members, Shri. Kesava Reddy and Shri. Maheshwar Reddy requested the Hon’ble MP Shri. A. Revanth Reddy to allot the MP LAD funds liberally to the Cantonment Board. The Hon’ble MP informed that he would more than willing to allot funds under MP LADs to the extent possible. He also offered to take up the matter of getting dues from the State Govt. like Transfer of Property Tax, Entertainment Tax. Etc., He also informed that he would liaise with the Ministry of Defence to ensure that the Service Charges to the Cantonment Board are released as per demand. He also informed that he would explore possibility of big industrial houses/ sector units taking up activities for infrastructural development and maintenance of the Cantonment area through funds from their Corporate Social Responsibility schemes. He further requested that wherever there is any breach of conditions in old grants and leases in bungalows outside civil area/bazaar area the same should be acted upon by way of determination / resumption and not just by way of demolition as the Board is doing now. The Elected Members informed that the aspect of management of bungalows on old

grant or lease is dealt with by the Defence Estates Officer, Telangana & AP Circle. However the Hon’ble MP requested that a communication may be sent to DEO requesting him to make a list OGBs where violations have occurred and to take further necessary action on the same as per rules.
