THE EAST AFRICAN COMMUNITY CUSTOMS

MANAGEMENTACT,2004

CONDITIONS FOR APPOINTMENT OF A TRANSIT SHED

PURSUANTto the provisions of section 12 of the East African

Community Customs Management Act, 2004, and regulation 57 of the

East African Customs Management Regulations, 2006, the

Commissioner of Customs Services prescribes the conditions set out in

the schedule hereto as the minimum conditions to be fulfilled by an

applicant to operate a Transit Shed.

SCHEDULE

1. The applicant shall give prior notice in writing to the

Commissioner of Customs Services of their intention to develop a

Transit Shed and obtain necessary approval, before commencement of

such development.

2. The proposed Transit Shed shall fulfill the following

conditions—

(a) only be located in plots of not less than 2.5 hectares, provided

that this requirement shall not apply to transit sheds appointedbefore 12th June, 2003;

(b) have a railway siding in case of transit sheds handling goods

imported by sea and be located close to a main road or

thoroughfare;

(c) be located not more than one kilometre from the airport, in the

case of transit sheds used for handling of goods imported by

air;

(d) be located close to existing customsareas, in the case of transit

shedsat frontier ports;

(e) where located more than ten (10) kilometer radius from the

port, the transit shed shall not be used for handling transit or

transshipment goods;

(f) haveits entire surface area properly paved and fully compacted

with suitable materials, preferably paving blocks;

(g) its surface area enclosed by a perimeter stone wall of a height

of not less than three metres from the ground with an electric

fencefitted on the top of the wall;

(h) floodlights installed to light up its entire surface area;

(i) provision of suitable office accommodation for Kenya RevenueAuthority officers including proper sanitation facilities for use

by the officers and other authorized users of the facility;

Gj) the office provided should be installed with computerfacilities

and suchother suitable office equipmentfor use by the resident

Kenya Revenue Authority officers;

(k) provide computer software that is compatible with that of

Kenya Revenue Authority (KRA) and facilities for electronic

tracking of all the goods imported into the shed including an

electronic gate pass system that can be linked to the SIMBA

system;

(1) abuilding, of not less than 3,000 square feet, suitable for use as

a customs warehouse;

(m)provision of separate facilities, including loading andoffloading facilities, for the verification of imports;

(n) inspection facilities and an all-weather verification bay;

(o) dedicated and specially designed motor vehicle inspectionfacility;

(p) surveillance cameras and a suitable facility to accommodate

mobile cargo scanning equipment;

3. Transit Sheds located near busy roads or thoroughfares shall

have adequate parking yards that are consistent with local authorities’

by-laws.

4. A person shall not be qualified for appointment to operate a

Transit Shed if that person, or where the applicant is a company, the

companyorits director(s) have any outstanding tax liabilities.

5. An application for appointment to operate a Transit Shed shall

be made in the prescribed form and shall be submitted together withthe following:

(a) relevant architectural drawings showingits situation in relation

to other developments or thoroughfares; and

(b) a statutory fee of one thousand five hundred dollars.

6. Upon being appointed to operate a Transit Shed, the operator

shall execute a security bond to cover the duties on the goods

deposited therein as the Commissioner may determine.

7. Before additional facilities are considered for gazettement, the

number of gazetted Transit Sheds, increase in cargo volumes on an

annual basis, of such sheds and the location of such facilities including

the necessary approvals from the relevant local authority will be key

considerations.

8. No new application will be approved in respect of an applicant

already gazetted, to operate another transit shed within the same

municipality.

9. The Commissioner may revoke the appointment of any Transit

Shed whose average monthly revenue payments in a calendar year, isless than one hundred million shillings.

10. All transit sheds gazetted prior to the publication of this notice

shall be required to comply with the provisions of this Notice by or on31st December, 2011.

NOTICEis issued pursuant to the provisions of section 5 of the

Disposal of Uncollected Goods Act (Cap. 38) of the laws of Kenya to

the owner of the Land-Rover Discovery reg. No. KAD 930R and

Mercedes Benz reg. No. KYZ 666, motor vehicles which are currently

lying at the premises of Messrs. Auto Evolution Limited, located at

Airport North Road, to take delivery of the same within thirty (30)

days from the date of publication of this notice upon paymentofall the

outstanding storage charges and any other incidental costs incurred as

at the date it was booked, delivered to the above mentioned premises.

If the aforesaid motor vehicle is not collected at the expiry of this

notice, the same shall be sold by public auction or private treaty by

Whitestone Auctioneers Limited, Chepkorio, off Lusaka Road, P.O.

Box 79157-00400, Nairobi, without any further notice.

IMPORTANT NOTICE TO SUBSCRIBERS TOTHE KENYA GAZETTE

THE following notes are for the guidance of persons submitting “copy” for

inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not

affect legislation. They are, therefore, submitted to the Government

Printerdirectly.

(2) Legislative Supplement contains Rules and Regulations which are

issued by the Central Government. Because of this, they must be

submitted to the Government Printer through the office of the

Attomey-General.

(3) Bill Supplement contains Bills which are for introduction in the

National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All “copy” submitted for publication should be prepared on one side of an

A4 sheet no matter how small the Notice is, each page being numbered and

should be typewritten with double spacing. Copy should be clear, legible and

contain no alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name

of the signatory in capitalletters.

(ii) Dates must be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised

Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D—

Kenya Gazette

“D 34. (1) Communications for the Kenya Gazette should reach the

Government Printer not later than 9 am. on Friday of the week before

publication is desired. The Government Printer will not publish communications

received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the

cost of advertising init.

It is emphasized that these notes are for guidance only, but it is requested

that persons submitting copy for publication first satisfy themselves that such

copy is complete in every respect.
