Novomber, 1980, and the court was told by tlw claimants thathe was seleded f'rom three applimnts aftrr an interview. Hewas to work as a boilor mochanic. He was dismissed in Fbbruary,1982. The claimants statM that his 'salary at that time wasKSh. 600 per month. lt is in dgsptttz whethor he was a casualamployee all tlfls time or whether he was a permanent employee.The reason for his dismissal w&s th'at on 7th Pebruary, 1982,

he ras arrosted on suspiciqn of Ihaving stden sixteen gtmny bagswhlch he was seen throwlng over the fence. He was arrrested,prosecuted fbut was acquitte'd. The claimants demanded his rein-statement without loss of privilegts but the rtspon'dents main-tained tha't they were unler no bbligation to omploy a casualwhose contract explred at the end of the day.

The disputo was investigated by the M inktry of Labour whoseinding was that ,Mr. Kiptoo was a casual employee frqm1980 to February, '1982 azfd that his wage was on a dallybasis at an hourly rale ran/iag from KSI:. 2.90 to KSh. 2.50per hour and the mimstry recommended that t'he matter shouldbe left to stand and the claimants demand .be relected.

During tho hearing tlle claimants' stand w&s that Mr. Kiptoowas not a casual emgloyee and through him they produced antmployment card whlc;h he olaimed *as issued to him by therejpondentj. This (rartl, however! did not 'bear his pidurezkMr.Kmtoe clajmed that the camd lhetd fallen into the boiler andthe picture had dissolved.The court believzs thal M r. Kiptoo was porf orming fluties

alone on the Moiler during shift t%'' but the court has gravedoubt i'f he was a permanent employee. On the 'ofher handthg court finds tha't the 'respondents have been shown to beuslng calsuals excossively in their oporations and .the ra'tio appearsto 'be 20 to 24 casuals for every 10 permanent emgloyees. Thecgurt notes that tlle claimants 'had stressed tlut lt would behlghlï unlikely t'hat a casual would be used on such an impor-t'mt job a's a boiler attendant on whioh tbe whole operationdepended. The fact, however, remains from the documenlaryevldence producod during tlw hearing that Mr. Kiptoo's mrmngsvaried from f ortnight to forrtnight. Tf he 'was on monthly termsthen this would not be so. The court, however, would liketo leave this point for the time being an'd come t'o the rsalreason why h'e lost his jocb. The. court is salîsfied on the evtd-ence of 'the rcspondentsg administration and personnel officerthat the security guard on duty on 7th February, 1982 had!caugilt M r. Kiptoo with sixteen gunny bags which prewouslyhq had thrown over the ftnce. Although he was acquitted of thtonminal offence the court finds that he has not begn able:to exonerate hlnpelf from thls gross misoonduct, 1.e. theattempted converslon of the rehspon'dents' property for his ownuse. A'fter careful considgration of al1 the faots tho courtfirîds itsel'f in agreem:nt wlth the ministry's finding and recom-mendation and the claiman'ts' dcmand for his reinstatementis rrekcted. .
