4. Secondary Stardards-(l) Every secondary Standards shall be verilied at any of theReference Standards Laboratories, in such manner and at such perioaical intervats asmay be prescribed under the Legal Metrology lNational StanjarJs) rules 20ll andshall, if found on such verification to confoim to tfre stanJarJ estaulished by orunder that Act, be stamped by Reference Standard Laboratory or a certificate ofverification willbeissued by rhal laboratory(2) The Secondary Standards shali be kept at such place, and ir such custody as thecontroller may direct.

5. Yo"Trq li.dards-( l) EveryWorking Standard shall beverified eirher at any ofthe ReferenceStafldards laboratories or at any ofthe Secondary Standards Laboratories maintained by theState Govemment, in such matroer atld at such periodical intervals as may be prescribed uflderLegal Metrologl (National stardards) rures 20 r l and shall, iffound on s;ch verification to confomr to the stdndards estabrished by or under the Act, be stamped or certifcaie ofverification w lbe issued by that laboratory as the case may be.(2)The Working Standards sha.ll be kepr in the custody oflega.l metrology officer6. Secordary Standard bdenc€s- (l) A set ofSecondary staridard balancis shatt be maintahed atevery place where Secondary Standard Weights are kept.(2) The number, types and specifications of sucir balances shalr be such as may beprescribed under the Legal Metrolory (Gqleral) Rules, 20 I L

(3) Every Secondary Standard balance shall be verified at least once within aperiod of twelve mqnths and shall be adjusted, if necessary, to make it correcrwithin the limits of sensitivity and other metrological qualiiies prescribed underrhe Act, by the Reference Standards Laboralory or by the Controile;;; such otherofficer as may be authorized by tbe Controller in thisiehalf.

Working Standard Balaoces: (l) A ser of Workiog Standard balances shall bcmaintained at every place where Working Standard W-eighfs are kept.(2) The number, types and specifications of such balancis shall be such as may beprcscribed under the Legal Merrology (General) Rutes. 201 l.(3) Evcry working standard balance sha[ be verified at leasr once wirhin a pcriodof twelv^e monlhs.and shall be adjusted, if necessary, to make it coneci within thclimits of sensitivity and other metrological qualities prescribed under the LegalMetrology (General) Rules, 2011, by the Rclbience Srandard Laboratory or ar anyofthc place where Secondary Standards are maintained by the Stare Uoremmcnt.Physical characteristics, configuration, construcaional details of Weights arldMeasures-l,lvery Weight or measure used or inlended to be used in any j.ansa.tiunor for protection shall conform as regards physical characteristic. configuration,constructional details. materials, performance, tolcrances and such othcr details. tothe specifications prescribed under the Act or the Legal Metrology (General)Rules- 201 1.

Use of Bullion Weights, Carat Weights etc. _ ( l) No weight other rhaD a BullionWeight as specified in the Legal Metology (General) Rulei, 201I shall be uscd inany fansaction or protection in bullion including precious metals. pearls.ornaments or other articlcs made ofgold or silvcr.(2) No weight other than a carat weight shall be used in any transaction orprotection in precious stones.(3) Only beam scale of class A or Class B cat€gory or a noir automaticweighitrg instrumetrt of high accuracy class (class II) oi special accuracy class(class I) shall be used in any transaction or protection referred to in sub_ rules(l) and (2).Use of weights only or measures only or number only in certain cases. _

Except in the cases of commodities specitied in Schertule I, the declaration ofquantity in every transaction, dealing or contract. or for prorection shall be termsof the unit of'-(a) Weight. if the commodity is solid. semi-solid, viscous or a mixture of solid andliquid;(b) length, ifthe commodity is sold by linear measure;(c) area, ifthe commodity is sold by area measure;(d) volume, ifthe commodity is liquid or is sold by cubic measure; or(e) number, if the commodity is sold by number.

I L Licencing ofmanufact[rer, repairer and dealer of Weights and Measur€s-(l) Every manufacturer or repairer of, or dealer in, weight or measure shall makean application for the issue of a licence to the conholl legal metology or such

other officer as may be authorized by him in this behalf, in the approp ate formset out in Schedule ll-A.

Provided that no licence to repair shall be required by a manufacturer torepair weight or measure manufactured by ltim and used in a state other than the

state of manufacturer of the same, but the manufacturer has to inform in advance ;the concemed legal metology officer about the repaidng.

Provided that a person who bonafide repairs any weight or measure ownedor possessed by him shall not require a repairer Iicence.(2) Every manufacturer or repairer ol', or dealer in weight or measure shall makcan application for the renewal of a licence within thirty days before the expiry ofvalidity of the licence to the Conlroller legal metrology or such other officer as jmay be authorized by him in this behall in the approp ate fonn set out inSchedulc IT-B.(3) F)very licence issued to a manufacturer, repairer or dcaler shall be in the

appropriate form set out in Schcdule Ill.(4) Every licence issued to a manufacturer, repairer, or dealer shall be valid for aminimurn period ol'one calendar year and may bc renewed for a pcriod of cne

calendar year, by the Controller or such other officer as may be authorized by hiutin this behalfon payment ofnecessary fee as specified in the Schedule IV.(5) The lbe payable for the alteratioo of a liccnce or for the issue of a duplicatelicence shall be as spccilied in Schedulc IV.Provided that an addilional fee at lull the rates specified in Schedule lV shall hc

payable by thc applicant ifhe is permitted by fic Controller to make an applicationfor the rcnewal ofa licence within a period of three months fiom the date ofexpir)'of the licence.(6)'l-he cortroller or such other officer as may be authorized by him in this behalfshall maintain a registcr ot'licenced manufacturers, dealers and rcpairers in thcform set out in Schedule V.(7) L,very manufactuer/ repairer/ dealer licensed under thc Act and these rulesshall maintain such workshop/ equipments/ tools/ registers etc. as the case may be, -as per thc terms and conditions ofthe license.(8) Every repairer licensed under the Act and these rules shall fumish a securitydeposit for each license to the State Govemment as specified in Schedule VI.(9) Very liceose issued or renewed under this Act shall be displayed in a

conspicuous place in the premises wher€ the licensee carries on business.(10) A license issued or renewed under this Act shall neither be salable nortranslbrable.-
