TERMS & CONDITIONS

1. General:

1.1 Any offer not received as per terms & conditions of the tender enquiry is

liable to be ignored. No offer shall be considered if:

a. received without bid money/security

b. received after the time and date fixed for its receipt. c. not signed by authorized person on each page of tender document d. the offer is ambiguous

e. the offer is received by fax or email f. the offer is from a black listed firm

g. the offer is from the firm not having their own repair & maintenance workshop h. offer received with shorter validity than required

i. the offer is not conforming to requirements indicated in the tender documents

j. Any conditional offer

1.2 Only Suzuki authorized dealers registered with tax (Income Tax, Sales

Tax, PRA/PST) authorities are eligible to participate in the tender having at least (03) three years of relevant experience inclusive of

government/semi government/autonomous bodies also.

1.3 Offer will remain valid for a period of 90 days after opening of the bid. The

contract will be enforced for a period of one year. No escalation in rate will be given during contract period.

1.4 The cover envelop should indicate particulars of tender and date of

opening. The envelop must be properly sealed.

1.5 The bid money / Bank security shall be forfeited if:

a. The acceptance of the bid is not received within ten days of the issuance of the acceptance letter

b. The offer is withdrawn, amended or revised.

c. The contractor fails to execute the contract strictly in accordance with terms and conditions.

1.6 The bidder should indicate their National Income Tax No. / circle of

Income Tax Department





1.7 All the tenders can be cancelled by the Chairman PVTC before acceptance of the bid (s) as per Claus: 35 of Punjab Procurement Rules, 2014.

2. Cancellation / Penalty:

2.1 Non-acceptance of the agreement/contract/work order, bid money shall

be forfeited.

2.2 In case the offer is withdrawn, amended or revised during the validity

period of the tender, the bid money shall be forfeited.

2.3 In case, the bidder fails to execute the contract in accordance with the

terms & conditions laid down in the contract, bid money will be forfeited and required job / services can be hired from another company at risk

and cost of the bidder.

2.4 In case of poor performance, PVTC may cancel the contract or impose

appropriate penalty. The penalty may be up to double of the approved rate of total billing amount against the particular work order for which

services taken. 3. Payment:

3.1 Payment will be made through crossed cheque to the bidder against

invoice after satisfactory performance against the services within 30 days.

3.2 Payment against partial work done will not be made.

4. Bid Money:

4.1 Fix bid money of Rs. 20,000/- of the estimated price of the said tender will have to be deposited along with this tender. It should be in the form of Pay Order/ Bank Draft/Call Deposit in the favor of Punjab Vocational

Training Council, Lahore.

4.2 Bid money of unsuccessful bidders shall be refunded on approval of contract/tender whereas the bid money of successful bidder shall be refunded on the successful completion of contract period.

5. Other Terms and Conditions

5.1 The repair work is to be carried out in the repair & maintenance workshop

of the bidder. The bidder should have the sufficient experience and infrastructure to undertake the service, repairs, overhauling and all kinds of mechanical/electrical works etc.





5.2 The repair & maintenance workshop should have sufficient parking

space/work area within their premises without any infringement of public place so that the driver of the vehicle is not booked for unauthorized

parking when the vehicle is taken to the workshop for repairs. 5.3 The contractor will submit estimate for replacement of parts/services that

may be required from time to time and will supply the original parts at the approved rates offered by him in the tender.

5.4 The work order will be given after the approval of approved rates

submitted by the bidder. In case of repair & maintenance services required whom rates have not been available in the tender documents list, quotation will be supplied from the approved bidder and after getting

approval, work /services will be completed accordingly.

5.5 The spare parts to be provided should be of original make and of genuine quality. Verification for the genuine parts can be made by PVTC and in case of non-genuine parts; payment will not be made for the non-original

parts. The replaced parts must be returned to the PVTC.

5.6 No advance payment will be made. The approved contractor shall submit submit the bill on satisfactory completion of the job.

5.7 No work/repair will be carried out without work order or directions from any PVTC officer other than the authorized person in this behalf.

6. Inspection:

The repair & maintenance work will be inspected by PVTC through authorized personnel who will coordinate the contractor in lieu of required job as per

tender requirements/terms & conditions of contract.

7. Deduction of Taxes:

Any taxes (if applicable) will be deducted while making payment as per

Government instructions/notifications.

8. Payment of Income Tax & other Taxes: Purchases & services shall be made only from the firms having their own repair

& maintenance workshop, registered with income tax and sales tax under Punjab Revenue Authority. All taxes and any other duties if applicable will be

liability of the firm. 9. Termination of Contract:

Chairman PVTC or any officer in this behalf may terminate contract for

convenience assigning reasons to the contractor in writing with compensation of items/services delivered to the purchaser if applicable.





10. Dispute:

In case of any dispute before or after the execution of contract, matter will be

resolved as per PPRA Rules 2014’ Clause: 67 & 68

The dispute arising after the contract shall be resolved in the following manner/mechanics

10.1 The arbitrator will be Senior Manager (Curriculum), PVTC, Lahore

10.2 The aggrieved party may submit its grievances in writing within 15 days after the dispute

10.3 The arbitrator shall decide the matter after hearing both parties preferably within 30 days after receiving the written complaints

from the aggrieved party.

10.4 The decision of the arbitrator shall be final and binding for both the

parties.

11. Contract Period

The contract will be for a period of 01 years with effect from the signing of

the date of agreement/contract.

12. Mandatory Technical Eligibility Evaluation Criteria:

The bidder will provide information along with the tender documents about the

following:

a. Suzuki authorized dealers registered with tax (Income Tax, Sales Tax, PRA/PST) authorities are eligible to participate in the tender having at

least (03) three years of relevant experience inclusive of government/semi government/autonomous bodies also

b. Suzuki authorization certificate from M/s. Pak Suzuki

c. Income Tax, Sales Tax & PRA/PST valid registration certificates

Note: Above mentioned mandatory evaluation criteria documents must be attached, failing which shall leads towards disqualification of the bid.
