ty said, “As of now weare charging Rs.50per seat from ShagunReality to Sector-17because we don’t getpassengers back fromthat area. If thefrequency of trainsincreases, we willcharge accordingly.The population nearKharkopar station isvery less and most ofthe flats are vacant.Once all the flats willbe filled, the fares willautomatically comedown.”

When a personchooses to end their lifebecause they can nolonger live with digni-ty, the question to beasked is not whethershe can waive her con-stitutional right to life,but whether she has aright to choice? The de-bate extends to wheth-er the fundamentalright to life extendsto the right tochoice, because, af-ter all, there is noovert act required tobe performed to livelife. The more ab-stract jurisprudencecontent that arisesis whether there is aright to choose at all,and if there is, willit govern the right tolife or be subservientto it. What is the pointin wasting money intreating old-age ail-ments when one has toeventually die?

Article 21 of theConstitution gives methe right to life, but Ialso interpret it as giv-ing me the right to takeaway my life. The rightto life includes theright to live with digni-ty. When you are inpain, that dignity is lostand you are forced torely on your kith andkin for support. Section309 of the Indian PenalCode prescribes punish-ment for attemptingsuicide. It is an offence,but it should not be one.You could die, but if yousurvive, you should getcounselling, not go tojail.

The right to life isan old debate. Whenthe Supreme Courtheard the challenge tothe imposition of Emer-gency, it rejected theargument that in India,the right to life avail-able to a citizen flowsfrom Article 21 of theConstitution, and that

if such an Article wereto be deleted or sus-pended, the citizenwould have no right tohis life under law. Theright to life was mademore sacrosanct and,over the years, has beenseen as a basic featureof the Constitution,thereby making it bothfundamental and per-manent.

The significance ofthis is that if one relin-quishes the right, onecan do so only in accor-dance with procedureestablished by law. Im-posing death by way ofcapital punishment isan example of the right

to life being termi-nated in accordancewith the procedureestablished by law.To terminate life,even one’s own life,were it to be donewithout the authori-ty of law, wouldamount to an unlaw-ful act. In certaincases, it may even bea criminal act. Infact, an attempt to

commit suicide is acrime under the IPC.

In the case of termi-nally ill patients, whoare provided with ex-pensive health care,whose families knowthat the patients areunlikely to return tonormalcy or near-nor-malcy, and given theeconomic burden on thefamily and on society totreat these patients,euthanasia could be de-bated. But euthanasiafor those who are men-tally alert, thoughphysically disabled, is abig no. There is anoth-er legal dimension tothis debate. Takingaway life is often relat-ed to the inability of theaffected or concernedindividual to live withdignity. Euthanasia ef-fects in society is man-ifold and these cases areto be taken individual-ly and each case is tobe treated with discus-sion and dignity.The writer is a freelancer

Need for introspectionOnce considered to be the heaven of peace and tranquility, Navi

Mumbai can hardly be described the same. In the last few monthsthere has been an alarming rise in crime, especially the petty theftsand house burglaries. Police response to the rising crime has beeninadequate. Insufficient police strength, huge migration of labour,because of large scale construction activities, close proximity toMumbai, which can well be described as the den of underworldgangs and criminal activities, are sported as excuse for the zoomin the crime graph. But along with these, there is no denying thefact that handling has been inept and wanting.

While police may pat their shoulders for solving a few of thecases, it is disheartening to note that several remain unsolvedwhich only help in bolstering the enthusiasm of the culprits, en-couraging them to venture further into crime. Police justify them-selves by claiming that some of the absconding culprits are for-eign immigrants who flee back after committing the crime and assuch fall beyond their jurisdiction. This is unfortunately true. Thepolice do not seem to have the authority as well as the power tonab such culprits, unless the Central Government permits, whichis a long procedure. This problem can only be tackled if India, likeother nations, follows the principle of issuing visas to the neigh-bouring countries and allows only those foreigners who have ob-tained proper jobs and accommodation. Secondly memorandum ofunderstanding should be signed with the neighbouring countriesto allow the police to nab the culprit from whatever area he mayhave fled to.

The attitude of the police officials towards the complainants isalso many times not encouraging. It is seen that there is the ten-dency to ignore the crime, discourage lodging of complaints, slowdisposal of cases, harassment of witnesses etc. This has certainlydwindled the faith of the public in the police department and theysimply hesitate in going to the police stations for lodging of com-plaints and for other grievances. Over the past few months, therehas also been a dereliction of duties as well. Night patrolling, whichused to be a daily exercise, has been abandoned, for reasons bestknown to the police officials themselves. This has led to the in-crease in the cases of chain snatching and house breaking inci-dents. The detection rate has also not gone up.

The Navi Mumbai police department is presently trying to builda public friendly image. This is heartening and is certainly the needof the hour. This will help in strengthening the much desired faithof the public in the police department. Without public joining handswith the police department, crime cannot be controlled. The pub-lic on their part should come forward bravely with complaints aswell as with information. The night patrolling exercise should bestarted for all the sectors to check the growing petty crime. Itshould be the endeavor of each one of us to make Navi Mumbai acrime free society.

Students go-ing to appear for theBoard examinationshave already decidedto study every day andget good grades.

Some of the eldersin the age group of 45years and above saidthat their new year’sresolution mostlydeals with more sav-ings and having funwith it. “My New YearResolution is to trav-el the world,” said a62 year-old lady, whohas already bookedtickets for the USAand Egypt.

Catch up with CAAOf late, we are noting that a lot of state government, due to vote bank

politics, are making public declaration that they won’t enforce the Citi-zenship Amendments Act (CAA). But it is immaterial that whether thestates are following it in true spirit or not. Article 245 and 246 and otherprovisions, state that parliament has complete power to pass laws re-garding naturalization and citizenship. These are clear constitutionalobligations. Both the houses discussed CAA and passed the law. There isno escape, the law has to be implemented.

All governments talking about not implementing it, need to knowthat once they have taken oath, they are bound to follow the mandate ofthe Constitution. It is time to catch up with CAA.

NAVI MUMBAI: TheVashi police stationhas filed a caseagainst a man and hisparents for givingtriple talaq under TheMuslim Women(Protection of Rightson Marriage) Bill,2019.

The complainant, a28-year-old womanfrom Vashi Sector-15,had been allegedlygiven divorce by herhusband who saidtalaq thrice over aphone call. She alsoalleged that her in-laws harassed her.

The complainanthad married Mudas-sar Beg in June 2014as per Muslim cus-tom. After the mar-riage, her husband,mother-in-law, broth-er-in-low and co-sisterin law started tortur-ing her mentally andphysically for variousreasons. She wasasked to do all thedomestic chores andwas ill-treated. Shewas even offered stale

food to eat. The in-laws allegedly alsodemanded Rs 55,000that they spent on herdelivery.

The complainantfurther alleged thatthe gifts which weregiven to her duringher son’s birth wassold by her in-law.They further demand-ed Rs10 lakh andthrew her out of thehouse. Followingwhich she has beenstaying at her par-ent’s place since 3years in Ambarnath.

In the complaintthe victim stated thather husband hadgiven triple talaq overa call in March 2019and filed a complaintin Ambarnath policestation followingwhich she recentlyfiled another com-plaint with the VashiPolice Station.

I think school lockers for students in school is an excel-lent ideology of reducing the bag load of students.
