Sealed Tenders duly super scribed above reference are hereby invited from the Pre-Qualified parties of NFL
Nangal Unit & other parties as approved by Competent Authority for the work as per following conditions/details:
BRIEF DETAIL OF NFL NANGAL UNIT
National Fertilizers Limited (NFL), a Govt. of India undertaking, owns and operating fertilizers plants at four
locations in India and one of them is at Naya Nangal, Distt. Rupnagar (Punjab). There are four boilers at Nangal
Unit, out of which one boiler is ISGEC John Thompson Make, single drum, water tube type, Oil Fired
Auxiliary Boiler and is in question for complete „Remnant Life Assessment‟ study & other three are BHEL Make
Model VU-40 for partial „Remnant Life Assessment‟ study.
HISTORY OF JOB
As per Indian Boiler Regulations (Ref.: Regulation No. 391A) it is statutory that all the boilers should be
inspected for „Remnant Life Assessment‟ study and making recommendations for boiler life enhancement from
an agency approved by Central Boiler Board after 100000 hours of running or 25 years of service and the report
of inspecting agency is to be submitted to Director of Boilers - Punjab for issuance of certificate for further
operation.
OBJECTIVE
The overall objective is assessment of the Remnant life of parts of a boilers and acceptance of the results as the
standards laid down by Central Boilers Board. It shall be the responsibility of consultant to arrange a certificate
from chief Inspector of Boilers for extending the life of the boilers for a further period of 10 years or such period
recommended by Remnant Life Assessment Organization.
QUALIFYING REQUIREMENTS OF BIDDERS
A) Essential requirement
a. Work Experience
The bidder must be approved by Central Boilers Board for RLA Study and must be working in the field
of boilers and Remnant Life and Extension thereof. The bidder shall furnish the documentary evidence in
this regard & its validity. The bidder should have got at least one boiler certified from respective
Directorate of Boilers in the last three years.
b. Technical Capabilities
The bidder shall furnish the following details
i. Non-Destructive Testing equipment available for carrying out RLA
ii. Software package for evaluation of the RLA of equipment.
c. Personal Capabilities
The personal should be qualified and their credentials shall be enclosed (refer OTCC clause No. 3.3)
d. Financial Capabilities
The last three years audited „profit & loss‟ account and Balance Sheets shall be furnished and must
demonstrate the current soundness of the financial position of the organization. Latest Income Tax
Clearance Certificate and PAN shall also be furnished.
B) Desired Information
The bidder shall furnish the following information in his bid:
a) Details of previous jobs
The party shall submit documentary evidence with respect to experience of having successfully
completed relevant works executed during last three years ending last day of previous month in which
NIT has been issued. Copies of the workorders/ contracts / LOI shall be submitted alongwith successful
execution / completion certificates.
b) Current commitments and availability of manpower
The bidder shall furnish information on their current commitments on all the contracts that have been
awarded or for which letter of intent or acceptance has been received or for contracts approaching
completion but for which an unqualified full Completion Certificate is yet to be issued.
The bidder shall furnish information on the Management Structure of the company and shall supply
information / Bio Data of the team purposed to be employed for the said job.
The bidder shall also demonstrate to the satisfaction of NFL that he has adequate manpower resources to
meet the requirements on the works currently in progress and for further contract commitments.
c) Concept Plan
The bidder shall submit the Concept Plan including tests to be conducted and the methodology for
execution of the job.
BASIC TENDER INFORMATION:

4. Estimated value of the contract : Rs. 14,20,000/-
5. Amount of Earnest Money : Rs. 17,700/-

7. Last Date of Receipt of Tenders : 11.11.2011up to 3.00 PM
8. Date of opening the Tender : 11.11.2011 at 3.30 PM
9. Validity of Tenders : 04 months

11. Terms & Conditions : As Per OTCC / GDCC
PROCEDURE FOR SUBMITTING TENDERS:-
The Tenders shall invariably be submitted by splitting it into three parts and putting separately into three sealed
envelops described as under:
a) ENVELOPE No. 1 to be super-scribed „EARNEST MONEY‟ will contain Earnest Money and Tender Fee
(in case down loaded from website) amount of Rs. 18,250/- (Rs. Eighteen thousand two hundred fifty only) in
the form of DD / Banker Cheques issued by any scheduled bank favoring National Fertilizers Limited,
payable only at Naya Nangal / Nangal Township (Pb.). NFL will not adjust the EMD / Security deposit of the
other tender / contract of the tenderer / contractor against this contract. Cheques shall not be accepted in any
case.
b) ENVELOPE No. 2 to be super-scribed „TECHNICAL & COMMMERCIAL BID‟ containing the following
documents:
Signed copies of complete tender documents, but excluding Performa for price bid (Annexure – 1). Each
page of copy of these documents should be signed / stamped by tenderer in token of acceptance of our
terms & conditions.
Documentary proof of Party‟s own PAN (Self Certified)
Documentary proof of Party‟s own PF Account No. (Self Certified)
Documentary proof of Party‟s own ESI Code (Self Certified)
Service Tax No. Evidence/Registration Certificate issued by Excise Authority. (Self Certified)
Copy of Labour License (if applicable).
Declaration form pertaining to Price bid strictly as per SOQ (Annexure – 2)
Declaration form pertaining to Acceptance of Terms & Conditions of LTE (Annexure – 3)
Declaration form pertaining to Service Tax (Annexure – 4 )
Declaration form pertaining to Undertaking under section II A (Annexure - 5)

Details as per Qualifying Requirements of Bidders as per Clause No. 3.3 of OTCC.
c) ENVELOPE No. 3 to be super-scribed “PRICE BID – Do Not Open” in red and shall contain schedule of
prices as per Annexure – 1 therein duly completed and signed by the tenderer. The price bid should not
contain any commercial & technical condition.
All the three envelopes are to be submitted in One Outside Envelope super-scribing clearly the enclosures of LTE
and Date of Opening of the Tender. Any tender not accompanied by EMD & Tender Fee (in case down loaded
from website) shall be out rightly rejected. The comparative status of offer will be assessed on the basis of
composite (i.e. Over All) amount quoted (and not on the basis of individual item).
Tender documents can be obtained from the office of Asstt. Mgr. (M) GE on any working day up to Dt.
. If there happens to be holiday on any date mentioned above, the relevant transaction will be held on next
working day. Tender documents can also be sent by post against relevant tender fee. However, NFL shall not take
any responsibility for postal delays, if occurred, from both the sides. The tender documents downloaded from
NFL‟s website shall be considered only if accompanied with requisite Tender fee & EMD besides other
documents as stated above.
NFL reserves its right to reject any or all the tenderers – without assigning any reason whatsoever. Quotations
given by you should be Unconditional and firm for the entire period of contract. Conditional tender shall not be
entertained.

‘Scope of Work‟ & „Other Terms & Conditions of Contract‟ (OTCC)
1.0 Technical Specifications of Boiler:
For technical specifications of ISGEC John Thompson Make, single drum, water tube type, oil fired auxiliary
Boiler (Boiler No. 4) refer Annexure – A and for BHEL Make VU-40 boilers (Boiler No. 1, 2 & 3) refer
Annexure - B
2.0 Scope of Work:
The Consultant would carry out “Remnant Life Assessment Study” (RLA) as per Indian Boiler Regulation-
1950 & its amendments for Aging of Boiler- Regulation 391A of Platen Super Heater Coils, Final Super
Heater Coils & Water wall Tubes of Boiler No. 1, 2 & 3 with in 08 days from the handing over of the job of
each boiler and all the boiler parts of the Boiler No. 4 with in 15 days from the handing over of the job,
however handing over of the job can be either simultaneously (two, three or all the four boilers) or separately
(boiler wise) for different boilers as per availability of the job.
The list of the parts of boiler No. 4 is as following but this list is indicative only and shall not be limited:
1. All relevant inspections of Steam drum
2. All relevant inspections of Water walls.
3. All relevant inspections of Water wall headers.
4. All relevant inspections of Economizer coils.
5. All relevant inspections of Economizer headers.
6. All relevant inspections of Platen super heater coils
7. All relevant inspections of Platen super heater header.
8. All relevant inspections of Final super heater coils
9. All relevant inspections of Final super heater header
10. All relevant inspections of Import steam super heater
11. All relevant inspections of De-Superheater.
12. All relevant inspections of Risers/Feeders/Scaph/Combustion Chamber etc.
13. All relevant inspections of Re-generative air heater
14. All relevant inspections of other equipment, headers etc. in Steam Generation Plant for meeting the Objective
as defined.
Above Quantities are indicative only. Actual Quantities can be increased / decreased by any amount as per
plant requirements but payment will only be done as per actual job completed. Contractor shall not be entitled
to enhance the rates due to variation. No minimum quantity of job will be guaranteed.
The Consultant shall take permission/approval from the office of Director of Boilers, Punjab for the above-
mentioned RLA study and for cutting of the above pressure parts/zone before starting the job.
IBR welder with endorsement (in the IBR certificate) by Director of Boiler & Consumables as required
during RLA study for cutting and welding of pressure part/zone, if required, will be in party's scope.
Supervision for cutting & welding job for execution of work will be in Consultant's scope.
To arrange a certificate from Chief Inspector of Boilers for extending the life of the boilers for a further
period of 10 years or such period as recommended by Remnant Life Assessment Study.
All statutory formalities shall be in Consultant's scope.
3.0 Contractor’s Obligations:
3.1 Contractor shall make all arrangement for execution of work at site i.e. All type of skilled/unskilled
manpower, material, all consumables and all type of safety equipments (i.e. personal protective devices
required for his staff).
3.2 Contractor shall be responsible for getting all the clearances from statutory authorities regarding the job to be carried out at NFL, Nangal Unit.
3.3 RLA Study shall be conducted by a team of experienced Technical Experts having in depth experience in
similar jobs. Contractor shall deploy at least ASNT level II certified person to carryout specialized NDT
tests.
3.4 Programme for carrying out RLA related jobs shall be finalized by Engineer-in-Charge. Contractor will keep Engineer-in-Charge informed regarding progress of job on day-to-day basis.
3.5 All the requirements of scaffolding inside or outside and removal/refixing of insulation where ever
necessary for the said job shall be carried out by the party and they them self has to arrange all the
material, manpower etc.
3.6 If there is any requirement of doing radiography job, activated source of the required strength shall be arranged and shifted by contractor at his own cost.
3.7 The Consultant shall furnish the details regarding assistance required (if any) from NFL during execution
of job, well in advance.
3.8 The job once started shall continue till completion, hence contractor‟s staff shall be required to work on
weekly off days & Holidays, as required and these duties shall be considered normal duties .
3.9 After completion clearance of site including cleaning etc. shall be in contractor‟s scope.
4.0 NFL’s Obligations:
4.1 All the requirements regarding air, water, power & floodlights shall be provided to contractor free of cost.
4.2 Dark room for the development of films and pit for keeping the radioactive camera shall be provided free
of cost for radiography jobs.
4.3 Job will be handed over with proper safety work permit.
4.4 NFL will provide space for safe custody of your instruments and material at works, free of cost.
5.0 Other Terms & Conditions of the Contract(OTCC)
5.1 Engineer-in-charge: Widely used term Engineer-in-charge stands for Asstt. Mgr. (M) GE.
5.2 Site In-charge: Contractor shall authorize a person during execution of job at Nangal, for co-
coordination of jobs at site and to make liason with NFL.
5.3 Accommodation, Conveyance & Canteen facility: NFL‟s Guest House accommodation if available
shall be provided on chargeable basis otherwise contractor shall make his own arrangement for
accommodation of his staff at Nangal & inform proper address of their stay along-with local telephone
numbers to Engineer-in-Charge. Conveyance arrangement for to-&-fro travel to works from their stay &
Canteen facility would also be in his scope. No other charges shall be admissible / reimbursable.
5.4 Job Schedule & Supervision of the job: Programme for carrying out all the said jobs shall be finalized
by Engineer-in-charge on day-to-day basis. Supervision of the entire job shall be in contractor‟s scope,
however, under the directions of Engineer-in-charge.
5.5 Material entry: All material required to be used by contractor inside the factory area shall be brought in,
with proper gate passes and such authentic documents with regard to material, shall be got inspected by
engineer in-charge along with material as per security rules in force.
5.6 Fire, Safety & Security Rules: It is obligatory on the part of the contractor to abide by the terms and
references as contained in the Fire, safety & Security rules. Violation will tantamount to disqualification
of the contractor for any type of work in NFL
5.7 Time Schedule / Validity of contract / Mobilization Period: Entire job has to be completed within a
period as specified in Scope of Work from the date of handing over of job to the contractor. The job has
to be executed during Turnaround-2012 (tentatively in March / April-2012) however; exact date of start
of job will be intimated to the contractor ten days in advance. Validity of contract is for one year from the
date of issue of Work Order; however it can be extended for a period of three months, twice, as per plant
requirement.
5.8 Penalty: If contractor fails to complete the job within given time schedule or not in accordance with the
standard engineering practice, penalty @ 1% of the value of the job (job wise) per day or part thereof
subject to a maximum of 10% of the value of each job shall be levied.
5.9 Risk & Cost: If it is observed at any stage that contractor is not capable to complete the job within the
time schedule or not in accordance with the standard specifications / as per terms & conditions of LTE,
NFL reserves the right to get the same executed from another agency at the risk and cost of the contractor.
5.10 Submission of Reports:
After completion of the entire job contractor shall provide preliminary report (in triplicate) in consultation
with Engineer-In-charge at site within seven days. Draft report (in triplicate) should be submitted within a
month. Within a fortnight of submission of the draft report, the Consultant shall attend a review meeting
with Engineer-In-charge, CM (GE) & CM (M) SGP. The meeting shall look into the fulfillment of the
scope of work as per the work order. All clarifications, changes mutually agreed in this meeting shall be
incorporated by the Consultant in the final report. The Consultant shall submit the Final Report (in
triplicate) within a fortnight of receipt of comments from the owner w.r.t draft report.
After acceptance of report by NFL, the Consultant would submit the report to Central Boiler Board for
arranging the certificate as described in the scope of work.
5.11 Payment Terms
5.11.1 Payment Terms: After completion of the entire job including clearance of site, the contractor will
submit his bills to the Chief Manager (GE-NDT). On acceptance of the draft report 25% payment
shall be released and on acceptance of final report 50% payment shall be released within 30 days after
deducting statutory levies & due recoveries next 15% payment shall be released after getting desired
certificates from Central Boiler Board as described in scope of work and getting endorsement /
acceptance from Chief Manager (GE) and the balance 10% shall be kept as security deposit. This
payment shall be released after six months inclusive of claim period after acceptance of final report if
no complaint is received during this period regarding quality of the job executed by you.
5.11.2 Security Deposit: Alternatively, the successful bidder can furnish security deposit @ 10% of the
value of the order after adjusting EMD (if already submitted) in the form of bank guarantee from
nationalized / scheduled bank excluding rural & co-operative bank covering performance guarantee
period plus 3 months claim period. Bank guarantee must be directly sent by their banker to NFL.
5.11.3 Submission of Monthly bill: The contractor shall submit his monthly bill (if applicable) within 1st
week of the following month to the Executing Department for verification & recommendation. In
case the contractor fails to submit the bill by last day of the following month, a penalty of 1% of the
billed amount or for every month of delay or part thereof subject to minimum of Rs. 1000/- shall be
recovered from the bill.
5.12 Payment of Taxes & Duties:
a. Other than Services Tax:
The tenderer(s) shall quote their rates inclusive of all taxes and duties excluding Service Tax. No
request for increase / decrease or inclusion of any tax (es) shall be entertained afterwards.
NFL shall not provide any C-Form for availing confessional rate of CST towards import of goods /
material by the contractor in the State of Punjab from the other states.
b. Payment of Service Tax:
The tenderer shall separately indicate the portion (amount) of taxable services on which service tax
shall be payable by NFL, in the price bid. The tenderer shall also indicate the service tax rate and the
amount of service tax in the price bid. As regards portion (amount) of the exempted services
representing value of goods etc. the necessary documentary evidence shall be available with the
tenderer.
In case tenderer opts composition scheme for payment of service tax, then the amount of service tax
on the value of goods received free of cost from NFL (if any), shall be borne by the tenderer.
In case of tenders called under duel bid system, the tenderer shall confirm that all the columns in the
price bid relating to item wise rates and service tax along with totals have been filled up. This
confirmation may be provided in prescribed performa (refer Annexure – 4) and submitted along with
technical bid in envelop - II
c. Evaluation of bids:
The amount of service tax as indicated in price bid, shall be considered for evaluation of bids for
arriving at L-1 status.
If nothing is mentioned in the columns relating to service tax, it shall be construed that the quoted
rates are inclusive of service tax and tenderer is not claiming anything extra on this account from
NFL.
If in the service tax columns, tenderer fills up the remarks such as, as applicable/service tax extra/ as
per Govt. rules etc. then it shall be construed that service tax at prevailing rates is applicable on all the
items i.e. on total quoted value of the contract, which shall be loaded for evaluation purposes for
arriving at the status of L-1.
d. Payment on account of service tax shall be made based on invoice / bill raised by the tenderer
separately indicating the amount of service tax, restricted to the quoted proportion / rate of the service
tax. The tenderer must provide copy of the service tax registration number which should also be
mentioned in invoices / receipts along with Service Tax Code and Accounting Code.
e. Any subsequent change in the rate of service tax shall be to NFL‟s account during contractual period
only.
f. As per service tax law, the liability towards payment of service tax lies with the service provider, so
NFL is not responsible for non compliance of service tax law by tenderer.
g. No other charges including statutory fee levied by any Govt. / Statutory / Autonomous Authorities for
testing inspection & approval shall be payable.
5.13 Income Tax & Other taxes: Income tax and other taxes if any shall be deducted as per rules.
5.14 Labour license / No Objection certificate: Contractor shall arrange Labour License / NOC as
applicable, before the start of job.
5.15 Ex-NFL Employees: Contractor will inform (vide undertaking under section IIA) whether any ex-
employee(s) of NFL is / are employed with him. If so, the Name, Designation Department and E. No. of
such ex-employee(s) to be indicated. (Annexure – 5)
5.16 Relationship with NFL Employee(s): The contractor will inform (vide undertaking under section IIA)
whether any relative of NFL is/are employed with him. If so, the Name, Designation, Department & E.
No. of such employee(s) be indicated. (Annexure – 5)
5.17 OTHER STATUTORY REQUIREMENTS:
5.17.1 Provident Fund
a. Every contractor should have his own PF Account Number and shall be responsible to deposit the PF
contribution in respect of workmen engaged by them.
b. The contractor shall indicate PF Account Number allotted to each worker engaged by him in the
monthly wage bill and will ensure its accuracy and correctness.
c. The contractor shall submit Annual Return in respect of all the workmen engaged by them with
concerned RPF authorities with copy to P&A Deptt.
d. After submission of the return the contractor shall arrange and distribute PF slips in respect of PF
Contribution, issued by the RPF Authorities and will distribute to the concerned workers after
intimation to the Executing Deptt and P&A Deptt.
e. After closure of the contract or in case of change of the employer (contractor), the outgoing contractor
and present contractor shall ensure submission of Form-13A, for transfer of PF contribution from old
account to the new account.
5.17.2 ESI
a. Every Contractor should have his own ESI Account Code Number from the ESI Authorities. It shall
be the responsibility of the contractor to deposit the ESI contribution every month @ 6.5% of the
monthly wage bill, (Employers Contribution @ 4.75% & Employees Contribution @ 1.75 %), under
intimation to P&A Deptt.
b. It shall be responsibility of the Contractor to ensure Registration and issue of ESI cards to the
workmen engaged by him, for availing medical facilities by the beneficiaries.
c. It shall be responsibility of contractor to submit ESI returns to statutory authority under intimation to
P & A
Note: However, the contractors providing super specialized services (Testing / calibration etc.) must specify
in writing if they pay wages to their specialists more than Rs. 15,000/- per month for waiver off
ESI/PF clauses.
5.18 Sub-Contracting: Sub contracting of the job will not be allowed without prior permission of NFL.
5.19 All terms and conditions of GDCC, all conditions of CISF, safe guards and following documents shall
form part of this NIT:
a) Central labour & Health Regulation.
b) Project Medical Scheme.
c) Provisions of EPF Act, 1952: To comply with these provisions you will have to obtain Provident
Fund Accounts Number from PF Commissioner‟s Office for making necessary deposits under the
said Rule/Act.
d) Contract Labour (Regulation & Abolition) Act, 1970/71.
e) Minimum Wages Act.
f) Employees Liability Act-1938.
g) Industrial Dispute Act-1947.
h) Any other Act framed by Govt. in this regard.
5.20 Compensation against damage of Plant & Machinery: NFL reserves the right to claim adequate
compensation from contractor on account of any damage caused to the plant & equipment handed over to
him for execution of work, due to careless handling or negligence on the part of the contractor.
5.21 Workmen Payment: NFL will make the payment as per approved rates, whereas contractor shall have to
pay his workmen as per statutory obligations along-with overtime as per rules.
5.22 Payment of Minimum Wages :
a) It shall be the responsibility of the Contractor to make payment of Minimum Wages to the workmen
engaged by him on or before 7th of the following month, as fixed /revised and notified by the Appropriate
Govt. (Presently Central Govt.)
b) In case the rates notified by the Central Govt. for scheduled employment are less than the rates notified by
the State Govt., in that case the Contractor shall be required to make the payment to the workmen at the
rates notified by the State Govt.
5.23 E-Payment: NFL Nangal unit is having its Cash Credit Account with State Bank of India, Naya Nangal,
who is having Electronic Fund Transfer Facility (EFT) in its branch at Naya Nangal and some other
important branches. The contractors / suppliers, who are maintaining their bank accounts with SBI,
having EFT facility may submit the bank particulars i.e. Bank Account Number, Name & Place of branch,
Branch Code Number, so that, their payments could be released through transfer of funds to their account.
5.24 Termination of Contract: In case the performance of the contractor during the currency of the contract
is not found satisfactory and there is breach of any of the terms and conditions of the contract. NFL
shall have the right to terminate the contract with forfeiting of EMD/SD or getting the job done at his risk
and cost at its sole discretion.
5.25 Arbitration:
Contracts having contract value more than Rs. 10.00 Lakhs.
The contract shall be governed by and construed in accordance with the laws of India.
Except where otherwise provided in the contract all matters, questions. disputes or differences whatsoever
which shall at any time arise between the parties hereto, touching the construction meaning operation or
effect of the contract or out of the matters relating to the contract or breach thereof, or the respective
rights or liabilities of the parties, whether during or after completion of the works or whether before or
after termination, shall be referred to Functional Director/Chairman & Managing Director, National
Fertilizer Ltd for appointing arbitrator from the panel maintained by the NFL (circulated vide IOM No.
NFL/Sec/Legal/Arb./123 dated 19.08.2010) or any other person of repute including persons on the Panel
of Arbitrators maintained by bodies like SCOPE Forum of Reconciliation and Arbitration (SFCA),
Construction Industry Arbitration Council (CIAC), ICA, etc. to adjudicate the dispute. The decision of the
arbitrator so appointed shall be final and binding on the parties.
It is agreed by and between the parties that in case a reference is made to the arbitrator or the arbitral
tribunal for the purpose of resolving the disputes/differences arising out of the contract by and between
the parties hereto, the arbitrator or the arbitral tribunal shall not award interest on the awarded amount
more than the rate of SBI PLR or actual interest rate paid by the owner (NFL) whichever is lower
prevailing on the date of award of contract.
Subject as aforesaid the provisions of India‟s Arbitration and Conciliation Act.1996 and the rules made
there under or statutory modification or re enactment thereof from time to time shall apply to the
arbitration proceedings under the clause.
5.26 Agreement: In case of award of contract, contractor have to execute an agreement on non-judicial paper
of Rs. 15/- to be purchased by him before the start of the job and specimen Performa for the same should
be obtained from Asstt. Manager (M) GE.
5.27 Besides these Terms & Conditions, the contractor shall strictly adhere to „General Directions &
Conditions of Contract‟ (GDCC). However in case of difference between „Other Terms & Conditions of
the Contract‟ (OTCC) & „General Directions & Conditions of Contract‟ (GDCC), „Other Terms &
Conditions of the Contract‟ (OTCC) shall prevail.
