That was the message that a professional consultant and parents who have been work- ing on the topic for the last six months deliv- ered to the Board of Education at its meeting Thursday. It came during an update on districtwide fundraising, a controversial policy that the board passed in November 2011 that radi- cally altered the way parents could donate money to public schools. Rather than pay the salaries of teaching assistants or supporting arts or sciences pro- grams at specific school sites, the dis- trictwide fundraising model restricts parents to buying “stuff,” while entrusting the Education Foundation with raising enough money to pay for staff for programs throughout the district. The policy is meant to impose some equi- ty on a district that historically saw huge amounts of parent dollars flooding into some schools, while others languished in per pupil parent spending and the amenities it provided. That was the message that a professionalconsultant and parents who have been work-ing on the topic for the last six months deliv-ered to the Board of Education at its meetingThursday.

It came during an update on districtwidefundraising, a controversial policy that theboard passed in November 2011 that radi-cally altered the way parents could donatemoney to public schools.

Rather than pay the salaries of teachingassistants or supporting arts or sciences pro-grams at specific school sites, the dis-trictwide fundraising model restricts parentsto buying “stuff,” while entrusting theEducation Foundation with raising enoughmoney to pay for staff for programsthroughout the district.

The policy is meant to impose some equi-ty on a district that historically saw hugeamounts of parent dollars flooding intosome schools, while others languished in perpupil parent spending and the amenities itprovided.

PUBLIC SAFETY FACILITY Police later this month plan tomeet with animal rights groups and local veterinarians tocreate new protocol to deal with wild animals following theshooting death of a mountain lion in Downtown.

On the morning of May 22, Santa Monica police officersshot and killed a 95-pound, 3-year-old mountain lion in thecourtyard of an office building on Second Street, just a blockfrom the popular Third Street Promenade.

A necropsy was conducted and preliminary findingsshow the male lion died as the result of a gunshot wound.

Since the shooting, the Santa Monica Police Departmenthas come under fire from animal rights groups and residentswho believe more steps should have been taken to trap theanimal and release it instead of firing fatal shots.

Police said there have been no reported instances in thelast 30 years of a mountain lion roaming the city and there-fore need to formulate “a unique approach” to address theunusual occurrence if it happens again in the future, accord-ing to a press release issued late Thursday by the SMPD.

Members of the SMPD plan to meet with theDepartment of Fish and Game, which was on scene duringthe lion shooting, the Society for the Prevention of Crueltyto Animals, In Defense of Animals, the Pacific Institute forRestoration Ecology at Cal State Channel Islands and localveterinarians who specialize in large animals.

The meeting is scheduled to take place during the latterpart of June, according to the release, which laid out thesequence of events that led to the shooting death of the

PCH Lindsay Lohan emerged uninjured from a collisionwith a dump truck on Pacific Coast Highway on Friday,returning to the set of her new movie hours after the acci-dent left the sports car she was driving crumpled.

Santa Monica Police Sgt. Richard Lewis said there was nosign Lohan was driving while impaired and that his agencywould continue to investigate who was at fault in the wreck.The truck’s driver was uninjured and that driver also showedno signs of driving under the influence, Lewis said.

“We’re treating this as a regular accident,” Lewis said.The accident at around 11:40 a.m. Friday near the

California Incline occurred while Lohan was on her way tofilm scenes for the Lifetime movie “Liz and Dick,” whichchronicles the love affair between Elizabeth Taylor andRichard Burton. Lohan’s publicist Steve Honig said theactress was released about two hours after the accident andwas returned to the set to continue filming.

“Fortunately, no one was seriously injured in the acci-dent,” he wrote in an e-mail.

Lohan was driving with her assistant, who police said wasnot seriously injured.

“First and foremost, we’re concerned about the well-being of Lindsay and anyone else who may have beeninvolved in the accident,” Lifetime spokesman Les Eisner

said, adding, “Lindsay has been doing fantastic work on theset of ‘Liz and Dick.’”

Production on the film started earlier this week and wasexpected to conclude around the end of June.

Lohan, 25, remains on probation in a necklace theft case,but is no longer being supervised by a judge or probationofficer.

The accident is the latest vehicular mishap for Lohan,who had her driver’s license restored in August 2010 afterlosing her driving privileges because of a pair of DUI arrestsin 2008. She is still being sued by three men who claimLohan forced them to remain in a sport utility vehicle shecommandeered and used to chase a woman she thought washer assistant on PCH. That incident ended in the parking lotof the Santa Monica Police Department, where Lohan wasarrested.

Friday’s accident comes after the Los Angeles DistrictAttorney’s Office last month determined there was insuffi-cient evidence to pursue a case against Lohan in a nightclubmanager’s claim that the actress struck him with her sportscar.

The prosecution said there was a lack of evidence in thecase.

SMMUSD HDQTRS A Malibu High School teacher accused ofslapping a female student at least four times for failing tobring a notebook to class did nothing of the sort, the super-intendent of schools said Friday.

Sandra Lyon told the Daily Press that the teacher, identi-fied in news reports as Jennifer Gonzalez, playfully pattedthe ninth grader and that there was no intent to harm thestudent.

“The teacher was trying to encourage the student to give

her best efforts in the last few weeks of school,” Lyon said,describing the incident as more of an innocent exchangerather than a frustrated, abusive outburst. “As far as weknow, up to this point the student has had a very positiverelationship with this teacher.”

The incident, which allegedly took place on May 22, iscurrently under investigation by the Los Angeles CountySheriff ’s Department after the family of Dionne Evans fileda police report last week.

Evans’ family has since hired an attorney and is threaten-ing to file a civil lawsuit against the Santa Monica-MalibuUnified School District.

The teacher walked to the student’s desk and then askedher if she had seen the movie “Bridesmaids.” She then beganslapping the student multiple times, according to the fami-ly’s attorney, Donald Karpel.

CITYWIDE Butler, Bloom still leading 50th

Assemblywoman Betsy Butler (D-53) and Santa MonicaMayor Richard Bloom still hold the top two positions in theclose race for the 50th Assembly District seat as countyofficials continued totaling uncounted ballots Friday.

As of 4:30 p.m. Friday, Butler had 13,677 votes, leadingBloom’s 13,542 by 132.

Both are ahead of their fellow Democrat Torie Osborn,who slipped into fourth place behind Republican BradleyTorgan with 12,811 and 12,832 votes respectively.

Each of the four candidates have gained approximately1,000 new votes over the past three days, leaving percent-ages nearly unchanged, according to the Los AngelesCounty Registrar-Recorder/County Clerk’s Office.

County officials would not disclose how many ballotsremain to be counted in the 50th District as of Friday. OnThursday, however, that number was 13,465.

That leaves room for hope in such a close election.Osborn sent out an e-mail to her supporters Friday urg-

ing them not to throw their weight behind either Bloom orButler just yet.

“There is a possibility that, given the majority of theseballots were from last minute voting, my margin of 673could be made up,” Osborn said, continuing to say that itwas not “highly probable.”

Traffic detours Editor:

After reading the article about ending the free park-ing [in Downtown] Santa Monica, I realized that it willreally help relieve the traffic in Downtown (“No freeride in Santa Monica,” page 1, June 5).

I am a 30-year resident of Santa Monica and havealways appreciated the two hours of free parking.Although, these days I very rarely go to Downtown andthe Third Street Promenade because of the traffic andcongestion. The only time I do go Downtown is to buythe monthly regional commuter EZ Pass at the Big BlueBus office across from Santa Monica Place. And, I canstill park at Santa Monica Place for free. So, I am all forthe pay parking Downtown.

I was a part of the Third Street Promenade Planningand Development project. I thought it was wonderfulcommunity improvement and went there quite often inthe early days. But now, just like many Santa Monicaresidents, I avoid the place like the plague. When I seeprojects like the Miramar Hotel development, I see mycommunity being taken away from the residents moreand more. I sure hope the new project gets scaleddown.

A young, trapped, lost and scared mountain lion wasshot and killed by Santa Monica police (“Necropsy findsmountain lion died from gun shots,” page 1, June 8). Imyself am outraged at this action. The lethal force thatthe police took was in haste and could have been easi-ly avoided. Clearly this wild animal had not attackedanyone. No one’s safety was in peril. I would like to commend the Loews Hotel for haltingits tree and shrub pruning until October. [The otherday] I saw a massive pruning operation going on at theLoews. From May to October it is the nesting season forour wildlife. I called the hotel and told them my con-cern. Jamie Lemon, systems operation manager, gotback to me saying he will halt all pruning until October.

I hope all who read this letter will follow in the Loewsfootsteps. The animal and bird rescue shelters are nowfilled to overflowing with injured birds and other ani-mals due to pruning.

I wish our own city of Santa Monica would stop thepruning it carries on during these critical months.

If the vehicle has the rentalcompany name on the frame, that would bea good indicator that your vehicle is a rental.You also don’t want to have a large paper orsticker on the windshield of your vehiclewith the rental company name and vehicleinformation on it.

The reason for not wanting to have anobvious car rental is because they are fre-quently targeted by suspects who commitvehicle burglaries. Unfortunately, touristswho visit Santa Monica often leave items ofvalue in their car rentals.

The next suggestion I have is to make sureto lock your vehicle and to roll up all of yourwindows when you are not using it. Do notleave items of value in your vehicle, whethervisible or not. If you are driving to SantaMonica immediately upon arrival, makesure to leave your luggage at your hotel. Ifyou arrive too early and can’t check intoyour room, ask the hotel if you can leaveyour luggage at the front desk until they areready to check you in.

You also want to make sure not to leavepersonal information inside your vehicle.Secure all passports and or any type ofidentification with you or in a safe at yourhotel. Cell phones, purses and laptops arecommon items left visible in vehicles,which creates a high possibility that yourvehicle will be broken into. Although SantaMonica is a safe area to live and visit, byleaving valuables in your vehicle and/ornot locking it, you are opening up the pos-sibility of being victimized. You will findthat Santa Monica has a lot to offer andwonderful places to visit. Don’t put adamper on your vacation by becoming anunnecessary victim.

Q: As a tourist I find that parking in SantaMonica is confusing. At times there are mul-tiple signs on top of one another and I can’tseem to figure out if I am legally parked.What can I do?

A: Santa Monica is a busy city with manyvisitors on a daily basis. I am frequentlyflagged down by tourists who have the samequestion and want me to verify for themwhether they are legally parked or not. Somesuggestions I have is to make sure you readall the signs and not assume that becausethere are other vehicles parked next to youthat they are legally parked. If you happen tofind parking at a meter in front of or in closeproximity to a restaurant, make sure tocheck if the parking spot becomes a valet

zone at a particular hour. I have seen manytourists and visitors have their vehiclesimpounded because they did not realize thatafter a certain time their parking spot wasconverted into a valet zone.

If you are parking in a residential area,make sure to check if the area is by permitonly during specific hours. The signs on thestreet will indicate so. When parking in citylots that don’t require you to take a ticketbefore parking, make sure to look for theticket kiosk in the lot which requires you topay to park your vehicle. You can chose howlong you would like to park and it will tellyou the fee. These ticket kiosks can usuallybe found at the entrances of the lot andsometimes in the middle of the structure.

If it is out of order, I would recommendyou call the number indicated on themachine to inform them and have themcome out and fix it. If you just leave withoutpaying or contacting the company you riskbeing issued a citation. If all else fails or ifyou are uncertain, you can always ask a traf-fic service officer or call the parking office at(310) 458-8466.

BOSTON The longtime girlfriend of mobsterJames “Whitey” Bulger should spend 10years in prison because she knowingly pro-tected one of the region’s most violent crim-inals for more than 16 years, federal prose-cutors said Friday.

In a sentencing memo filed in U.S.District Court, prosecutors say CatherineGreig hid Bulger’s identity and handled thedaily tasks necessary for them to keep a low-profile in Santa Monica, Calif., where thecouple was captured last June while living ina rent-controlled apartment.

Bulger, now 82, is the former leader of thenotorious Winter Hill Gang and was also anFBI informant who provided informationon the rival New England Mafia. He ischarged with participating in 19 murdersand is awaiting trial.

Greig, 61, pleaded guilty in March tothree charges: conspiracy to harbor a fugi-tive, identity fraud and conspiracy to com-mit identity fraud. She admitted she usedaliases, unlawfully obtained identificationdocuments and repeatedly helped Bulger getprescription medication from a pharmacyby claiming to be his wife.

Although the charges carry a maximumof 15 years in prison, federal prosecutors hadwarned family members of the peopleBulger is accused of murdering that shecould get as little as 32 months under feder-al sentencing guidelines.

In their memo, prosecutors said Greigdeserves a much longer prison term and rec-ommended that she be fined $150,000.

“Greig’s conduct also did far more thanprotect Bulger from law enforcement. It alsodenied victims and family members of vic-tims for many years the opportunity to seeBulger answer for his alleged crimes,” prose-cutors wrote.

The brother of Debra Davis, a 26-year-old woman who prosecutors say was killed

by Bulger in 1981, said he thinks a 10-yearsentence for Greig is fair.

“She knew everything that had happenedwhen she got in the car with him. She choseto get in that passenger seat and go. Thereshouldn’t be any leniency,” Steve Davis said.

Greig’s lawyer, Kevin Reddington,declined to comment on the recommenda-tion from prosecutors and wouldn’t revealwhat sentence he will recommend.

“I’m going to leave it up to the judge,”Reddington said.

In their memo, prosecutors say Bulgerfled Boston in late 1994 after being warnedthat he was about to be indicted. They say heleft Boston with another girlfriend butreturned a couple of months later, droppedthat girlfriend off and picked up Greig.

Greig and Bulger traveled to Chicago,New York City and Grand Isle, La., duringthe first year they were on the run, posing asa married couple and using aliases. Theyarrived in Santa Monica in 1996, rented atwo-bedroom apartment and pretended tobe a married couple from Chicago, accord-ing to prosecutors.

While in Santa Monica, Greig paid thebills and the rent, usually in postal moneyorders or cash, and did all of the couple’sshopping while Bulger remained indoorsmost of the time, prosecutors said. She alsohelped him get medical and dental careand stayed by his side during several proce-dures.

Greig “was the key actor in the conspira-cy to protect Bulger from being discovered,”prosecutors say in their sentencing memo.

The couple was caught just days after theFBI began running a new public serviceannouncement focusing on Greig, a careful-ly groomed woman who was known to fre-quent beauty salons and dental offices.

Bulger had seen the announcement andtold Greig, “’This is it,’” prosecutors said.

Two days later, the couple was caughtafter a tipster reported meeting them inSanta Monica.

US seeks decade sentencefor ‘Whitey’ Bulger’s lover

ended in the selection of JacquelineSeabrooks, the former chief in Inglewood,Calif., but the document didn’t contain itscomments to that topic.

Instead, it provided a wide range ofsuggestions for the reorganization of thedepartment, including a role for non-sworn officers in the supervision of uni-formed personnel, a reexamination of apopular work schedule that gives officersmore days off and splitting the currentunion into three bargaining units insteadof one.

The suggestions are “food for thought”rather than a set path forward for thedepartment, said City Manager RodGould.

“It causes us to look at it in a differentway to promote the discussion,” Gouldsaid. “It’s always good in a time of transi-tion to have the department take a look atitself.”

Consultants spent days interviewing peo-ple from within the city government andpolice department as well as the generalpublic to get a sense of the structure andmake recommendations on what’s working,what isn’t and the qualities a new chiefwould have to have to be successful. That work as well as past experienceresulted in the suggestions, some of whichhave raised red flags for the union that rep-resents all sworn officers in the department,the Police Officers Association or POA.

SPLITTING THE UNION The consultants recommended the cre-

ation of an elected group called the“Officers’ Council” to meet with Seabrookson a regular basis to discuss “the state of thedepartment,” including current and futurepolicies and challenges.

The group would represent all rankswithin the department, and would play arole in developing and putting in place newpolicies and programs.

“What it’s recommending is what thePOA already does,” said Matthew Rice,spokesman for the union.

The group has a board composed of threesergeants, five officers and a lieutenant, andpart of the job is to meet with the chief ofpolice for all of the reasons listed in thereport.

“We didn’t understand why it was neces-sary, because it was repetitive,” Rice said.“None of our members are interested in hav-ing a second POA to do the work we wereelected to do. We don’t know where thatcame from.”

The report also plants the seed of split-ting the POA into different bargaining unitsto represent different ranks within thedepartment.

ICMA consultants believed that theunion could be divided into three pieces,one dealing with police officers, a secondwith sergeants and lieutenants and a thirdfor captains and above.

It’s not unheard of.The Los Angeles Police Department has

two such bargaining units, said Eric Rose, aspokesman for the Los Angeles PoliceProtective League.

That group represents 9,900 rank and filemembers, many times the size of the entireSMPD.

Furthermore, the Command OfficersAssociation, which represents management,has a “me too” clause in its agreements,meaning they get the same percentages andpay increases that the rank and file receive,Rose said.

Rice was puzzled by the ICMA’s approachto the bargaining units, calling it “curious.”

“From our perspective, we’re happy withwhat we have,” Rice said.

Gould didn’t jump on board with thesuggestion either.

“We already have 10 bargaining groups(to negotiate with),” Gould said. “Having 11or 12 doesn’t excite us.”

ISSUES OF CONCERNThe report also identified three areas of

concern brought up during the 35 inter-views conducted by consultants.

According to the report, the “most sensi-tive and critical issue” confronting theSMPD is youth engagement and violenceprevention, followed by homeless outreachand the impact of development on car andpedestrian traffic.

Youth violence snagged the headlines inthe beginning of 2012 when police had to getinvolved with a series of fights that eruptedout of Santa Monica High School duringschool hours, after classes let out and duringsporting events.

Ultimately, both the prospects for reor-ganization and the focus of the depart-ment depend on Seabrooks, who’s still get-ting her feet wet during her second weekon the job.

“The report will serve as reference mate-rial as I conduct my independent assessmentof the organization,” read a statementreleased by Seabrooks. “Once that assess-ment has been completed I will be workingwith the department’s executive leadershipand other key staff to implement any neededchanges and to refocus our attention onreducing crime and the fear of crime in thiscommunity.”

If a minimum of $29,000 is not in thebank account by that time, band camp willnot open and the students will not march atthe first home football game, she said.

In addition to performing at home foot-ball games, the Samohi Marching Band alsocompetes in field shows, recently placingthird in the 2011 Southern California fieldchampionships.

Currently, the account holds almost$28,000, though this amount does not reflectunpaid bills for uniform dry cleaning andthe districtwide Equity Fund, which collectsmoney from all student-instruction organi-zations and redistributes payments accord-ing to need. This year, the band contributednearly $7,000. For the upcoming year, theband is being asked to contribute about$4,000.

Though Samohi receives a large chunk ofthe redistributed funds — last year, theschool collected nearly $90,000 — the banddoes not reap the benefit, as the stated inten-tion of the fund is to reduce achievementgaps in math and science, said Robb Brown,co-president of the parents association.

Add to that the increasing cost of sheetmusic, instruments, the greater number of stu-dents interested in band and fewer donations,and the band’s financial situation becomesmore dire. Though the band raised $130,000 infundraising this year, it’s not enough.

“It’s important for people to understandthat the costs don’t change, and in somecases, go up,” Brown said. “The band pro-gram has a situation in which people haveless discretionary spending and less moneyto dedicate to things, and are having to makedifficult choices.”

Though the marching band is in the mostcritical financial straits, the concert bandalso faces an $11,000 deficit, while the jazzband expects to break even before July,Stewart said.

A few years ago, this kind of financial sit-uation was unthinkable. In 2009 and 2010,the Samohi band program received a com-bined $169,620 from the “rainy day fund,” asum of money that was left after the dis-banding of a previous Santa Monica bandparents association. Over the years, the fundwas used as a supplemental source of moneyto pay debts and correct any overspending,Stewart said. The association continued toapprove expenses because of the availabilityof funds, but didn’t pay close enough atten-tion to replace what they had taken, she said.

“In our defense, that money was intend-ed to contribute towards the musical educa-tion of Samohi students, and that’s exactlyhow it was used,” Stewart said, in an e-mail.

Some parents raised concerns about howrainy day funds were spent in the past, andhow these decisions may have affected theband’s current situation. With controversysurrounding the former band parents asso-ciation’s transparency and the huge amountof assets they held, it was surprising to seethe current band’s call for help, said MichaelChwe, a band parent.

However, he said he appreciated the newassociation’s transparency and willingness toexplain finances.

To make up the deficit and keep the bandafloat, the parents association voted on May21 to approve three measures. The first wasto ask the district for an exemption from the

Equity Fund, along with a refund of themoney paid into the fund this past year. Theparents association brought this request toThursday’s Board of Education meeting,though administrators could not commenton the measure because it was not an agen-da item. The association will await the dis-trict’s decision, Stewart said.

Though the district provided support inthe past, it no longer does so, said Jan Maez,assistant superintendent and chief financialofficer of the Santa Monica-Malibu UnifiedSchool District. She added that she wasunsure if an exemption would be the direc-tion the district would want to take, and thatthe district was considering changing theEquity Fund, which could occur in the nextone to two years.

“Their dilemma is not unlike the dilemmathe district is facing,” she said. “It’s a problemwe all have with how services to students arebeing funded all across the state.”

The parents association also passed amotion to stop paying the cost of trans-portation for students to play at home foot-ball games and up the fair share donationexpected of all band families from $450 to$600.

In spite of the added expense, some par-ents, like Birgit Roberts, are willing to paythe price.

“The bottom line is that we have nomoney, and we all want to make this workand move forward,” she said. “It would besuch a shame if (the band) went away — it’ssuch a jewel in Samohi’s crown.”

Alternative options for funding includegrants or foundations, though some parentshave already committed to donating extrasums, Roberts said. A direct donation cam-paign is also in progress through a form onthe band’s website, Stewart said.

In the meantime, Stewart said she hopesto find 20 parents who are committed to pay-ing the new fair share donation before Aug. 6,resulting in a sum of $12,000. Already, shesaid she believes parents will contribute$10,000 of donation money before bandcamp. This would put them on track to openthe camp in the summer, prompting therelease of the registration forms.

Though it’s not everything, it puts themcloser to the goal — Stewart thinks they cando it.

with their hard-earned cash, as well as keep-ing lines of communication open with par-ent groups who are expected to fundraise as-usual until July 2013.

The district also needs a consistent wayof recognizing big donors, either with signs,naming rights or other forms of acknowl-edgment so that people feel inspired togive.

The ultimate goal isn’t to redistributemoney that the foundation is already capa-ble of attracting, it’s to increase the amountavailable through superior fundraising,Lanning said.

“I’m not here to advise you how torearrange the furniture,” Lanning said. “Ithas to be about developing new dollars.”

That goal still means that all the playersin the district need to be “rowing in the samedirection,” Lanning said.

That’s been a struggle in the district,which was very divided over the topic of dis-trictwide fundraising.

Parents at schools that traditionally bring inmore money — up to $2,100 per student at thehighest — objected the most loudly, accusingthe district of making each school equallymediocre rather than improving the fundrais-ing abilities of schools that bring in less.

Those politics are still alive and well,Lanning said.

“There’s not enough talk going on witheach other,” he said. “There’s lots of talkgoing on period, and I’ve heard it all, but notwith each other.”

Parents and district employees thatworked on the Superintendent’s Advisory

Group, a coalition responsible for fleshingout various parts of the districtwidefundraising policy, stressed communicationas well.

That will be particularly important in thecoming year where the EducationFoundation and parent groups will befundraising simultaneously so that the foun-dation will have money for salaries readyand waiting when the transition takes placein 2013.

Changes will roll out quickly, saidSuperintendent Sandra Lyon.

By the end of the 2012-13 school year, theadvisory group will have worked out a donoracknowledgment program for the board toreview, as well as a definition for what kindsof classes, staff or programs the foundation’smoney will pay for.

In 2013 and 2014, the district hopes tohave the centralized fundraising piece of thepuzzle underway, at which point the adviso-ry group will divvy up the money raised inthe previous year.

By June 30, 2014, all staff whose salariescurrently rely on parent gifts will beswitched over to the centralized fundraising.

“Then we’re there,” Lyon said. “From the2014-15 school year and beyond it’s fullyimplemented.”

Although some board members seemedto hope for more detail, they all seemedtaken by the can-do spirit and enthusiasm ofthe presenters.

The topic will return to the board inAugust with more policies and an officialcontract with the Education Foundation forthe work.

Karpel said his client has not returned tothe classroom and has been completingcoursework in the school’s library.

“She has been humiliated and devastat-ed,” Karpel said. “She’s in therapy for post-traumatic stress.”

Karpel said he has a letter from Gonzalezapologizing for the incident.

“I want to tell you how truly sorry I am,”the letter says. “My intention was never tohurt you or embarrass you. Rather, I was try-ing to reach out to you and help you focuson your school work and motivate you.

“Even though I thought my intentions werehonorable, they did not come out that way andfor that I am so very sorry. Please know that Ifeel terrible about causing you pain and wouldlike the opportunity to make it right.”

Lyon said the teacher, who has not beenidentified by district officials, was removed

from the classroom for a few days whileadministrators conducted an internal inves-tigation. She is now back in the classroom.

The results of the internal investigation,which Lyon would not disclose per districtpolicy, have been given to the sheriff ’sSpecial Victims Unit, which is looking intothe allegations.

The president of the Santa Monicabranch of the NAACP called on the districtto suspend the teacher indefinitely. Evans isAfrican American.

Lyon said race is not a factor.“There was no racial intent or motivation

on the part of the teacher,” she said.In an interview with KLTA News, Evans

said she did not want to report the incidentat first, but a bus driver told her to speak up.

“I tried to convince myself that I wasoverreacting and part of me had felt guilty,”Evans told the television station.

“Then I was like, ‘You can’t be in denialabout your feelings.’ Like, I was genuinelyoffended and I felt hurt and embarrassed.”

“We’ve encroached on the wildlife,” saidMadeline Bernstein, president of the Societyfor the Prevention of Cruelty to Animals LosAngeles. “They’ve had to cope with less andless hunting grounds … we should at leastrealize we’ve done that and respect our dif-ferences and learn how to coexist.”

Police said on May 22 at approximately5:45 a.m. they received reports of a moun-tain lion roaming Downtown. A short timelater, a janitor at an office building at 1227Second Street, where Emeritus College class-es are held, saw the lion resting inside acourtyard and called police.

Officers closed the surrounding streetsand sidewalks, however, several people begancongregating outside the perimeter, raisingconcerns that the lion could escape the court-yard and harm onlookers, police said.

“I think the reality is that once thismountain lion came into Santa Monica, hepretty much sealed his fate,” said SeanAnderson, associate professor and directorof the Pacific Institute for RestorationEcology at Cal State Channel Islands, whowill be part of the June meeting. “But if youhave someone who knows what they’redoing, there’s a much higher chance of anes-thetizing it.”

Officials with Fish and Game, which istasked with handling reports of wildlife,were contacted and responded to the scene.Santa Monica Animal Control officers, firefighters and a National Park Service moun-

tain lion biologist assisted. The incident last-ed approximately 3 1/2 hours, according tothe press release.

It was determined by authorities that thebest way to handle the situation was tosedate the male mountain lion so that itcould be captured and released in the SantaMonica Mountains.

Fish and Game used a tranquilizer dart tosedate the lion. The lion immediatelybecame aggressive, police said, and lookedfor an avenue of escape. It charged and shat-tered one of the glass doors at the court-yard’s entryway and leaped “effortlessly”over large planters within the courtyard as itsearched for an escape route.

Contrary to what some media outletsreported at the time of the shooting, the lionwas not hit with water. Fire fighters usedhoses to spray the glass doors to the court-yard in an attempt to make them lookopaque to deter the lion from trying to runthrough or jump over the approximately 8-foot tall doors.

“The lion was not hit with water from thefire hoses,” according to the press release.

Pepper balls the size of paintballs werefired into the ground in an attempt to keepthe lion from running out of the courtyard.The goal was to keep the lion contained untilthe tranquilizer could take effect. The lioncontinued to try and escape.

“Because of the threat to public safetycaused by the lion’s continuous efforts toescape, the determination was made to usedeadly force,” the press release stated.

The lion died at the scene. The necropsywas performed by California Animal Healthand Food Safety Laboratory System in SanBernardino, Calif.

The full necropsy report has not yet beenreleased by the lab.

rent.But, it is never a good idea to withhold rent. If a tenantdoes not pay the full rent,when due, the landlord would mostlikely serve the tenant with a three day notice to pay or quit.Once a three day notice to pay or quit expires, the landlorddoes not have to accept the money even if the tenant offersthe full amount.The landlord can refuse the payment and pro-ceed with an unlawful detainer action (eviction case).

An unlawful detainer action is very stressful.Also, the tenantwould have the expense of litigation costs and probably attor-ney fees.A tenant does not have to retain an attorney todefend an unlawful detainer action,but it would be very wiseto do so.

If a tenant loses an unlawful detainer case, the tenant wouldbe evicted and owe all of the back rent and possibly the land-lord’s attorney fees and litigation costs.Further, the unlawfuldetainer judgment would probably appear on the tenant’scredit reports as well as reports kept by landlord agencieswhich could make it difficult to rent a new home in thefuture.

For all of the above reasons,a tenant should never withholdany rent.

GIVEE LANDLORDD AA LISTT INN WRITINGThe first thing a tenant should do is give the landlord a list in

writing of items which need to be repaired.The list should behand-delivered or mailed to the landlord.The tenant must keepa copy of that list and keep track of when and how the listwas delivered to the landlord (the specific date when the listwas mailed or hand-delivered).

A tenant must give the landlord a reasonable period to makerepairs.What is a “reasonable period”is defined on a case bycase basis.Usually,a tenant should give the landlord 30 days tomake repairs.But, if the condition is serious (i.e.:no electricity,no hot water,hole in the roof),a reasonable time would bemuch shorter.

A tenant should list all items which need repair, in detail.Failure to notify the landlord of a specific problem may pre-vent a tenant from being compensated later for the defectivecondition.

CONTACTT GOVERNMENTT INSPECTORSIf the landlord does not make the repairs within a

reasonable period, the tenant should contactappropriate government inspectors.

In Santa Monica, the first office to be contact-ed should be the Santa Monica CodeCompliance Department: (310) 458-4984.The Code Compliance Department will notcome to a rental unit to perform a generalinspection.The tenant must have a specific listof items which need repair.

In addition to the Code Compliance

Department,a tenant should call the County of Los AngelesDepartment of Health Services.To arrange for an inspection,aSanta Monica tenant would call: (310) 665-8484.

The advantage of government inspectors is that the govern-ment agency may order the landlord to make repairs.Also, ifthe tenant is in trial with the landlord (or a hearing with theSanta Monica Rent Control Board), the government inspectors’reports may be admissible as evidence.

PETITIONN FORR RENTT DECREASEE If the landlord does not make the required repairs, a tenant

may file a petition for rent decrease.The petition is filedwith the Santa Monica Rent Control Board, located in SantaMonica City Hall, 1685 Main Street, Room 202, Santa Monica,CA 90401; (310) 458-8751.The petition for rent decreasemay be filed 30 to 180 days after service of the writtennotice to the landlord of items which need repair.

If the petition is granted, the rent will be reduced.But, therent reduction is prospective (from that point forward).TheRent Control Board does not have the authority to award anymoney to compensate the tenant for past conditions orreduced services.

SMALLL CLAIMSS COURTT If a tenant wishes to be compensated for the defective condi-

tions or reduced services in the past, the tenant would have tofile a lawsuit.A suit could be filed in superior court.Althoughan attorney is not required for superior court, it is likely thatthe landlord would retain an attorney.When one party has anattorney and the other does not, it is a big advantage. If the ten-ant retains an attorney, the expenses might make such a suit insuperior court impractical.

Usually, the most economical way to proceed is to file a law-suit in small claims court.A person can sue in small claimscourt for up to $7,500.00.And,there are no attorneys in smallclaims court.Thus, the expenses are greatly reduced.

CONSULTT WITHH ANN ATTORNEYEven if the tenant is not going to retain an attorney on a full-

time basis, it is usually a good idea to at least have a consulta-tion with a tenants’ rights attorney,especially before filing suitin small claims court or filing a petition for rent decrease.

JUNEAU, Alaska More than a year after a tsunami devastat-ed Japan, killing thousands of people and washing millionsof tons of debris into the Pacific Ocean, the U.S. governmentand West Coast states don’t have a cohesive plan for cleaningup the rubble that floats to American shores.

There is also no firm handle yet on just what to expect.The Japanese government estimates that 1.5 million tons

of debris is floating in the ocean from the catastrophe. Someexperts in the United States think the bulk of that trash willnever reach shore, while others fear a massive, slowly-unfolding environmental disaster.

“I think this is far worse than any oil spill that we’ve ever facedon the West Coast or any other environmental disaster we’vefaced on the West Coast” in terms of the debris’ weight, type andgeographic scope, said Chris Pallister, president of a group ded-icated to cleaning marine debris from the Alaska coastline.

David Kennedy, assistant administrator for the NationalOceanic and Atmospheric Administration’s National OceanService, told a U.S. Senate panel last month that in mostcases debris removal decisions will fall to individual states.Funding hasn’t been determined.

U.S. Sen. Mark Begich, D-Alaska, and other West Coastpolitical leaders, have called that scenario unacceptable, say-ing tsunami debris poses a pending national emergency. “Ifthis was a one-time event all at once, we’d declare it an emer-gency and we’d be on the ground like that,” he said, duringthe hearing he led.

One astonishing example of how the unexpected can sud-denly appear occurred Wednesday in Oregon when a con-crete and metal dock that measured 66 feet long, seven feettall and 19 feet wide, washed ashore a mile north ofNewport. A Japanese consulate official in Portland con-firmed that the dock came from the northern Japanese cityof Misawa, cut loose in the tsunami of March 11, 2011.

“I think that the dock is a forerunner of all the heavierstuff that’s coming later, and amongst that heavier stuff aregoing to be a lot of drums full of chemicals that we won’t beable to identify,” Pallister said.

His group, Gulf of Alaska Keeper, works in the same regiondevastated by the Exxon Valdez oil spill, which dumped 11million gallons of oil into Prince William Sound in 1989.

Tsunami debris is tough to monitor. Winds and ocean cur-rents regularly change, while rubbish can break up. Some trash,like fishing gear, kerosene and gas containers and building sup-plies, can be tied to the tsunami only anecdotally. But in othercases — a soccer ball and a derelict fishing boat in Alaska anda motorcycle in British Columbia, for example — items havebeen traced back to the disaster through their owners.

NOAA projects the debris having spread over an area rough-ly three times the size of the contiguous United States, but can’tpinpoint when or how much might eventually reach the coastsof Alaska, Washington, Oregon, California and Hawaii.

An independent group of scientists and environmentalactivists are scheduled to sail aboard the “Sea Dragon” fromJapan Saturday to an area north of the Hawaiian islands, withplans to zigzag through the debris, document what’s floatingand try to determine what might reach the West Coast.

“You have a unique experiment,” said Marcus Eriksen, aresearcher at the Algalita Marine Research Institute in LongBeach, Calif., who is leading the expedition. “You have entirehomes and all their contents ... anything you may find in aJapanese home could be floating in the ocean still intact.”

Seattle-based oceanographer Curtis Ebbesmeyer, who hasbeen tracking ocean trash for 20 years, predicts the mainmass of tsunami debris will reach the U.S. coast fromNorthern California to southeast Alaska as early as October,with the beginning of fall storms.

Cleanup plans should be finalized no later thanSeptember, Ebbesmeyer cautioned. There may also be sensi-tive issues to be decided, he said, including how to deal withany human remains or personal mementos.

But just who will clean up the debris and who will pay forit hasn’t been fully determined.

Begich wants to make at least $45 million available forlocal community groups to conduct clean-up efforts. Gulf ofAlaska Keeper believes Congress should set aside $50 milliona year for four years.

As it stands now, NOAA has $618,000 allocated to cleanup tsunami debris. The agency’s total marine debris pro-gram budget could drop by 26 percent to $3.4 million, underPresident Obama’s proposed budget.

Marine trash isn’t a new problem. The ocean is littered

with all kinds of things that can trap and kill wildlife, hurthuman health and navigation and blight beaches.

NOAA has previously given grants to local groups forcleanup work. The agency expects the tsunami debris to sim-ply add to the ongoing problem of massive amounts of trashflowing into the ocean every day.

Volunteers in California report their efforts beingstretched thin just in dealing with day-to-day rubbish.Seasonal opportunity for cleanup could close as early asSeptember at spots in Alaska, where some beaches are acces-sible only by boat or aircraft and removing trash can be dif-ficult and expensive. Washington has monitored someincoming debris for radioactivity.

Eben Schwartz, marine debris program manager for theCalifornia Coastal Commission, said more recognitionneeds to be given to the fact that it will be beach cleanup vol-

unteers who respond to tsunami debris.“Given that, I would like to see more state and federal

support for the volunteer programs that will be taking thelead,” he said. They’re going to need help, resources andfunding, he said.

NOAA’s marine debris program expects solid plans from thestates within the next few months. The governors of Washington,Oregon and California, as well as the premier of BritishColumbia, have said they will work together to manage debris.

Widespread or concentrated die-offs of marine animalsaren’t expected, said John Hocevar, oceans campaign direc-tor for Greenpeace, but there could be local impacts.

power plant in Fukushima.Merrick Burden, executive director of the Marine

Conservation Alliance in Alaska and Washington, said hethinks states, local governments, volunteers and industriesincluding fishing and tourism need to pull together to cleanup debris, and not simply wait and hope for federal funds.

“One of the things standing in the way is a unified, coor-dinated approach to this,” he said.

Pallister worried that a lack of awareness may hamper theeffort.

“You just don’t have that visceral, gut-wrenching reactionto having oiled otters and drowned seabirds in that crude toget the public pumped up about it,” he said of the tsunamidebris. “And even if you could get the public pumped up,again, you don’t have that culprit to go after — a bad guy. It’skind of a tough one to deal with.”

NEW YORK First responders and residents who were strick-en with cancer after being exposed to the toxic ash thatexploded over Manhattan when the World Trade Center col-lapsed would qualify for free treatment of the disease andpotentially hefty compensation payments under a rule pro-posed Friday by federal health officials.

After months of study, the National Institute forOccupational Safety and Health said in an administrative fil-ing that it favored a major expansion of an existing $4.3 bil-lion 9/11 health program to include people with 50 types ofcancer, covering 14 broad categories of the disease.

People with any of the cancers on the list could qualify fortreatments and payments as long as they and their doctors makea plausible case that the disease was connected to the caustic dust.

The decision followed years of emotional lobbying byconstruction workers, firefighters, police officers, officecleaners, and many other people who fell ill in the decadeafter the terror attack, and were sure it had something to dowith the many days they spent toiling in the gray soot.

“It’s amazing,”said Ernie Vallebuona, a former New York Citypolice detective who retired after being diagnosed with lym-phoma in 2004. “It’s nice to have the federal government recog-nize that your cancer was caused by ground zero. It’s somethingwe’ve always known. I’m just ecstatic that we are finally beingrecognized. You almost felt like you were being brushed aside.”

NIOSH, which oversees the 9/11 health program, acted afteran advisory committee made up of doctors, union officials andcommunity advocates recommended that cancer be added tothe list of covered conditions. Previously, the aid effort has onlycovered people with mostly less-serious ailments, includingasthma, acid reflux disease and chronic sinus irritation.

The decision on whether to add cancer to that list is a dif-ficult one, and there are still substantial questions about howthe program will function.

While stories about first responders struck by cancer arecommon, there is still little scientific evidence of elevatedcancer rates connected to either the trade center dust orother toxins at the ground zero recovery site.

Cancer experts also say that it usually takes many yearsfor an environmental exposure to lead to a cancer case, dueto the slow, undetectable development of many types of thedisease. That means that many of the people falling ill withcancer now, or in the past 10 years, are unlikely to have got-ten it as a result of the attacks.

Questions about whether the dust truly caused cancerwas one of the reasons why Congress did not include it in theinitial list of covered illnesses.

But some occupational health experts have expressed con-cern about the presence of carcinogens in the ash and soot,and the advisory panel said it believed there were enough tox-ins to create a risk. NIOSH director Dr. John Howard said ina statement that the agency had embraced all of the recom-mendations of the advisory panel, which had urged inclusionof a majority of the most common forms of cancer.

“We recognize how personal the issue of cancer and all ofthe health conditions related to the World Trade Centertragedy are to 9/11 responders, survivors and their lovedones,” Howard said.

The expansion proposal isn’t final yet. The rule will beopen for public comment for several weeks, or up to twomonths, before being finalized. It will still be open to revi-sions, or even outright abandonment, during that time.

U.S. Reps. Carolyn Maloney, Jerrold Nadler and PeterKing, three New York lawmakers who helped create the lawcreating the health program, then lobbied hard for its expan-sion, said in a joint statement that they were “thrilled,” andconfident the change would go through as planned.

“As we have all seen with our own eyes again and again,cancer incidence among responders and survivors is a tragicfact, and we must continue to do everything we can to providethe help that those who are sick need and deserve,” they said.

There has been some concern that adding cancer to thelist of covered conditions could put a severe financial strainon the program’s limited resources. Congress capped fund-ing for the program at $1.55 billion for treatment and $2.78billion for compensation payments. Those amounts willremain unchanged even if many people file for benefits.

Some 60,000 people have already enrolled in 9/11 health pro-grams for those who lived or worked within the disaster zone.Up to 25,000 more could still join before the program closes.

Even before the proposal to add cancer, it is unclear whetherthe amount of money allocated would be enough to cover thecompensation claims. Sheila Birnbaum, the special master over-seeing applications for compensation, has said she might have toprorate payments based on the number of people who apply.

Backers of the program are already talking about gettingmore funding, and also extending the program, which is setto expire in 4 1/2 years.

“Next, we need to start working to extend the VictimsCompensation Fund past its current end point in 2016 inorder to ensure that responders and survivors who developthese cancers after that will be able to receive compensation,”said the joint statement by Maloney, Nadler and King.

Noah Kushlefsky, an attorney who represents about 3,800people who plan to enroll in the program, said he was confi-dent Congress will eventually extend the program.

“This is a huge victory on many levels. This gives themmuch needed health care. It gives them much needed finan-cial assistance ... I think that it means a lot emotionally aswell,” he said. “These folks needed to know that everybodyrecognized what they did, and what they are going through.”

FROM THE MOMENT YOU WALK IN THEdoor to the seemingly unpretentious littlerestaurant Sushi Zo, located in a shoppingmall near a Vons in Palms, you know you arein for a singular sushi experience.

From the exterior, however, one wouldnever realize that such an unassuming spotserves up the very finest and freshest fish inall of Los Angeles.

This Michelin-starred restaurant, with itshighly attentive, quality service, is a bit like aJapanese Zen temple in the seriousness withwhich the itamae san (sushi chefs) regardthe art of serving only the very best seafoodto an enthusiastic, yet very reverent follow-ing of hard-core sushi aficionados whocrowd the place nightly. And at approxi-mately $200 or more per head with drinks,this is no small feat.

The absolutely exquisite meal begins herewith a small bowl of miso soup. The remark-able quality of the dashi, or fish stock, iswhat sets Sushi Zo’s soup apart from theordinary run-of-the-mill.

Next comes a small, premium qualityKumamoto oyster from Washington state,served with a perfect ponzu sauce accompa-niment in the shell. To describe this openeras merely excellent would not do justice tothe chefs.

Then the reticent (and somewhat surly,until you get on his good side) owner-chefquietly dishes out the stuff that any realsushi hand knows to be the heart and soulof a true sushi experience: the blue-fintuna. Sushi Zo’s generous plate of theakami, or red meat blue-fin tuna, hailedfrom the East Coast, near Boston, and wasserved sashimi style, already seasoned withsoy sauce.

Next came another sashimi delight ofsuper fresh California awabi (abalone) deli-cately draped in a yuzu (Japanese citrus) seasalt and served sliced in the shell.Remarkably extravagant by anyone’s stan-dards, this hallmark of the Japanese sushiexperience also impressed.

The next fish was a super fresh, trulygreat piece of halibut (hirame) with lemonand salt. The chef tells you not to add soysauce (an instruction that will become veryfamiliar as the night progresses), partiallybecause of the range of highly refined sea-sonings that the itamae san add before serv-ing the fish. Another characteristic pointabout the halibut and all the pieces of fishwas the small size of the neta, or fish itself,and the paucity of shari (sushi rice) uponwhich the fish rest. While this could putsome big eaters off, actually this is a realplus. The quality-over-quantity philosophyof Sushi Zo is one the best things about theplace.

And because they only serve one piece ofeach kind of fish instead of the traditionaltwo pieces, it allows the customers to enjoy awider range of seafood. Indeed, the sheervariety of seafood one enjoys here is incred-ible.

After the hirame came a wonderful, richpiece of ankimo (monkfish liver) withponzu sauce, which was so fresh it almostseemed like another dish when comparedwith the usual fare one gets at a lesserestablishment. Then another deliciouspiece of shiromaguro (albacore), interest-ingly seasoned with an ponzu sauce thatincluded a hint of orange. Out of thisworld.

After all these amazing pieces (there’smore, but better to let you be surprised), one

would imagine the meal might be windingdown. Not at Sushi Zo. More delectablesushi delights would follow, such as a divinepiece of cod served with warm vinegaredmiso sauce, a great black snapper seasonedwith truffle salt, a wonderful piece of yellow-tail from Japan, squid superbly seasonedwith ginger, a superior piece of crunchygiant clam served with sea salt, a sweetshrimp from Santa Barbara that was practi-cally a religious experience to eat it was sogood, and a piece of sea perch from Japanthat is rarely seen at other Japanese restau-rants.

To finish off this incredible feast, thesushi chef served up a spectacular mediumfatty tuna roll, also seasoned lightly withvinegar, as well as a sweet egg that was a niceway to end the perfect meal.

I cannot recommend Sushi Zo highlyenough. After visiting the restaurant fourtimes over the last couple of months, I ambeginning to think if I can afford $200 fordinner, I might not bother going to anyother sushi restaurants in town. Just don’texpect too much friendly banter with yoursushi chef when you go; these guys are allabout the fish, don t particularly like smalltalk, and really mean business when it comesto serving you only the very best fresh fishpossible.

BEIRUT U.N. observers could smell the stench of burnedcorpses Friday and saw body parts scattered around a Syrianfarming hamlet that was the scene of a massacre this week inwhich nearly 80 men, women and children were reported slain.

The observers were finally able to get inside the desertedvillage of Mazraat al-Qubair after being blocked by govern-ment troops and residents, and coming under small armsfire Thursday, a day after the slayings were first reported.

In central Damascus, rebels brazenly battled governmentsecurity forces in the heart of the capital Friday for the firsttime, witnesses said, and explosions echoed for hours.Government artillery repeatedly pounded the central city ofHoms and troops tried to storm it from three sides.

U.S. Secretary of State Hillary Rodham Clinton met withinternational envoy Kofi Annan in Washington to discusshow to salvage his faltering plan to end 15 months of blood-shed in Syria. Western nations blame President Bashar Assadfor the violent crackdown on anti-government protests thatgrew out of the Arab Spring.

The U.N. team was the first independent group to arrivein Mazraat al-Qubair, a village of about 160 people in cen-tral Hama province. Opposition activists and Syrian govern-ment officials blamed each other for the killings and differedabout the number of dead.

Activists said that up to 78 people, including women andchildren, were shot, hacked and burned to death, saying pro-government militiamen known as “shabiha” were responsi-ble. A government statement on the state-run news agencySANA said “an armed terrorist group” killed nine womenand children before Hama authorities were called and killedthe attackers.

Sausan Ghosheh, spokeswoman for the U.N. observers,said residents’ accounts of the mass killing were “conflict-ing,” and that they needed to cross check the names of themissing and dead with those supplied by nearby villagers.Mazraat al-Qubair itself was “empty of the local inhabi-tants,” she said.

“You can smell the burnt smell of the dead bodies,”Ghosheh said. “You could also see body parts in and aroundthe village.”

Ghosheh said she saw two homes damaged by shells andbullets. She spoke of burned bodies found in a house, butdid not elaborate and was not clear whether the U.N. teamsaw them.

She told the BBC:“We can say that there was definitely a hor-rific crime that was committed. The scale is still not clear to me.”

A BBC correspondent traveling with the U.N. observersdescribed the hamlet as an “appalling scene” of burned-outhouses and gore.

“There are pieces of human flesh lying around the room,there is a big pile of congealed blood in the corner, there’s atablecloth that still has the pieces of someone’s brainattached to the side of it,” said the correspondent, PaulDanahar.

“They killed the people, they killed the livestock, they leftnothing in the village alive,” he added.

The U.N. observers also visited a cemetery where some of thedead were buried, according to an activist in Mazraat al-Qubair.

Activists said the Sunni hamlet is surrounded by Alawite vil-lages. Alawites are an offshoot of Shiite Islam and Assad is amember of the sect,while the opposition is dominated by Sunnis.

The United States condemned Assad over the killings,saying he has “doubled down on his brutality and duplicity.”

The violence followed another mass killing last month ina string of villages known as Houla, where 100 peopleincluding many women and children were also shot andstabbed to death. The opposition and the regime blamedeach other for the Houla massacre.

In April, the U.N. said more than 9,000 people have beenkilled since the crisis began in March 2011, but it has beenunable to update its estimate since and the daily bloodshedhas continued in past weeks. Activists put the number ofdead at about 13,000.

Before her meeting with Annan, Clinton said they wouldlook at “how to engender greater response by the govern-ment of Syria to the six-point plan that he has put forth.”

Annan’s plan calls for an end to violence followed by apolitical transition. Although Assad agreed to it, the violencehas continued unabated with reports of brutal massacresagainst innocents.

Annan allowed that some people “say the plan is definite-ly dead.” He asked rhetorically whether the problem is theplan or its implementation.

“If it’s implementation, how do we get action on that?

And if it’s the plan, what other options do we have?” he said.U.N. diplomats say Annan is proposing that world pow-

ers and key regional players, including Iran, come up with anew strategy to end the conflict.

In Damascus, government troops clashed with defectorsfrom the Free Syrian Army in the Kfar Souseh district insome of the worst fighting yet in the capital. The clashes werea clear sign that the ragtag rebel group has succeeded in tak-ing its fight into the regime’s base of power.

“I’ve been hearing shooting and explosions for hoursnow and can see smoke rising from the area,” a witness whospoke on condition of anonymity for security concerns toldThe Associated Press.

On Thursday night, armed rebels took part in a largeanti-government rally in the same district, witnesses said, ina rare and bold public appearance by the fighters in the cap-ital. Friday’s fighting began when the rebels attacked a gov-ernment checkpoint in the morning, according to RamiAbdul-Rahman of the Britain-based Syrian Observatory forHuman Rights.

“The men are shouting ‘God is great,’ women are crying,”said Omar, a Damascus resident who would not provide hisfamily name for fear of reprisal by Syrian officials. Thesound of machine gun fire and blasts could be heard in thebackground as he spoke by Skype.

A resident of the Damascus neighborhood of Qabounsaid the battles began in his area after Syrian forces openedfire on an evening demonstration, killing a young man heidentified as Mahmoud Said. Following that, gunmen hidingin the area began clashing with security forces. Nobody wassure how many people were killed, because they could notleave their houses, said the resident, who asked not to beidentified because he feared government reprisal.

The Observatory and another activist group, the LocalCoordination Committees, said clashes also broke out inother Damascus districts. There was no immediate word oncivilian casualties but the LCC said three rebels were killed.

In Homs, one of the main battlegrounds of the uprising,the offensive against Khaldiyeh appeared to be a new pushby regime forces to retake the enclave that has been held byrebels for months.

Pro-Assad troops overran the opposition-held neighbor-hood of Baba Amr on March 1 after a government siegekilled hundreds of people — many of them civilians — inSyria’s third-largest city.

Activist Tarek Badrakhan said regime troops were tryingto advance on Khaldiyeh from three sides, battling withrebels trying to stop them.

“This is the worst shelling we’ve had since the start of therevolution,” he said via Skype. A shell could be heard explod-ing in the background as he spoke.

Shells were hitting the neighborhood at a rate of five to 10a minute, said a statement by the Observatory.

There was no immediate word on casualties fromKhaldiyeh, whose original 80,000 inhabitants have mostly fled.

Amateur videos showed missiles exploding into balls offlames in the crowded concrete jumble of homes, with thun-dering crashes that sent up plumes of heavy gray smoke. Thevideos suggested the attack began at dawn as birds chirpedand roosters crowed. In one video, the missiles came in rapidsuccession, four exploding in less than a minute.

Homs has been one of the hardest-hit regions in Syriasince the uprising began.

The government news agency reported troops on theeastern Lebanese border area clashed with rebels, who theysaid were trying to smuggle in three pick-up trucks full ofweapons. The agency said they destroyed one car, but twosped back into Lebanon

In several locations across Syria on Friday, troops firedtear gas and live ammunition in an attempt to disperse thou-sands of anti-government protesters, activists said, includingthe northern provinces of Idlib and Aleppo, the southernregion of Daraa and in the suburbs of Damascus. Severalpeople were reported killed, but the numbers were notimmediately clear.

In Geneva, International Committee of the Red Crossspokesman Hicham Hassan said Syria’s humanitarian situa-tion was worsening. And Kristalina Georgieva, Europeancommissioner for humanitarian aid, said in Brussels thatthere are 1 million “vulnerable people who need humanitar-ian assistance.”

“Between 200,000 and 400,000 are internally displaced ...and we have 95,000 refugees in Turkey, Lebanon and Jordanprimarily,” she said.

Also on Friday, the Committee to Protect Journalists saidfive citizen journalists documenting the unrest in Syria werekilled in a two-day period at the end of May.

NEW YORK The Triple Crown curse lives.This time the horse didn’t even make it tothe starting gate.

I’ll Have Another’s bid for the first TripleCrown in 34 years ended stunningly Fridaywhen the chestnut colt was retired on the eveof the Belmont Stakes with an injury to hisleft front tendon.

“I’m afraid history is going to have towait for another day,” said J. Paul Reddam,the colt’s owner.

I’ll Have Another, who won the KentuckyDerby and the Preakness Stakes with stirringstretch drives, was the 4-5 early favorite to winthe Belmont and become the 12th TripleCrown winner and first since Affirmed in 1978.

Instead, he’ll make one final trip to theracetrack with his jockey Mario Gutierrez tolead the other Belmont horses duringSaturday’s post parade — no longer a prel-ude to greatness, but merely a wistfulfarewell.

“He’ll be my hero forever,” a somberGutierrez said. “What I’ll Have Another didfor me is so amazing. He brought happinessto my life.”

Always the longest and toughest of theTriple Crown events, the 1 1-2-mile Belmontwas instantly reduced to being just anotherbig race.

The favorite’s role fell to Dullahan, whoran third in the Derby and had been secondin the morning line for the Belmont. He wasmade the 9-5 early choice.

Santa Monica-based trainer DougO’Neill said I’ll Have Another was beingretired because he developed swelling in hisleft front tendon that was the beginning oftendinitis.

“This is extremely tough for all of us. It’sfar from tragic but it’s extremely disappoint-ing,” he said.

O’Neill’s brother, Dennis, said it was hardto tell anything was wrong just by looking atthe horse.

“He looks great. He’s sound. He wentgreat this morning. He looks super (but) youjust can’t take a chance,” he said. “He’s toovaluable of a horse and we love him to deathlike all of them. You wouldn’t run a horse ifyou think something might happen.”

The scratch comes a day before an estimat-ed 100,000 fans were expected to converge onthe track in hopes of seeing, at long last, a TripleCrown winner — a champion who would helpresurrect a struggling racing industry.

I’ll Have Another joined 11 other horsessince Affirmed who won the Derby and thePreakness, but were unable to complete aTriple Crown sweep in the Belmont, extend-ing the longest gap between Triple winnersto 35 years. The colt also became the thirdwinner of the first two legs who was unableto run in the finale; Burgoo King in 1932 andBold Venture in 1936 were the others.

“It’s like completely letting the air out ofa balloon,” said Ken McPeek, who trainsBelmont contenders Atigun andUnstoppable U.

Dale Romans, who trains Dullahan, said:“This was going to be a special race, one ofthe biggest races of our time. I’d rather havehim in there. It would have been somethingspecial to beat him.”

Doug O’Neill said he first noticed some-thing might be wrong with the colt Thursday,hours after his usual morning gallop.

“We prayed he kind of hit himself andthat it was a little bit of skin irritation,” hetold a horde of media gathered outside thedetention barn at Belmont Park.

O’Neill had called an audible Friday andtaken his horse out to gallop at 5:30 a.m.,three hours earlier than he had been work-ing out in the days leading up to the race. Hewanted to avoid the congestion created by allthe Belmont horses going to the track at thesame time.

“I thought he looked great on the track,”he said, “and then cooling out, you could tellthat swelling was back, and at that point Ididn’t feel very good.”

A veterinarian confirmed the diagnosisand suggested that O’Neill give the colt threeto six months off before resuming training.But O’Neill said he and his brother, alongwith Reddam and his wife, were unanimousin deciding to retire the colt who had wonfour consecutive Grade 1 races, starting withthe Santa Anita Derby in April.

“I really thought he was going to run offtomorrow and really show something,”Reddam said. “So we were all a bit shocked,but we have to do what’s best for the horse.”

Dr. Larry Bramlage, on-call veterinarianfor the Belmont, said it wouldn’t hurt I’ll HaveAnother to walk on the track “but would be aconcern at a mile-and-a-half at full speed.”

He compared the problem to an Achillestendon injury, which usually keeps a personoff his feet for six weeks.

“This one to the horse is nowhere nearthat severity,” he said, “but it takes the sameamount of time to rehab it.”

Bramlage said it probably would take ayear for the colt to recover. He added that atendon in a racehorse is “more highlyevolved” than anything in a human.

O’Neill said I’ll Have Another wouldreturn to his home base at BetfairHollywood Park in Inglewood, Calif., in thenext few days.

The injury underlines the fragility ofthese 1,100-pound thoroughbreds, racing atspeeds up to 40 mph. Other Triple Crownbids were foiled in odd ways, too.

Big Brown was pulled up at the top of thestretch in the 2008 Belmont, mysteriouslyfailing to finish the race; War Emblem near-ly fell to his knees coming out of the startinggate in 2002 and wound up eighth;Charismatic broke two bones in his left frontleg with a quarter mile to go, but still fin-ished third in 1999; Spectacular Bid steppedon a safety pin in his stall before the 1979race and finished third; and Tim Tam endedup second in 1958 after running the finalquarter-mile with a broken bone in his rightfront ankle.

“You only get one chance to do this,” saidfour-time Belmont winner D. Wayne Lukas,who trains Belmont Stakes contenderOptimizer. “From the standpoint of a purist,it’s a blow.”

After talking to the media, O’Neill led I’llHave Another out of the detention barn andwalked him down a path toward the barnwhere the colt had stayed for most of thetime he had been at the track. SinceWednesday, all the Belmont Stakes horseswere housed in the same barn with 24-hoursurveillance; New York racing officials said itwas to ensure the race was run fairly.

“Some people have asked did the deten-tion barn have anything to do with this.Absolutely not. Just a freakish thing,” O’Neillsaid. “I’ve been hoping and praying he wouldstay injury-free, and it didn’t happen.”
