C .S .R ......... —In exercise of the powers conferred by the proviso toarticle 30)9 of the Constitution, the President hereby makes the following rules negiulating the recruitment of persons to Class I posts in the General Contrail Ser/ice under the Education Department of Himachal Pradesh Admimisttrajon, namely:—

1. Shoit title and commencement.—(1) These rules may be called the Himachal Pradesh Administration Education Department (Class I Posts) RecruiitmieHt Rules, 1967.

(2) TIhey shall come into force on the date of their publication in the Officia 1 Gazette.

2. Application.—^Thcse rules shall apply for recruitment to the posts specificed in column 1 ot the Schedule to these rules.

3. Number, Classification and scales o f pay.— The number of posts, classification of the said posts and the scales of pay attached thereto shall be as sipecified in columns 2 to 4 of the said Schedule.

4. Method o f recruitment, age limit and qualifications.— The method of recruittment, age limit, qualifications and other matters connected there­with sihall be as specified in columns 6 to 13 of the Schedule aforesaid:

Pr<ovided that the maximum age limit specified in the schedule iri res­pect oi direct recruitment may be relaxed in the case of candidates belonging to Scheduled Castes or Scheduled Tribes or other special catergories in accordance with the orders issued by the Central Government from time to timie.

5. Disqualifications.—{a) No person, who has more than one wile living or who, having a spouse living, marries in any case in which such

^ a r r ia g c is void by reasons of its taking place during the hie time of such Jpouse, sJiall be eligible for appointment to any of the said posts; and

{b) Now woman, whose marriage is void by reasons of the husband having a wife living at the time of such marriage or who has married a person who has a wife living at the time of such marriage, shall be eligible for appointment to any of the said posts:

Provttdeid that the Central Government may satisfied that there are special ^grounds for so doing, exempt an> person from the operation of th*s rule.

No. l-426/72-Edu.-A.—In exercise of the powers vested in him vide pro­viso to Articles 309 of the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the following rules in respect of Himachal Pradesh, Education Department Class III (College Cadre) Services in regard to the following matters namely:—

(0 the method of recruitment to the Himachal Pradesh Education Department Class III (College Cadre) Services;

(k) the qualifications necessary for appointment to such service and posts; and

{in) the conditions of service of persons appointed to such service and posts for the purposes of probation, seniority, promotion and confirmation.

RECRUITMENT RULES

P a r t I G e n e r a l

1. Short title and commencement.—{a) These rules may be called the Himachal Pradesh Education Class III (College Cadre) Service Rules, 1973.

(b) These rules shall come into force from the date of their publication in the Official Gazette.

2. Definition.—In these rules, unless there is anything repugnant in the subject or context,

{a) “Annexure” means an annexure attached to these rules,

{b) “department” means the Department of Education, Himachal Pradesh.

(c) “departmental candidates” mean employees serving in Educa­tion Department who on fulfilment of the requisite minimum qualifications apply for the vacant posts,

(d) “Director” means the Director of Education, Himachal Pradesh, or any other authority appointed to perform the duties of the post of Director of Education in Himachal Pradesh,

(e) “direct recruitment” means a recruitment made otherwise thanby promotion from amongst the members of the sevices or by transfer of an official already in service of the Government.

( f) “Departmental Promotion Committee” means a commi'.tee ap­pointed by the Government for the selection of candidates for appointment to posts and for promotion to higher grade in the service,

(g) “J?^-ssrvicemeil” means the discharged Army personnel,

Qi) “Governor” means the Governor of Himachal Pradesh,

(0 “Government” means the Government of Himachal Pradesh,

(j) “Member” means a member of the Himachal Pradesh Education Department Class HI (College Cadre) Service,

{k) “ Recognised University/Board of Education” means any Uni­versity/Board of Education incorporated by law in force in India or any other University/Board of Education which is declared, by the Government of India, or the Government to be a recognised University/Board of Education for the purpose of these rules.

(/) “Service” means the Himachal Pradesh Education Class III (College Cadre) Services,

(m) “Scheduled Caste” means the Castes, Races or Tribes or parts of groups within Castes, Races or Tribes specified in the Schedule to the Constitution (Schedule Castes/Order, 1950) as amended by Section 19(1) read with First Schedule of the State of Himachal Pradesh Act, 1970 (53 of 1970) and as it may further be amended from time to time,

in) “Schedule Tribes” means the tribes or tribal communities or parts of groups within Tribes or Tribal Commmiities specified in Sche­duled to the Constitution (Scheduled Tr ibes) Order 1950, as amended by the Section 20(1) read with Third Schedule ol the Himachal Pradesh Act, 1970 (53 of 1970) and as it may be amended from time to time.

3. Character o f post.—The character (i.e. designation grade etc.) of the various posts included in the service and their rates of pay shall be as in­dicated in the annexure to these rules, subject to any additions, reductions that may be made by or under the orders of the Himachal Pradesh Go­vernment.

4. Authority empowered to make appointments.—All appointments to posts in the service shall be made by the Director of Education or any other authority declared as such by the Governor, and in making appointments, the provisions of Rule 9 shall be kept in view.

5. (0 A candidate for appointment to any post in the service must be:—

id) a citizen of India; or {b) a subject of Sikkim; or

(f) a subject of Nepal; or{d) a person of Indian origin who has migrated from Pakistan with

intention of permanently settling in India;

Provided that if he belongs to category (c) or (d) he must be a person in whose favour a certificate of eUgibility has been given by the Government of India:

Provid,ed further that if he belongs to category (d) the certificate of eli- gibiUty will be valid only for a period of one year from the date of appoint­ment beyond which he can be retained in service only if he has become a citizen of India.

Explanation.—A candidate in whose case a certificate of eligibility is necessary may be admitted to an examination or interview and he may also provisionally be appointed subject to the necessary certificate being given to him by the Government; and

(2) Unless he is already in Government service he must produce—

(0 a certificate of good moral character from the Principal Academic Officer of his/her University, College, Scheool or the Head, of the Educational or Technical Institution last attended,

(/7) Certificate of good moral character from two responsible persons not being his relatives who are well acquainted with his private life and un-connected with his University, College, School or other Educational or Technical Institution,

{iii) medical certificate, as required under the relavent rules;

(/v) a declaration to the effect that he has not more than one living wife;

Note: No person who has more than one wife living or who having a spouse living, marries in any case in which such marriage is void by reason of its taking place during the life time of such spouse, shall be eligible for appointment to service;

(v) in the case of female Government servant, a declaration to the effect that she has not married a person having already a living wife.

Note: No woman whose marriage is void by reason of one husband having a wife living at the time of such marriage or who has married a person who has a wife living at the time of such mar­riage, shall be eligible for appointment to service:

Provided that the Himachal Pradesh Government may, if satisfied that there are special grounds for doing so, exempt any person in whose case second marriage is permissible in law from the operation of rules in clasuse O'v) and (v) above.

(3) Must not be less than 18 years and not more than 27 years of age on the date of his appointment,

" Provided further that minimum and maximum age limit may be relaxed by the competent authority keeping in view the general or special orders of the Government from time to time;

Provided further that the minimum and maximum age limits will be re- laixed in the case of scheduled caste/tribe candidates, displaced persons and oither special categories in accordance with the orders issued by the Government from time to time.

5. Educational and Technical qualifications o f Candidates.—No person shall be appointed to the service unless he possesses quaUfications as given in the annexure.

6. Special provisions for Scheduled CasteslTribes and Ex-servicemen.— Posts in the service shall be reserved for Scheduled Castes and Scheduled

;_Tribe candidates in the ratio of 23 %and 5 %respectively for direct recruit- ^ment subject to the minimum qualifications being satisfied by them A ros­ter shall be maintained for this purpose as required under standing instruc­tions of the Government on the subject. Similarly 20% of the vacancies will be reserved for released Indian Armed Forces personnels who joined Military Service or were commissioned on or after tne 1 / day o f November, 1962 and are released at any time thereafter. And second preference for abosrption in Civil Government Service will be given to those £A:-servicemen who were already in the service of the Army on 1-11-62 and whatever Vacan­cies in the reservation quota are left over will be filled by persons who joined military service before 1-11-62; subject to the condition of fulfilment of mini­mum qualifications being satisfied by them. In any one recruitment year the total number of vacancies reserved for ex-servicemen, Scheduled Castes and Scheduled Tribes taken together should not exceed 50% of the va­cancies to be filled in that year:

7. Procedure for making appointments.—Appointments to the service under rule 5 shall be made by the Appointing Authority on the recommenda­tions of the Himachal Pradesh Public Service Commission or the De­partmental Promotion Committee constituted by the Government from time to time, depending on whether the consultation with the Himachal Pradesh Public Service Commission is necessary or not.

8. Probation o f members o f service.—Members of the service shall re­main on probation for two years;

Provided that

(a) any period, after appointment to the service, spent on deputationon a corresponding or a higher post shall count towards period of probation fixed under this rule;

(b) in the case of an appointment by transfer, any period of work in equivalent or higher rank prior to the appointment to the service may at the discretion of the appointment authority be allowed to count towards period of probation fixed under this rule.

Explanation.—(?) Approved officiating service shall be taken as a period spent on probation but no member who is officiating in any appointment shall on the completion of the probationary period prescribed, be confirmed until he is appointed against a permanent post in the service.

(a) If the work or conduct of any member during his period of proba­tion is, in the opinion, of the appointing authority, not satisfactory, thte appointing authority may dispsnse with his services or revert him to his former post if he has been appointed to that post otherwise than by direct recruitment.

(Hi) On the completion of the period of probation of any member, th.e authority competent to make appointment to the post in the services as prescribed in Rule 4 may confirm such member in his appointment subject to availabiUty of a permanent post or if his work or conduct has, in the op­inion of the appointing authority, not been satisfactory, may dispense with his service, or revert him to h’S former post, if he has been appointed other­wise than by direct appointment or may extend the period of probation and thereafter pass such orders on the expiry of probation as it should have passed on the expiry of first period of probation:

Provided always that the total period of probation including extensiom, if any, shall not exceed four years,

9. Pay scale.—Members of the service will be entitled to the pay scale s as given in Annexure to these Rules subject to their revision by the Govern­ment from time to time.

10. Discipline.—In respect of discipline, punishment and appeals, the members of service shall be governed by the provisions of the Servicie Rules as applicable to them from time to time.

11. Seniority o f members o f service.—(/) Persons appointed in a sub­stantive/officiating capacity to a grade prior to issue of these rules, shall retain the relative seniority already assigned to them or such seniority as may thereafter be assigned to them under the existing orders applicable to their cases and shall be senior to all others in that grade.

Explanation.—For the purpose of these rules:—

ia) persons who are confirmed retrospectively with effect from a date earlier than the issue of these rules, and

{b) persons appointed on probation to a permanent post substan­tively vacant in a grade prior to the issue o. these rule;

shall be considered to be permanent officers of the grade.

11. (2) Subject to the provisions of paragraph (3) below, permanent officers o. each grade shall be ranked senior to persons who are officiating in that grade.

11. (3) Direct recruits.—Notwithstanding the provisions of para­graph 11 (2) above, the relative seniority of all direct recruits shall be de­termined by the order of merit in wliich they are selected for such appoint­ment, on the recommendation of the Selecting Authority, persons appointed as a result of an earlier selection being senior to those appointed as a result of subsequent selection:

Provided that where persons recruited initially on a temporary basis aire confirmed subssqueatly in an order different than the order of merit imdicated at the time of their appointment, seniority shall follow the orders o)f confirmation and not the original order of m erit:

Provided further that a person who does not join within the specified period shall lose his seniority according to the select list and shall rank in tthe seniority list next to the person who joined earlier:

Provided further that he shall not lose his seniority, if the fact of his j(oining later was caused by circumstances beyond his control and for the rreasons to be recrorded in writing, if the appointing authority is satisfied t:hat this was so.

11. (4) Promotees.—The relative seniority of persons promoted to the warious grades shall be determined in the order of their selection for such prom otions:

Provided that where persons promoted initilally on a temporary Ibasis are confirmed subsequently in an order different than the order of im^rit indieUed at the time of their promotion seniority shall follow"the corder of confirmation and not the original order of merit.

12. Leave and pension.—In respect of leave, pension and other (cognate) imaUers not specifically mentioned in these rules, the members of the service shall be governed by the leave and pension rules contained in the relevant irules framed/adopted by the Government from time to time.

13. Training and examination.—The Members of service shall have tto qualify examinations or to undergo training as may be prescribed by the IDepartment/Government from time to time for any Class of posts specified iin Annexure to these rules.

14. Other conditions o f service.—In respect of conditions of service (Other than those covered by these rules, members of the service shall be ^governed by the rules, orders and instructions as may be issued by the <Government from time to time.

15. Power to relax provisions o f rules^—Where the Governor is of the opinion that it is necessary or expedient to do so, he may by order, for reasons to be recorded in writing relax any of the provisions of these rules >with regard to any Class or category of persons/posts.

Provided further that the minimum and maximum age limits may be relaxed in the case of Scheduled Caste/Tribes candidates, displaced persons and other special categories in accordance with the orders issued by the Government from time to time.

5. Educational and technical qualifications o f candidates.—No person shall be appointed to the service unless he possesses qualifications as given in the annexure.

6. Special provisions for scheduled castejtribes and QX-servicemen.— Posts in the service shall be reserved for Scheduled Castes and Scheduled Tribes candidates in the ratio of 23 % and 5 % respectively for direct recruit­ment subject to the minimum qualifications being satisfied by them. A roster shall be maintained for this purpose as required under standing ins­tructions of the Government on the subject. Similarly 20 % of the vacancies will be reserved for released Indian Armed Forces Personnels who joined Military Service or were commissioned on or after the I5? November, 1962 and are released at any time thereafter. And second preference for absorp­tion in Civil Government Service will be given to those e^:-servicemen who were already in the Service of the Army on 1-11-62 and whatever vacancies in the reservation quota are left over will be filled by person who joined military service before 1-11-62; subject to the condition of fulfilment of minimum qualifications being satisfied by them. In any one recruitment year the total number of vacancies reserved for e^r-servicemen Scheduled Castes and Scheduled Tribes taken together should not exceed 50% of the vacancies to be filled in that year.

7. Procedure for making appointments.—Appointments to the service under Rule 7 shall be made by the appointing authority on the recommenda­tions of the Himachal Pradesh Public Service Commission or the Depart­mental Promotion Committee constituted by the Government from time to time, depending on whether the consultation with the Himachal Pradesh Public Service Commission is necessary or not.

8. Probation o f members o f service.—Members of the service shall remain on probation for two years;

Provided tha t:

(a) any period, after appointment to the service, spent on deputationon a corresponding or a higher post shall count towards period of pobation fixed under this rule;

(b) in the case of an appointment by transfer, any period of work in equivalent or higher rank prior to the appointment to the service may at the discretion of the appointing authority be al­lowed to count towards period of probation fixed under this rule.

9. Pay scale.'—Members of the service will be entitled to the pay scales given in Annexure to these Rules subject to their revision by the Government from time to time.

Provided that where persons recruited initially on a temporary basis are confirmed subsequently in an order different than the order of merit indicated at the time of their appointment, seniority shall follow the orders of confirmation and not the original order of merit:

Provided further that a person who does not join within the specified period shall lose his seniority according to the select list and shall rank in the seniority list next to the person who joined earlier:

Provided further that he shall not lose his seniority if the fact of his joining la:er was caused by circumstances beyond his control and for the reasons to be recorded in writing, if the appointing authority is satisfied that this was so.

11. (4) Promotees.—The lelative seniority of persons promotea to the various grades shall be determined in the order of their selection for such promotions:

Provided that where persons promoted initially on a temporary basis are confirmed subsequently in an order different than the order of merit of indicated at the time of their promotion seniority shall follow the order of confirmation and not the original order of merit.

12. Leave and pension.—In respect of leave, pension and other (congnate) matters not specifically mentioned in these rules, the members of the service shall be governed by the leave and pension rules contained in the relevant rules framed/addopted by the Government from time to time.

13. Training and Examination.—The members of service shall have to qualify examinations or to undergo Training as may be prescribed by the Department/Government from time to time for any class of posts specified in Annexure to these rules.

14. Other Conditions o f Service.—In respect of conditions of service other than those covered by these rules, members of the service shall be governed by the rules, orders and instructions as may be issued by the Government from time to time.

15. Power to relax provisions o f Rules.—Where the Governor is of the opinion that it is necessary or expendient to do so, he may by order, for reasons to be recorded in writing relax any of the provisions of these rules With regard to any class or category of persons/posts.

No. 17-4/69-Edu-II.— In exercise of the powers vested in him under the proviso to Article 309 of the Constitution, the Governor, Himachall Pradesh, is pleased to make the following rules, in consultation with the Himachal Pradesh Public Service Commission in so far as categories of posts; mentioned in Annexure I to these rules; are concerned and also in respect of the posts mentioned in Annexure II which do not fall within the pur­view of the Commission, in regard to the following m atters, namely:—

(/) the method of recruitment to the Himachal Pradesh, Educationi Department Class III (School and Inspection Cadre) Services;

(//) the qualifications necessary for appointment to such services; and posts; and

(Hi) certain conditions of service of persons appointed to such services; and posts for purposes of probation, confirmation, seniority and promotion.

PART I—GENERAL

R e c r u it m e n t r u l e s

1. Short title and commencement.—(a) These rules may be called the Himacnal Pradesh Education Department Class HI (School and Inspec­tion Cadre) Service Rules, 1973.

(b) These rules shall come into force with immediate effect.

2. Definition.—In these rules unless there is anything repugnant in the; subject or context.

{a) ‘Annexure’ means an annexure to these rules;

(b) ‘Commission’ means Himachal Pradesh Public Service Commis­sion;

(c) ‘Department’ means the Department of Education, HimachalPradesh;

(d) ‘Director’ means the Director of Education, Himachal Pradesh;

{e) ‘Direct Appointment’ means an appointment made otherwise than by promotion from amongst the members of the services; or by transfer of an oflHcial already in the service of the Govern­ment or of the Union;

(/) ‘Government’ means the Government of Himachal Pradesh in the administrative Department;

(^) ‘Governor’ means the Governor, Himachal Pradesh;

{h) ‘Member’ means a member of the Himachal Pradesh State Educa­tion Department Service Class HI (School and Inspection Cadre);

(/) ‘'Recognised Board” means any Board of School Education in­corporated by Law in India;

(/) “ Recognised Institutions” means any institution recognised by the Himachal Pradesh Ui iversity or H.P. Board of School Education or Government of Himachal Pradesh, as the case may be, for purposes of fulfilling the requirements of particular/specific qualifications under these rules;

{k) ‘Recognised University’ (means any University incorporated by Law in India;

(/) “ Released Indian Armed Forces Personnel” means the Emergency Commissioned Officers, Short Service Regular Commissioned Officers, Junior Commissioned Officers, Non-Commissioned Officers and other Ranks of the Armed Forces of the Indian Union, who joined service or Commissioned on or after 1st Novem­ber, 1962 and are released at any time thereafter;

(jn) ‘Service’ means the Himachal Pradesh Education Department class III (School and Inspection Cadre) Services;

(n) ‘Fx-scrvicc Officers/Men’ means the officers and Men of the Armed forces of the Indian Union who joined service or Commissioned before 1st November, 1962 and released at any time thereafter;

(o) ‘Scheduled Caste’ means castes, races or tribes or parts of groups within castes, races or tribes specified in the Schedule to the Constitution (Scheduled Castes) Order, 1950 as amended by sec­tion 19(1) read with First Schedule of the State of Himachal Pradesh Act, 1970 (53 of 1970) and as it may further be amended from time to time.

(p) ‘Scheduled Tribes’ means the tribes, tribal communities or parts of groups within tribes, tribal communities specified in the Schedu­le to the Constitution (Scheduled Tribes) Order, 1950, as amended by Section 20(1) read with Third Schedule of the State of Himachal Pradesh Act, 1970]|(53 of 1970) and as it may be amended from time to time.

P a r t II—R e c r u ft m e n t t o S e r v ic e

3. Character o f Posts.—The Character {i.e. designation, grade, etc.) of the various posts included in the service and their rates of pay shall be as indicated in Annexures to these rules.

4. Authority Empowered to make appointments.—All appointments to posts in the service shall be made by the Head of the Department or any other authority declared as such by the Governor.

5. Conditions o f Service.—A candidate for appointment to any, post in the service must be:—

(1) Nationality, Eligibility, Age, etc.—(a) A citizen of India;

(b) (i) Who produces before the appointing authority concerned, if so, required by it, a certificate of eligibility granted under Rule 4 of the Himachal Pradesh, Manipur and Tripura Public Employ­ment requirement as to Residence) Rules, 1959; and

(ii) No eligibility certificate is required in the case of those who are banafied resident of Himachal Pradesh but they must pro­duce the Certificate of bona fied residents of Himachal Pradesh issued by the Magistrate I Class or by the Tehsildar:

Provided further that in case, the Governor, in any exceptional case and for reasons to be recorded in writing, relaxes the provision of sub-rule (i)) of this rule, in exercise of h> s discretion under Rule 5 of the Himachal Pradesh Manipur and Tripura Public Employment (Requirement as to Residence)' Rules, 1959. A candidate for appointment to any post in the service must be:—

(а) A citizen ol India; or

(б) A subject of Sikkim, or

(c) A subject of Nepal, or

(d) A person of Indian origin who was migrated from Pakistan with the intention of permanently settling in India:

Provided that if he belongs, to category (c) and (d) above, he must be a person whose favour a certificate of eligibility has been given by the Government of India:

Provided further that if he belongs to category (d) the certificate o f eligibility will be valid only fo r a period of one year from the date of his appointment beyond which he can be retained in service only if he has be­come a citizen of India;

A candidate in whose case a certificate of eligibility is necessary, may be admitted to an examination or interview and he may also provisionally be appointed subject to the necessary certificate being given to him by the Government.

(2) Unless he is already in Government service, must produce:

(i) A certificate of good moral character from the Principal, Academic Officer of his University, College, S'chool or the Hea<l of his Educational or Technical Institution last attanded;

(«) Certificate of good moral character from 2 responsible persons, not being his relatives who are well acquainted with him in private life and unconnected with his University, College, Technical Institution;

{iii) A Medical Certificate as required under the service rules made applicable by the Government from time to time;

{iv) No person who has more than one wife living or who having a spouse living, marries in any case in which such marriage is void by reason of its taking place during the life time of such spouse, shall be eligible for appointment to the service;

(v) In the case of a Married Woman a declaration to the effect she has not married a person having already a living wife;

Note.—No woman whose marriage is void by reason of the husband- having a wife living at the time of such marriage or who has mar, ried a person who has a wife living at the time of such marriage shall be eligible for appointment to service:

Provided that the Himachal Pradesh Government may, if satisfied that there are special grounds for doing so, exempt any such person in whose case second marriage is permissible in law from the operation of rules in clauses (iv) and (v) above; and

(3) Not less than 18 years and not more than 25 years of age on the date of appointment:

Provided that minimum andmaximun age limits as prescribed may be relaxed in pursuance of the instructions laid down by the Government from time to time:

Provided further that the maximum age limit may be relaxed in the c^se of Schedubd Castes/Scheduled Tribes candidates and other special categories in accordance with the orders issued by the Government from time to time.

6. Educational and Professional Qualifications o f Candidates.—The Education'll and Professional qualifications of candidates for appointment to the various posts in the service shall be as specified in Annexure T to these rules.

7. Mathod o f Recruitment.—The Method of recruitment for appoint­ment to the various posts in the service shall be as specified in Annexures I to these rules.

8. Special Provision o f Reservation o f Posts for Scheduled Castes/Tribes, the Released Indian Armed Forces Personnel and Backward Classes.—Such percentage of posts as may be prescribed by the Government from time to time, shall be reserved for the following special catergories:—

(0 Scheduled Castes;

(//) Scheduled Tribes;

{Hi) The Released Indian Armed Forces persomiel; and

(iv) Backward Classes:

Provided that the minimum Qualifications prescribed for the posts in the service are s^tisfisd by them. A roster shall be maintained for this purpose as required under standing instructions of the Government on the subject. In any oni recruitment year the total number of vacancies reserved for Sche­duled Caste Tribes, Released Indian Armed Forces Personnel and Back­ward Class:;s, taken together shall not exceed 50% (percent) of the total number of vacancies to be filled up in the service.

9. Appointment by Promotion.—Appointments to the service under Rule 7 shall b^ made by the Appointing Authority on the recommendation of the Departmental Promotion Committee, constituted by the Government from time to time, or on the recommendations of the Himachal Pradesh Public Service Commission, as the case may be.

10. Probation o f Members o f the Service.—(a) Members of the service who are appointed against permanent vacancies shall, on appointment to a post in the service, remain on probation for a period of two years.

(b) any p3riod, after appointment to the post in the service, spent on deputation on a corresponding or a higher post shall count towards period of probation fixed under sub-rule (a) above.

Explanation.—(/) Approved officiating service shall be taken as a period, spent on probation but no member who is officiating in any appointment shall on completion of the probationary period prescribed, be confirmed until he is appointed against a permanent post in the service;

(ii) If the work or conduct of any member during his period’of probation is, in the opinion of the appointing authority, not satisfactory, the appoint­ing authority may dispense with his services or revert him to his former post if he has been appointed to that post otherwise than by direct recruit­ment. Tiie appointing authority may extend the period of probation and thereafter pass such orders on the expiry of first period of probation, pro­vided always that the total period of probation including extension, if any, shall not exceed 3 years.

11. Confirmation o f Members o f Service.—On completion of the period of probation, the authority competent to make appointment to the posts in the service as prescribed in rule 4, may confirm members of service in the posts, subject to the availability of permanent posts, on the recommenda­tions of the Departmental Promotion Committee constituted foi the pur­pose from time to time.

Explanation.—Vov the purpose of these rules, persons who are con- firined retrospectively with effect from a date earlier than the issue of these rules shall be considered to be permanent employees of the grade.

12. Pay Members of the service will be entitled to the pay scalein Annexures I and II to these rules, subject to their revision by theas given x.* ----

Government from time to time.

13. Discipline.— In respect of discipline, punishment and appeals, the members of service shall be governed by the provisions of rules which are mad.e by the Government or are made applicable by the Government in this behalf.

14. Seniority o f members o f service.- {\) Persons appointed in a sub­stantive/officiating capacity to a grade prior to the issue of these rules, shall retain the relative seniority already assigned to themor such seniority as may thereafter be assigned to them under the existing orders applicable to their cases and shall be senior to all others in that grade.

(2) Subject to the provisions of sub-rule (3) below, permanent officers of each grade shall be ranked senior to persons who are officiating in that grade.

(3) Direct Recruits.—Notwithstanding the provisions of sub-rule (2) above, the relative seniority of all direct recruits shall be determined by the order of merit in which they are selected for such appointment, on the recommendations of the selecting authority; persons appointed as a result of an earlier selection being senior to those appointed as a result of a subsequent selection:

(4) Promotees.—(0 The relative seniority of persons promoted to the various grades shall be determined in the order of their selection for such promotion:

Provided that where persons promoted initially on a temporary basis are confirmed subsequently in an order different than the order of merit indicated at the time of their promotion, seniority shall follow the order of confirmation and not the original order of merit.

(ii) Where promotions to a grade are made from more than one grade, the eligible person shall be arranged in separate list in the order of their relative seniority in their respective grades; thereafter the Departmental Promotion Committee shall select persons for promotion from each list, strictly on the basis of seniority subject to the rejection of unfit, and shall

anange all the candidates selected from different list(s) in a consolidated form of merit/select list according to prescribed percentage for each grade. This marit/select list will determine the seniority of the persons on promo­tion to the higher grade.

(5) Relative seniority o f Direct recruits and promotees.—The relative seniority of direct recruits and promotees shall be determined according to the rotation of vacancies between direct recruits and promotees which shall be based on the quotas of vacancies reserved for direct recruitment and promotion respectively as provided in these rules.

E x p l a n a t o r y M e m o r a n d u m

Rule 4(1).—Where promotions are made on the basis of selection by a Departmental Promotion Committee, the seniority of such promotees shall be in the order in which they are recommended for such promotion by the Committee. Where promotions are made on the basis of seniority subject to the rejection of unfit, the seniority of persons considered fit for promo­tion, at the same time, shall be the same as the relative senioiity in the lower grade from which they are promoted. Where, however, a person is considered as unfit for promotion and is superseded by a junior, such person shall not if he is subsequently found suitable and promoted, take seniority in the higher grade over the junior persons who had superseded him.

Rule 5.—A roster shall be maintained, based on the reservations for direct recruitment and promotion, as provided in the Recruitment and Pro­motion Rules. Appointments shall be made in accordance with this roster and seniority be determined accordingly.

I l l u s t r a t io n

Where 75% of the vacancies are reserved for promotion and 25% for direct recruitment, each direct recruit shall be ranked in seniority below three promotees, and where 90 % of the posts in service are to be filled up by direct recruitment and 10% from amongst the Junior teachers, each promotee shall be ranked in seniority above 9 direct recruits. If for any reason, a direct recruit or a promotee ceases to hold the appointment in the grade, the seniority list shall not be re-arranged merely for the purpose of ensuring the proportion referred to above.

15. State I District Caders.—There will be two types of cadres for the purpose of seniority in the service,

(a) State Cadres.—The following categories of service will be borne on State Cadres:—

(i) Headmaster/Headmistresses of High Schools;

O'O Lecturers;

(Hi) Trained Graduates and Block Education Officers/Craft Masters/ Arts and Craft Masters/Fine Arts Masters/Senior Home Science Teachers/Agriculture Teachers and all other posts of teachers in the scale of Rs. 220—500;

(iv) P. T. S.;

(v) A.P.T.S./D.P.E.;(vi) Radio Instructor/Wood-Work Instructor/Glass Blower; and

(vii) J.A.V./J.S.T.

(b) District Cadres.—The following categories of service will be borneon District Cadres:—

(0 Classical and Vernacular teachers viz. Drawing Masters/P.T.Is/ L.Ts./Ots./Band Masters /M.T.Is./Art and Craft Teachers etc,

(n) J.B.Ts.;

(///) Art/Craft Teachers (Agriculture, Spinning Weaving/Tailoring/ Mistresses/MasteiS, Home/Domestic Science Teachers) and all other posts of teachei s in the pay scale of Rs. 125—300;

Provided that as a result of transfer of teachers borne on the District Cadre, from one District to the other, he/she shall be placed at the bottom of the seniority list of the corresponding Cadre of the District to which he/she may wish to be transferred.

16. Leave and Pension.—In respect of leave, pension and other (cong- naite) matters not specifically mentioned in these rules, the members of ser­vice shall be governed by the Rules/Instructions/Executive Orders as are miade applicable by the Government from time to time.

No. 1-478/72-Edu-A.—In exercise of the powers vested in him under the proviso to Article 309 of the Constitution oflndia, the Governor, Himachal Pradesh, is pleased to make the following rules, in consultation with the Himachal Pradesh Public Service Commission in so far as categories of posts mentioned in Armexure I to these Rules are concerned and also the rules in respect of ca-tegories of posts indicated in Annexure II, with regard to the following matters namely:—

(/) the method of recruitment to the Himachal Pradesh Education Department Class III (Cadre of Head Pandits, Pandits and other Teaching Porsonnel of Sanskrit Colleges and Sanskrit Pathsals);

(«) the qualifications necessary for appointment to such services and posts; and

{iii) certain conditions of service of persons appointed to such services and posts for purposes of promotion, probation, confirmation and seniority.

P a r t I— G e n e r a l

R e c r u it m e n t R u l e s

1. Short title and commencement.—{a) These rules may be called the Himachal Pradesh Education Department Class III (Cadre of Head Pandits, Pandits and other teaching personnel of Sanskrit colleges and Sanskrit Pathshalas) Service Rules, 1973.

(ft) These rules shall come into force with immediate effect.

2. Definition.-An these rules there is anything repugnant in the sub­ject or context,—

(a) ‘Annexure’ means an annexure to these rules.

(b) ‘Commission’ means Himachal Pradesh Public Service Com­mission ;

(c) ‘Department’ means the Department of Education, HimachalPradesh;

{d) ‘Director’ means the Director of Education, Himachal Pradesh;

{e) ‘Direct Appointment’ means an appointment made otherwise than by promotion from amongst the members of the services or by transfer of an official already in the service of the Govern­ment or of the Union;

(/) ‘Government’ means the Government of Himachal PradeshJ

‘Governor’ means the Governor of Himachal Pradesh;

(h) ‘Member’ means member of the Himachal Pradesh Education Department Service Class IH (Cadre of Head Pandits, Pandits and other Teaching Personnel of Sanskrit Colleges and San­skrit Pathshalas);

(/) ‘Recognised Board’ means any Board of School Education incor­porated by law in India;

(j) ‘Recognised Institution’ means any institution recognised by the Himachal Pradesh University or Government of Himachal Pra­desh, as the case may be, for purposes of fulfilling the require­ments of particular/specific qualifications under these rules;

(k) ‘Recognised University’ means any University incorporated by law in India;

(I) ‘Released Indian Armed Forees Personnel’ means the Emergency Commissioned Officers, Short Service Regular Commissioned Officers, Junior Commissioned Officers, Non-Commissioned Officers and other Ranks of the Armed Forces of the Indian Union, who joined service or commissioned on or after 1st November, 1962, and are released at any time thereafter;

(m) ‘Service’ means the Himachal Pradesh Education Department Class III (Cadre of Head Pandits, Pandits and other Teaching Personnel of Sanskrit Colleges and Sanskrit Pathshalas) Service;

(n) ‘Sanskrit College’ means an Institution/College recognised by the Government of Himachal Pradesh or by the Himachal Pradesh University and imparting instructions to the students for Pragya, Vishard, Shastri and Acharya Examinations of the Himachal Pradesh University;

(o) ‘Sanskrit Pathshala’ means an institution recognised by the Government of Himachal Pradesh or by the Himachal Pradesh University and imparting instructions to the student for Pragya, Vishard and Shastri Examinations of Himachal Prad.esh Uni­versity;

(p) ‘Scheduled Castes’ means castes, races or tribes or parts of groups within castes, races or tribes specified in the schedule to the Con­stitution (Scheduled Castes) Order, 1950 as amended by ‘ section 19(1) read with First Schedule of the State of Himachal Pradesh Act, 1970 (53 of 1970) and as it may further be amended from time to tim e;

(g) ‘Scheduled Tribe’ means the tribes, tribal communities or parts of groups within Tribes, Tribal Communities specified in the Schedule to the Constitution (Scheduled Tribes) Order 1950, as amended by section 20(1) read with Third Schedule of the State

of Himachal Pradesh Act, 1970 (53 of 1970) and as it may further ba amended from time to time.

P a r t H — R e c r u it m e n t to S er v ic e

3. Character o f Posts.—The character {i.e. disignation, grade, grades, etc.) of the various posts included in the service and their rates of pay etc. shall be as ind icated in Annexure to these rules,

4. Authority empowered to make appointment.—All appointments to posts in the service shall be made by the Head of the Department or any other authority declared as such by the Governor,

5. Conditions o f service [^Nationality, Eligibility, age etc.).—A candidate for appointment to any post in the service must be:—

{a) A citizen, of India, and

{b) (i) who or whose father has been continuously resid,ing in Himachal Pradesh for a pteriod of not less than 3 years immediately prece- diag the last date fixed for making applications to a p o s t, or

(/?■) whose father, if died, continuously resided in Himachal Pradesh for a period of not less than 3 years immediately preceding his death continued to reside in Himachal Pradesh upto the last date fixed for making applications for appointment to a post:

Provided that any period of temporary absence from Himachal Pradesh for the purpose of prosecuting his studies or for under­going medical treatment or any period of such temporary absence not exceeding 3 months for any other reasons, shall not be deemed to continued a break in the continuity of such reasidence, but for the purpose of calculating the said period of 3 years any such period of temporary absence shall be excluded ; and

(Hi) who produces before the appointing authority concerned, if so, required by it, a certificate of eligibility granted under Rule 4 of the Himachal Pradesh, Manipur and Tripura Public Employ­ment (Requirement as to Residence) Rules, 1959; and in case the Governor, in any exceptional case and for reasons to be recorded in writing, relaxes the provision of sub-rule (/) of this rule in exer­cise of his discretion under Rule 5 of the Himachal Pradesh, Manipur and Tripura Public Employment (Requirement as to Residence) Rules, 1959, a candidate for appointment to any post in the service must be :—

(a) a citizen of India, or(b) a subject of Sikkim, or(c) a subject of Nepal, or(d) a subject of Indian origin who has migrated from Pakistan

with the intention of permanently settling in India:

Provided further that if he belongs to category {d) and (c) above, lie must be a person in whose favour a certificate of eligibility has been given by the Government of India:

Provided further that if he belongs to category {d) the certificate of eli­gibility will be valid only for a period of one year from the date of his appointment beyond which he can be retainedm service only if he has become a citizen of India;

A candidate in whose case a certificate of eligibility is necessary may be admitted to an examination or interview and he may also provisionally be appointed subject to the necessary certificate being given to him by the Government.

(2) Unless he is already in Government Service must produce:—

(0 a certificate of good moral character from two responsible persons, not being his relatives who are well acquainted with him in private life and unconnected with his University, college. Institution;

(ii) a certificate of good moral character from the Principals, Academic Officer of his University, Colleges, Schools or Head of his Educa­tional or Professional Institution/College last attended;

{Hi) a medical certificate as required under the service rules made applicable by the Government from time to tim e;

{(iv) a declaration to the effect that he has not more than one wife living.

Note:—No person who has more than one wife living or who having a spouse living marries in any case in which such marriage is void by reason of its taking place during the life time of such spouse, shall be eligible for appointment to the service;

(v) In the case of female candidates a declaration to the effect that she has not married a person having already a living wife;

Note:—No woman vsrhose marriage is void by reason of the husband ha­ving a wife living at the time of such marriage or who has married a person who has a wife living at the time of such marriage, shall be eligible for appointment to service:

Provided that the Himachal Pradesh Government may, if satisfied that there are special grounds for doing so, exempt any person from the operation of rules in clauses (iv) and (v) above subject to observence of the Government’s instructions in this behalf.

(3) Not less than 18 years and not more than 27 years of age on the date o f appointment:

Provided that minimum and maximum age limits as prescribed may be relaxed in pursuance of the instructions laid down by the Government from time to time:

Provided further that the maximum age limit may be relaxed in the case of Scheduled Castes/Tribes candidates and other special categories in accordance with the orders issued by the Government from time to time.

6. Educational and professional qualifications o f candidates.— No person shall be appointed to the service unless he/she possessed qualifications laid down in the Annexure to these rules.

7. Method o f recruitment. -Posis in the service shall be filled ia by promotion or by direct recruitment as laid down in the Annexure to these rules.

8. Special provision o f reservation o f posts for Scheduled Castes jTribes. the released Indian Armed Forces Personnel and Backward Classes.—Such percentage of posts as may be prescribed by the Government from time to time, shall be reserved for the following special categories:

(/) Scheduled Castes;(//) Scheduled Tribes;

{Hi) The Released Indian Armed Forces Personnel; and(iv) Backward classes:

Provided that the minimum qualifications prescribed for the posts in the ssrvice are satisfied by them. A roster shall be maintained for this pur­pose as required under standing instructions of the Government on the subject. In any one recruitment year the total number of vacancies reserved for Scheduled Castes/Tribes, Released Indian Armes Forces Personnel and Backward Classes, taken together shall not exceed 50 per cent of the total number of vacancies to be filled up in the service.

9. Appointment by promotion.—Appointments to the service under rule 7 shall be made by the Appointing Authority on the recommendation of the Departmental Promotion Committee constituted by the Government from time to time or on the recommendations of the Himachal Pradesh Public Service Commission, as the case may be.

10. Probation o f members o f the service.—{a) Members of the servica shall remain on probation as specified in the Annexure.

(b) Any period, after appointment to the post in the service, spent on deputation on a corresponding probation fixed under sub-rule {a) above.

Explanation.—(0 Approved officiating service shall be taken as a period spent on probation but no member who is officiating in any appointment shall be on completion of the probationary periotl prescribed, be confirmed until he is appointed against a permanent post in the service.

(//) If the work or conduct of any member daring his period of proba­tion is, in the opinion of appointing authority not satisfactory, the appointing authority may dispense with his services or revert him to his former post if

he his been appointed to that post otherwise than by direct recruitment. Tlhe appointing authority may extend the period of probation provided al­ways that the total period of probation including extension, if jiny, shall n(Ot txceed four years.

11. Confirmation o f th& members o f service.—On completion of the psricd of probation, the authority competent to make appointment to the posti in the service as prescribed in rule 4, may confirm members of service in the posts, subject to the availabiUty of permanent posts, on the recom- miendations of Departmental Promotion Committee constituted for the puirfX)sefrom time to time.

12. Pay scale.—Members of the service will be entitled to the pay scale as given in Annexure to these rules, subject to their revision by tie Government from time to time.

IJ. Discipline.—In respect of discipline, punishment and appeals, the members of service shall be governed by the provisions of rules which are made by the Government or are made applicable by the Government in this behalf.

14. Seniority o f members o f service.—(1) Persons appointed in a sub- staniive/oificiating capacity to a grade prior to the issue of these rules; shall r i ia h the reVa.Uve seniority already assigned to them or such seniority as may thereafter be assigned to them under the existing orders applicable to theircases and shall be senior to all others in that grade.

(2) Subject to the provisions of sub-rule (3) below, permanent officers o f each grade shall be ranked senior to persons who are officiating in that grade.

(3) Direct recruits.—^Notwithstanding the provisions of sub-rule (2) above, the relative seniority of all direct recruits shall be detei mined by the order of merit in which they are selected for such appointment on the recom­mendations of the selecting authority; persons appointed as a result of an earlier selection being senior to those appointed as a result of a subsequent selection:

Provided that where persons recruited initially on a temporary basis are confirmed subsequently in an order diflFerent from the order of merit indicated at the time of their appointment seniority shall follow the order of confirmation and not the original order of merit:

Provided further that a person who does not join within the specified period shall lose his seniority according to the select list and shall rank in the seniority next to the person who joined earlier:

Provided further he shall not lose his seniority if the fact of his joining later was caused by the circumstances beyond his control and if the ap­pointing authority is satisfied that this has so.

(4) Promotees.—{i) The relative seniority of persons promoted to the various grades shall be determined in the order of their selection for such promotion:

(//) Where promotions to a grade are made from more than one grade the eligible parsons shall be arranged in separate list in the order of their relative seniority in their respective grades. Thereafter the Departmental Promotion Committee shall select person for promotion from each list strictly on the basis of seniority subject to the rejection of unfit and shall arrange all th-? candidates selected from different lists in a consolidated form of merit which will determine the seniority of persons on promotions to the higher grades.

(5) Relative seniority o f direct recruits and promotees.—The relative seniority of direct recruits and of promotees shall be determined according to the rotation of vacancies reserved for direct recruitment and promotion respectively in these rules.

(6) Transfers.—^The relative seniority of persons appointed by transfer in the ssrvice from or other departments of State Government shall be de­termined in accDrdance with the order of their selection for such transfer,

(7) Explanatory Memorandum.—Where promotions are made on the basis of selection by a Departmental Promotion Committee the seniority of such promotees shall be in the order in which they are recommended for such promotion by the Committee. Where promotions are made on the basis of seniority subject to the rejection of unfit, the seniority of persons con­sidered fit for promotion at the same time shall be the same as the relative seniority in the lower grade from which they are promoted. Where, however, a person is superseded by a junior such person shall not if he is subsequen­tly found suitable and promoted take seniority in the higher grade over the junior persons who had superseded him.

(8) Direct recruit shall be ranked in seniority below the promotees. If for any reason, a direct recruit or a promotee ceases to hold the appoint­ment in the grade, the seniority list shall not be re-arranged merely for the purpose or ensuring the proportion referred to above.

15. The cadres of service shall be as under:—

{a) Head Pandits o f Sanskrit Colleges.—The Head Pandits of Sans­krit Colleges shall constitute their own district cadre:

{b) PanditsjHead Pandits o f Sanskrit Pathshalas.—ThQ Pandits wor­king in the Sanskrit Colleges and the Head Pandits/Pandits working in the Sanskrit Pathshalas shall constitute their own one and single cadre.

16. Leave and Pension.—In respect of leave, pension and other (cognate) matters not specifically mentioned in these rules, the members of service shall be governed by the Rules/Instructions/Executive Orders as are made applicable by the Government from time to time,

No. 'l-409/7l-Edu-A.—In exercise of the powers vested in him under the proviso to Article 309 of the Constitution, the Governor, Himachal Pradesh, is pleased to make the following rules, in consultation with the Himachal Pradesh Public Service Commission in so far as categories of posts men­tioned in Annexure I to these rules are concerned and also the rules in respect of categories of posts indicated in Annexure II, with regard to the following matters, namely:—

(0 The method of recruitment to the Himachal Pradesh Education Class III (Technical) services;

(//) the qualifications necessary for appointment to such services and posts; and

{iii) certain conditions of services of person appointed to such service and posts for purposes of probation, confirmation, seniority and promotion.

P a r t I - G e n e r a l

1. Short title and commencement.—(a) These rules may be called the Himachal Pradesh Education Department Class III (Technical) Service (Recruitment, Promotion and certain Conditions of Service) Rules, 1971.

{b) These rules shall come into force from the date of notification in the official gazette.

2. Definition.— In these rules unlefss there is anything repugnant in the subject or context.

{a) “annexure” means an annexure attached to these rules;

(b) “department” means the Department of Education, Himachal Pradesh;

(f?) “departmental candidates” means the employees serving in Education Department who on fulfilment of the requisite mini­mum qualifications, apply for the vacant posts;

id) “direct appointment” means an appointment made otherwise than by promotion from amongst the members of the service or by transfer of an official already in the service of the Govern­ment or of the Union;

(e) “£xnservicemen” means the discharged army persomiel;

(/) “Government” means the Government of Himachal Pradesh

(g) “ Governor” means the Governor of Himachal Pradesh;

(h) “member” means a member of the Himachal Pradesh EducationDepartment Class HI (Technical) Service;

(0 “recognis3d University” means University incorporated by law in India;

0 ) “ Scheduled Caste” means castes, races or tribes or parts of groups within castes, races or tribes specified in the Constitution (Sche­duled Castes) Order, 1950 as amended by section 19(1)read with the Fifst Schedule of the State of Himachal Pradesh, Act, 1970 (53 of 1970) and as it may further be amended from time to tim e;

(k) “ Scheduled Tribes” means the tribes, tribal communities or parts of groups within tribes, tribal communities specified in the Schedule to the Constitution (Scheduled Tribes) Order, 1950, as amended by section 20(1) read with Third Schedule of the State of Himachal Pradesh Act, 1970(53 of 1970) and as it may be amended from time to tim e;

(/) “ the service” means the Himachal Pradesh Education Depart­ment Class HI (Technical) service;

(m) “ State” means the state of Himachal Pradesh.

3. Character o f posts.—The character {i.e. designation, grade etc.) of t.he various posts included in the service and their rates of pay shall be as iindicated in the appendix to these rules.

4. Authority empowered to make appointments.—All appointments to posts in the service shall be made by the Director of Education or any other authority declared as such by the Governor.

5. Conditions o f service.—A candidate for appointment to any post in the service must b e :—

(1) (a) a citizen of India, or(b) a subject of Sikkim, or(c) a subject of Nepal, or(d) a person of Indian origin who has migrated from Pakistan

with intention of permanently settling in India;

Provided that if he belongs to category (c) or (d) he must be a person n i whose favour a certificate of eligibility has been given by the Govern- mento-f India:

Provided further that if he belongs to category {d) the certificate of eligibility will be valid only for a period of one yeai from the date of appoint­ment beyond which he can b3 retained in service only if he has become a citizen of India. A candidate in whose case a certificate of eligibility is neces­sary may be ad.mitted to an examination or interview and he may also pro­visionally be appointed subject to the necessary certificate being given to him by the Government;

(2) Unless he is already in Government se rvice, must produce:—

(/) A certificate of good moral character from the principal acade­mic officer of his university, college, school or the head of the educational or technical institutions last attended,

(/7) Certificate of good moral character from two responsible persons not being his relatives who are well acquainted with his private life and un-connected with his university, college, school or other educational or technical institution;

(m) A medical certificate, as required under the service rules made applicable by the Government from time to time;

(/v) a declaration to the effect that he has not more than one living wife;

Note.—No person who has more than one wife living or who having a spouse living, marries in any case in which such marriage is void by reason of its taking place during the life time of such spouse, shall be eligible for appointment to service:

(v) in the case of a female Government servant, a declaration to the effect that she has not married a person having already a living wife;

Note.—No woman whose marriage is void by reason of the husband having a wife living at the time of such marriage or who has married a person who has a wife living at the time of such mar­riage, shall be eligible for appointment to service:

Provided that the Himachal Pradesh Government may, if satisfied that there are special grounds for doing so, exempt any such persoi in whose case second marriage is permissible in law from the operation of rules in clause (/v) and (v) above; and

(3) must not be less than 18 years and not more than 27 years of age on the d ate of his appointment:

Provided further that minimum and maximum age limits as prescribed may be relaxed in persuance of the instructions laid down by the Govern­ment from time to time;

Provided further that the miximum age limit may be relaxed in the case of scheduled caste/tribe candidates, displaced persons and othef special categories in accordance with the orders issued by the Government from time to time.

6. Educational and technical qualification o f candidates.—No person shall be appointed to the service unless in the case of appointment to the post of:—

(0 Lecturer in Library Science.—{a) He has passed Master’s Degree examination 1st or 2nd class with Diploma/Degree in Library Science from a recognised University with at least 3 years pro­fessional experience in a library of standing; or

(b) he is graduate with Master’s Degree in Library Science (1st or high second class) from a recognised University with at least 3 years professional experience in a Library of standing.

(//) D istrict LibrarianjCollege Librarian!Junior Librarian {Central State Library, Solan).—He is graduate of a recognised University with Diploma in Library Science from a recognised institution;

(iii) Assistant Librarians {CollegejSchoollPublic and community Central Libraries.—He has passed at least Matriculation or its equivalent examination of any recognised University/Board with certificate in Library Science from a recognised institution.

(iv) Senior Technical Assistant {Audio-Visual) Education Unit.—He has passed at least Matriculation or its equivalent examination of a recognised University/Board with training in handling of Pro­jectors and repairs of Radios etc. etc.

(v) Photographer-cum-Darkroom Assistant {Audio-Visual Education- Unit).—He has passed at least Matriculation or equivalent ex­amination from any recognised University/Board and is acquinted with operation of skill and movie camera, developing of films and 35mm film strips knowledge of handling/fittings of photo­graphic equipment and preperation of photographic slides.

{vi) Artist {Audio-Visual-Education-Unit).—He has passed at least Matriculation Examination or equivalent examination from any recognised University/Board with Diploma in Arts, knowing preparation of simple non-projected slide i.e. scroll boxes, flash cards, charts, maps etc. and also the techniques of preparing pup­pets.

{vii) Instructor-projectionist and Projectionist {Audio-Visual-Educa- tion Unit).—^He has passed Matriculation or equivalent examina­tion from any recognised University or Board and has eitherI.T.I. Electrician Trade Certificate or is licence-holder in cinema­tography.

{via) Statistical Assistant—Essential.— B.Com. or B.A./B.Sc. with Economics/Maths/Commerce/Statistics as one of the subjects from a recognised University or equivalent or M.A. in Math/ Economics with statistics as one of the subjects from a recognised University or equivalent.

Desirable:—Knowledge of customs, manners and dialects of Himachal Pradesh,

(ix) Driver-cu.m-Projectionist (Audio-Visual Education-Unit Public Li­braries) and Driver-cum-Operator (Mobile Libraries in other im" titutions).—He has a Driving licence Oight and heavy vehicles) with knowledge of Hindi/English and knowledge in handling of Projectors with at least 3 years working experience.

(a:) Studio Artist—Essential.—(/) Matric (ii) Diploma in Commercial Art from a recognised Institution, (Hi) Proficiency in preparing Charts and Graphs, (iv) Two years experience in Publicity or ganisation or in a reputed commercial concern, (v) Experience of Dark Room Photography and handling of Audio-Visual equip­ment like Projectors, Tape Recorders.

Desirable.—Knowledge of customs, manners and dialects of Himachal Pradesh.

(xi) Driver (junior!senior scale).—He has a driving licence with know­ledge of Hindi/English and at least 2 years working experience.

(xii) Gallery Assistant (Bhuri Singh Museum Chamba).—Essential.—He is graduate with History as a subject. Good knowledge of Sans­krit Training as Gallery Assistant or Diploma in Muscology/ Archaeology.

(xiii) Nurse-c\im-Warden.—Matric with 3 Years Training.

(xiv) Compounder.—Matric with one Year’s Training.

7. Method o f Recruitment.—Posts in the service shall be filled either by promotion or by direct appointment in the following manner:—

(i) Lecturer in Library Science (Rs. 300i—600).—(a) IS % by promotion from amongst District Librarians/College Librarians and Junior Librarians, Central State Library Solan in the scale of Rs. 220—500 on the basis of merit-c«m-seniority; provided they fulfil the minimum prescribed qualifications for the post failing which appointment to be made by direct recruitment; and

(b) 25 % by direct recruitment.

(//) District Librarian!College Libarian!Junior Librarian {Rs. 220— 500).—(a) 75% by promotion from amongst Assistant Librarians (125—300) College, School, Public and Community Centre Libraries on the basis of seniority-c«m-merit; provided they ful­fil minimum prescribed qualifications, failing which by direct recruitment;

(b) 25 % by Direct Recruitment.

(Hi) Assistant Librarians (College!SchooljPublic and Cotnmunity Centre Libraries (125—300).—By direct recruitment subject to the

condition that 25 % of the posts will be reserved for Restorers, Library Attendants and Library Bearers provided they fulfil requisite prescribed qualification, failing which all posts to be filled by direct recruitment.

(v) Photographer-cam-Dark room Assistant (120—250).—By direct recruitment or by transfer of a person already in the service of the State.

(v/<7) Statistical Assistant (200—500).—By promotion from amongst graduate Clerks/Assistants(Rs, 160 400) having 5 years experience as Statistic'll Clerk/Assistant in theolficss of District Education Oflicors in the Department failing which by direct recruitment.

(ix) Driver-c\im-Projectionist and Driver-cum-opcrator (Rs. 120—250).— By promotion from amongst Drivers in the pay scale of Rs. 110— 180 on the basis of seniority -cum-mei it.

(x) Studio Artist (Rs. 160 -400). - By direct recruitment or by trans­fer of a person already in the service of the State.

(xi) Drivers (Rs. 110—180).—By promotion from amongst Drivers in the pay scale of Rs. 100—160 on the basis of seniority-cwm- merit.

(xii) Drivers (Rs. 100—160).—By direct recruitment or by transfer of a person already in the service of the State.

{xiii) Gallery Assistant (Rs. 225 —500).—By direct recruitment.

(xiv) Nurse-cum-Warden {Rs. 120—250).—By direct recruitment.

(xv) Compounder {Rs. 140—300).—By direct recruitment.

8. Special Provisions for Scheduled Castes and Tribes and Ex-Service­men. p e r c e n t a g e of posts as may be prescribed by the Government from time to time shall be reserved for Scheduled Caste and Scheduled Tribes cindidates as also for the e.xr-servicemen/Released Emergency Commissioned Oificers/Short Service Commissioned Officers, subject to the minimum qualifications bsing satisfied by them. A roster shall be maintained for this purpose as required under standing instructions of the Government on the subject. In any on^ recruitment year the total numb?r of vacancies reserved for ex-servicemen, Scheduled Castes and Scheduled Tribes etc. takec to­gether shall not exceed 45 % of the vacancies to be filled in that year.

9. Appointment by promotion.—Appointments to the service under rule 7 shall be made by the appointing authority on the recommendations of the Departmental Promotion Committee constituted by the Government from time to time or on the recommendations of the Himachal Pradesh Public Service Commission, as the case may be.

10. Probation o f members o f service.—^Members of the service shall remain on probation for two years>

(a) any period, after appointment to the service, spent on deputationon a corresponding or a higher post shall count towards period of probation fixed under this rule;

(b) in the case of an appointment by transfer, any period of work in equivalent or higher in rank prior to the appointment to the service, may at the discretion of the service, may at the discre­tion of the appointing authority, be allowed to be counted to­wards period of probation fixed under this rule.

Explanation.—(/) Approved officiating service shall be taken as a period spent on probation but no member who is officiating in any appointment shall on the completion of the probationary period prescribed, be confirmed until he is appointed against a permanent post in the service.

{it) If the work or conduct of any member during his period of pro­bation is, in the opinion of the appointing authority, not satis­factory, the appointing authroity may dispense with his services or revert him to his former post if he has been appointed to thatpost otherwise that by direct recruitment.\

(iii) On the completion of the period of probation of any member, the authority competent to make appointment to the post in the services as prescribed in rule 4 may confirm such member in his appointment subject to availability of a permanent post or if his work and conduct has, in the opinion of the appointing authority, not been satisfactory, may dispense with his services,or revert him to his former post, if he has been appointed other­wise than by direct appointment or may extend the period ofprobation and thereafter pass such orders on the expiry of firstperiod of probation PROVIDED ALWAYS that the totalperiod of probation including extension, if any, shall not exceedfour years.

11. Pay scale.—Members of the service will be entitled to the pay scaleas given in Annexure to these rules subject to their revision by the Govern­ment from time to time.

12. Discipline.—In respect of discipline, punishrnent and appeals,the members of service shall be governed by the provisions of rules whichare made by the Government or are made applicable by the Government in this behalf.

13. Seniority o f members o f service.—(1) Persons appointed in a sub­stantive/officiating capacity to a grade prior to issue of these rules, shall

rfetain the relative seniority already assigned to them or such seniority as may tthereafter be assigned to them under the existing orders applicable to their (cases and shall be senior to all others in that grade.

Explanation.—For the purpose of these rules;

{a) persons who are confirmed retrospectively with effect from a date earlier than the issue of these rules; and

{b) persons appointed on probation to a permanent post substantively vacant in a grade prior to the issue of these rules;

shall be considered to be permanent officers of the grade.

(2) Subject to the provisions of sub-rule (3) below, permanent officers o f each grade shall be ranked senior to persons who are officiating in that grade

(3) Direct Notwithstanding the provisions of sub-rule(2) above,the relative seniority of all direct recruits shall be determined by the order o f merit in which they are selected for such appointment, on the recommenda- t:ion of the selecting authority, persons appointed as a result of an earlier s*election being senior to these appointed as a result of subsequent selection:

Provided that where persons recruited initially on a temporary basis are confirmed subsequently in an order, different than the order of merit i ndicated at the time of their appointment seniority shall follow the orders o f confirmation and not the original order of merit:

Provided further that a person who does not join within the specified period shall lose his seniority according to the selection list and shall rank i;n the seniority list next to the person who joined earlier:

Provided further that he shall not lose his seniority, if the fact of his jcoining later caused by circumstances beyond his control and for the rea- s;ons to be recorded in writing and if the appointing authority is satisfied t hat this was so.

(4) Promotees.—(i) The relative seniority of persons promoted to the V'arious grades shall be determined in the order of their selection for such promotion:

Provided that where persons promoted initially on a temporary basis are confirmed subsequently in an order different than the order of merit indicated at the time of their promotion seniority shall follow the order of confirmation and not the original order of merit.

(n) Where promotions to a grade are made from more than one grade, tlhe eligible persons shall be arranged in sparate list in the order of their relative seniority in their respective grades, thereafter the Departmental Promotion Committee shall select persons for promotion from each list sttrictly on the basis of seniority subject to the rejection of unfit and shall airrange all the candidates selected from different list in a consolidated form oif merit which will determine the seniority of persons on promotions to the higher grades.

(5) Relative seniority o f direct recruits and promotees.—The relative seniority of direct recruits and of promotees shall be determined according to tKe rotation of vacancies reserved for direct recruitment and promotion respectively in these rules.

(6) Transfers.—The relative seniority of persons appointed by transfer in the service from or other departments of State Government shall be determined in accordance with the order of their selection for such transfer.,

Explanatory memorandum—Rule 4(1).—Where promotions are made on the basis of selection by a Departmental Promotion Committee the seniority of such promotees shall be in the order in which they are recommended for such promotion by the committees. Where promotions are made on the basis of seniority subject to the rejection of unfit, the seniority of persons considered fit for promotion at the same time shall be the same as the re­lative seniority in the lower grade from which they are promoted. Where, however, a person is superseded by a junior, such persons shall not if he is subsequently found suitable and promoted take seniority in the higher grade over the junior persons who had superseded him.

Rule 5.—A roster should be maintained based on the reservations for direct recruitment and promotion in the recuitment rules.

Appointments should be made in accordance with this roster and seniority determined accordingly.

Illustration.—WhQTQ 75% of the vacancies are reserved for promotion and 25% for direct recruitment, each direct recruit shall be ranked in senioiity below 3 (tiiree) promotees. If for any reason, a direct recruit or a promotee ceases to hold the appointment in the grade, the seniority list shall not be re-arranged merely for the purpose or ensuring the proportion referred to above.

14. Leave ;;e/w/o/2. -In respect of leave, pension and other (co­gnate) matters not specifically mentioned in these rules, the members of service shall be governed by the rules instructions/executivr orders as are made applicable by the Government from time to time.

15. Training and examination.—-The members of service shall have to qualify examinations or to undergo training as may be prescribed by the Department/Government from time to time for any class of the posts speci­fied in annexure to these rules.

16. Power to relax.—Where the Governor is of the opinion that it is necessary or expedient to do so, it may by order, for reasons to be recorded in writing relax any of the provisions of these rules with regard to any class or category of persons/posts.

No. 1-323/70-Edu.A.—In supersession of this Department Notification of even number, dated 4-10-72 and in exercise of the powers vested in him vide proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the following rules in respect of Himachal Pradesh Education Department Class III Ministerial Services an regard to the following matters, namely:—

(1) the method of recruitment to the Himachal Pradesh EducationClass III {Ministerial Section) Service',

(2) the qualifications necessary for appointment to such service andposts; and

(3) the conditions of service of persons appointed to such service and posts for the purposes of probation, seniority, promotion and confirmation.

RECRUITMENT RULES

P a r t I— ^Ge n e r a l

1. Short title and commencement.—(a) These rules may be called the Himachal Pradesh Education Class III (Ministerial Section) Service Rules1972.

{b) These rules shall come into force from the date of publication in the 'Official Gazette.

2. Definition.—In these rules, unless there is anything repugnent in the ■subject or context,—

(«) “Governor” means the Governor of Himachal Pradesh.

{b) “Government” means the Government of Himachal Pradesh.

(c) “Director” means the Director of Education, Himachal Pradesh, or any other authority appointed to perform the duties of the post of Director of Education in Himachal Pradesh.

(d) “Recognised University/Board” means any University/Board incorporated by law in force in India or any other University/ Board which is declared by the Government of India or the Go­vernment to be a recognised University/Board for the purpose of these rules.

(e) “The Service” means the Himachal Pradesh Education Class III(Ministerial Section) Services.

(/) “Direct Recruitment” means a recruitment made otlierwise than by promotion.

(g) “Departmental Promotion Committee” means a Committee appointed by the Government for the selection of candidates for appointment to posts and for promotion to higher grades in the service.

(h) “Scheduled Caste” means the Castes, Races or Tribes or parts of groups within Castes, Races or Tribes specified in the Schedule to the Constitution (Scheduled Castes) Order, 1950 as amended by section 19(1) read with First Schedule of the State of Himachal Pradesh Act, 1970 (53 of 1970) and as it may further be amended from time to time.

(0 “ Scheduled Tribes” means the tribes or tribal communities or parts of groups within Tribes or Tribal communities specified in Sch­edule to the Constitution (Scheduled Tribes) Order, 1950, as amen­ded by the Section 20(1) read with Third Schedule of the State of Himachal Pradesh Act, 1970 (53 of 1970) and as it may be amended from time to time.

(j) “Annexure” means an annexure attached to these rules.

(k) “ Department’' means the Department of Education, Himachal Pradesh.

(/) “ Departmental Candidates” means an employee or employees serving in Education Department who on fulfilment of the re­quisite minimum qualifications, apply for the vacant posts.

(m) “£'x-Servicemen” means the discharged Army Personnel.

R e c r u it m e n t to S er vic es

3. Character o f post.—The service shall comprise the posts and grades as specified in annexure to these rules, subject to any additions/reductions that may be made by or under the orders of the Government.

4. Authority competent to make appointments.—All appointments to posts in the services shall be made by the Director in accordance with these rules.

5. Nationality^ eligibility and age etc.—(1) No person shall be appointed to the service unless:—

{a) He/She is a citizen of India, and

(/) who or whose father has been continuously residing in Himachal Pradesh for a period of not less than 3 years im­mediately preceding th e last date fixed for making applica­tions to a post, or

(«) whose father, if dead, continuously resided in Himachal Pradesh for a period of not less than 3 years immediately preceding his death and who has, after the death of his father, continued to reside in Himachal Pradesh upto the last date fixed for making applications for appointment to a post:

Provided that any period of temporary absence from Himachal Pradesh for the purpose of prosecuting his studies or for undergoing medical treatment or any period for such temporary absence not exceeding three months for any other reasons, shall not be deemed to constitute a break in the conti­nuity of such residence, but for the purpose of calculating the said period of three years any such period of temporary absence shall be excluded; and

(Hi) who produces before the appointing authority concerned, if so required by it, a certificate of eligibility granted under rule IV of the Himachal Pradesh, Manipur and Tripura Public Employment (Requirement as to Residence) Rules, 1959; and in case the Governor in any exceptional case and for reasons to be recorded in writing, relaxes the provisions of sub-rule (a) of this rule, in exercise of his discretion under Rule 5 of the Himachal Pradesh, Manipur, Tripura Public Employment (Recquirement as to Residence) Rules, 1959 a candidate for appointment to any post in the service must be:—

(a) a citizen of India, or(b) a subject of Sikkim, or(c) a subject of Nepal, or(d) a person of Indian origin who has migrated from Pakistan

with the intention of permanently settling in India:

Provided that if he belongs to category (c) or (d) he must be a personi n whose favour a certificate of eligibility has been given by the Government o f India:

Provided further that if he belongs to category (d) the certificate of esligibility will be valid only for a period of one year from the date of his appointment beyond which he can be retained in service only if he has be­come a citizen of India. A candidate in whose case a certificate of eligibility iis necessary, may be admitted to an examination or interview and may also provisionally be -appointed subject to the necessary certificate being given to him by the Goverament; and

(2) Unless he is already in Government service, must produce:—

(0 a certificate of good moral character from the Principal Academic Officer of his/her University, College, School or Head of his/her educational or technical institution last attended;

(//) certificate of good moral character from two responsible persons, not being his relatives, who are well acquainted with him in private

life and unconnected with his University, College, School of other educational or technical institution;

(Hi) a medical certificate, as required under Rule 10 of the Fundamental Rules and Rules 3 and 4 of the Supplementary Rules;

(iv) a declaration to the effect that he has not more than one wife living;

Note.—No person who has more than one wife living or who having a spouse living, marries in any case in which such marriage is void by reason of its taking place during the life time of such spouse, shall be eligible for appointment to service.

(v) in the case of female Government servant, declaration to the effect that she has not married a person having already living wife.

Note.—No woman, whose marriage is void by reason of the husband having a wife living at the time of such marriage or who has merried a person who has a wife living at the time of such marriage, shall be eligible for appointment to service:

Provided that the Himachal Pradesh Government may, if satisfied that there are special grounds for doing so exempt any person from the opera­tion of rules in clauses (/v) and (v) above subject to observance of the Cen­tral Government’s instructions in this behalf.

(3) Must not be less than 18 years and not more than 27 years of age on the date of his appointment:

Provided further that minimum and maximum age limits as prescribed may be relaxed by the competent authority in accordance with the pro­visions of the rules/instructions issued by the Government from time to tim e:

Provided further that the maximum age limit may be relaxed in the case of Scheduled Castes/Tribes candidates, displaced persons and other special categories in accordance with the orders issued by the Government of India from time to tim e:

Provided further that knowledge of customs, manners and dialects of Himachal Pradesh shall be and desirable qualification for purpose o f eligi­bility to the service.

6. Educational and technical qualifications for direct recruitments.—The educational and technical qualifications for direct recruitment to the posts and methods of recruitment to various posts shall be as specified in the Annexure.

7. Special provision for scheduled castesi tribes and Servicemen.—Such percentage of posts, as specified by the Government, from time to time shall be reserved for Scheduled Castes and Scheduled Tribes candidates and Re­leased Indian Armed Forces personnel who joined service or were commis­sioned on or after 1-11-62, and are released at any time thereafter 10% of the vacancies will be reserved for Class IV Government employees of Edu­cation Department, subject to the condition o f fulfilment of minimum

qualifications being satisfied by them. In any one recruitment year the total number of vacancies reserved for Class IV, Released Indian Armed Forces personnel, Scheduled Castes and Scheduled Tribes taken together should not exceed 50 % of the vacancies to be filled in that year.

8. {a) Procedure for recruitment by promotion.—The recruitment by promotion to the posts shall be made on seniority-CMW-merit basis subject to the rejection ofthe unfit from amongst the persons holding posts and with the length of service prescribed in the rules. In other words, for recruitment by promotion both merit and seniority of eligible persons will be attached due importance.

{b) Procedure for direct recruitment.—The vacancy/vacancies shall be advertised and circulated amongst the Department of the Government as may be required under the rules and instructions for the time being in force. The selection will be made on the basis of a viva voce as may be prescribed in the advertisement/circular.

9. Probation o f members o f service.—Members of the service shall re­main on probation as specified in the Annexure.

Explanation.—Approval officiating service shall be taken as a period spent on probation but no member who is officiating in any appointment shall on the completion of the probatioaery period prescribed, be confir­med until he is appointed against a permanent post to the service.

(i7) If the work or conduct of any member during his period of pro­bation is not satisfactory , the appointing authority may dispense with his services or revert him to his former post if he has been appointed to that p ost otherwise than by direct recruitment.

{Hi) On the completion of the period of probation of any member, the authority competent to make appointment to the post in the service as prescribed in Rule 4 may confirm such member in his appointment sub­ject to availability of a permanent post or if his work and conduct has, in the opinion of the appointing authority, not been satisfactory, may dis­pense with his service, or revert him to his former post, if he has been appointed otherwise than by direct appointment or may extend the period of probation and thereafter pass such orders on the expiry of the first period of probation:

Provided always that the total period of probation including extension, if any, shall not exceed three years.

10. Pay on recruitment!appointment.—The person appointed to any post in the service will get the minimum of the time-scale prescribed for that post, unless the recommendations of the Himachal Pradesh Public Service Commission or the Departmental Promotion Committee are to the contrary or the fixation of the pay under the rules results in pay being fixed at a higher stage than the minimum.

11. Discipline.—In respect of the discipline, punishment and appeals, the members of the service shall be governed by the provisions of the Central Civil Service (Classification, Control and Appeal) Rules, 1965, the Central

Civil Services (Conduct) Rules, 1964, amended from time to time or such other rules as may be enforced by the Government.

12. Seniority o f members o f service.—Subject to the provisions of para­graph (2) below, persons appointed in a substantive/officiating capacity to a post prior to issue of these rules, shall retain the relative seniority already assign^ to them or such seniority as may thereafter be assigned to them under these rules applicable to their cases and shall en bloc be senior to all others in that grade.

Explanation.—For the purpose of this rule.—

{a) persons who are confirmed retrospectively with effect from a date earlier than the issue of this rule, and

{b) persons appointed on probation to a permanent post substan­tively vacant in a scale prior to the issue of this rule,

shall be considered to be permanent officers in the scale.

(2) Subject to the provisions of paragraph (3) below, permanent officers shall be ranked senior to persons who are officiating in that scale.

(3) Direct recruits.—The relative seniority of all direct recruits shall be determined by the order of merit of which they are selected for such ap­pointment, on the recommendation of the selecting authority, persons appointed as a result of an earlier selection being senior to those appointed as a result of subsequent selection:

Provided that where persons recruited initially on a temporary basis are confirmed subsequently in an order, different than the order of merit indicated at the time of their appointment, seniority shall follow the orders of confirmation and not the original order of m erit:

Provided further that a person who does not join within the specified period shall lose his seniority according to the select list and shall rank in the seniority list next to the person who joined earlier:

Provided further that he shall not lose his seniority if the fact of his join­ing later caused by circumstances beyond his control and for the reasons to be recorded in writing and if the appointing authority is satisfied that this was so.

(4) Promotion.—(/) The relative seniority of persons promoted to the various grades shall be determined in the order of their selection for such promotion:

Provided that where persons promoted initially on a temporary basis arec onfirmed subsequently in an order different than the order of merit in­dicated at the time of their promotion seniority shall follow the order of confirmation and not the original order of merit.

(i7) Where promotions to a grade are made from more than one grade the eligible persons shall be arranged in separate list in the order of their

relative seniority in their respective grades. Thereafter the Departmental Promotion Committee shall select persons for promotion from each list strictly on the basis of seniority subject to the rejection of unfit and shall arrange all the candidates selected from different lists in a consolidated form of merit which will determine the seniority of persons on promotions to the higher grades.

(5) Relative seniority o f direct recruits and promotees.—The relative seniority of direct recruits and of promotees shall be determined according to the rotation of vacancies reserved for direct recruitment and promotion respectively I n these rules.

(6) Transfers.—-The relative seniority of persons appointed by transfer in the service from or other Departments of State Government shall be determined in accordance with the order of their selection for such transfer.

(7) Explanatory Memorandum.—'Where promotions are made on the basis of selection by a Departmental Promotion Committee the seniority of such promotees shall be in the order in which they are recommended for such promotion by the Committee. Where promotions are made on the basis of seniority subject to the rejection of unfit, the seniority of persons considered fit for promotion at the same time shall be the same as the rela­tive seniority in the lower grade from which they are promoted. Where, however, a person is superseded by a junior, such person, shall not if he is subsequently found suitable and promoted take seniority in the higher grade over the junior persons who had superseded him,

(8) Direct recruit shall be ranked in seniority below the promotees. If for any reason, a direct recruit or a promote e ceases to hold the appoint­ment in the grade, the seniority list shall not be re-arranged merely for the purpose of ensuring the proportion referred to above.

13. Leave and Pension.—In respect of leave, pension and other (co­gnate) matters the members of the service shall be governed by the rules/ orders in force from time to time.

14. Training and Examination.—The members of service shall have to qualify such examinations or to undergo such training as may be prescribed by the Government from time to time for any class of posts specified in the Annexure.

15. Crossing o f efficiency bar.—No member of the service shall be allowed to cross the efficiency bar unless in the opinion of the appointing authority he has worked satisfactorily and his integrity is unquestionable,

16. Saving.—All matters not provided for in these rules shall be governed by such general or special rules as may be framed by the Government from time to time.

No. 1-323/70-Ecu-A.—'In supersession of this Department Notification of even number, dated 4th October, 1972 and in exercise of the powers vested in him vide proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consulation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules in respect o f Himachal Pradesh Education Department Class III Ministerial Services in regard to the following matters namely:—

(1) the method of recruitment to the Himachal Pradesh Education Class III (Ministerial Section) Service;

(2) the qualifications necessary for appointment to such service andposts; and

(3) the conditions of service of persons appointed to such service and posts for the purposes of probation, seniority, promotion and confirmation.

RECRUITMENT RULES

P a r t I — G e n e r a l

1. Short title and commencement.—{a) These rules may be called the Himachal Pradesh Education Class III (Ministerial Section) Service Rules,1972.

(Z?) These rules shall come into force from the date of publication in the Official Gazette.

2. Definition.—In these rules, unless there is anything repugnant in the subject or context,—

(a) “ Governor” means the Governor of Himachal Pradesh .

{b) “Government” means the Government of Himachal Pradesh.

(c) “Director” meansHhe Director of Education, Himachal Pradesh,or any other authority appomted to perform the duties of the post of Director of Education in Himachal Pradesh.

(d) “Recognised University/Board” means any University/Board incorporated by law in force in India or any other University/ Board which is declared by the Government of India or the Go­vernment to be a recognised University/Board for the purpose of these rules.

(e) “The Service” means the Himachal Pradesh Education Class III(Ministerial Section) Services.

( /) “Direct Recruitment” means a recruitment made otherwise than by promotion.

(g) “Departmental Promotion Committee” means a Committee appointed by the Government for the selection of candidates for appointment to posts and for promotion to higher grades in the service.

(h) “Scheduled Castes” means the Castes, Races or Tribes or parts of groups within Castes, Races or Tribes specified in the Schedule to the Constitution (Scheduled Castes Order, 1950 as amended by section 19(1) read with Fifth Schedule of the State of Himachal Pradesh Act, 1970 (53 of 1970) and as it may further be amended from time to time.

(/) “ Schedule Tribes” means the tribes or tribal communities or parts of groups within tribes or tribal communities specified in Schedu­led to the Constitution (Schedule Tribes) Order, 1950, as amended by the section 20(1) read with Third Schedule of the State of Himachal Pradesh Act, 1970 (53 of 1970) and as it may be amended from time to time.

(j) “Annexure” means an annexure attached to these rules.

(k) “Department” means the Department of Education, Himachal Pradesh.

(/) “Departmental Candidates” means an employee or employees Feiving in Education Department who on fulfilment of the requi­site minimum qualifications, apply for the vacant posts.

{m) “£jc-Servicemen” means the discharged Army Personnel.

3 . Character o f post.—^The Service shall comprise the post and grades as, specified in annexure to these rules, subject to any additions/reductions thi^t may be made by or under the orders of the Government.

4. Authority competent to make appointments.—^All appointments to posts in the services shall be made by the Director in accordance with these rules.

5. Nationality, eligibility and age etc.—(1) No pefson shall be appointed to the service unless:—

(a) He/She is a citizen of India, and

(0 who or whose father has been continuously residing in Himachal Pradesh for period of not less than 3 years immediately preceding the last date fixed for making

applications to a post, or

(//) whose father, if dead, continuously resided in Himachal Pradesh for a period of not less than 3 years immediately preceding his death and who has, after the death of his father, continued to reside in Himachal Pradesh upto the last date fixed for making applications for appointment to a post:

Provided that any period of temporary absence from Himachal Pradesh for the purpose of prosecuting his studies or for undergoing medical treatment or any period of such temporary absence not exceeding three months for any other reasons, shall not be deemed to constitute break in the continuity of such residence, but for the purpose of calculating the said period of three years any such period of temporary absence shall be excluded; and

{Hi) who produces before the appointing authority concerned, if so required by it, a ceitificate of eligibility granted under rule IV of the Himachal Pradesh, Manipur and Tripura Public Em­ployment (Requirement as to Residence) Rules, 1959; and in case the Governor in any exceptional case and for reasons to be re­corded in writing, relaxes the provisions of sub-rule (a) of this rule, in exercise of his discretion under Rule 5 of the Himachal Pradesh, Manipur and Tripura Public Employment (Require­ment as to Residence) Rules, 1959, a candidate for appointment to any post in the service must be:—

{a) a citizen of India, or {b) a subject of Sikkim, or(c) a subject of Nepal, orid) a person of Indian origin who has migrated from Pakistan

with the intention of permanently settling in India;

Provided that if he belongs to category (c) or (d) he must be a person in whose favour a certificate of eligibility has been given by the Government of India:

Provided further that if he belongs to category (d) the certificate of eligibility will be valid only for a period of one year from the date of his appointment beyond which he can be retained in service only if he has

become a citizen of India. A candidate in whose case a certificate of eligibi­lity is necessary, may be admitted to an examination or interview and he may also provisionally be appointed subject to the necessary certificate being given to him by the Government; and

(2) Unless he is already in Government service, must produce:—

(0 a certificate of good moral character from the Principal Academic Officer of his/her University, College, School or Head of his/ her educational or technical institution last attended;

(ii) certificate of good moral character from two responsible persons, not being his relatives, who are well acquiainted with him in private life and unconnected with his University, College, School or other educational or technical institution;

(///) a medical certificate, as required under Rule 10 of the Funda­mental Rules and Rules 3 and 4 of the supplementary Rules;

{iv) a declaration to the effect that he had not more than one wife living;

IVote.—No person, who has more than one wife living or who having a spouse living, marries in any case in which such marriage is void by reason of its talcing place during the life time of

- such spouse, shall be eligible for appointment to service;

(v) in the case of female Government servant, a declaration to the effect that she has not married a person having already a living wife:

Note.—No woman, whose marriage is void by reason of the husband having a wife living at the time of such marriage or who has mar­ried a person who has a wife eligible for appointment of service:

Provided that the Himachal Pradesh Government may, if satisfied that there are special grounds for doing so exempt any person from the opera- ti(on of rules in clauses (iv) and (v) above subject to observance of the Cen- tr:al Government’s instructions in this behalf.

(3) Must not be less than 18 years and not more than 27 years of age on the date of his appointment:

Provided further that minimum and maximum age limits as prescribed may be relaxed by the co npstent authority in accordance with the pro- visiions of the rules/instructions issued by the Government from time to tim e:

Provided fiirther that the maximum age limit may be relaxed in the case of Scheduled Castes/Tribes candidates, displaced persons and other special categories in accordance with the orders issued by the Government of India from time to time:

Provided further that knowledge of customs, manners and dialects of Hiimachal Pradesh shall b^ an desirable qualification for purpose of eli­gibility to the service.

6. Educational and technical qualifications for direct recruitees.—The Educational and Technical qualifications I'or direct recruitment to the posts and method of recruitment to various posts shall be as specified in the Annexure.

7. Special provision for scheduled castes/tribes and servicemen.—Such per­centage of posts, as specified by the Government, from time to time shall be reserved for scheduled castes and scheduled tribe candidates and re­leased Indian Armed Forces Personnel who joined service or were Commis­sioned on or after 1-11-62, and are released at any time thereafter. In any one recruitment year the total number of vacancies reserved for Class IV, Released Indian Armed Forces Personnel, Scheduled Castes and Schedaled Tribes taicen together should not exceed 50 % of the vacancies to be filled in that year.

8. Procedure for recruitment by promotion.—I’he recruitment by pro­motion to the posts shall be made on seniority-cwm-jnerit basis subject to the rejection of the unfit from amongst the pcisons holding posts and with the length of service prescribed in the rules. In other words, for recruitment by promotion both merit and seniority of eligible persons will be attached due importance . In the case of promotion to the selection posts of Superintendents the basis will be changed to marit-a/m-seniority.

9. Probation o f members o f service.—Members of the service shall remain on probation as specified in the Annexure.

Thereafter the Departmental Promotion Committee shall select persons for promotion from each list strictly on the basis of seniority subject to the rejection of unfit and shall arrange all the candidates selected from different lists in a consolidated form of merit which will determine the seniority of persons on promotions to the higher grades.

(5) Relative seniority o f direct recruits and promotees.—The relative seniority of direct recruits and of promotees shall be determined according to the rotation of vacanices reserved for direct recruitment and promotion respectively in these rules.

(6) Transfers.—The relative seniority of persons appointed by transfer in the service from or other departments of State Government shall be de­termined in accordance with order of their selection for such transfer.

(7) Explanatory Memorandum.—Where promotions are made on the basis of selection by a Departmental Promotion Committee the seniority of such promotees shall be in the order in which they are recommended for such promotion by the Comrnittee. to Article 309 of the Constitution of India, the Governor, Himachal Pradesh is pleased to make the following rules to amend further the Himachal Pradesh Education Class III (Ministerial Section) Services Rules, 1972, notified vide this Department Notification No. 1-323/70-Edu-A, dated the 26th April, 1973:—

1. Short title and commencement.—(/) These rules may be called the Himachal Pradesh Education Class III (Ministerial Section) Services (Second Amendment) Rules, 1975.

{ii) They shall come into force from the date of issue of this Notifica­tion.

2. In the Annexure to the Education Department Class III (Minis­terial Section) Services Rules, 1972, the following amendments be made; namely:—

P a r t I— G e n e r a l

1. Short title and commencement.—{a) These rules nray be called the Himachal Pradesh Education Department Class IV Service (Recruitment, Promotion and certain Conditions of Service) Rules, 1973.

(b) These rules shall come into force from the date of their publication in the Official Gazette.

4. Definitions—In these rules, unless there is anything repugnant in the subject or context,—

(a) “annexure” means an annexure to these rules;

{b) “department” means the Department of Education, Himachal Pradesh;

(c) “departniental candidate” means an employee serving in theEducation Department who fulfils the requisite minimum quali­fications and applies for the vacant post;

(d) “direct appointment” means an appointment made otherwise than by way of promotion from amongst the members of the service or by transfer of an official already in the service of the Government;

((?) “iSv-Servicemen” means a person discharged from the Armed F'orces oif the U nion;

(/) “Government” means the Government of Himachal Pradesh;

(g) “Governor” means the Governor of Himachal Pradesh;

(A) “Head of Department” means Director of Education, Himaphal Pradesh;

(0 of Office” means the Heads of Educational InstitutionsOffices of the H.P. Education Department;

(j) “Member” means a member of the Himachal Pradesh, Education Department Class IVservice;

{k) “Recognised University” means a University established by law in India;

(/) “Scheduled Caste” means castes, races or tribes or parts of groups within crates, races or tribes specified in the Schedule to the Constitution (Scheduled Caste) Order, 1950 as amended by sec­tion 19(1) read with, the First Schedule of the State of Himachal Pradesh Act, 1970 (53 of 1970) and as it may further be amended frpmtim,et9 time;

(m) “Scheduled Tribes” means the tribes, tribal communities or parts of groups within tribes, tribal communities specified in the Schedule to the Constitution (Scheduled Tribes) Order, 1950, as amended by section 20(1) read with Third Schedule of the Stat? of Himachal Pradesh Act, 1970 (53 of 1970) and as it may be amended from time to tim e;

(9) “Service” means the Himachal Pradesh Education Department Class IV service; and

ip) “State” means the State of Himachal Pradesh.

RECRUITMENT TO SERVICE

3. Character o f posts.—^The character {i.e. designation grade etc.) of the various posts included in the services and their rates of pay shall 3e as indicated in the annexure to these rules.

4. Authority empowered to make appointment.—^All appointments to posts in the service shall be made by the Head of Office or any other auth­ority declared as such by the Governor.

5. Condition o f service.—(I) A candidate for appointment to . any po*st in the service must be,—

{a) a citizen of India, or{b) a subject of Sikkim, or(c) a subject of Nepal, or(d) a person of Indian origin who has migrated from Pdkistan v 'ith

intention of permanently settling in India:

Provided that if he/she b-longs to category (c) or (d) he/she musit be a person in whose favour a certificate of eligibility has been given by the Government ol India:

provided further that if he belongs to category (d) the certificate ef eli­gibility will be valid only for a period of one year from the date of appoint­ment beyond which he can be retained in service only if he has become a citizen of India. A candidate in whose case a certificate of eligibility is nece­ssary may be admitted to an examination or interview and he m% also pro­visionally be appointed subject to the necessary certificate being, given to him by the Government; and

(2) Unless the candidate is already in Government service he must produce:

(/) a certificate of good moral character from the Principal acade­mic Officer of the University, College, School or the Head of the Educational or Technical Institution last attended;

(ii) certificate of good moral character from two responsible persons not being his relatives who are well acquainted with his privaite life and unconnected with his University, College, School or other Educational or Technical Institution;

(Hi) a medical certificate, as required under the service rules made applicable to the service by the Goverrmient from time to time:

(?>) a declaration to the effect that he has not more than one living wife.

Note: No person who has more than one wife living or Who, having a spouse living , marries in any case in which such marriage is void by reason of its taking place during the life time of such spouse shall be eligible for appointment to the service; ' ’

(v) in the case of a female Government servant, declaration to "the effect that she has not married a person having already a living wife.

Note: No woman whose marriage is void by reason of the husband having a wife living at the time of such marriage or who has mar­ried a person who has a wife living at the time of such marriage shall bs eligible for appointment to the service:

Provided that the Himachal Pradesh Government may, if satisfied that there are special grounds for doing so, exempt any such person in whose case second marriage is permissible in law from the operation of rules in clause (/v) and (v) above.

(3) The candidate must not be less than 18 years and not more than 25 years of age on the date of his appointment:

Provided that minimum and maximum age limits as prescribed may be relaxed in pursuance of the instructions laid down by the Government from time to time or in case of a Departmental candidate already in service on regular basis or a contingent paid official:

Provided further that the maximum age limit may be relaxed in the case of Scheduled Caste/Tribe candidates, displaced persons and other special categories in accordance with the orders issued by the Government from time to time.

6. Educational and technical qualifications o f candidates.—No person shall in future be appointed to the service unless in the case of appoint­ment to the posts o f:

(/) Gestetnor Operator.—Has passed the Middle School Examination conducted by Education Department/by School Board of Educa­tion or from a recognised University with at least 2 years experience of handling duplicating machine. The prescribed educational qualifications may be relaxed in the case of Departmental can­didates; provided that the Departmental proraotee is either per­manent or quasi-permanent in the grade of Peon or other Class IV post and has put in at least five years of service in that grade and possesses knowledge of English.

(//) Restorer.—Has passed the Middle School Examination conduc­ted by Education Department/School Board of Education or from a recognised University. The prescribed educational quali­fications may be relaxed in the case of Departmental candidates; provided that the Departmental promotee is either permanent or quasi permanent in the grade of Peon or other similar Class IV: post and has put in at least five years of service in the grade and possesses knowledge of English.

(///) Laboratory Attendant.—Has passed the Middle School Examina­tion (with Science) from Education Department/School Board of Education or from a Recognised University.

(rv) Laj'car (iVCC).—Has knowledge of Hindi/English, has served in the Armed Forces and has knowledge of handling arms and amunition;

(v) Jamadar.—^Has normally rendered five years service, (officiating or confirmed) as a Peon or any other Class IV servant in the Department.

(W) Library Attendant.—^Has passed the Middle Standard Examina­tion of a recognised School/Board/University.

(v«) Library Bearer.—Has passed the Middle Standard Examination of a recognised School/Board/University.

{viii) Binder.— passed the Middle standard Examination of a recognised School/Board/University.

(ix) Staff Attendant.—Has passed the Middle standard Examination of a recognised school/Board/University;

(aj) Beldar.—Has passed the Middle standard Examination of a recognised School/Board/University.

(xi) Animal Collector.—Has passed the Middle Standard Examination of a recognised School/Board/University.

{xii) Laboratory Assistant.—^Has passed the Middle Standard Examina­tion (with Science) of a recognised School/Board/University.

7. Method o f recruitment.—Posts in the service shall be filled either by praniotion or by direct appointment in the following manner:—

(0 Gestetnor Operator.—75 % by promotion from amongst the Peoms and other regular Class IV employees on the basis of seniority subject to the rejection of unfit and remaining 25 % of the postts by direct recruitment.

(//) Restorer.—75 % by promotion from amongst the Peons and other regular Class IV employees of the same pay-scale on the basis of seniority of Class IV employees working within the respective jurisdiction of the Head of Office subject to the rejection of unfit and 25 % by direct recruitment.

{Hi) Laboratory Attendant.—75% by promotion from amongst the Peons and other similar Class IV employees on the basis of seniority subject to the rejection of unfit and remaining 25 % posts by direct recruitment. The quota fixed for promotion is subject to the availability of candidates with requisite qualifications otherwise the posts will be filled by direct recruitment.

(/v) Lascar.—50% by promotion from amongst Peons and other Class IV employees working in the NCC Organisation on the basis of seniority subject to the rejection of unfit. The remaining 50 % posts will be filled by direct recruitment of eJc-servicemen.

(v) Jamadar.— %y promotion from amongst Peons and other regular Class IV employees on the basis of seniority subject to the re­jection of the unfit.

(vi) Library Attendant.—By promotion from amongst Class IV ser­vants on the basis of seniority and subject to the rejection of the unfit failing which by direct recruitment.

(V/7) Library Bearer.—By promotion from amongst Class IV contingent paid employees on the basis of seniority and subject to the re­jection of the unfit, failing which by direct recruitment.

{xii) Laboratory Assistant.—75 % by promotion from amongst Peons and other similar Class IV employees on the basis of seniority and suitability to the nature of job, and rejection of the unfit and fulfilment of qualification failing which by direct recruitment;

8. Special provisions for Scheduled Caste!Tribe and Ex-servicemen.—Such percentage of posts as may be prescribed by the Government from time to time shall be reserved for Scheduled Caste and Scheduled Tribe and the

£jc-servicemen candidates subject to the minimum qualifications being satis­fied by them, A roster shall be maintained for this purpose as required under­standing instructions of the Government.

9. Appointment on the recommendations o f the Departmental Promotion Committee.—Appointments to the service under Rule 7 shall be made by the Appointing Authority on the recommendations of the Departmental Pro­motion Committee constituted by the Government from time to time.

10. Probation o f Members o f Service.—Members of the service shall remain on probation for two years:

(a) any period, after appointment to the service spent on deputation on a corresponding or a higher post shall count towards period of probation fixed under this rule;

(b) in the case of an appointment by transfer, any period of work in equivalent or higher post prior to the appointment to the service may at the discretion of the Appointing Authority, be allowed to be count towards period of probation fixed under this rule.

Explanation.—(/) Approved officiating service shall be taken as a period spent on probation but no member who is officiating in any appointment shall on the completion of the probationary period prescribed, be confirmed untill he/she is appointed against a permanent post in the service.

(h) If the work or conduct of any member during his/her period of pro­bation is unsatisfactory in the opinion of the appointing authority he may dispense with his services or revert him/her to his former post if he/she has been appointed to that post otherwise than by direct recruitment.

L.{Hi) On the completion of the period of probation of any member, the

authority competent to make appointment to the post in the services as prescribed in Rule 4 may confirm such member in his appointment subject to the availability of a permanent post or if his/her work and conduct has, in the opinion of the appointing authority, not been satisfactory, may dis­pense with his/her services, or revert him/her to his former post, if he/she has been appointed otherwise than by direct appointment or may from time to time extend the period of probation and thereafter pass such orders as on the expiry of the first period of probation:

Provided always that the total period of probation including extension, if any, shall not exceed four years.

11. Pay Scale.—Members of the service will be entitled to the pay scale as given in the annexure to these Rules subject to their revision by the Government from time to time.

12. Discipline.—In respect of discipline, punishment and appeals the members of service shall be governed by the provisions of rules which are made by the Government or are made applicable by the Government in this behalf.

13. Seniority o f members o f service.—(1) Persons appointed in a sub­stantive/officiating capacity to a grade prior to issue of these rules, shall

detain the relative seniority already assigned to them or such seniority as may thereafter be assigned to them under the existing orders applicable to their cases and shall be senior to all others in that grade the seniority will be maintained office/institution-wise by the concerned Heads of Office.

(fi) persons who are confirmed retrospectively with effect from a date earlier than the issue of these rules, and

ip) persons appointed on probation to a permanent post substan­tively vacant in a grade prior to the issue of these rules,

shall be considered to be permanent holders of the grade,

2. Subject to the provisions of sub-rule (3) below, permanent holders of each grade shall be ranked senior to persons who are officiating in that grade.

3. Direct recruits.—Notwithstanding the provisions of sub-rule (2) above, the relative seniority of all direct recruits shall be determined by the order of merit in which they, are selected for such appointment, on the re­commendation of the Selecting Authority. Persons appointed as a result of an earlier selection being senior to those appointee as a result of subse­quent selection:

Provided that where persons recruited initially on a temporary basis are confirmed subsequently in an order, different than the order of merit indicated at the time of their appointment, seniority shall follow the orders of confirmation and not the original order of m erit:

Provided further that a person who does not join within the specified period shall lose his seniority according to the select list and shall rank in the seniority list next to the person who joined earlier;

Provided further that he shall not lose his seniority, if the fact of his joining later is caused by circumstances beyond his control and for reasons to be recorded in writing the appointing authority is satisfied that this was so and permits him to join after the scheduled date.

4. Promotees.—(/) The relative seniority of persons promoted to the various grades shall be determined in the order of their selection for such promotion:

Provided that where persons promoted in itially on a temporary basis are confirmed subsequently in an order different than the order of merit indica­ted at the time of their promotion seniority shall follow the order of con­firmation and not the original order of merit.

(«) Where promotions to a grade are made from more than one grade, the eligible persons shall be arranged in separate list in the order of their relative seniority in their respective grades, thereafter the Departmental Promotion Committee shall select persons for promotion from each fist strictly on the basis of seniority subject to the rejection of unfit and shall arrange all the candidates selected from different list in a consolidated form

of merit which will determine, the seniority of persons on propiotions to the highergrad.es.

(5) Relative seniority o f direct recruits and promotees.—Tire relative seniority of direct recruits and of promotees shall be determined according to the rotation of vacancies reserved for direct recruitment and promotion respectively in these rules.

{6) Transferees.—The relative seniority of persons appointed by trans­fer in the service from other Departments of State Government shall be determined in accordance with the order of their selection for such transfer.

Explanatory Memorandum—Rule 4(1).—Where promotions are made on the basis of selection by a Departmental Promotion Committee, seniority of such promotees shall be in the order in which they are recommended for such promotion by the Committee. Where promotions are made on the basis of seniority subject to the rejection of unfit, the seniority of persons considered fit for promotion at the same time shall be the same as the re­lative seniority in the lower grade from which they are promoted. Where, however, a person is superseded by a junior, such person shall not if he is subsequently found suitable and promoted take seniority in the higher grade over the junior persons who had superseded him.

Rule 5.—A roster should be maintained based on the reservations for direct recruitment and promotion in the Recruitment Rules.

Appointments should be made in accordance with this roster and seniority determined accordingly.

Illustration.—Where 75% of the vacancies are reserved for promotion and 25 % for direct recruitment, each direct recruit shall be ranked in seniority below three promotees. If for any reason a direct recruit or a promotee ceases to hold the appointment in the grade, the seniority list shall not be re-arran­ged merely for the purpose or ensuring the proportion referred to above.

14. Leave and pension.—In respect of leave, pension and other (cognate) matters not specifically mentioned in these rules, the members of service shall be governed by the rules/instructions/executive orders as are made applicable or framed by the Government from time to time.

15. Power to relax.—Where the Governor is of the opinion that it is necesssry or expedient to do so, it may by order, for reasons to be recor­ded in writing relax any of the provisions of these rules with regard to any Class or category of persons/posts.

of the powers vested in him under proviso to Article 309 of the Constitution of India and in consaitation with the Himachal Pradesh Public Service Com­mission is pleased to frame the following rules to amend the Himachal Pradesh Education Department Class III (School and Inspection Cadre) Service Rules, 1973, notified vide this Department’s notification No. 17-4/69- Edu-ll,dated the28th December, 1973, namely:—

1. Short title and commencement.—^These rules may be called the Hiniachal Pradesh Education Department Class III (School and Inspection Cadre) Service (1st Amendment) Rules, 1975. These rules shall come into force from the date of issue of this notification.

2. Amendment to sub-rule (3) of rule 5.—In the Himachal Pradesh Edu­cation Department Class III (School and Inspection Cadre) Service Rules,1973, hereinafter referred to as the said rules, the figures “27” shall be substi­tuted for the figures “25” occurring in between the words “ than” and “years” in sub-rule (3) of rule 5 Conditions of Service in “Part 11” of the said rules. )

3. Amendment to serial No. S o f the Annex ure-I.— In the first part o column No. 8 agai nst serial number 8 (Senior Music Teachers) of Annexure I to the said rules, the word “ B” shall be added before the words “Music” and further, the word “its” shall be added in between the words “or” and “Equivalent”.

4. Amendment to serial No. 19 o f Annexure-I.—In Annexure I to the said rules the words “knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in peculiar conditions prevailing in the Pradesh” shall be added as ‘desirable’ qualifications at the end of the existing provision in column No. 8 against serial No. 19, pertain­ing to the posts of {a) Hindi teachers, {b) Sanskrit teachers, (c) Urdu teachers.

5. Amendment to serial Nos. 2 to 4 ,6 to IS and 20 to 22 o f Annexure-I.~ In the Annexure I to the said rules, the words “and suitability for appoint­ment in peculiar conditions prevailing in the Pradesh” s h a l l be added after the words “ knowledge of customs, manners and dialects of Himachal Pradesh” in column No, 8 against serial Nos. 2 to 4, 6 to 18 and 20 to 22 against the posts of Lecturers in Higher Secondary Schools, Lecturers in

No. l-323/70-Edu-A(I).—'In exercise of the powers vested in him under proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the following rules to amend the Himachal Pradesh Education Class III (Ministerial Section) Services Rules, 1972, noti­fied vide this Department notification No. 1-323/70-Edu-A, dated the 26th April, 1973;—

1. Short title and commencement.—(/) These rules may be called the Himachal Pradesh Education Class III (Ministerial Section) Services (First Amendment) Rules, 1975.

(ii) They shall come into force from the date of issue of this notification.2. Amendment to Annexure.-An the Annexure to the Education Depart­

Directors of Educa­tion will be prepared based on length of Service as such, inter-seniority not being disturbed.

Note.—In all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including /?oc) in the feeder post, all persons senior to him in the respective category shall be eligible for consideration and placed above the junior official in the field of consideration.

12. If a D. P. C. exists, what is its composition.

D. P. C. to be presided over by the Chairman of the H. P. Public Service Commission or a member thereof to be nominated by him.

Foot notes.—

I. Uppar age-limit for direct recruits will not be applicable to candidates already in the service of the Government.

2. Upper age-limit is relaxable for Scheduled Casles/Fribes candidates and other categories of persons to the extent per­missible under the general or special orders of the H.P. Government.

3. Age and qualifications for direct recruits relaxable at tie dis­cretion of the Comraissioa in case of candidates otherwise well qualified.

4. Provisions of column 10 and 11 are to be revised by the Government in consultation with the H, P. Public Service Commission as and when the number of posts under column No. 2 are increased or decreased..

5. Age limit for direct recruits will be reckoned from the last date fixed for receipt of applications by the Commission.

6. When the Government of the opinion that it is necessary or expedient to do so, it may by order for reasons to be recor­ded in writing and in consultation with the H .P . Public Service Commission, relax any of the provisions of these rules with respect to any class or category of person,

7. Selection for appointment to these posts shall be made on the basis of viva voce tests, if the Commission so considers necessary or expedient, by a written test, the staadered/ syllabus etc. of which will be determined by the Commission or a practical test.
