Chief Frank Ahern is official host to hisbrother officers who will meet May 27th,28th and 29th with the St. Francis Hotelas headquarters and engage in three daysof constructive sesions interspersed withsightseeing trips and entertainment fash-ioned upon the usual warm hospitality ofthe city by the Golden Gate.
Pre-convention activities include regis-tration at the St. Francis on May 26th,and a reception at the Press and UnionLeague Club hosted by the Chief SpecialAgents' Association of Northern Cali-fornia.

RULES OF EVIDENCE — QUESTIONS, ANSWERSHerein is contained another of a series of questions and answers pertinent to Police training and helpful in promotional
examinations. These questions and answers are supplied to the JOURNAL, as a service to law enforcement officers through-out the state, by E. D. Kerkhoven, director of the Peace Officer Training Service in Oakland. The questions are based onthe 1955 revised edition of the Peace Officers' Handbook. They are selected to test the reader's knowledge of First Aid,Narcotics and the Rules of Evidence. Each question has a number of suggested answers, labeled 1, 2, 3, etc. You decide whichis the best answer to the question asked and then encircle the number. When you have completed the test, compare youranswers with the KEY on Page 28.
1. A tourniquet should be loosenedevery (1) five minutes; (2) 10 minutes;(3) 15 minutes; (4) 20 minutes; ) 30minutes.
2. BleedinA from a vein should betreated by (1) applying a tourniquet be-tween the wound and heart; (2) protect-ing from air; (3) applying a tourniquetat a point where the wound is between thetourniquet and the heart; (4) place firmcompress over the wound.
3. A severe burn should be (1 )ackedin ice; (2) covered with iodine; 3) pro-tected from air with a burn dressing; (4)covered with dry gauze; (5) washed withperoxide.

"Mad Bomber" Lesson Learned
ANTICS OF THE MAD BOMBER who recently terrorized New York, have had SOME beneficial results in that they have led to the settingup of classes in the proper handling of explosives by law enforcement officers. In an effort to be fully prepared againstthe possible appearance in San Franciscoof a "Mad Bomber" such as terrorizedthe City of New York, or the work of anoutright saboteur bent on destroying someimportant local manufacturing or ship-ping facility, the San Francisco Police De-partment completed in March a specialtraining program at the Presidio of SanFrancisco for fifty selected members of itspolice force.
The three-day course included such sub-jects as the identification of military andcommercial-type explosives, instruction onthe various types of detonating devices,safety precautions in the handling of ex-plosives and explosive devices, and rec-ommended techniques. for disposal ofbombs and other devices. A highlight ofthe course was a demonstration of thepower of various types of explosives con-ducted at nearby Fort Cronkhite.

All instruction was conducted by theArmy's 49th EOD squad with Lt. DelwynAlbrecht, instructor-in-charge. To insureboth safety and thoroughness of the in-struction, the course was limited to a max-imum of 25 police officers. The first groupof 25 completed the course on March 14and the second group of the same size wasgraduated on March 21.
Police Chief Ahern, in selecting thepolice officers to receive this training,chose one representative from each policeprecinct so that in an emergency, all areaswould have at least one available officerwho was trained in the handling of ex-plosives and explosive devices.
General comment of those taking thecourse offered by the Sixth U. S. Army,praised the quality of the instruction, thecomprehensiveness of the course, and thevalue of the training they received.
"It's just what we needed! " said morethan one upon receiving his certificate.
The Sixth Army is currently conductingsimilar courses at other urban centers inits area, utilizing Ordnance units and per-sonnel at nearby Army installations to as-sist civil authorities with this highly spe-cilalized training.
"In a real emergency," Colonel Moor-ing pointed out to the first class of policeofficers, "Army personnel may not bereadily available to assist local law enforce-ment officers in safely disposing of an ex-plosive device. It is necessary, therefore,that city police departments have trainedmen of their own. This is the purpose ofour course.''

Dr. Douglas M. Kelley, Professor ofCriminology, School of Criminology, Uni-versity of California at Berkeley, recentlyannounced three summer courses in thefield of interrogation and the detection ofdeception.
"Interrogation is a basic police tech-nique found useful but at the same timedifficult to learn. Mechanical detection ofdeception is also of great value but, again,opportunities to learn these methods arefew." he declared.
"Two years ago the School of Crim-inology offered courses in both these areasas a summer session institute. The materialwas designed primarily for law enforce-ment officers. The courses were quite pop-ular, and we have decided to present themagain," Dr. Kelley added.
The complete program—three coursesof two units—will include a survey of themental factors important to an under-standing of criminal behavior and a studyof their application to interrogation. Spe-cial techniques of questioning will be con-sidered, and a survey of polygraph opera-tion will be presented. This will includeactual experience with the machines.
Dr. Kelley will give two of the courses,Psychological Basis of Criminology andInterview Technique in Criminology,while the third, Instrumental Detection ofDeception, will be given by Albert E. Rie-del, Lecturer in Criminology at the uni-versity. University credits of two units willbe given for each course satisfactorily com-pleted.

Gestures have been a form of con icjuni-cation since the beginning of man. Longbefore man learned to communicatethrough the spoken word, gestures signi-fied his intentions to his fellow man. Asman progressed, speech and writing be-came shortcuts in communicating his ideasand intentions to others and they were aug-mented by gestures, expressions of theface, movements of the hands and arms.
Even today modern man realizes thevalue of gestures . . . or does he?
Traffic laws require certain gestures ofmotorists who operate vehicles upon ourhighways: We are required to signal ourintention to turn right or left by producingour left arm, and in a conspicuous andsignificant manner, signal to others follow-ing, or approaching, (which brings up apoint!).
"What happened to those arms? " Howoften do you drive down the street andsee an arm signal? It is, indeed, an un-usual occurrence which we might even re-gard an as oddity! True, mechanical en-gineers have given the motorist a "help-ing hand" in the form of signal devices;turning indicators and brake lights, how-ever, these are not substitutes for the re-quired signals. First let us understand thatsignal devices are only legal when appliedunder certain cinditions:
1. Turning indicators are legal as suchonly when they give a clear indication ofthe intention of the driver to turn right orleft, and when they are clearly visible anddiscernible in normal sunlight or, at night-time, for at least three hundred feet to thefront and rear.
Too many times the motorist reliessolely on the turning lights to signify hisintention to turn when, actually, the lightsmay not be working at all, or at least notat both the front and rear, or many timeshe employs his turn indicators during day-light hours when they are not discernibleto others from one hundred feet, muchless three hundred. This, of course, is il-legal. Turn indicators at night are legaland even preferred when they meet all ofthese requirements.
2. Brake, or "Stop lights" have been thecause of many accidents, although a brakelight, when functioning, suffices as a sig-nal for the intention of a motorist to slowdown or stop his vehicle, stop lights havea nasty habit of failing to light up and,numerous times, this malfunction goes un-detected for days or months until another

vehicle plays piggy-back at a sudden stop.Here again we have certain requirementswhich govern the use of the brake light:1. The brake light must be clearly visibleand understandable from a distance ofthree hundred feet to the rear both duringnormal sunlight and at nighttime.
Even though exercise is a luxury thatmany of us cannot afford, let's play it safe,whenever in doubt, use the arm signal and,in any case, put your arm out during day-light driving. It's a real attention getter,try it!

Arrest Not Always Best Course
When does a policeman issue a warning or give a piece of advice rather than make an arrest? That's the burning ques-tion in far-off Australia. It seems the Police Commissioner urges "go slow" to the force but that his admonition is being"undermined" by "Officers-in-charge of Divisions" in the state of New South Wales. Read it as it appeared in the PoliceAssociation News. Then figure if it has happened to you! Here's the Editorial:
The Police Commissioner has oftengone on record as saying that Policeshould exercise a great deal of discretionand common sense in their dealings withthe public. He has counselled young Po-lice that frequently a warning graciouslygiven to a motorist and perhaps to others,could have the desirable result. That thegood record of a Policeman is not earnedby penalising the public for trivial offen-ces, but to the contrary could be harmfuland could adversely affect public relations.
The Police Association backs the Com-missioner's viewpoint and congratulateshim for endeavouring to foster goodwilland good relations. However, there is afear that the Commissioner's policy isbeing undermined.
It has become a practice for Officers-in-charge of Divisions to call upon all Policeto submit reports, setting out the numberof breach reports that they had submittedand also the number of arrests made dur-ing the previous month.
Young Police, especially, who haveheard their Commissioner tender adviceas stated, must be bewildered with theset-up.
It appears that, as has happened in thepast, a form of intimidation is being usedto boost UIJ the numbers of arrests madeand breach reports submitted. Naturally,a Policeman who is asked for the abovedetails would feel that his O.I.C. waslooking for breaches. That his Officer waswarning him to get busy with his pencil

It would appear, however, that theremay be too many Inspectors in the Forceand that jobs just have to be found forthem. They would, indeed, require a greatdeal of time to peruse and otherwise dealwith reports rendered by each member oftheir staffs.
Police should not be expected to wagewar on motorists and others by taking ac-tion when a word of advice would suffice.The public rave enough restrictions with-out a "get tough" policy.

drivers of passenger cars towing trailers orother vehicles, and light trucks towingtrailers are increasing according to infor-mation released today by the CaliforniaHighway Patrol.
"During 1956 the Patrol issued 6,056citations for violations of the speed lawsgoverning the towing of trailers by driversof passenger cars and trucks weighing un-der 4,000 pounds," declared Patrol Com-missioner B. R. Caldwell. "This representsan increase of 29 per cent as comparedto 1955.
"Motorists must remember that when-ever a passenger motor vehicle ragardlessof weight or commercial motor vehicleweighing less than 4,000 pounds is draw-ing a trailer coach, trailer, semitrailer, orother type of vehicle, the maximum speedshall not at any time exceed 45 miles perhour subject to other and more restrictivelimits as established by law," Caldwellstated.
"The Patrol is always ready to answerquestions concerning traffic laws and reg-ulations," he concluded. "Stop by any ofour field offices for further information onthe use of trailers."

were outstanding in California as of De-cember 31, 1956, reports the NationalAutomobile Club. Of this total, 6,494,416were operators' licenses and 392,630 werechauffeurs' licenses.

BIKE SAFETY PLANThree out of every four American
youngsters between the ages of six and15 ride a bicycle; every 19 minutes oneof these youngsters is injured—and atleast once a day one is killed—in colli-sions with automobiles.
To protect these youthful users of thepublic streets and highways, the Associa-tion of Casualty and Surety Companies,at the request of state and municipal gov-ernment officials throughout the nation,has announced the completion of a modelplan for the organization and operationof a bicycle safety program on a commu-nity level. According to Thomas N. Boate,manager of the Association's AccidentPrevention Department, the program pro-vides for the proper education, training,and testing of bicycle riders and the in-spection of bicycles to detect unsafe con-ditions. The plan is explained in abooklet entitled "A Community BicycleSafety Program." After describing howsuch a program can be established andmaintained, the booklet explains the rolesplayed by city legislators, traffic engineers,police, schools, students, parent groups,civic and business organizations, publicinformation media and others. It alsogives information on testing, registering,and licensing cycles and cyclists—and re-prints in full the model bicycle ordinancesuggested for municipal use by the Na-tional Committee on Uniform TrafficLaws and Ordinances.
"There are more than 20,000,000 bi-cycles on American streets and highwaystoday," Mr. Boates said. "As a result,every community, large or small, is facedwith a bicycle safety problem. The bestway of solving it is through a community-wide bicycle safety program. Such pro-grams not only reduce bicycle accidentsand control the problem of lost or stolenbicycles, but they also help develop con-structive attitudes in youngsters which willmake them better automobile drivers laterOn.

RIGHTS OF PRESS DURING RIOTSThe first opinion in the history of the
city of Philadelphia, Pennsylvania, clarify-ing the relations between police officersand news photographers and reporters dur-ing emergency situations, was recentlyissued by City Solicitor David Berger.
In essence, it holds that the freedom ofthe press provision in the Federal Consti-tution guarantees newsmen their news-gathering rights even during emergencies.
"Meaningful freedom of the press in-cludes the right to photograph and dissem-inate pictures of public events occurring inpublic places," the opinion states. It addsthat physical abuse of news personnel bya police official can constitute "an extremeform of censorship."
On the other hand, it holds that thepolice are under no compulsion to assistnews personnel to secure news when suchhelp hampers them in performing theirduty.

volving a press photographer during anAdlai Stevenson speech at the Universityof Pennsylvania Palestra during the recentpresidential campaign.

The incident prompted Police Commis-sioner Thomas J . Gibbons to ask for legaladvice to clarify the respective rights ofthe police and the press during riots, dem-onstrations, arrests, and like circumstances.
The City Solicitor replied in a three-page opinion, believed to be the first of itstype ever issued in any major Americancity, as follows:

It is to be highly regretted that a mem-ber of the press was so treated. There isno more important constitutional guranteeto be observed by governmental law en-forcement officers than freedom of thepress.
PERSONAL LIBERTYThe First Amendment to the Federal
Constitution provides that Congress shallmake no law abridging the freedom ofspeech or press. Protection against the in-fringement of these freedoms by state orcity agencies is guaranteed by the Four-teenth Amendment of the United StatesConstitution.
The freedoms of speech and of press arefundamental personal liberties. The rightsto speak freely and promote diversity ofideas constitute the foundation of free gov-ernment. The continued enforcement andprotection of these rights distinguish theUnited States from totalitarian nations.The vitality of our civil and political insti-tutions depends upon the right of oursociety freely to discuss social, economicand political problems of local, nationaland international import. Truth dependsupon freedom to speak, write, think anddiffer. Hence the widest latitude in thedissemination of information is essential.
PHYSICAL ABUSEMeaningful freedom of the press in-
cludes the right to photograph and dissem-inate pictures of public events occurring inpublic places. It is intolerable that policeofficials who are not vested with discretionto permit or forbid the exercise of thisright should perpetrate the most extremeform of censorship: physical abuse of thephotographer. No more tolerable is policeaction reaching the same result by threator intimidation rather than by bodily con-tact.
Adherence to these fundamental pre-cepts in no way impedes the police power.This was clearly an occasion for its exer-cise. In promptly quelling the disturbanceby removing the demonstrators so thatthe speaker could continue with his na-tionally televised speech the police actedproperly. Only the interference with thepress was incorrect.
This is not to say the press must be pres-ent every time an arrest is made. Nor doesthis mean that the police must first informthe press that an arrest is planned beforeapprehending a law violator. The policehave full freedom to carry out lawful po-lice action regardless of whether press rep-resentatives are present or have priorknowledge thereof.
But where police action is taken in apublic place during a public event whichis being covered by the newspapers, radio

and television, the press plainly has theright to report such public occurrence withor without photographs.
No INTERFERENCE
The exercise of this right by the pressmay not be the occasion for interferencewith proper police action. Photographersin their zeal to make a pictorial report maynot hamper the police. The cry for "justone more" picture may have to give wayto the exigencies of the emergency. Thepolice are there to arrest, not to pose forpictures.

Accordingly, you are advised that thepolice have the duty to take all measuresreasonably necessary, including the use offorce, to protect the public, especially whenits peaceable assemblage is violated orthreatened. Performance of this duty isclearly a proper subject of news reporting.Photographs of the police action may betaken. There may be no interference withthe exercise of the freedom of the pressby force or threats. By the same token,press representatives may not hamper thepolice in the exercise of the police power.
The public interest in the maintenanceof law and order exists side by side withthe public interest in the protection of ourbasic and fundamental liberties. Neitherjustifies suppression by the other.

lights for other drivers as required by laware a menace on the highways, accordingto the California Highway Patrol.
"The law required that when a driverapproaches within 500 feet of an oncom-ing vehicle, he shall use a distribution oflight so aimed that the glaring rays arenot projected into the eyes of the oncom-ing driver," states Patrol CommissionerB. R. Caldwell. "This also applies to traf-fic on divided highways.
"In addition to this requirement it isnecessary for the driver of a vehicle fol-lowing within 200 feet of another vehicleto use the low beam distribution of light.Courteous drivers will always dim theheadlights when meeting or followinganother vehicle.
"The Patrol asks every driver to be morecourteous in the use of headlights," Cald-well concluded. "Cooperate and help as-sure safety for yourself and the driversyou meet or follow in the darkness."
"OUT OF FRYING PAN"In an attempt to get away from the pur-
suing highway patrolman, the boy darteddown a side street, spotted an empty gar-age, roared into the garage, turned off themotor, and slid down in the seat. Thepatrolman went roaring on by.
Then, reports the National AutomobileClub, the housewife came down to thegarage, gave the boy a spirited lecture, andcalled her husband to take the proper ac-tion. Her husband just happened to be asergeant in the California Highway Patrol!

Frank J. Ferguson became Chief of Po-lice of Huron, California, last Decemberwhen he was but 24 years old.
When Tobie A. Bybee, policewoman ofHuron, read in a recent issue of the Po-LICE AND PEACE OFFICERS' JOURNAL,the claim of his friends that Louis PeterMountanos, Chief of Sausalito was theyoungest holding that post in California,loyalty to her own boss prompted her tosend along the story of Chief Fergusonand a picture of the personnel of his de-partment.
Huron was incorporated in 1951 andGlenn T. Clark was appointed the firstChief. He passed away in May, 1956, andFerguson, then a patrolman, was namedActing Chief which position which posi-
tion he held for six months. Last Decem-ber he was named Chief.
The youthful police boss is realistic inhis thinking and decisive in his actions.Four others make up the department: Sgt.Homer J . Worth, Patrolman John Saar-loos and Floyd Runion and PolicewomanBybee.

GOSSIP OF THE PISTOL RANGESFar be it from me to say a word against
any of my fellow pistol shooters but I'msure that on Sunday, March 3, 1957, theasylum at Napa was denuded of male pa-trons as they were all down at the Oak-land Pistol Range for the opening of the1957 season. It was a mass exodus fromthe sanctuary at Napa. Wot a mob!! Over320 cwazy people standing out in the rainall day long shootin' holes in a piece ofpaper and having one hell of a time adoin' it!!
Six relays, too, with each relay holding52 nuts that gives with a figure of 312plus a few odds and ends making a totalof 320 demented, maniac and moonstruckhumans (?). It's just too horrible to con-template. The little men in the white coatsmust have done a thriving business Sun-day taking them all back home to theirnice padded cells.
Ran into "Dragrace" Rhul, of the Bur-lingame Police Department who is nowknown as "Doc" Rhul having earned thesobriquet when he had to play midwifeto one of the ladies on his beat. No medicaround so "Dragrace' '—no, I mean Doc—delivered the baby by himself and, accord-ing to medical authorities who arrivedlater, the job was as neat as could be—tied cord and all. How ABOUT THIS?
There is a muchly controversial Assem-bly Bill proposed, to be added to the PenalCode AB No. 3842. It briefly states thatevery erson who possesses a fire arm ca-pable of being concealed must, within 72hours after he acquires the weapon, or ifhe possesses a weapon on the effective dateof this section, register the fact of suchpossession with the Chief of Police of hiscity. Failure to comply with this section isa misdemeanor. Did I say controversial?Think of the gun collectors' plight. Well,you take it from there.
Randy McDermott was back on thelines, after a four-year layoff, with a kitfull of new guns, gadgets and 'scopes.Randy ran into a lot of tuff competitionand a lot of hard luck for his first day outbut he sez it was a lot of fun and is sureglad he is back at the game again.
I see that Fred Plough, taken right outfrom the City College Criminology class,is taking a job over in the Mann CountySheriff's office under our old friend Sher-iff Dave Menary. Dave hasn't been withus since he took over the sheriff's job inMann. Guess he has been too busy to domuch shooting.
As I walk along the lines during the.45 matches I notice that quite a few ofthe shooters are using .45 revolvers nowinstead of the automatic. Wonder wothoppen and why. Maybe it's a good thingto look into some day.
Several inquiries have been made of meabout the rumor that the new freeway isgoing right smack thru the Oakland PistolClub range. Relax, boys and gals, it's justa rumor as the freeway will go thru thewest end of the zoo which is about three-quarters of a mile away from the pistolrange.

1957 INDOOR PISTOL CHAMPSBy J. Ross DUNNIGAN
Took a flying trip to the 1957 NRAIndoor Pistol Championship matches heldlast month at the U. S. Naval Base rangein San Bruno. This was one of the thirtysuch matches held all over the UnitedStates during the month of March to de-termine the champs of the teams andindividuals.
There was just the one match held inCalifornia. Some 85 shooters from allover the state showed up for the matchesin San Bruno where the marines have avery fine 23 firing point range for the .22gun only. The matches at San Bruno weresponsored by the Mainliner Rifle-PistolClub (the United Airlines) under thesecretaryship of John Low—and a swellJob the Mainliners turned out. Ray Felton,from the Oakland Club, acted as referee.This match, or these matches, are for theUS indoor .22 caliber championships, bothteams and individuals and are shot underNRA rules. The matches are the slowtimed and rapid strings of 20 shots, oneshort national plus the aggregate ofmatches 1, 2, 3 and 4. For good measurethey threw in an extra match for the NRAbuilding Fund made up of the aggregateof matches 2 and 3. Colonel Leon Rouge,SF Presidio, won the high aggregatematch and the building fund aggregatematch. Scores received too late for publi-cation.

stuff you should get a copy of the Marchissue of "GUNS" (one of the newershooting magazines) and read the article"The Target That Shoots Back" - it'sinteresting to say the least. This target isbuilt like a man and is electrically con-trolled to shoot back at you (with blanks,my dear fellow) if'n you don't beat himto the draw in 3/10's of a second. Trydrawing and firing from the hip withoutlive ammo and see how you'd make outif you were in front of the dummyshooter.

I have been noticing of late that manyshooting clubs have been trying to holdmatches but for some reason or other theydo not get the interest nor the crowdsthey should. There is plenty of shootinggoing on around our way, San Jose, Mont-erey, Sacramento and the likes but theshooters just don't patronize them. Takethe case of John Bellera and the shoot heheld a few months ago at Fort Ord. About40 shooters turned out leaving John witha few dozen medals that he still has yet todispose of.

THEY HAVE TROUBLES
Jake Cook, one of the newer shooters,was having a tuff time of it trying to getall his shots on the paper and was ex-tremely happy in having found six out often on his timed fire string. Jake explainsthat he has been shooting for possibles allday and unless he gets the possibles hejust don't want anything. In that he wasnot disappointed.
Bill Dennis also had his troubles butin another way. Bill was having difficultiesin getting them in the black and statedthat this was caused because he cleaned hisgun the night before the matches and asthe gun hadn't been cleaned in many,many years he wasn't quite used to theaction. So-o-o-o he vowed never to cleanthe gun again. SCORES

It's no wonder that on the brassards ofthe Oakland Pistol Club they have "TheBiggest Pistol Club In America"—.boy,oh boy, you should see the ever growingcrowds that flock to the monthly matchesas witnessed in March where some 330shooters were running all over the place,arid this does not take in the women andchildren that come along for the outingand a nice picnic lunch. That's a lot ofpeople to handle in a one day's shoot andthe Club is praying they get that longpromised bulldozer to enlarge the firingpoints to make 104 on the 50 and 104 onthe 25 yard lines. Then the whole darnedarmy can come out to the matches and willbe handled con mucho mucho. As it isnow there are 6 relays in each matchwhich all goes for making a long, long dayfor Mr. Shooter yet the Club officials donot wish to cut the number of entries northe number of relays but, if the crowdscontinue on the increase sumpins gotta be

Colonel Rouge again took away the topaggregate prize followed by another armyshooter, Nelson Lincoln, from the SFPresidio, who placed 2nd in the aggregatematch. The third open winner was Braith-waite and as you might know he was fromthe armed forces. It's quite refreshing tosee new names heading the lists all whichkeeps up the old spirit—and makes theboys buckle down if they want to stay inthe top spots.
USE REVOLVERS
I have been noticing lately that many ofthe shooters in the .45 match are usingrevolvers and also in the .22 matches Isee many revolvers. There could be a goodstory someplace there about that but forthe nonce it escapes me.
The Sacramento matches opened lastmonth on the 3rd Sundays of the monththru October so will have to get up theresome Sunday and give my guns the heattreatment—and I don't mean from thepowder either. The last match I shot thereI thought the sun was gonna melt the gunbarrel but I won 45 cents and that madeup for the heat.
Jim Spang, just retired from the Navyand claims he hadn't pulled a trigger insix years, arrived on the lot with newshooting equipment and anxiously awaitedhis first match. I noted his first string anddidn't have the heart to follow the rest ofhis shooting for the day. I hope Jimwasn't so discouraged he didn't toss hisgun kit over the side of the bridge on theway home. -

GREAT BUSINESS PERIODCalifornia experienced the greatest ac-
tivity on record during the last quarter of1956, it was announced today by GeorgeR. Reilly, First District Member of theState Board of Equalization. The volumeof transactions subject to state sales anduse taxes between October 1 and Decem-ber 31 amounted to $5,356,626,000__71/2per cent more than the comparable figurefor the last quarter of 1955. In no preced-ing quarter has the $5-billion mark beenreached.
Fourth-quarter taxable business activitybrought to more than $ 191/4 billion thevolume of self-assessed taxable transac-tions during the calendar year 1956. Thisactivity exceeded by more than $1 1/4 bil-lion, or over 7 per cent, the previous year-ly record set in 1955. Each of the fourquarters of 1956 produced a greater dol-lar-volume of taxable transactions thandid the comparable period in any previousyear.
The 3 per cent state sales and use taxyielded $160,698,780 of self-assessed rev-enue for the fourth quarter. Additionally,Board-assessed taxes and interest and pen-alties on unreported or underreported tax-able transactions amounted to $2,646,659,bringing the total quarterly revenues fromthese sources to $ 163 1/3 million.
The most notable feature of the fourth-quarter taxable sales pattern was the 5.3per cent increase in total retail sales ascompared with the same quarter of 1955.With the exception of sales by new auto-mobile dealers, most major classes of bus-iness reported notable gains. Spearhead-ing the advance was a group of specialtystores. Photographic equipment and sup-plies dealers and sellers of trailers, boats,motorcycles, and planes, continuing toshow the relative strength which they haveevidenced for more than a year, registeredgains of about 22 per cent.

hand. He gets more worked up about itthan if he'd shot his wife in the stomach.The violator who walks into your officewith an earned $5.00 ticket, to demandthat something be done, is more difficultto deal with than a client who has beenslightly sued. He's going to take up a lotof time you can't bill him for, due to themicroscopic nature of the transaction. Andthere isn't much you can do for him any-way except hold his hand and sympathizewith him in his sorrow.
The guy's got that please-pass-the-revol -vers attitude, and sings a song that soundslike the 3rd strain from Hernia. The officersaid he did it when he didn't do it. Hiswife was in the car, and she says he didn'tdo it either, and will so testify. He dis-plays a passion for detail about circum-stances surrounding the alleged violation,together with a description of the way hedrives, has always driven and did drive onthis occasion, plus the way other peoplewere driving all around him, frequentlygoing off into tangents about previousviolations he was accused of, their out-come and disposition, mostly unsatisfac-tory, and "he's not going to let them getaway with it this time." So help himHannah.

All right. You're sitting there nodding,holding his hand in sorrow over the in-justice of it all. Good. Now we come tothe meat of the thing, the reason for hisentre, so to speak. He wants the ticketdismissed. The unseen handle up in thesky is supposed to be pulled, by you, hisattorney.
Don't alarm the man by saying rightoff that nothing can be done. You've gotto let him down easy. So your face is fullof maybe. By no two-way stretch of theimagination should he be allowed to feelthat the mission can be accomplished, un-derstand. But don't come right out andsay that if you could get him out of thisit would be the most sensational thingthat's happened since Dr. Dafoe held upa hand instead of a finger to Mr. Dionne.You've got to time yourself, first by lettinghim know that it's improbable, then un-likely, then impossible. Finally like un-screwing the inscrutable. Mix in a littlePei, se, personna non grata and ipso factoif he seems intelligent.
IT'S THE PRINCIPLE
We haven't discussed the little matterof the fee. We aren't going to let youdown easy. Right here we're going to letyou have it. There ain't going to be any.He has already told you that he don't carewhat it costs, but you can take that witha dose of salts. He has said too, that "itisn't the $5.00, you know, it's the prin-ciple of the thing." $5.00 means no moreto him than an arm or an eye. The quick-est way of all to get rid of him would beto tell him you will have to charge him$50.00 to represent him in court. Don'tdo it. The loss of a client who may begetting a divorce or calling you from thejailhouse next week is serious.
Now, why is it that the ordinary trafficticket can be such a mad and marvelousthing? The answer is, that outside of send-ing a check whereby you not only paythrough the nose but automatically admitguilt, the only thing you can do is appearin court on the court date. The officer has

told you to tell it to the judge. You canhave a fair and impartial trial. All youlose, of course, is a day's work, and thepunishment for that is three or four timesthe value of the ticket. Aye, there's therub. You don't have to be a keen studentof the dollar to figure it out. This createsthat frustrating and hopeless feeling inthe defendant's soul.
Another thing. If he goes to court heknows in his heart that the odds out ofone hundred of winning the case couldbe counted on the fingers of a careless saw-mill hand. His mind tells him he is goingto be found not guilty, but his heart tellshim differently. He hasn't heard from hisliver. The last time we checked, the per-centage of convictions for the entire Stateof traffic arrests was 97.4 per cent. Thatwas years ago. We haven't bothered toinquire again. A generous sample can beobtained by listening to a group of trafficcases being tried anywhere. How oftendoes the judge turn to the officer and tellhim he made a mistake? "The man wasn'tspeeding, officer. He says so himself.""You must be colorblind, officer. I don'tbelieve the light was red." Then the littlefairy prince tapped her on the shoulderand said, "Shall we dance?"
SELDOM WRONG
Why is the defendant found guilty?Frankly, because he should be. That's ashocking and arbitrary answer, but true.There are exceptional cases where thetraffic cop is wrong, there will be and con-tinue to be illegal tickets issued, but wecan't soak up your valuable time discussingrare instances. Let's stick to the general.The misdemeanor has been witnessed, notonly by an eyewitness, but a trained eye-witness who is fulfilling the duty of apublic servant. When your client says toyou, "The judge won't take my word, he'lltake the police officer's word," he has in-deed said a mouthful.

ist receives a traffic ticket. You don't everhear of big cities like Detroit being speedtraps. It's the cross-roads village, always.The delightful defense, which in the mindof the defendant seems to bind the casewith hoops of steel, is that he was "justgoing along with traffic." This is some-times varied by the equally entrancinglegalistic hypothesis that the officer washiding behind a billboard. The latter isfascinating because it's the story of Amer-ica. Everybody should be given a sport-ing chance, even when violating the law,and if the weather eye in the rear viewmirror reveals nothing, our man has beeneuchered out of the square deal. It's likea body blow below the motorist's belt.
DIFFERENT TERMThe police do not call this sort of thing
hiding around the corner, they call it "off-street observation," but whatever they callit, the traffic ticket addict compares itfavorably with the secret police of redRussia.
Other "defenses," the total of whichmean nothing but are bothersome andtime consuming to explain, are the follow-ing; the defendant wasn't hurting nobody;he didn't have a thing to drink; he didn'tdo it deliberately; he has a good trafficrecord; this is his first ticket; the police-man wasn't wearing a coat; his car wasn'tidentified with "police" in big letters;the policeman misspelled one letter of hisname ("and if he made one mistake, hecould make another, couldn't he, Coun-sel?"); the signs were hidden by trees; hedidn't see the sign; the community is try-ing to raise revenue to build a new cityhail; the cop was "hard up for a ticket"because he "hadn't filled his quota forthe day;" and then again, repeat, thedefendant wasn't hurting nobody.
The above repeated phrase strikes rightat the heart of the traffic ticket problem.What puzzles so many defendants is whythey can't make their own laws. If there'sno traffic on the street and it's 3 in themorning, why in the world shouldn't hebe allowed to go 10 or 15 miles over thelimit? If he rolls up to a stop sign andthere's nothing within a block in eitherdirection, why should the wheels of hisChevy cease their motion, when he cansafely shift gears and mosey on across?What if the light did change to red be-fore he completed the crossing? Cross-traffic didn't have time to start up yet?There was no possible danger of harminganyone.
LAWS IMPORTANTThe conclusion is, the traffic misde-
meanor is technical by nature, almost inevery case. Traffic laws are by their verynature arbitrary laws. You don't have tobe a hazard on the street to deserve aticket, you don't have to have an accident

or come close to one. You've been stoppedonly on a technicality. That's what mostpeople find it so hard to understand. Theclient says, "I wasn't driving reckless."Your ready answer should be, 'You arenot charged with reckless driving, mygood fellow."
Traffic laws are important. They mustbe enforced. The enforcement should berigorous and uniform. Otherwise they'llbe shoveling the bodies into trucks in-stead of picking them up one at a time inan ambulance. The public can't be allowedwhen and where to comply with a law andwhen to ignore it. There are many driverswho aren't equal to such an occasion. Alldrivers should be able to drive on thetheory that all other drivers are going todo the correct thing. We must be able torely on compliance with the laws by every-body else on the street. Should enforce-ment cease, traffic would be a terrible mess.Even good drivers would slip into care-less ways.
So while you sit there listening to histale of woe, rolling you eyeballs towardthe ceiling, and occasionally looking at theinside of your eyelids as though immersedin deep thought, keep in mind that thecommon traffic ticket, like the commoncold, is a necessary evil and one aboutwhich little can be done.

"GOOD OLD DAYS"Depressed by the bumper-to bumper
blues, you might some day find yourselfwishing for the good old days when carswere fewer and farther between. Don'tdo it, advises the National AutomobileClub. Like most good old days, the goodold days of motoring just weren't verygood at all.
Suppose you did find yourself back inthe noisy nineties, clutching your moneyin your wet little palm, and eager to buyyourself one of those newfangled horselesscarriages. About all you could buy thenwould be a steam carriage, which amountedto an old buckboard with the shafts cutoff, four rubber-tired wheels, and a powerplant under the seat. And that power plantseemed to have a strange propensity foreither soaking you with vapor from timeto time or blowing you higher than theproverbial kite.
And the car you got would be littlemore than a stripped-down chassis. If youwanted a top, windshield, side curtains,battery, or tires, you'd have to go out andbuy these on your own.
Then you were ready to go, almost, Ifyour trip was going to be more than 20miles, you had to get out your tools, yourkit of spare parts, and your maps, and layyour plans like an attacking general. Thenyou put on your fur-lined overcoat, hauledon your heavy woolen gloves, tight-fittingrubber-lined cap, and oversize goggles.
Away you went, and so did most of theloosely fitting parts of your new car. Junkdealers followed you at a respectable dis-tance to pick up the bolts, bars, and brokenaxles, that bounced right off.
If you wanted to warn that junk dealerthat you were about to stop, there were nosignals. A lot of the time there were nobrakes, so you just headed for the nearestbank, tree, or other solid obstacle andbrought your journey to a crashing con-clusion.
If a tire went flat, there was no de-mountable rim, no spare. You just tookthat tire off, repaired it, then blew it upwith a wheezy pump that got about onepound of pressure to one hour of pump-ing.
Had enough? Probably. But don't for-get the charm of those flickering gasolineheadlights that hardly let you see whereyou were going but did offer some feeblewarning to pedestrians and cows that youwere thundering towards them at your topspeed of fifteen miles per hour.
Back to those bumper-to-bumper blues?
Alameda, in Spanish, means a "groveof poplars." The California State Automo-bile Association states that the name firstappeared in a report of exploration madeby Sergeant Pedro Amador in 1795.

DROP IN DEATHSThe American motorist in January
shifted the traffic death toll into reversefor only the second time in the last twoyears, according to the National SafetyCouncil.
Traffic deaths in the first month of 1957dropped 3 per cent-2,860 as comparedwith 2,950 in January last year. The Coun-cil said October, 1956, was the only othermonth in two years to show a death re-duction, although the December, 1956,toll was unchanged from the previousDecember. Travel figures for January arenot yet available, so the Council said itcould not relate the decrease to any changein mileage.
Ned H. Dearborn, Council president,said he is confident the "Back the Attack"campaign launched by the Council in De-cember and still continuing is having afavorable effect.
Although the January decrease was notlarge, its geographical spread was inter-preted by the Council as minimizing theeffect of weather. Improvement was re-ported in 26 of 45 reporting states. Twostates had no change, and only 17 reportedincreases.
The decrease in January apparently camechiefly in urban areas. Among 562 report-ing cities, deaths showed a sharp 15 percent drop, the Council said.
Of the 562 cities, 420 had perfect rec-ords in January. Decreases in deaths werereported by 118 cities. Only 85 cities hadmore deaths than a year earlier.
In 1937 there were some 15 trafficdeaths per 100 million miles of travel.Today there are 6.4 deaths per 100 mil-lion miles, reports the California StateAutomobile Association.
The average motorist pays $34 a yearin state gasoline taxes, according to theCalifornia State Automobile Association.

the American motorist, according to theCalifornia State Automobile Association.Major milestones were passed in virtuallyevery phase of motor transportation -road building, safety, vehicle registrationand travel.
The single development that over-shad-owed all others in the motor world waspassage of the huge Federal highway bill.Although no direct benefits were noticeableduring 1956, the $33 billion Federal pro-gram will eventually provide a 41,000-mile system of interstate highways andalso make more funds available for theimprovement of many more thousands ofmiles of state roads and city streets.
The AAA motorists' organization saidthe only black mark on the 1956 recordwas the increase in the number of high-way deaths. Final figures are not yet tabu-lated, but it seems certain that a new highof over 40,000 deaths will be recorded.
"On the other hand, a significant gainwas made in the growth of high schooldriver and traffic education classes. Forthe first time, student enrollment in classesoffering both classroom study and drivertraining exceeded 500,000 during the1955-56 school year. This is a major stepforward because studies prove that com-plete driver education courses can reduceaccidents and traffic violations by as muchas 50 per cent for those taking the Course,"the CSAA said.
Two record marks of near astronomicalproportions were established in vehicleregistrations and miles traveled in theUnited States during the past year. Thetotal number of cars, trucks and buses nowon American streets and highways passedthe 65,000,000 point late in the year, andit is estimated that these vehicles rolledup over 600 billion miles. The previoushigh mileage figure was achieved in 1955,when Americans drove 583 billion miles.
The CSAA also pointed out that recre-ational travel by automobile also continuedto spiral upward. More than 80,000,000Americans, roughly half the population,took at least one vacation trip during theyear. About 85 per cent of these tripswere made by car.

SEX DEVIATION AND CRIME!Predicating his article on the contention that sexual deviates present an ever perplexing problem to law enforcement
officers, Alan Canty, executive director of the Psychopathic Clinic of the Recorder's Court in Detroit, makes several perti-nent observations for the benefit of police departments the country over. Describing the various forms that sex deviationtakes, Mr Canty, in The Police Chief, gives this advice: "As a law enforcement officer, you do not round up all known pick-pockets when you are investigating a safe robbery . . . (so) when investigating a sadistic rape or murder concentrate yourfire. Don't waste time bringing in all known homosexuals or exhibitionists. If the investigation leads nowhere, those peoplecan be brought in later." His article, in full:
Sex crimes and sexual criminals are aproblem to all of us in the field of lawenforcement. Following one well-publi-cized sex crime, the citizen is alarmed,frightened and aroused. He has a desirefor protection and, in some cases, forrevenge.
When the public is aroused, more of-fenses are reported and the citizen's ap-prehension is further reflected by hisalertness to suspicious persons or circum-stances which he considers threateningin the sexual area. This means more ar-rests, more investigations, the classificationof suspects as to their possible involve-ment in the case under investigation, orthe realization that there is no evidence toconnect the suspect with this particularcrime.
NEED SPECIALISTSWhenever a vicious sex crime occurs,
perhaps the rape and murder of a littlegirl, hundreds of suspects may be broughtin for study. All known sex deviates inyour area are certain to come under in-vestigation. You are then faced with theproblem of deciding which of your sus-pects, though not involved in the crimeunder investigation, might nevertheless bereacting to dangerous symptons or mightwell be considered suspects in other un-solved sex crimes.
In this situation, the police investigatorfeels insecure and welcomes the advice andassistance of the skilled psychologist orpsychiatrist, particularly if this specialistin the field of human behavior has hadexperience in working with criminal of-

fenders. Fortunate indeed is the policedepartment which has ready access to con-sultants of this type.
In the city of Detroit, the writer, asdirector of the Psychiatric Clinic of theRecorder's Court, has had occasion tostudy convicted criminal offenders duringthe past 36 years in collaboration with astaff of psychiatrists and clinical psycholo-gists. Since the ten judges in this courthave the responsibility for trying cases in-volving all criminal offenses committedin the city of Detroit, all types of criminaloffenders may be referred to the clinic bythe trial judge interested in the clinic'sadvisory services.
SEX OFFENDERS
In the average year, the clinic studiesover 2,500 convicted criminal offenders.About 500 of these, or approximately 30per cent, are sex offenders. Each subjectis studied physically, psychiatrically, psy-chologically and sociologically for a periodof five hours. This 2,500 hours each year,devoted to the study of sexually malad-justed criminal offenders, has given ussome understanding of sexual problems intheir relationship to crime. As a result, we

While working with these law enforce-ment officers, we have learned somethingabout their problems; they, in turn, haveacquired valuable knowledge in the areaof human behavior. Today there is a veryclose working relationship between thesetwo units of our city government, thePsychopathic Clinic of the Recorder'sCourt and the Detroit Police Department.This relationship is based on our mutualinterest in a common problem—the pro-tection of the citizens in our communityfrom the offenses committed by the sex-ually deviated criminal.
It is not within the scope of this paperto discuss sexual maladjustment in all itspossible criminal ramifications. You willrealize that over the years we had occasionto study individuals who were expressingtheir sexual maladjustment by committingevery conceivable kind of unsocial andantisocial criminal sexual act. A few of thesex offenders of particular interest to thelaw enforcement officer will be consideredbriefly.
MARK OF SADIST
From time to time, law enforcementofficers in every community are called uponto investigate the rape and brutal assaultof a woman or a young girl. There maybe evidence of strangulation, or perhapsknife wounds, skull fractures or other in-dications of violence are observed. Notuncommonly, the victim has met the resultof such mistreatment. This behavior is thehallmark of the sadist.
A sadist is an individual who exper-iences sexual excitement or derives sexualpleasure from hurting someone. If he be-comes sexually aroused because of the suf-fering of his victim, or more particularlyif he finds it necessary to injure or torturehis victim in order to achieve sexual grati-fication, he is a true sexual sadist. SEX INFERIORITY
Another very common sex offense isthat involving the male who has sex rela-tions with a girl below the statutory age.This is, in some instances, merely a situa-tion where a young man is taking advan-tage of an opportunity for sex relationswith a young girl who is herself coopera-tive. At other times, we find the man whois bored, jaded, surfeited with normal sexactivities, and who looks forward to a newor unusual sex experience with a minorgirl.
In the majority of these cases, however,we are dealing with a man who is reactingto feelings of sexual inferiority. This isthe psychological condition referred to bythe Freudian psychologists and psychia-trists as the castration complex. These cas-tration ideas or feelings of sexual infer-iority can develop for a number of reasons,some of which will be discussed later. Instudying the cases of sex relations withminor girls, we often find that the infer-iority feelings are related to some organicdefect of the sex organs. This may be afeeling of misgiving as to the small sizeof the penis or concern because of an un-descended testicle. Premature ejaculation,with its attendant dissatisfaction on thepart of the sexually experienced femaleand embarrassment on the part of the male,can lead to similar feelings of inadequacy.
FEARS RIDICULE
Most important in this connection is thefact that the sexually insecure male avoidscontact with sexually experienced adultfemales in fear of embarrassment or becausehe has been held up to ridicule as theresult of his organic or functional prob-lem. He then turns to young, sexually in-experienced girls, feeling that they willnot detect his peculiarities or inadequacies.In this case, he feels emotionally morecomfortable in his relationship with girls

Closely allied to this offense is the sex-ual molestation of young girls, not involv-ing actual sexual intercourse or attemptsat intercourse. This is an offense committedby the very old man who is impotent andincapable of experiencing normal sexualintercourse. His feelings of frustrationand embarrassment increase with each sex-ual failure. He then engages in sex playwith very young girls, thus avoiding criti-cism for his lack of adult sexual prowessand entertaining the vain hope that hisimpotence will accordingly disappear.
INDECENT EXPOSURE
The crime of indecent exposure, or ex-hibitionism, leads all others in numericalfrequency. Nearly 20 per cent of the sexcrimes studied in the Recorder's Courteach year are cases of indecent exposure.This offense is usually committed by theyoung man with feelings of sexual inse-curity resulting from guilt feelings asso-ciated with masturbation, an inability towork out a satisfactory marital sexual ad-justment, or because of an organic sexualproblem such as those previously des-cribed.
These subjects are reacting to what isvirtually a neurotic compulsion to exposetheir privates. In an attempt to compensatefor their inferiority feelings, they seek todemonstrate—to prove—their masculinityby the overt display of the privates. Theexhibitionist is not aware of how cause-and-effect is operating; he only knows thatperiodically he feels these driving urges toexpose his privates. Psychologically, weunderstand his exposure as his way of de-nying or escaping' from his deep-seatedfeelings of sexual inferiority.
HOMOSEXUALITY
Homosexuality is widely recognized to-day as resulting from an inability to re-solve childhood emotional problems or asdeveloping through contact with olderhomosexuals during childhood or earlyadult life. Latent or mild homosexualtendencies are present in large numbers ofpeople and manifest themselves in many

short of overt sexual relationships.The law enforcement officer is chiefly
concerned with the adult homosexual whomay be found accosting strangers in a pub-lic place or who is engaged in an occupa-tion which furnishes opportunities for sex-ual advances to children. These people are,by and large, an unhappy group. They mayhide their emotional distress by display-ing a superficial facade of joviality andcontentment, but basically they are se-verely discontented because of their mal-adjustment.
Our society is built around the homeand the desire for parenthood. The homo-sexual cannot fit himself into this socialstructure. Sometimes, in a desire to escapefrom—or perhaps merely to hide—hisreal desires, the homosexual retreats intomarriage. In some instances, he is able toconceal his basic problem from his maritalpartner for a period of time; but, in anycase, marriage proves to be no cure" forhis homosexuality.

Director J. Edgar Hoover has announcedthat 13,530 persons, representing some4,600 organizations, attended the 178 lawenforcement conferences on the automo-bile theft problem which the FBI spon-sored throughout the United States during1956.
Stating that the regional conferences metwith an enthusiastic response in all partsof the nation, Mr. Hoover said that theparticipants agreed that automobile theftscan be substantially reduced only throughthe cooperative efforts of law enforcementagencies and car owners. Particular atten-tion was devoted to the problem createdby negligent motorists, such as those wholeave the keys in the ignition or forget tolock the doors and windows of theirvehicles.
In addition to discussing methods ofpreventing auto thefts, the participantsalso devoted attention to measures whichcan be employed to make it more difficultto use or sell a stolen motor vehicle with-out its stolen character being detected. In-cluded were many suggestions involvingmore thorough inspection of automobiles,greater uniformity of state title and regis-tration requirements, and closer supervi-sion of automobile salvage.
The FBI Director stated that in addi-tion to municipal, county, state and Fed-eral law enforcement officers, those attend-ing the conferences included representa-tives of the National Automobile TheftBureau, insurance firms, motor vehiclebureaus and other interested groups.
