In early 2017, the City of Rolla Fire & Rescue was contacted by the Department of the Army CriminalInvestigation Command — Foil Leonard Wood to assist in providing an arson investigation course inconjunction with their leadership. City ofRolla Fire & Rescue. Missouri Division of Fire Safety and theRolla Rural Fire Protection District. Over the last nine months we have participated in four classes whichhas provided arson investigation instruction to over 120 miLitary wan-ant officers.

Today, Major General Donna Martin — Commanding General Fort Leonard Wood and Kelly Jameson,Warrant Chief Officer - Forensic Scientist wish to recognize the City of Rolla Fire & Rescue. MissouriDivision of Fire Safety. and the RoLla Rural Fire Protection District for their leadership and assistancewith this program. The program continues to grow as the last course hosted U.S. Anny personnel andalso U.S. Marines.

Dog Park Paver and other public fund raising appeals have been halted asof 9-14-18 in deference to theAnimal Shelter fund raising campaign.

We look forward to assisting the City in any way thatwe can to expedite the construction of the Dog Park.

COMMENTARY:

Attached is the proposed budget for FY 2019. The budget remains very tight as we anticipatetax revenue growth between 1.5— 2.0%. The budget and all corresponding Funds are balanced withanticipated revenues and unrestricted find balances. but there remains little margin for unexpectedrevenue losses or major unplanned expenses, particularly in the General Fund.

The budget includes the first payment of the new firetruck (FY 18 expense of SI ,25M). gapfinancing ofS 1.5 M for the substantial design work on the Iwo sewer treatment plant upgrades. andthe addition of 4 new positions: police officer. parks maintenance/equipment operator and twoadditional equipment operators for the recycling/sanitation division. While we have been able to filla few key positions that were eliminated during the 2008 — 2012 recession we remain down 4positions in the fire department.

With what appears to be good growth!new investment in FY 2018 - 2019 our priorities stillfocus on providing quality basic City services, rebuilding cash reserves and providing someflexibility for City employees. In addition passage of Prop P (1/4 cent sales tax for traditional parks)provides ftill finding for the maintenance of all City parks and is providing $300,000 in capitalimprovements in the park system (restrooms & playground upgrades).

The budget does include a sewer service availability fee increase from $3 to S6/month onevery water meter for the pending S25M treatment plant upgrades, a fee increase for trasliirecyclingfees (last increased in 2015), and an increase in cemetery burial and plot fees (last increased in 2012).

Dear Mayor and Council:

Pursuant to the requirements of Section 67.020 of the Revised Statutes of Missouri, the Fiscal Year2018-19 Budget is hereby submitted. This Budget has been prepared in conjunction with the Mayor,Council and Department Directors who have anticipated the needs oftheir departments realisticallyin relation to both available money and department demands.

In every respect the 2018-19 Budget meets the legal requirement that expenditures not exceedanticipated revenues plus any unencumbered fund balance from the previous year. The 201 8-19Budget will begin on October 1,2018. The budget represents a total yearly program of $29,433,287offset by anticipated revenues of $28,908,103

— the deficit of $525,184 being made up from theSewer Fund and the Environmental Services Fund for special projects. The budget anticipates anoverall pay adjustment of 2.5% for quali’ing ftill-time City employees with modest growthprojections in other expenditure lines including an increase in retirement and health insurance costs.The budget includes $300,000 in park improvements thanks to Prop p (1/4 cent sales tax), a newlease payment on a new fire truck, and looming sewer treatment plant improvements. The budgetdoes include user fee increases in sewer rates, trashrecycling fees, building pennit fees and cemeteryplot and burial fees.

The 2018-19 Budget is submitted with the belief that it represents a worthy effort to obtain abalanced program for the ensuing year. The Budget expresses on paper and in dollars the never-ending struggle to provide Rolla citizens the most service possible for each tax dollar spent.

AN ORDINANCE ADOPTING AN ANNUAL BUDGET FOR THE FISCAL YEARBEGINNING ON OCTOBER 1. 2018 AND APPROPRIATING FUNDS PURSUANTTHERETO.

WHEREAS, the City Administrator has presented to the City Council an annualbudget for the fiscal year beginning on October I. 2018, and

WHEREAS, a public meeting on the budget was conducted on August 27, 2018,and the required public hearing scheduled on September 4, 2018, at which hearingcitizens were given an opportunity to be heard:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THECITY OF ROLLA, MISSOURI, AS FOLLOWS:

Section 1: The annual budget for the City of Rolla, Missouri, for the fiscalyear beginning October 1, 2018, a copy of which is attached hereto and made a partthereof as if filly set forth herein, having been hcretofore submitted by the CityAdministrator, is hereby adopted.

Section 2: Funds are hereby appropriated for the objects and purposes ofexpenditure set forth in said budget.

Section 3: This Ordinance shall be in full force and effect from and after itspassage and approval.

The Personnel Rules were last revised and adopted by City Council on April 2, 2007. TheCity conducts a formal review of the policies every five (5) to seven (7) years. Policy reviewbegan in 2016 and progressed through 2018 with Administration, Department Director andLegal review.

Tonight is the final reading of the proposed changes to the personnel manual. I have includedthe agenda coversheet from the last meeting as a reminder of the key changes made to thepolicy. There have been no additional changes made after the first reading on September 41•

Staff is recommending the approval of this ordinance with these proposed changes. Once thepersonnel manual is adopted. a bound copy will be distributed to City personnel and employeetraining will take place.

WHEREAS. an Ordinance dated April 2, 2007 authorized the City Council toadopt certain rules and regulations establishing the comprehensive personnel system forCity employees and did by said ordinance establish that such rules and regulations couldbe from time to time amended and modified by the City Council; and,

WHEREAS, the City Council deems it appropriate and necessary to modify andamend said Personnel Rules and Regulations in the City Code;

I, Added stepfather and stepmother to the definition of immediate family (page 11). This change is tobetter recognize the step parent roles ofa blended family.

2, Added clarification to new employee familiarization (page 21). jhis is to provide clarification thatwhen a new hire signs the acknowledgement form. they agree that they have received a copy of thepersonnel manual, have gone over the major sections during orientation but have not read andorunderstand the policy. t

a3. Added clarification for the promotion process for City departments (page 30).

Added clarification for departmental transfers (pages 31-32). An employee must retain a position intheir current depariment for at least one (I) year before requesting a transfer. Currently new hires arefinishing training with one department and transferring to another department with different demands.

5. Added Columbus Day to the holiday schedule and modified the Christmas Eve holiday (page 43).

6. Added language to clank items in the Borrowed Leave Policy (page 48-50). The majority of changesin this section are to the members of the Borrowed Leave Committee. The changes are to createconsistency with the Adininisirative Advisory Committee.

7. Added clarification to the hearing procedures for the Police Personnel Board and City PersonnelAppeals Board (page 69). A hearing officer will be approved and appointed prior to the hearing.

8. Rewrote Chapter 18 and created an Administrative Advisory Committee (AAC) (page 71). Thisreplaces the past Employee Advisory Committee (EAC) and reduces the number of committees used toreview various C iiy functions.

9. Added a section for social media (page 104-105). This addresses the growing participation in socialmedia in the workplace.

10. The proposed changes will be in eftect on October I, 2018, subject to the final reading at theSeptember 17,2018 meeting.

APPLICANT: The only property’s address affected by the proposed street name change (thesubject parcel) is owned by Rolla SNF LLC and is located at 2735 Eagleson Drive. Greg Spenceis the registered agent of this LLC and is one of the owners of the Silverstone Place Skilled Nursing& Rehabilitation Center, which is located on the subject parcel. Greg Spence is the applicant ofthis proposal.

LOCATION: The street subject to this ordinance (the subject street) was dedicated through theArwood Hills No. 1 Subdivision (the approximate 240 feet of ROW that connects Vichy Road tothe Rolla Skilled Nursing Home Facility Plat No.2) and through the Rolla Skilled Nursing FacilityPlat No. 2 (a 0.19 Acre cul-de-sac that consists of the end of the Eagleson Drive that connectsVichy Road to Lot I, Lot 3, and Lot 4 of the Rolla Skilled Nursing Home Facility Plat No. 2).

FINDINGSPROJECT BACKGROUND/DESCRIPTION: When Eagleson Drive was first dedicatedthrough the Anvood Hills No. I Subdivision, it was intended to be a loop that began at theintersection of Vichy Road and the area between the northeast sides of Lot I and Lot 2 the ArwoodHills No. 1 Subdivision and ended at the intersection of Vichy Road and the area between thenortheast sides of Lot 6 and Lot 7 of the Anvood Hills No. 1 Subdivision. Shortly afler ArwoodHills No. 1 was platted, the idea of the loop was abandoned and all that would remain of EaglesonDrive were the ends of the loop where they transected with Vichy road. Because of this, twoEagleson Drives exist today. The Eagleson Drive that is to have its name changed begins at theintersection of Vichy Road and the area between the northeast sides of Lot 1 and Lot 2 the ArwoodHills No. 1 Subdivision and extends to the southwest (See Figure 1 for the street location). Theother Eagleson Drive that is to remain named Eagleson Drive begins at the intersection of VichyRoad and the area between the northeast sides of Lot 6 and Lot 7 of the Arwood Hills No. ISubdivision and extends to the northwest along the fronts of Lots 7-9 and through Lots 27-30 ofthe Anvood Kills No. 1 Subdivision and ends at Lot 1 of the Rolla Skilled Nursing Home FacilityPlat No.2.

CAUSE AND PUBLIC PURPOSE OF PROPOSAL:The applicant agreed to apply for the street name change upon the City’s recommendation. TheCity recommends this street name change in order to prevent confusion for emergency firstresponders and others from turning down the wrong Eagleson Drive because it could possiblycause the first responders to unnecessarily prolong their response time to an emergency. Inaddition, such a street name change would help prevent the visitors of the nursing home fromtaking a wrong turn, which causes unnecessary traffic in the Arwood Hills subdivision,

PROCESS:The City Council approved Resolution 1929 that authorized the City to iHitiate the process ofchanging the subject street’s name. This resolution was posted in the Rolla Daily News for oneweek, as required by state law (RSMO 77.230). Four weeks subsequent to the last day ofadvertising the resolution, there has been no written petitions submitted to the City from anyproperty owner along the subject street. According to state law. once such a resolution has beenadvertised in such a paper and no such written petitions are submitted after a period of four weeksafter the last day of such a resolution being advertised (last advertisement was July 29, 201 8), theCity Council has the authority to change the name of such a street by ordinance. Therefore, enoughtime has passed since the last advertisement for the City Council to change the street name throughordinance,

PUBLIC & INTERNAL COMMENTS: No protest petitions or internal comments have beenfiled to this department.

ACTION REOUIRED: The Planning and Zoning Commission unanimously approved theresolution that initiated this process. The action requested from the City Council is conduct thefinal reading ofan ordinance that would change the name of the street that begins at the intersectionof Vichy Road and the area between the northeast sides of Lot 1 and Lot 2 of the Anvood HillsNo. I Subdivision and ends at the rim of the cul-de-sac that connects Lot I. Commentary:

Our current Minor in Possession Ordinance Sec 4-4 Purchase or possession by a minor, onlymakes it a crime for a minor to purchase or be in possession of alcohol. By contrast, the state lawmakes it a crime for a minor to either purchase, be in possession of alcohol or to have consumedalcohol (either by being visibly intoxicated or having a BAC [Blood Alcohol Content] in excessof .02%). Officers are routinely charging underage drinkers through the state statute rather thancity ordinance because of this fact, It is easier to prove possession by having a teen give a breathsample using a Portable Breath Tester (PBT) then proving that the teen was holding an intoxicatingbeverage when the police arrived. As you can imagine the scene upon the arrival of the police,full or partially full alcoholic beverages sitting around everywhere but of course, nobody claimsthem. Unless the officer can prove that specific, drink was in that specific minor’s possession it ishard to get a conviction. With that being said we would like to see the city expand the ordinanceto frilly mirror the state stature (RSMo. 311.325) so that officers can have consistency in enforcingthese two laws.

Recommendation:

Staff recommends final reading of this ordinance.

Section 1: That Section 4-4. Purchase or possession by a minor - prohibited, of theCode of the City of Rolla. Missouri, is hereby amended to read as follows:

Sec. 4-4. Purchase or possession by a minor - Prohibited; penalty’ provisions.

a. It shall be unlawfiul for any’ person under the age of twenty-one (21) years toknowingly purchase or attempt to purchase or knowingly have in his possessionany intoxicating liquor as defined in Section 311.020 (RSMo) or who is visibly inan intoxicated condition as defined in Section 577.001 (RSMo), or has a detectableblood alcohol content of more than two-hundredths of one percent or more byweight of alcohol in such persons body.

b. Any person found guilty of violating the provisions of this Section shall be subjectto a fine of not to exceed three hundred and no/l00 (S300.00) dollars (Ord. 2381,§1; Ord. 3683, §1)

AN ORDINANCE AMENDING SECTION 27-66 OF THE GENERAL ORDINANCES OF THECITY OF ROLLA, MISSOURI, KNOWN AS THE CODE OF THE CITY OF ROLLA,MISSOURI PERTAINING TO REGULATION OF SPEED.

NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF ROLLA. MISSOURI AS FOLLOWS:

Section 1: That Section 27-66 of the General Ordinances of the City of Rolla. Missouri,known as the Code of the City of Rolla, Missouri is hereby amended by deleting the following:

Sec. 27-66. Maximum limits established generally.

No vehicle shall be moved or propelled along, over or upon any street at a greaterrate of speed than is reasonable, having regard to the traffic and use of such streetor so as to endanger the life or limb of any person or the safety of any property, andshall in any event, while upon any such street, not be moved or propelled at a greaterrate of speed than twenty-five miles per hour. except on the following streets orportions of streets and the speed limit shall not be greater than provided by thefollowing: (Ord. 3903, §2).

Eighteenth Street. Between a point approximately 140 feet east of Farrar Driveand Forum Drive, thirty miles per hour.

Highway 72. Between intersection with U.S. Highway 63 and a point locatedapproximately 1,250 feet east of Route 0, a.k.a. Lecoma Road, thirty-five miles perhour; between such point located approximately 1,250 feet east of Route 0, a.k.a.Lecoma Road and the south right of way line of Lions Club Drive, 45 miles perhour; between the south right of way line of Lions Club Drive to southeast citylimits, fifty five miles per hour.

Route E (Nagogarni Road). Between Bishop Avenue (U.S. Highway 63) and westcity limits, thirty-five miles per hour.

Section 2: That Section 27-66 of the General Ordinances of the City of Rolla. Missouri.known as the Code of the City of Rolla, Missouri is hereby amended by adding the following:

We therefore recommend award to the lowest responsive bidder, Robinson FenceCompany of Springfield, MO, for $27,256.92.

CONTRACT AGREEMENT

THIS AGREEMENT, made and entered into this

by andbetween the City of Rolla, Missouri, Party of the First Part and hereinafter called Owner, and

Robinson Fence Company Party of the second Part andhereinafter called the Contractor.

WITNESSETH:

THAT WHEREAS, the Owner has caused to be prepared, in accordance with law, specifications,plans, and other Contract Documents for the work herein described, and has approved and adoptedsaid documents, and has caused to be published and adverised for and in connection with theconstruction of: Dog Park Fencing, PROJECT 476, in complete accord with the ContractDocuments and the said plans and specifications; and

WHEREAS, the said Contractor, in response to such advertisement, has submitted to the Owner,in the manner and at the time specified, a sealed proposal in accordance with the terms of saidadvertisement; and

WHEREAS, the Owner, in the manner prescribed by law, has publicly opened, examined andcanvassed the proposals submitted in response to the published invitation therefore, and as a resultof such canvass has determined and declared the aforesaid Contractor to be lowest and best bidderfor the said work and has duly awarded to the said Contractor a contract therefore, for the sum orsums named in the Contractor’s proposal, a copy thereof being attached to and made a part of thiscontract.

NOW THEREFORE, in consideration of the compensation to be paid to the Contractor and of themutual agreement herein contained, the parties to these presents have agreed and hereby agree, theOwner for itself and its successors, and the Contractor for itself, himself, or themselves, or its, hisor their successors and assigns, or its, his, or their executors and administrators, as follows:

ARTICLE I. That the Contractor shall (a) furnish all tools, equipment, supplies, superintendent,transportation, and other construction accessories, services and facilities; (b) furnish all materials,supplies, and equipment specified and required to be incorporated in, and form a permanent partof the completed work except the items specified to be furnished by the Owner; (c) provide andperform all necessary labor, and (d) in a good, substantial, and workmanlike manner, and inaccordance with the provisions of the General Conditions and the Special Conditions of theContract, which are attached hereto and made a part hereof, and in conformity with the ContractPlans and Specifications designated and identified therein, execute, construct, and complete allwork included in, and covered by the Owner’s official award of this Contract to the said Contractor,such award being based on the acceptance by the Owner of the Contractor’s proposal, for theconstruction of Dog Park Fencing, PROJECT 476.

It is fur her stipulated that not less than the prevailing hourly rate of wages as found by theDepartment of Labor and Industrial Relations of the State of Missouri, or determined by the Courtof Appeal shall be paid to all workers performing work under this Contract.

ARTICLE II. Contractor acknowledges that Section 285.530, R.S.Mo, prohibits any businessentity or employer from knowingly employing, hiring for employment, or continuing to employan unauthorized alien to perform work within the State of Missouri. Contractor thereforecovenants that it is not knowingly in violation of Subsection 1 of Section 285.530, R.S.Mo, andthat it will not knowingly employ, hire for employment, or continue to employ any unauthorizedaliens to perform work on the Project, and that its employees are lawfully eligible to work in theUnited States.

ARTICLE III. Occupational Safety and Health Administration (OSHA)Safety Training:a. Contractor shall provide a ten (10) hour Occupational Safety and Health Administration

(OSHA) construction safety program for all employees who will be on-site at the project.The construction safety program shall include a course in construction safety and healththat is approved by OSHA or a similar program approved by the Missouri Department ofLabor and Industrial Relations which is at least as stringent as an approved OSHA programas required by Section 292.675, R.S.Mo.

b. Contractor shall require its on-site employees to complete a construction safety programwithin sixty (60) days after the date work on the project commences.

c. Contractor acknowledges and agrees that any of Contractor’s employees found on theproject site without the documentation of the successful completion of a construction safetyprogram shall be required to produce such documentation within twenty (20) days, or willbe subject to removal from the project.

d. Contractor shall require all of its subcontractors to comply with the requirements of thisSection and Section 292.675, R.S.Mo.

Notice of Penalties for Failure to Provide Safety Traininga. Pursuant to Section 292.675, R.S.Mo, Contractor shall forfeit to City as a penalty two

thousand five hundred dollars ($2,500.00), plus one hundred dollars ($100.00) for each on-site employee employed by Contractor or its Subcontractor, for each calendar day, orportion thereof, such on-site employee is employed without the construction safety trainingrequired in Safety Training section of Article Ill above.

b. The penalty described in above subsection A of this section shall not begin to accrue untilthe time periods described in Sections B and C Safety Training of Article III above haveelapsed.

c. Violations of Article III — Safety Training above and imposition of the penalty describedin this Section shall be investigated and determined by the Missouri Department of Laborand Industrial Relations.

ARTICLE IV. That the Contractor shall construct and complete the work designated anddescribed in the foregoing proposal and attached specifications in accordance with the Notice toBidders, Instruction to Bidders, Proposal, Bond, General Conditions, Special Conditions,Technical Specifications, Drawings, Addenda, and other component parts of the Contract

Documents hereto attached, all of which documents from the Contract and are as fully a part heretoas if repeated verbatim herein.

ARTICLE V. That the Owner shall pay to the Contractor for the performance of the workdescribed as follows: Complete construction of the improvements in accordance with plans andspecifications; and the Contractor will accept as full compensation therefore, the sum (subject toadjustment as provided by the Contract) of $27,256.92 for

ARTICLE VI. That the Contractor shall begin assembly of materials and equipment within ten(10) days after receipt from the Owner of executed copies of the Contract.

Liquidated Damages - Should the contractor fail to complete the work on or before the completiondate specified the contractor will be charged liquidated damages in the amount of $100.00 percalendar day for each full calendar day that the work is not fully completed. Liquidated damageswill not be charged for weekends and holidays.

ARTICLE VII. Before the final payment can be made to the Contractor on the project, theContractor must complete and return the Affidavit Compliance with the Prevailing Wage Lawform furnished at the end of the Special Conditions section.

ARTICLE VIII. Before the final payment can be made on the project to the Contractor, theContractor must complete and return the Contractor’s Affidavit Regarding Settlement of Claimsform furnished at the end of the Special Conditions section.

ARTICLE IX. This Contract will not be binding and effective until confirmed by the Owner.

COMMENTARY: On 08/27/2018 we went out for bids on four (4) new 2019 model year,all-wheel drive Pursuit Package SUV/Utility Vehicles (Police SUV’s).

This process was started earlier than normal due to the fact that Ford announced a modelyear change over (new body style), with order deadlines of 09/21/2018 to get the 2019model. Any orders after this date would result in ordering a 2020 Ford Police InterceptorUtility Hybrid, which would be approximately $3,000 higher per vehicle. Since thisannouncement was made, the order cutoff has been rolled back one week to 09/14/2018,because of the high volumes of orders which Ford has received. Their plant will be shutdown on February 28, 2019 so that they can change their line for the new 2020 FordPolice Interceptor Utility Hybrid.

COMMENTARY:While there seems to be considerable sentiment that Missouri’s infrastructure is

deteriorating and needs new investment, neither the MO Legislature nor MO citizens have founda good solution.

HB 1460 is a strangely worded bill that phases in a 10-cent gas tax over the next four years.Missouri’s current gas tax ($0.17) is among the lowest in the country with one of the largesttransportation systems in the Country in tenns of miles and bridges. The MO Constitution dictatesthat cities and counties receive 15% each of the gas tax revenues ($309,000 for Rolla after frillimplementation).

There is no obligation for the City Council to take a position on Prop. D but citizens arelikely looking for leadership from both State and Local leaders on same. The two draft resolutionsprovide an opportunity to either acknowledge the Local benefit of Prop. D or to affirmativelysupport the effort. Discussion needed.
