Approval of the Memorandum of Agreement with the Civil Service Commission (CSC) for the Use of Office

Space and Facilities for the CSC Field Office in the GSIS Headquarters Building1

RESOLUTION NO. _____

WHEREAS, in a letter dated 4 November 2019, the Civil Service Commission (CSC) – National Capital Region requested to use office space in the GSIS Headquarters Building to house the CSC Field Office located at the Department of Foreign Affairs Building along Roxas Boulevard, which is undergoing retrofitting, and to establish a new field office to improve its services;

WHEREAS, Section 18, Chapter 4, Book V of the Administrative Code of 19872 provides:

“The Civil Service Commission shall, whenever it deems it in the interest of the public service, organize in each department, office, agency, government-owned or controlled corporation, and provincial and city government a Civil Service Staff which shall be headed by an officer of the Commission. The necessary staff personnel and office facilities and equipment shall be provided by the department, government-owned or controlled corporation or local government where the staff is established but the Commission may augment these with its own.”

WHEREAS, GSIS granted the CSC’s request and has been providing free use of office space and facilities since 1 March 2020 for the CSC Field Office, similar to the accommodation granted to the Commission on Audit unit assigned in GSIS;

WHEREAS, the CSC requires that a MOA be issued for the existing arrangement with GSIS, which is not covered by the Manual of Codified Signing and Approving Authorities;

WHEREAS, the Legal Services Group has reviewed the proposed MOA with the CSC on the free use of office space and facilities, with a term of three years starting 1 March 2020, subject to renewal upon mutual agreement of the parties, as submitted by the Executive Vice President for the Support Services Sector in his memorandum dated 2 March 2021;

RESOLVED, to APPROVE and CONFIRM the MOA with the CSC on the use of office space and facilities for the CSC Field Office in the GSIS Headquarters Building;

RESOLVED FURTHER, to AUTHORIZE the President and General Manager to sign the above-mentioned MOA on behalf of GSIS.

A copy of the above-mentioned MOA is made an integral part of this Resolution.

MEMORANDUM OF AGREEMENT

This Agreement is made and entered into by and between:

The CIVIL SERVICE COMMISSION, a constitutional commission organized and existing under Section I, Article IX (B) of the 1987 Philippine Constitution with office and postal address at IBP Road, Constitution Hills, Quezon City, herein represented by its Chairperson, ALICIA dela ROSA-BALA, and hereinafter referred to as the "CSC";

and

The GOVERNMENT SERVICE INSURANCE SYSTEM, a social insurance institution created under Commonwealth Act No. 186, as amended, and operating under its present Charter, Republic Act No. 8291, otherwise known as the "GSIS Act of 1997," with principal address at GSIS Headquarters, Financial Center, Pasay City, herein represented by its President and General Manager, ROLANDO L. MACASAET, and hereinafter referred to as the "GSIS."

RECITALS

WHEREAS:

1. The CSC, as the central human resource agency of the government, ismandated to promulgate policies and standards relative to governmenthuman resource management, uphold merit and fitness in the civil serviceand act on human resource actions and transactions, among others;

2. The GSIS, as a social insurance institution, is primarily responsible forproviding social security and financial benefits to all government employeesand qualified dependents.

3. Under Section 18, Chapter 4, Book V of the Administrative Code (ExecutiveOrder No. 292, the CSC shall, whenever it deems necessary in the interestof public service, organize in each department, office, agency, government­owned or controlled corporation, and provincial and city government CivilService Staff headed by its officer to serve as the principal liaison betweenthe CSC and the agency concerned. Moreover, the necessary staffpersonnel and office facilities and equipment shall be provided by thedepartment, government-owned and controlled corporation or localgovernment where the staff is established but the CSC may augment thesame with its own.

4. The existing CSC Field Offices with its assigned personnel who areoverseeing government agencies in the northern/central part of the NationalCapital Region (NCR), are not sufficient to provide the necessary servicesand assistance specifically in the areas of appointment processing andcascading of CSC initiatives and programs.
