Minutes of 216 th SEAC Meeting Date 25/05/2015 The 216 th meeting of SEAC was held in Directorate of Environment, U.P. on 25/05/2015. File No. 2447/SPO-V The committee noted that an application dated 14/06/2015 was made by the project proponent M/s Solaris Infra projects Pvt. Ltd. for Environmental Clearance of Group Housing Project ‘Solaris City” at Plot No-16F, Sector-1, Greater Noida. The project proponent again submitted a letter dated 18/05/2015 through which is was informed that there are certain changes in planning and there is slight amendment in the built up area of the project, However, the plot area alongwith the land specifications do remain the same. A presentation was made by Shri Mritunjay Kumar, Director/authorized representative of project proponent alongwith their consultant M/s Grass Roots Research & Creation India (P) Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:- 1. The 216th

meeting of SEAC was held in Directorate of Environment, U.P. on

The Chairman welcomed the members to the 216th SEAC meeting.

The minutes of 215th SEAC meeting dated 23/05/2015 were confirmed.

The Members of SEAC unanimously taken following decisions on the agenda

points discussed:

1- Group Housing Project ‘Solaris City” at Plot No-16F, Sector-1, Greater Noida. Sri

Mritunjay Kumar, Director, 102-105, 2nd Flor, JS Arcade, Secto-18, Noida. File No.

2447/SPO-V

The committee noted that an application dated 14/06/2015 was made by the project

proponent M/s Solaris Infra projects Pvt. Ltd. for Environmental Clearance of Group Housing

Project ‘Solaris City” at Plot No-16F, Sector-1, Greater Noida. The project proponent again

submitted a letter dated 18/05/2015 through which is was informed that there are certain

changes in planning and there is slight amendment in the built up area of the project,

However, the plot area alongwith the land specifications do remain the same.

A presentation was made by Shri Mritunjay Kumar, Director/authorized

representative of project proponent alongwith their consultant M/s Grass Roots Research &

Creation India (P) Ltd. The proponent, through the documents submitted and the presentation

made, informed the committee that:-

1. The environmental clearance is sought for Group Housing Project ‘Solaris City” at

Plot No-16F, Sector-1, Greater Noida, U.P. M/s Solaris Infra projects Pvt. Ltd.

2. Solaris Infra projects Pvt. Ltd. has obtained Environmental Clearance from SEIAA,

U.P. vide Letter no. 1873/Parya/SEAC/1727/2013/AD(H) dated 12.10.2013 for

existing plot area 24,620 m2 (6.08 acres) and built up area 1,22,721 m

2.

3. As there is increase in F.A.R., so, there is increase in built up area i.e. total built up

area becomes 1,31,665.768 m2 from

1,22,721 m

12. The project proposals are covered under category 8"a" of EIA Notification, 2006.

The project proponent informed that revised maps in commensuration to the revised

proposal have been submitted to the Greater Noida Authority. The committee discussed the

matter and deliberated that recommendation for grant of environmental clearance on the

project proposals alongwith general conditions as earlier prescribed by the authority for

construction project and following specific conditions may be made subject to submission of

approved plans and structural safety certificate vetted by qualified structural engineer

regarding the revised proposals:

1. 3.5 m peripheral green shall be provided around the project inside the project boundary.

2. Setback as per authority bye-laws shall be left on front and each side of the building. 3. 15% area of the total plot area shall be compulsorily made available for the green belt

development including the peripheral green belt.

4. NOC from Fire Fighting Department and Airport Authority of India should be obtained.

5. Criteria/ norms provided by competent Authority regarding the seismic zone be

followed for construction work. Provision of alarm system, to timely notify the

residents, in case of occurrence of earthquake/other natural disasters/fire should be

provided. A well defined evacuation plan should also be prepared and regular mock

drills should be arranged for the residents. Rise of stairs should be constructed in a way,

so that it should provide smooth movement.

6. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

7. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water.

8. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the compliance of the E-waste and municipal solid waste disposal.

9. Environmental Corporate Responsibility (ECR) plan along with budgetary provision amounting to Rs. 2.5 Crore shall be prepared and approved by Board of Directors of the

company. A copy of resolution as above shall be submitted to the authority. A list of beneficiaries with their mobile nos./address should be submitted alongwith six monthly

compliance reports. 10. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases.

11. Parking guideline as per Greater Noida Development Authority should be followed.

Parking for disabled persons should be explored.

12. All entry/exit point should be bell mouth shaped.

13. Submit section of 06 m wide road.

14. To discharge excess treated waste water into public drainage system, permission from

the competent authority to be taken prior to any discharge.

15. RWH shall be initially done only from the roof top. RWH from green and other open

areas shall be done only after permission from CGWB.

16. An underground Pucca tank for collection/reuse of rain water may be constructed.

17. Height of the stack should be provided based on combined DG sets capacity and be 6mt higher than the tallest building.

18. Post project monitoring for air, water (surface+ ground), Stack noise of D.G. sets, STP to be carried out as CPCB Guidelines.

19. Crèche to be provided during the construction/operation phase. 20. Provision of separate room for senior citizen with proper amenities shall be made.

21. Protection shall be provided on the windows of the high rise flats for security of residents.

22. Unless and until all the environmental issues are sorted out the occupancy will be restricted

and would be only allowed after achieving the Permission from the competent authority. 23. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law.

24. For any extraction of ground water, prior permission from CGWB shall be taken.

25. Sprinkler to be used for curing and quenching and ready mix concrete may be used for construction.

26. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

27. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc. Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

2- Group Housing at Vill-Mao, Kanth Road, Moradabad. Sri I K Thakur, GM, Paific

Development Corp., Sahibabad Idustrial Area, Ghaziabad. File No. 2450/AD-H

The committee noted that the construction work beyond 20,000 sqm regarding the

project has already been undertaken without seeking prior environmental clearance. In

view of this, the committee directed that the project proponent should be directed to

submit compliance to O.M. dated 12/12/2012 regarding violation of E.P. Act for

construction without obtaining prior environmental clearance. The project proponent

should also provide the names and address of the Members of Board of Directors

including Chairman with their address and details of year wise construction including

details (building wise/block wise/floor wise). This information should be communicated

to all committee members alongwith copy of compliance to MoEF OM dated 12/12/2012.

After getting this information, Secretary, SEAC shall make a communication to State

Govt. for providing permission regarding initiation of legal action for violation of E.P.

Act in the matter against the project proponent. The matter shall be discussed by the

committee after receipt of information from UPPCB regarding initiation of credible legal

action.

3- Group Housing Project “Apex Golf Avenue”at Plot No-GH-3, Sports City-1,

Techzone-IV, Greater Noida. Sri Sandeep Batra, Director, F-3, Golf Link Road,

Opp. Khaitan Public School, Sec-39, Noida. File No. 2451/AD-Sub

The committee noted that an application dated 19/07/2014 was made by the project

proponent M/s Floral Realcon Pvt. Ltd. for Environmental Clearance of Group Housing

Project “Apex Golf Avenue” at Plot No-GH-3, Sports City-1, Techzone-IV, Greater Noida. A

presentation was made by Shri Sandeep Batra, project proponent along with their consultant

M/s Ascenso Enviro Private Limited. The committee discussed the matter and directed the

project proponent to submit following information:

1. Approval letter regarding FAR allotment.

2. Submit the approved copy of layout.

3. Setback details as per authority bye-laws.

4. The structure design certificate vetted by qualified structure engineer.

5. Provision of alarm system, to timely notify the employees/residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided.

6. 15% of total plot area should be green. Revised plan should be submitted. At

least 200 trees should be planted.

7. 03 m peripheral green shall be provided around the project inside the project

boundary. Details of landscape plan with list of ornamental trees.

8. Submit section of internal road with ROW and carriage way.

9. Storage water tank should be provided for storm water collection.

10. Provision of over head tank should be made for fire fighting. Fire NOC should

be taken. 11. Provision of 100% solar lighting along the road site, stair cases, common

places. 12. RWH shall be initially done only from the roof top. RWH from green and

other open areas shall be done only after permission from CGWB.

13. Provision of 10% EWS/LIG in the project.

14. Plan for organic waste convertor.

15. Environmental Corporate Responsibility (ECR) plan along with budgetary

provision amounting to 2% of total project cost shall be prepared and

approved by Board of Directors of the company. A copy of resolution as

above shall be submitted to the authority. A list of beneficiaries with their

mobile nos./address should be submitted alongwith six monthly compliance

reports.

The matter shall be discussed after submission of information as above.

4- Residential Cum Commercial Complex at Vill-Aurangabad Khalsa, Pargana-Bijnor,

Lucknow. Sri Ashok Kumar Shukla, Sec., 588/186, Bhadrukh, Jail Road, Lucknow.

File No. 2452/SPO-V The committee noted that an application dated 22/07/2014 was made by the project

proponent M/s New Sahyogi Sahkari Awas Samiti Ltd. for Environmental Clearance of

Residential Cum Commercial Complex at Vill-Aurangabad Khalsa, Pargana-Bijnor,

Lucknow. A presentation was made by Shri Ashok Kumar Shukla, authorized representative

of project proponent along with their consultant M/s Paramarsh. The committee discussed the

matter and directed the project proponent to submit following information:

1. Approval letter regarding FAR allotment. 2. Submit the approved copy of layout.

3. Setback details as per authority bye-laws. 4. The structure design certificate vetted by qualified structure engineer.

5. Provision of alarm system, to timely notify the employees/residents, in case of occurrence of earthquake/other natural disasters/fire should be provided.

6. 03 m peripheral green shall be provided around the project inside the project boundary.

7. Submit section of internal road.

8. Provision of water body with kuccha based for storm water collection.

9. Name and addresses of authorised vendors for Municipal Solid waste disposal

10. Fire/AAI NOC.

11. Area details showing proposed uses as residential, commercial, parks, parking,

roads, other services, facilities of the project also in percentage.

12. Provision of over head tank should be made for fire fighting.

13. Provision of 100% solar lighting along the road site, stair cases, common

places.

14. RWH shall be initially done only from the roof top. RWH from green and

other open areas shall be done only after permission from CGWB.

15. Provision of 10% EWS/LIG in the project.

16. Provision of convenient shopping. 17. Environmental Corporate Responsibility (ECR) plan along with budgetary

provision amounting to 75.0 Lac shall be prepared and approved by Board of Directors of the company. A copy of resolution as above shall be submitted to

the authority. A list of beneficiaries with their mobile nos./address should be submitted alongwith six monthly compliance reports

5- Group Housing Project at Gata No-127, 118, 135, 138, 120, 221, 197, 201, 201, 204,

214, 225, Vill-Kasimpur Biruha, Pargna & Tehsil-Mohanlalganj, Lucknow. Sri

Jawed Irshad, Director, C/o Wing Construction & Developers Pvt. Ltd. File No.

2453/OSD-T

The committee noted that an application dated 24/07/2014 was made by the project

proponent M/s Wing Constructions & Developers Pvt. Ltd. for Environmental Clearance of

Group Housing Project at Gata No-127, 118, 135, 138, 120, 221, 197, 201, 201, 204, 214,

225, Vill-Kasimpur Biruha, Pargna & Tehsil-Mohanlalganj, Lucknow. A presentation was

made by Shri Jawed Irshad, authorized representative of project proponent along with their

consultant M/s Sawen Consultancy Services Pvt. Ltd. The committee discussed the matter

and directed the project proponent to submit following information:

1. Copy of maps submitted to LDA with receiving alongwith ownership

documents. 2. Gazzette of Master plan 2031. The proposed site is green belt as per Lucknow

Master Plan. Land use certificate from LDA should be submitted. 3. Width of roads should be according to building bye-laws. Plan should be

submitted. 4. 15% of total plot area should be green. Also 5% area should be provided for

rain water harvesting purposes. Plan should be submitted.

5. Sale deeds of all khasra nos. of the project should be submitted.

6. Size of all proposed plots/nos of plots, setbacks/total no. of unit proposed

should be submitted.

7. Area details showing proposed uses as residential, commercial, parks, parking,

roads, other services, facilities of the project also in percentage.

8. All plans and elevation sections/all service plan/landscape plan/standard

electrification plan/drainage/sewerage plan.

9. Approach road should be maintained by project proponent.

10. Provision of over head tank should be made for fire fighting.

11. Provision of 100% solar lighting along the road site, stair cases, common

places.

12. RWH shall be initially done only from the roof top. RWH from green and other open areas shall be done only after permission from CGWB. Plan should

be submitted. 13. Storage water tank should be provided for storm water collection.

14. Point of discharge of treated effluent alongwith route upto ultimate discharge point. Map of the same should also be submitted.

15. Environmental Corporate Responsibility (ECR) plan along with budgetary provision amounting to 2% of project cost shall be prepared and approved by

Board of Directors of the company. A copy of resolution as above shall be

submitted to the authority. A list of beneficiaries with their mobile

nos./address should be submitted.

16. Provision of 10% EWS/LIG in the project.

The matter shall be discussed after submission of information as above.

6- Group Housing Project “Olympus Group Housing” at plot No-2, Sector-M, Sushant

Golf City Extension, Lucknow Sri Vinod Tiku, Executive Director (Projects), 306,

Ansal Naurang House, 21, KG Marg, New Delhi File No. 2255/AD-Sub.

The committee noted that the matter was earlier discussed in SEAC meeting dated

10/01/2015 wherein the project proponent was directed to submit following information:

1. All approved layout plan/building plan/service plans from the competent authority

is to be submitted with the signature of an architect certifying that they are all in

the conformity with the master plan of the area and as per building bylaws/rules

and regulation of the authority. Submit structural design with the signature of

competent/qualified structural engineer.

2. Approved extension plan from LDA should be submitted.

3. Submit the compliance report of environmental clearance issued earlier by

SEIAA, U.P.

4. Permission from CGWB is to be submitted.

5. Details of installation of water meter also assess for water yield regarding the

borewell should be submitted.

6. Plans for green belt development around the periphery of the scheme leaving 03 m

boundary wall. Trees to be planted in 3 meter wide on all sides. Astonia tree to be

added in tree plantation.

7. Certificate of ground water level at the site from the competent authority.

8. Plan for recharging the pond by rain water.

9. Design of all block should be submitted.

10. Lab certificate should be submitted alongwith the approved parameters.

11. Details to be given regarding EWS and LIG bring provided at town ship level.

12. All dimensions of internal roads to be given

13. Parking two nos. in corner to be deleted.

14. Structure design for each tower is to be submitted.

15. CSR scheme is being implemented at town ship level as such details to be

provided.

The project proponent submitted their replies through letter dated 12/02/2015. A

presentation was made by Shri Vinod Tiku, project proponent along with their consultant M/s

Min Mec Consultancy Pvt. Ltd. The committee discussed the matter and recommended grant

of environmental clearance on the project details as given at Para-A alongwith following

specific and general conditions:

1. Submit letter through which plans have been submitted to LDA for approval. Approved

plan should be submitted within one month.

2. Large copy of maps should be submitted.

3. Compliance report regarding clearance of mother city should be submitted.

6. Criteria/ norms provided by competent Authority regarding the seismic zone be

followed for construction work. Provision of alarm system, to timely notify the

residents, in case of occurrence of earthquake/other natural disasters/fire should be

provided. A well defined evacuation plan should also be prepared and regular mock

drills should be arranged for the residents. Rise of stairs should be constructed in a way,

so that it should provide smooth movement.

7. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization. 8. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water. 9. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the compliance of the E-waste and municipal solid waste disposal.

10. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to 2% of total project cost shall be prepared and approved by Board of

Directors of the company. A copy of resolution as above shall be submitted to the

authority. A list of beneficiaries with their mobile nos./address should be submitted

alongwith six monthly compliance reports.

11. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases.

12. Parking guideline as per Lucknow Development Authority should be followed. Parking

for disabled persons should be explored.

13. All entry/exit point should be bell mouth shaped.

14. 10% EWS / LIG housing provision shall be made as per Development Authority bye-laws.

15. To discharge excess treated waste water into public drainage system, permission from the competent authority to be taken prior to any discharge.

16. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB. 17. An underground Pucca tank for collection/reuse of rain water may be constructed.

18. Height of the stack should be provided based on combined DG sets capacity and be 6mt higher than the tallest building.

19. Post project monitoring for air, water (surface+ ground), Stack noise of D.G. sets, STP

The committee noted that the matter was earlier discussed in SEAC meeting dated

31/01/2015 wherein the project proponent was directed as follows:

1. Earlier E.C. dated 12/10/2013 was in the name of "Mayfair Residency" however the expansion is sought under the name "Mayfair" only. This change

in project name may be clarified with supporting documents. 2. Kalindi Bird Sanctuary was mentioned to be at a distance of 13.57 KM WSW

direction of the project site in the proposal submitted earlier, against which E.C. dated 12/10/2013 was issued however Kalindi Bird Sanctuary is

mentioned to be 17.5 KM SW direction in the expansion application. This

mismatch should be clarified alongwith maps showing the Kalindi Bird

Sanctuary with reference to the project site.

3. Under environmental sensitivity it is mentioned that no water bodies within 15 KM radius and, only Yamuna River is at 18 KM West whereas in the earlier

proposal against which E.C. dated 12/10/2013 was issued, Hindon River has been mentioned at a distance of 2.91 KM.

4. Similar glaring mismatches are evident in application however the above 02 (point no. 2 & 3) are crucial with environmental sensitivity point of view. This

should be clarified alongwith proper justification.

The committee also directed the proponent to submit following information:

1. Reasons of grant of increase in FAR with related documents.

2. Copy of structural design approved by Authority and structural design

engineer for revised proposal.

3. Compliance report to earlier E.C. dated 12/10/2013.

4. Podium shall not be covered under green. Change the percentage of green in

area chart accordingly and compensatory plans, if any. 5. Parking plan above podium parking should be confirmed from Noida

Authority with related bye-laws. 6. Permission of Authority for discharge of treated sewage in to public sewer

lines as proposed. 7. Plan for installing water meters at water intake and water discharge points.

8. All revised services plans. 9. Detailed CSR plan with Rs. 5.0 crores should be submitted.

The project proponent submitted their replies through undated letter received on

20/02/2015 in the Directorate. A presentation was made by Shri Tilak Raj, authorized

representative of project proponent along with their consultant M/s Ind Tech House Consult.

The project proponent informed that:

1. The project name is “May Fair Residency” which was misprinted as Mayfair in earlier

presentation. Hence, “May Fair Residency” is the name of project.

2. In the application submitted earlier , it was mentioned that Kalindi Bird Sanctuary

was at a distance of 13.57 KM WSW which was submitted by some other

consultant. As per point no. 9 (II) of the Form I, we have to give environment

sensitivity within 15 km radius of the project site. The Kalindi Kunj bird sanctuary

lies outside the 15 km radius of the project site. The correctness of the same is

checked again in view of observation & found correct.

3. Local body (GNIDA) granted purchasable FAR 75 in addition to 275 FAR already

permitted FAR as per GNIDA building bye laws. Hence, total FAR is now 350

instead of 275. The project is also approved for 350 FAR . Copy of sanctioned layout

plan and building bye laws already submitted during presentation dated 31st Jan.

2015.

4. Structural design has been vetted by Jamia Millia Islamia.

5. Green area provided over podium is not covered under green. It is open to sky.

Revised Green area calculations, are given in the approved landscape plan. In fact

there is increase in green area. As per the previous EC the Total green area was

13040.364 m2 and as per revised sanctioned drawing the total green area is 13874.91

m2. Out of 13874.91 m2, 3644.25 m2 (15.18% of plot area) is peripheral green and

remaining 10230.66 sq. m. other green areas.

6. Podium parking plan designed as per building bye laws is approved by Greater Noida

Authority. The copy of sanctioned plan has already been submitted.

7. The applicable fee for discharge into public sewer of authority has already been paid

to GNIDA.

8. Water meters shall be installed at Intake & discharge points for measurements & to

conserve water during execution stage of this work.

The committee discussed the matter and recommended grant of environmental

clearance on the project details as given at Para-A alongwith following specific and general

conditions subject to submission of approved layout and services plans from the Authority:

3. Structural safety certificate has been vetted by Jamia Millia Islamia, New Delhi.

The committee discussed the matter and recommended grant of environmental

clearance on the project details as given at Para-A alongwith following specific conditions:

1. 03 m peripheral green shall be provided around the project inside the project boundary. 2. 15% area of the total plot area shall be compulsorily made available for the green belt

development including the peripheral green belt. 3. Criteria/ norms provided by competent Authority regarding the seismic zone be

followed for construction work. Provision of alarm system, to timely notify the

residents, in case of occurrence of earthquake/other natural disasters/fire should be

provided. A well defined evacuation plan should also be prepared and regular mock

drills should be arranged for the residents. Rise of stairs should be constructed in a way,

so that it should provide smooth movement.

4. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

5. Discharge of storm water drain will be proponents responsibility and permission to be

taken from competent authority.

6. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water. 7. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the compliance of the E-waste and municipal solid waste disposal.

8. Environmental Corporate Responsibility (ECR) plan along with budgetary provision amounting to 2% of total project cost shall be prepared and approved by Board of

Directors of the company. A copy of resolution as above shall be submitted to the

authority. A list of beneficiaries with their mobile nos./address should be submitted

alongwith six monthly compliance reports.

9. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases.

10. Parking guideline as per Ghaziabad Development Authority should be followed.

Parking for disabled persons should be explored.

11. All entry/exit point should be bell mouth shaped.

12. 10% EWS / LIG housing provision shall be made as per Development Authority bye-

laws.

13. To discharge excess treated waste water into public drainage system, permission from

the competent authority to be taken prior to any discharge.

14. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

15. An underground Pucca tank for collection/reuse of rain water may be constructed.

16. Height of the stack should be provided based on combined DG sets capacity and be 6mt

higher than the tallest building.

17. Post project monitoring for air, water (surface+ ground), Stack noise of D.G. sets, STP

to be carried out as CPCB Guidelines.

18. Crèche to be provided during the construction/operation phase.

19. Provision of separate room for senior citizen with proper amenities shall be made.

20. Protection shall be provided on the windows of the high rise flats for security of

residents. 21. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent authority.

22. The project proponent shall ensure that the project site does not attract/infringe any buffer zone of no activity identified/declared under law.

23. For any extraction of ground water, prior permission from CGWB shall be taken. 24. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction. 25. Possibilities of use of treated waste water for irrigation purposes should be explored.

Drip irrigation should be tried upto extent possible. No fresh water will be used for

irrigation purpose.

26. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

The committee noted that the matter was earlier discussed in SEAC meeting dated

21/02/2015 wherein the project proponent was directed as follows:

"The committee discussed the matter and directed the project proponent to submit

following information:

1. Approved building plan.

2. NOC granted by UPPCB.

3. Status on air monitoring as per NAAQS standards dated 16/11/2009.

Monitoring data of H2S.

4. Proposal of raw material storage.

5. All services/ environmental facilities should be earmarked on plan layout.

6. OHT to be proposed in rear setback. Plan for same should be submitted.

7. Proposal of diffusers in aeration process.

8. Projection about emission level in operational phase of proposed project.

9. Route map of drain where discharge of tanneries effluent is proposed.

10. Costing of proposed Environmental Management Facilities in the industry.

11. Details of the pollution load at the intermediate and the ultimate discharge

points with flow diagram should be furnished. Scheme for the reduction in

TDS as per the norms of CPCB should be detailed separately with calculation

sheet.

The committee also directed to get a status report regarding construction at site

as required from Member Secretary, UPPCB vide letter dated 26/05/2014 of

SEAC."

The project proponent submitted their replies through letter dated 09/03/2015 through

which they have submitted building plan, consent for establishment (NOC) from UPPCB for

dry and wet process, UPSIDC layout plan of the area, Site plan of the project, Air Pollution

Equipment and design parameter, setback plan as per UPSIDC, Sketch of industrial drain

near industry. The Secretariat also informed that a letter dated 26/05/2014 was communicated

to Member Secretary, UPPCB regarding status of construction on the site which has not been

replied yet.

A presentation was made by Shri Mayank Nigam, authorized representative of project

proponent along with their consultant Shri Hari Om Dwivedi. The committee discussed the

matter and recommended grant of environmental clearance on the project details as given at

Para-A alongwith following specific and general conditions:

A. General Conditions:-

1. A suitable plan for providing shelter, light and fuel, water and waste disposal for

construction labour during the construction phase shall be provided along with the

numbers of proposed workers.

2. Measures shall be undertaken to recycle and reuse treated effluents for horticulture

and plantation.

3. Obtain necessary clearance from the competent authority on the abstraction and use of

ground water during the construction and operation phases. 4. Hazardous/inflammable/explosive material likely to be stored during the construction

and operation phases shall be handled as per standard procedure prescribed under law, necessary clearance in this regard shall be obtained.

5. Solid waste shall be suitably segregated and disposed. A separate and isolated Municipal Waste Collection Centre should be provided. Waste shall be disposed as

per Municipal Solid Waste Rules prescribed under EP Act, 1986. 6. Suitable Rain Water Harvesting Systems as per designs of Ground Water Department

shall be installed. 7. The emissions and effluents etc. from machines, Instruments and Transport during

construction and operation phases should be according to the prescribed standards.

8. Water sprinklers and other dust control measures should be undertaken to suppress

dust generation during the construction and operation phases.

9. Suitable noise abatement measures shall be adopted during the construction and

operation phases in order to ensure that the noise emissions do not violated the

prescribed Ambient Noise Standards.

10. Separate stock piles shall be maintained for excavated top soil and the top soil should

be utilized for development of green belt.

11. Sewage effluents shall be kept separate from rain water collection and storage system

and separately disposed. Other trade effluents should not be allowed to mix with

domestic effluents. Sewage transportation pipe lines should be at least 2 meter bellow the water supply lines.

12. Hazardous/Solid Wastes generated during construction and operation phases should

be disposed off as prescribed under law. Necessary clearances in this regard shall be

obtained.

13. Alternate technologies for solid waste disposals (Like- vermin-culture etc.) should be

used in consultation with expert organizations.

14. No wetland should be infringed during construction and operation phases. Any

wetland coming in the project area should be suitably rejuvenated and conserved.

15. Pavements shall be so constructed as to allow infiltration of surface run-off of rain water. Fully impermeable pavements shall not be constructed. Construction of

pavements around trees shall be as per scientifically accepted principles in order to provide suitable watering, aeration and nutrition to the tree.

16. Ensure usage of dual flush systems for flush cisterns and explore options to use sensor bases fixtures, waterless of urinals and other water saving techniques.

17. Explore options for use of dual pipe plumbing for use of water with different qualities such as municipal supply, recycled water, ground water etc.

18. Ensure use of measures for including water demand for landscaping and using xeriscaping, efficient irrigation equipments& controlled watering systems.

19. Make suitable provisions for using solar energy as alternative source of energy. Solar

energy application should be incorporated for illumination of common areas, lighting

for gardens and street lighting in addition to provision for solar water heating. Present

a detailed report showing how much percentage of backup power for institution can

be provided through solar energy so that use and polluting effects of DG sets can be

minimized.

20. Make separate provision for segregation, collection, transport and disposal of e-waste.

21. Educate citizens and other stake-holders by putting up hoardings at different places to

create environmental awareness.

22. Traffic congestion near the entry and exit points from the roads adjoining the

proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized.

23. Prepare and present Disaster Management Plan. 24. A report on the energy conservation measures confirming to energy conservation

norms finalize by Bureau of Energy efficiency should be prepared incorporating details about building materials and technology, R&U factors etc.

25. Fly ash should be used as building material in the construction as per the provision of fly ash notification of September, 1999 and amended as on August, 2003 (The above

conditions is applicable only if the project lies within 100 km of Thermal Power Station).

26. The DG sets to be used during construction phases should use low sulphur diesel type

and should conform to E.P. Rules prescribed for Air and Noise emission standards.

27. The green belt design along the periphery of the plot shall achieve attenuation factor

conforming to the day and night noise standards prescribed for residential land use.

The open spaces inside the plot should be suitably landscaped and covered with

vegetation of indigenous variety.

28. It is suggested that literacy program for weaker sections of society/women/adult

(Including domestic help) and under privileged children could be provided in a formal

way.

29. The use of Compact Fluorescent Lamps should be encouraged. A management plan

for the safe disposal of used/damaged CFLs should be submitted.

30. It shall be ensured that all street lighting is solar powered. Additionally 50% of the

same may be provided with dual (Solar/electrical) alternatives.

31. Solar water heater shall be installed to the maximum possible capacity. Plans may be

drawn up accordingly with justification.

32. Construction activities including movements of vehicles should be so managed as to

cause no disturbance to nearby residents. Parking should be design on the basis of

projected growth in next 20 years.

33. All necessary statutory clearances should be obtained and submitted before start of any construction activity. If this condition is violated the clearance shall be

automatically deemed to have been cancelled. 34. Parking areas should be in accordance with the norms of MoEF, Govt. of India. Plans

may be drawn up accordingly and submitted.

B. Specific Conditions:

1. The conditions stipulated in the NOC issued by the UP Pollution Control Board

should be complied.

2. The tannery operations should be such that the environmental stipulations as

prescribed under Charter on "Corporate Responsibility for Environmental Protection

(CREP)" are complied with.

3. 33% area of industrial unit should be covered under Green belt.

4. Tannery unit should install effluent treatment and chrome recovery facilities as

proposed upto tertiary level. The flow of treated effluent should not stagnate in

disposal channel till the end point.

5. It should adopt cleaner technologies as recommended by CLRI to ensure minimum

chrome discharge in effluent. 6. Over head tank for fire fighting shall be provided.

7. Record should be maintained in the unit for the quantity of raw process water used and pre treated waste water discharge.

8. The tannery should adopt state of the art technology recommended by CLRI. The technology should include recovery and reuse of Chrome/Alutan BCS/closed-loop

Alutan-BCS combined tanning process to ensure maximum chromium recovery and minimum chromium-discharge in the effluent.

9. To reduce TDS concentration in the primary treated effluent, cleaner technologies e.g.

dry salting for reduction of TDS in waste water, counter current soaking to reduce waste water quantity, enzyme assisted liming process, combined pickling- tanning

process, pre-treatment and segregation of waste should be practiced and soak liquor should be segregated and evaporated in the solar evaporation ponds.

10. Unit should ensure that ambient air quality monitoring stations should be set-up in the down wind direction as well as at locations were maximum ground level

concentration is anticipated. These locations should be fixed in consultation with the U P. Pollution Control Board.

11. The unit should not exceed the norm of 28 cu. meter/tonne of raw hide as stipulated in

schedule 1 of the Environment Protection Act, 1991 for the total quantity of waste

generated.

12. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to 2% of total project cost shall be prepared and approved by Board of

Directors of the company. A copy of resolution as above shall be submitted to the

13. The unit should install separate flow meter and water meter for entire effluent

generated after pre-treatment. The waste water after primary treatment should be

discharged into CETP through a closed non corrosive pipe line.

14. Guard ponds of sufficient holding capacity should be provided to cope with the

effluent discharge during process disturbances.

15. A secured double line land fill should be developed for temporary storage of hazardous solid waste by providing impervious liner and leach ate collection system.

16. The fleshing from the Tannery unit should be supplied to the manufacturers of dog chew and glue.

17. The ground water quality around the guard ponds, solar evaporation ponds and land fill site should be monitored on a regular basis.

18. Annual Environmental auditing should be carried out by the unit. 19. Occupational health surveillance of the workers should be done on a regular basis and

records maintained. 20. The unit should comply with environmental protection measures and safeguards

recommended in the ElA/EMP.

21. Proper Protective Equipments and Barrier Cream should be given to workers.

guidelines for conducting EIA studies regarding the proposals:

be described including solar water heating in the guidelines for entrepreneurs.

34. Consider solid wastes, including e-waste in addition to other solid wastes and their

36. Explore possibility of generating biogas from biodegradable wastes.

37. Arrangements for hazardous waste management may be described as also the

common facilities for waste collection, treatment, recycling and disposal of all

Special attention should be made with respect to bird menace.

38. Provisions made for safety in storage of materials, products and wastes may be

described.

39. Disaster management plan should be prepared.

40. Traffic management plan including parking and loading/unloading areas may be

described. Traffic survey should be carried out both on weekdays and weekend.

41. Parking provision is to be made for higher ECS worked out either as per state bye-

laws or construction manual of the MoEF

42. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned

minimum 2% of the project cost as discussed in meeting shall be submitted on need

base assessment study in the study area.

53. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance

from National Board Wild Life (NBWL) even if the eco- sensitive zone is not

earmarked.

54. Declare/submit the running cost of STP and other environmental management

services (e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water

Management etc.) in the proposals which are to be including in the allotment letters.

55. The proponent will submit the schedule of monitoring/data collection programme to

the Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for

any such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil

construction has been undertaken at site except fencing of the site to protect it from

getting encroached and construction of temporary shed(s) for the guard(s). (if fencing

has not been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to

be false or misleading at any stage, the project will be rejected and clearance given,

if any to the Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented

are factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted

along with EIA.

c. Current, site photographs viewing towards the project area from four directions

indicating date of photograph taken, direction from which taken, name of the project,

and signature of Project proponent along with consultant with seal should be submitted,

so as to ensure that no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA

notification of 2006 and the Methods of Monitoring and analysis (Annexure-IV):

Guidance for assessment of representativeness and reliability of baseline environmental

attributes detailed under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which

this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm

along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated

with/involved in the preparation of these reports and the Name of laboratory through

which the samples have been got analysed should be stated in the report. It shall clearly

be indicated whether said laboratory is accredited by NABL or approved under the

Environment (Protection) Act, 1986 (Please refer MoEF office memorandum dated 4th

August, 2009). The name project leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the

information’s is to be submitted along with the EIA.

11- Plotting and Infrastructure Development of Sandila Industrial Area. Ex. Engineer

The committee noted that an application dated 18/11/2014 was made by the project

proponent M/s UPSIDC for Environmental Clearance of Plotting and Infrastructure

Development of Sandila Industrial Area Village Jamsara, Som, Reso, Usrha & Samodha;

Pargana & Tehsil Sandila, District Hardoi, M/s UPSIDC.

A presentation was made by Shri Akhtar Husain, Assistant Engineer, authorized

representative of project proponent along with their consultant M/s Sawen Consultancy

Services Pvt. Ltd. The proponent, through the documents submitted and the presentation

made, informed the committee that:-

5. The sewer line would be laid on PCC (150 mm thick) over compacted earth. The

horizontal distance between sewerage and water supply line shall not be less than 3.0

m. The sewerage through sewer line shall ultimately be discharges into a lofting

station, fitted with bar screen.

6. 33/11 KV sub-station is already in existence with 5 MVA transformer and 11 KV

distribution lines in the Sandila Industrial area. It is expected that power demand will

increase to 20 MVA once all the industrial units are established and start functioning

at Sandila.

7. Expected source of water supply is 06 nos. of bore well at depth of 200 ft. for 24

running hours on an average. With capacity of 135 cum/ hr each.

26. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

27. Landscape plan, green belts and open spaces may be described separately.

28. Study the existing flora and fauna of the area and the impact of the project on them.

29. Examine existing crèche, education, health facilities, police, post Office, Banks and

other services and make adequate provisions in the proposal.

30. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

31. Application of renewable energy/alternate energy, such as solar and wind energy may

be described including solar water heating in the guidelines for entrepreneurs.

32. Consider solid wastes, including e-waste in addition to other solid wastes and their

disposal.

33. Identification of recyclable wastes and waste utilization arrangements may be made.

34. Explore possibility of generating biogas from biodegradable wastes.

35. Arrangements for hazardous waste management may be described as also the

common facilities for waste collection, treatment, recycling and disposal of all

effluent, emission and refuse including MSW, biomedical and hazardous wastes.

Special attention should be made with respect to bird menace.

36. Provisions made for safety in storage of materials, products and wastes may be

described.

37. Disaster management plan should be prepared.

38. Traffic management plan including parking and loading/unloading areas may be

described. Traffic survey should be carried out both on weekdays and weekend.

39. Parking provision is to be made for higher ECS worked out either as per state bye-

laws or construction manual of the MoEF

40. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned

41. Provide service road for entry and exit to project site.

42. Use of local building materials should be described.

43. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack

details with provisos of sampling port for monitoring be described.

44. Work out MGLC for the combined capacity of DG sets.

45. Provide for conservation of resources, energy efficiency and use of renewable sources

of energy in the light of ECBC code.

46. Application of resettlement and rehabilitation policy may be described. Project

affected persons should be identified and rehabilitation and resettlement plan should

be prepared.

50. Source and quantity of required water during construction and management of

generated waste water.

51. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance

from National Board Wild Life (NBWL) even if the eco- sensitive zone is not

earmarked.

52. Declare/submit the running cost of STP and other environmental management

services (e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water

Management etc.) in the proposals which are to be including in the allotment letters.

53. The proponent will submit the schedule of monitoring/data collection programme to

the Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for

any such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil

construction has been undertaken at site except fencing of the site to protect it from

getting encroached and construction of temporary shed(s) for the guard(s). (if fencing

has not been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to

be false or misleading at any stage, the project will be rejected and clearance given,

if any to the Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented

are factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted

along with EIA.

c. Current, site photographs viewing towards the project area from four directions

indicating date of photograph taken, direction from which taken, name of the project,

so as to ensure that no construction has been started before the grant of EC.

28. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

29. Application of renewable energy/alternate energy, such as solar and wind energy may

be described including solar water heating in the guidelines for entrepreneurs.

30. Consider solid wastes, including e-waste in addition to other solid wastes and their

disposal.

31. Identification of recyclable wastes and waste utilization arrangements may be made.

32. Explore possibility of generating biogas from biodegradable wastes.

35. Disaster management plan should be prepared.

36. Traffic management plan including parking and loading/unloading areas may be

base assessment study in the study area.

48. Source and quantity of required water during construction and management of

generated waste water.

49. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance

from National Board Wild Life (NBWL) even if the eco- sensitive zone is not

earmarked.

50. Declare/submit the running cost of STP and other environmental management

services (e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water

Management etc.) in the proposals which are to be including in the allotment letters.

51. The proponent will submit the schedule of monitoring/data collection programme to

the Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly attested by

Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil construction has

been undertaken at site except fencing of the site to protect it from getting encroached and

construction of temporary shed(s) for the guard(s). (if fencing has not been done, then the

same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and I/We

am/are aware that if any part of the data and information submitted is found to be false or

misleading at any stage, the project will be rejected and clearance given, if any to the Project

will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified under

any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along with

EIA.

c. Current, site photographs viewing towards the project area from four directions indicating date

of photograph taken, direction from which taken, name of the project, and signature of Project

proponent along with consultant with seal should be submitted, so as to ensure that no

construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification of

2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for assessment of

representativeness and reliability of baseline environmental attributes detailed under EIA

manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this EIA

is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along with

their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in the

preparation of these reports and the Name of laboratory through which the samples have been

got analysed should be stated in the report. It shall clearly be indicated whether said laboratory

is accredited by NABL or approved under the Environment (Protection) Act, 1986 (Please refer

MoEF office memorandum dated 4th August, 2009). The name project leader of the EIA study

shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be submitted

within 15 days from the date of receipt of the letter and remaining of the information’s is to be

submitted along with the EIA.

The committee noted that an application dated 10/03/2014 was made by the project

proponent for environmental clearance of Group Housing Project “Sangwan Heights” at

Khasra No. 1085, 1089 & 1091, Noor Nagar, Rajnagar Extension, Distt. Ghaziabad, Uttar

Pradesh, M/s Sangwan Heights Pvt. Ltd. Terms of reference were issued through SEAC letter dated 09/10/2014. Final EIA was submitted by the project proponent on 30/03/2015. The

project proponent through their letter dated 21/05/2015 again submitted a revised EIA stating that the project has under gone some changes in the planning and there is slight amendment

amended).

The committee discussed the matter and recommended grant of environmental

clearance on the project proposals alongwith general conditions as prescribed by authority for

construction projects and following specific conditions:

1. This environmental clearance is not applicable for any compounded FAR.

2. 03 m peripheral green shall be provided around the project inside the project boundary.

3. 15% area of the total plot area shall be compulsorily made available for the green belt

development including the peripheral green belt.

4. Criteria/ norms provided by competent Authority regarding the seismic zone be

followed for construction work. Provision of alarm system, to timely notify the

residents, in case of occurrence of earthquake/other natural disasters/fire should be

provided. A well defined evacuation plan should also be prepared and regular mock drills should be arranged for the residents. Rise of stairs should be constructed in a way,

so that it should provide smooth movement. 5. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization. 6. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water. 7. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal.

8. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to Rs. 2.5 Crore shall be prepared and approved by Board of Directors of the

company. A copy of resolution as above shall be submitted to the authority. A list of

beneficiaries with their mobile nos./address should be submitted alongwith six monthly

compliance reports.

9. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases. 10. Parking guideline as per Ghaziabad Development Authority should be followed.

Parking for disabled persons should be explored. 11. All entry/exit point should be bell mouth shaped.

12. To discharge excess treated waste water into public drainage system, permission from the competent authority to be taken prior to any discharge.

13. RWH shall be initially done only from the roof top. RWH from green and other open areas shall be done only after permission from CGWB.

14. An underground Pucca tank for collection/reuse of rain water may be constructed. 15. Height of the stack should be provided based on combined DG sets capacity and be 6mt

higher than the tallest building.

16. Post project monitoring for air, water (surface+ ground), Stack noise of D.G. sets, STP

to be carried out as CPCB Guidelines.

17. Crèche to be provided during the construction/operation phase.

18. Provision of separate room for senior citizen with proper amenities shall be made.

19. Protection shall be provided on the windows of the high rise flats for security of

residents.

20. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent

authority.

21. The project proponent shall ensure that the project site does not attract/infringe any

buffer zone of no activity identified/declared under law.

22. For any extraction of ground water, prior permission from CGWB shall be taken.

23. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

24. Possibilities of use of treated waste water for irrigation purposes should be explored.

Drip irrigation should be tried upto extent possible. No fresh water will be used for

irrigation purpose. 25. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including the proper treatment and the disposal of the wastes.

6. What are the permissible uses of the site as per Agra Master Plan.

7. Plan for use of Solar Energy. Maximum solar energy uses should be explored.

8. Area details showing proposed uses as residential, commercial, parks, parking, roads,

other services, facilities of the project also in percentage.

9. Phase wise project details and proposed activities.

10. What is the total cost of the project and its detail of different phases. Specially Ist

phase details of project to be implemented with cost and recovery system.

11. What will be the Socio Economic impact on Agra town.

12. What is the distance from Taj Mahal of the proposed site. Whether the view of Taj will be affected. A complete report with necessary supporting documents should be

submitted. 13. Permission to be obtained from Central Ground Water Board for drilling of tube well

and for making of water works. 14. Minimum 2% provision is to be made under CSR. The detail with of CSR to be

provided with total cost and scheme to be executed in various phases during the implementation of project. The list of beneficiaries along with project photographs is

to be submitted.

The committee also observed that the project proponent/EIA CONSULTANT has not fully

complied the TOR POINTS like approval of the lay-out plan, conversion of land use from agricultural to non agricultural, approvals of entire built up areas, obtaining NOC from

NRCD, Irrigation Deptt.cental water commission, Archealogical Survey of India etc. The proposed land area is also not fully transfered and some part of it is under Stay of Hon' High

court, Allahabad. The proponent has also not provided the details of the proposed built up area block wise or building wise. The project proponent has not submitted the DPR actually

prepared by the project proponents. The EIA report is not well documents and lacks in the

following:

• The Impact Analysis on the River Yamuna, The study of highest flood level/point and

the calculation of the safity distances, Impact on the seasional floods of

Yamuna,alternative sources of water like putting water works instead of ground water

utilisation, Thinking of conducting a bandha along the river.

• There are approx. 400 big trees, many old water wells and the hand pumps etc in the proposed land but nothing has been discussed in this regard. The same should be

covered under EIA.

• Disposal of domestic waste, domestic solid wastes are tentatively discussed and their

final disposal is also not environmentally safe. A comprehensive plan in this regard

should be prepared and submitted.

The matter shall be discussed after submission of information as above. .

17- Group Housing Project "Shushant Aquapolis" Doondaherra, Ghaziabad. File No.

2580/AD-H

The committee noted that:

A. In compliance to Hon'ble NGT order dated 05/09/2014 in the application M.A. no.

455/2013the following request from the project proponent were discussed in SEAC

meeting dated 15/11/2014 -

a) To reinstate the Environmental Clearance granted vide letter no. 692/ SEAC/

148/2011/TA(J) dated 30.03.2012 in light of NGT order M.A. No.455 of 2013

vide dated 05.09.2014

b) Since the controversial solid waste dumping yard area can now become

available to the developer hence, TOR for additional 14 acres land may be

issued.

B. The SEAC in its meeting dated 15/11/2014 directed as follows:

"------- request regarding reinstating of environmental clearance dated 30/03/2012 can

be decided only after the reasons for cancelation of the E.C. letter dated 30/03/2012

be complied/fulfilled.

Also, the status/land use of the site of proposed project “SushantAquapolisDoondaherra, Ghaziabad" may be conformed from Ghaziabad

and 15/11/2014 should be conformed from Ghaziabad Development Authority, Nagar Nigam, Ghaziabad and UP Jal Nigam as on date. A copy of above communications

should also be made to M/s Ansal Properties and Infrastructure Ltd.

The committee also directed the project proponent to submit copy of writ

petitions and related orders/judgments made by Hon'ble Courts in the related matter,

in any. "

C. In this reference communication was made by Member Secretary, SEIAA to

Ghaziabad Development Authority, Ghaziabad, Municipal Corporation Ghaziabad,

Construction and Design Services and Member Secretary, UPPCB for providing their

comments with respect to directions of SEAC made in meeting dated 15/11/2014.

D. Secretary, Ghaziabad Development Authority, Ghaziabad (through his letter dated

16/12/2014), project manager C&DS, UP Jal Nigam (through his letter dated

06/12/2014) and Municipal Commissioner, Ghaziabad Nagar Nigam (through his

letter dated 21/01/2015) communicated their replies to SEIAA. In all these

communications, these agencies have denied the following claim /version of M/s

Ansal Properties and Infrastructures Ltd. regarding 14 acres land in Village-

Doondahera, Ghaziabad that:

"…….The Ghaziabad Development Authority has allocated alternate plot for the

Solid Waste Scheme in Galland and Pipalhera Villages."

E. The SEAC noted that land use of the said 14 acre land is "Dumping Yard" as notified by Housing and Urban Planning Department, Govt. of U.P. order no. 4582/8-3-2009-

502 writ/2006 dated 21/10/2009. The additional land for Dumping Yard in Village-Galland and Pipalhera which has been made available by GDA to Nagar Nigam

Ghaziabad is not an alternate for 14 acres Dumping Yard land at Village-Doondahera. The committee directed the project proponent that correctness of statements should be

duly verified by the project proponent before making any submissions/claims at SEIAA.

F. The committee deliberated that in view of information received from Ghaziabad Development Authority, Nagar Nigam, Ghaziabad and C&DS, UP Jal Nigam,

Ghaziabad the request made by M/s Ansal Properties and Infrastructures Ltd. can not

be entertained by the committee as land use of said 14 acre land in Village-

Doondahera is "Dumping Yard" and Ghaziabad Development Authority has not

allocated any alternate land which would make this 14 acre land in Village-

Doondahera available to M/s Ansal Properties and Infrastructures Ltd. Hence, the

submissions/claim made by M/s Ansal Properties and Infrastructures Ltd. in their

petition to SEIAA are not correct and here by rejected.

G. The committee also noted that there is a Court Case pending at Hon'ble Supreme

Court related to said 14 acre land at Village-Doondahera Ghaziabad as also informed

by project proponent. Hence, no decision can be taken by SEAC in a subjudice matter

at Hon'ble Supreme Court. H. Further, the committee also observed that the project details as submitted in form-1

along with the letter dated 30/09/2014 of M/s Ansal Properties and Infrastructures Ltd. are not same as proposals on which environmental clearance dated 30/03/2012

was earlier granted by SEIAA, which was later cancelled by SEIAA on dated 01/04/2013. A comparative statement may be seen as follows:

Hence, the request of project proponent to reinstate the environmental

clearance dated 30/03/2012 cannot be accepted prima-facie as consideration of

reinstatement request cannot be made on a proposal which is different from the one,

which was cancelled by the SEIAA through letter dated 01/04/2013.

I. The committee also noted that the E.C. dated 30/03/2012 was cancelled by SEIAA

hence,the above observations/situation may be forwarded to SEIAA for taking

decision. The SEIAA may also ask Members Secretary, UPPCB to submit their reply

with reference to letter dated 1974/parya/SEAC/2582/2014 dated 26/11/2014 in the matter.

J. The UP Pollution Control Board through its letter no F55948 dated18/2/2015 has informed that the firm has re-applied for NOC on 15/01/2015 in UPPCB which is

being processed. Till date firm has not being issued any NOC by UPPCB for this project at this site.

K. The matter was discussed in SEIAA meeting dated 17/03/2015 wherein following decision was taken:

L. In light of the SEIAA decision dated 17/03/2015 the committee considered and

discussed the matter in its meeting dated29/04/2015.

ShriVinod Tikku, project proponent appeared in the meeting and presented the

matter.The committee noted that the project proponent has submitted a letter dated

13/02/2015, received in the office on 16/02/1015 along with the copies of form 1 and

form 1A enclosed with the copy of the E C issued earlier vide office letter No.

692/SEAC/148/20111/TA(J) dated 30/03/2012. Committee has gone through this letter and the E C letter previously issued. It is found that the project proponent now

has made a request to re-instate the same EC issued earlier on dt. 30/03/2012 without any alterations/modifications proposed. On being enquired by the committee it was

informed by the project proponent that until now they have completed about 11.5% construction work as per the E C issued earlier and as on today no litigation is

pending against any piece of land within the proposed project boundary, besides E C issued by the authority has never been challenged in any court of law nor there is any

investigation is pending against the proposed project in the concerned departments. After the discussion the project proponent is directed to submit an affidavit regarding

the above versions as made by the project proponent along with the following

acceptances. The project proponent had been regularly submitting the six monthly

progress report as directed in the EC earlier issued before being revoked. The project

proponent is also directed to submit the copy of the six monthly reports submitted last

time along with the present status of the construction. The committee also

directed the proponent to submit their replies on following issues along with related

documents:

I. Whether the present proposal is for revocation of environmental clearance dated

30/03/2012 or is a fresh proposal for environmental clearance.

II. If there are any changes in the present proposal from the proposals on which

environmental clearance dated 30/03/2012 was granted, enlist them clearly with relevant paras of the application.

III. If there is any litigation pending related to the project, submit their details with issues involved and present status.

IV. It there are any final orders given by Hon'ble Courts related to the project, submit the copies of the same with a combined summery.

V. Submit copies of project plans/maps/drawings as approved by the Ghaziabad Development Authority. Also submit an affidavit regarding validity of these

approvals as on date. In above reference the project proponent has submitted a reply dated 22/05/2015. The

committee considered and discussed the reply in its meeting dated 25/05/2015 ShriVinod

Tikku, project proponent appeared in the meeting and presented the matter. The proponent,

through the documents submitted and the presentation made, informed the committee that:

1. No such case is filed in any of the Courts as on date and an affidavit to that affect has

been filed on 29/04/2015.

2. No PIL against this project is pending in any Court as on date.

3. No investigation regarding Environmental Clearance granted to this project is going on as

on date.

4. There is no change in the project parameters vis-a-vis the parameters based on which the

above Environment Clearance was granted. An affidavit to this affect is already been filed

on 29/04/2015.

5. The compliance reports are being filed regularly and a copy of last three compliance

reports dated 30/11/2013, 01/07/2014 and 31/01/2015 duly received in the office of

Ministry of Environment and Forest have been annexed along with the above referred

affidavit to the letter bearing reference no. APIL / PROJ / GZB / 15 / 290 dated

29/04/2015. 6. The project proponent undertakes to abide by the decision of the Hon'ble Apex Court as

far as the pending petition regarding Dumping Yard is concerned. 7. The project had been earlier granted Environmental Clearance vide letter no.

692/SEAC/148/2011/TA(J) dated 30.03.2012 for 138.56 Acres excluding Solid Waste Management (SWM) Site.

8. After getting EC, the existing construction of 1,46,853 sq.m. of built-up area has been done.

9. This EC was cancelled by SEIAA, Uttar Pradesh vide letter no. 05/SEAC/148/2011/TA(J) dated 01.04.2013.

10. The cancellation was challenged in NGT.

11. NGT directed for representation for restoration of the EC as per order their order no.

M.A. No.455 of 2013 vide dated 05.09.2014.

12. Application for Restoration of EC (138.56 Acres) was submitted on 30.09.2014 along

with request for grant of TOR for additional 14 acres SWM site to be appended to the

township.

13. A representation was held before SEAC on 15.11.2014.

14. Since, 14 acres is still sub-judice, the request for restoration of EC of 138.56 acres

township, the TOR application dated 30.09.2014 was withdrawn vide our letter dated

21.01.2015.

15. This presentation is based on the same project parameters on which EC dated 30.03.2012 was granted.

18. The estimated total wastewater generation from the project = 2.83 MLD.

19. Domestic sewage will be treated through a Sewage Treatment Plant (S.T.P.) of capacity

3.97 MLD within the project.

20. STP based on FAB technology has been proposed.

21. Rain Water Harvesting structures for recharge of roof top runoff from buildings and

houses and Pipe network with manholes to collect rooftop runoff and convey the same up

to the RWH structure will be provided. The proposed Rainwater Harvesting Scheme has

been designed to harvest 70% of the total average annual rain fall considering 30% losses due to Evaporation, spillage and first flush Water body/ ponds will be introduced in the

area for recharging ground water. 22. 7 nos. of Recharge pits have been proposed in the township including 3 no. of Recharge

pits have been proposed in the group housing. 23. All construction work generated solid wastes shall be collected and stored at designated

places and will be reused in infrastructural construction activities. 24. Total digging for township will be 210407.5 cum vs 204185.8 cum of filling. The balance

shall be used for road making & fill material in low lying areas. Excavated soil will be stored in temporary constructed soil bank and will be reused for landscaping of the

proposed township.

25. The temporary dumping areas will be maintained at all times until the excavated material

is reutilized.

26. The solid waste from the proposed residential project will be around 19.81 tonnes/ day.

Waste segregation at household level will be compulsory. Solid waste from House to

House will be collected in separate bins meant for organic (decomposable) & inorganic

waste. Inorganic recyclable will be sold to recycling vendors. The organic waste will be

treated at the vermi-composting site next to the STP. Balance shall be sent to municipal

landfill site

27. The solid waste collection, transportation and its dumping in landfill shall be done by

Municipal Corporation. The dumping of solid waste of the Township shall be done in the site earmarked in the Galand village.

28. Adequate capacity Roads will be provided to avoid congestion. The Road circulation pattern has been designed by taking entries from existing NH-24 through service road and

underpass arrangement. Existing 12 m wide road connecting NH-24 with Greater Noida Expressway and being widened to 45 m ROW by Greater Noida Authority

29. Total Parking as 5150 ECS is provided(Surface parking 2575,Underground parking 2575).

30. Total proposed green area is 25.428 Acres. This is approx. 16.63% of the total project area. Trees will be planted on the two sides of roads. Endemic species, observed to

prosper in the area, will be grown.

31. The project proposals are covered under category 8"a" of EIA Notification, 2006.

The committee discussed the matter and recommended grant of environmental

clearance on the project proposals along with general conditions as prescribed by the

authority earlier and following specific conditions:

1. All proposals should be in accordance to Ghaziabad Master Plan and permissions from Ghaziabad Development Authority shall be taken in this regards.

2. Green area (minimum 12 m) should be left all around the periphery in the project for tree plantation as committed by the project proponent. Total green area should not be

less than 20% of the total project area.

3. Organic waste convertor will be installed on site to treat bio-degradable/organic waste

generated within the site.

4. NOC from Fire fighting and Air port Authority shall be obtain prior to start of

construction.

5. Approved agencies shall be indentified for Solid Waste Disposal.

6. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

7. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water.

8. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to be used in-house as manure and surplus manure should be managed by giving it to end

users. 9. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to 2% of project cost shall be prepared and approved by Board of Directors of the company. A copy of resolution as above shall be submitted to the authority. A list

of beneficiaries with their mobile nos./address should be submitted alongwith six monthly compliance reports.

10. Criteria/ norms provided by competent Authority regarding the seismic zone be

followed for construction work. Provision of alarm system, to timely notify the

residents, in case of occurrence of earthquake/other natural disasters/fire should be

provided. A well defined evacuation plan should also be prepared and regular mock

drills should be arranged for the residents. Rise of stairs should be constructed in a way,

so that it should provide smooth movement.

11. LEDs should be used in all common areas and corridors. 100% Solar lighting is to be

provided in the open areas/stairs cases.

12. Parking guideline as per GDA should be followed. Parking for disabled persons should

be explored.

13. All entry/exit point should be bell mouth shaped.

14. To discharge excess treated waste water into public drainage system, permission from

the competent authority to be taken prior to any discharge. 15. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after permission from CGWB.

16. Height of the stack should be provided based on combined DG sets capacity and be 6mt higher than the tallest building.

17. Post project monitoring for air, water (surface+ ground), Stack noise of D.G. sets, STP to be carried out as CPCB Guidelines.

18. Crèche to be provided during the construction/operation phase.

19. Provision of separate room for senior citizen with proper amenities shall be made.

20. Protection shall be provided on the windows of the high rise flats for security of

residents.

21. Criteria/ norms provided by competent Authority regarding the seismic zone be

followed for construction work. Provision of alarm system, to timely notify the

residents, in case of occurrence of earthquake should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for the residents.

22. Unless and until all the environmental issues are sorted out the occupancy will be restricted and would be only allowed after achieving the Permission from the competent

authority. 23. The project proponent shall ensure that the project site does not attract/infringe any

buffer zone of no activity identified/declared under law. 24. Ground water should not be extracted for the purpose of construction or otherwise. In

case of default the Environmental Clearance will deem to be cancelled. 25. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

26. Possibilities of use of treated waste water for irrigation purposes should be explored.

Drip irrigation should be tried upto extent possible. No fresh water will be used for

irrigation purpose.

27. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

28. Any decisions/orders made by the Hon'ble Supreme Court/ Hon'ble N G T and the

Hon'ble High Court etc. with regard to the proposed project proposal shall be binding

on the project proponent.

29. No fresh water will be used for irrigation purpose. 30. Rain water runoff from the open area of the project shall not be discharged outside but

suitably collected in a pond and utilised for useful purposes.

The Secretariat informed the committee that:

1. Environmental clearance to the proposal "IC Engine Based Power Production

Manufacturing Unit, M/s Honda Siel Power Products at Plot no. 5, Sector-41, Kasna,

Greater Noida, Industrial Development Area, Gautam Budh Nagar" was issued through

letter no. 1960/Parya dated 24/11/2014.

2. Fresh water requirement was given as 504 KLD in the proposal whereas it is mentioned

as 254 KLD in environmental clearance dated 24/11/2014.

3. Also, in project proponent letter dated 19/09/2014 aluminium of Die casting will be

about 3500 TPA however, in EC dated 24/11/2014 it is mentioned as 06 MT/day.

The project proponent has requested to issue amended environmental clearance

with these amendments. The committee discussed the matter and directed the

Secretariat to prepare a note based on records in view of submissions made by project

proponent in his letter as above and present to committee in next meeting.

The committee examined the proposal submitted by the project proponent and

the presentation made in SEAC meeting dated 14/09/2014 and observed that:

1. At slide no. 15 of presentation dated 14/09/2014, the project proponent informed

that total water requirement shall be 817 KLD whereas net fresh water

requirement would be 254 KLD. The same was mentioned in the minutes of

210th SEAC meeting dated 14/09/2014.

2. Also, at slide no. 14 in the list of basic raw material and its daily consumption,

06 MT aluminium ingot is mentioned to be used for die casting. The same was mentioned in the minutes of 210

th SEAC meeting dated 14/09/2014.

In view of above, the committee deliberated that the proponent should be

directed to present their case in light of their presentation made before SEAC on dated

14/09/2014 and their letter received on 18/02/2015 regarding reissuance of

environmental clearance.

11. The project proposals are covered under category 8"a" of EIA notification, 2006, as

amended.

The committee discussed the matter and recommended grant of environmental

clearance on the project proposals alongwith general conditions as prescribed by authority for

construction projects and following specific conditions:

1. Land use of the proposed project should be as per Master Plan of Noida Development

Authority.

2. Structural design should be approved by qualified structure engineer prior to any

construction.

3. Provision shall be made for the housing of construction labour within the site with all

necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile

STP, safe drinking water, medical health care, crèche etc. The housing may be in the

form of temporary structures to be removed after the completion of the project.

4. Provision of drinking water, wastewater disposal, solid wastes management and

primary health facilities shall be ensured for labour camps. Proper sanitation facilities

shall be provided at the construction site to prevent health related problem. Domestic

as well as sanitary wastes from construction camps shall be cleared regularly.

5. Water usage during construction shall be optimised to avoid any wastage.

6. Ground water shall not be used for construction works during construction phase. 7. Adequate safety measures shall be adapted for the construction workers.

8. In case, existing structures, if any, within project site, are proposed to be demolished, Re-use of debris at existing site as far as practicable is recommended with a special

care for handling and disposal of asbestos waste, if any. Rest of waste is to be disposed at the sanitary landfill disposal site.

9. The asbestos waste, from demolition debris, if any, shall separated and shall be disposed at proposed Common Hazardous Wastes, Treatment and Disposal Facility.

10. For the treatment for total sewage, a full-fledged STP is to be provided with 20%

more capacity than waste water generated during operation phase.100% waste water

is to be treated in captive STP conforming to prescribed standards of receiving body

for designated use. Monitoring of STP to be done daily till its stabilization.

11. Appropriate measure like adequate drainage, embankment consolidation and slope

stabilization shall be taken along the city road to avoid soil erosion. Top soils of the

borrow pit sites shall be conserved and restored after completion of excavation. All

the topsoil excavated during construction activities shall be stored for use in

horticulture/landscape development within the project site. Proper erosion control and

sediment control measures shall be adopted.

12. Earth material generated from excavation shall be reused to the maximum possible

extent as filling material during site development. The construction debris and surplus

excavated material shall be disposed off by mechanical transport in suitable pre-identified dumping areas to avoid land degradation and water logging due to

indiscriminate dumping. Dumping areas shall be biologically reclaimed through topsoil cover and plantation.

13. A soil erosion and sedimentation control plan shall be prepared prior to construction. The soil erosion, sediment control and storm water practices shall be incorporated

depending upon the site characteristics to control soil erosion and loss of top soil during construction.

14. Disposal of muck including excavated material during construction phase should not

create any adverse effects on the neighbouring communities and disposed off taking

the necessary precautions for general safety and health aspects.

15. Low sulphur diesel type diesel generator sets should be used during construction

phase. Diesel generator sets during construction phase shall have acoustic enclosures

and shall conform to Environment (Protection) Rules, 1986 prescribed for air and

noise emission standards.

16. All Vehicles/equipments deployed during construction phase shall be ensure in good working condition and shall conform to applicable air and noise emission standards.

17. Ambient noise levels shall conform to residential standards both during day and night. Fortnightly monitoring of ambient air quality (RPM, SPM, SO2 and NOx).

Equivalent noise levels shall be ensured during construction phase and closely monitored during construction phase.

18. The protective equipments such as earplugs etc. shall be provided to construction personnel exposed to high noise levels. Stationary construction equipments generating

noise shall be placed at-least 125 m away from inhabited areas and at-least 200 m away from the silence zones. Construction activities carried out near residential area

shall be scheduled to day time only. Only limited necessary construction shall be done

during nighttime. No unloading of construction materials shall be done at night.

Vehicular noise and use of horns shall be controlled through enforcement of laws and

public awareness. Use of pressure horns shall be strictly prohibited. Appropriate noise

barriers at silence zones shall be provided. To reduce noise level, the arterial roads

shall be designed to have 2 to 3 rows of plantation.

19. Construction spoils, including bituminous material and other hazardous materials

including oil from construction equipments must not be allowed to contaminate

watercourses and the dumpsites for such material must be secured so that they shall

not leach into the ground water. If necessary, oil trap shall be installed where heavy

machineries are deployed. 20. Proper and prior planning, sequencing and scheduling of all major construction

activities shall be done. Construction material shall be stored in covered godowns/sheds. Truck carrying soil, sand and other construction materials shall be

duly covered to prevent spilling and dust emission. Adequate dust suppression measures shall be undertaken to control fugitive dust emission. Regular water

sprinkling for dust suppression shall be ensured. 21. Use of Ready-Mix concrete is recommended for this project.

22. Accumulation/stagnation of water shall avoid ensuring vector control. 23. Use of energy efficient construction materials shall be ensured to achieve the desired

thermal comfort.

24. Use of fly ash based bricks/blocks/tiles/products shall be explored to the maximum

extent possible. The provisions of Ministry of Environment and Forests, Government

of India Notification No. 763(E) dated 14/09/1999 (as amended) regarding use of Fly

Ash must be complied with. The use of perforated brick / hollow blocks / fly ash

based lightweight aerated concrete etc. should also be explored so as to reduce load

on natural resources.

25. Construction shall conform to the requirements of local seismic regulations. The

project proponent shall obtain permission for the plans and designs including

structural design, standard and specifications of all construction works from

concerned authority.

26. The use of glazed surface shall be as per National Building Code 2005.

27. Street lighting shall be energy efficient with provision of solar lighting up to

maximum level. Provision of 100% solar energy in open spaces and common places.

28. Use of reflecting paints on roof top and side walls if all buildings.

29. Reduce hard paving-onsite (open area surrounding building premises) and/or provide

shade on hard paved surfaces to minimize heat island effect and imperviousness of the

site.

30. Provision of a water body may be made to conserve rain water. 31. Water saving practices such as usage of water saving devices / fixtures, low flow

flushing systems, sensor based fixtures, auto control walls, pressure reducing devices etc. should be adopted.

32. Green belt shall be comprised of specific plant species as per Central Pollution Control Board’s guidelines depending up on the type/nature of pollution. The

pollutants wise plant species shall be provided. 33. All utility lines (electricity, telephone, cable, water supply, sewerage, drainage, etc.)

shall be laid below ground level. 34. The road drainage shall be designed to enable quick runoff of surface water and

prevent water logging.

35. Adequate provision shall be made to cater the parking needs. Parking spaces

standards as given in ‘Manual on Norms and Standards for Environmental Clearance

of Large Construction Projects’ issued by Ministry of Environment & Forests,

Government of India shall be adapted.

36. All mandatory approvals and permissions as required from Airport Authority,

Director of explosives and Fire Department etc. shall be obtained.

37. Unskilled construction labourers shall be recruited from the local areas. Construction

materials shall be procured locally as far as possible.

38. Provisions shall be made for the integration of solar water heating system. Provision

for the use of biomass as a source of energy generation may be explored. 39. Provision of vermi-composting for the biodegradable solid wastes generated from the

project may be developed. 40. Information regarding hydrogeology and ground water regime shall be incorporated.

Surface water analysis regarding quality and the availability of sufficient quantity of water supply to the various complexes shall be ensured. Periodical monitoring of

ground water table and quality shall also be carried out. Construction of tube wells, bore wells shall be strictly regulated. The ground water shall not be abstracted without

prior permission from the competent authority in the project area. Permission to draw ground water shall be obtained from the competent authority prior to construction /

operation of the project.

41. The Strom water management plan shall be designed in such a manner so as to

confirm the existing drainage scheme of the surrounding locality. Storm water control

and its re-use as per CGWB and BIS standards for various applications should be

followed.

42. Noise barriers shall be provided at appropriate locations so as to ensure that the noise

levels do not exceed the prescribed standards. DG sets shall be provided with

necessary acoustic enclosures as per Central Pollution Control Board norms.

43. Municipal solid wastes generated shall be managed and handled in accordance with

the compliance criteria and procedure laid down in Municipal Solid Waste

(Management and Handling Rules), 2000 (as amended).

44. Proper composting/vermi composting of municipal solid wastes shall be carried out.

The proponent must develop the Solid Wastes Segregation, Collection, Handling,

Transportation and Disposal Scheme ensuring safe and scientific segregation,

collection, handling, transportation and disposal of organic and inorganic portion. The

organic waste is to be composted/vermi composted at the compost plant within the

project site. All municipal solid wastes shall be segregated, collected, transported,

treated and disposed as per provisions of the Municipal Solid Wastes (Management

and Handling) Rules, 2000 (As amended). 45. Hazardous wastes and bio-medical wastes shall be disposed off separately. All bio-

medical wastes shall be segregated, collected, transported, treated and disposed as per provisions of the Bio-Medical Wastes (Management and Handling) Rules, 1998 (As

amended). 46. Recycling of all recyclable wastes such as; newspaper, aluminium cans, glass bottles,

iron scrap and plastics etc. shall be encouraged. 47. All the conditions, liabilities and legal provisions contained in the Environmental

Clearance shall be equally applicable to the successor management of the project in the event of the project proponent transferring the ownership, maintenance of

management of the project to any other entity.

48. The project proponent shall make financial provision in the total budget of the project

for implementation of the above-mentioned conditions and for suggested

environmental safeguard measures. The funds earmarked for the environmental

protection measures shall not be diverted for other purposes.

49. Six monthly monitoring reports shall be submitted to this Authority and UPPCB.

50. The responsibility of implementation of environmental safeguards rests fully on the

project proponent. Project proponent shall establish an environmental management

cell to carryout functions relating to environmental management under the supervision

of senior executive, directly reporting to the head of organization.

51. In the case of any change(s) in the scope of the project, the project shall require a fresh appraisal by the SEIAA. The issuance this clearance shall not convey any

property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor

any infringement of Central, State or Local laws or regulations. 52. Adequate crowd management plan shall be undertaken. Risk Assessment study along-

with Disaster Management Plan (DMP) should be get approved from competent authority. The mitigative measures for disaster prevention and control shall be

prepared and All other statutory clearances from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest Conservation Act, 1980 and Wildlife

(Protection) Act, 1972 etc. shall be obtained, as applicable by project proponent.

53. The State Level Environmental Impact Assessment Authority, UP reserves the right to

amend the above conditions and add additional safeguard measures subsequently, if

found necessary.

dioxide (SO2), oxides of nitrogen (NOX) and carbon monoxide (CO) for the study area ( 6

from National Board Wild Life (NBWL) even if the eco- sensitive zone is not

earmarked.

General Guidelines

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for

any such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil

construction has been undertaken at site except fencing of the site to protect it from

getting encroached and construction of temporary shed(s) for the guard(s). (if fencing

has not been done, then the same may be deleted).

III. The project proposals are not covered under general conditions as prescribed under

EIA notification, 2006, as amended.

IV. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to

be false or misleading at any stage, the project will be rejected and clearance given,

if any to the Project will be revoked at our risk and cost.”

V. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented

are factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted

along with EIA.

c. Current, site photographs viewing towards the project area from four directions

indicating date of photograph taken, direction from which taken, name of the project,

and signature of Project proponent along with consultant with seal should be submitted,

so as to ensure that no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA

notification of 2006 and the Methods of Monitoring and analysis (Annexure-IV):

Guidance for assessment of representativeness and reliability of baseline environmental

attributes detailed under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which

this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm

along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated

with/involved in the preparation of these reports and the Name of laboratory through

which the samples have been got analysed should be stated in the report. It shall clearly

be indicated whether said laboratory is accredited by NABL or approved under the

Environment (Protection) Act, 1986 (Please refer MoEF office memorandum dated 4th

August, 2009). The name project leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the

information’s is to be submitted along with the EIA.

The committee noted that the matter was earlier discussed in SEAC meeting dated

29/04/2015 wherein the project proponent was directed to submit following information:

1. A copy of the master plan showing the proposed project should be submitted.

Approved copy of DPR of the project should also be submitted.

3. Copy of approved layout plan. All sanctioned building plans/Services

plans/sewerage plan/drainage plan alongiwth certificate from architect that the

plans have been prepared in accordance to Development Authority Bye-laws.

4. Permission from CGWB, if any water extraction is proposed.

5. Physical features within 30 m of the project sites with their ownership status.

6. Section details of all roads. Details about approach roads to proposed site.

7. Structural stability plan duly signed by structural engineer and vetting

organization alongwith complete details /qualifications of structural engineer and

vetting Organization/Authority.

8. The details of the E-Waste generated from the sister units of the project

proponents along with the present status of its disposal should be made available.

E-waste management/disposal plan alongwith plan for disposal of CDs/DVDs.

9. Exact location of STP along with annual operation and maintenance cost may also

be informed. Ultimate discharge of the treated sewage if any may be spelled out

clearly.

10. NOC from Forest, Fire fighting and Air port Authority should be submitted.

11. Area details showing proposed uses as residential, commercial, parks, parking,

roads, other services, facilities of the project also in percentage.

12. Provision of 100% solar energy on all roads and common areas like stair cases.

13. Project cost and corresponding CSR cost with details under commitment from

Board of Directors. A copy of resolution in this regard shall be submitted to the

authority. A list of beneficiaries with their mobile nos./address should be

submitted alongwith six monthly compliance reports.

14. Provision of alarm system, to timely notify the employees/residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well

defined evacuation plan should also be prepared and regular mock drills should be

arranged for the residents.

15. Built-up area of the project is proposed to be 1,49,321.69 sqm. If it exceeds

1,50,000 sqm, scoping and preparation of EIA will be required for appraisal of

project.

The project proponent submitted their replies through letter dated 06/05/2015 and

21/05/2015. A presentation was made by Shri Sanjeev Shukla, project proponent along with

their consultant M/s Ascenso Enviro Pvt. Ltd. The committee discussed the matter and

recommended grant of environmental clearance on the project details as given at Para-A

alongwith following specific and general conditions:

SPECIFIC CONDITIONS

I. Construction Phase:

1. Digging of basement shall be undertaken in view of structural safety of adjacent buildings

under information/consultation with District Administration/Mining Department.

2. Sprinkler to be used for curing and quenching during construction phase. No ground

water to be used for construction.

3. Structural safety certificate from qualified structural engineer should be obtained. The

same should get vetted from IIT, Delhi as discussed with project proponent.

4. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to 2% of total project cost shall be submitted (within three month) on need

base assessment study in the study area. Income generating measures which can help in

up-liftment of weaker section of society consistent with the traditional skills of the people identified. The program can include activities such as old age homes, rain water

harvesting provisions in nearby areas, development of fodder farm, fruit bearing orchards, vocational training etc. In addition, vocational training for individuals shall be imparted

so that poor section of society can take up self employment and jobs. Separate budget for community development activities and income generating programmers shall be

specified. 5. Consent for Establishment shall be obtained from UP State Pollution Control Board under

Air and Water Act and a copy shall be submitted to the Ministry before start of any construction work at the site.

6. Provision shall be made for the housing of construction labour within the site with all

necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile

STP, safe drinking water, medical health care, crèche etc. The housing may be in the form

of temporary structures to be removed after the completion of the project.

7. A First Aid Room will be provided in the project both during construction and operation

of the project.

8. All the topsoil excavated during construction activities should be stored for use in

horticulture/landscape development within the project site.

9. Disposal of muck during construction phase should not create any adverse effect on the

neighbouring communities and be disposed taking the necessary precautions for general

safety and health aspects of people, only in approved sites with the approval of competent authority.

10. Soil and ground water samples will be tested to ascertain that there is no threat to ground water quality by leaching of heavy metals and other toxic contaminants.

11. Construction spoils, including bituminous material and other hazardous materials, must not be allowed to contaminate watercourses and the dump sites for such material must be

secured so that they should not leach into the ground water. 12. Any hazardous waste generated during construction phase, should be disposed off as per

applicable rules and norms with necessary approvals of the UP State Pollution Control Board.

13. The diesel generator sets to be used during construction phase should be low sulphur

diesel type and should conform to Environment (Protection) Rules prescribed for air and

noise emission standards.

14. The diesel required for operating DG sets shall be stored in underground tanks and if

required, clearance from Chief Controller of Explosives shall be taken. DG set shall meet

the CPCB norms.

15. Vehicles hired for bringing construction material to the site should be in good condition

and should have a pollution check certificate and should conform to applicable air and

noise emission standards and should be operated only during non-peak hours.

16. Ambient noise levels should conform to residential standards both during day and night.

Incremental pollution loads on the ambient air and noise quality should be closely

monitored during construction phase. Adequate measures should be made to reduce

ambient air and noise level during construction phase, so as to conform to the stipulated

standards by CPCB/ UPPCB.

17. Fly ash should be used as building material in the construction as per the provisions of

Fly Ash Notification of September, 1999 and amended as on 27th August, 2003.

18. Ready mixed concrete must be used in building construction.

19. Storm water control and its re-use as per CGWB and BIS standards for various

applications. 20. Water demand during construction should be reduced by use of pre-mixed concrete,

curing agents and other best practices referred. 21. Permission to draw ground water shall be obtained from the competent Authority prior to

construction/operation of the project. 22. Separation of grey and black water should be done by the use of dual plumbing line for

separation of grey and black water. 23. Fixtures for showers, toilet flushing and drinking should be of low flow either by use of

aerators or pressure reducing devices or sensor based control. 24. Use of glass may be reduced by up-to 40% to reduce the electricity consumption and load

on air conditioning. If necessary, use high quality double glass with special reflective

coating in windows.

25. Roof should meet prescriptive requirement as per Energy Conservation Building Code by

using appropriate thermal insulation material to fulfill requirement.

26. Opaque wall should meet prescriptive requirement as per Energy Conservation Building

Code which is proposed to be mandatory for all air conditioned spaces while it is

aspirational for non-air conditioned spaces by use of appropriate thermal insulation

material to fulfil requirement.

27. The approval of the competent authority shall be obtained for structural safety of the

buildings due to earthquake, adequacy of fire fighting equipments, etc. as per National

Building Code including protection measures from lightening etc. 28. Regular supervision of the above and other measures for monitoring should be in place all

through the construction phase, so as to avoid disturbance to the surroundings. 29. Under the provisions of Environment (Protection) Act, 1986, legal action shall be

initiated against the project proponent if it was found that construction of the project has been started without obtaining environmental clearance.

II. Operation Phase:

1. Details of E-waste should be submitted.

2. The installation of the Sewage Treatment Plant (STP) should be certified by an

independent expert and a report in this regard should be submitted to the Ministry before

the project is commissioned for operation. Treated affluent emanating from STP shall be

recycled/ reused to the maximum extent possible. Treatment of 100% grey water by

decentralised treatment should be done. Discharge of unused treated affluent shall conform to the norms and standards of the UP State Pollution Control Board. Necessary

measures should be made to mitigate the odour problem from STP. 3. The solid waste generated should be properly collected and segregated. Wet garbage

should be composted and dry / inert solid waste should be disposed off to the approved sites for land filling after recovering recyclable material.

4. Diesel power generating sets proposed as source of backup power for elevators and common area illumination during operation phase should be of enclosed type and

conform to rules made under the Environment (Protection) Act, 1986. The height of stack

of DG sets should be equal to the height needed for the combined capacity of all proposed

DG sets. Use low sulphur diesel. The location of the DG sets may be decided with in

consultation with UP State Pollution Control Board.

5. Criteria/ norms provided by competent Authority regarding the seismic zone be followed

for construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for the residents. Rise of stairs should be constructed in a way, so that it should provide

smooth movement. 6. Noise should be controlled to ensure that it does not exceed the prescribed standards.

During night time the noise levels measured at the boundary of the building shall be restricted to the permissible levels to comply with the prevalent regulations.

7. The green belt of the adequate width and density preferably with local species along the periphery of the plot shall be raised so as to provide protection against particulates and

noise. 8. Weep holes in the compound walls shall be provided to ensure natural drainage of rain

water in the catchment area during the monsoon period.

9. Rain water harvesting for roof run- off and surface run- off, as plan submitted should be

implemented. Before recharging the surface run off, pre-treatment must be done to

remove suspended matter, oil and grease. The borewell for rainwater recharging should

be kept at least 5 mts. above the highest ground water table.

10. The ground water level and its quality should be monitored regularly in consultation with

Central Ground Water Authority.

11. Traffic congestion near the entry and exit points from the roads adjoining the proposed

project site must be avoided. Parking should be fully internalized and no public space

should be utilized.

12. A Report on the energy conservation measures confirming to energy conservation norms finalize by Bureau of Energy Efficiency should be prepared incorporating details about

building materials & technology, R & U Factors etc and submit to the Ministry in three months time.

13. Energy conservation measures like installation of CFLs/LED for the lighting the areas outside the building should be integral part of the project design and should be in place

before project commissioning. Use CFLs and LED should be properly collected and disposed off/sent for recycling as per the prevailing guidelines/ rules of the regulatory

authority to avoid mercury contamination. Use of solar panels may be done to the extent possible.

14. Adequate measures should be taken to prevent odour problem from solid waste

processing plant and STP.

15. The building should have adequate distance between them to allow movement of fresh air

and passage of natural light, air and ventilation.

16. Water segregation shall be carried-out at source and organic shall be composted.

Adequate space shall be provided within the complex.

PART-B: GENERAL CONDITIONS:

1. The project proponent shall also submit six monthly reports on the status of

compliance of the stipulated EC conditions including results of monitored data (both

in hard copies as well as by e-mail) to the respective Regional Office of MoEF, the

respective Zonal Office of CPCB and the UPPCB.

2. Officials from the Regional Office of MOEF, Lucknow who would be monitoring the

implementation of environmental safeguards should be given full cooperation,

facilities and documents/data by the project proponents during their inspection. A

complete set of all the documents submitted to SEIAA should be forwarded to the

CCF, Regional office of MOEF, Lucknow.

3. In the case of any change(s) in the scope of the project, the project would require a

fresh appraisal by this Ministry.

4. The Ministry reserves the right to add additional safeguard measures subsequently, if

found necessary, and to take action including revoking of the environment clearance

under the provisions of the Environmental (Protection) Act, 1986, to ensure effective

implementation of the suggested safeguard measures in a time bound and satisfactory

manner.

5. All other statutory clearances such as the approvals for storage of diesel from Chief

Controller of Explosives, Fire Department, Civil Aviation Department, Forest

Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, as

applicable by project proponents from the respective competent authorities.

6. These stipulations would be enforced among others under the provisions of Water

(Prevention and Control of Pollution) Act, 1974, the Air (Prevention and control of

Pollution) act 1981, the Environment (Protection) Act, 1986, the Public Liability

(Insurance) Act, 1991 and EIA Notification, 2006.

7. The project proponent should advertise in at least two local Newspapers widely

circulated in the region, one of which shall be in the vernacular language informing

that the project has been accorded Environmental Clearance and copies of clearance

letters are available with the U' Pollution Control Board and may also be seen on the

website of the Ministry of Environment and Forests at http://www.envfor.nic.in. The

advertisement should be made within 10 days from the date of receipt of the

Clearance letter and a copy of the same should be forwarded to the Regional office of

this Ministry at Lucknow.

8. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat,

Zilla Parisad/Municipal Corporation, Urban Local Body and the Local NGO, if any,

from whom suggestions/ representations, if any, were received while processing the

proposal. The clearance letter shall also be put on the website of the company by the

proponent.

9. The proponent shall upload the status of compliance of the stipulated EC conditions,

including results of monitored data on their website and shall update the same

periodically. It shall simultaneously be sent to the Regional Office of MoEF, the

respective Zonal Office of CPCB and the UPPCB. The criteria pollutant levels

namely; PM10, PM2.5, SO2, NOx (ambient levels as well as stack emissions) or critical

sectoral parameters, indicated for the project shall be monitored and displayed at a

convenient location near the main gate of the company in the public domain.

10. The environmental statement for each financial year ending 31st March in Form-V as

is mandated to be submitted by the project proponent to the concerned State Pollution

Control Board as prescribed under the Environment (Protection) Rules, 1986, as

amended subsequently, shall also be put on the website of the company along with the

status of compliance of EC conditions and shall also be sent to the respective

Regional Offices of MoEF, Lucknow by e-mail.
