SUBJECT: AN ORDINANCE OF THE CITY COUNCIL OF THECITY OF LAKE ELSINORE, CALIFORNIA,AMENDtNc SECTTONS 6.04.020, 6.04.030, 6.04.060,6.04.070, 6.04.140, 6.04.150, 6.04.245 AND EXH|B|TA TO CHAPTER 6.04 OF THE LAKE ELSINOREMUN¡CIPAL CODE REGARDING ANIMAL CONTROL

Backqround

The new animal shelter is scheduled to open later this year and the City'sagreement for animal control field services expired on June 30'n; however, it hasbeen extended on a month-to-month basis until a new agreement has beenapproved. The City's overall cost for Animal Control services is projected to risesubstantially during the current fiscal year. To help offset a portion of the increasedcost of Animal Control services, City Staff desires to increase animal license andimpound fees.

Currently the City's Animal Control Fee Schedule is embedded as part of theordinance in Chapter 6.04 of the Lake Elsinore Municipal Code (LEMC). City Staffdesires to amend the ordinance so that all fees, penalties and other chargesrelated to animal control are established by resolution. In general, setting fees byordinance is not desirable, because the ordinance process takes additional time tobecome law and the City shouldn't have to amend an ordinance every time itdesires to change fees.

ln a separate housekeeping measure, City Staff recommends deletion of Exhibit-Afrom Chapter 6.04 of the LEMC. Exhibit-A is an outdated listing of exotic animals.City Staff believes the listing is irrelevant and redundant, because section 6,04.260(Keeping of exotic animals) already provides regulation of all "exotic" animals.

Amending the Animal Control ordinance and establishing the Animal Control FeeSchedule by resolution will be a two step process. The first step is for the CityCouncil to consider amending the ordinance. In addition, City Council should

provide direction to City Staff on a DRAFT Animal Control Fee Schedule. Duringthe second reading of the ordinance, the City Council will have the opportunity toadopt the revised Animal Control Fee Schedule by resolution.

Discussion

The estimated annual cost for Animal Control Services during a full fiscal year forthe City of Lake Elsinore equals:

$712,912 (Field & Shelter Services) minus $135,800 (license revenue) = $577,112

However, this estimate will be prorated based upon the actual opening date of thenew shelter.

Per the City's current agreement with Animal Friends of the Valley (AFV), alllicense and impound fees are retained by AFV. For the Fiscal Year ending 2010,AFV collected the following revenue.

License Fees = $127,900lmpoundFees= $ 10,628BoardingFees= $ 4,679Citations = $ 16.000Total = $159,207

Attached is an Animal Control Fee Schedule Comparison for regional cities and theCounty of Riverside. Included in the Fee Schedule are City Staff's proposedincreases and changes in fees. The changes are summarized below.

. lncrementally increase license fees over a three year period.o Eliminate multi-year license fee discount.o Increase lmpound Fees equivalent to the County.. Increase Boarding Fees ($/day¡ on par with actual cost.

City Staff request direction from the City Council on the Animal Control FeeSchedule in order to prepare a resolution to adopt the Fee Schedule during thesecond reading of the amended ordinance.

Fiscal lmpact

There is no fiscal impact for amending the ordinance.

Recommendation

Waive further reading and introduce by title only an ordinance amending certainsections of Chapter 6.04 of the Lake Elsinore Municipal Code regarding AnimalControl.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITYOF LAKE ELSINORE, CALIFORNIA, AMENDINGsEcTtoNS 6.04.020, 6.04.030, 6.04.060, 6.04.070,6.04.140,6.04.150,6.04.245 AND EXHIBTT A TOCHAPTER 6.04 OF THE LAKE ELSINORE MUNICIPALCODE REGARD¡NG ANIMAL CONTROL

THE CITY COUNC¡L OF THE CITY OF LAKE ELSINORE, CALIFORNIA,ORDAINS AS FOLLOWS:

SECTION 1. That Section 6.04.020 of the Lake Elsinore Municipal Code ishereby amended and restated in its entirety as follows:

6.04.020 Animal Gontrol Fees

Fees, penalties and charges related to animal control shall be established byresolution of the City Council.

SECTION 2. That the title and Subparts A and B of Section 6.04.030 of the LakeElsinore Municipal Code are hereby amended as follows:

6.04.030 Dog and Cat Licensing

A. lt is unlawful for any person to own, harbor or keep any dog or cat fourmonths of age or older within the City for a period longer than 30 days, unless there isattached to such dog or cat a valid license tag obtained from the City of Lake Elsinore.A license will be issued for each dog or cat upon payment of a license fee establishedPursuant to@in LEMC 6.04.020.

Said license shall be valid for a period of one year following issuance and shallbe renewed within 30 days after such period termination.

B. lf an application for a license is made more than 30 days after the date suchlicense is required, the applicant shall pay a penalty established pursuant toras-setJe#hin LEMC 6.04.020.lf a valid license tag is lost or destroyed, a duplicate thereof may beprocured from the Animal Control Department upon submission of proof of loss andpayment of the fee established pursuant in-LEMC 6.04.020.

SECTION 3. That Subpart B of Section 6.04.060 of the Lake Elsinore MunicipalCode is hereby amended as follows:

B. lf an application for a license is made more than 30 days after the date suchlicense/permit is required, the applicant shall pay a penalty established pursuant to asse++e"4h-in LEMC 6.04.020.

SECTION 4. That Subpart D of Section 6.04.070 of the Lake Elsinore MunicipalCode is hereby amended as follows:

D. The Animal Control Agency may deny an application for a permiUlicenserequired by this chapter, whether original pr renewal, or suspend or revoke such apermiUlicense if it finds that any kennel, cattery or pet shop fails to meet any of theconditions set forth in this chapter, or the premises within which dogs or cats are kept ormaintained as provided in this chapter fail to meet any of the conditions set forth herein.The Animal Control Agency shall prepare a notice of denial of an application, orsuspension or revocation of a permiUlicense, setting forth the reasons for such a denial,suspension or revocation. Such notice shall be served personally on the applicant orlicensee. Such notice of denial, suspension or revocation by filing with the City, within15 days after notice of such denial, suspension or revocation, a written notice of appealbriefly setting forth the reasons why such denial, suspension or revocation is not properand by paying the fee for appeal established pursuant to by LEMC 6.04.020. The CityClerk shall give notice to the appellant by regular mail of the time and place of thehearing. Such appeal shall be heard by the City Council which may affirm, amend orreverse the decisions. In conducting the hearing, the Council shall not be limited by thetechnical rules of evidence.

SECTION 5. That Subpart A of Section 6.04.140 of the Lake Elsinore MunicipalCode is hereby amended as follows:

A. No impounded animal shall be redeemed except on payment of all appropriatefees established pursuant to as-sta*ed-in LEMC 6.04.020. No dog or cat which is to bekept or harbored within the corporate limits of the City of Lake Elsinore shall be releasedfrom the shelter unless or until it is duly licensed in accordance with the provisions ofthis chapter. No unredeemed dog or cat shall be sold if or while the same is sufferingfrom any infectious or communicable disease.

SECTION 6. That Section 6.04.150 of the Lake Elsinore Municipal Code ishereby deleted in its entirety.

SECTION 7. That paragraph 7 of Subpart F of Section 6.04.245 of the LakeElsinore Municipal Code is hereby amended as follows:

7. Require that the animal be impounded at the expense of the owner or personin charge, custody, or control of the animal in accordance with the fee scheduleestablished pursuant to s€+{€"4h-irì LEMC 6.04.020.

SECTION 8. That Exhibit A to Chapter 6.04 of the Lake Elsinore Municipal Codeis hereby deleted in its entirety.

SECTION 9. lf any provision, clause, sentence or paragraph of this Ordinance orthe application thereof to any person or circumstance shall be held invalid, suchinvalidity shall not affect the other provisions of this Ordinance and are hereby declaredto be severable.

SECTION 10. This Ordinance shall take effect thirty (30) days after the date ofits final passage or such later date as may be designated by the City Council. The CityClerk shall certify as to adoption of this Ordinance and cause this Ordinance to bepublished and posted in the manner required by law.
