Per the request of the Developer, the Design Consultant acknowledges the following statements in accordance with their Design Consultant Agreement for the project:

1. The Design Consultant (Name) confirms, based on available data and information, and based upon our diligence that all design, engineering, traffic, safety and environmental studies are in compliance with the applicable and required regulations, building codes, approved planning and design guidelines, and good industry practice necessary for construction and future operation of the project.

2. The Design Consultant confirms that it has taken and will continue to take all required steps, in accordance with our agreement, to ensure that the property is designed in accordance with applicable and required regulations, approved guidelines, building codes and good industry practice. Therefore, the Design Consultant confirms that the property has met all conditions required to be served by sewage, drainage, water supply and electricity services and that the existing works for these services are in compliance with the requirements of the approved construction documents.

In the event of any fraud, misrepresentation, negligence, recklessness, or willful misconduct in relation to the above statements, the Design Consultant shall be held liable for any damages resulting therefrom.
