Preface: Ministry of Power, Government of India,

has launched the Restructured Accelerated Power

Development and Reforms Programme (R-APDRP)

in July 2008 with focus on establishment of base

line data, fixation of accountability, reduction of AT&C

losses up to 15% level through strengthening & up-

gradation of Sub Transmission and Distribution

network and adoption of Information Technology

during XI Plan. Projects under the scheme shall be

taken up in two parts. Part-A shall include preparation

of Base-line data for the project area covering

Consumer Indexing, G!S Mapping, Metering of

Distr ibut ion Transformers and Feeders, and

Automatic Data Logging for al l Distr ibut ion

Transformers and Feeders and SCADA / DMS

system (only in the project area having more than 4

lacs population and annual input energy of the order

of 350 MU). It would include Asset mapping of the

entire distribution network at and below the 11kV

transformers and include the Distr ibut ion

Transformers and Feeders, Low Tension lines, poles

and other distribution network equipment. It will also

include adoption of IT applications for meter reading,

billing & collection; energy accounting & auditing;

MIS; redressal of consumer gr ievances;

establishment of IT enabled consumer service

centers etc. The base line data and required system

shal l be ver i f ied by an independent agency

appointed by the Ministry of Power. Part-B shall

include regular distribution strengthening projects

and will cover system improvement, strengthening

and augmentation etc.

SAP was rolled out in WBSEDCL in most of the

RAPDRP part -A project areas in West Bengal. Its

effect is so prominent and debatable that it has

become the centre point of discussion in different

tiers of our hierarchy. Prior to this, we have long time-

tested epoch-making in-house software developed

in Oracle environment that is performing well in

billing related activities and is supposed to be the

backbone of revenue monitoring system. Oracle

based system run in different establishments of

WBSEDCL regarding in house business modules like

bi l l ing, payment, accounts and employee

information. In Oracle environment, each system was

modularized under each division having one server

only and these could be communicated with other

units via BSNL 2 MBPS leased line architecture. The

system was developed & supported by our learned

in-house engineers and so the software process

lifetime costs were negligible like cost of requirement

analysis, freezing of requirements, design, coding,

uni t test ing, stress and volume test ing and

maintenance. Maintenance is the entire main thing

that software is into, which covers almost 69% of

the SDLC (Software Development Life Cycle). And

it’s the maintenance that incurs major production

issues which actually come from after roll-out of any

new patch. So maintenance being the most crucial

part of SDLC and during post-implementation of the

software, Oracle based system enforces practically

zero maintenance cost in both LT & HT model billing

system. If all these sound good for an organization,

then what was the need for SAP implementation?

Unfortunately, this most competent and versatile

billing related application software developed in

Oracle is gradually being substituted by SAP

applications only in the name of ERP - business

management software that allows an organization

to use a system of integrated applications to manage

their business. Wel l , we cannot deny the

technological advancement to cope up with the pace

of reforms and restructuring. ERP is welcome as it

integrates all facets of an operation, including

network planning and development, energy billing,

payroll, employee information, store management

etc. But to the best of knowledge, another ERP

namely ORACLE E-business suite was previously

purchased from Oracle Corporation and a good

number of engineers were also trained in 11 i. Our

Engineers were more famil iar with Oracle

environment as they were engaged in the dealing

with this RDBMS since inception level. In short,

WBSEDCL is having abundant resource of

manpower well familiar with Oracle environment than

SAP environment. The answer was, however,

explained by the so-called software think-tank like

this. “SAP was required to centralize the entire

business processes l ike bi l l ing, employee

information, payroll, CRM etc. Centralization is all

that the corporate level of an organization needs to

capture business data and management information

for better decision making at the corporate level.

Decentralized architecture had some drawbacks

regarding reporting and information and it could be

diverse across the regions depending upon the state

of view of the local administrators.” But centralization

could also be achieved with Oracle 11i with havoc

expertise and proficiency of our engineers in Oracle

domain instead of offering the development and

support activity of SAP billing to an outside vendor

ultimately leading to no control of us in our own

revenue management software. The biggest USP of

Oracle ERP, as we know is that it is based on Oracle

Database, which in itself is a market leader. So .the

Oracle ERP is best placed to take advantage of the

advances in the database technology. The buzzword

is “If it is in the database, you will get it and get it

fast!!” As far as the components of the suite itself

are concerned, Oracle Financials is a market leader;

Oracle HRMS and Payroll are already catching up

pretty fast. So the market indications are pretty

positive and you have enough consultants in the

market to cash in.

Now let us see what is SAP?

SAP stands for System Applications and Products

in Data Processing. It’s an ERP software started by

5 IBM engineers in 1970s.The SAP Utilities (IS-U)

component is a sales and information system that

supports all business processes and utility services

of a utility company. You can use IS-U for managing

and billing residential, commercial and industrial, and

prospective customers. IS-U is integrated with the

Service Management (PM-SMA), Customer Service

(CS) and Sales and Distribution (SD) application

components, enabling you to bill service orders,

service contracts, and the sale of goods.

SAP Utilities

l IS-U/CCS

l With Basic Functions you manage addresses and

regional structures, as well as generating dates

and schedules for meter readings, billings, and

budget billings.

l With Master Data you manage data that remains

fixed for long periods of time. In IS-U, this data

includes the business partners, contracts and

contract accounts, connection objects (buildings

and real estate) and the premises, installations,

and device locations contained therein.

l With Device Management you manage the

installations, meter reading, and the certification

of all devices for a utility company.

l The IS-U. Billing component is used for billing

the following standard divisions: Electricity, gas,

water/waste water, distr ict heat ing, and

multimedia services (for example, cable TV).

l The IS-U Invoicing component enables you to

group services and invoice them on one bill. You

can also use the component to calculate and

charge fees and taxes.

l Intercompany Data Exchange (IDE) is a solution

that covers the requirements that have arisen

from the deregulation of energy markets. IDE

covers the following areas:

l Management of deregulation data

l Process execution

l Management of data exchange processes etc.

Post Migration Issues from Legacy to SAP:

In our legacy system, information was stored in

tables which were accessed by different schema.

There are mainly two types of information i.e. Master

data and Transactional data. Normally Master data

remains fixed for a long period of time and is also

called Static data while Transactional data is

populated each time any local or remote process is

executed. In table format most of the data can be

retrieved using one composite primary key i.e.

Customer or billing information can be retrieved with

the combination of office code and consumer no or

consumer id at user’s discretion apart from menu

driven reports. This means uniqueness is maintained

among all consumers across West Bengal. However,

in SAP, robust concepts are introduced. These are

MRU, PORTION, INSTALLATION, DEVICE and

SMRD. The meter reading unit abbreviated as MRU

is the concatenation of <bill office code><billing

zone><quarterly/monthly><MR> and PORTION (for

bi l l ing) is l ike <bi l l off ice code><bi l l ing

zone><quarterly/monthly><PR>. The logic is not

easily conceivable for any DCC-in-charge. For any

customer care centre, unique billing zone is identified

for metering and billing activity. Consumer in SAP is

mapped to installation and meter is mapped to

device. Hence, comes the major difference between

the two systems. In legacy reading is taken in terms

of reading period or accounting month. For a

particular month say 10 number zones are to be

billed. Then these 10 zones are mapped to a

particular month. Other zones are mapped to other

accounting months. Thus in a span of three months,

all billing zones are covered within a supply. This is

the quarterly billing process. Reading is taken after

every 90 days (30 days for monthly billing) and so

bill for every consumer in every month is ascertained.

But in SAP, billing is carried out in terms of scheduled

meter reading date and not against any particular

accounting month. Also, these scheduled meter

reading dates are captured from legacy database

where the reading date pattern of legacy billing

zones are frozen. But these dates are not mapped

to any particular accounting month and accounting

year which often creates confusion to the meter

readers at supply level. More to add that there inflicts

a paradigm shift in conception of billing logic from

the conventional billing system with which our

engineers were accustomed to.

Let’s talk about the unbilling issue. It is seen in

every month report that many CCCs have thousands

of unbilled consumers. But if one could go through

past records of that CCC through legacy system, it

was far lesser that that. None but the inherent logic

of SAP is responsible for this. According to experts,

the primary problem lies in the scheduled meter

reading dates and the non-existence of subjective

mapping between scheduled meter reading date and

accounting month. Normally SMRD ranges are taken

in between 16th of previous month to 15th of current

month. These are to be calculated for three months

to cover all consumers. But, it is seen that some

zones those are to billed in the next accounting

month comes in the 16th-15th loop due to their

haphazard scheduled meter reading date are also

treated as unbilled. Any CCC with more no of zones

is to suffer from this issue. This creates confusion in

the management about the actual scenario and the

incorrect reporting. As a result, site authorities face

lot of criticisms from top management for this

fictitious unbilling.

The funniest thing is that you will struggle to bill

actual unbilled consumers in your system. One single

billing involves eight rigorous steps right from order

creation to spooling. So if you have a minimum 80

numbers of unbilled consumers, end user has to

perform 80 x 8 = 640 operations to get the billing

done. Think about the time required to complete the

job as well as the human efforts. If there is any meter

replacement, then device deletion and attachment

increases the total steps further. This is because

there is no batch process generation of unbilled

consumers one at a time in SAP.

It is a pithy saying that “To err is human”.

Generally any software is developed to catch

repetitive human error through its various validations,

be it web based or PC based to acquire most correct

user data. End user cannot be blamed for wrong

entry in database because of absence of validation.

In legacy system the validation was robust and even

there were chances of rectification after validity of

garbage data. But in SAP, absence of validation

makes newspaper headlines. Several occurrences

of meter-roll-over cases are surfacing throughout the

state. For example, any meter with 4 digit dial should

produce its maximum reading 9999 and then roll over

to 0. SAP can’t capture this yet and thus end user

has to capture this error from assuming system that

this is 5 digit meter and the consumption comes as

={(99999-9999)+1}=90001 instead of 1 unit. So, it’s

easy to find why such crore bills were hitting the

headlines. After reading entry which is now being

carried out by outside agencies in most of the CCCs

in West Bengal, one has to manually check the

plausibility clause one by one which is tedious,

cumbersome and time wasting job to perform for all

the SMRD in every month.

Next comes the concept of batch process i.e.

bunch of processes scheduled to run in a particular

non-working hours of the day. SAP solely depends

on batch processes for billing, defaulter notice and

disconnection generation, where as in legacy these

can be carried out any day by any end user preferring

the due dates as per his or her choice. The same

flexibility is not available in batch process. It is often

seen that batch process fails often resulting in partial

billing and thus creating disturbance in bill sorting

and delivery. Batch process is not reliable at all. The

dunning batch process runs every week end so the

due dates expired before that particular weekend will

only be defaul ted as defaul ter not ice and

disconnection order generation. Even cases are

found that even after expiry of due dates notice is

not generated. The funny thing is that in legacy

system, one can understand how many consumers

are paid and how many defaulter notices are

generated. But, in SAP, this process still remains like

a black box. Whatever will be the outcome is not

known. DCC in-charge depends solely on the

message about the spool preparation completion and

to act accordingly. This message is shown only once.

If he or she unmindfully ignores it, there are chances

of no notice generation. Moreover, this alert message

does not flash often either. Even sometimes HT

related pop-up comes in LT related bill window.

The reporting in oracle database is seamlessly

easy as compared to SAP. Where as to generate

report from SAP one has to depend on database

snapshot of web portal. Database snapshot cannot

be compared with the real time live production

database of oracle system. As a result portal often

reflects historical data only. So, to extract any report

for any particular day, say number of unpaid industrial

consumers for this month as on date, one has to run

a sample historical report from portal and then

manually check the data in live database through

payment checker fp!9 to get actual payment status.

This is laborious process and consumes manpower.

Effectively to send a disconnection team to field list

preparation takes more t ime than the actual

execution of disconnection in consumer premises.

But, it is very difficult to retrieve the live data from

data centre production server for an end user. For,

example say one is running industrial defaulter list

from portal, the report what is coming is not

convincing , even short payment amounting less than

one rupee (often in paisa !!) comes in report. A

sample is listed below.

Payment processing is very tough in fpl9. As

payment related authorization is generally not

granted to DCC level, It is granted to Circle Level

Manager (F & A). So it often creates problem in

regeneration unlike legacy system where control

over billing is at hand. Also, single shot billing is not

available. All eight steps need to be performed to

generate individual bill if that consumer is not billed

in his billing zone batch system. In many aspects of

SAP authorization are distr ibuted throughout

different level. It causes communication problem and

hinders progress activity.

One thing is surprising that for any Company to

adopt particular software for its commercial usage

in respective business domain, the Company has to

freeze the requirements first. Requirements analysis

is critical to the success of a systems or software

project. The requirements should be documented,

actionable, measurable, testable, traceable, related

to identified business needs or opportunities, and

defined to a level of detail sufficient for system

design. This is not clear to us whether in SAP, such

requirements analysis was made to determine

whether the stated requirements are clear, complete,

consistent and unambiguous, for resolving any

apparent conflicts. The vendor responsible for

development of the software might have not

identified our needs, might have not evaluated the

system for feasibil i ty and on the other hand,

WBSEDCL might have not tested the software as

per requirements to fit into its business domain, might

have not encouraged the vendor to prepare a data

model from the frozen requirements to have the

required designs and coding. Hence, lies the big gap.

More defects identified in later stages invite more

rework which demands more costs to fix the problem.

One issue tracker has been developed by the

vendor to track the software related problem there.

The site authorities put the software bugs there for

getting fixed it by the vendor. As on date, 52098

issues in the software were put in the tracker.

Imagine the numbers of issues relating to the

software which deals with our revenue management

system. For giving a piece of information to the

learned readers of this article, only a mere 1375 bugs

were attended and closed by the vendor which has

astonishingly outsourced that areas of work and the

status of others are kept as HOLD, WAITING NEW,

REOPENED etc. It is vivid that there are plenty of

unattended and unsolved issues. Issues are not

attended regularly and thus increase consumer

grievances, ultimately leading to tarnish of the image

of the company. With so many bottlenecks in the

software, it is surprising to see how UAT (User

acceptance test) of the software was done and

passed for deployment at site!

As previously stated, software is at sole hand of

M/S TCS. The engineers of WBSEDCL are in dark

about SAP internal logic unlike oracle based system.

When any software patch is updated, end user has

no idea what the patch is all about and whether the

patch has arrested the previous bug.

All these lead to erroneous implementation of

SAP system which results reduction of flexibility, loss

of revenue, increased consumer grievance etc. Also,

huge amount of money is getting wasted to pay

towards development cost, maintenance cost and

production support and hardware & network resource

cost. The key takeaway here is that, as with any ERP

solution, SAP and Oracle both have their strengths

and weaknesses. One solution may be the best fit

for one organization, while not a good fit for others,

even within the same industry. The only way to make

sense of the pros and cons in a way that is

meaningful to your organization is to engage in a

robust ERP software select ion process that

considers your requirements, pr ior i t ies, and

competitive advantages to find the right fit. Oracle

has a slight advantage in average implementation

duration and an even larger advantage in average

implementation cost, at 20% less than SAP. SAP,

on the other hand, has the lowest business risk of

the two, measured via the probability of a material

operational disruption at the time of go-live.

POWER THEFT AND ITS SOCIAL IMPACT

Theft of electricity is the greatest menace for any

electricity distribution company. The very existence

of the company may be jeopardized, if the theft of

electricity is allowed to occur for narrow political or

personal gains. Considering the importance of the

matter, the law of the land has been made stringent

by implementing and amending the Electricity Act in

2003 and in 2007. The offence has been made non-

bail able one. This means the offenders have to get

bail from the court after arrest by the police. Provision

has been created for formation of Special Court for

speedy disposal of electricity theft cases and there

is also provision for formation of special police station

which will take care of the offence of the theft of

electricity exclusively. It is true that there are some

real problems towards tackling this theft of electricity.

Perhaps, this is the only business where the

measuring instruments (energy meters) remain in the

custody of the consumers. This is apart from the

easily available bare conductor in the remote villages

making the system theft-pron. So, task of prevention

of electricity is not so easy one so that the same

can be prevented by the utility persons only. What

we need a tremendous support from the society as

whole. Unfortunately, in our society electricity theft

is not looked upon with same view on theft of other

commodities. As a result many people do this crime

openly without caring of any criticism from the

society.

As per provision of the law, India Government

is determined to provide electricity to its all citizen

in time bound manner. This task is laid on the

different distribution agencies of the country. As such

in case of West Bengal, the responsibility of sending

power to the remotest corner of the State has laid

on WBSEDCL and proudly enough it is doing the

same with whole hearted support f rom the

Government of West Bengal. Because of the same

effort, the number of consumers has been increased

from 80 lacs to 120 lacs by last two years itself. As

the electric lines are expanded rapidly, the security

on these lines is being jeopardized. As a result, ATC

Loss of the company is increasing day by day. If the

same is not taken care of properly, the company may

loss its financial balance and for this purpose, we

need social help. It is needless to mention here that

WBSEDCL has to procure electricity by paying price

for the same and being a government owned

organisation it will not be able to allow the misuse

of public money in form stealing of electricity. If

WBSEDCL do not get back the full price of electricity,

it will not be able to develop its financial health which

will ultimately affect the society as a whole. So, let

the people know that now-a-days utility cannot

provide free electricity to any consumer. For getting

quality power in reasonable price, the theft of

electricity to be stopped and this can only be possible

with social help. Not only loss of Government

revenue, power theft poses great threat to life and

property. In course of taking unauthorised power (see

the picture), they destroy all kind of safety for life

and property. Many deaths can be avoided by

avoiding theft of electricity.

‘CONSERVATION OF ENERGY’ is a popular term

of modern t ime. Unauthorised users misuse

electricity grossly, because they do not pay for the

same. So from that angle also, the theft of electricity

should be stopped. So we should raise slogan “STOP

THEFT OF ELECTRICITY, SAVE THE SOCIETY

AND ENJOY QUALITY POWER”.

PREAMBLE:

In exercise of power conferred by Department of

Power and NES vide No. 79/PO/O/Cell-lll/ 3R-29/

2006 Dated, 05/03/2008 and in pursuance of the

decision of the Board of Directors of West Bengal

State Electr ic i ty Distr ibut ion Company Ltd

(WBSEDCL) in its meeting Dated, 06/02/2009, the

WBSEDCL Revision of Pay and Allowances Rules,

2009 (ROPA, 2009) of employees of WBSEDCL was

introduced with an effect from 1st Day of January,

2006. Accordingly, an O.O. No. 89, dated 16.02.2009

of the Director (HR): WBSEDCL was issued on ROPA

of Employees of WBSEDCL.

Though WBSBEA’s all demands were not fulfilled

through ROPA, 2009 but we accepted those with a

hope that WBSEDCL management would take care

all our issues on subsequent date to give proper

justice to the Engineers who are the backbone of

this organisation.

Of all other resources, human resources can be

the most important. With the development of modern

management, this resource was tried to make more

and more effective. In the present modern days, for

any modern organisation it is the priced possession.

Scientific and modern “Human Resource Policy” as

we understand is yet to be inked and adopted in our

organisation. Still, we do have some established

activities to run the show. To ensure sustainable

improvement of performance of the organisation, a

comprehensive and scientific “HR” policy comparable

to the best power utilities in India is a must. The

policy must cover the following major areas:

l Timely and quality recruitment at the induction

level.

l To ensure career growth of all employees, by

creating required scope and maintaining a

transparent promotion policy i.e career growth

management policy. This will motivate and uphold

the dignity of the employee; which in turn improve

the bonding between the employees and the

organisation.

l To remunerate the employees properly for

rendering their services.

l To reassign delegation of power with extension

of statutory financial limits.

l To adopt and adhere rotational transfer policy.

We have many demands to place before you in

respect of Revision of Pay Structures and Allowances

and other HR & welfare policies which are already

due. We are working on these issues. We are

examining the Pay structures and other benefits

existing in the leading power utilities in India like

POWERGRID, BHEL, NTPC, NHPC, DVC etc. It is

seen that we, the Engineers of WBSEDCL (a leading

power utility in India) are the most deprived section

of employees in this organisation. Our Pay structures

& Allowances and career progression/promotional

scheme are no match with the other leading power

utilities in India. So, we will place our detailed

demand regarding Pay structures in due course. But

as we are facing acute stagnat ion problem

particularly in the post of superintending Engineer,

so we would like to address this long burning issue

before you for immediate solution of the problem to

motivate Senior management level engineers and

to uphold their dignity for ensuring a sustainable

improvement of performance of the organisation.

SHORTCOMING OF THE EXISTING CAREERPROGRESSION SCHEME (CPS) WITH A BACKGROUND

OF EARLIER ASSURED PROMOTION SCHEME (APS)

We, the Graduate Engineers are the worst

sufferer in this organisation. In WBSEB regime also

we were the most sufferer section of employees in

respect of Pay packages as wel l as career

promotional scheme. We, the Engineers Association,

as a whole, had long glorious movement and

personal sacrifice to resolve the long pending

stagnation issues and career promotional issues. At

that time graduate Assistant Engineers were used

to stay in the same post for more than 18 years.

Few of them were promoted to the Divisional

Engineer post as per vacancy through an unscientific

interview system. Many engineers even had to

complete their full length of service in the Divisional

Engineer post, particularly in the Electrical cadre.

With our constant persuasion, agitation, movement

and with the intervention of the Government, the then

management ult imately adopted an “Assured

Promotion Scheme (APS)” in the year 2001 with the

stipulat ions that an Assistant Engineer after

completion of total 8(eight) years of continuous

service will get promotion to the next higher post

i.e. in the post of Divisional Engineer. Similarly, an

Divisional Engineer after completion of total 16

(sixteen) years of continuous service from the

induction level and 8 (eight) years of continuous

service in Divisional Engineer ’s post wil l get

promotion to the next higher post i.e. in the post of

Superintending Engineer. But as the stagnation of

engineers were very much acute dur ing

implementation stage of that APS and as the major

section of engineers in the rank of DE (A) had

crossed 18/19 years of services at that time, so they

got promoted to the Superintending Engineer post

after completion of 21 (Twentyone) years of total

service adhering initial condition of fulfilling 3 (Three)

years locking period as per the then prevailing rule

of that APS system. Those engineers, now in the

senior management level i .e. In the post of

Superintending Engineer, got suffered at that time

by way of not getting Superintending Engineer post

on the date of implementation of APS. Rather, they

got the Superintending Engineer post af ter

completion of 21 (Twentyone) years of service

instead of eligibility years of 16 (Sixteen) years of

service due to bizarre and unscientific conception in

that APS Policy. Still those senior management level

Engineers are also suffering a lot at present.

After formation of WBSEDCL in the year 2007

and subsequent implementation of ROPA, 2009, we

observed that the term APS has been replaced by

CPS i.e. Career Progression Scheme keeping the

eligibility years unaltered for promotion up to the third

level i.e. in Superintending Engineer post like APS

but without addressing the acute stagnation problem

of engineers in particular. Situation was worsened

due to abolition of intermediate scale of pay and

designations like Sr. AE, SR. DE and DY. CE during

implementation of ROPA, 2009, unlike other leading

power utilities in India like POWERGRID, BHEL,

NTPC, NHPC, DVC etc. At that t ime we, the

Engineers Association demanded to modify the CPS

with new Pay Band and Grade Pay with new

designation in between Superintending Engineer

post and Additional Chief Engineer post. We may

also refer to the Promotional policy of Engineers of

Govt. of West Bengal, implemented in ROPA , 2009,

wherein an Superintending Engineer after

completion of 1(one) year in the his post were

allowed to get Pay Band : PB - 5 with grade pay of

Rs. 8700/-. Ultimately, after long persuasion from our

side, the then CMD: WBSEDCL & WBSETCL

principally agreed for extension of the CPS. But

unfortunately, it was observed that only Pay Band :

PB-5 with a new formulated grade Pay of Rs. 8100/

- (which had no reference in the ROPA, 2009 of

WBSEDCL) without any designation was allowed to

the class-l employees after completion of total 25

(Twenty five) years of continuous service from the

induction level, subject to completion of 9 (Nine)

years of cont inuous service in the post of

Superintending Engineer or equivalent level. So,

acute stagnation particularly in the Engineering

cadre was going on and it is still continuing.

REASONS BEHIND THE DEMAND FOR IMPLEMENTATIONOF “ASSURED CAREER PROGRESSION SCHEME (ACPS)WITH NEW DESIGNATION” WITH EFFECT FROM

01.04.2009.

1. There is an acute stagnat ion that exists

particularly in the Engineering cadre in the post

of Superintending Engineer.

2. Where Engineers are the main backbone of the

company’s business in power sector,

nontechnical officers in HR&A cadre and F&A

cadre are getting quicker promotion. The situation

as was existing in the erstwhile WBSEB regime

is still continuing at the present.

3. At present when Engineers are getting promotion

(as per policy, one third of the interviewers only

get promotion through interview system) to the

post of Additional Chief Engineer from the post

of Superintending Engineer after completion of

total 28/29 years of service, on the other hand

officers from HR&A cadre and F&A cadre are

getting the equivalent rank after completion of 18/

19 years of total service. That means non-

technical officers are getting the equivalent post

of Additional Chief Engineer at least 10 (Ten)

years earlier than the Engineers which is an

unfortunate stigma of this glorious organisation

lasting for the long time. It is seen from the very

beginning that the pivotal role of the Engineering

Service was not given due cognizance while

deciding the career progression scheme.

4. Even after the bifurcation of WBSEB in to two

companies namely WBSEDCL and WBSETCL,

still there exists the glaring disparities between

the career value of Engineer officers and the non-

technical officers which are very much frustrating

and demoralizing to the senior management level

Engineers.

5. We have worked out our position in the post of

Superintending Engineer i.e. total length of

services, no. of Engineers stagnated in this post

and from the table below it can be seen how the

acute stagnation is there in the Engineering cadre :

6. The above Stagnation of Engineers is due to

wrong HR Policy of the organisation as well as

thinking of wrong concept while implementing

Promotional/Career progression Policy. We have

thoroughly examined the HR Policies and

promotional policies adopted in other leading

power utilities in India like POWERGRID, BHEL,

NTPC, DVC, NHPC etc. and the organisation

wise pictures showing the Pay Band/Pay Scale,

Grade Pay, Designation of Engineers/Executives

in each Pay Band/Pay Scale and Eligibility years

for promotion in each post. Side by side our

system of pay structures and promotional criteria

including CPS has also been shown.

— From the above tables it is seen that there are 8 (eight) stages of grade i.e. promotional post from

Assistant Engineer to Chief Engineer or equivalent level post with different Pay Scale/Pay Band in

POWERGRID, NHPC & DVC. Similarly there are 9(nine) stages of grade i.e. promotional post from Assistant

Engineer to Chief Engineer or equivalent level post with different Pay Scale/Pay Band in BHEL and 10

(Ten) stages of grade i.e. promotional post from Assistant Engineer to Chief Engineer or equivalent level

post with different Pay Scale/Pay Band in NTPC. Whereas in WBSEDCL there are only 5 (Five) stages of

grade i.e. promotional post from Assistant Engineer to Chief Engineer or equivalent level post with different

Pay Scale/Pay Band. That means, compared to other leading power utilities in India, WBSEDCL are having

short of 3 (Three) to 5 (Five) stages of 5 promotional post which is obviously the main reason for inviting

suffocating condition in the total promotional system and has created acute stagnation, particularly in

Graduate engineering cadre.

OUR PROPOSAL:

To get rid of this suffocating condition of acute stagnation particularly for the Graduated Engineers of

this organisation. We, the West Bengal State Electricity Board Engineers Association proposes the

following modification of the present promotional Policy/Career Progression Scheme as a immediate

solution of the problem subject to formulation of detailed “Time Bound Career Management Policy’’ for

the Engineers/Executives of this organisation for kind consideration of the management of WBSEDCL/

WBSETCL.

Method of Promotion and Qualifying Marks :

For getting promotion of class-l Engineer at

regular intervals under Assured Career ProgressionScheme (ACPS), the following principles shall have

to be drawn up:

1. Performance Appraisal Report (PAR): Max. 30marks (Av. of last three years. For A - 10 marks,

B-08 marks, C-06 marks, D-0 mark).

2. Qualification : 20 marks {Induction level

qualification - 20 marks, one level below - 10

marks & two levels below - 05 marks).

3. Experience i.e. Eligibility Years: 15 marks (Min.)

for completion of min. eligibility years. 02 (two)

marks for extra year of service.

4. Attendance : 15 marks ( Record average 70%

attendance during last 03 (three) years)

5. Field/Site Experience: 10 marks {Min. 03 years

experience in field/site posting for promotion up

to the post of SE and Min. 05 years experience

in field/site posting for promotion above SE post,

except in cases of specialized/expertise to be

predefined which are required to meet the

organization needs).

6. Suitability Test : 10 marks

l Qualifying marks for promotion: 60 marks.

l Selection shall be Seniority cum Merit Basis.

l Pay protection of Senior Employees than his

junior counterpart shall be strictly maintained.

Stagnation Promotion: promotion from Sr. Dy. CE

level post to Addl.CE post & beyond, candidate who

i) Have spent 02 (two) years more than the normal

It is proposed that under Modified Assured Career

Progression Scheme (ACPS), a Graduate Engineer

(Assistant Engineer) being inducted in the Pay band

of 15600-39100 in PB 4 with Grade Pay of Rs.5400/-

shall be entitled to get promotion in the next rank of

Divisional Engineer after completion of 8 (eight) years

continuous service and will be allowed in pay band of

15600-39100 with Grade Pay of Rs. 6600/-.

A Divisional Engineer, shall be entitled to get

promotion in the next rank of Superintending Engineer

after completion of total 13 years of continuous service

and will be allowed in the pay band of 15600-39100 in

PB 4 with Grade Pay of Rs. 7600/-.

A Superintending Engineer, shall be entitled to get

promotion in the next rank of Deputy Chief Engineer

after completion of total 17 (seventeen) years of

continuous service and will be allowed in the Pay Band

(PB-5) of 37400-67000 with Grade Pay of Rs. 8600/-.

A Deputy Chief Engineer, shall be entitled to get

promotion in the next rank of Senior Deputy Chief

Engineer after completion of total 19 (nineteen) years

of continuous service subject to 2 (two) years

continuous service in the Deputy Chief Engineer level

post and will be allowed in the Pay Band (PB- 5) of

37400-67000 with Grade Pay of Rs. 8700/-.

To give due weightage, it is proposed to allow a

special pay of Rs 150/- in the grade pay of Additional

Chief Engineer in Pay Band (PB) 5 i.e. Rs. 8700/- plus

Rs. 150/- (Special pay).

The date of effect of Assured Career Progression

Scheme (ACPS) for promotion up to and including

Superintending Engineer level shall be from 1/1/06 i.e.

as per ROPA 2009. And the date of effect for promotion

under modified Assured Career Progression Scheme

from Superintending Engineer to senior Dy. Chief

Engineer shall be from 1/6/09.

Promotion of Engineers shall be extended up to

Executive Director level and selection shall be made

from the in-house Chief Engineers.

OTHER BENEFITS TO BE EXTENDED TO THE DY.

CHIEF ENGINEER

Company vehicle shall be provided to all Deputy

Chief Engineer on chargeable basis as extended in

case of Additional Chief Engineer, for official journey

to and from residence.

Mobile/telephone etc facilities as provided to the

Additional Chief Engineers shall be extended to all

Deputy Chief Engineers, The same facilities shall also

to be extended to all Class-l Engineers.

Proper sitting arrangements with all sorts of

infrastructural facilities as extended to the Additional

Chief Engineers shall also to be provided to all Deputy

Chief Engineers.

CONCLUSION

With the untiring effort of the Engineers in particularand the employees of the organisation, both WBSEDCL& WBSETCL have achieved progressively substantialprofit and also trying to provide quality services, whichis an unique and excellent example of character anddetermination in the INDIAN POWER SECTOR. Afterunbundling of erstwhile WBSEB and enforcement ofElectricity Act 2003, WBSEDCL and WBSETCL hadformed. M/S PWC was appointed as Consultant forrestructuring of the organisation. One of the keyconsiderations in the re-design of the organisation wasto encourage performance driven culture & motivationamong the employees. But PWC was silent on thisissue while recommending their suggestions forrestructuring which is very much unfortunate. Thoughthey took many references from the other leading powerutilities in India while designing the organisationstructure and policies for introduction in ourorganisation, but astonishingly, were silent regardingCareer progress of the Employees of this organisation.However, the Engineers of this organisation took thechallenges to cope up with the reform in spite of manyodds and rendered their best. For which WBSEDCL

has got the 4th. India Energy Summit Award’2010 and

India-Tech Excellence Award’2010. WBSETCL also got

best Transmission System Availability Award with Gold

Shield for the year 2007-08 from ministry of Power, Govt.

of India and Power Line Award’ 2012 for Best Performance

in Transmission in India. Still Engineers are trying theirbest to take new challenges in the present complexmarket in the power business adopting newtechnologies to give quality power and services to theirconsumers. We have seen that the presentmanagement is also thinking to bring innovative ideasand allowing new technology in the organisation forsurvival in this present competitive market and isrethinking of some changes in respect of organisationstructures, manpower planning and policies toeradicate all existing lacunas in the system as pointedout be WBSEBEA time to time. We also hope that thepresent management will give due cognizance of ourlegitimate demand, examining the service condition ofthe engineers in the other similar organisation and willdefinitely resolve our long pending stagnation issuesby way of immediate implementation of MODIFIED

PROMOTIONAL POLICY & ASSURED CAREER

PROGRESSION SCHEME (ACPS) as proposed by us forassured career growth of engineers and maintaining atransparent promotion policy for upholding the dignity ofengineers and to get rid of the suffocating condition ofacute stagnation of senior level Engineers for sustainableimprovement of this organisation which may improve

Observations on the draft WBSEDCL Employees’

Service Regulations Medical and LTC Regulations

General observations: The words “generally”,

“ordinarily”, “competent authority”, “appropriate

authority” are words which have the propensity to

invite disputes and misinterpretation. Hence, those

terms may have to be fully clarified.

Specific Observations:

1) Refer Chapter I, clause 2

Observation: Whether the contents as appearing

would br ing into coverage, the employees

subsequently absorbed e.g. Ex-employees of

WBREDC, Singur-Haripal Co-Operative Society. The

issue relating to coverage would also arise in case

of future absorptions.

2) Refer Chapter I, clause 5

The sentence as appearing “If the company is

satisfied..............................”.

Observation : The sentence appears to be

vague, as who would constitute as the company is

not at all clear. Moreover, page 2, Clause-6; chapter

1 of existing ESR had conferred the powers to ‘Board’

only, which in the current context would be ‘Board

of Directors’.

3) Refer Chapter I, clause 10.1

The Contents : The first sentence “......................

except incase of Career Progression Scheme (CPS),

i f not ment ioned otherwise special ly in the

appointment/promotion order, subject to extension

depending upon the performance of the employee

concerned”.

Observation :

a) Whether promotion be termed as appointment?

b) “If not mentioned otherwise specially in the

appointment/promotion order” is a content which

is subject to dispute and misinterpretation.

Hence, the contents that would be mentioned in

the “appointment/promotion order” require full

disclosure to avoid any future action based on

discretion.

4) Refer Chapter II

Observation :

a) The definition of ‘Board of Directors’ is missing.

b) ‘Officiate’ has not been included in the definition.

c) ‘Presumptive pay of a post’ has not been included

in the definition.

d) ’Leave on Average (or half average) pay has not

been included in the definition.

5) Refer Chapter II, clause 12.3

The insertion of the words “registered under the

Companies Act, 1956” appears to be unnecessary

to define the company.

6) Refer Chapter II, clause 12.10

Observation : That “Service as a probationer

provided that such service is followed by confirmation.”

is not covered in the relevant clause relating to Duty.

This implies that service as a probationer would not

be counted as a Duty. Further, notes to Duty as

appearing in the existing ESR is also missing.

7) Refer Chapter II, clause 12.11

Observation : In the definition of Employee ‘part

time employees’ should also be excluded.

8) Refer Chapter II, clause 12.12

Observation :

a) “Step children”, “Legitimate Children”, “Adopted

Children” should have been used to ensure

completeness.

b) The word ‘generally’ appearing before ‘residing’

as earlier stated is a confusing word and has the

likelihood to invite disputes.

c) The definition of the word ‘Son’ is observed to be

different for the purpose of death gratuity and

medical, LTC purpose?

d) The contents appearing under clause 12.12, sub

para IV A and as appearing under para 8 under

“Rules on Leave Travel Concession/Home Travel

Concession” deals with similar object but are

conflicting to each other.

Existing regulations in this context stipulates that

Leave Travel Concession is admissible to the

spouse of an employee working in other

organization not having similar benefit. On the

contrary, this proposed framework contemplates to

bring spouses under coverage entitled to receive

such benefit but opting not to avail such benefit.

e) The proposed draft to bring sons upto the age of

25 years under the coverage of medical and

Leave Travel concession provided the son is a

student of a regular course appears to have the

likelihood to invite disputes. The matter relating

to regular course appears to be not tenable if

compared with the regulat ions of best

organisations. Hence the dispute area relating to

“regular course” should be deleted.

9) Refer Chapter II, clause 12.15

Observation : The definition of ‘Head Quarter’

as proposed by stating ‘or otherwise specified by an

administrative order’ will open the doors to use

discretion and/or interpretation. There is a clear

guideline as to what would constitute to ‘Head

Quarter’ in ROPA.

10) Refer Chapter II, clause 12.16

Observation : The definition as proposed is in

conflict as defined in “Schedule of Delegation of

Power”.

11) Refer Chapter II, clause 12.17

Observation :

a) “............................for the transaction of the

business” is incomplete in the context as to whose

business stands not specified.

b) “All Sundays are generally considered.........” is

again unspecific as the word ‘generally’ does not

convey any specif ic meaning. In fact, the

proposed insertion is not at all required.

12) Refer Chapter II, clause 12.25

Observation : “Remuneration” appears to be not

a befitting term in context of the contents covered.

The apt word appears to be “Pay”.

13) Refer Chapter II, clause 12.29

Observation : The sub clause “unhealthiness of

the locality in which the work is performed" as

appearing in the existing stands omitted.

14) Refer Chapter II, clause 12.31

Observation : The reason for use of ‘Subsistence

allowance’ instead of ‘Subsistence grant’ is not

understood.

15) Refer Chapter III, clause 14.3

Observation : The sub clause (3) has been

referred under the same clause, which cannot

happen in reality.

Observation : The said clause cannot be

accepted.

14) Refer Chapter III, clause 16

Observation : Who would constitute as ‘the

Chairman’ needs to be defined. Moreover, it would

not be rationale to confer such power on a sole

authority. The appropriate authority would have to

be the ‘Board Of Directors’.

15) Refer Chapter III, clause 17.1, Note 3

Observation : Who can be referred to as

‘appointing authority’ is not understood being not

defined in the chapter under definition.

16) Refer Chapter III clause 19

Observation : Refer the word ‘employment’. The

use of such word has made the contents unclear.

The correct word would be ‘employee’.

17) Refer Chapter III, clause 22

Observation : The proposed contents appear to

be incomplete and hence may have to be aligned

with the contents as appearing at clause 26, chapter

III of existing regulations.

18) Refer Chapter III, clause 29

Observation : That “if he remains absent from

duty, on leave or otherwise, for a continuous period

exceeding 2 years” needs to be inserted.

19) Refer Chapter III clause 30.1

Observation : May refer “20”.May review whether

it would be ’20 years’.

Observation :

a) The heading portion of the clause has been

proposed for a change to “Superannuation”. The

existing description of this clause is “Compulsory

Retirement”. The proposed change is not a

welcome change as the word “Compulsorily” has

been used in this clause and in later chapter the

reference with Punishment Regulations. Hence

the similarity of words and the proposed change

has the high propensity of the usage of discretion

and misinterpretation. Hence, “Compulsory

Retirement” as a description of this clause may

be retained.

however, be made with the approval of the

Chairman of the Company' cannot be acceded

to and hence requires to be deleted.

Observation : “by the Company from time to

Observation: Who can be referred to as

‘competent authority’? The use of ‘competent

author i ty ’ is ambiguous and portrays non-

transparency.

Observation : ‘controlling officer’ as appearing

may have to be replaced by ‘appointing authority’.

Observation : The contents as appearing in the

said clause are not all tenable and hence require an

out and out review.

Moreover, it would be unjust to head General

Manager (HR&A) a committee who would also

address the grievances of officers of equivalent

rank. Hence, Director (HR) should preferably

head the committee.

28) Refer Chapter IV, clause 50

Observation : Only prior sanction has been

specified whereas in the regulations of GOWB, there

are scopes for post sanction on certain activities with

KMDA, WB Housing Board and etc.

29) Refer Chapter IV, clause 50.1

Observation :

a) The declaration of asset should be extended to

all employees.

b) In line with (a) above, consequently, 'However,

in special, case...................’ would stand deleted.

30) Refer Chapter IV, clause 51

Observation : It could not be understood as to

how transactions in Shares, Debentures, Securities

or Mutual Funds for more than Rs. 100000 and Rs.

50000 in relation to Class I, II and Class III, IV

employees respectively during a calendar year would

fall under speculation. The question arises that would

transactions in Futures, Options, Commodities,

hedge funds and OTCEI dealings would not be

termed as ‘speculative transactions’. Will going short

and long not constitute to ‘speculative transactions’.

What would constitute to ‘Securities’ needs clear

outlay. It is further added that the explanation to the

clause contradicts the contents.

31) Refer Chapter IV, clauses 52 & 53

Observation : The clause should preferably cover

the mutual trust and respect between superior and

subordinates and accordingly clause 56 (g) also

requires review.

32) Refer Chapter IV, clause 56(s),(j),(q),(x),(ad)

Observation :

a) Clause 56(g): Besides insubordination, act of

disrespect by a superior to a subordinate needs

to be brought under coverage.

b) Clause 56(j): The use of ‘ intel lectual

property............................Company’ appears to

be unnecessary.

c) Clause 56(q): Harassment to “Working man”

needs to be brought under the coverage.

d) Clause 56(x): The use of words “safety

standards” requires review as perhaps the

company is yet to form any safety standard. It is

further added that safety guidelines and safety

standards are different.

e) Clause 56(ad): The ‘IT Laws’ as used in the

clause would not refer to any relevant law in force

and hence requires to be correctly dealt with.

33) Refer Chapter IV, clause 57

Observation :

a) ‘Compulsory retirement or compulsorily retired’

wherever appearing in the clause requires to be

deleted as observed earlier.

b) What would constitute as the “terminal dues” as

appearing at clause 57(f) requires clarity since

sum at the credit of Provident Fund at the time of

retirement cannot be attached for the purpose of

recovery.

c) ‘Forfeiture of Gratuity ‘as proposed cannot be

made applicable to the employees covered under

Payment of Gratuity Act, 1972, hence the

stipulation would become redundant for the said

employees. Moreover, i t is unjust to keep

provision for forfeiture of gratuity those are covered

under DCRB Regulations as the proposed action

intends to have a discriminating effect.

d) Contents appearing under sub clauses (i) and (j)

requires clarity with explanation.

34) Refer Chapter IV, clause 59

Observation :

a)”Officers appointed on contract basis “as appearing

in sub clause (b) should preferably be deleted.

b) “More than 3" as appearing in sub clause (c)

should preferably be deleted.

c) “Prior permission of the competent authority” as

appearing in note 1 to sub clause ( c) is not clear

and hence should preferably be deleted.

Observation :

a) The contents covered under suspension requires

review on the rationale that an employee alleged

should preferably be excluded from the coverage

as allegations can be backed by malafide

intentions with a view to harass.

carried out.

14/0357 dt. 11/06/2013.

Sir,

We, the West Bengal State Electricity Board

Engineers’ Association, would like to put forward our

view on some points related to the above notification.

As per the provision 15.0 of the notification no. 46/

WBERC dt. 31/05/2010, there is provision for

compensation for non- compliance of Standard of

Performance. There, it is mentioned ‘If a licensee

fails to meet the standard as specified against

various service areas laid down in this regulations,

he shall be liable to pay in addition to any other

penalty which the licensee is liable to pay in terms

of the act or other regulations a compensation to

the affected person as specified below.....’

Although in its heading, it has been mentioned

that ‘Determination of compensation.................’

apparently there is no methodology of calculation of

the rate of compensation for non-compliance of

Standard of Performance in various field. Practically

calculation of compensation in such cases can never

be realistic assignment as there is no specific

determinant in this regard. It is also seen that the

amount has no relation even with the per day

consumption of the consumer. As a result the same

is being grossly misused by different persons with

vested interest. Moreover, we do believe that there

must be some logic in favour of the amount of

compensat ion. So, we propose that this

compensation should be in proportion with the same

exists in other states like Bihar, Gujarat, Mumbai,

Punjab, Nagaland, Orissa and in view of that we are

placing our proposal for the rate of compensation

as follow :

a) ‘Failure to comply with the time period as

specified in regulations 3.0, 4.0, 5.0, 6.0, 7.0 and

12.0 of these regulations the compensation will

be at the rate of Rs. 500/- for each additional day

of delay or part thereof.’............existing

Proposed- Rate should be Rs. 50/- per day with

maximum limit will Rs. 5000/- which to be adjusted

with monthly energy bill. The claim to be made

within one month from the date of connection.

b) ‘Failure to comply with any other standard of

performance as specified in regulations 9.0, 10.0

and 11.0, in this regulations except for wrongful

disconnection and delay in reconnection - at the

rate of Rs. 500/- for each additional day / slab of

time or part thereof, as the case may be,

In all the cases claim to be made within one

month from the date of declaration by appropriate

authority that the disconnection in question is

unlawful.

Moreover, it is seen in the ‘Draft West Bengal

Electricity Regularity Commission (Installation and

operation of Consumers’ meter)’ that the Commission

has suggested some guide lines related to the

sealing of meter (7.0) and type of meter the licensee

will use(4.4.3). In this case our suggestion is that

the licensees should have the liberty which seals or

which meters they will use, depending upon the

design of the meter and demography of the area

where the meter will be used. The commission can

suggest the accuracy class of the meter only. In case

of seals, the onus is on the licensees to prove any

theft case in the court of law. So, it should have the

liberty to use seal of its choice. In fact at present,

the design of the meter itself has taken care of

recording the event of ‘Cover Open’ of the meter

which was previously detected by checking of seals.

This has made the use of meter’s body seals as

redundant.

We are ready to discuss all the point mentioned

above and we hope that you will kindly consider our

proposal for the interest of WBSEDCL as well as for

those who are real suffers.

Dear Sir,

We, the WBSEBEA, had demanded for proper clarifications of the different aspect as regards arrangements

of funds for payments of Staff terminal benefit on absorption to WBSETCL, transfer of CP fund and GP fund from

WBSEDCL to WBSETCL, introduction of employees service regulation (ESR) in WBSETCL, medical insurance

benefit to all future retired employees of WBSETCL etc. before exercising the option for better clarity for the

future opted employees. It was also pointed out that as the matter is serious in nature which involves proper

arrangements with regards to “Staff Terminal Benefits”, “Transfer of personnel” etc. in accordance with Kolkata

Gazette vide Notification No. 12-PO/O/III/3R-29/2006, dated 25.01.2007, we demanded that for transparency, a

bipartite agreement between WBSEDCL and WBSETCL authorities, duly approved / authenticated by Govt. of

W.B. is essential. But the same has not yet been finalized.

Of late, CMD: WBSEDCL had called one meeting on 15.05.2013 at conference hall at Vidyut Bhavan

taking all the recognized Unions and Associations regarding issues related to repatriation. After going

through the MOM of the said meeting, circulated under the signature of the CMD: WBSEDCL vide memo.

no.CHR/675/13/131 dated 31.05.2013, it has been surprisingly noticed that our point wise deliberations,

explanations on the different clauses of the Gazette Notification vis-a-vis our suggestions given in the said

meeting has not been recorded properly.

However, the matter has been discussed amongst us i.r.o. the record notes of minutes as circulated by

CMD:WBSEDCL on 31.05.2013 and as per the decision of that meeting, we are going to submit one letter

to him on behalf of WBSEBEA explaining our stand regarding issues related to repatriation.

In the above context, we, on behalf of WBSEBEA would like to request you to kindly extend, the last date for

exercising option from 30.06.2013 to a suitable date so that, before the last date for exercising option, all the

dispute, doubt, differences or issue which have been arisen, can be solved with the involvement of the Govt. of

W.B. in line with cl. no. 10(1) of the above mentioned Gazette notification. It may also be mentioned here that,

few days back, when we, on behalf of WBSEBEA met with you for discussion on different issues including

repatriation, you have assured that there will not be any problem for extension of last date for exercising the

option. So kindly issue one circular immediately on this issue with extension of time for exercising option.

at Vidyut Bhavan regarding repatriation issues

in presence of Official/Representatives of

recognized Unions & Associat ions and

circulated vide Memo No. CHR/675/13/131

dated 31.05.2013 of the CMD: WBSEDCL.

Dear Sir,

We have gone through the above subject MOM,

circulated under the signature as referred above and

which was received at this end on 01.06.2013. First

of all, we are extremely amazed to find out that the

proceedings as drawn in the said minutes does not

f ind place, the material contents which were

del iberated on behalf of WBSEB Engineers’

Association in the said meeting. If, it can be

recapitulated correctly, on that day several pertinent

and relevant aspects according to the Gazette

Notification No. 12PO/0/111/3R-29/2006 dt. 25.01.2007

was pointed out by our Association which, are

inherently linked to this vital issue of repatriation.

But the outcome of the proceedings in form of

the MOM appears to be an abbreviated version which

only touches up on the issues on a very general

manner, not to mention that the material issues

remain uncovered.

The WBSEBEA, a recognized and responsible

association, are proud of their engineers and the

employees of both WBSEDCL & WBSETCL for their

untiring effort for achieving progressively substantial

profit and improvement of quality of services, cannot

keep silent on this issue and always eager to sort

out all lacunas and to see all the interest and right

of the employees of the company, particularly for our

engineers member. So, what we have said before in

different occasion to the CMD; WBSEDCL and the

MD: WBSETCL both verbally and in writing and also

hereby attempt to recapitulate the entire issues which

were pointed by us in the said meeting with the

expectation that those issues are taken into

consideration while finalizing or taking the next steps

towards the repatriation.

We made our submission in the said meeting in

the following manner :

l The option for rendering future services in

WBSETCL should be extended to al l the

employees who were in the payrolls of the

erstwhile WBSEB”. This was pointed out on the

rationale that option limited to few employees as

has been announced portrays unequal

opportunity. Further, there is every possibility to

get insufficient response, if option is restricted to

only deputed personnel of WBSETCL which may

in turn result to a situation where WBSETCL will

only not have less than the required personnel

but also shortage of experienced personnel. This

again will pave way for induction by way of lateral

entry. Hence, it was pointed out to review this

aspect in a thorough manner.

l The contents of the clause 5(3) of the Gazette

Notification No. 12PO/0/111/3R-29/2006 dt.

25.01.2007 was requested by us for reference

wherein it stood stipulated “on such transfer and

subject to the provisions of the said Act and

provisions of this Scheme, the personnel shall

for a part of the services of WBSEDCL and their

rank, scale of pay and inter-seniority as existing

in WBSEB on the effective date of transfer shall

be maintained”. The said clause was requested

for reference as the clause has been deviated

subsequently by both WBSEDCL and WBSETCL

while inducting employees at higher positions by

way of lateral entry. The induction of employees

by way of lateral entry has entirely disrupted the

essence and the spirit of the clause 5(3]. Now,

we feel that it is the onus of the authority of the

WBSEDCL to uphold the stipulation as contained

in the said clause by inducting restoration

measures to all concerned who were employees

of erstwhile WBSEB.

l The contents of the clause 5(5)(a) of the Gazette

Notification No. 12PO/0/111/3R-29/2006 dt.

25.01.2007 was requested by us for reference

wherein it stood stipulated “that the terms and

conditions of service applicable to the personnel

on the effective date of transfer shall not, in any

way, be less favorable than those applicable to

them immediately before the said effective date

of transfer”.

We have requested to refer this clause on the

rationale that WBSEDCL inducted a Deputy

Company Secretary which is equivalent position

of Superintending Engineer and three AGMs

(F&A) which are equivalent position of Addl Chief

Engineer at a subsequent date and extended

privilege and out of turn exemptions from the

stipulated rules and regulations in force in

WBSEDCL. The recruitment of AGMs (F&A) and

Head IT are in out and out violation to the clause

20(d) of the ROPA, 2009. The clause 20(d) only

permits to induct in the rank of ACE/AGM in absence

of sufficient no adequately qualified and

experienced personnel. It can not be easily verified

that those personnel have any exceptional

qualification nor have higher level of experience.

a) WBSEDCL has inducted three AGMs (F&A)

relaxing the experience criteria. The number of

years experience as has been set out for those

AGMs (F&A) where 15 years without the mention

of post qualification experience and the relevant

industry experience. WBSEDCL for its own

employees have set out to have 19 years of

experience in this company for eligibility for

consideration for the post of AGM (F&A) and that

too with the restriction that the number of eligible

candidates for the post of AGM (F&A) cannot be

more than 3 times the number of vacancy.

b) Simi lar ly, the Deputy Company Secretary

appointed in the rank of Senior Manager/

Superintending Engineer had worked less than

16 years prior to joining this company. Moreover,

her experience has been in a different discipline.

Further, she has been awarded with higher basic

pay of Rs.35000 which any inductee class-I officer

in WBSEDCL never reaches to that basic pay

after having worked for continuously 16 years.

Besides she has been privileged with facilities

beyond entitlements of an officer in the rank

equivalent to Superintending Engineer/Senior

Manager. Her extra facilities are exclusive mobile

phone usage reimbursement, residential landline

phone reimbursement and company’s vehicle for

commuting from residence to office and back. The

clause 20(a) of ROPA, 2009 may be referred which

will reveal that recruitment of Deputy Company

Secretary is in contravention to the set out

guidelines. (Appointment order copy enclosed)

c) Another glaring example of such contravention

is appointment of Head of IT by WBSETCL

authority. The head of IT neither possesses

extraordinary qualification nor has extraordinary

exposure/experience. Surprisingly, her initial

basic pay at the t ime of jo ining was Rs.

47,000.00.The pay band in which she has joined

starts with Rs. 37,400.00. It is diff icult to

corroborate as to under which rationale her pay

was fixed in such a manner, in this context, it is

very easy to arrive at a conclusion that she has

been privileged in a very exceptional manner.

Hence, it would be imperative for the WBSEDCL

authority to have a relook upon the irregularities

and take steps to set right by extending similar

privileges to all concerned.

l We had also pointed out the stipulation as set

out in clause 5(5) (d) on the unresolved demands

of the unions and associations. Those demands

stand as follows:-

a) Full pension on completion of 20 years of service

in line with the regulations as prevailing in Central

Government/State Government

b) Extension of similar benefits to all the employees

joining WBSEDCL on or after 16.02.2009 as

granted to Director (R&T). Those benefits which

we referred were extension of benef i t as

contained in DCRB Regulations of WBSEDCL.

The Director (R&T) was appointed in WBSEDCL

vide o/o No. WBSEDCL/MR/2010/181 dt .

18.08.10 but surprisingly his date of joining in the

said office order stood mentioned as 30.01.2009.

It is very difficult to understand that whether

WBSEDCL authority barring this appointment has

issued any appointment letter to any employee after

joining and working in WBSEDCL for more than one

and half years. The move resulted to grant of

privilege by bringing him under the coverage of

DCRB Regulations. Hence to restore parity it would

not be very unjustified if we demand to extend the

same benefits to others also. (Appointment order

copy enclosed)

c) Similarly, we are also not clear about the sentence

as recorded in the MOM against sl. no. 4 (b) that

“Individual employees will apply accordingly for

further action by the authorities of both the

companies.” i.r.o. transfer of CP fund and its

withdrawal by the employees. For more clarity and

to avoid any complicacy it is suggested that the

employees of WBSEDCL who are in CP Fund (no.

is negligible compared to the total strength) should

be given an opportunity to opt for GP Fund as

WBSETCL provident fund is un-exempt.

d) Reviewing the promotion policy.

e) Deleting the intense coverage in the promotion

policy 2010 and ROPA 2009 on the subject

covering Fast Tract Promotion and Lateral Entry.

l The contents of the clause 5(5)(6) was also

brought to the notice which stipulates “The

arrangements with regard to Staff Terminal

Benefits including provident fund, gratuity fund,

pension fund .......”. Our concern in this context

was whether both WBSEDCL and WBSETCL has

conformed to the stipulation as set out in the

clause 5(5)(6).The concern expressed was

backed by the fact that 8.50 percent BOND

amounting to Rs. 1800 crore (Rs. 1530 crore for

WBSEDCL employees and Rs. 270 crore for

employees of WBSETCL) was issued to meet up

the pension liability of employees and that the

said Gazette Notification stipulates towards

redemption of such BONDS in 5 equal installments

commencing from the year 2016, but till date we

are not aware as to whether both the authorities

have initiated any measures towards such

redemption. Our concern was also’ guided upon the

requisite provisioning in stepped manner towards

ensuring the stipulated redemption.

l Our concern was also expressed as we had

discovered that there is a serious asset -liability

mismatch of the pension fund. Total liability under

the pension fund account is Rs. 5637 crore [Rs.

5346 crore- WBSEDCL and Rs.291 crore-

WBSETCL) as per latest available records

whereas the total asset in the said fund is Rs.

4008 crore. Hence, it is clearly evitable that the

assets fall short by Rs. 1629 crore which has to

be make good by the authority of WBSEDCL. If

we consider the other payables by WBSEDCL to

the said fund the same tantamount to Rs. 2863

crore. You should surely appreciate that our

concern is backed by genuine reasons.

l The total liability under Gratuity Fund Account is

Rs. 605 crore whereas the total asset is only

221.00 crore which clearly reveals that the assets

are insufficient by Rs. 384 crore to match the

l iabi l i ty. We ser iously at tempted to have

knowledge on the contemplation of the authority

of WBSEDCL towards liquidating the mismatch.

l It was also felt to point out an issue in context to

terminal benefit cost which stood accepted by

WBERC. An amount of Rs. 455 crore has been

allowed in tariff by WBERC accepting the terminal

benefit cost of employees’ of WBSEDCL, but

even after elapse of substantial period of time

the same is yet to be transferred to the trustee

boards of the respective trust funds.

l We thereafter raised some issues on the areas

pertaining to WBSETCL. We had brought to the

notice that any amount or sum can be transferred

from an approved trust fund to only another

approved trust fund. This was pointed out on the

perspective that the amount that stood transferred

to WBSETCL’s trust fund is an unapproved trust

fund as the WBSETCL authority is yet to obtain

the approval from RPF authority in respect of CPF

trust fund as an exempted trust fund under EPF

and MP Act, 1952.

l From the MOM it is seen that the CMD,

WBSEDCL has expressed his views & clarified

his position for transfer of funds i.r.o. terminal

benefit to the employees on absorption in

WBSETCL, Inter-se-seniority issue, transfer of

GP fund & CP fund etc., but there is no line in

the said MOM regarding any views given by the

WBSETCL authorities how they will guarantee all

such benefits to their future employees to be

absorbed in WBSETCL from WBSEDCL. So, we

think that before going to further, s igned

Agreement/MOU between two companies, duly

approved/authenticated by Govt. of West Bengal

regarding phase wise transfer of Funds pertaining

to the different components of terminal benefits

liabilities as per the Gazette notification and other

aspect of the service condit ion is utmost

important.

l Optee employees should know their service

condition in their future company along with some

other aspects like recruitment policy, welfare

policy, fund management, medical insurance

benefit of retired employees of WBSEDCL to be

absorbed in WBSETCL etc. But till date no ESR

[Employees Service Regulation) of WBSETCL

has been published. This should be published

before the last date of exercising option.

We reiterate that the issues as pointed out which

did not Find a place in the said MOM are extremely

important, relevant, pertinent and vital issues. In the

event, those issues are not addressed then it would

be an act of inequity and disparity towards reliable

and committed workforce.

We feel that both the employers WBSEDCL and

WBSETCL may have to act rationally placing the

interest of the employees’ at priority and without

compromising to the futures of the workforce and

displaying natural justice, restoring equal opportunity

to all concerned. Lastly it may not be out of place to

mention that a strict adherence to the Gazette

Notification is always expected from responsible

organizations like WBSEDCL and WBSETCL. So,

we on behalf of WBSEB Engineers' Association

would like to request you to have a relook upon the

issues pointed out and unless resolved, proceeding

towards repatriation appears not to be a sensible

approach.

5. During the period of probation, the appointment may be liable to termination or one month’s notice

from either side or on payment of one month’s pay (including DA) in Iieu thereof.

6. She, will have to serve the Company for a minimum period of 3 years after completion of the Probation

period. If she fails to serve the Company for such period or leaves the Company during the Probation

period or during the aforesaid period of 3 years after completion of probation period, she will be required

to pay a sum of Rs.50,000/- [Rupees, fifty thousand] only, to the Company, apart from serving one

month’s or three month’s notice, as will be applicable on the date of resignation, or on payment of pay

[including DA] equivalent to the shortfall of notice period. On the date of joining, she is required to

execute a Bond and Agreement in favour of WBSEDCL for an amount of Rs. 50,000/- in prescribed

proforma (enclosed), in non judicial stamp paper of Rs. 100/- each for the purpose so stated.

7a) She shall be required to furnish necessary declaration of Nationality in the prescribed form (as enclosed)

at the time of joining.

7b) She shall also be required to furnish a family declaration with details of relations in the prescribed form

[as enclosed] at the time of joining.

7c) She shall; be required to furnish necessary declaration regarding age in the prescribed form (as

enclosed) duly supported by certificate issued by the appropriate authority at the level of Secondary

Examination, at the time of joining. Declaration of age once made and accepted shall be binding and

shall not be revoked subsequently for any reason whatsoever.

8. Confirmation in service under the regular establishment of the WBSEDCL in the above post shall be

considered on fulfillment of the requisite formalities i.e. receipt of satisfactory Police Verification Report

of Certificate and Antecedents, Medical fitness Certificate and satisfactory completion of Probation

Period. Verification Rolls in duplicate (as enclosed) need be produced duly filled In and signed before

or at the time of joining. If the report of the Police Authority is found adverse, the appointment shall be

cancelled/terminated forthwith, at any stage, without any correspondence.

9. She shall be liable to be transferred in the interest of work of the Company to any of the Offices,

Establishments, Departments, Projects of the Company.

10. She should note that the appointment shall be cancelled or the service shall be terminated at any

stage, if it is detected that the information furnished and/or document(s) submitted is/are false/

incomplete/invalid.

5. His service will be guided by the rules and regulations of WBSEB Employees’ Service Regulations

FAST TRACK PROMOTION

Sir,

With reference to the above subject and draft Circular on Fast Track Promotion as issued to us vide

memo no.: MR/ESTB/1494 dated 24.06.2013, we request you kindly refer our earlier communications

submitted on different occasion where lot of points have been recorded regarding above issue.

During the last few years, we have been observing that authorities of both WBSEDCL & WBSETCL has

intended into activities which are either flouting to its own laid out rules and regulations or in violation to the

Gazette Notification No. 12PO/0/111/3R-29/2006 dated- 25.01.2007 and our association have already

communicated the same vide Memo No.: WBSEBEA/Admin/2013-14/14 dated 26/06/2013.

But it is a matter of great concern that the authorities of both WBSEDCL & WBSETCL have, perhaps, become

directionless into their activities which are not in the best interest of workforces of both the company at large.

Whereas, we had requested earlier to the authorities of WBSEDCL & WBSETCL vide Memo no.-

WBSEBEA/Admin/2013-14/9 dated-04.06.13 and WBSEBEA/Policy/2012-13/29 dated-17.08.12 for creating

better promotional avenues for the employees of Class I Officers and optimum utilization of man power

through review of restructuring process (as portrayed by M/s PWC earlier) so as to improve the overall

performances and motivation of the workforce but the above draft Circular has enough potential to have

detrimental effect on the employees of Class 1 level. We, as a responsible association and an important

stakeholder had submitted our proposal vide memo no mentioned above for creating better promotional

avenues to all the levels of Class I Officers. It appears that the proposal has been misinterpreted as the

said draft circular instead of contemplating the career avenues at all levels of class I officers, envisages

restricted promotional avenues.

While creating promotional path or avenues for the employees, it is quite expected that the career

avenues of the peers be consulted or the best be followed. But the contents of the draft Circular depicts

that there is an intended approach to create an impasse and divert the attention of all from the arena of

work. This pattern of fast track promotion system at the lower level of executive positions is no where followed in

the top performing CPSUs. It is not understood, with any context or rationale, as to how such restricted pattern

of promotion can ever be envisaged by the authorities of WBSEDCL. Till date both WBSEDCL and WBSETCL

have not come up with a mechanism as to what constitutes an expected performance.

This is stated on the ground that the major component of the performance for selection at higher positionis evaluated on the basis of interview. Again, the major components of the questionnaire in all the interviews

are mostly theoretical in natures which are not in general applicable in day to day affairs. The intended fasttrack promotion scheme envisages more theory learning as one has to attain 75% marks in suitability test.Hence, the envisaged fast track promotion policy, as such, will motivate the employees to keep themselvesaway from day to day work and concentrate their efforts on reading theoretical books. As a responsibleassociation an important stakeholder, we cannot involve ourselves in propagating theory learning and todiscourage the employees to make them detached from performing the goods in the arena of work.

It is an unconcealed reality that any special privilege or out of turn promotion scheme only restricted to

specific level of employees is not free from biasness. Consequently, the outcome of the selection from fasttrack process has the likelihood to be based on other factors and not on performance. The subsequenteffect will be mass discrimination without any sound rationale.

The said draft, if implemented, will invite a culture where the processes will be non transparent, disparityand misdeed. Moreover, it will be again a one step ahead towards the act of unequal opportunity andunfairness towards the Class I Officers.

The Class I Officers, as pointed out by us in an earlier communication, is in dearth of motivation as the

result of present gloomy avenues of career growth. We had requested the authorities of both WBSEDCL tocontemplate for a better career path for the Class 1 officers so as to sustain and achieve the journeytowards the vision of WBSEDCL. But it appears that the authority is not desire to contemplate the future ofWBSEDCL and the harness the potential of the workforce.

Hence, we do not feel interested in forwarding any further suggestion on the said draft copy of thecircular and strongly demand not to proceed further with the draft circular.

Information came to this end that some junior engineers at SE level have got interview letters for the

post of Addl CE which will be held on 13.08.13 & 14.08.13, where senior engineers are being deprived /

bypassed from such interview process, which further leads the concern engineers to frustration &

demotivation and thereby creating unhealthy industrial atmosphere. We Engineers’ Association repeatedly

invited the concern authority to set right the issue before going to such interview process, so that the above

business can run smoothly. In this regard Engineers’ Association has also submitted one proposal for

process of selection of eligible candidate to appear before the above interview and we strongly believe that

such proposal was the best proposal to avoid any unrest among the engineers. We also mentioned that lot

of mistakes are still there in the gradation list which are to be set right first. But we observed that the

authority concern simply ignored the concern matter by keeping us in dark and such attitude may also

become detrimental i.r.o. maintaining industrial relationship. You are requested to take necessary steps

towards solving above unwanted issues.

Department.

Dear Sir,

We are enclosing a copy of letter issued by the

Advisor (S&V) dt. 5/3/2010 addressed to the AE,

Kolaghat Gr. E/S and a copy of the reply against the

said letter dt. 15/03/2010 by AE, Kolaghat Gr. E/S

and another copy of letter issued on 18/3/2010 by

the then AGM (HR&A) Corporate Vigilance Cell for

your perusal.

From the first two letters, it is appeared that there

was case of power theft in the premises of one

commercial consumer for which necessary pilfer bill

was raised. As far as we know that the Advisor(S&V)

is the competent authority in the matter of power

theft. However, in case of pilfer bill, competent

authority is the Station Manager of the respective

CCC and other than he only appellate authority or

appropriate court can intervene into the matter of

pilfer bill. So, it is not clear to us why by violating all

the norms and regulation as laid down in Electricity

Act and the provision of WBERC, the said letter was

issued by Corporate Vigilance probably keeping

Advisor(S&V) in dark (as these two letters are found

to be contradictory in nature). It has also been come

to our knowledge that at that time AE, Kolaghat Gr.

E/S was called in the chamber of CVO where a

statement was collected from him under stressed

condition. Now, after a long gap of more than three

years, he has been called again recently for further

submission for the reason best known to the authority.

We think that the instruction for withholding the

pilfer bill was served with an ulterior motive and

malafide intention and may be for personal gain just

to make the said pilfer bill (amounting to Rs.

11,82,752) BAD IN LAW. This act on behalf of

Vigilance Department has not only caused financial

loss of the Company but also weaken the criminal

case against the accused person. As gathered the

person is still enjoying electricity without paying a

paisa as pilfer bill. The then AGM (HR&A), Corporate

Vigilance Cell, just cannot avoid his responsibility

by saying ‘I am directed by competent authority.......’

Being a senior officer of his rank, it should have been

known to him who is the competent authority related

to any pilfer bill. In this context it is to mention here

that the said accused person to whom the pilfer bill

was issued for detected theft of electricity had confined the entire inspection team by using unholy muscle

power and thereby he had compelled them to reconnect his service line with a new cable. This incident was

also noted in the said FIR.

It is true that in some cases authority need enquiry but for that reason withholding of pilfer bill was not

compulsory. So, when the same is done it has become crystal clear what the purpose of such enquiry is.

There may have been a ‘HAND OF GOD ' which can only be revealed through proper enquiry into the

matter. So, we are requesting you to conduct a high level transparent enquiry into the matter of issuance

the said letter from vigilance department. And for the sake of clarity, at least one nominated member from

WBSEBEA is to be inducted in the said committee. Moreover, immediate action towards disconnecting the

service line which was forcefully reconnected by the said consumer to be undertaken instead of demoralizing

action against our honesty engineer member.

Sub : Request for reopening of the scope for

exercise of option for Pension Scheme

as per WBSEB Employees’ (Death-cum-

Retirement) Benefit Regulations,1985.

Sir,

You are perhaps aware that some of our members

had opted for ‘Employees’ Provident Fund &

Miscellaneous Provision Act’ in lieu of ‘WBSEB

Pension Scheme’.

Their options for ‘EPF & MP’ scheme, prior to

2002, was largely due to their apprehension

regarding the continuity and the ultimate benefits of

the other option under Employees’ (Death-cum-

Retirement) Benefit Regulations, 1985 (DCRB

Regulations).

In the last decade various Rules and Regulations

were introduced to make the DCRB Regulations

more remunerative. As a result of which these

members, after their dedicated service to WBSEB/

WBSEDCL for more than two and half decade, now

find themselves deprived and neglected because of

their inability to opt for DCRB Regulation,1985. The

quantum of terminal benefits between the optees’ to

DCRB Regulat ion and the non- optees have

increased in the recent past and created huge

monetary difference.

However, since 2002, no scope was extended to

the employees who had earlier opted for EPF&MP

Scheme to change over for DCRB Regulation, 1985.

In view of above, WBSEBEA requests you to

allow one last scope to the employees to exercise

their option for coming within the coverage of

WBSEB Employees’ (Death-cum-Retirement)

Benefit Regulations, 1985.

Sub : Submission of Restructure Review

Committee Report prepared by

WBSEBEA.

Sir,

With due respect, this is to inform you that we

have already submitted one proposal for considering

the Restructure Review Committee Report prepared

by our Association vide memo no. WBSEBEA/Policy/

2012-13/29 dated-17.08.12 and the same was

prepared taking into consideration the constraints are

being faced by our filed offices in their day to day

activities in respect of giving better consumer

services. Already one year has elapsed and lot of

table talks & discussion happened towards revert

back of erstwhile Sub-Division for providing better

consumer services. In this regard it is to mention

here that one report has been submitted before the

authori ty of WBSEDCL by manpower review

committee constituted by WBSEDCL, where the

committee also recommended the same views what

our Association does think. We also do believe that

we the WBSEB Engineers’ Association along with

our efficient field level engineers can only give you

good suggestions in respect of both technical and

administrative issues for betterment of our esteemed

organization right from technical to financial health.

Here we must request you to kindly go through our

submitted proposal vide memo no mentioned above,

where you will be able to understand that the

manpower strength as per our proposal is much less

than that of report submitted by M/s PWC. Which

proves the inefficient approach of M/s PWC and

thereby the erstwhile management also. It is also to

be noted here that no more additional expenditure

will be incurred if the erstwhile Sub-Divisions are

reverted back. At present our field offices are running

in a much unorganized way, where in some places

both technical and non-technical staffs & officers are

not getting any sitting arrangement due to place

constraint mainly and the field staffs are not placed

in their exact working place, as a result of which

working atmosphere is also deteriorating day by day.

Field staffs placed at Division offices are taking more

time to reach the working spot as most of the cases

the distances are the main factor.

For creat ing smooth and healthy working

environment, you are requested to give due

importance into the matter and revert back of

erstwhi le Sub-Division for betterment of the

organization by placing the new empanelled

Assistant Engineers selected through recent

recruitment process or the Assistant Engineer posted

in different areas since long.

LONG PENDING DEMANDS

Sub : Record note of discussion held on

27.08.2013 i.r.o. various long pending

demands of WBSEBEA.

Dear Sir,

Please recall our discussions had with you on

27.08.2013 in your chamber which started at about

4 P.M. regarding following long pending demands of

WBSEB Engineers’ Association.

1. Out of turn placement of SE & ACE in the post

of CE:

The WBSEB Engineers’ Association has been

representing continuously for placing of Chief

Engineer or senior most ACE (if CE is not available

for posting) in the post of CE and Addl. Chief

Engineer in the post of ACE.

We observed that comparatively junior ACEs

were posted in Procurement Department and SLDC.

In spite of repeated persuasion, you did not show

any positive attitude to set right the problem by

placing senior most engineers in those posts which

is very much required for creating and maintaining

congenial and good working atmosphere. Most

surprisingly we have seen recently that just before

the interview for selection for the post of CE from

ACE, you have again issued order for posting of

comparat ively junior ACE to take charge of

CE:TR(O&M) and also in the newly created post of

CE(TR. O&M - construction) and all the vacant CE’s

post i.e. in SLDC, Procurement, Tr (O&M) and Tr

(O&M-Construction) have been filled up virtually

bypassing the process of selection through interview

exists in the company; rather you felt it comfortable

to adopt pick and choose system without giving

due weight and recognition on experience and

knowledge of senior most engineers and thus

creat ing an unhealthy atmosphere in the

organization. We strongly protested this type of

illogical pick and choose system adopted by you.

Moreover, you have issued an order for assuming

charge of CE, CTD by one junior most engineer in

the rank of Superintending Engineer. Looking after day to day works for the temporary period could have

been entrusted to any of the existing CEs or the senior most SE posted in that department or senior most

ACE could have been posted there.

It is seen from the above that the autocratic attitude of the TCL management has made the interview

system meaningless and there might have every possibilities to create annoyance in the forthcoming interview

process. It may be assumed from your above actions that, those ACEs are out of turn posted now in

different CE’s post will be selected for regularization through interview which is expected to be held in the

mid September’2013. Then other ACEs (senior level as well as junior level) eligible for appearing interview

for the post of CE will appear with zero expectation in their mind in the coming selection process of interview

system which is very much painful and also very much detrimental for an organization.

We are again strongly placed our logical demand for withdrawal of all the above orders immediately

before the ensuing interview for selection of CE and ACE at the same time we also request you to refrain

from any kind of unscientific action and violation of basic norms of the company. Resentment amongst the

engineers are gearing up and top management of both organizations viz, WBSEDCL and WBSETCL will be

held responsible for any unwanted situation if arises out of it.

2. Review of Restructuring of the Organization and Manpower setup :

Though we welcome for creation of one post in the rank of CE in TR (O&M-Construction) but we requested

you to see the above issue in a broad perspective as there was lacuna in the existing Organization Structure

considering rapid expansion of Transmission system, to meet the future demand growth, to remove cadre

disparity exists in the organization etc. We expect your active consideration regarding our submission of

composite proposal for “Re-Design of Organization Re-Structures and Man Power Set-Up” few months

back. We demand your early response as till date nothing has been received.

3. Assured Career Progression Scheme (ACPS):

We again placed our demand submitted by WBSEBEA few months back for early implementation of

ACPS. Thorough analysis on the career prospect of engineers of other similar Indian power utilities is

done; it is to both the companies to remove cadre disparity which exists in the organization.

4. Inclusion of Activities of Corporate Monitoring in the Corporate Plan :

We have noticed that the name of Corporate Monitoring Cell and their activities have not been included

in the Corporate Plan, published from WBSETCL. The same has been pointed out to you. Though you

admitted it as an unintentional mistake and also assured us that next time due care will be taken.

5. Inclusion of one post of Chief Engineer as Head of HRD Department in WBSETCL :

In view of recent move towards creation of HRD Department in WBSETCL, WBSEBEA demands that

the post should be headed by one Chief Engineer, as in this purely technical organization the issues to be

handled by that position would also be technical in nature.

Hope that you will consider our long pending logical demands and will take positive action for early

redressal of grievances of the Engineers for creation of healthy atmosphere within the organization for its

further improvement and giving better consumer services.

VIGILANCE ACITIVITES

Sub : Vigilance Activities in WBSEDCLSir,

Time and again we have lodging our protest against unreasonable vigilance activities in our organisationand now we are enclosing herewith a copy of a part of report submitted by T. K. Ghosh and Co.(CharteredAccountants), the audit firm, which was engaged for verifying the ATC loss calculation of RaghunathganjDivision. Accordingly, they have submitted a report wherein it has been stated........

‘As informed by the DM there is no specific guidelines prescribed by the HQ for the computation of ATCloss and other than the formula provided by the IT&C cell of HQ. It is our suggestion that a guideline, taking

into consideration all the variables like sharing of energy, own premises billing, old outstanding collectionetc. should be prepared and made available all divisions so that the calculation process is standarised andmay also be cross referenced with the data available at the HQ level.’

From the above observation and suggestion of a specialized agency engaged by WBSEDCL, there is enoughreason to believe that our organisation has no standardised process of computation of ATC loss of a particularunit. In such a case there is every possibility of human error or different result for adopting different method forsame calculation and in no way this is unusual. By admitting the shortcomings in the system, recently a changed

method has been adopted by the authority in computation of ATC loss in WBSEDCL.

Now, it has come to our notice that some charge sheets have been issued to some engineers due todifference in calculation of ATC loss. This is most unfortunate. We fail to understand why some individualsare held responsible for the reason that generated out of System Deficiency. So, we, WBSEBEA demandto withdraw the said charge sheets against our engineers which causes to demoralise our engineer members,otherwise we may be forced to take the street.

5. Suggestions and modificatioms needed for computation of loss

Our observations

As informed by the DM there is no specific guidelines prescribed by the H.O. For the computation of AT& C loss other than the formula provided by the IT & C cell of the H.O. It is our suggestion that a guideline,taking into consideration all variables like sharing of energy, own premises billing, old outstanding collectionsetc, should be prepared and made available at all divisions so that the calculation process is standardizedand may also be cross referenced with the data available at the H.O. level.

6. If any further communication or guideline is required for the site

Our Observations

l All substations under the division should be metered so as to make available the accurate incoming power.

l Single phase defective meters are 48365 as on 31.08.2012 in the division. Immediate steps should betaken to replace / repair the defective meters.

l There are 46587 conventional meters in the division which should be immediately replaced by thedigital meters for accurate readings.

l Discussion was made on the number of consumers between 0-25 units and 26-50 units for the monthsof August 2011 and August 2012 as per the following table :

PROTEST AGAINST IRRATIONAL INTERVIEW PROSESS

Sub : Protest against the attempt for calling of engineers for interview for promotion to

the 4th and 5th level post in much higher numbers than the established norms of

3 candidates per post.

Sir,

We regret to note that an attempt is being made to call a large number of engineers for interview for the

4th and 5th level posts violating the established norms of three candidates per post. We feel that such an

attempt shall increase resentment amongst the engineers due to large scale supersession.

You are therefore, requested to intervene and stop such an attempt in the greater interest of the Company.

Incidentally it may be mentioned that the matter has already been brought to the notice of the Director

(HR), WBSEDCL, on 09.09.2013 with a request to set right the issue, without any tangible result as yet.

We are constrained to inform you that unless the matter is set right immediately we may be compelled

to go for agitation programme in the near future, starting with a gate meeting on 13.09.2013 to press for our

demand.

Sub : Reminder to reinstate the Maintenance Sub-Division for improved power system.

Sir,

Recently it has been observed that four Transfer Orders have been issued vide Office Order nos. 90 to

93 dated 13.09.2013 under the signature of Dir. (HR). The R.M, Birbhum R.O, D.M, Rampurhat Division

and associated other five (5) engineers are involved in those transfer orders.

It is gathered that recent power interruption on the festive date 05.09.13 at Tarapith is the primary cause

behind the Transfer orders. The transfer order i.r.o. Er. Kallol Das, R.M, Birbhum R,O is categorically appeared

to be irrational and unjustified in reference to some other crucial factors of the Districts at this juncture. A

reporting in daily news paper, Anandabazar dated 17.09.2013 is being attached herewith as reference

which is not encouraging message for the Organisation, WBSEDCL.

Sir, our network is outdoor type having numerous obstacles on its way. So, interruption is a common

phenomenon. However, the same can be restricted to a limited value if our experimentally proven structure

including the Sub-Division is rolled back.

INTERVIEW FOR PROMOTION

Sub : Unsettled issue on calling of engineers i.r.o. interview for promotion to the 4th

and 5th level post.

Ref. : Our previous letter vide Ref. No. WBSEBEA/Admin./2013-14/32 dated 10.09.13.

Sir,

We are yet to observe any positive response from your end on the captioned matter. Post interview

status for the position of Chief Engineer (5th level) held on 17.09.2013 are still found to be kept at stalemate

condition. Expected interview of engineers for the 4th level is also being got delayed.

It is reiterated that we are against the violation of established norms of calling three (3) candidates

per post for interview of promotion to the 4th and 5th level post. Because, we feel, this will generate

“Loss of motivation” and create “Resentment” amongst the engineers due to large scale supersession

which will become unhealthy for the organization as a whole.

You have also observed, by this time, that other Officer’s Association of our organization also expressed

same view on this issue.

At this juncture, your specific view about this serious issue is requested for early and smooth settlement

of the Promotional guideline for 4th & 5th level post.

We are always ready to discuss with you over the issue, if necessary, for an early settlement in the

interest of our members as well as for the organization.

Prompt response from your end to settle the aforesaid issue in a congenial atmosphere is highly solicited.

So, keeping the defective structure intact you can never expect better result towards getting uninterrupted

power by initiating some transfer orders / penal actions against Engineers / employees after occurrence of

any unwanted power interruption. In last year, we had formed a Technical Committee consisting of engineers

having vast practical experience in Distribution System of WBSEDCL and they had suggested for roll back

of Sub-Division which was abolished on the recommendation of an agency having no experience in power

system. We have already mentioned this in our earlier meeting with you.

So, we are requesting you to study our comprehensive proposal which was submitted earlier (a copy is

enclosed for your ready reference) and reinstate the Sub-Division with immediate effect, otherwise there

will be a big mess every now and then.

Sub : Review of the punishment against

vigilance enquiry i.r.o Sri Gobinda

Biswas.

Sir,

This in reference to our discussion with you on

05/09/2013 when we had mentioned that one

vigilance enquiry was constituted against Sri

Gobinda Biswas, AE, presently posted at Barasat

Area Office, WBSETCL. This was related to an

electrical accident at Kolaghat 132KV Sub-Station.

We are not going to details of the fact. We just want

to mention that at the material point of time Sri

Biswas was on leave. Still he was held responsible

for the accident. As far as we have investigated, Sri

Biswas is very responsible and duty bound engineer.

In no way he gave any instruction for work without

Shut Down of the line. Still he has been held

responsible through a complex enquiry process.

During enquiry the basic thing of his sanctioned leave

of absence was ignored. This shocking finding has

demoralised Sri Biswas to a great extent. In this

context, we further to state that you had assured us

to look into the matter sympathetically.

Under the stated circumstances, we are praying

to your goodself to reconsider his punishment for

withholding three increments, so that he gets back

his working spirit which will be ultimately beneficial

both for him as well as for the organisation. Sri

Biswas has already submitted the formal appeal

before you. Hope that you will consider our prayer.
