NOTIFICATION OF THE PROPOSED VETERINARY SURGEONS ANDVETERINARY PARAPROFESSIONALS (VETERINARY MEDICINESDIRECTORATE) REGULATIONS, 2014, REGULATORY IMPACT

STATEMENT

PURSUANTto section 8 of the Statutory Instruments Act, 2013,

the Cabinet Secretary for Agriculture, Livestock and Fisheries notifiesthe general public of the preparation of the Regulatory ImpactStatement for the proposed Veterinary Surgeons and VeterinaryParaprofessionals (Veterinary Medicines Directorate) Regulations,2014.

The objective of the proposed Veterinary Surgeons and VeterinaryParaprofessionals (Veterinary Medicines Directorate) Regulations,2014 is to provide the legal framework that assures proper professional

control in the distribution and use of veterinary medicines and toreduce their misuse and abuse in the community. The proposedregulations provide for the regulation of the manufacture, importation,exportation, registration, distribution, prescription and dispensing ofveterinary medicines and poisons as provided in section 39(2)(a) of theVeterinary Surgeons and Veterinary Paraprofessionals Act, 2011.

Copies of the Veterinary Surgeons and VeterinaryParaprofessionals (Veterinary Medicines Directorate) Regulations,2014 and the Regulatory Impact Statement may be obtained andinspected from the Kenya Veterinary Board offices in Kabete, Nairobi,or from the website www.kenyavetboard.org, free of charge.

Any person may comment on the proposed Veterinary Surgeonsand Veterinary Paraprofessionals (Veterinary Medicines Directorate)Regulations, 2014 and on the Regulatory Impact Statement, in writing.The written submissions may sent to the Kenya Veterinary Boardthrough email address [email protected] or posted to P.O. Box513-00605, Nairobi or hand-delivered to the Kenya Veterinary Boardoffices in Kabete, Nairobi, within fourteen (14) days from the date ofpublication of this notice.

PURSUANTto Regulation 21 of the Environmental Managementand Co-ordination (Impact Assessment and Audit) Regulations, 2003,

the National Environment Management Authority (NEMA) has

received an Environmental Impact Assessment Study Report for theabove proposed project.

The Proponent (Kenya National Highways Authority) proposes to

upgrade the Marich Pass — Lodwarroad, totaling 197.89 Km.

The following are the anticipated impacts and proposed mitigation

or disturbed nor should any unauthorized

planting of vegetation take place.

The clearance of the site for construction

purposes shall be kept to a minimum. The

use of existing un-vegetated or disturbed

areas for the Contractor’s Camp, stockpiling

of materials etc shall be encouraged.

Areas to be cleared should be agreed anddemarcated before the start of the clearing

operations.

Clearing and removal of vegetation,

especially at borrow sites must be carried

out in such a way that damage to adjacent

areas is prevented or minimized.

Areas with dense indigenous vegetation at

Kainuk and adjacent areas are not to be

disturbed unless required for construction

purposes.

Plant indigenous and native trees along the

project road at Kainuk and Lodwar.

The use of fuel wood by construction

workers should be discouraged.

Asfar as possible earthworks should avoid

the rare wet seasons that are always intense

to prevent soil erosion and landslides.

Excavated materials and excess earth should

be kept at appropriate sites approved by the

Supervising Engineer.

Whereverpossible, the earth dumping sites

will be designed in such a manner as to

facilitate natural water discharge.

Areas affected by construction related

activities and/or susceptible to erosion or

landslides must be monitored regularly.

IMPORTANT NOTICE TO SUBSCRIBERS TOTHE KENYA GAZETTE

THE following notes are for the guidance of persons submitting “copy” for

inclusion in the Kenya Gazette, Supplement,etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not

affect legislation. They are, therefore, submitted to the Government

Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are

issued by the Central Government. Because of this, they must be

submitted to the Government Printer through the office of the

Attorney-General.

(3) Bill Supplement contains Bills which are for introduction in the

National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All “copy” submitted for publication should be prepared on one side of an

A4 sheet no matter how small the Notice is, each page being numbered and

should be typewritten with double spacing. Copy should be clear, legible and

contain noalterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name

of the signatory in capital letters.

(iiust be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised

Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D—

Kenya Gazette

“D 34, (1) Communications for the Kenya Gazette should reach the

Government Printer not later than 9 am. on Friday of the week before

publication is desired. The Government Printer will not publish communications

received after that hour until the next subsequentissue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the

cost of advertisinginit.

It is emphasized that these notes are for guidance only, but it is requested

that persons submitting copy for publication first satisfy themselves that such

copy is complete in every respect.
