Commission.

Sir,

I am directed to bring the following issues regarding the functioning of the Central Information Commission to your kind notice.

2. Section 12(2) of the Right to information act, 2005, provides for the constitution of the Central information Commission with the Chief information Commissioner and such number of Central Information Commissioners not exceeding ten in number as may be deemed necessary. Presently, one Chief Information Commissioner and eight Information Commissioners are functioning in the Commission.

3. The Chief Information Commissioner is an integral member and indispensable to the functioning of the Commission is provided for in section 12(4) of Right to Information Act, 2005 which inter-alia, states that;

"The general superintendence, direction and management of the affairs of the Central Information Commission shall vest in the Chief Information Commissioner who shall be assisted by the Information Commissioners."

4. The term of Mrs. Sushma Singh, the present Chief Information Commissioner will come to an end on 21st May, 2014 after which, Mr. Rajiv Mathur, Information Commissioner is expected to superannuate on 22nd August 2014 . Details enclosed in Annexure.

5. Over 24,594 cases are pending for disposal in the Commission as on1.1.2014. Many more fresh cases have been received since then.

6. Information Commissioners being crucial to the early disposal of cases, it is requested that appropriate steps may be initiated for filling up vacancies so that disposal of cases carry on uninterruptedly.

The Government is in the process of appointment of Information Commissioners(s) in the Central Information Commission at Delhi. The Central Information Commission is a statutory organisation. It adjudicates on complaints and appeals received against Central Government Public Authorities.

2. The Right to Information Act, 2005 mandates constitution of a Central information Commission (CIC), consisting of the Chief Information Commissioner and such number of Information Commissioners not exceeding ten as may be deemed necessary. At present the Central information Commissioner is assisted by eight Information Commissioners.

3. The number of appeals and complaints are on increase in the Central Information Commission and the Commission is finding it difficult to cope up with the pendency with the existing number of Information Commissioners. It is thus necessary to appoint two more Information Commissioners in the Central Information Commission, in accordance with the established procedure.

4. As per the Act, the appointment is made by the President on the recommendation of a Selection Committee comprising:

(i) The Prime Minister- The Chairperson of the Committee; (ii) The Leader of Opposition in the Lok Sabha; and (iii) A Union Cabinet Minister nominated by the Prime Minister.

5. The Government is making all efforts to complete the selection process by end of March, 2014. However, having regard to the nature of the various activities involved in this process, it is likely that the entire process may spill over beyond March, 2014 by one or two weeks. This possibility is being brought to the notice of the Election Commission of India for kind information, having regard to the fact that general elections to the Lok Sabha are due very shortly.

Subject: Appointment of Information Commissioners in the Central Information Commission.

The Government of India has constituted a body under the Right to Information Act, 2005 (the Act) known as the Central Information Commission to exercise the powers conferred on and to perform the functions assigned to it under the Act. It is located in New Delhi. The Commission shall have the Chief Information Commissioner and upto ten Information Commissioners. The present composition of the Central Information Commission can be seen at www.cic.gov.in. The powers and functions of an Information Commissioner in the Central Information Commission are as per chapter V of the Act.

2. It is proposed to appoint more Information Commissioners in the Commission. The Act provides that the Information Commissioners shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass-media or administration and governance.

3. Further, the Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession. It is clarified that cessation/termination of holding of office of profit, pursuing any profession or carrying any business is a condition precedent to the appointment of a person as Information Commissioner.

4. An Information Commissioner shall hold office for a term of five years from the date on which he enters upon his office or till he attains the age of 65 years, whichever is earlier. The salary and allowances payable to an Information Commissioner shall be the same as that of an Election Commissioner, subject to adjustment of the pensionary/retirement benefits availed by him, if any, in accordance with the provisions of the Act.

5. 6. It may be noted that these appointments would be subject to the outcome of Review Petition (C) no. 2309 of 2012 pending before the Hon'ble Supreme Court.

Sub: Selection of two Information Commissioner (ICs) in Central Information Commission (CIC)

Reference is invited to the proposal of the Department contained in the note dated 20.02.2014 at page 1-3/n in the DoPT's File no. 4/4/2014-IR, on the above subject.

2. The Prime Minister has approved the following proposals of the DoPT as contained in para 5 of the aforestated Note:

(i) Action for selection of two ICs in CIC, may be initiated;

Savings under the Object head are expected after taking into account the anticipated expenditure.

Reasons for Additionality

2. There is a proposal of IR division to fill up some posts of Information

commissioners in the Central Information commission (CIC) and to this effect an advertisement is to be given in the leading newspapers. It is stated the advertisement may be given in three leading newspaperd, Directorate of Advertising & Visual Publicity (DAVP) has estimated the cost to be around Rs

3.40 Lakh for the advertisement. After taking into account the Authorisations

issued and Revised Estimate (RE) 2013-14 figures under the head Advertising & Publicity, there is a shortfall of Rs 2 Lakh under the head.

Savings

3. It has been intimated by the cash section that there is a likely saving of Rs

2 Lakh under DOPT's Publication head as the printing of Annual Reports are to be undertaken during the next financial year . This saving can be utilized to meet the Reappropriation proposal to augment funds under Advertising & Publicity head by Rs 2 Lakh.

As per item No 2 of the. COI's ciecision (6) below rule 10 of the L'r-Ti-z,

1978, all re-appropriation, irrespective of the foci that these are made on the

basis of estimates approved by the Finance Ministry, having the effect of

increasing the budget provision by Rc.5 crore or more under a sub-head shall be

mode only with the prior approval of Secretary (Expenditure.). Notwithstanciino

the above, the Administrative Minis-iricsii)epartments shall have full powers for

augmenting the provisions of the heads 'Salaries', 'Wages', 'Pensionary Charges,

"Medical Expenses' and Rent, Rates & Taxes etc' through re-appropriation,

provided the approved ceiling of the Grant is not exceeded and re-appropriation

I does not involve transfer of funds from an Externally Aided Project (EAP) to a

Non-EAP purpose and from Capital to Revenue, Voted to Charged and Plan to Non-

Plan sections of the Grant or vice versa. In the current proposal the proposed

reappropriation does not increase the budget provision by Rs.5 crore or above

under a sub-head and the object heads under which the reappropriation

proposed are not coming under the heads which require the prior approval of

MoF.

7. The present reappropriation proposal does not increase the budget

provision under a sub-head by 5 crore or more. Therefore, we may send the

proposal for the approval of AS & FA (Home) and Secretary (P) for

reappropriation of Rs 2 lakh within the Revenue/Voted Section of Grant No.73-

M/o Personnel,' Public Grievances & Pensions for the year 2013-14 as proposed at

para 5 on pre page please.

Reference is invited to the proposal of the Department contained in the note dated 20.02.2014 at page 1-3/n in the DoPT's File no. 4/4/2014-IR, on the above subject.

2. The Prime Minister has approved the following proposals of the DoPT as contained in para 5 of the aforestated Note:

(i) Action for selection of two ICs in CIC, may be initiated;

(ii) The same procedure as was followed during the last selection of ICs, by issuing a draft circular for inviting applications and draft advertisement for newspapers as per draft submitted, may be followed;

(iii) The same Search Committee for appointment of the ICs, may continue.

3. As proposed by MoS (PP), DoPT may also inform Election Commission of India of the commencement of the process immediately.

PMO vide ID no. 600/31/C/39/2013-ES.2 dated 18.7.2013 has conveyed the approval of Hon' ble Prime Minister for continuation of the "Search Committee" during the current round of selection for appointment of Information Commissioner in the Central Information Commission as constituted during the last round of selection process, as given below:

1) Cabinet Secretary Chairman 2) Principal Secretary to PM Member 3) Secretary (Higher Education) Member 4) Law Secretary Member 5) Secretary (Personnel) Member 6) Ms Amrita Patel, Chairperson (NDDB) Member

2. The first meeting of the Search Committee is scheduled to be held on 13.8.2013.

3. It is mentioned that Law Secretary, Dr. Brahm Avtar Agrawal, who is a member of the Search Committee, is one of the applicants for the post of Information Commissioners in the CIC. It is therefore, proposed that another person may be nominated as member of Search Committee in place of Law Secretary.

4. It is pertinent to mention that in a similar case of selection of members for Central Administrative Tribunal (CAT), initially Shri. B.A. Agrawal was one of the members of the Selection Committee. However, since he was also one of the applicants for the post of CAT member, another person was nominated in his place as member of the Selection Committee.

5. It is also pertinent to mention that during the last round of selection of Information Commissioners, the then Law Secretary, Shri D. R. Meena was one of the members of the Search Committee and also one of the applicants for the post of Information Commissioners. It is learnt that for this reason, he was not called for the meetings of the Search Committee.

6. It is submitted for the consideration of Hon' ble Prime Minister for nomination of a member of Search Committee in place of Law Secretary.

context of the Model Code of Conduct during General Elections and decided to issue to

following Guidelines regarding implementation/processing of the various projects,

schemes, rural development programmes etc. by the Central/State Governments :-

1. All Model Code of Conduct related directions shall be issued only by the

Commission. The Cabinet Secretariat or any other government agency should

reiterate and disseminate the directions of the Commission for compliance.

2. RBI may continue to take decisions unhindered on monetary policy issues.

3. After the Model Code of Conduct comes into effect, the Ministry of Finance will

need to take prior approval of the Commission on any policy announcements, fiscal

measures, taxation related issues and such other financial relief. Similarly, other

Ministries/Departments will need to take prior approval of the Commission before

announcing any relief/benefit.

4. The following types of existing works can be continued by the government agencies

without reference to the Election Commission after the Model Code of Conduct

comes into force:

a. Work-Projects that have actually started on the ground after obtaining all

necessary sanctions;

b. Beneficiary-projects where specific beneficiaries by name have been identified

before coming of the Model Code of Conduct into force;

c. Registered beneficiaries of NREGA may be covered under existing projects.

New projects under NREGA that may be mandated under the provisions of

the Act may be taken up only if it is for the already registered beneficiaries

and the project is already listed in the approved and sanctioned shelf of

projects for which funds are also already earmarked.

5. There shall be no bar to release of funds for the completed portion of any work

subject to observance of laid down procedures and concurrence of finance

department.

6. The following type of new works (whether beneficiary or work oriented) that fulfill

all the following conditions before Model Code of Conduct comes into effect, can be

taken up under intimation to the Commission-

a. Full funding has been tied up.

b. Administrative, technical and financial sanctions have been obtained

c. Tender has been floated, evaluated and awarded and

d. There is contractual obligation to start and end the work within a given time

frame and failing which there is an obligation to impose penalty on the

contractor.

e. In case of any of the above conditions not being met in such cases prior

approval of the Commission shall be sought and obtained.

7. Global tenders already floated, can be evaluated and finalized where any time limits

are specified for such purpose.

8. Tenders other than global tenders, that are already floated may be evaluated but not

finalized without prior approval of the Commission. If they are not already floated,

they shall not be floated without prior approval of the Commission.

9. Commission invariably takes a humanitarian view on the work that are necessitated

due to man-made or natural calamities.

a. Ex-gratia payments and gratuitous relief in the aftermath of a disaster can be

given directly to the persons affected at the current rates/scales of assistance

presently in force, under intimation to the Commission. No change in the

extant and prescribed scales of payments, however, shall be made in the

existing rates/scales without prior permission of the Commission.

b. Payment directly to the hospitals from CM's/ PM's Relief Fund, in lieu of

direct cash payment to individual patients (beneficiaries) will be permissible

without reference to the Commission.

c. Emergent relief works and measures that are aimed to mitigate the hardships,

directly and solely, of the persons affected in a disaster may be taken up

under intimation to the Commission.

d. However, new works that may be necessitated by way of preventive

measures to mitigate the likely effects of natural disasters like repair of

embankments, water channels etc. can be taken up only with prior

permission of the Commission.

e. Also, an area shall not be declared drought/flood affected or any such

calamity affected without prior approval of the Commission. The extent of

area already declared to be calamity-effected cannot be expanded without

prior approval of the Commission.

f. Similarly, any selective assistance to a group of persons from the PM's or the

CM's Relief Fund will require prior approval of the Commission.

10. The following type of activities will require prior permission of the

Commission:

a. New works and project cannot be taken up from discretionary funds of

whatever nature. Discretionary fund, in this context, includes funds, which

are provided for in the budget in a generic manner and for which no

identified and sanctioned project exists prior to Model Code of Conduct

coming into effect.

b. Proposals for revival of sick PSUs, governmental take over of enterprises etc.

(or any policy decision on similar lines) cannot be taken up.

c. Fresh auctions of liquor vends etc. cannot be held even if the annual auction

time falls within the Model Code of Conduct period. Where necessary, the

government should make interim arrangements as provided in their

respective laws.

d. Area of operation of any existing project/scheme/programme can not be

extended or expanded.

e. No land allocation shall be made by the government to any entity, whether

individual or an enterprise.

f. Signing a MOU or an agreement where the government is a party will also

require prior clearance by the Commission.

11. Regular recruitment/appointment or promotion through the UPSC, State

Public Service Commissions or the Staff Selection Commission or any other

statutory authority can continue. Recruitments through non-statutory bodies, will

require prior clearance of the Commission.

12. While starting any work (including any relief work) or developmental

activity no formal function shall be held involving any political functionary. As a

matter of good practice, normal functions and publicity even with the presence of

official functionaries should be kept to the minimum.

13. Where works are to be undertaken or functions are to be held in fulfillment of

international commitments, prior concurrence of the Commission shall be taken.

14. All Government of India references to the Election Commission of India shall

be made preferably through the Cabinet Secretariat. In so far as reference from State

Governments are concerned, the same shall be made to the Election Commission of

India through the Chief Electoral Officer (CEO) of the state concerned.

This may be brought to the notice of all concern authorities.

Constitution of Central. inforiniltion Commission

12. (i) The Central Government shall, by notification in the Official Gazette, constitute a body to be known as the Central Information Commission to exercise the powers conferred on, and to perform the functions assigned to, it under this Act.

(2) The Central Information Commission shall consist of—

(a) the Chief Information Commissioner; and (h) such number of Central Information Commissioners,

not exceeding ten, as may be deemed necessary.

(3) The Chief Information Commissioner and Information Commissioners shall be appointed by the President on the recommendation of a committee consisting of—

(i) the Prime Minister, who shall be the Chairperson of the committee; (ii) the Leader of Opposition in the Lok Sabha; and (iii) a Union Cabinet Minister to be nominated by the Prime Minister.

Explanation.---For the purposes of removal of doubts, it is hereby declared that where the Leader of Opposition in the House of the People has not been recognised as such, the Leader of the single largest group in opposition of the Government in

the House of the People shall be deemed to he the Leader of Opposition.

(4) The general superintendence, direction and management of the affairs of

the Central Information Commission shall vest in the Chief Information Commis-sioner who shall be assisted by the Information Commissioners and may exercise all such powers and do all such acts and things which may be exercised or done by the Central Information Commission autonomously without being subjected to direc-tions by any other authority under this Act.

(5) The Chief Information Commissioner and Information Commissioners

shall be persons of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass

media or administration and governance.

(6) The Chief Information Commissioner or an Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union territory, as the case may be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any profession.

(7) The headquarters of the Central Information Commission shall be at Delhi and the Central Information Commission may, with the previous approval of the Central Government, establish offices at other places in India.

A reference forwarded by PMO from Sh. Satyanand Mishra, Ex. Chief Information Commissioner with regard to need of obtaining vigilance clearance for appointment of Information Commissioners and other statutory positions, is under examination in this file.

2. He has suggested that there may not be any need of Vigilance Clearance for appointment of Information Commissioners and other Statutory positions, if the person concerned, at the time of appointment or few months prior to that was serving as Secretary to the Govt. of India, which will avoid unnecessary delay in such appointments for want of Vigilance Clearance. A detailed note in this regard may be seen at pg. 20-23/ante.

3. In this connection, it was decided to put the issue on hold and put up the file when the next appointment of ICs takes place.

4. Since the appointment of Information Commissioners in the Central Information Commission is on with last date of receiving applications 25.03.2014. File is re-submitted for further direction.

5. It is pertinent to mention that since Secretary(P) is one of the applicants for the said post, he has recused himself from handling the file for selection of ICs in the CIC. It has been further mentioned in the said note that JS (AT & A) may submit the file directly to MoS (PP) on the subject.

Agenda Note

Appointment of Information Commissioners in the Central Information Commission.

1. As per section 12 (2) of the Act, the Central Information Commission shall consist

of the Chief Information Commissioner and such number of Central Information

Commissioners, not exceeding ten, as may be deemed necessary. At present, the Central

Information Commission has Chief Information Commissioner and 8 (eight) Information

Commissioners.

2. Section 12 (3) of the Act stipulates that the Chief Information Commissioner and

the Information Commissioners shall be appointed by the President on the

recommendation of a Committee consisting of the following:-

(i) the Prime Minister who shall be the Chairman of the Committee,

(ii) the Leader of the Opposition in the Lok Sabha, and

(iii) a Union Cabinet Minister to be nominated by the Prime Minister.

3. As per Section 12(5) of the RTI Act, 2005, the Chief Information Commissioner and

Information Commissioners shall be persons of eminence in public life with wide

knowledge and experience in "law, science and technology, social service,

management, journalism, mass media or administration and governance."

4. Section 12(6) of the RTI Act, 2005 mandates that "The Chief Information

commissioner or an Information Commissioner shall not be a Member of Parliament or

Member of the Legislature of any State or Union territory, as the case may be, or hold any

other office of profit or connected with any political party or carrying on any business or

pursuing any profession."

5. PMO has conveyed the approval of the Prime Minister for starting the selection

process for appointment on two posts of Information Commissioners in Central Information

Commission, as per the same procedure as was followed during the last selection of

Information Commissioners.

6. It is pertinent to mention that in a Review Petition filed by Union of India against,

Hon'ble Supreme Court judgement dated 13.09.2012 in Namit Sharma case, the Ho"le

Supreme Court vide its judgement dated 03.09.2013, inter-alia, gave the following

directions:-

(I)

We direct that only persons of eminence in public life with wide knowledge and

experience in the fields mentioned in Sections 12 (5) and 15 (5) of the Act be

considered for appointment as Information Commissioner and Chief Information

Commissioner.

(ii) We further direct that persons of eminence in public life with wide knowledge

and experience in all the fields mentioned in Section 12 (5) and 15 (5) of the

Act, namely, law, science and technology, social service, management,

journalism, mass media or administration and governance, be considered by

the Committee under Sections 12 (3) and 15 (3) of the Act for appointment as

Chief Information Commissioner or Information Commissioners.

(iii) We further direct that the Committees under Section 12 (3) and 15 (3) of the Act

while making recommendations to the President or to the Governor, as the case

may be, for appointment of Chief Information Commissioner and Information

Commissioners must mention against the name of each candidate

recommended, the facts to indicate his eminence in public life, his knowledge

in the particular field and his experience in the particular field and these facts

must be accessible to the citizens as part of their right to information under the

Act after the appointment is made.

7. The Prime Minister has also accorded approval for continuation of Search

Committee, as given below during the current round of selection for appointment of ICs in

the CIC as constituted on the last round of selection process.

(i) Cabinet Secretary Chairman

(ii) Principal Secretary to PM Member

(iii) Secretary (Higher Education) Member (He himself is an applicant, so he will not attend)

(iv) Secretary (D/o AR&PG) Member

(v) Law Secretary Member

(vi) Ms. Amrita Patel, Former Chairperson (NDDB) Member

• 8. As per earlier process, a circular had been posted on the website of DOPT on

25.02.2014 seeking particulars of the interested persons for the post of Information

Commissioners in the Central Information Commission. The last date of receipt of

applications was 25.03.2014. An advertisement was also published in the 2 leading English

newspapers (Times of India and The Hindu) and in one Hindi newspaper (Dainik Bhasker)

and their editions throughout India.

9. In response, a total of 293 applications for the post of ICs in CIC have been

received by the last date i.e. 25.03.2014. As per Section 12(5) of the RTI Act, 2005, the Chief

Information Commissioner and Information Commissioners shall be persons of eminence in

public life with wide knowledge and experience in "law, science and technology, social

service, management, journalism, mass media or administration and governance."

10. Accordingly, all these 293 applications have been broadly categorised into 7

categories of knowledge and experience, as mentioned above. Few applications which

do not fall within these 7 categories, have been mentioned in "others" category.

However, for the sake of categorisation, only the main field of knowledge and experience

have been mentioned, while the additional fields of knowledge and experience, if any,

have not been indicated. Tabulated details on the basis of such categorisation is at

Annexure-l.

The category-wise distribution of these applications is as under;-

10. As per the earlier procedure, the Search Committee would empanel the names

of suitable persons to the Selection Committee headed by the Prime Minister for selection

1 1 . During the last round of selection, the Search Committee had decided that since

seeking report from CVC would take considerable time, DoPT may seek reports from CO in

respect of shortlisted persons as to whether these persons are under any investigation by

the CBI. The Committee also decided that DoPT may also obtain reports from IB in respect

of all the shortlisted persons and vigilance clearance from the respective cadre controlling

authorities. For the current round of selection, MoS (PP) has approved that we may

continue the procedure followed during the last round of selection viz. obtaining vigilance

clearance from the respective cadre controlling authorities, inputs from IB and CBI,

without going to CVC.

The Search Committee was informed that at present there are eight Information

Commissioners functioning in the Central Information Commission apart from the Chief

Information Commissioner. The Committee was informed that the Prime Minister had

approved the proposal of the Department of Personnel and Training for starting the selection

process for appointment to two positions of Information Commissioners (ICs) in Central

Information Commission, as per the same procedure as was followed during the last selection

of ICs.

2. As per Section 12(5) of the RTI Act, 2005, the Information Commissioners shall be

persons of eminence in public life with wide knowledge and experience in law, science and

technology, social service, management, journalism, mass media or administration and

governance. The Information Commissioner shall not be an MP or MLA or hold any other office

of profit or be connected with any political party or be carrying on any business or pursuing any

profession. The Committee was also informed of the Supreme Court's directions/observations

in the Review Petition filed by Union of India in Namit Sharma case, as indicated in Annexure i.

3. The Committee was informed that the circular seeking applications from interested

persons for the position of Information Commissioner was posted on the website of DoPT on

25.02.2014 and an advertisement was also published in two leading English newspapers and in

one Hindi newspaper. The last date for receipt of applications was 25.03.2014. The Committee

was informed that a total of 293 applications had been received by the last date. The details of

the 293 applicants are at Annexure II.

4. In light of the decision to select two ICs during the current process of selection, the

Committee decided to prepare panels to fill two positions of Information Commissioners with

three names in each panel.

5. The Committee after considering the details of the applicants, their educational

qualifications, the breadth, diversity, relevance and length of their experience, and after

detailed discussions, recommended the following two panels, each in alphabetical order, for

consideration of the Selection Committee as provided in section 12(3) of the RTI Act for making

recommendations for appointment of Information Commissioners:

6. Keeping in view the urgent need to fill the vacancies of Information Commissioners and

that seeking report from the Central Vigilance Commission would take considerable time, the

Committee decided that DoPT may seek reports in respect of all the shortlisted persons from

the Central Bureau of Investigation as to whether these persons are under any investigation by

the CBI. The Committee also decided that DoPT may also obtain reports from the Intelligence

Bureau in respect of all the shortlisted persons and vigilance clearance from the respective

Cadre Controlling Authorities.

Annexure -I

DIRECTIONS OF THE HON'BLE SUPREME COURT

In a Review Petition filed by Union of India against Hon'ble Supreme Court judgement dated

13.09.2012 in Namit Sharma case, the Hon'ble Supreme Court vide its judgement dated 03.09.2013,

inter-alia, gave the following directions:-

(i) We direct that only persons of eminence in public life with wide knowledge and experience

in the fields mentioned in Sections 12 (5) and 15 (5) of the Act be considered for

appointment as Information Commissioner and Chief Information Commissioner.

(ii) We further direct that persons of eminence in public life with wide knowledge and

experience in all the fields mentioned in Section 12 (5) and 15 (5) of the Act, namely, law,

science and technology, social service, management, journalism, mass media or

administration and governance, be considered by the Committee under Sections 12 (3) and

15 (3) of the Act for appointment as Chief Information Commissioner or Information

Commissioners.

(iii) We further direct that the Committees under Section 12 (3) and 15 (3) of the Act while

making recommendations to the President or to the Governor, as the case may be, for

appointment of Chief Information Commissioner and Information Commissioners must

mention against the name of each candidate recommended, the facts to indicate his

eminence in public life, his knowledge in the particular field and his experience in the

particular field and these facts must be accessible to the citizens as part of their right to

information under the Act after the appointment is made.

1.0 Introduction

Right to Information Act, 2005, mandates constitution of a Central Information

Commission (CIC), consisting of the Chief Information Commissioner and such number of

Information Commissioners not exceeding ten as may be deemed necessary. The

Commission adjudicates appeals and complaints under the RTI Act. The current constitution

of the CIC is as given below:

2.0 Legal Position

2.1 As per Section 12 (5) of Act, the Information commissioners shall be persons of

eminence in public life with wide knowledge and experience in law, science and


governance. The Commissioner shall not be a MP or MLA or hold any other office of profit or

connected with any political party or carrying on any business or pursuing any profession.

2.2 Sub-Section (2) of section 13 provides that every Information Commissioner shall hold

office for a term of five years from the date on which he enters upon his office or till he

attains the age of 65 years, whichever is earlier.

2.3 According to sub-section (3) of Section 12 of the Act, the Chief Information

Commissioner and the Information Commissioners are appointed by the President on the

recommendation of a Committee consisting of -

i. The Prime Minister;

ii. The Leader of Opposition in Lok Sabha ; and

iii. A Union Cabinet Minister to be nominated by the Prime Minister

3.0 Constitution of the Committee

3.1 The Committee has now been constituted under Section 12(3) of the RTI Act 2005 with

the following composition:

i. The Prime Minister who shall be the Chairman of the committee,

ii. Leader of Opposition

iii. The Minister of Law and Justice.

4.0 Search Procedure

4.1 Prime Minister had approved the constitution of a Search Committee, as given

below:-

iii. Secretary (DAR&PG) - Member

iv. Secretary (School Education & Literacy) - Member v. Law Secretary - Member

4.2 Prime Minister has approved appointment of two posts of Information Commissioners

in the Central Information Commissioner in the current round of selection.

4.3 293 applications have been received in response to a circular dated 25.02.2014

posted on the Department of Personnel and Training's website and through leading

newspapers. A list of the applicants, with particulars in brief in a tabular form is annexed as

Annexure 'A'.

4.4 The Search Committee met on 21.04.2014 and after scrutinizing the particulars of the

applicants and after detailed discussions, recommended the following 2 panels, each in

alphabetical order, for consideration of the Committee prescribed in section 12(3) of the RTI

Act for making recommendations to the President for appointment of Information

Commissioners. A copy of the minutes of the Search Committee is annexed as Annexure 'B'.

• 6.0 A Writ Petition was filed by Shri Namit Sharma against Union of India challenging the

constitutional validity of sub-Sections (5) and (6) of Section 12 of the RTI Act. Union of India

filed a Review Petition against the judgement dated 13.9.2012 of the Supreme Court.

Hon'ble Supreme Court in its order dated 03.09.2013 allowed the review petition and gave

certain declarations, which may be seen at Annexure-'D'. For the sake of emphasis, few of the directions is mentioned below:

(i) We further direct that persons of eminence in public life with wide knowledge and experience in all the fields mentioned in Sections 12(5) and 15(5) of the Act, namely, law, science and technology, social service, management, journalism, mass media or administration and governance, be considered by the Committees under Sections 12(3) and 15(3) of the Act for appointment as Chief Information Commissioner or Information Commissioners.

(ii) We further direct that the Committees under Sections 12(3) and 15(3) of the Act while making recommendations to the President or to the Governor, as the case may be, for appointment of Chief Information Commissioner and Information Commissioners must mention against the name of each candidate recommended, the facts to indicate his eminence in public life, his knowledge in the particular field and his experience in the particular field and these facts must be accessible to the citizens as part of their right to information under the Act after the appointment is made.

weekly column on the website whispersinthe corridors.com since 2008 and also started in 2011 a

website www.rtifoundationofindia.com. A social activist, Dr. Verma was also shortlisted for the post

Information Commissioner in the CIC during the last two rounds of selection. At present she is

working as RTI consultant to IIM, Indore.

2 Shri Balwant Rai Mittal Law

Shri Balwant Rai Mittal did his Masters in Law in 1979 in Corporate Law and Economic Legislations. He

is a Gold Medal Awardee by Commercial Law Society, Faculty of Law, Delhi University and is also an

Associate Company Secretary. He was associated with Industrial Finance Cooperation of India for 14

years and left that financial institution in 1997 while working as General Manager (Legal) to join the

Income Tax Appellate Tribunal as Judicial Member in January 1988 and is continuing in the same

capacity till date. He has very good knowledge of economic legislations and 16 years experience of

judicial work.

3 br. Syamal Kumar

Sarkar

Administration

and Governance

Dr. Sarkar did his post graduation in physics and obtained doctorate in Economics from USA. As a Joint

Secretary and then Secretary in DoPT, he was closely associated with implementation and propagation

of Right to Information Act. He was instrumental in framing and implementation of Centrally

sponsored scheme on RTI, Capacity building of State Information Commissions and Administrative

Training Institutes, creation of RTI Songs, development of RTI gateway. It was under his guidance that

online filing of RTI applications was started. He was also responsible for issuance of guidelines for

strengthening of suo-motu disclosures. He was also instrumental in giving RTI a separate entity by way

of RTI logo. Many anti corruption legislations like Lokpal and Lokayuktas Act, Whistle Blowers and

Foreign Bribery Bills etc. were formulated under his guidance. At present Dr. Sarkar is serving as

Secretary Department of Personnel & Training.

Board of Excise and Customs. She is a post graduate in English and History and holds a Diploma in

of over 70 thousand including recruitment, promotion, placement, disciplinary proceedings etc. She

has to her credit formulation and enforcing a robust anti-corruption and vigilance policy in CBEC. She

sector as well as international trade issues dealing with matters related to compliance and

enforcement of a wide range of laws and regulations. She is also well versed with accounting

standards and business and book keeping practices of different sectors. A Presidential awardee for

specially distinguished record of service in 1992, Ms Praveen Mahajan retired as Chairperson CBEC on

31.1.2014.

The Search Committee was informed that at present there are eight Information

Commissioners functioning in the Central Information Commission apart from the Chief

Information Commissioner. The Committee was informed that the Prime Minister had

approved the proposal of the Department of Personnel and Training for starting the selection

process for appointment to two positions of Information Commissioners (ICs) in Central

Information Commission, as per the same procedure as was followed during the last selection

of ICs.

2. As per Section 12(5) of the RTI Act, 2005, the Information Commissioners shall be

persons of eminence in public life with wide knowledge and experience in law, science and


governance. The Information Commissioner shall not be an MP or MLA or hold any other office

of profit or be connected with any political party or be carrying on any business or pursuing any

profession. The Committee was also informed of the Supreme Court's directions/observations

in the Review Petition filed by Union of India in Namit Sharma case, as indicated in Annexure I.

3. The Committee was informed that the circular seeking applications from interested

persons for the position of Information Commissioner was posted on the website of DoPT on

25.02.2014 and an advertisement was also published in two leading English newspapers and in

Anne Hindi newspaper. The last date for receipt of applications was 25.03.2014. The Committee

was informed that a total of 293 applications had been received by the last date. The details of

the 293 applicants are at Annexure II.

4. In light of the decision to select two ICs during the current process of selection, the

Committee decided to prepare panels to fill two positions of Information Commissioners with

three names in each panel.

5. The Committee after considering the details of the applicants, their educational

qualifications, the breadth, diversity, relevance and length of their experience, and after

detailed discussions, recommended the following two panels, each in alphabetical order, for

consideration of the Selection Committee as provided in section 12(3) of the RTI Act for making

recommendations for appointment of Information Commissioners:

6. Keeping in view the urgent need to fill the vacancies of Information Commissioners and

that seeking report from the Central Vigilance Commission would take considerable time, the

Committee decided that DoPT may seek reports in respect of all the shortlisted persons from

the Central Bureau of Investigation as to whether these persons are under any investigation by

the CBI. The Committee also decided that DoPT may also obtain reports from the Intelligence

Bureau in respect of all the shortlisted persons and vigilance clearance from the respective

Cadre Controlling Authorities.

Declarations and directions of the Supreme Court in its judgement dated 03/09/2013 in Review petition in Namit Sharma Case

"Under Order XL of the Supreme Court Rules, 1966 this Court can review its judgment or order on the ground of error apparent on the face of record and on an application for review can reverse or modify its decision on the ground of mistake of law or fact. As the judgment under review suffers from mistake of law, we allow the Review Petitions, recall the directions and declarations in the judgment under review and dispose of Writ Petition (C) No. 210 of 2012 with the following declarations and directions:

(i) We declare that Sections 12(5) and 15(5) of the Act are not ultra vires the Constitution.

(ii) We declare that Sections 12(6) and 15(6) of the Act do not debar a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case may be, or a person holding any other office of profit or connected with any political party or carrying on any business or pursuing any profession from being considered for appointment as Chief Information Commissioner or Information Commissioner, but after such person is appointed as Chief Information Commissioner or Information Commissioner, he has to discontinue as Member of Parliament or Member of the Legislature of any State or Union Territory, or discontinue to hold any other office of profit or remain connected with any political party or carry on any business or pursue any profession during the period he functions as Chief Information Commissioner or Information Commissioner.

(iii) We direct that only persons of eminence in public life with wide knowledge and experience in the fields mentioned in Sections 12(5) and 15(5) of the Act be considered for appointment as Information Commissioner and Chief Information Commissioner.

(iv) We further direct that persons of eminence in public life with wide knowledge and experience in all the fields mentioned in Sections 12(5) and 15(5) of the Act, namely, law, science and technology, social service, management, journalism, mass media or administration and governance, be considered by the Committees under Sections 12(3) and 15(3) of the Act for appointment as Chief Information Commissioner or Information Commissioners.

The Union of India is in the process of making appointments to the post of

Information Commissioners in Central Information Commission.

2. As per Section 12(3) of the Act, the Chief Information Commissioner and Information Commissioners shall be appointed by the President on the recommendation of a committee consisting of—

(i) the Prime Minister, who shall be the Chairperson of the committee;

(ii) the Leader of Opposition in the Lok Sabha; and

(iii) a Union Cabinet Minister to be nominated by the Prime Minister.

Explanation.—For the purposes of removal of doubts, it is hereby declared that

where the Leader of Opposition in the House of the People has not been

recognised as such, the Leader of the single largest group in opposition of the

Government in the House of the People shall be deemed to be the Leader of

Opposition.

3. Lok Sabha Secretariat is requested to kindly clarify whether any leader of

opposition in the Lok Sabha has been recognized. If the leader of opposition in the

Lok Sabha has not been recognized as such, it is requested to kindly intimate the

name of the leader of the single largest group in opposition of the Government in

Lok Sabha, for the purpose of selection of Information Commissioners as per the RTI

The Government of India has constituted a body under the Right to Information Act, 2005 (the Act) known as the Central Information Commission to exercise the powers conferred on and to perform the functions assigned to it under the Act. It is located in New Delhi. The Commission shall have the Chief Information Commissioner and upto ten Information Commissioners. It has been observed that most of the societies have so far responded partially to the verification process despite the efforts made by the department and has not even removed the specific deficiency conveyed to them in respect of each member so far. While some of the societies have facilitated physical /personal verification of some of their members, most of the societies have been observed to be reluctant to participate in the process of physical/personal verification of members. Thus out of a total of 1141 persons claimed by thesetocieties as their members. Only 74 numbers of members have appeared in person so far and got their documents as available with them, verified in respect of their membership. Now, therefore one final opportunity is given to the representative of these 11 societies to present themselves alongwith all remaining members of their society during office hours for verification of documents as well as identification of members on dates given in the below mentioned table before officers against each society:-

Kindly refer to this Department's sanction letter of even number dated the 16th

July,2014 and the Letter of Authorisation No.Pr.AO/DPAAR/26/Authorisation/2014-15/990,

dated the 18th July, 2014 (copies enclosed). In this connection it is stated that the above LoA

for Rs.3,77,727/- was issued for advertisements issued in newspapers. It is now requested that

the above amount may kindly be utilized by DAVP for audio visual for settling the bills relating

to production of creatives on Right to Information instead of print advertisement.
