EXPLANATORY NOTE
The system of origin rules used by the Community in its preferentialtrading Agreements is based on the concept of sufficient working orprocessing . As the general rule this is defined as sufficient workingor processing to cause the product to be classified in a differenttariff heading than that of each of the imported components used . "There are two lists of exceptions ! one , List A , is when in addition

certain specific rules have to be met and the other , List B , wherea change of tariff heading ie not obligatory provided that certainconditions are met instead . ' J
The tariff headings used for this system are those of the CustomsCo-operation Council Nomenclature ( CCCN ) ( formerly the Brussels TariffNomenclature ( BTN ). The CCCN will be considerably modified as fromT.1.1978 and consequently to maintain the present economic effects of

the Lists A and B they will have to be modified * The Lists A and Bannexed to the draft decision contain the . necessary modifications *
Nevertheless at the time the Decisions are made it is proposed thatthe Joint Committees adopt a joint declaration covering the possiblecases where the modified Lists A and B result in economic consequencesprejudicial to the sectors involved. The Joint Committees shall in
such cases re-examine urgently the origin rule for the product in question and if necessary change the rule - so as to re-establish the situation existing before 1*1*1978 - following the procedures laid down inthe Origin Protocol#
The declarations shall be valid until 31 December 1979 to give a reasonable period to evaluate any unforeseen results of the Amendments *

For reasons of simplification It Is proposed to replace the Lists Aand B as a whole *
In addition , the CCCN has been modified to provide a simplified methodfor the tariff classification of sets , which has necessitated the introduction into the Origin Protocol of a new rule on sets designed to maintain the status quo , with the exception of introducing a tolerance ruleof 15# for n<5B-originati»g articles as a measure of simplification ,

various Decisions adopted by the Joint Committees . Other JointCommittee Decisions have introduced some procedures simplifying the
application of the Protocols .
With the aim of making the task of traders end customs' administrationsimpler tnd in the interest of assuring the proper working of theAgreement , it is felt to be time to replace the Decisions refered toabove and certain posts of Protocol No 3 by a single Decision , thusfurthering the possibility of ftet&blishing a single text including allthe provisions concerned# ; •

Joint Declaration concerning the review of the changes to Lists A and Bas a result of the Customs Cooperation Council Nomenclature modifications
As a result of the amendments made to the Customs Cooperation Council
Nomenclature , new lists A and B have been introduced by Decision No 177 .If it should appear that , as a result of the simplification in wording , thenew lists have the effect of changing the substance of any rule or rulesexisting prior to the said Decision, and if such change results in a situationprejudicial to the interest of the sectors concerned , then , where any ofthe contracting parties so requests , an urgent examination shall be conducted ,before 31 December 1979 and under the proceudre laid down in Article 28 ofProtocol No 3, with a view to determining whether it is necessary to restorethe effect of the rule or rules concerned as it was before the adoption of thesaid Decision .

whereas an Agreement between the European Economic Community and. ( 2 ) ( 3 ) was signed on CO
and entered into force on ( 5 );« ,
whereaB by virtue of Article 28 of Protocol No 3 concerning the definition of the concept of originating products and methods of administrative cooperation , which forms an integral part of the above Agreement ,the Joint Committee has adopted Decision No /77 adding to andmodifying Protocol No 3 and replacing certain Joint Committee Decisions ;
whereas it is necessary to apply this Decision in the Community ,

v Whereas for the purposes of implementing the Agreement , the rules of. origin laid down as regards both the conditions under which productsacquire the status of originating products and proof of such status and ,the detailed rules for verifying it in accordance with the said Protocol ,have been amended by a number of Joint Committee decisions ; whereas other
f decisions of the said Committee have introduced certain procedures» . simplifying implementation of that Protocol ;
. Whereas it 1s therefore appropriate for the proper functioning of theAgreement to incorporate in a single text all the provisions . in question

These provisions shall be applied only when such goods are' not imported by way of trade and have been declared ^s meeting the '•conditions required for the application of the Agreement , an(*

Importations which are occasional and consist solely of goods for thepersonal use of the recipients or travellers or theif families shallnot be considered as importations by way of trade if it -is evident ;-from the nature and quantity of the goods that no commercial purpose16 1n view.

• 1 . An EUR . 1 certificate shall be Issued by the customs authoritiesof the exporting State when the goods to which it relates are exported .7t shall be made available to the exporter as soon as actual exportationhas been effected or ensured .
2. The FUR . 1 certificate shall bo issued by the customs authoritiesof a Member State of the European Economic Community if the goods to beexported con be considered as products originating in the Community within
„ the meaning of Article 1 ( 1 ) of this Protocol ;
The EUR . 1 certificate shall be issued by the customs authoritiesof < 1 ) if the goods to be exported can be considered a s productsoriginating in ( 1 ) within the meaning of Article 1 ( 2 ) D f this Protocol .
3 . The customs authorities of the Member States of the Community or ( 1 )may issue EUR.1 certificates under the conditions laid down in the Agreementsreferred to in Article 2 of this Protocol if the goods to be exported can beconsidered as products originating In the Community , in or in .,
, . , f or ( 2 ) within the meaning of Article 2and, where applicable, Article 3 of this Protocol and provided that the goods
■ t' . covered by the EUR.1 certificates are 1n theCommunity or ( 1 >»
Where Article H , and where appropriate,.' Article 3 of this Protocol are applied, tEUR.1 certificates shall be issued by the customs authorities of each of •.
1 the countries concerned where the goods have either been held beforetheir re-exportation in the same state or undergone the working orprocessing referred to in Article 2 . of this Protocol , upon presentation of'the EUR . 1s certificates issued previously .
An EUR.1 certificate may be issued only where it can serve as thedocumentary evidence required for the purpose of implementing the 'preferential treatment provided for in the Agreement .

5 . In exceptional circumstances an EUR.1 certificate nay also be issuedafter exportation of the goods to which 1t relates If 1t was notIssued at the time of exportation because of errors, Involuntaryomissions or special circumstances .

* following phrases : "NACHTRAGLICH AUSGESTELLT", " DELIVRE A POSTERIORI ","RILASCIATO A POSTERIORI ", "AFGEGEVEN A POSTERIORI ", " ISSUED RETROSPECTIVELY" "UDSTEDT EFTERFOLGENDE" , " ANNETTU JALKIK&TEEN", "UTGEFID EFTIRA","UTSTEDT SENERE", "EMITIDO A POSTERIORI", "UTFARDAT I EFTERHAND".
6 . In the event of the'theft , loss or destruction of an EUR.1 certificate/the exporter may apply to the customs authorities which issued it for a
• duplicate to be made out on the basis of the export documents in theirpossession . The duplicate issued in this way must be endorsed with one .of the following words : "DUPLIKAT", "DUPLICATA", "DUPLICATO", "DUPLl-CAAT", "DUPLICATE"* "KAKSOISKAPPALE", "SAMRIT", "SEGUNDA VIA".
The duplicate , which must bear the date of Issue of the originalEUR.1 certificate, shall take effect as from that date . «
, 7" The endorsements referred to in paragraphs 5 and 6 shall be inserted inthe "Remarks" box of the EUR.1 certificate . '
8 . It shell always be possible to replace one or more EUR.1 certificatesby one or more EUR.1 . certificates, provided that this is done at the customsoffice where the goods are located .
^ For the purpose of verifying whether the condition* stated In paragraphs 2 and 3 have been eat , the custoasauthorities shall have the right to call for any documentary evidence or to carry out any check vhloh theyconsider appropriate . Article 10
1 * An EUR.1 certificate shall be issued only on application having beenmade in writing by the exporter or, under the exporter 's responsibility ,by his authorized representative , on the form^a specimen of which isgiven in Annex V to this Protocol , which shall be completed in accordancewith this Protocol .
<*• It shall be the responsibility of the customs authorities of the exportingcountry to ensure that form referred to in paragraph 1 is properlycompleted . In particular,they shall check whether the box reserved
t for the description of the goods has been completed in such a manneras to exclude any possibility of fraudulent additions . To this end , thedescription of the goods must be given without leaving any blank lines *
' Where the box is not completely filled a horizontal line must bedrawn below the last line of the description, the empty space beingcrossed through . » .
Since the EUR.1 certificate constitutes the documentary evidencefor the application of the preferential tariff and quota arrangementslaid down in the Agreement , it shall be the responsibility of thecustoms authorities of the exporting country to take any steps necessaryto verify the origin of the goods and to check the other statements oftthe certificate *
The exporter or his representative shall submit with his request anyappropriate supporting document proving that th® goods to he exportedqualify fop the Issue of an gURel

3 * When an E'JR.1 certificate 1s Issued within the meaning of Article 9 ( 5 )of this Protocol after the goods to which 1t relates have actually been

Article 11
1 * EUR.1 certificate * shall be made out on the form a specimen of which1s given in Annex V to this Protocol . This form shall be printed in oneor more of the languages in which the Agreement is drawn up . EUR.1 certificatesshall be made out in one of those languages and in accordance with theprovision ; of the domestic law of the exporting State ; if they arehandwrittrn, they shall be completed., in Ink in capital letters .
2 « Each EUR.1 certificate shall measure 210 x 297 mm, a tolerance of up to 5 »»less and 8 mm more being permissible as regards length , lhe paper usedmust be white-sized writing paper not containing mechanical pulp andweighing not less than 25 g /m . It shall have a printed green guillochepattern background making any falsification by mechanical or chemicalmeans apparent to the; eye . '
3 * The Member States of the Community and ( 1 ) may reserve the rightto print the EUR.1 certificates themselves or may have them printed by
. approved printers . In the latter case , each EUR.1 certificate must includea reference to such approval . Each EUR.1 certificate must bear the name andaddress of the printer or a mark by which the printer can be Identified .It shall also bear a serial number, either printed or not , by which it can'
' • be Identified .Article 12
. i » An EUR.1 certificate must be submitted, within four months of liv dateof issue by the customs authorities of the exporting State , to thfcustoms authorities of the importing State whi»r* the goods are enter*W .
• in accordance with the procedures laid down by that State . The saidAuthorities may require a translation of a certificate . They may alsorequire the import declaration to be accompanied by a statement fromthe importer to the effect that the goods meet the conditions requiresfor the implementation of the Agreement .
Without prejudice to Article 5 (3) of this Protocol , where, at the request,of th^person declaring the goods at customs a dismantled or non-assembledarticle falling within Chapter 84 or 85 of the Nomenclature is importedby instalments on the conditions laid down by the competent authorities ,it shall be considered to be a Single article and an EUR.1 certificate•>*/ b« s'iSvnitted for the whole article upon importation of the firstInstalments

EUlVl certificate which Is submitted to the customs authoritiesof the Importing State after the final date for presentation specifiedin oaragraph 1 may be accepted for the purpose of applying preferential
• treatment / where the failure to submit the certificate by the finaldate set is due t0 reasons of force majeure or exceptional circumstances .In other cases of belated presentation , the customs authorities $)fthe importing State may accept the EUR.1 . certificates where the goods havebeen submitted to them before the said final date .
L The discovery of slight discrepancies between the statements made 1nthe EUR 1 certificate and those made in the documents submitted tothe customs office for the purpose of carrying out the formalities forimoorting the goods shall not ipso facto render the certificate nulland void , provided it Is duly established that the certificate correspondsto the goods .
5 ei id v certificates shall be preserved by the customs authorities• of the importing State in accordance with the rules in force in that■ State .
6* Proof that the conditions set out in Article 7 of this Protocol havebeen met shall be provided by submission to the customs authorities of
^ the importing State of either »,• a ) a single supporting transport document / made out in the exporting
State, under the cover of which the transit country has been crossed /or .
b) a certificate issued by the customs authorities of the transit countrycontaining :
< i ) an exact description of the goods ,
' v ( ii ) the date of unloading and reloading of the goods and, whereapplicable , the names of the ships,
(Hi ) certified proof of the conditions under which the goods havestayed in the transit country;

c) or , falling these, any substantiating documents . •• < VI
Article 13
V By derogation to Article 9 ( 1 ) to ( 6 ) _ EUR «and ( 6 ) of this Protocol/a simplified procedure for the Issue of EUR.l .' certificates Is applicable undof the provisions below# .
The custor»3 authorities in the exporting State may authorize anyexporter , hereinafter referred to as " approved exporter", who satisfiesthe conditions set out ir. paragraph 3 and who intends to carry outtransactions for which EUR . 1 certificates may be issued , not to submitto the customs office in the exporting St^te at the time of exporteither the goods or the application for an EUR . 1 certificate relatingto those goods , for the purpose of obtaining an EUR . 1 certificateunder the conditions laid down in Article g ( 4 ) Article 9 C1 ) to ( 4) and
^Article 12 ( 2 ) of this Protocol * ••
The customs authorities in the exporting State may declare ceftaincategories of goods ineligible for the special treatment provided ,for in paragraph 1 .
The authorisation referred to in paragraph 2 shall be granted only toexporters making frequent shipments and who offer , to the satisfactionof the authorities , all guarantees necessary to verify the originatingstatus of the products *

The customs authorities shall refuse such, authorization to exporterswho do not offer all the guarantees which' they consider necessary.
• •
The customs authorities may withdraw the authorization at any time .They must do so where the approved exporter no longer satisfies theconditions or no longer offers these guarantees .
The authorization shall stipulate, at the choice of the customsauthorities , that box No 11 , "Customs Endorsement"/ of the EUR . 1certificate must
a ) either be endorsed beforehand with the stamp of the competent customsoffice of the exporting State and the handwritten or non-handwrittensignature of an official of that office, or
b) be endorsed by the approved exporter with a special stamp whichhas been approved by the customs authorities of the exporting Stateand corresponds to the specimen given in Annex VII to this Protocol ;this stamp may be preprinted on the forms*

The customs authorities in the exporting State may carry out anycheck on the approved exporter which they consider necessary. The ,approved exporter must allow this to be done .

Article H
1 * Form EUR . 2 shall be completed and signed by the exporter or , under' his. responsibility , by his authoritzed representative . It shall be
made out on the form of which a specimen is given in Annex VI . Thisform shall be printed in one or more of the languages in which theAgreement is drawn up . It shall be made out in one of those languagesand in accordance with the provisions of the domestic law of the ex*porting State . If it is handwritten it must be completed in ink andfin capatal letters .
2 * One form EUR . 2 shall be completed for each consignment .
. 3 * 'Form EUR . 2 shall be 210 x 148 mm . A tolerance of up to plus 8 mmor minus S mm in the length may be aLlowed . The paper used shall bewhite-sized writing paper not containing mechanical pulp and weighingnot less than 64 g /m2 . •
A. The Member States of the Community and ^ may reserve the rightto print the forms EUR . 2 themselves or may have them printed by printers
• approved by them . In the Hotter case each form must bear a referenceto such approval . In addition , the form must bear the name and addressof the printer or a mark by which the printer can be identified . Itshall also bear a serial number/ whether or not printed, by which Itcan be identified .

Article 16
1 * In order to ensure the proper application of this Title , the MemberStates of the Community artd ( 1 > shall assist each other , throughtheir respective customs administrations , in checking the authenticityand accuracy of EUR.1 certificates , including those issued underArticle 9 ( 3 ) of this Protocol , and the exporters' declarations made ,on forms EUR . 2 . i
2. The Joint Committee shall be authorized to take any decisions necessaryfor the methods of administrative cooperation to be applied at thedue time in the Community and in . _ ( 1 ).
3 . The customs authorities of the Member States and ( 1 ) shall provideeach other , through the Commission of the European Communities , withspecimen impressions of stamps used in their customs offices for theissue of EUR.1 certificates .
4« Penalties shall be imposed on any person who , drawi up or causes to bedrawn up, a form which contains incorrect particulars for the purpose ofobtaining a preferential treatment for goods . This paragraph applies mutatisMutandis- in the case of the use of the procedure laid down in Article 13 ofthis Protocol .
S « The Member States and ( 1 > shall take all necessary steps to ensurethat goods traded under cover of an EUR.1 certificate , which in thecourse of transport use a free zone situated in their territory, arenot substituted by other goods and that they do not undergo handlingother than normal operations designed to prevent their deterioration.
6* When products originating in the Community or ( 1 ) and importedinto a free zone under cover of an EUR.1 certificate undergo treatmentor processing , the customs authorities concerned must Issue a new EUR.1certificate at the exporter 's request if the treatment or processing'undergone is in conformity with the provisions of this Protocol. ... v!

Article 17
Subsequent verif i cations of EOrH .. certificates and of forms EUR . 2shall be carried out at random or whenever the customs authoritiesof the importing state have reasonable doubt as to the authenticityof the document or the accuracy of the information regarding the trueorigin of the goods in question .
2* For the purpose of implementing the provisions of paraqr*oh 1 , the customsai/chorities of the importing State shall return the EUR.1 certificate *or the form EUR . 2 or a photocopy thereof , to the customs authoritiesof the exporting State , giving , where appropriate , the reasons ofsubstance or form for an inquiry. The invoice, if it has been submitted ,or * copy thereof shall be attached to the EUR.1 certificate or to the form EUR . 2and the customs authorities shall forward any information that has been obtainedsuggesting that tne particulars given on the said certificate or thesaid form are inaccurate. ^

If the custom - authorities of the Importing Stat <* decide to suspendthe provisions of the Agreement while awaiting the results of theverification , they shall offer to release the goods to the importersubject to any precautionary measures judged necessary .
The customs authorities of the importing State shall be informed ofthe results of the verification as soon as possible . These resultsmust be such as to make it possible to determine whether the disputedLUR .1 certificate or form EUR . 2 applies to the goods actuallyexported , and whether these goods can / in faot , qualify for applicationof the preferential arrangements .
; *Where such disputes cannot bp settled between the customs authoritiesof the importing State and those of . the exportinq State or where theyraise a question as to the interpretation of this Protocol they shallbe submitted to the Customs Committee *
For the purpose of the subsequent verification ov EUR.1 certificates,, thecustoms authorities of the exporting country must keep the exportdocuments, or copies of EUR.1 certificates used in place thereof/ for notless than two years * "
