selected agencies & in this case decision of the undersigned is final in all respect'

document at anY stage of tender

Bidder or any Bidder for verification of original

Enverope-A & B wi[ have to be submitted to the tender box which wiil be kept in the office of the undersigned

as per schedured date and time mentioned herein. Tender paper may be submitted by post and it should reach

the undersigned within one hour before on the date and time of opening. Envelope-A & B received after the

schedured time and date wilr not be entertained. Tender papers wiil be opened as per given date and time in

the office chamber of the undersigned'

The intending applicant(s) or his authorized representative may remain present at the time of opening of

tender along with ldentity card & proper authorization of the applicant in his letter head'

lf any of the above mentioned date is declared as holiday, the particular event will occur on the next working

day & the date of subsequent events will also change similarly on the next working days'

Before submission of the tender the applicant must visit the work site to judge the local conditions from all

aspects and no plea / complaint will be entertained thereafter during the execution of work' lt will be

presumed that the appricant has offered the tender after reviewing entire position of the work site' Details of

estimatecanbeseenfromthisofficeinanyworkingdayuptoo4.oopm.Theapplicantswhowillnotsubmittender paper or do not return the same before the date and time of dropping after receiving the same, will not

be allowed to participate in three consecutive tenders'

undersigned will not be bound to issue work order to the lowest bidder if found, this is necessary for the better

execution of the work. This office will not be responsible for the loss of tender form or application or bank

draft.

11. The successfur Appricants wilr have to execute a formar agreement on a Non-judicial stamp paper worth Rs' t0/-

(Rupees Ten) in the prescribed format within three working days from the date of issue of work order non-

compliance of which will invite cancellation of the work order'

12. The undersigned reserves the right to call all the Applicants in table bid if it is found that the all the quoted rate

is above the estimated rate & in any other situation as the undersigned desires as per his discretion'

,,. Time is the essence of contract. The successful Agency must start the work within two days from the date of

givingoflayoutfailingwhichtheundersignedmaycanceltheworkorderandforfeittheearnestmoney.Ther^prk should be completed within the prescribed time. No extension of time will be allowed except in special

case if it is found that the delay caused due to such reason which is beyond the control of the Agency and the

decision of the undersigned wiil be finar in this respect. A penarty (a). 0.1% (Zero point one percent) of the

varue of work order wiil be imposed on perday deray at severar stages of work. rn case of inordinate delay, the

undersigned reserves the right to cancer the work order at any time of work, forfeiting the earnest money & the

amount of work done and the Agency may be black listed. The undersigned may also proceed to get the

balance work completed by engaging other Agency or departmentally. The excess expenditure if any, due to

suchastepwouldberecoverablefromtheunpaidbilts&earnestmoneyofthedefaultingAgency.

14. Ail works wiil have to be done according to specifications and drawing approved by the authority and as per

direction of s.A.E /Jr. Engineer in-charge of this scheme under the overail supervision of Executive officer,

chhatna panchayet Samity & Block Development officer, chhatna Dev. Block. Prior approval should be taken

regarding quarity & quantity of materiars. Agency or his representative must keep a copy of the estimate at the

work site for lnspecting Authority as well as intending beneficiaries etc' use of substandard quality of materials

will be treated as a breach of contract with the panchayat Samity / Block Dev. office & subsequent legal action

will be taken against him which incrudes forfeiture of earnest money & withheld the payment of the entire

amount of work.

15. No consumable materials will be supplied to the Agency for any work from the office of the undersigned'

Agency will be responsible for procuring ail materials required for proper execution of work at his own cost' All

working toors and prants and imprements required for the work have to be arranged and supplied by the

successful Agency at his own cost. claim for idle labour, vehicle etc. from Agency will not be entertained under

any circumstances. No claim will be entertained for any increase in Railway freight and market price, royalty of

materials etc. No claim will be entertained regarding accidental damage at work site'

16. Before starting the work, site must be dressed and creared by cutting ail sorts of jungle, shrubs etc' for which no

extrapaymentwillbemade.SiteclearancealsohastobedonebytheAgencyafterthecompletionoftheworkfor which no extra payment will be made'

17, Payment deduction(s) will be made as per Govt' norms'

18. Payment will be made as and when fund is available from the concerned source'

,,. For materiars that wi, be used in the work against which payment of royarty and cess (as appricabre) to

competent authority is mandatory under any existing act or rule, original copy(s) of challan(s) as proof of

deposition of royarty is/are to be produced at the time of processing of bi[ fairing which bills shall not be

entertained.

24. since notification if the undersigned finds that the Agency or anybody rinked to it either directly or indirectly

is/are engaged in any untoward & unlawful activities either directly or indirectly during the whole process

which can affect the proper execution of work, legal action will be taken by the undersigned which includes

canceration of work order, forfeiting of earnest money, security& other payments, blacklisting the Agency &

any other action as the undersigned deems fit as per law'

27. The contractor,s responsibirity to keep the road opens to ail kind of traffic during the execution of work' No

claim what-so-ever will be entertained for idle labour , establishment cost of hire & labour charges of tools &

plants and any unwanted incidentsetc' at any circumstances'

28. lncome Tax @ L I 2 % (as applicable), relevant GST Rules under GST Act,2OL7 shall be applicable in the time of

billing, Labour Welfare Cess @ L% and other statutory deductions at the Govt. prescribed rate will be deducted

at source during payment of each bill (R/A or Final). (Rate may be changed as per direction of competent

authority)

8(Eighr) % value of the work will be deducted as Security deposit from the progressive / final bill & 10 (ten)

% Security deposit (including the2% earnest money) which will be released after one year from the date of

completion subject to condition that no defect appears in the work. ln case of defects found within one year

the same should be repaired properly by the contractor in his own cost and after repairing, the earnest money

may be released in full or part depending on the nature of defect.

30. Contractor has to arrange to display the signboard at the site before starting the job indicating the following

or as per proforma.Name of the work. ii) Name & nature of the contract. iii) Name of the Executing Agency. iv) Name & Address of

the Contractor. V) Estimated amount. Vi) From which fund the work is being executed vii) Time of completion.

31, As per Memorandum no. 4608-F(Y) dated tSlOT/zOtB of Finance Deptt, Audit Branch & the Addl. Chief

SecretarytotheGoW.of WestBengal 'Addl.PerformanceSecurity' @tO%of thetenderedamountshall be
