CHIEF JUSTICE

The Judicial Service Commission of Kenya invites applications

from qualified persons for the following positions in the Judiciary:

1. CHIEF JUSTICE OF THE REPUBLIC OF KENYA (1 POST)

Ref. V/No. 1/2011 Terms of Service: Constitutional Office

Period of Service: Maximum ten years subject to retirement age of seventy (70) years

Functions:

The Chief Justice shall discharge the following functions:

(a) Be the Head of the Judiciary.

(b) Be the President of the Supreme Court.

(c) Convene and Chair the Judicial Service Commission meetings.

(d) Be the link between the Judiciary and other arms of

Government.

(e) Assign duties to the Deputy Chief Justice, the President of the

Court of Appeal, the Principal Judge of the High Court and the Chief Registrar of the Judiciary.

(f) Give an annual report to the Nation on the state of the Judiciary and the administration of Justice.

(g) Exercise general direction and control over the Judiciary.

(h) Chair the National Council on Administration of Justice.

(i) Oversee the management and administration of the Judiciary Fund.

(j) Discharge any other functions as required of him or her by the Constitution and any other legislation.

Constitutional and Statutory Requirements for Appointment:

For appointment to the position of Chief Justice, the applicants

must be in possession of the following minimum qualifications:

(a) Hold a law degree from a recognised university or are an

advocate of the High Court of Kenya or possess an equivalent qualification in a common-law jurisdiction.

(b) Possess at least fifteen (15) years experience as a Superior Court Judge or a distinguished academic or a Judicial Officer

or a Legal Practitioner in other relevant legal field, or

(c) Hold the outlined qualifications in (a) and (b) above for a

period amounting, in the aggregate, to fifteen (15) years.

(Experience gained in Kenya or in another Commonwealth

Country with a common-law jurisdiction will be considered).

(d) Have a high moral character, integrity and impartiality.

In addition to the above qualifications, the candidates must have demonstrated a high degree of professional competence,

communication skills, fairness, good temperament, making good judgements in both legal and life experiences, and

commitment to public and community service.

2. DEPUTY CHIEF JUSTICE OF THE REPUBLIC OF KENYA (1

POST)

Ref. V/No. 2/2011

Terms of Service: Constitutional Office

Functions:

The Deputy Chief Justice shall discharge the following functions:

(a) Deputise the Chief Justice.

(b) Be the Vice-President of the Supreme Court.

(c) Be responsible to the Chief Justice in the exercise of the duties

assigned to him or her.

(d) Discharge any other functions as required of him or her by the

Constitution and any other legislation.

Constitutional and Statutory Requirements for Appointment:

For appointment to the position of Deputy Chief Justice, the applicants must be in possession of the following minimum

qualifications:

(a) Hold a law degree from a recognised university or are an

advocate of the High Court of Kenya or possess an equivalent qualification in a common-law jurisdiction.

(b) Possess at least fifteen (15) years experience as a Superior Court Judge or a distinguished academic or a Judicial Officer

or a Legal Practitioner in other relevant legal field, or

(c) Hold the outlined qualifications in (a) and (b) above for a

in accordance with the provisions of Article 166 (1) (a) of the Constitution read with section 24 (2) of the Sixth Schedule.

applicant’s bio-data including; background information (such as community service, financial discipline, pro bono activity, involvement

as a party in litigation and involvement in political activity including any financial contribution to any political party/parties and criminal

record) legal education, legal practice / engagement for the last five (5) years, three (3) professional references and two (2) character

references who can verify and comment on the applicant’s past and present employment,

(3) Completed Application for Employment Forms in triplicate - JSC 2A (for public officers) or JSC 2 (for other applicants),

(4) Five (5) samples of any writings by the applicant, including but not limited to Judgements, scholarly writings or any legal publications

that the applicant has authored,

(5) The applicant’s three recent coloured passport size

photographs,

(6) Declaration of income and liabilities as at the time of making

the application, using the prescribed forms. For those who are in Government employment, attach copies of returns of declaration of

income and liabilities and for those in private practice attach income tax returns, for the last three (3) years,

(7) Certified copies of testimonials and professional certificates

and academic transcripts,

PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environment

Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed

housing development.

The proposed project comprising of a comprehensive middle cost housing estate, will by design constitute 50 town houses-135sq meters

(Type A), 34 town houses-150sq meters (Type B), the other two types 17 town homes (Type C & D)-180sq meters and all the supporting

amenities. In total, one hundred and one (101) town housing units will be established in the proposed estate.

The proposed project will be located on Eldoret Municipality Block 14/1197 in the leafy Elgon View area of Eldoret town of

Taragwa (Uasin Gishu South) District. The subject parcel of land measures 13.09 ha whereby, the proposed estate will be subdivided

into one hundred and one (101) 1/8th acres pieces each with clean and unencumbered legal titles.

The following are the anticipated impacts and proposed mitigation measures:

atlas petrol station.

The proposed development entails construction of a petrol station and ancillary facilities.

The Proposed Petrol Station is Located along Kawangware Road

off Naivasha Road in Kawangware Estate on plot LR. NO. Dagoretti/Riruta/4286. The site is directly opposite Kenya Bus Service

Limited Yard in Kawangware along Kawangware road.

The following are the anticipated impacts and proposed mitigation

measures:

PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed La Nyavu housing project.

The proposed development comprises five different designs totaling to 130 units. The units are grouped into five clusters namely cluster A, cluster B, cluster C, cluster D, cluster E. Each of the clusters is described as follows:

Cluster A will have 26 units (also known as country house A) –The units will occupy 526 sqm.

Cluster B will have 26 units (also known as Country house B) each occupying 434 sqm.

Cluster C will have 26 units (also known as traditional) occupying 495 sqm.

Cluster D will have 26 units each (also known as Cape Dutch) occupying 536 sqm.

Cluster E will have 26 units each (also known as Mountain) occupying 417 sqm.

The proposed project will be located on land parcel number, 2259/703, Fair acres, Off Bogani Road, Nairobi. The parcel of land measures 72.5 acres.

The following are the anticipated impacts and proposed mitigation measures:


Air pollution &dust

FOR THE PROPOSED MIGAA MIXED DEVELOPMENT PROJECT IN KAMITI LOCATION, KIAMBAA DIVISION,

KIAMBU DISTRICT


PURSUANT to regulation 21 of Environmental (Impact

Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental

impact assessment study report for the implementation of the proposed Migaa mixed development project.

The proposed project shall comprise of development of a mixed

project which will include among others apartments, villas, shopping malls, boulevard and street scapes, country club, office parks, spa,

pools and water park, golf course, schools and other amenities in the

774 acres plot. The land use will be as follow, residential 343.33 acres,

communal facilities 22.87 acres, hotel 15.32 acres, commercial 19.69 acres, education 9.19 acres, pen space including golf course 339.2

acres and roads 24.58 acres.

The proposed site is located 16.5 km. from the Muthaiga roundabout at Kamiti Location of Kiambaa Division in Kiambu

District, Central Province. The project will be on 6 parcels of land namely L.R. Nos. 4890/5, 4890/4, 5866 (orig. No. 98/3/1), 4925 (orig.

No. 98/4/2), 4889, and 4890/3 amounting to 774 acres.

The following are the anticipated impacts and proposed mitigation measures.



Ensure that building plans are approved by Kiambu County Council.

Workers will be provided with adequate PPEs during the construction phase, these will include working boots, overalls, helmets, goggles, earmuffs and goggles. Workers will also be provided with harnesses and proper secure equipments for scaling heights.

The construction workers will also be sensitized on social issues such as drug abuses, use of alcohol and occupational diseases.

Workers will be provided with a well stocked First Aid Box which will be replenished at all times and managed by trained first aiders.

The proponent will ensure that the contractor through the Project Manager obtain a workmen’s act, as well as ordinance and regulations.

Adequate sanitary facilities will be

provided with proper segregation for both genders where applicable.

Contractor will ensure that people

provide food to the workers have been sensitized on safe handling of food to

avoid outbreaks of food poisoning.

Soil erosion and compaction

The proponent will ensure that watering is done during excavation and adequate

screens will be provided.

Landscaping will be done on the land

during the decommissioning phase to ensure that the same is returned to its

original state.

The contractor will provide adequate soil conservation structures to ensure

that areas prone to soil erosion are protected from runoff.

Air and dust pollution While construction of building is going

on, water shall be sprayed on excavated areas.

There shall be proper maintenance of

equipment and vehicles.

Noise pollution and excessive vibration

The exercise will only be carried during working hours.

Workers will be provided with ear plugs.

The proponent will also establish the noise levels for the various equipments

to be used.

Proponent will also provide barriers for noise.

Increase in solid waste Proponent will use an integrated solid

waste management system by source reduction, recycling, composting, reuse

or sanitary land filing.


The proponent will ensure that debris is collected by a NEMA approved waste

There will be a central collection point

for waste generated preferably with segregation of the same.

The proponent will provide or construct

ADDENDUM 1: RUIRU WATER SUPPLY PROJECT, RUIRU MUNICIPALITY



Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed

Ruiru Water Supply project.

The project involves construction and commissioning of the Ruiru water supply project that will supply to the residents of Ruiru town up

to 10,000m3 of water per day.

The proposed project intakes works is located at the confluence of

Ruiru and Komothai Rivers next to Coffee Research Foundation, within Ruiru District.

The project anticipates the following impacts and mitigation measures:


Physical setting, flora and

fauna

Provide structures that will not hinder

free movement of animals.

Structure shall not block drainages.

Grade sites to original levels to maintain topography.

Compensation/replacement for uprooted cash crops destroyed.

As much as practical limit the amount of vegetation cleared during works.

Interruption of key infrastructure

installations

Establish the nature of all stakeholders.

Identify key interests of each of the stakeholders.

Formally liaise with the stakeholder and

communicate the project details to them with a view of developing a work plan.

Implement work plan.

Acquire Certificate of Satisfactory Works Completion.

Compensation and land

take

Land take shall be minimized where

feasible, exploring all viable alternative project designs e.g. realignment of the

pipeline may significantly reduce compensation.

Where displacement is unavoidable,

plan for compensation plans shall be developed with adequate compensation.

Noise and vibrations

management

Construction activities limited to

All equipment used during the construction phase to be regularly

maintained to ensure efficient operation;

Noise dampening materials to be used where excessive noise generating-

equipment are in use.

controls.

Energy management through use of sound equipment.

Application of rated equipment in

welding and related works.

Use of efficient mechanical plant and energy savers on sites.

manufacturers’ specifications.

Use environmentally friendly fuels.

Minimize the period for machinery idling.

Pursue good practice in energy use during operations and sensitize staff.

Provide appropriate personnel protective equipment to site workers.

Waste management All wastes shall be contained on site prior to disposal using appropriate storage containers.

All wastes shall be regularly cleared from the site and disposed of in approved manner.

High level of housekeeping shall be maintained.

Staff shall be trained/sensitized about waste management at the start of the project and regularly as may be found appropriate.

Erosion and sediment management

Develop an erosion and sediment control plan prior to commencement of works.

Design erosion control structures to address operational erosion incidences;

Provide for proper storage and sanitation utilities on site.

Provide for run-off water diversions as appropriate.

Plan for motorized machinery movement with limited disturbance of soil.

Maintain as much vegetation as may be practical at work sites.

Take corrective measures on noticing indication of land degradation.

Follow procedures for chemical handling and dispensing.

Enhance the staff appreciation through regular review and onsite training.


Liaise with the Directorate of Occupational Health and Safety Department to provide for appropriate induction training and regular updating of worker skill on occupational health and safety matters.

Provide for appropriate signage and warnings at work sites.

Use personal protective equipment (PPE) to workers and any visitors.

Provide for First Aid facilities as per the OSHA.

Provide and clearly display emergency contacts.

Develop and implement a detailed and site specific emergency response plans.
