RESOLVED:

1.2. On the Executive Secretary of the Advisory Committee.

Zhaksylykov (the Commission): informed that in accordance with paragraph 8 ofSection III of the Regulation on Advisory Committee approved by the Decision of EEC Boarddated April 27, 2015 No. 36, P. U. Suyumbaeva, Director of the Labor Migration Departmentof the Commission, was appointed the Executive Secretary of the Advisory Committee.

RESOLVED:

To take note of the information of the Member of the Board – Minister in charge ofEconomy and Financial Policy of the Eurasian Economic Commission T. M. Zhaksylykov on theExecutive Secretary of the Advisory Committee.

1.3. On the implementation of the Protocol of the second meeting of the AdvisoryCommittee.

P. U. Suyumbaeva (the Commission): reported on the implementation of the Protocol ofthe second meeting of the Advisory Committee.

RESOLVED:

To take note of the Commission’s information on the implementation of the Protocol of thesecond meeting of the Advisory Committee.

2. On the progress on the draft Agreement on Pension Benefits of Workers of the EEUMember States.

T. M. Zhaksylykov: informed about the progress on the draft Agreement on PensionBenefits of Workers of the EEU Member States (hereinafter – the draft Agreement) and theresults of the Commission meeting held on September 28, 2017 on the draft Agreement with theDeputy Heads of the authorized pension authorities of the Member States within the Instructionof the Eurasian Intergovernmental Council dated August 14, 2017 No. 8 (hereinafter – the Orderof the EIGC No. 8), as a result of which an agreement was reached to hold retreat round tables(presentations) on the draft Agreement in each Member State.

RESOLVED:

1. To take note of the information of the Member of the Board – Minister in charge ofEconomy and Financial Policy of the Eurasian Economic Commission T. M. Zhaksylykov on theprogress on the draft Agreement.

2. The Commission shall, together with authorized and competent pension authorities ofthe Member States, hold a series of retreat round tables (presentations) in the Member States inorder to inform the representatives of government authorities, deputy corps and the public of theMember States about the progress on the draft Agreement, the benefits of the Member Statesworkers and the need to sign it in accordance with the Instruction of the EIGC No. 8.

3. To kindly request the Ministry of Labor and Social Protection of the Russian Federationto send presentation materials to the Commission by October 20, 2017, about the benefits whichthe Member States workers will be able to obtain in the Russian Federation, after adoption of thedraft Agreement for use at the retreat round tables (presentations) on the draft Agreement in eachMember State (proposal of the State Secretary – Deputy Minister of Labor and Social Protectionof the Russian Federation A. N. Pudov).

4. To kindly request the authorized and competent pension authorities of the Republic ofArmenia, the Kyrgyz Republic and the Republic of Kazakhstan to send the Commission someinformation on the potential time of retreat round tables (presentations) on the draft Agreementin each Member State by October 27, 2017.

5. The Commission shall inform the Member States of the plan to hold retreat round tables(presentations) on the draft Agreement in the Member States by November 1, 2017.

3. On the progress on the draft Procedure for cooperation between the authorized,competent authorities and the Eurasian Economic Commission in the sphere of pensionbenefits.

S. V. Evdokimov (the Commission): informed on the progress on the draft Procedure forcooperation between the authorized, competent authorities and the Eurasian EconomicCommission in the sphere of pension benefits (hereinafter – the draft Protocol) following theCommission meeting held on 26-27 September 2017 between the authorized and competentpension authorities of the Member States and the draft Decision of the Council of theCommission “On the draft Procedure of the Eurasian Intergovernmental Council “On the issuesrelated to the implementation of the Agreement on Pension Benefits of Workers of the Member

States of the Eurasian Economic Union” in order to form the legal basis for the development ofthe draft Procedure and technological documents.

He noted the need to plan the work of the Member States departments on the developmentof the draft Procedure, technological regulations, which ensure information exchange in theimplementation, by means of the Union integrated information system, general processes for theapplication of the draft Procedure, as well as planning of the Parties’ relevant budgets, since thecooperation between the authorized, competent authorities of the Member States and theCommission will be carried out using the Union integrated information system.

RESOLVED:

1. To take note of the information of the Commission on the progress on the draftProcedure.

2. Approve the draft Decision of the Council of the Commission “On the draft Instructionof the Eurasian Intergovernmental Council “On the issues related to the implementation of theAgreement on Pension Benefits of Workers of the Member States of the Eurasian EconomicUnion” and submit it by the Commission to the next meeting of the Council of the Commission.

4. On the progress on technological documents governing information exchange in theimplementation, by means of the EEU integrated information system, of the generalprocesses for the application of the Procedure for cooperation between the authorizedcompetent authorities and the Eurasian Economic Commission in the sphere of pensionbenefits.

S. V. Evdokimov (the Commission): informed about the work carried out by theCommission to prepare amendments to the List of general processes within the Union, approvedby the Decision of the Board of the Commission dated April 14, 2015 No. 29 (hereinafter – theList of general processes), by amending the List of general processes with the section“Information support in the sphere of labor migration” , by adding two general processes in thesphere of pension benefits of the Member States workers.

RESOLVED:

1. To take note of the information of the Commission about the progress on technologicaldocuments which regulate information exchange in the implementation, by means of the EEUintegrated information system, of the general processes for the application of the draft Procedure.

2. Approve the draft Decision of the Board of the Commission “On amendments to the Listof general processes within the Eurasian Economic Union” (hereinafter – the draft Decision ofthe Board of the Commission), which provides for the addition to the List of general processessection: “Information support in the sphere of labor migration” including the following items:

- “Support of the exchange of electronic documents and (or) information between thecompetent authorities of the Member States of the Eurasian Economic Union, necessary for theaward and payment of pensions to workers (family members)”;

- “Support of the exchange of electronic documents and (or) information between thecompetent authorities of the Member States of the Eurasian Economic Union in order to paypensions to workers (family members)”.

3. The authorized pension authorities of the Member States shall inform the Ministries ofEconomy of the Member States about the decision and the need to complement the List ofgeneral processes to ensure operational and effective implementation of the draft Agreement andpreparation of the information systems of the competent authorities of the Member States for theinternational informational cooperation in the sphere of pension benefits of workers, andplanning of the relevant budgets of the Parties.

4. The Commission shall make a draft Decision of the Board of the Commission specifiedin paragraph 2 of this Protocol at a meeting of the Board of the Commission.

5. On the elimination of barriers, exceptions and restrictions in the sphere of labormigration and social welfare of workers of the Member States.

5.1. On the implementation of paragraph 3 of Article 98, subject to paragraph 5 ofArticle 96 of the Treaty on the Eurasian Economic Union, in terms of providingcompulsory social health insurance to workers of the Member States and their familymembers in the Republic of Kazakhstan.

P. U. Suyumbaeva (the Commission): informed on the implementation of the provisionsof the Treaty on the Eurasian Economic Union dated April 29, 2017 (hereinafter – the Treaty onthe Union) in terms of providing workers of the Member States and their family members withmedical care within the framework of the system of compulsory social health insurance(hereinafter – the CSHI) in the Republic of Kazakhstan.

B. Sh. Zhakselekova (the Republic of Kazakhstan): informed about the ongoing reformin the sphere of health protection in the Republic of Kazakhstan, as a result of which the systemof CSHI was introduced in the Republic of Kazakhstan for the first time. Since March 1, 2016the Law of the Republic of Kazakhstan dated November 16, 2015 No. 405-V ZRK “Oncompulsory social health insurance” was put into execution in the Republic of Kazakhstan,according to which since July 1, 2017 the system of CSHI and payment of contributions to theSocial Medical Insurance Fund were established in Kazakhstan. She noted that since January 1,2018, the Member States workers and their family members will be granted access to the systemof CSHI in the Republic of Kazakhstan.

RESOLVED:

To take note of the information submitted by P. U. Suyumbaeva and B. Sh. Zhakselekova.

5.2. On the implementation of paragraph 3 of Article 98 subject to paragraph 5 ofArticle 96 of the Treaty on the Eurasian Economic Union with regard to the provision ofobligatory medical insurance to family members of the workers of the Member States inthe Russian Federation.

P. U. Suyumbaeva (the Commission): informed about the settlement of the problem ofaccess to the system of compulsory health insurance (hereinafter – the CHI) in the RussianFederation for the Member States workers by amending the Rules of compulsory healthinsurance, under which the Member States nationals lawfully engaged in labor activity in theRussian Federation from January 1, 2017, gained the right to healthcare under the CHI, which isnow delivered under the same conditions and in the same manner as those of the nationals of theRussian Federation.

She noted that the provisions of the Treaty on the Union in terms of providing medical careto family members of the Member States workers were not fully implemented in the RussianFederation.

She noted that the Treaty on the Union provides for national treatment for the MemberStates nationals in the state of employment, which provides for the right to receive medicalassistance by the Member States workers on the same conditions and in the same manner asthose of the nationals of the state of employment, provided that they stay and work in the state ofemployment on legal grounds.

She stressed the need to preserve the level of integration in the social sphere achievedwithin the Treaty on the Union. She noted the importance of maintaining the scope of guaranteesfor the Member States workers and their family members provided for by the Treaty on theUnion.

Dmitry Kostennikov (the Russian Federation): noted that the volume of medical careguaranteed by the Treaty on the Union is defined in Annex 30 to the Treaty on the Union“Protocol on Provision of medical treatment of workers of the Member States and their familymembers” (hereinafter – Annex 30), according to which workers of the Member States and theirfamily members are provided with free emergency medical care (emergency and urgent care) inthe same order and on the same conditions as nationals of the state of employment. After theelimination of the immediate threat to his/her life or the health of others, the actual costs of theservices rendered shall be paid directly by the patient or from other sources not prohibited by thelegislation of the state of employment.

He noted that in those Member States where there is no compulsory health insurancesystem, workers of the Member States and their family members are not provided with access tohealth assistance on an equal basis with the nationals of the state of employment. Thus, thevolume of medical assistance within the CHI in different Member States differs. For example, inthe Russian Federation, the CHI includes the provision of certain types of high-tech medicalcare, which is not available in other Member States.

He informed about the additional mechanism in the Russian Federation in terms ofproviding the Russian nationals, permanently residing abroad, with the CHI Policies within theframework of bilateral agreements which determine the policyholder, conditions, the procedurefor issuing the CHI Policies, their validity (Agreements of the Russian Federation with theRepublic of South Ossetia and the Republic of Abkhazia).

He informed about the draft Protocol developed by the Russian Party on amendments tothe Treaty on the Union, which provides for the amendment of the Treaty on the Union withsome provisions on financial support of medical treatment of family members of the MemberStates workers on the territory of the state of employment, including at the expense of the stateof permanent residence in accordance with separate international agreements within the Union.

RESOLVED:

1. To take note of the information submitted by P. U. Suyumbaeva and D. V. Kostennikov.

2. The Commission shall, together with the competent authorities of the Member States,continue working on the implementation of Article 98, paragraph 3, subject to Article 96,paragraph 5, of the Treaty on the Union, with regard to the provision of compulsory healthinsurance to workers of the Member States and their family members under the same conditionsand in the same manner as those of nationals of the state of employment.

3. The Commission shall send to the Parties the draft Protocol prepared by the RussianParty for consideration and sending to the Commission by October 27, 2017 their opinions onthe draft Protocol (Letter No. 26882 – GA/D1io dated September 22, 2017 of the Ministry ofEconomic Development of the Russian Federation – attached).

5.3. On the admission of drivers to motor vehicle driving on the basis of national andinternational driving licenses during their employment directly related to motor vehicledriving.

Ch. A. Sarybaev (the Commission): reported on the ongoing work of the Commission onthe implementation of the Instruction of the Eurasian Intergovernmental Council held on August14, 2017 dated August 14, 2017 No. 7 (hereinafter – the EIGC Instructions No. 7) and theproposal of the Kyrgyz Party, submitted to the Commission, on the amendments to Article 97 ofthe Treaty on the Union concerning express recognition of driving licenses issued by competentauthorities of the Member States to workers of the Member States who implement theirentrepreneurial or labor activities in the state of employment, and the draft law developed by theRussian Party, which provides for the employers to prohibit drivers who failed an independentqualification assessment, to drive motor vehicles. At the same time, persons with the Russian

national driving licenses will be allowed to pass an independent qualification assessment ofdrivers.

V. E. Zakharov (the Commission): informed that in accordance with the provisions of theTreaty on the Union it is not necessary and possible to adopt additional international agreementsregarding the recognition of driving licenses by service sectors and activities covered by thescope of Section XV of the Treaty on the Union, since the provisions of Section XV of Annex 16to the Treaty on the Union concerning the conditions of conducting business activities includethe prohibition to introduce new discriminatory measures against service trade, establishmentand activities of persons of other Member States, as well as the application of new permissiverequirements and procedures.

T. M. Zhaksylykov (the Commission): noted the inexpediency of introducingamendments to the Treaty on the Union, as this approach will create a precedent for numerousamendments to the Treaty on the Union in other specialties.

RESOLVED:

1. To take note of the information of the Commission on the admission of drivers to drivemotor vehicles on the basis of their national and international driving licenses if theiremployment directly related to motor vehicle driving.

2. The authorized authorities of the Republic of Armenia and the Russian Federation shall,in accordance with paragraph 1 of the EIGC Instructions No. 7, inform the Commission and theMember States of the measures taken to amend the national legislation of the Republic ofArmenia and the Russian Federation in order to ensure mutual access of drivers-nationals ofthese countries to motor vehicle driving on the basis of their national driving licenses.

3. The Commission shall, by October 20, 2017, submit a request to the Ministry of InternalAffairs of the Russian Federation about the provision to the Commission of its opinions on theimplementation of paragraph 2 of the EIGC Instructions No. 7 in terms of working out the issueof preparation of a comprehensive agreement within the Union aimed at harmonizing therequirements for professional training of drivers, the procedure for confirming their professionalqualifications and solving other road safety issues.

4. The authorized authorities of the Member States shall send to the Commission byOctober 27, 2017 the opinions of the Parties on the draft law developed by the Ministry ofTransport of the Russian Federation, which prohibit drivers, who failed the independentqualification assessment, to drive motor vehicles.

5. The authorized authorities of the Member States shall by October 20, 2017 send to theCommission the Parties’ opinions on the issue of amending Article 97 of the Treaty on the Unionproposed by the Kyrgyz Party (Letter of the Ministry of Economy of the Kyrgyz Republic datedJuly 14, 2017 No. 11-2/9970 – attached).

5.4. On the possibility of nationals of the Member States of the Eurasian EconomicUnion to be part of flight crews of the civil aircraft of the Member States without anyrestrictions.

Ch. A. Sarybaev (the Commission): informed about the peculiarities of admission offoreign nationals to be part flight crews of the civil aircraft of the Member States.

T. M. Zhaksylykov: noted the need for the Parties to determine the issue of air trafficsafety as a matter of national security, as well as the feasibility of eliminating this exemption andbringing the legislation of the Member States in accordance with the Treaty on the Union, takinginto account the harmonization of educational standards in the Member States in the training ofcivil aviation pilots.

RESOLVED:

1. To take note of the information of the Commission on the possibility to allow theMember States nationals be part of flight crews of the civil aircraft of the Member States withoutany restrictions.

2. To agree with the proposal of the representative of the Republic of Armenia to take intoaccount international standards and requirements in this sphere and the issues of harmonizationof educational standards in the Member States in training of civil aviation pilots when workingout the issue on the possibility of the Member States nationals be part of flight crews of the civilaircraft of the Member States without any restrictions.

3. To kindly request the authorized authorities of the Member States to submit to theCommission their opinions on the need to remove the restriction imposed on the nationals of theUnion Member States to be part of flight crews of the civil aircraft of the Member States withoutany restrictions by October 27, 2017.

5.5. About recognition of education certificates issued by educational organizations(educational institutions, organizations in the sphere of education) of the Member States tothe nationals applying for employment in educational, legal, medical or pharmaceuticalactivities in other Member States without undergoing the procedure for recognition ofeducation certificates as well as documents on scientific and academic degrees establishedby the legislation of the state of employment.

S. V. Evdokimov (the Commission): informed about:

existing exceptions provided for by the Treaty on the Union concerning the need torecognize education certificates by the Member States nationals applying for employment ineducational, legal, medical or pharmaceutical activities, as well as the need to recognizedocuments on scientific and academic degrees in the state of employment;

existing international treaties between the Member States on mutual recognition ofeducation certificates, documents on scientific and academic degrees, concluded at bilateral andmultilateral levels;

The Instruction of the Council of the Commission dated October 18, 2016 No. 29 “Aboutthe progress on the identification and elimination of barriers, exemptions and restrictions in theinternal market of the Eurasian Economic Union”, according to which the Board of theCommission is instructed to prepare, annually by March 1, relevant Actions Plans (“Roadmaps”), agreed at the meetings of specialized Advisory Committees, to eliminate exemptions andrestrictions in the internal market of the Union, the elimination of which is recognized asappropriate by the Union Member States.

I. V. Titovich (the Republic of Belarus): proposed to consider the creation of aninformation resource on the Commission’s website, including information on the degreecertificates issued in educational, legal, medical or pharmaceutical spheres, using which theemployers will be able to confirm the authenticity of issued documents in the Member States.

He proposed to explore the issue of recognition of education certificates issued by theMember States educational organizations to the Member States nationals when carrying out theirwork activities in the state of citizenship.

S. B. Aliev (the Commission): informed about the opinions of the Parties on the inclusionof the said exemptions in the Treaty on the Union during its development and adoption.

Summarizing the results, the opinions of the Parties on the expediency of removing theexemption from the Treaty on the Union in terms of the need to recognize education certificatesissued by the educational organizations (educational institutions, organizations in the sphere ofeducation) of the Member States to the nationals applying for employment in educational, legal,medical or pharmaceutical activities have been documented:

the representatives of the Republic of Armenia support the removal of the exception fromthe Treaty on the Union;

the representatives of the Republic of Belarus, the Republic of Kazakhstan, the RussianFederation consider it necessary to keep the exemption in the Treaty on the Union;

the representatives of the Kyrgyz Republic will send their opinion to the Commission inwriting.

Summarizing the results, the opinions of the Parties on the expediency of removing theexemption in terms of the need to recognize documents on scientific and academic degrees in thestate of employment have been documented:

the representatives of the Republic of Armenia, the Republic of Belarus, the KyrgyzRepublic, the Russian Federation reserved their opinions (will send their opinions to theCommission in writing);

the representatives of the Republic of Kazakhstan consider it necessary to keep theexemption in the Treaty on the Union.

The representatives of the Parties spoke about the need to study the issue at the expertlevel.

RESOLVED:

1. To take note of the information of S. V. Evdokimov, I. V. Titovich, S. B. Aliev.

2. The Commission shall, together with the competent authorities of the Member States,continue working on the feasibility of removing the existing exceptions provided for in theTreaty on the Union concerning the need to recognize education certificates of the MemberStates nationals applying for employment in educational, legal, medical or pharmaceuticalactivities, as well as the need to recognize documents on scientific and academic degrees in thestate of employment, subject to national regulatory aspects of the Member States in these areasof activity.

3. The Parties shall, by October 27, 2017, send to the Commission their opinions on:

the expediency of keeping the exceptions stipulated in the Treaty on the Union concerningthe need to recognize education certificates of the Member States nationals applying foremployment in educational, legal, medical or pharmaceutical activities, as well as the need torecognize their documents on scientific and academic degrees in the state of employment;

the proposal of I. V. Titovich (the Republic of Belarus) on the creation of informationresource on the Commission’s website, including information on the education certificates issuedin educational, legal, medical or pharmaceutical spheres.

6. On the draft Memorandum on Cooperation between the Eurasian EconomicCommission and the International Association of Pension and Social Funds.

Sergey Evdokimov (the Commission): informed about the draft Memorandum onCooperation between the Eurasian Economic Commission and the International Association ofPension and Social Funds (hereinafter – the ISPSF), developed by the Commission together withthe International Association of Pension and Social Funds.

S. S. Dyusenova (the Republic of Kazakhstan): informed the Members of the AdvisoryCommittee on the activities of the ISPSF and their cooperation with the Commission.

RESOLVED:

1. To take note of the information of S. V. Evdokimov and S. S. Dyusenova.

2. To approve the draft Memorandum on Cooperation between the Eurasian EconomicCommission and the International Association of Pension and Social Funds and the Commissionto make the relevant draft Instruction of the Board of the Commission at the meeting of theBoard of the Commission.

7. On the development of the Principles of labor legislation (model Labor Code) of theMember States of the Eurasian Economic Union (proposal of the General Confederation ofTrade Unions).

N. P. Zanko (General Confederation of Trade Unions – the GCTU): informed about theexpediency of developing and adopting the Principles of labor legislation (model Labor Code) ofthe Member States, which will allow, within the Union, to identify basic approaches to solvingkey problems in regulation of labor and directly related relations for the effective functioning ofthe Union common labor market.

S. K. Zhakupova (the Republic of Kazakhstan): supported the proposal of the GCTU,subject to the exclusion from the draft document of the provisions on the Trade Union controlover compliance with the labor laws of the Member States.

RESOLVED:

1. To use the GCTU proposal to develop the Principles of labor legislation (model LaborCode) of the Member States of the Eurasian Economic Union as a guide.

In accordance with the Regulation on Cooperation of the federal executive authorities withthe Ministry of Economic Development of the Russian Federation, approved by the GovernmentDecree No. 1126 dated October 21, 2015, the Ministry of Economic Development of the RussianFederation hereby sends you a draft Protocol on amendments to the Treaty on the EurasianEconomic Union dated May 29, 2014, prepared by the Ministry of Healthcare of the RussianFederation together with the federal executive authorities.

on amendments to the Treaty on the Eurasian Economic Union

dated May 29, 2014

The Member States of the Eurasian Economic Union, hereinafter referred to as the Parties,having regard to the provisions of Article 115 of the Treaty on the Eurasian Economic

Union dated May 29, 2014 (hereinafter referred to as the Treaty), have agreed as follows:

Article 1Paragraph 3 of Article 98 shall be amended as follows: “3. Social security (social insurance) (other than pension and compulsory health insurance)

of workers of the Member States and their family members shall be ensured on the sameconditions and in the same manner as those for the nationals of the state of employment.

Workers of the Member States shall be subject to compulsory health insurance uponpayment of insurance premiums or other equivalent payments in accordance with the legislationof the state of employment.

Employed (pensionable) service of workers of the Member States shall be included in thetotal employed (pensionable) service for the purposes of social security (social insurance), exceptfor pensions, in accordance with the legislation of the state of employment.

Pension benefits of workers of the Member States and their family members shall begoverned by the legislation of the state of permanent residence, as well as by an internationaltreaty between the Member States.”

Paragraph 4 of Article 98 shall be amended as follows: “4. The right of workers of the Member States and their family members to receive

emergency medical care (emergency or urgent care) and other types medical care shall begoverned in the procedure under Annex No. 30, as well as by the legislation of the state ofemployment and international treaties to which it constitutes.

Financial support for the provision of medical assistance to family members of the workersof the Member States in the territory of the state of employment shall be governed in theprocedure under Annex No. 30, including at the expense of the state of permanent residence inaccordance with an international treaty within the Union.”

Article 2This Protocol shall enter into force after 30 days from the date of receipt by the Depositary

of the last written notification on the implementation by the Member States of the EurasianEconomic Union of the internal procedures required for its entry into force.

In order to exclude any prohibitions on motor vehicle driving on the basis of foreigndriver’s licenses in the course of business and labor activities in the territories of the EAEUMember States, we hereby propose to amend Article 97 of the EAEU Treaty dated May 29, 2014(hereinafter – the Treaty) with sub-paragraph 3-1 as follows:

“3-1. In order to enable worker of the Member States to conduct labor activities inthe state of employment, driving licenses issued by the authorized state bodies of theMember States shall be recognized without carrying out the procedures, established by thelegislation of the state of employment, of exchange of national and international drivinglicenses of the Member States”.

In addition, we deem it advisable to discuss this proposal within the framework of theConsolidated Working Group on improving the provisions of the Treaty.
