Regarding the proposed retail marijuana store to be opened in Keystone I cant see wherethere is any true advantage to allowing a retail marijuana store so close to a facility that hastaken decades to build such an amazing reputation Keystone IS the place families want to goin the country and it is the best resort for youngsters to learn how to ski Children parentsand grandparents can all ski together in a way that isnt possible at other resorts Allowing amarijuana store in such close proximity is completely contrary to the image and reputationKeystone has worked so hard to achieve Agreeing to this proposal would not only be aprecedent setting an image shift for the resort but being so close to a school bus stop seemslike a poor choice and a safety hazard for the children within the community

It is obvious that past decisions have been made with care and in support of the hard earnedreputation Keystone has come to enjoy A clean fun beautiful resort known internationallyfor catering to young families Based on this amazing reputation and history I ask that you alltake into account what you have all built in this community and the reputation as the 1Family Resort in the country I vote to deny the proposal for a retail marijuana store inKeystone and hope you all do as well

As a local Colorado property owner in The Pines at Keystone and frequent visitor to theKeystone area I was made aware of the proposed marijuana retail store in Keystone at 57 RasorDrive I am strongly against approval of this application by the county and provided comments tothe Planning Department prior to the September 10 2021 deadline I was pleased to hear that thePlanning Department denied the application and am now concerned that the applicant hasappealed the decision to the County Commissioners ostensibly to get a second bite at the apple

I am concerned with the applicantrsquos appeal not only because of my previous commentsabout the type of developments the Planning Department determines are appropriate for that partof Keystone but also procedural concerns I am familiar with the county planning approval processfrom working with various county commissions related to renewable energy development within thestate of Colorado It is my understanding that County Commission review of Planning Departmentdecisions and potential overruling of those decisions should only be considered if material errorsoccurred during the planning review process In the absence of these material errors CountyCommission reversal would create an unfortunate and long-standing precedent immediatelyundermining the authority of the Planning Department For this reason I strongly encourage theCounty Commission to deny this appeal from a procedural standpoint in the absence of any errorsduring the review process

If there are extenuating circumstances such that it is appropriate for the County Commissionto consider the appeal I again want to provide my comments against the proposed marijuanadispensary development My earlier comments about the proposed development are attached andpresented below

My family and I greatly enjoy the quality of life in Keystone and its family-friendly atmospherecompared with other resort areas in Summit County It is unique in its location and style andI strongly believe that a retail marijuana store is not the right kind of development toencourage in the Keystone area More specifically the addition of a marijuana dispensary at the proposed Keystone site will

middot create a risk of attracting individuals who will commit drug-related crimes such astheft driving under the influence and vehicle accidents

I am writing to you to share my objection to the current proposal to buildinstall a marijuanadispensary at 57 Rasor DriveLoveland Pass Village (LPV) Keystone Colorado I am writingon behalf of my husband and I who have been year-round residents of LPV for over 30 yearsWe were also former business owners where we operated a busy restaurant right in MountainView Plaza for over ten years We reside at 237 Rasor Drive where we also rent out tworooms long term for a fair rent in our home to locals as we are extremely sympathetic to thelocal housing crisis and its impact on sustaining our community LPV is a very special placewith an extremely supportive and close knit community of mostly long-term year-roundSummit County residents While more and more part-timesecond home owners are movinginto the area historically this has been a solid and probably one of the few (only)continuous year-round residential neighborhoods in Keystone since it was established in the1970s The news of this proposal is extremely concerning for many reasons but mostimportantly

-it adds significantly to the already overwhelmed traffic congestion on hwy 6 specifically theturn offentranceexit to LPV and Mountain View Plaza-We have been extremely concerned about the cross-walk situation on highway 6 for manyyears and it is only a matter of time before we sadly have more fatalities Crossing hwy 6 is tosay the least a deadly and very risky endeavor -The existing plaza is already overwhelmed during the ski season with parking and trafficissues-as someone who is very sensitive to smells I am quite concerned about this potential issue -We do not have children but our neighbors do and I know this is of great concern to themand the safety and influence of their children -As most probably over 90 of Keystone is comprised of short term rentals that do not allowsmoking inside buildings and public areas and as Keystone Resort (Vail) does not permit thesmoking of marijuana on the mountain Im not sure where visitors (which will be the mainpatronage of this store) will actually enjoy marijuana products

I would like to offer solutions to this issue for example perhaps a store like this would bebetter suited in the middle of Keystone River Run or the Lakeside villages that havesupporting parking and infrastructure Of course designated areas to enjoy Marijuana wouldalso need to be established

We are submitting this objection completely independently and I want to be clear that we areneither affiliated nor associated with the Keystone Citizens League or the Keystone OwnersAssociation or representatives of these various organizations but it seems we are united inour objection to this proposal

My wife Jennifer Kagan and I live at 206 Rasor Drive in Keystone in Loveland Pass Village We are writing today to voice our opposition to the proposed Retail Marijuana license Planning Case PLN21-084 Jennifer and I have lived in Summit County for 25+ years and have owned our home at 206 Rasor since 2007 It is our only home we live here full time and we both work full time as professionals in the community Jennifer as a Nurse Practitioner at Summit Community Care Clinic and I as an Associate Professor at Colorado Mountain College Our opposition is on several fronts

We understand intimately the issues related with the intersection at Rasor Drive and Highway 6 There have been fatalities and several traumatic injuries as a result of the intersection We have both personally witnessed close calls at this intersection

There is also a dire need for improvement of the structure of the intersection perhaps in the form of a roundabout a stop light a pedestrian bridge or some combination(s) thereof In addition to the danger to pedestrian traffic there have been several traffic crashes at the intersection over the years Sometimes the traffic is so backed up on Rasor Drive one will be forced to turn right out of the intersection even if the intention is to go left (east) on Highway 6 because it becomes impossible to turn left out of the intersection

There is not enough parking in the shopping plaza right now The plaza often becomes filled to overcapacity causing fender benders frustration of everyone trying to park back out or pull around the plaza

Allowing for further development in the plaza without any remediation of the traffic issues is reason enough alone for us to oppose the shop

There is an element of risk to the family-oriented nature of Keystone and particularly to our neighborhood with the addition of a marijuana dispensary at the entrance to the neighborhood A plethora of dispensaries exist throughout the county in clearly commercial-oriented areas that are not directly adjacent to neighborhoods and we believe that these are the proper area for such businesses We urge you to consider this matter from the standpoint of if it were your neighborhood

Unfortunately there have been some crimes reported over the years between the hotel at the entrance to the neighborhood and the liquor store The liquor store was actually robbed a few years back We and others have witnessed shady activity around the motel at all times of day and several reports of mail gone missing from our mailboxes which are right there have been circulated We believe that the addition of a marijuana dispensary with its product on top of increased traffic will only increase this element of behaviors in the area

Please consider our objection to the dispensary as you consider the planning case tomorrow Thank you for the consideration Thank you

My name is Tara Brand My parents have owned a condo in Snowdance Manor since 1996 Asa kid we were up almost every weekend and most holidays As a high school student I was amember of the Summit County Ski Team It is easy for me to call Keystone my second home

When my mom told me about this proposal I was immediately concerned and am againstapproving the marijuana license for 57 Rasor Drive Keystone is a small community whichmeans other dispensaries are not far A dispensary in this area would not mean access asaccess is already very easy I would also be concerned about a dispensary this close to the skimountain The quick access could encourage people to visit the dispensary then go to themountain This is dangerous and also puts undue stress on the mountain staff as they are theones who have to enforce the law on the mountain We all know that marijuana use is stillillegal on federal property

In addition travel across the highway is dangerous and the parking lot space in that area isalready limited Due to the limited parking I would be concerned that it would encouragepeople to park across the street and walk over This would cause more foot traffic than isalready happening and put stress on the building managers to manage more unlawful parking

I encourage local business However this is not the right space for this particular business Iam concerned for safety for mountain staff and for putting undue stress on an already verybusy area For all of these reasons I am opposed to approving the application for a marijuanadispensary

1 There is already an issue with traffic flow in front of our home due to the many vehicles that come and go from Summit County Mountain Retreats They recently purchased the building infront of us and the flow of traffic has become very dangerous since they are flying in and out all day Having another store front that will attract many more consumers will cause even moretraffic through our previously quiet neighborhood

2 According to the plans the little parking lot for Dos Locos employees will remain where it is We already have a problem with cars being parked 2 and 3 side by side sometimes almostblocking in the street blocking our driveway and even parking on our property This will become even more congested when patrons of the marijuana store cannot find parking in the frontespecially in the winter Weve already had to call the tow company numerous times due to illegal parking

3 The smells from the store will be there not matter how much the owners try to mask it We dont mind the smell of weed but to have it being a constant smell RIGHT outside of our house isdefinitely a very upsetting possibility We have children and they do not need to be exposed to this We spend our time in the mountains to enjoy fresh air not to be bombarded by this strongsmell

4 Due to our house being directly behind the store there will be many smokers trying to go behind the building to get high before they ride bike etc We feel there will be a constant flow ofpeople trying to get high behind the store RIGHT in front of our house Once again we have children and they do not need to be exposed to that where we live

5 There are so many other areas in Summit County and or Keystone where a Marijuana store can be placed Why is this location even being considered We cant think of a singledispensary in Colorado where there is a single family home DIRECTLY behind it let alone an entire neighborhood

6 Keystone is all about the family fun environment Placing this dispensary here will deter a lot of families from choosing Keystone to plan a family vacation There are a lot of homes in thisneighborhood that rent during high season We are one of those homes that exclusively rents during high times in the winter Weve spoken to families who come back every year and theyhave already said they will rent elsewhere if this store goes in So we are already seeing an impact on our revenue and the store hasnt even been approved yet

7 Our property value will be compromised with this store going in We have owned here for 9 years and have enjoyed the benefits of our property value rising because of the beauty andproximity to Keystone This store going in will have nothing but a negative impact on the value of our home

If we are talking about availability of cannabis for legal age adults Summit County has 2dispensaries in Silverthorne 3 dispensaries in Frisco 3 Dispensaries in Breckenridge and 3dispensaries in Dillion It seems we are reaching saturation

With the passage of House Bill 1234 allowing for medical deliveries in 2020 and recreationaldeliveries in 2021 any legal aged adult should be able to indulge at their convenience

I would hate to see another dispensary open so close to the ski slopes and my property I donot agree with the proposal and hope the board refuses the land use request and subsequentappeal

After reviewing the Project Narrative and the Criteria Statements we have the following comments in reference tothe compliance with Resolution 2015-69

a PROXIMITY to other land uses Our concern is that the proposed business is too close to a predominantly residential neighborhood If the marijuanabusiness is required to be at a minimum of 50 feet from residential land use then 63 feet is too close to theminimum standard to be acceptable Additionally if the wording of the code alludes to land use then why in this instance isnt the commercial land useboundary considered to be 40 feet from the residential land use boundary (The building setback is noted at 23 feet)

b PUBLIC HEALTH Safety and WelfareAs long time residents and employees in the Keystone community - health safety and welfare are of utmost concernto us While we have no issue with the availability of legal substances we question the wisdom of the statement thatthe location of this store will reduce the amount of travel for local residents and visitorsThe traffic congestion and lack of adequate walkway space along highway 6 has already led to numerous accidentsserious injury and fatality On any given evening there are people walking along the unlit highway - summer andwinter If they are not walking along the highway they are walking through neighborhood yards to get to the existingcommercial spaces Adding a marijuana dispensary will add traffic and pedestrian congestion both on the highwayand in residential neighborhoodsIn no way does this support public health and safety

In my travels I have found that the highest quality cannabis and its most earnest and thoughtfulpurveyors are found in the small mountain town areas like yours Places like Crested ButteTelluride and Durrango are not inundated with storefronts and large commercial (oftentimessubpar quality) grows like the Denver metro area but rather are sprinkled with a handful oftasteful dispensaries with high quality cannabis and knowledgeable and genuinely caringstaff That in part is why I never skip those towns on my annual summer road trips Theproposal by Tree Line would match or even better the character displayed in those townsdispensaries As you know the petitioners are local medical doctors and their family Thephysical footprint they propose is small the construction green and the location consistentwith other surrounding uses They intend to offer affordable workforce housing for theiremployees and to market locally sourced product lines For those reasons and many more Icould not think of a better group of people to own and operate your areas first dispensary

Speaking from experience as the Mayor of the Town of Montezuma I know how difficult itcan be to make decisions that are met with both opposition and support from the communityHowever many people in the community have faith that they are being represented by thosethey elect without having to voice concern So many times the squeaky wheel is the onlyone heard I beg the Commissioners to think about all the silent community members that youare representing in this decision Cannabis is a normal way of life in Colorado Our ColoradoCommunity voted to legalize Cannabis within our State We see responsible dispensariesserving the Cannabis needs of many all over Colorado Cannabis is an extremely regulatedindustry that has proven to be safe within numerous communities The success of localCannabis dispensaries shows that majority of our silent community is in support I trust thateven though they may not have voiced that support the Commissioners are aware of theirpresence

The Tree Line application satisfies all developmental setbacks required by the County andState This application satisfies all State Cannabis requirements as well In fact they havealready been granted a license by the State of Colorado to sell Cannabis within the Statelimits It seems extremely discriminatory to deny The Tree Line application solely because ofCannabis Many who oppose this application simply oppose Cannabis However that electionalready occurred and our CO population voted to legalize Cannabis in 2012

When I drive home from the airport on 70 West I easily pass 50+ visible dispensaries All ofthem uphold the same presence and quality of the other 1000s of businesses we pass if notbetter In Colorado Cannabis businesses are the same as other business and should be treatedthe same way Once we enter our area we see numerous other dispensaries sprinkledthroughout Dillon and Silverthorne It makes no sense to me why Keystone should not havethe same opportunities as these other areas just because Keystone is not a Town Every Townin Summit County has a dispensary available If Keystone had a Town government I have nodoubt it would be the same The Board of County Commissioners is Keystones TownGovernment We are relying on the three Commissioners to observe what is occurring inmajority if not all the Towns throughout Colorado and give the Keystone neighborhoodresidents the same opportunities

I have lived in the Town of Montezuma for 19 years and worked for Vail Resorts at aKeystone outlet for all of those 19 years Keystone is my home and my community I loveeverything about it Recently times have been tough in our Community due to short termrentals pushing out long term community members and COVID causing many to lose orchange their jobs COVID has had numerous impacts on all of us However when COVID hitin the Spring of 2020 our Colorado State Governor declared the Cannabis industry asessential Not just a luxury or a problem ESSENTIAL The Tree Line will help alleviate some of these community issues by providing more essentialjobs in the area creating housing opportunities for local employees allowing a largeneighborhood closer access to their medicalrecreational Cannabis needs increase touristattractions to the area decrease car traffic by allowing 1000s to walk from their rented condoto a dispensary rather than driving into Dillon and most importantly creating a local familyowned and operated business

Today it seems large corporations are taking over majority of the businesses This isKeystones chance to maintain local character and allow a small local business to thriveKeystone prides themselves on being a family friendly resort yet there is a liquor store andmultiple bars in the center of Keystone village I do not need to explain the risks and concernsassociated with alcohol but Cannabis does not have these same risks and concerns There isno reason that a Cannabis dispensary should be denied at the Razor Drive location if itsatisfies all setbacks and requirements To deny it simply because some do not like Cannabisis unconstitutional I believe the proposed location for The Tree Line is the best possible location for a Cannabisbusiness I would understand opposition concerns if it was in a quiet residential neighborhoodbut instead they are requesting to build in the center of Keystones business district TheRazor Drive location is nestled between the three most popular late night bars in the area (TheGoat The Snake and Dos Locos) and a liquor store would be the adjacent neighbor Plus it isright off of US HWY 6 This means that The Tree Line would be harmonious and compatiblewith the area In fact it would be much more than that The Tree Line would be an upgrade tothe area with a beautiful green building and being extremely safe clean and regulated

I remember 8 years ago when a request for a dispensary was denied in the area At that pointCannabis was still very new and there were limited locations throughout the State Iunderstand the Boards decision at that point because there were numerous unknownsFortunately now we know many of those unknowns and they are not concerns anymore Nowis the opportunity to try again with more knowledge and data regarding Cannabis

I am sure that every dispensary approved within the State faced a good amount of oppositionAt times Im sure even the local law enforcement opposed the new business Howeverfortunately the decision makers were able to see the bigger picture I am pleading with theBoard of County Commissioners to please support this appeal and approve The Tree Linesapplication to build in Keystone at 57 Razor Dr

We are very invested personally and professionally in Summit County and proud to be so Kyle has continued to play the Dillon Amphitheater for the past 3-4 years every summerwith his solo band Kyle Hollingsworth Band and his main band The String CheeseIncident I know many of Kyles fans have since discovered the Dillon Amphitheater andattend shows there regularly as well as staying there to ski eat shop and support localbusinesses in the county He just played the Ten Mile Room last month and I know alsobrought more fans into the area Many music fans do travel for music and many enjoy thebenefits of marijuana

First of all thank you for working in government Elected officials accomplish important work for our communities in peaceful times and tumultuous I respect that

In regards to the Tree Line Dispensary opening in Keystone I support it and would like to voice a few reasons why

Dispensaries are an ldquoupliftrdquo business their presence can improve the quality and standard of living in a community In essence uplifting community members in a number of ways

One of those ways is through taxation The County will receive tax from a Keystone dispensary According to Coloradorsquos Department of Education website the 15 excise tax on wholesale recreational marijuana sales goes towards funding public education As a County resident with two kids in two different county schools (elementary and middle) that taxation carries a large weight in my support of the Tree Line DIspensary The quality of their education and the opportunities that education presents them rank among one of my highest priorities

Employment

The Tree Line Dispensary would provide employment for local residents As a locally owned business it would provide an opportunity for work Nothing along the lines of the employment numbers Vail Resorts offers but I see an argument for the local economyrsquos benefit in diversifying places of employment from one behemoth (Vail) to several smaller businesses that seek employees from full-time residents and that are also owned and run by full-time residents In effect monopolies on employers and employees are not the most beneficial to a diverse and growing workforce or for I think capitalism itselfFor example recently a locally owned brewery opened in Keystone I know that the owners are local and when I go in I know most of the employees as they are my friends and neighbors This is a positive local ldquoupliftrdquo business It is not owned by a multinational corporation nor even a restaurant conglomerate the runs its businesses from Denver or out of state The brewery is a true locally owned and operated business and The Tree Line Dispensary promises to be the same If County Commissioners seek to ground community in real tangible business policy the brewery and future dispensary represent the fruit of that goal

Personal

I am employed in the Cannabis industry as a farmer During Covid I had to find work that was directly in my neighborhood so I could both work and supervise my kidrsquos home online education A cannabis cultivation facility operates a block away from my house The application process was rigorous and thorough and one big takeaway from the cannabis cultivation side of the industry is that this is a highly regulated arena The dispensary side is the same Arguments about loitering and consumption at the proposed Keystone dispensary are pretty ludicrous once yoursquove witnessed the regulations involved in every step of this industry Cannabis advocates took years to get to a place of legality they do not trifle with either State or Local regulations that could jeopardize their hard-won rights to own and operate

Personally becoming a cannabis cultivator has changed my life for the better Approaching 40 I have been gifted with a chance to learn a new field one that incorporates biology chemistry and just plain enjoyment into my career path Farming cannabis is both diligent focused and hard work and an uplift business that has the potential to positively impact a larger pool of the local community in hiring and education After a year in the business I count myself as a success story in the positive employment benefits that happen when one works locally for local people in the community and see the ripple effects in both the health and well being in my own family home as well as the wider community People like myself find great benefit in the business side of this industry as it is by nature locally run and operated with great investment and care by local residents I voice my support for this endeavor It fosters equity It uplifts the community If allowed to pass it will increase the human value of the community in several ways an endeavor I believe this County Board can get behind with confidence
