On motion by Freeholder Murphy and seconded by Freeholder Nordstrom the meeting minutes were approved. -- COMMUNICATIONS 1. A regular meeting of The Board of Chosen Freeholders of the County of

Morris, State of New Jersey, was held on April 13, 2011, in the Freeholders

Public Meeting Room, Administration and Records Building, Morristown, New

Jersey. The meeting began at 7:30 p.m.

Clerk of the Board Diane M. Ketchum announced that adequate notice of

this regular meeting held this 13th day of April, 2011 has been providedthrough resolution adopted by this Board at its Regular Meeting held at the

Administration and Records Building on January 5, 2011, and by mailing the

resolution to the Star Ledger, the Daily Record, and the Record and by filing

a copy of same with the Clerk of the Town of Morristown and the Morris County

Clerk.

On motion by Freeholder Murphy and seconded by Freeholder Nordstrom themeeting minutes were approved.

COMMUNICATIONS

1. The Historic Chester Business Association is asking permission to

hang a banner across County Route 513 (Main Street) in Chester

Borough from May 8 to 25th to advertise Chester’s Annual Cruise-N-

Shop Car Show.

2. The Township of East Hanover is requesting permission to close a

portion of Ridgedale Avenue from 9:00 a.m. to 12 noon on Monday,

May 30 for the annual Memorial Day Parade.

Request from Road Inspection Supervisor for the following road

opening permit:

GRANT AGREEMENT

BETWEEN

MORRIS COUNTY OFFICE OF HEALTH MANAGEMENTAND

THE STATE OF NEW JERSEY

BY AND FOR

THE DEPARTMENT OF ENVIRONMENTAL PROTECTION

GRANT IDENTIFIER: EN11-023

GOVERNING BODY RESOLUTION

The governing body of Morris County desires to further the public

interest by obtaining a grant from the State of New Jersey in the amount

of approximately $165,800 to fund the following project: Investigation,

Compliance, Monitoring and Enforcement of Approved CEHA Workplans

Therefore, the governing body resolves that William J. Chegwidden or

the successor to the office of Director Board of Chosen Freeholders is

authorized (a) to make application for such a grant, (b) if awarded, to

execute a grant agreement with the State for a grant in an amount not less

than $165,800 and not more than $165,800 and (c) to execute any amendments

thereto which do not increase the Grantee’s obligations.

*The Morris County Board of Chosen Freeholders authorizes and hereby

agrees to match 50% of the Total Project Amount, in compliance with the

match requirements of the agreement. The availability of the match for

such purposes, whether cash, services, or property, is hereby certified.

100% of the match will be made up of in-kind services (if allowed by grant

program requirements and the agreement).*

The Grantee agrees to comply with all applicable federal, State and

municipal laws, rules and regulations in its performance pursuant to the

agreement.

WHEREAS, a contract was awarded on November 28, 2007 for engineering

services related to the vehicle wash water recycle pad and wash water

recycling equipment; and

WHEREAS, it has been determined that it is necessary to increase

said contract to provide for changes in the location of the wash water

recycling pad and recycling equipment to be located within the building,

as well as an upgrade to the electrical system;

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of

the County of Morris in the State of New Jersey that, pursuant to Local

Public Contract Regulations, contract modification as detailed on

“Contract Change Order Request” No. 2-11675 is hereby approved as follows:

natural gas fueled stand-by generator at the Administration and Records

WHEREAS, it has been determined that it is necessary to increase

said contract to provide for additional professional services for the re-

bid of the construction plans and specifications;

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of

the County of Morris in the State of New Jersey that, pursuant to Local

Public Contracts Regulations, contract modification as detailed on

“Contract Change Order Request” No. 1-9243 is hereby approved as follows:

Services has identified Morristown Memorial Hospital as the sole existing

agency that has performed satisfactorily through a non-competitive renewal

process; and

WHEREAS, the contract was awarded as a “Professional Service” in

accordance with N.J.S.A. 40A:11-5 (1) (a) (i) et seq.

(“Grantor”) and the County of Morris, having its principal address at

authorized to sign and execute Modification #1 to Subgrant Agreement

#NEWSER-10M-WIA between the Morris/Sussex/Warren Employment &

Training Services and Newbridge Services, Inc. for the period

07/01/09 to 06/30/10, which increases the contract amount from

$80,000 to $95,000.

2. The Treasurer is hereby authorized to issue an Amendment to

Certificate of Availability of Funds #4068 increasing it by

$15,000.00 and charging account No. 02-213-41-742020-391 for the

aforesaid increase.

Morris in the State of New Jersey as follows:

1. That the Director of the Board of Chosen Freeholders is hereby

authorized to sign and execute Modification #1 to Subgrant Agreement

# SCVOTE-11Y-WIA for the period July 1, 2010 through June 30, 2011,

between the Morris/Sussex/Warren Employment & Training Services and

Sussex County Technical School which increases the contract amountfrom $35,973 to $36,835.00.

2. The Treasurer is hereby authorized to issue an Amendment to

certificate of Availability of Funds #18956 increasing the amount by

$862.00 and charging Account No. 02-213-41-742020-391 for the

aforesaid increase.

WHEREAS, on December 14, 1990 an agreement was entered into between

the County of Morris and Riverdale High Tech Center 15 Green Street,

Hackensack, NJ 07601, whereas new address is 2 North Street, Suite 2B,

Waldwick, NJ 07463; which allowed the Director of Finance/County

Treasurer to retain twenty (20%) percent of Thirty Nine Thousand Two

Hundred Thirty Four Dollars ($39,234.00) which is Seven Thousand Eight

hundred Forty Six Dollars and Eighty Cents ($7,846.80) to be placed on

deposit in an interest bearing account with the County through its Road

Inspection Office in lieu of a maintenance bond for Road opening permit

#89-28 for work and construction done at Riverdale Road, Riverdale

Township.

WHEREAS, the Engineering Division of the County of Morris has

requested that the County of Morris through its Director of Finance/County

Treasurer to release the sum of Seven Thousand Eight Hundred Forty Six

Dollars and Eighty Cents ($7,846.80) together with accrued interest on

said amount to Riverdale High Tech Center, 2 North Street, Suite 2B,Waldwick, NJ 07465.

BRIDGE NO. 1400-832 ON BERKSHIRE VALLEY ROAD OVER THE

ROCKAWAY RIVER IN THE TOWNSHIP OF JEFFERSON,

COUNTY OF MORRIS

WHEREAS, Federal Funds are available for Local-Lead Transportation

Improvement Program Projects; and

WHEREAS, the New Jersey Department of Transportation has prepared

Federal Aid Agreement No. 2009-DT-BLA1-01, a cost reimbursement agreement,

which is established under and constitutes a part of the Basic Agreement

signed on March 23, 2000; and

WHEREAS, it has become necessary to perform additional design work

outside of the original Scope of Work. As a result the reimbursed cost to

Morris County for the Final Design of the above referenced bridge has to

be increased by $106,917.00

NOW THEREFORE BE IT RESOLVED that the Board of Chosen Freeholders of

the County of Morris in the State of New Jersey does hereby authorize the

Director and the Clerk of the Board to execute Modification No. 1 to

Federal Aid Agreement No. 2009-DT-BLA1-01 with the New Jersey Department

of Transportation.

Morris in the State of New Jersey as follows:

1. That the County of Morris hereby awards a grant of $29,400 from the

Morris County Municipal Utilities Authority’s (hereinafter, MCMUA)

allocation from the Open Space and Farmland Preservation Trust Fund

to the Township of Mount Olive and The Land Conservancy of NJ for

their contribution toward the purchase of the South Branch Preserve

Additions-Smith–Marra Property in the Township of Mount Olive.

2. That the Treasure issue a Certificate of Availability of Funds

indicating that funds are available from the Morris County Dedicated

Open Space Account #13-290-56-580552-888 and process payment to the

grantee as directed by the office of the Department of Planning &

Development, all in accordance with this resolution.

WHEREAS, an Assignment and Assumption of Grant Agreement has been

the county of Morris in the State of New Jersey as follows:

1. The Director of the Board of Chosen freeholders is hereby authorized

to sign the Assignment and Assumption of Grant Agreement and accept

the assignment of the Project to the Morris County Park commission.

2. That the Treasurer process payment to the Assignor and Assignee as

directed by the Department of Planning & Development all in

accordance with this resolution.

3. This resolution shall take effect immediately.

BE IT RESOLVED, by the Board of Chosen Freeholders of the County of

Morris in the State of New Jersey as follows:

1. That the Morris County Loss Prevention Manual, of the Morris County

Policies and Procedures, adopted on January 28, 1981, and on file in

the office of the Morris County Administrator, is hereby

supplemented by the Policy and Procedure entitled “Alcohol and Drug

Policy for Morris Area Paratransit System” which shall be numbered

3:6.1.

2. This is approved by the Board for purposes of the grant, “Federal

Transit Administration (FTA) Non-urbanized Area Formula – Section5311” for the period July 1, 2010 through June 30, 2011 and any

succeeding grants of an identical or similar nature.

1. The County of Morris hereby allocates $155,000 from the Park

Commission’s share of the Open Space and Farmland Preservation Trust

Fund toward the purchase of the Hog Pen III/Kern Properties located

in the Township of Boonton.

2. The Treasurer issue a Certificate of Availability of Funds

indicating that funds are available from the Morris County Dedicated

Open Space Account #13-290-56-580552-888 and process payment to the

grantee as directed by the office of the Department of Planning &

Development, all in accordance with this resolution.

WHEREAS, policy 2:1.17 Purchasing-Motor Vehicle Replacement Policy,

has been revised;

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen freeholders of

the County of Morris that the Policy and procedures manual is hereby

amended by deleting the original version of the above numbered policy and

by including the revised version, a copy of which is on file in the Office

of the County Administrator.
