iii) From A-10 Section/Secretariat Branch/Chennai Memo.No. 3000/A10/A101/2016-5, dated 27.01.2016 alongwiththe extract of the minutes of the 61st Board Meeting ofthe TANGEDCO held on 25.01.2016.

-----PROCEEDINGS:

In G.O. (Ms) No. 99 [P&AR (A)] Department, dated 21.09.2015, orders havebeen issued on the various procedures to be followed while dealing with the grievancepetitions received through on-line and off-line in the Government offices.

2. The Secretary to Government (Expenditure), Finance (BPE) Department,Chennai has requested to extend the above procedure in State Public SectorUndertakings/Statutory Boards and to place the above matter before the Board foradoption.

3. The Board of TANGEDCO hereby approves to adopt the procedures to befollowed in dealing with the grievance petitions received through on-line and off-line inTANGEDCO/TANTRANSCO/TNEB Ltd, as follows:-

i) An acknowledgement should go immediately and at the most within threedays of the receipt of grievance petitions.

ii) Grievance itself should be redressed within a maximum period of one monthof its receipt and it should be with a speaking order in the event of aredressal or rejection if found necessary.

iii) The citizens approaching the TANGEDCO/TANTRANSCO/TNEB Limited Officeswith their grievance petitions should be informed of the progress of his/hergrievances.

iv) In case, for some reason, additional time is required for its finalization, theperson, who has given grievance petition, should be informed in writing forthe extended period of time for its finalization.

v) In case, it is not found feasible to accede to his/her request, a reasonedreply may be issued to the aggrieved citizen within the stipulated time limitof one month.

4. Accordingly, all Chief Engineers/Superintending Engineers/Heads of Departmentare directed to strictly adhere to the above procedures and also to communicatethese instructions for compliance to the sub-ordinate offices.

Pension -Family pension - Payment of Family Pension to the children in the case ofpersons suffering from Chronic Schizophrenia and Divorced or widowed or unmarrieddaughter - Clarification issued by the Government - Adoption - Orders Issued.

-----PROCEEDINGS:

In the reference first and second read above, orders were issued that apensioner/spouse of the deceased pensioner/employee shall furnish to the sanctioningauthority concerned a list of the names of eligible children indicating whether any childis handicapped together with an attested copy of the certificate obtained from aMedical Officer of the rank of Civil Surgeon in the case of children suffering from

disorder of disability of mind or is physically crippled or disabled so as to render him/her unable to earn a living, for inclusion of names in the Pension Payment Order. ThePension sanctioning authorities after due verification of the list of the names, shallfurnish the names of eligible children to the Chief Internal Audit Officer/Board OfficeAudit Branch with intimation to the pensioner for issue of a fresh Pension PaymentOrder based on the sanction accorded by the pension sanctioning authorities in respectof eligible children as and when their turn come up after the death of the pensionersubject to fulfillment of the conditions specified in rule 49 (6) of the Tamil NaduPension Rules 1978. Now, the Government in the letter third read above have issuedcertain clarification. After a detailed consideration, it has been decided to adopt thesame.

2. Accordingly, it is hereby ordered that in the case of child of an employee/pensioner who is suffering from Schizophrenia, rendering him/her unable to earn forhis/her livelihood even after attaining the age of 25 years of the age shall be grantedfamily pension for life and the same shall be evidenced by a certificate indicatingChronic Schizophrenia or Chronic Severe Schizophrenia obtained from a Medical Officernot below the rank of a Civil Surgeon as per Rule 49(6) of Tamil Nadu Pension Rules,1978 or from the Medical Board.

3. It is also hereby ordered that in cases wherein eligibility of family membersi.e. divorced or widowed or unmarried daughter occurs after issue of the PensionPayment Order (PPO), the pensioner himself or his/her spouse may intimate thedetails of divorced or widowed or unmarried daughter to the pension SanctioningAuthority. Similarly, in cases where the Pensioner or his/her spouse expired, thewidowed or divorced or unmarried daughter can themselves intimate such details tothe Pension Sanctioning Authority as and when their eligibility comes up. However,the family pension in such cases can be processed by the Pension Sanctioning Authorityeven without such intimation/acknowledgement, if sufficient proof of entitlement isproduced by the claimant and all other conditions for grant of family pension arefulfilled as per the Tamil Nadu Pension Rules, 1978 and Orders in force.

2. Representation have been received for enhancement of ceiling limit by5% over the previous years and to fix the Grade Pay of Rs.2800/- for availingconveyance advance as in Government orders first read above.

3. The Board has decided that

i. the ceiling of conveyance advance towards the purchase of Motor Cars andtwo wheelers be enhanced at the rate of 5% over the previous years notionally

with effect from 2010-2011 and to extend monetary benefits from the year2015-2016 prospectively as per the statement annexed.

ii. the benefits of availing conveyance advance be extended to the employeeswho are drawing their pay in Pay Band-1 with Grade Pay of Rs.2800/-.

4. The revised ceiling prescribed in the annexure will bear only prospectiveeffect from the year 2015-2016. For every subsequent year, the sanctioning authoritiesare instructed to accord the enhanced sanction as in the Annexure at the rate of 5%over the previous years, until further orders.

In the reference second cited, orders were issued superceding the earlier orderfirst cited upgrading the post of Record Clerks as Record Assistants in the ratio of 5:1and the same proportion be maintained for every 6 posts of Record Clerks inGovernment of Tamil Nadu. Subsequently, in the reference third cited, orders wereissued by the Government extending the same to the State Pubic Sector Undertakings.

2. Most of the Unions have represented to adopt the Government order tocreate promotional avenues to the Record Clerks in TANGEDCO. Since the strengthof Record Clerks working in Circle level is low, to adopt the ratio of 5:1, the Unionshave represented to modify the seniority of the Record Clerks from the existingCircle level to State level seniority for creation of promotional avenue alone.

3. The TANGEDCO has considered the request and after careful examination itis hereby ordered

i) To create 47 posts of Record Assistants in the Pay band of Rs.5,400-20,200+Rs.2,500 G.P. by abolishing 47 posts of Records Clerks duly adoptingthe G.O. under reference 2nd cited in the ratio of 5:1. by taking into account thepresent sanctioned strength of Record Clerks of 279. The number of RecordAssistants upgraded from Record Clerks will depend on the correspondingsanctioned strength from time to time.

ii) To create the Record Assistant posts, separate State Seniority list of RecordClerks working in TANGEDCO is to be prepared and maintained by theAdministrative Branch, taking into account the date of their joining in the postof Record Clerk.

iii) 47 Senior most Record Clerks be promoted as Record Assistants in the newlycreated post.

iv) The post held by the individual alone shall be upgraded without transferring himto other place and on their retirement, the post shall be downgraded.

v) Vacancies that would arise consequent on retirement/ Voluntary Retirement/Resignation of existing incumbents and death shall be filled up by the nextsenior most eligible person in the State Seniority list.

vi) Record Assistant promotion orders will be issued by the Administrative Branchon preparation of State Level seniority list of Record Clerks.

vii) This order will take effect from the date of issue of order.

viii) Necessary amendment to Tamil Nadu Electricity Board Service Regulations willbe issued separately.

PROCEEDINGS:

The Chief Engineer/Distribution/Coimbatore Region has stated that theCoimbatore Hotlines is covering 17 circles in 6 regions (i.e.) in 2 Distribution Regionsand partly in Hydro, Thermal Windmill Regions having around 250 Nos. 230 KV &110 KV Sub-Stations/Power Houses with associated 230 KV & 110 KV feedernetworks, and more number of 400 KV, 230 KV & 110 KV Sub-Stations and feedersare under progress. For these networks, phase matching has to be conducted whilecommissioning of new SS/Lines. Any emergency works on live line grid has to becarried out without disturbing the network. In order to avoid disruption of the Hotlinesworks and since, it is a specialized nature of works in the EHT transmission system, itis essential to carry out the Hotline works with the present incumbentThiru K.Narayanaswamy, who is having vast experience in Hotlines Wing and hasattended basic level training upto 230 KV training on high voltage testing techniquesetc.

2. Therefore, the Chief Engineer/Distribution/Coimbatore Region has proposedto upgrade the post of Assistant Executive Engineer/ Hotlines/Coimbatore held byThiru K.Narayanaswamy as Executive Engineer/Hotlines/Coimbatore, so as toaccommodate him on his promotion as Executive Engineer/Electrical for attendingthe hotline works. The Chairman-cum-Managing Director/TANGEDCO has approvedthe proposal.

3. Accordingly, sanction is hereby accorded for upgradation of one post ofAssistant Executive Engineer/Hotlines/Coimbatore in the pay band of Rs.15,700-39,100+Rs.6,100/- Grade Pay last continued in the reference first read above asExecutive Engineer/Hotlines/Coimbatore in the pay band of Rs.15,700-39,100+Rs.7,000/- Grade Pay, in the office of the Superintending Engineer/Operation/Coimbatore, for a period of one year from the date of utilization of the post, so as toaccommodate Thiru K.Narayanaswamy, Assistant Executive Engineer/Hotlines/Coimbatore in the upgraded post. In view of the above, the Shift Operator log books andreading registers in Chief Engineer/Mettur Thermal Power Station-I are accumulatedin Store rooms and there is no space to maintain these records.

2) During the review meeting on "Thermal Generation" held at Head Quarterson 06.03.2013, a proposal for destruction of these aforementioned records hadbeen placed by the Chief Engineer/Mettur Thermal Power Station-I and it was decidedto obtain proposal from the Chief Engineer/Mettur Thermal Power Station-I. TheChief Engineer/ Mettur Thermal Power Station-I submitted a proposal for destructingthe entire completed Shift Operators log book and reading registers pertaining to allthe Shift operating locations of Mettur Thermal Power Station-I, retaining the recent5 years record of Log Books and recent 15 years record of Reading Registers andalso requested to maintain the above procedure in future also.

3) The proposal of the Chief Engineer/Mettur Thermal Power Station-I hasbeen examined in detail and the Chairman-cum-Managing Director/TANGEDCO hasapproved the same. Further, the Chairman-cum-Managing Director/TANGEDCO hasalso ordered to follow the procedure in all other Thermal Stations as well.

4) Accordingly, in partial modification of the instructions issued in the TNEBOffice Manual, Appendix XIV, the following orders are issued:-

To destruct the entire completed Shift Operators Log Book and Reading Registerspertaining to all the shift operating locations of all Thermal Stations only by retaining:-

In the reference-1 cited above, certain guidelines were issued to provide theLT/HT consumer to show cause as to why the claim relating to earlier assessmentperiods should not be levied against him, thereby providing an a opportunity of beingheard, keeping in mind the Principles of Natural Justice and then to raise claim/ demand.

2.0) In the reference -2 cited, the Hon'ble State Information Commissioner,Tamil Nadu Information Commission, Teynampet, Chennai in the order of a AppealCase filed by a Appeal Petitioner one Thiru.A.V.Mani/Kallakurichy Taluk (Vs) EE/O&M,Thirukkovilur, has stated as below:-

"It is one of the features of the EB Officials' duty to be informed to the consumeras to how and in which circumstances it is collected as c.c. arrears. The petitionerinformed that it is prevailing all over Tamil Nadu. So the Commission considers thatformulating a fixed and required procedures will be suitable to welfare of justice.Examining this feature, the Chairman/TNEB may decide appropriately".

3.0) Hence the Superintending Engineers/E.D.C are again instructed to strictlyadopt the following guidelines:

"i) Whenever any claim is made against the service connection relating to theearlier assessment period which are raised based on the reports of BOAB, AG Audit,Inspection, etc., then such claim has to be scrutinized by the officials concerned forits correctness before being billed/claimed from the consumer.

ii) The working details of such demand/claim and the Regulations/Orders/Instructions based on which such demand/claim is raised have to be communicatedto the consumer so as to enable him to arrange for payment.

iii) In such communication to the consumer, it need not be stated that thedemand has been raised by BOAB, etc. Rather, it should be a communication fromthe officer-in-charge/Competent Authority to levy such demand.

iv) In such communication to the consumer, he may be requested to showcause within a time limit (say 15 days) as to why such demand shall not be leviedagainst him.

v) The consumer may be given an opportunity to represent, in each occasion,whenever the claim is made relating to earlier assessment period in both H.T and L.TServices.

vi) The final claim should be in a speaking manner duly addressing the contentionsof the consumer in the reply to the show cause notice and mentioning the Regulations/Orders/Instructions etc. in force."

In the reference (1) cited, TANGEDCO had sought Tamil Nadu Mercantile Bankto explore the possibility to collect the current consumption charges of LT consumersthrough their ATMs. In this regard, TMB in reference (2) cited had requested TANGEDCOto extent the facility for remittance of LT CC Charges through ATMs.

2.0) Discussions were held in this regard between the officials of TANGEDCOand TMB as per the reference (3) cited and Agreement for the alternate mode ofcollection of TANGEDCO CC bills through their ATMs using Debit card by their customerswas executed on 07.01.2016 between TMB and TANGEDCO.

3.0) In this regard, as per the reference (5) cited, TMB is requested to arrangeto introduce the facility of collection of LT CC Charges through their ATMs from27.02.2016 onwards. The amount collected through ATMs which are credited in"TANGEDCO-ATM account" with your bank shall be transferred to the designatedaccount of TANGEDCO as per the Agreement executed vide reference (4) cited.

As per Regulation 5(5) of Tamil Nadu Electricity Supply Code, the adequacy ofSecurity deposit is to be reviewed and re-fixed once in a year in case of High Tensionconsumers and LT consumers with monthly billing; once in two years in case of LowTension consumers with Bi-monthly billing, during April/May, taking into account theinterest due for credit. Therefore, as per Tamil Nadu Electricity Supply Code, thereview of adequacy of security deposit for H.T and L.T consumers (LTCT & IIIB Industries,since the last review was made in 2014) are to be made during April/May 2016.

2. In this connection, the following instructions are issued:-

2.1 Calculation of Interest on SD and Crediting the same:

i) The TNERC in the reference cited has directed for payment of interest @ 8%p.a on the Security Deposit from the consumers for the year 2015-2016 and intereston MCD should be 8% p.a. Hence, before reviewing the adequacy of SD in respect ofHT and LT consumers, the interest due for 2015-2016 at 8% p.a may be arranged tobe credited to all the HT/LT consumers SD account and 8% interest on MCD may alsobe allowed to all HT consumers.

ii) As per Regulation 46(2) of Tamil Nadu Electricity Distribution Code, interest ispayable on the Meter Security Deposit (MCD) at the rate specified by the TNERCfrom time to time. Therefore the interest @ 8% p.a may be allowed on MCD inrespect of HT services for the period 01.04.2015 to 31.03.2016. The above interestmay be paid to the consumer through adjustment in the future month currentconsumption charges. However no interest on Meter Security Deposit is payable inrespect of LT Services.

iii) As per Regulation 35(4) of the Distribution Code, while allowing the intereston security deposit, full calendar months only should be taken into account for thepurpose of interest calculation and the interest to be calculated to the nearest rupeei.e 50 paise and above should be rounded off to the next higher rupee.

iv) As per Section 5(5) (iii) of Tamil Nadu Electricity Supply Code, the creditavailable including the interest shall be informed to each consumer before the end ofJune 2016. Therefore, necessary intimation to all the consumers about the availabilityof Security deposit including interest as on 01.04.2016 may be arranged to becommunicated before 30.06.2016.

2.2.Review of Adequacy of SD:

i) A through review of adequacy of security deposit in respect of H.T. servicesmay be commenced during 1st week of April 2016 and completed before 20th of thesame month and in respect of LT (LTCT & IIIB Industries) consumers, as the reviewhas been automated, arrangements may be started from 1st April to issue the demandnotices to the consumers for additional security deposit, wherever required, and maybe completed before the end of April 2016 for early collection.

ii) The review of adequacy of security deposit shall be made as per the provisionsof Regulation 5(5) (ii) of Tamil Nadu Electricity Supply Code as follows:

a) For the categories of consumer under monthly billing, the Security Deposit isequivalent to two times of the monthly average of the electricity charges for thepreceding twelve months prior to April.

b) For the categories of consumer under Bi-monthly billing, the Security Depositis equivalent to three times of the monthly average of the electricity charges for thepreceding twelve months prior to April.

iii) After crediting the interest to the SD account, the review of adequacy ofsecurity deposit as per the provisions of Regulation 5(5) of Tamil Nadu ElectricitySupply Code, may be arranged to be made and the Demand notices to be sent to theconsumers, wherever required. In case of excess, such excess deposit may bearranged to be adjusted/refunded to the consumers as per Regulation 5(5)(v) ofTamil Nadu Electricity Supply Code.

iv) As per TNERC's Order No.6, dt.31.07.2012, Order No.7, dt.31.07.2012,Order No.8, dt.31.07.2012, Order No.4 of 2014, dated 12.09.2014 in respect of

Wind Energy Captive User/third party user, Bagasse based Co-generation plants'captive user/third party and Biomass based power plants' captive/third party userand Solar Power Plant’s captive/third party user respectively, two times the chargescorresponding to maximum net energy supplied by the distribution licensee in anymonth in the preceding financial year (ie, prior to April 2016) shall be taken as thebasis for the payment of Security Deposit.

v) Further, as per the TNERC's Order No.4 dt.15.05.2006 in respect of fossilfuel based Captive Generating Plants' captive/third party user and fossil fuel basedCo-generation plants' captive/third party users, the Security Deposit shall be fixed attwo times of the average net consumption during the preceding twelve months priorto April 2016.

vi) Further, while review of adequacy of SD in respect of HT Consumers whohave adjustment of inter-state energy (ie, energy from IEX, etc.) the Security Depositshall be at two times of the average net consumption during the preceding twelvemonths prior to April 2016.

vii) The Hon'ble TNERC, in its Notification Nos.7-29, dt.16.12.2011 has statedthat:- In the Principal Code, in Clause (5) of Regulation 5, the following sub-clause(vii) shall be added at the end, namely-

" (a). For the consumers under monthly billing who are not the owners of thepremises and are unable to produce the consent letter in Form 5 of Annexure III tothe Distribution Code from the owner of the premises for availing supply, the SecurityDeposit shall be equivalent to four times of the monthly average of the electricitycharges for the preceding twelve months prior to April;

(b). For the consumers under bi-monthly billing who are not the owners of thepremises and are unable to produce the consent letter in Form 5 of Annexure III tothe Distribution Code from the owner of the premises for availing supply, the SecurityDeposit shall be equivalent to six times of the monthly average of the Electricitycharges for the preceding twelve months prior to April."

Therefore, the above aspects have to be taken into consideration while reviewingthe adequacy of SD.

viii) The Consumers who own buildings/super-structures in the SIPCOT/SimilarIndustrial estates under 99 years lease agreement with such institutions, the Regulation5(5) (ii) (a) of the Supply Code may be applied. If such consumers are captive/thirdparty user, the relevant provision has to be applied.

ix) The security deposit in the above categories shall exclude incidental chargeslike operation and maintenance of lines/sub-stations of generator charges for thepurchase of power from third parties but shall be inclusive of all other charges specifiedby the Commission from time to time in accordance with Regulation 5(5) (ii) (d) ofthe Tamil Nadu Electricity Supply Code.

x) The Chief Engineer/IT shall make necessary programme in the computer asindicated above for the review of adequacy of SD in HT & LT including the servicescovered under R-APDRP.

xi) In respect of LT services, the review of adequacy of SD may be madethrough Computer programme. The Rev.Branch AAO/AS shall ensure the correctnessof the Opening Balance of SD and posting of further collection of additional SD/refundof excess SD, if any.

2.3.Serving of ASD Notices:

i) As per Regulation 5(5) (iv) the intimation of the requirement of ASD shall bethrough a separate notice in the case of HT services & by a distinct entry in theconsumer meter card (or) separate notice in the case of LT services. Thirty daysnotice period shall be allowed for the payment.

ii) The CE/IT is requested to make a computer programme to print the detailssuch as, availability of SD, rate of interest, interest accured, SD required, AdditionalSD required, last date of payment of ASD, in the bottom of the CC receipt issued tothe LT consumers during April, May and June 2016. Further SMS and e-mail may alsobe arranged as "add on facility". The demand intimation notices may be arranged tobe printed in Tamil & English. Demand Notice may also be arranged to be sent throughe-mail to the HT consumers and also to the LT consumers, wherever available.

iii) The SE/EDCs must make necessary arrangements to educate all the LTConsumers (through display boards in the collection counters, etc.) that the ASDdetails are printed at the bottom of the CC Receipts and the consumers must remitthe ASD amount with in the due date so as to avoid levy of BPSC & disconnection oftheir service connections.

2.4 Collection of ASD:

i) As per Section 5(5) (iv) of Tamil Nadu Electricity Supply Code, thirty daysnotice period shall be allowed for payment. Therefore, necessary demand notice maybe arranged to be issued for collection of additional security deposit by indicating theabove provision. However, if the consumers request for payment by instalments, insuch cases, three instalments commensurate with the billing cycle may be allowedby the Superintending Engineers of Distribution Circles for HT services and by theExecutive Engineers of O&M (Revenue Branch) in respect of LT services. The duedate of instalment should be watched and collection made according to the scheduleof instalment. The facility of payment in instalments will be made available to theconsumer on request. To avail this facility, the consumer shall execute an undertakingin Form (5) in the Appendix to Supply Code. The Chief Engineer/IT is requested toarrange to provide necessary screens in this regard.

2.5. Levy of Belated Payment Surcharge (BPSC):

(i) As per Regulation 5(4) (vi) of the TNE Supply Code, in case of sums otherthan the price of electricity supplied which are outstanding, surcharge shall be leviableat a rate not exceeding 1.5% per month.

(ii) The Chief Engineer/IT may arrange to indicate that "failure to make paymentof the ASD with the due date will attract levy of BPSC" in the demand intimationNotices/CC receipts, as may be applicable.

(iii) Where the consumers have been permitted to make payment in instalments,then surcharge shall accrue only when there is default in the payment schedule andthe surcharge shall be worked out from the day following the day on which theinstallment fell due and shall be payable along with the amount of instalment due.

2.6.Payment of Honorarium:

i) For attending the work of checking the interest on SD, review of adequacy ofSD, compliance of demand notices etc. in respect of all LT services relating to vacantseats /excess over norms, the honorarium of Rs.2/- per service may be paid.

ii) In respect of LT Services where adequacy of SD is not involved and only the

work of allowing/checking of interest on SD; Verification /Posting, posting in respectof ledger; preparation/compilation of intimation on the availability of SD are involved,in such cases an honorarium of Rs.1/- per service in respect of vacant seats/excessover norms may be paid.

iii) Further it is also ordered for payment of a separate honorarium of Rs.1/-per service for serving of notice of ASD demand to the consumers duly getting properacknowledgement.

2.7 Income Tax:

i) The Income Tax may be deducted (TDS) for the interest allowed, if theinterest payable exceeds Rs.5,000/- as per Sec 194 A of the IT Act 1961.

ii) The Income Tax may be deducted at the following rates:-

a) If PAN is furnished @ 10%

b) If PAN is not furnished @ 20%

iii) Time Limit to remit to the Government A/c :- Since the interest relatesto the previous financial year, (ie) 2015-2016, provision (credit) is made in the booksof accounts on 31.03.2016, the time limit is "on or before 30th day of April 2016".

2.8. Report:-

i) The fortnightly progress of demand, collection and balance of ASD should bewatched without omission and it must be ensured that the figures available in theComputer, reflect the actual position.

As per TNERC Distribution code clause 27(2), Form- 2 has been prescribed forregistering application for new agriculture service connection. The application is to besigned by the owner of the well. If there are partners, all must sign or consent to begiven by co-owners.

In the absence of co-owners consent, accepting Indemnity bond as per clause27(4) are still considered by some of the field officers for the new and alreadyregistered pending agriculture applications. In some of the cases, where there aredisputes between the owners, one move to court before or after giving serviceconnection, impeding TANGEDCO as respondent either not to give service connectionor to disconnect the service connection. Resources are wasted in dealing with suchtypes of court cases. Also acceptance of Indemnity bond is inconsistence with theTNERC Form-2.

In this connection, a copy of judgement pronounced by Honarable HIGH COURTOF JUDICATURE AT MADRAS in W.A.No.261 of 2015 and M.P.No.1 of 2015dt.23.04.2015 is enclosed. In the penultimate Para of the judgement it is stated that

“12.Examining from all angles, as aforestated, we are of the considered viewthat the provisions of Clause 27(4) of the Code 2004 shall not be available andapplicable in case of agriculture service connection as in the case on hand.”

As such, it is informed that obtaining indemnity bond in the absence ofco-owner consent should not be entertained in dealing with new and registered pendingagriculture applications excluding the ready parties.

JUDGEMENT

Challenging the order dated 17.07.2013 rendered in W.P.No.22941 of 2010,the appellant, who was the writ petitioner, has come up with the instant appeal,questioning the validity of the order on the ground that if the co-owners of theproperty in question do not give consent letter or no objection to the electricityconnection in the name of the writ petitioner, the service connection can be given tothe occupant, on indemnifying the licensee against any loss on account of disputesarising out of effecting service connection and also acceptance to pay security deposittwice the normal rate. As such, the writ petitioner is entitled to electricity connectionon submission of the indemnity bond and also payment of security deposit twice thenormal rate.

2. The facts in brief are that the writ petitioner seeks agricultural electricityservice connection to the Well situated in S.F.No.60/4B, Thevur village, Salem Districtwithout no objection certificate from the third respondent and others, who areco-owners of the Well in question. The learned Single Judge, relying on the provisionof Clause 27(2) of the Tamil Nadu Electricity Distribution Code, 2004 (for short “Code2004”) rejected the writ petition on the ground that agricultural electricity serviceconnection cannot be granted without no objection certificate obtained from theco-sharer / co-owner of the Well in question. Feeling aggrieved, the writ petitioner isbefore us, in the instant appeal.

3. The question before us for consideration is whether Clause 27(4) of theCode 2004 is applicable to the agricultural service connection for the Well owned andshared by the third respondent and others for want of no objection certificate fromthem.

4. The learned counsel appearing for the appellant would submit that Clause27(4) of the Code 2004 clearly provides that if owner refuses to give consent letter,including the co-owner, the intending consumer, after producing proof of lawfuloccupation of the premises, including Well and also on executing an indemnity bond in

Form 6 of the Annexure III to the Code, indemnifying the licensee against any loss onaccount of disputes arising out of effecting service connection to the other ownerand also on payment of security deposit twice the normal rate, is entitled to electricityservice connection. The writ petitioner /appellant is ready and willing to execute suchindemnity bond and also to produce relevant certificate indicating that he is theco-owner of the Well and shall also pay the security deposit twice the normal rate.

It is further contended by the learned counsel for the appellant that the thirdrespondent is already having a connection in the Well though he is one of theco-owners and despite that, he is objecting the other co-owners, which is not properand the same cannot be denied if the indemnity bond in the statutory form is executedand the requisite fee is paid by the intended consumer, relying on a decision of thisCourt in A.Muthusamy and others Vs. The Assistant Engineer, Tamil Nadu ElectricityBoard, V.M.Chathiram, Tirunelveli” 1 2009 (4) CTC 606

On the other hand, Mr.S.K.Raameshuwar, learned counsel appearing for theElectricity Board and R.Marudhachalamurthy, learned counsel appearing for theco-owner / third respondent would submit that Clause 27(4) of the Code 2004 isapplicable only to the premises for availing supply in case the owner refuses to giveconsent letter or he is not available to give the consent letter on the condition specifiedtherein. In the case on hand, the service connection is required for Well, which is notthe premises and also the appellant is not the occupant or a resident as requiredunder the provisions of Sub-clause 4 of Clause 27 of the Code 2004 to get thebenefit under the said provision.

7. We have considered the rival contentions carefully and also examined thepleadings and documents appended thereto.

8. It is beneficial to refer and extract the relevant provisions of Clause 27(2)and (4) of the Code 2004.

“(2)Supply to Agricultural category : Application for supply to agriculturecategory shall be in Form 2 of Annexure III. In respect of the agriculturalcategory, this provision shall be governed by the directives issued by theCommission from time to time, on the basis of the guidance on thismatter by the National Electricity Policy (as stipulated in sub section 4under section 86 of the Act) and the policy directions in public interestgiven by the State Government under sub section (1) of section 108 ofthe Act.

(4) An intending consumer who is not the owner of the premises shallproduce a consent letter in Form 5 of Annexure III to this code from theowner of the premises for availing the supply. If the owner is not availableor refuses to give consent letter, the intending consumer shall produceproof of his/her being in lawful occupation of the premises and alsoexecute an indemnity bond in Form 6 of the Annexure III to this codeindemnifying the licensee against any loss on account of disputes arisingout of effecting service connection to the occupant and acceptance topay security deposit twice the normal rate.”

9. On perusal of the relevant provisions, it appears that Clause 27(4) of theCode 2004 is intended to provide supply of electricity to the occupant of the premises,who is unable to obtain consent letter from the owner of the premises either onaccount of non availability or refusal to give consent letter, on production of proof of

occupancy, execution of indemnity bond in Form 6 of the Annexure III and alsopayment of security deposit twice the normal rate.

10. There is no dispute that in the instant case, the property in question is aWell owned by the co-sharers /co-owners. The appellant is one of the sharers /owners of the Well. The well cannot be held from any point of view as premises forthe purpose of taking the benefit under the provisions of Clause 27(4) of the Code2004. The reliance of the petitioner in A.Muthusamy case (supra) is misplaced as thefacts in that case was that the intended consumer therein was seeking electricityservice connection to the residential house, which was acquired by the Governmentfor the purpose of the housing scheme.

11. Clause 27(4) of the Code 2004 contemplates requirement of productionof consent letter in Form 5. Form 5 is annexed in Annexure III to the Code. Clause27(4) refers to a premises whereunder the tenant is an occupant and in the event ofrefusal to give consent by the owner, a deed of indemnity bond in Form 6 of theAnnexure III to the Code shall be executed which also refers to the premises takenon lease by the intending consumer. Form 2 of Annexure III to the Code is the properform for making an application for agriculture service connection. But, in the case ofagriculture service connection, there is no provision for availability of Clause 27(4) ofthe Code 2004. Sub clause (2) of Clause 27 deals with the supply to agriculturalcategory. Sub clause (3) of Clause 27 deals with application for HT supply and subclause (4) of Clause 27 deals with the supply of electricity connection to the tenantor lessee in the premises owned by other persons.

12. Examining from all angles, as aforestated, we are of the considered viewthat the provisions of Clause 27(4) of the Code 2004 shall not be available andapplicable in case of agriculture service connection as in the case on hand.

13. For the reasons and analysis herein-above, no case has been made out forinterference. Thus, the writ appeal is dismissed. No costs. Consequently connectedmiscellaneous petition is closed.

Standing Committee meeting on Power System Planning of Southern Region held on31.08.2014.

1.2 For terminating the 765KV DC line from Ariyalur 765KV substation, 2 numbers of765KV GIS bays with Line reactors are required at Thiruvalam 765KV PGCIL substationfor stability and transfer of power to other region. It is to be stated that, it is theexisting practice that bays are to be constructed by the owner of the substation.Accordingly, TANTRANSCO has requested M/s. PGCIL to give their offer.

1.3 In this connection, recently M/s. PGCIL has offered a tentative estimated cost ofRs.182.21 crores (inclusive of customs duty @ 23.4155 plus 2% handling charges)excluding Consultancy fee @ 15% of the final actual executed cost of the works,applicable taxes and duties on consultancy fee and compensation payable to PowerGrid for 2 numbers of 765KV GIS bays with line reactors at Thiruvalam 765KV PGCILSS. The first Customer Support Programme was conducted at the Head QuartersHoward hall on 18th and 19th December-2015.

The AGM/Commercial/NTPC vide their letter dated 18.01.2016 has intimatedthat owing to the non availability of resource personnel, would like to conduct thesecond Customer Support Programme on the subject "Maintenance and testing ofPower transformers, switch yard protection and Gas Insulated Substation" for oneday between 1st to 4th March 2016 either at Head Quarters or at NCTPS as perTANGEDCO's choice. Also, NTPC has agreed to conduct the above program withtheir faculties and to provide the training course kit to all the participants. TANGEDCO

shall provide the venue with all training infrastructures like audio/visual aids, tea/snacks & lunch to all the participants and faculties.

Accordingly, the Deputy General Manager/Thermal Training Institute (TTI) hasrevised the estimate to Rs.12,000/- (Rupees Twelve thousand only) with 30participants for the training program.

After careful consideration approval is hereby accorded for conducting the secondNTPC Customer Support Programme for TANGEDCO Engineers on the subject"Maintenance and testing of Power transformers, Switch yard protection and GasInsulated Substation" for one day at the training the hall of NCTPS-I with 30participants in between 1st to 4th March – 2016 (on a mutually convenient date) atan expenditure of Rs.12,000/- (Rupees Twelve thousand only) organized by theDeputy General Manager/TTI.

The Superintending Engineer/P&A/NCTPS-I, Chennai is authorized to makepayment for conducting the above program by opening Temporary Advance in thename of officer nominated by the Deputy General Manager / TTI, North Chennai.

REPORT

For implementing AMR (Automated Meter Reading ) for WindFarm, Co-gen,Solar in TANGEDCO for Billing and Monitoring activities, CMD/TANGEDCO has directedas below:

i) CE/MM to procure meters.

ii) P&C wing to procure Modems, Data Concentrator Units (DCUs).

iii) CE/IT will finalise the mode of software procurement

In this regard the following are submitted.

I. In the process of tender for supply, installation, testing and commissioningof Data Concentrator units (DCUs), GPRS Modems with SIM card, CE/P&C hasrequested to clarify the following queries raised by the vendors during the pre-bidmeeting conducted on 15.10.2014 by P&C wing.

1) Details of Head End Hardware setup like servers, storage devices, load balanceetc., where date of GPRS modem/DCU has to be transferred.

2) Details related to the Meter Data Acquisition System (MDAS) software, MeterData Management System (MDMS) for acquiring the data from the remoteGPRS Modems/DCU.

3) Data Security system features.

4) In case the MDAS software is to be included in the tender for procurementof modem itself, the same may be specified.

II. Further CE/O has requested to ensure the real time data from all the WEGs& load points of the Grid at the Renewable energy Management Centre (REMC)preferably at Madurai and the consolidated data summation of all wind generation asa single value from Renewable energy Management Centre (REMC) may be arrangedto be communicated to State Load Despatch Centre, Chennai through Maduraisub-load despatch centre, for monitoring and maintain Grid discipline.

III. It is stated that CE/IT wing has a suggestion to make use of the Hardwareand software procured under R-APDRP scheme, for the implementation of AMR forWindfarms, Solar, etc., as the R-APDRP Hardware (servers & Network accessoriesare meant for 110 towns initially and are scalable. However to get the opinion orR-APDRP wing the above queries were communicated to CE/R-APDRP.

IV. in response, CE/R-APDRP has suggested the following on utilising R-APDRPresources:-

i) The Existing R-APDRP MDAS server capacity has been sized for the modemscoming under R-APDRP Part-A i.e. 110 towns and can be scaled based onthe requirements. As on date around 6000 modems only are communicatingto this server and balance 45000 modems are yet to communicate. As

such the performance of the server to cater this load cannot be assumednow. Moreover, under Part-B another 35000 modems are also expectedto communicate to the same server. As such, it is suggested that theproposed AMR for windmills, CPP, Co-Gen, Solar panels, etc can be dealtseparately with required Hardware & Networking at Data centre.

ii) The MDA (Meter Data Acquisition) software is solely dependent on the Modemsupplier as there is no defined protocol for the data communication betweenModem & MDA server. As such, the successful bidder for Modem deploymenthas to deploy his own MDA software in the server to be provided for him.

iii) The software specifications as mentioned in the SRS, under R-APDRP, forMDAS can be implemented for the proposed AMR if necessary.

iv) The proposed AMR for Windmills, CPP, Co-Gen, Solar Panel etc…can be dealtseparately with separate Hardware, MDA software & Generation Billingsoftware and integrated with existing R-APDRP HT Billing software to acquirethe windmill data for HT Billing. The Infrastructure of the present Data Centrecan be assessed and utilized by IT wing for erection of servers & Networkingequipment’s.

V) The above details received from CE/R-APDRP was communicated toCE/P&C to proceed with Tender activities and also requested to deal with the aboverequest of CE/O, regarding of ensuring real time data of all WGGS, at CE/P&C end.

VI)Subsequently CE/O has suggested that instead of procuring new hardwarefor the proposed AMR project the existing Hardware available in the R-APDRP projectcould be beneficially used.

In this regard it is submitted that R-APDRP project has been envisaged to monitorAT&C loss in 100 towns, at present only 68 Towns have gone 'GO-Alive'. As such theperformance of the Servers at full load cannot be predicted now. Also as perR-APDRP project LOA, if the server is to be scaled up it will be at the cost of TANGEDCOonly. Moreover, CE/operation has requested for real time data from all the WindEnergy Generators from this AMR project, if these data are stored in the R-APDRPservers, performance issue may arise.

VII) Meanwhile, during the meeting held on 02/07/2015 at MD/TANTRANSCO's Chamber for Implementation of AMR, along with CE/Grid operation(i/c), CE/P&C, CE/NCES, CE/MM (i/c) the above suggestion of CE/Operation wasdiscussed in detail. Based on the outcome of the discussion MD/TANTRANSCO hasdirected that "Exclusive servers with billing software to be made ready by CE/IT withnecessary security features. "

Considering the above points, it is suggested that the required Hardware andSoftware needed for the AMR project as detailed in the Annexure I may be providedexclusively. The same may be procured through open tender by CE/IT wing andhouse the Hardware and Software in the MLDC Server Room/Chennai. The AMRproject data can be used for billing purposes, real time Monitoring in Load dispatchcentre and exchanging the data between R-APDRP installed servers through webservices.

The estimate for provison of Hardware and Software for AMR project is worked outto Rs.2,06,65,000 (Rupees Two Crore Six Lakhs Sixty Five Thousand only).
