WHEREAS by "The Water Supply, Sewerage, and Drainage Act, 1912,II it is provided that the Governor may dissolve a Board constituted under (inter alia) "The Water Boards Act, 1904," and that on and after such dissolution the lands and works of the Board :Alan vest in the Minister, and the Minister may exett-rise the powers and authorities and shall have the immunities conferred on a Board by Such last men-tioned Act: Now, therefore, His Excellency the Gover-nor, by and with the advice and consent of the Execu-tive Council, in exercise of the powers conferred by "The Water Supply, Sewerage, and Drainage Act, 1912," doth hereby revoke the order for the constitu-tion of the Board for the Cue-Day Dawn Water Area, and doth hereby dissolve the Board for the said Area, as from the 1st day of January, 1914, inclusive.

WHEREAS by "The Metropolitan Water Supply, Sew-erage, and Drainage Act, 1909," it it, provided that, subject to the provisions of the Act, the Minister of Water Supply, Sewerage, and Drainage shall, with the approval of the Itovernor, have power to construct and extend_ Water Works. Sewerage Works, and Stormwatep Drainage Wm ts: Now, therefore, His Excellency the Governor, with the advice of the Executive Council, hereby approves of the construction by the Minister of Water Supply, Sewerage, and Drainage of the following works ander the said Act, namely:—

Cast iron water main to supply Brighton reservoir, East Fremantle, Division No 143.

This Order in Council shall take effect Trout the 19th, day of December, 1913.

Henry Peterson. in trust for an Agricultural Hall: Now, therefore, His Excellency the Governor, by and with the advice and consent of the Executive Council, (loth hereby .direct that the before-mentioned Reserve shall vest in and be held by Joseph Antony Elliott, Frederick Turner, and Thos. Henry Peterson, in trust for an Agricultural Hall; subject, nevertheless to the powers reserved to him by Section 41 of the said Act.

WHEREAS by Section 42 of " The Land Act, 1898," it is made lawful for the Governor to direct that any Reserve shall vest in and be held by any Municipality, Road Board, or other person or persons to be named in the order, in trust for any of the purposes set forth in Section 39 of the said Act, or for the like or other public purposes to be specified, in such order : And whereas it is deemed expedient that Reserve No. 9610 should vest in and he, held by Leonard Charles Dalton, Herbert Percival Tuckfield, and David Struth, in trust for the purpose of Water : Now, therefore, His Excel-lency ,the Governor, by and with the advice and consent of the Executive Council, cloth hereby direct that the before-mentioned Reserve shall vest in and be held by Leonard Charles Dalton, Herbert Percival Tuckfiela, and David Struth, in trust for the purpose aforesaid; subject, nevertheless, to the powers reserved to him by Section 41 of the said Act.

IT is hereby notified, for general information, that His Excellency the Governor in Executive Council has been pleased to approve of the areas scheduled hereunder being made available for selection under "The Land Act, 1898," and its amendments. The selector of a Homestead Farm from any location available under Part VIII. must take the balance thereof under Conditional Purchase, and a selector of a portion of any location available under Part VI. must take the balance of same under Grazing Lease conditions.

The areas which are open under Part V. are open under Section 55 (Residential Conditions), and only under Section 56 (Non-residential Conditions) to those persons already holding their full complement under Section 55 in the immediate vicinity.

The lands marked with an asterisk are available under Part VI.

Applications must be lodged at the Local Land Office for the District in which the land is situated.

Any application may be lodged before the fixed date, but will he treated as having been received on that day; if there are more applicants than one for any lot, the application to be granted will be determined by the Land Board, and should any lands remain unselected such will continue available until applied for or other-wise dealt with.

If a Land Board sitting becomes necessary, after the closing of the date for receiving applications, notice will he given in the Gocernment Gazette and at least one newspaper advising the applicants for the blocks of the (late, time, and place of the meeting of the Board, to deal with the matter; but it shall not he obligatory on the Department to give any other notice.

If an applicant wishes to appear before the Land Board in person, he may apply to the Head Office or to the Clerk in Charge of any of the District or Branch Land Offices for a certificate to the Railway Department, which, on presentation at the nearest Railway Station, will entitle him to a Return Ticket, at Excursion Rates, to the place where the Board will sit, available for seven days from the date of issue.

Any application may be lodged before the fixed date, but will be treated as having boon received on that day; if there are more applicants one for sup lot the application to be panted will be determined by the Land Board, and should any lands remain un.seleeted such will continue available until applied for or otherwise dealt with.

If a Land Board sitting becomes, necessary, after the closing of the date for receiving applications:, notice Will be given in the Covcrninent Gazette and at least one 'newspaper adv tna applicants for the blocks of the date, time, and pine of the meeting of the Board, to deal with the matter; but it shall not be obligatory on the Department to give any other notice.

If an applicant wishes to appear before the Land Board in person, he may apply to the Head Office or the Clerk in Charge of any of the District or Branch Land Offices for a certificate to the Railway Department, which, on presentation at the nearest Railway Station, will entitle him to a Return Ticket at Excursion Rates, to the place where the Board will sit, available for seven days from the date of issue.

Land specified as carrying an Agricultural Bank advance is available subject to the special condition that an expenditure of not less than one-fourth of the amount set out shall be made on prescribed improvements in each of the first four years of the lease; but this shall not release the holder from any covenant in the Agricultural Bank Mortgage requiring the improvements to be made at an earlier date. Such= advance is subject to the usual conditions governing a loan from the Agricultural Bank, particulars of which may be had on application to the Managing Trustee. Applications for advance must be accompanied by a fee of one per cent.

The areas which are open under Part V. are open under Section 55 (Residential Conditions), and only under Section 56 (Non-residential Conditions) to those persons already bolding their fell complement under Section 55 in the immediate vicinity.

IT is hereby notified, for general information, that His Excellency the Governor in Executive Council has been pleased to approve of the following By-laws for the Leonora Water Area, under Section 141 of "The Water Boards Act, 1904,'' as from the 1st day of January, 1914, inclusive, and also to approve of the cancellation of all previous By-laws relating to the said Area made under the aforementioned Act, as from the 31st day of December, 1913.

LEONORA WATER SUPPLY. By-laws.

Interpretation Clause. In the construction and for the purposes of these By-

laws, unless the context otherwise requires, the terms " Cesspool, " " Dra i n, " " Earth Closet." " -Hon se, " "Laud," "Owner," "Person," "Piggery," and "Slaughter-house" shall have the meanings severally attached to them in Section 3 of "The Health Act, 1911."

The words " Board," " Fitting, ' ' " Land," "Occu-pier," " Owner, " "Person," " Pipe, " " Prese'ribed,"

Rateable land," "Water Area," " Waterworks, " and "Works" shall have meanings severally attached to them in the principal or any amending Act and the By-laws made thereunder.

" Reservoir" shall mean any reservoir, clam, tank, cistern, or well.

"Feeder" shall mean any watercourse, creek, stream, or other channel with either perennial or intermittent flow whereby water can be conveyed to any reservoir.

"High Water Mark" shall mean the level of full supply of any reservoir, or feeder thereto.

" Inspector " and Local Officer" respectively shall mean a person appointed by the, ,Minister for the pur-poses of these By-laws or to administer the said By-laws.

"Minister" shall mean the Minister of' Water Supply; Sewerage, and Drainage acting in pursuance of Section 161 of "The Water Boards Act, 1904."

Division 1.-By-laws for Preventing Pollution of the Waters of the Catchment Area.

1. No person shall bathe, or wash clothes or other articles, in any reservoir or other waterworks 'within the water area, or wash, throw, or cause to enter therein any dog or other animal; or throw or convey, or permit to be conveyed or thrown therein any rubbish, dirt, filth, dead animal, or other noisome thing or otherwise cause any pollution of water within the Water Area.

2. No person shall deposit, or permit to be deposited, any refuse, dung, manure, or other offensive matter in or near say Catchment Area, or in any place where, in the opinion of the Inspector, storm waters will be liable to wash such matter into any feeder.

3. No person shall place or deposit or spread, or permit to be placed, deposited, or spread, in or upon any land or garden within the Catchment Area, any night-soil or human urine, whether mixed with any other substance or not, or any solution of nightsoil, unless the sa ire has been thoroughly deodorised and disin-fected to the satisfaction of the Inspector, and unless written consent thereto has been obtained.

4. In the event of the death, or of any accident necessitating the slaughter of any horse, cattle, sheep, or other animal, the carcase of such animal shall be-re-moved by the owner thereof to a safe distance from any waterworks, or to such place as the i tor may direct, and the owner shall immediately thereafter dis-pose of same, by burning, to the satisfaction of the Inspector.

5. No person shall deposit or cause or permit to be deposited. any rubbish, filth, blood, offal, or manure, or any slops, soap-suds, urine, water containing urine or othei' refuse, noisome thing, or matter in any part of the Catchment Area or Water Area, whence it may, in the opinion of the Inspector, be carried by storm water into any feeder.

G. Unless otherwise provided for, the time which may elapse between the giving of a notice and the doing of a thing required to be done by any Inspector or other authorised officer shall be determined by the Minister, according to the nature of each ease.

Division 2.-By-laws for Protecting the Water, Grounds, Works, etc., from Trespass and Injury_

7. No unauthorised person shall trespass within the fenced area adjacent to any waterworks or any reserve or other lands vested in the Minister.

8. No person shall, without first obtaining a license, cut or remove limber from. any land or from any reserves or other properties in the possession of the Minister.

9. No person shall, without proper authority, enter any machinery house, valve houSe, or other portion of the. works not open to the public, or enter any enclosure within the Water Area containing a tank, reservoir, mote', house, store, office, or other waterworks. "1.0. No person shall permit live stock to have access

to any portion of the grounds in the vicinity of any to rworks. 11. No person shall post any bills, advertisements, or

17. Every license shall be annual, expiring the 10th day of January next following the granting thereof, and may be in the Form A in the Schedule hereto.

`1S: A fee of ten shillings shall be payable for every license except when a license is granted after the 10th day of July in ally year, in which case the fee shall be five shillings.

19. Every applicant for a plumber's license shall, before receiving a license, deposit with the Minister the sum of five pounds, to be held by the Minister dur-ing the currency of the license as security for the proper performance of all work undertaken by the licensee.

20. The Minister may deduct from such deposit the expense of making good any bad work of the licensed dumber or his workmen, and as often as any expense is so deducted the licensed plumber shall make good the deposit to the sum of five pounds, and in default his license will be cancelled.

21. Every licensed plumber shall, within forty-eight hours of any change of his address, give notice, in writing, thereof to the Minister,

23. No licensed plumber shall interfere with any pipe or fitting belonging to the waterworks without the permission, in writing, of a local officer first obtained.

24. No ground shall be open, nor shall any work be undertaken for the purpose of laying and fixing a new service or fittings, or in the extension or alteration of an existing service or fittings until notice shall have been given by the responsible licensed plumber to a local officer. Such notice shall be in writing, in the Form B in the Schedule, and shall describe the nature and extent of the proposed work, and shall be given forty-eight hours at least before the work is ill-Ai:Jaded to he commenced, unless the officer expressly accepts shorter notice.

25. On the completion or extension of any service the responsible plumber shall report the work to a local officer as ready for inspection.

26. In no case shall the ground be filled in or water he turned on to any land until the work executed by the responsible plumber has been examined and passed by a local officer, and a certificate in writing has been given by such officer to that effect.

.) 4.--By-laws for General Purposes. 27. Within the Leonora Water Area the water rate

Hhall he at a rate not exceeding two shillings in the pound per annum upon the net annual value of all rateable land, provided that a minimum rate of not exceeding' one pound per annum shall be payable on each separately assessed piece of land.

27a. The Minister may in his discretion allow a dis-count of not exceeding 20 per centum upon any rates paid within three months of the date upon which such

-rates become payable, but such discount shall not apply to minimum rates or fees which shall be paid- in full.

28. Water rates shall become due and payable yearly, in advance, on each first day of January: Provided that in all eases where a water rate is made after the first day of "January in any year, the notice of the order for the making and levying of such rate, published in the Government Genetic and a newspaper, as provided by Section 94 of the said Act, shall specify the minimum sum payable as rate as aforesaid, and the date or dates when the rate shall be due and payable, and such rate shall be and become due and payable in accordance with the terms of such notice.

29. Every ratepayer will be entitled to consume on each separately assessed property for which he is rated

. that quantity of water which, if calculated at the price specified in Schedule 1 hereto would amount to the equivalent of the water rate paid on such property, provided that such water be taken during the period for which the rate is struck.

30. Every ratepaying-consumer taking water in excess of the quantity to which lie is entitled in respect of the rate will be charged for the excess at the prices set forth in Schedule 1 hereto,

31. It shall be at the discretion of the Minister to supply water to any individual consumer, whether rated or not, at such price or prices as may be mutually agreed upon.

32, Where water is supplied by measure to the owner or occupier of land, whether rated under the Act or otherwise, payment for the same shall be made at such times and in such manner as may be agreed upon between the Minister and the consumer.

33. Any person or persons requiring a water service to premises in respect of which, for the time being, a' water rate may not he made, may be supplied on payment of an annual minimum charge, which shall be fixed by the Minister in each case. The minimum charge shall then take the place of a water rate, and the general provisions of these By-laws, as applying to rate-paying consumers, shall apply to minimum-charge paying consumers.

37. The Minister may, from time to time, when neces-sary for the purpose of tapping or repairing the main, or otherwise, cut off the supply of water from any part or parts of the Water Area.

38. It shall be at the discretion of the Local Officer is to whether or not a meter shall be affixed to any

service, and such officer will also determine the size and class of meter in each case.

39. Meters will be supplied by the Minister, and nay, in the discretion of the Minister, be open or encased, and every person supplied with water by measure to other than rateable premises or private residences shall pay meter rent in advance according to the following scale:—

13. orates has bean turned on, disconnect or interfere with any piping within twelve fee! of such meter. Such work shall be done by the servants of the Minister only.

45. Any person supplied with water through a meter belonging to the Minister shall pay the cost of making good all damages to such meter whilst on his land and in his charge, and shall deliver such meter up in good order on ceasing to hire same. Any repairs required shall be done by the officers of the Minister, and the expense incurred the Minister in so - doing shall, on demand, be paid 1w the owner or -occupier of the -land, and if not paid on demand, shall be recoverable in the same manner as water rates.

46. Any person supplied by the Minister with water through a meter shall, on finding that meter is damaged or not registering, immediately give notice of the fact to the local Water Supply Office.

47. No person knowing that a meter is damaged or does not register properly shall draw water, through such meter from a service pipe which is supplied with water by the Minister.

4S. In every ease in which the supply of water shall have been cut off by reason of non-payment of rates or other charges, or by reason of a defective service, or by request of the occupier or owner,' or when, in the opinion of the Minister or local officer necessary to prevent waste of water, or for other reason, a - fee of five shillings shall be charged for reconnection, and - shall be payable by the owner or occupier for the time being on demand. The service shall not be restored until such fee -shall have been paid.

49. No person to whom water is supplied by the Minister shall, without written permission, sell or supply water to any person who may not reside on the premises of which he is the occupier.

50. The occupier of any premises to which the water has been laid on, or in the event of there being no occu-pier, the owner shall cause proper means 'to be taken by locks or otherwise, subject to the approval of the Local Officer, to prevent the use of the water from the main by persons not connected with the premises sup-plied.

51, The owner or occupier of any allot !vent of land within the Water Area who shall erect or make. el' cause to be, creel ,!ii or made, any building or :iddition to an existing building: en such land shall,- within one calendar month thereaffle!, -lye notice in writing thereof to the Minister.

52. 'Officers nr workmen employed by the Minister shall not solicit or receive from the public any fee, gratuity-, or reward.

Division 5.—Pemalties. 53. Any person contravening any of these By'-laws,

whether by act or omission, ,shall be liable on summary conviction to a penalty not exceeding Twenty pounds.

Income Tax.

NOTICE is hereby given that every person liable under the above-named Act to make any Return of Income is hereby required to make and furnish to me, on or before Monday, the 2nd day of February, 1914, an Income Tax Return in the prescribed Form of his or her income for the year ended the 31st December, 1913.

Land Tax. Notice is further hereby given that every person who

was, on the 31st December, 1913, the owner within the meaning of the said Act, of any land whatsoever in Western Australia, and who is liable to Land Tax, is hereby required to make and furnish to me, on or before Monday, the 2nd day of February, 1914; a Land Tax Return in the prescribed form.

Penalty for not furnishing Return, £20.

Penalty for making false Return, £100 and Treble Tax.

Note.-Taxpayers may obtain Return Forms at the Taxation Department, Perth; at the principal Land Offices (except Perth) ; at the principal Treasury Offices (except Perth) ; and at Police Stations in the Suburbs of Perth and other places throughout the State.

Forms will be posted to Taxpayers if a stamped addressed envelope is forwarded to the Commissioner of Taxation, Perth.

WARREN DISTRICT ROAD BOARD.

Proposed Loan of £300. IN accordance with Section 265 of " The Roads Act, 1911 (1 George V., No. 29), notice is hereby given that the Board of the Roads District of Warren proposes to borrow the sum of Three Hundred Pounds (2300) sterling, such sum to be expended in the construction of works and undertakings.

Plans and specifications, and the estimates of such works and undertakings, and a statement showing the proposed expenditure of the money to be borrowed, are open for inspection at the office of the Secretary, "Dunreath," via iilanjimnp, for the space of one month from the date of the publication hereof.

The amount of £300 is proposed to be raised by the issue of Debentures bearing interest at the rate of £5 per centum per annum ; such interest to be payable half-yearly at the Office of the Board, Warren ; and the said Debentures to be repayable twenty-one years after the issue thereof, unless purchased by the Board at an earlier date, under the pro-visions of Sections 271 and 272 of "The Roads Act, 1911."

Petition to Annex outlying Lands do the Municipality of South Perth. Department of Public Works,.

P.W. 8544/13. Perth, 25th November, 1913. IN accordance with the provisions of "The Municipal Corporations Act, 1906," the Minister directs it to he notified that a petition has been received from the Mayor and Councillors of South Perth, and a majority of the owners of rateable land within the area herein-after defined, the substance and prayer of which is that the outlying lands, being the whole of "B" Re-serve No. 5988, known as South Perth Park Lands, and Location 168, also part of Swan Location 37, bounded on the North by the North boundary of Swan Location 37, on the East by part of the West boundary of Vic-toria Park Municipal District, and on the South extend-lag Westward by part of the North boundary of Queen's Park Municipal District to the right bank of the Can-ning River, and on the West by the right bank of the Canning River from Canning Bridge to the North-West corner of Swan Location 37, be annexed to the Muni-cipality of South Perth and included in the East Ward of the said Municipality.
