Executive Summary

A Fire Safety Audit of the Newstead Building in relation to the proposed use as a Childcare Centre & Early Learning Hub located at Lot 101 DP 1252700, Cnr Kite & Hill Streets, Orange NSW 2800 has been undertaken against specific fire safety provisions of Section C, D and E of the National Construction Code, Volume One ­ Building Code of Australia 2019 Amendment 1 (NCC).

The purpose of the Fire Safety Audit is to address Orange City Councils request that a Fire Safety Upgrade Report be submitted as part of the Development Application (DA) in relation to the proposed change of use and associated building works. As building works have been proposed the Fire Safety Audit/ Upgrade Report addresses the requirements of Clause 94 (1) (b) of the Environmental Planning & Assessment Regulation 2000 to assist Council in determining any Fire Upgrades that should be imposed on the development.

A number of the compliance issues that have been identified in this Report rely on assumptions and interpretations that have been made, as outlined in Section 5 of this Report. These matters should be clarified and confirmed prior to construction.

1. Brief

Mr. Greg Hedley of Gregory Hedley Quantity Surveying of behalf of Gowrie NSW has engaged the services of Registered Certifiers from Pro Cert Group Pty Ltd to undertake a Fire Safety Audit of the Newstead Building in relation to the proposed use as a Childcare Centre & Early Learning Hub (Refer to Figure 1) located at Lot 101 DP 1252700, Cnr Kite & Hill Streets, Orange NSW 2800 and provide a Fire Safety Upgrade Report.

The purpose of the Fire Safety Audit is to address Orange City Councils request that a Fire Safety Upgrade Report be submitted as part of the Development Application (DA) in relation to the associated building works. As building works have been proposed the Fire Safety Audit/ Upgrade Report addresses the requirements of Clause 94 (1) (b) of the Environmental Planning & Assessment Regulation 2000 to assist Council in determining any building upgrades that should be imposed on the development.

The Fire Safety Audit/ Upgrade Report will identify those measures contained within the nominated buildings that are inadequate when assessed against Section C, D and E of National Construction Code 2019 (NCC 2019).

2. Qualifications, Scope and Limitations

2.1 Qualifications, Relevant Experience and Competence The National Construction Code consultants for this project are Mr. Travis Stewart and Mr. Neil Diamond. All consultants hold post graduate degrees in Building Surveying and are Registered Building Surveyors with the NSW Fair Trading.

Mr. Travis Stewart & Mr Neil Diamond are current members of the Australian Association of Accredited Certifiers.

2.2 Scope The purpose of the Fire Safety Audit/ Upgrade Report is to provide supporting documentation to Orange City Council to assist in determining if any Fire Safety Upgrades should be imposed on the proposed development as may be required by Clause 94 (1) (b) of the Environmental Planning & Assessment Regulation 2000.

The Fire Safety Upgrade Report will detail a gap analysis of the compliance of the existing and proposed Building with the Fire Safety requirements of NCC when assessed against Section C, Parts D1 & D2 and Parts E1, E2 & E4 of the NCC.

The extent of the Fire Safety Audit includes the existing and proposed Buildings (referred throughout this Report as the Childcare Centre & Early Learning Hub).

As discussed and agreed by Council, the Fire Safety Audit and Upgrade objective has been determined against meeting the relevant Deemed-to-Satisfy (DtS) provisions in Section C, Part D1, D2, Part E1, E2 and E4 of the NCC and also applying additional upgrades where the existing Building does not or would not be capable of complying with a DtS provision of the NCC.

Meeting the DtS provisions has been used to determine compliance with the relevant Performance Requirements of the NCC.

This Report is provided for the exclusive use of Mr. Greg Hedley of Gregory Hedley Quantity Surveying of behalf of Gowrie NSW. The reproduction or use of this Report by any other party without the written permission of Pro Cert Group Pty Ltd is not permitted.

2.3 Limitations The following limitations apply to the assessment:

• The Report is limited to an assessment of the Building based on the site inspection undertaken of the Building and the plans and documentation listed in Appendix A of this Report.

• This Fire Safety Audit has been initiated by Orange City Council and the Owners of the Building to address the requirements of Clause 94 of the Environmental Planning & Assessment Regulation 2000 in relation to the proposed Building development.

• This report is provided as supporting documentation to Orange City Council to address the requirements of Clause 94 of the Environmental Planning & Assessment Regulation 2000. This report does not constitute building advice in that the findings of this report are provided as recommendations for Orange City Council's consideration.

• The assessment is limited to a desk top Audit and site inspections undertaken with visual observations made by walking through the Building.

• The Report is limited to an assessment of the relevant Performance Requirements applicable to Section C, Part D1, D2, Part E1, E2 and E4 of the NCC as detailed in the assessment details in Appendix A of this Report.

• The Report does not consider the applicable provisions relating to Section B, Section F, Section G, Section H and Section J of the NCC.

• The Report does not consider provisions relating to Part D3 of the NCC (Access for People with a Disability) and/or AS 1428.1-2009 (Design for Access and Mobility) except where provided.

• The assessment is limited to matters relating to life safety however does not necessarily consider the protection of the Building.

• Whilst care has been taken to nominate compliance requirements with various Australian Standards, this Report does not incorporate detailed requirements of Australian Standards.

• The assessment does not consider the requirements of legislation, which might address Building works such as Work Health and Safety requirements.

• This Report has been prepared based upon plans and documentation prepared by others. Pro Cert Group Pty Ltd has not verified the accuracy and / or completeness of this information and shall not be responsible for any errors or omissions which may be incorporated into this Report as a result.

The following documentation has been reviewed, referenced and/or relied upon in the preparation of this Report-

• National Construction Code, Volume One - Building Code of Australia 2019 Amendment 1 (NCC 2019);

3. Statutory Framework

The following summarises the key statutory issues relating to the Fire Safety Audit and Upgrade Report as required by Orange City Council in relation to the requirements of Clause 94 of the Environmental Planning & Assessment Regulation 2000.

94 Consent authority may require buildings to be upgraded

(1) This clause applies to a development application for development involving the rebuilding, alteration, enlargement or extension of an existing building where:

(a) the proposed building work, together with any other building work completed or authorised within the previous 3 years, represents more than half the total volume of the building, as it was before any such work was commenced, measured over its roof and external walls, or

(b) the measures contained in the building are inadequate: (i) to protect persons using the building, and to facilitate their egress from the building, in the event of fire, or (ii) to restrict the spread of fire from the building to other buildings nearby.

(c) (Repealed)

(2) In determining a development application to which this clause applies, a consent authority is to take into consideration whether it would be appropriate to require the existing building to be brought into total or partial conformity with the Building Code of Australia.

(2A), (2B) (Repealed)

(3) The matters prescribed by this clause are prescribed for the purposes of section 4.15 (1) (a) (iv) of the Act."

Comment:

The measures contained within the building are considered inadequate in the event of fire to protect persons using the building and to facilitate their egress from the building, or to restrict the spread of fire from the building to other nearby buildings in the event of a fire.

It is therefore deemed appropriate that the combined buildings be partially upgraded to further shift compliance of the building to the requirements of NCC 2019.

4. Methodology

The following process has been adopted in the preparation of the Fire Safety Audit/ Upgrade Report:

5. Assessment Data Summary

5.1 Assumptions & Limitations The following assumptions have been made in relation to the subject Buildings:

1. The floor areas and volumes for the building as noted in this Report have been determined from the drawings listed in Appendix A of this Report.

2. All fire safety measures installed within the Building as detailed in Appendix C of this Report are assumed to be designed and installed in accordance with the appropriate standard of performance.

3. For the purposes of this assessment and based on the site inspection it has been assumed that the building will have a Class 9b building classification.

4. Occupant numbers for the building have determined in accordance with Clause D1 .13(c).

5. As detailed in Section 2.2, for the purposes of the assessment, the Report focuses on the proposed development and the application of Clause 94 of the Environmental Planning & Assessment Regulation 2000 in order to provide supporting documentation to Council to assist Council in determining any Fire Safety Upgrades that should be imposed on the proposed development.

6. It is an assumption of this Report that all new building work associated with the proposed Building will comply with the requirements of the NCC.

5.2 Interpretations It should be noted that a number of issues within the NCC are recognised to be interpretive in nature. Where these issues are encountered interpretations are made that are considered to be within standard industry practice and / or Pro Cert Group Pty Ltd policy formulated in regard of each issue.

The following interpretations and assumptions have been made in the preparation of this Report:

1. For the purposes of this assessment, where a reference to an Australian Standard is made on the plans and specifications listed in Appendix A of this report and there is no reference to the Year, it is an assumption of this report that the Year to be adopted of the Australian Standard is the most recent version adopted by Schedule 4 of NCC 2019.

2. References to Building room names throughout the Report are reflective and based on those depicted on the plans detailed in the Appendix A. Where the on-site layout was noted to differ from the layout on the plans the subject areas have been described using the room names shown on the plans with additional descriptors added to best describe these areas.

3. For the purposes of this assessment the proposed early childhood centre has been assessed on the basis of having a Class 9b assembly building an Early Childcare Centre building classification.

4. For the purposes of this assessment an Early Childhood Centre means any premises or part thereof providing or intending to provide a centre-based education and care service within the meaning of the Education and Care Services National Law Act 2010 (Vic}, the Education and Care Services National Regulations and centre-based services that are licensed or approved under State and Territory children's services law, but excludes education and care primarily provided to school aged children in outside school hours settings.

5. For the purposes of this assessment the required exits are deemed to be those doorways identified in Section 6.2.2 of this report.

6. Exit travel distances have been measured in accordance with Clauses D1 .14 & D1 .15 of the NCC 2019.

6. Description of Subject Buildings

The building is single story with construction materials are noted to be generally timber, bricks, concrete and a metal sheet roof.

The Newstead Building in relation to the proposed use as a Childcare Centre & Early Learning Hub subject of this assessment is located at Lot 101 DP 1252700, Cnr Kite & Hill Streets, Orange NSW 2800, this is depicted on the image provided below:

6.2 Building Characteristics The following assessment data has been drawn from the provisions of the NCC and from an assessment of the plans provided by the client.

6.2.1 Classification The Building in its proposed form have been classified in accordance with the requirements of Clause A3.2 of the NCC and the Building classifications are summarised as follows:

7. Issues Requiring Resolution

7.1 Issues Requiring Upgrades to Building The matters noted in BOLD in the NCC assessment table in Appendix B of this Report are areas where either additional information is required or where building works are required to establish compliance with the NCC 2019.

7.2 Performance Solutions The NCC 2019 is written in a performance format which allows for performance based buildings. This has allowed for innovation and variation from the deemed-to-satisfy requirements, whilst maintaining the principle levels of health, safety and amenity of building occupants.

Performance building solutions are generally utilised when a nominated deemed-to-satisfy provision appears inappropriate for the design, or when a proposed design varies from the prescriptive requirements of the NCC.

A performance building solution may be a performance solution supported by Fire Engineering analysis or another assessment method as prescribed under Clause A2.2 of the NCC 2019.

There are no approved performance solutions applicable to the subject building.

8. Statutory Fire Safety Measures

8.1 Fire Safety Measures The fire safety measures within the Building must be maintained to ensure correct operation at all times the Building is occupied, all firefighting equipment should be tagged when tested / inspection and log books kept up-to-date for all emergency lighting etc.

An annual fire safety certificate must be submitted to Orange City Council and the NSW Fire Brigade each year indicating satisfactory performance of the fire safety measures contained within the Building. The annual fire safety statement should be displayed in a prominent place within the Building (i.e. the front counter / reception / principal entrance area).

The correct operation and maintenance of the Buildings fire safety measures is critical in affording an adequate level of fire safety for occupants of the Building.

8.2 Housekeeping The ongoing management of the Building should ensure good housekeeping procedure. The following matters should be considered by Building management:

• Ensure exits and paths of travel to exits remain unobstructed in accordance with the requirements of Clause D1 .6;

• Avoid storage of materials in unoccupied areas (i.e. large amount of flammable liquids / combustible materials within storage cupboards);

• Limit storage of flammable I combustible materials to designated and approved areas, and

• Prevent storage of materials that could hinder access to firefighting equipment, (i.e. storage in front of fire extinguishers).

9. Conclusions

The required outcome of this Fire Safety Audit I Report gap analysis process was to provide supporting documentation to assist Council in determining if any Fire Safety Upgrades should be imposed on the proposed development as required by Clause 94 of the Environmental Planning & Assessment Regulation 2000 and also provide commentary in relation to Disability (Access to Premises -- Buildings) Standard 2010 (Premises Standard).

The Fire Safety Audit I Upgrade Report in relation to the Building was undertaken by Pro Cert Group Pty Limited on behalf of Mr. Greg Hedley of Gregory Hedley Quantity Surveying of behalf of Gowrie NSW adopted a systematic audit process as recommended in Australian Standard 4655 - 2005 'Fire Safety Audits'. The Fire Safety Audit/ Report adopted was equivalent to a Level 2 type audit consisting of desktop review and site inspection.

Based on the results of the assessment of the documentation provided for the subject Buildings and from the notes taken during the site inspection it has been determined that the Buildings as described in this Report do not comply with the relevant Fire Safety requirements of the NCC when assessed against Section C, Part D1, D2, Part E1, E2 and E4 of the NCC of the National Construction Code 2019 (Amendment 1) Volume 1.

It is considered that the NCC non-compliances identified within this Report can be dealt with by NCC DtS solutions with respect to Fire Safety and at the discretion of Orange City Council through partial Building Upgrades in lieu of requiring a full Building upgrade. This discretion is undertaken by having regard to a balance of life safety, NCC compliance, practicality, economics, site constraints / benefits and history through the application of Clause 94 of the Environmental Planning & Assessment Regulation 2000.

It is recommended that Council require the existing Buildings to be brought into partial conformity with the Building Code of Australia (NCC) as detailed in this Report.

Clause 5 and Table 5 in Specification C1.1 details the requirements for fire-resisting construction for a building of Type C Construction.

As previously noted, it is assumed that all new building works in relation to the proposed Building will comply with the requirements of the NCC in relation to fire resistance levels.

C1 .1: Type of construction The fire source features (FSF) applicable to the Building have been determined to be as follows­ Complies required • The northern allotment boundaries with Lot 1 DP 347256 and Lot 104 DP 1260853; • The western allotment boundaries with Lots 102 & 104 DP 1260853; • The far boundary of Hill Street that adjoins the site on eastern side, and • The far boundary of Kite Street that adjoins the site on southern side.

Table 5 in Specification C1.1 of the NCC outlines the required Fire Resistance Levels (FRL) of building elements in a building required to be of Type C construction, see Appendix D of this Report for the required FR Ls.

Exit doors and doors that in a path of travel to an exit within the building (excluding vault/strong room and sanitary compartment doors) must be readily openable without a key from the side that faces a person seeking egress, by - (a)

During the inspection there were noted to be a number of non-compliances in relation to the requirements of this clause throughout the Building as follows:

• Height of door furniture, i.e. greater than 1.1 m above floor level . • Round knob style door furniture provided throughout, which is not compliant • • Pad bolts, snibs and latches were installed on numerous doors throughout the building .

It is a recommendation of this Report that all door hardware provided on all exit doors and doors located in a path of travel to an exit throughout the building be upgraded to comply with the requirements of this clause and all pad bolts, snibs and latches are to be removed.

Please note that height requirements under sub-clause (a) can have a concession in early childhood centres subject to egress arrangements being in place (b)(iii)(B), (C) & (D), see below.

(BJ the secure parts of a bank, detention centre, mental health facility, early childhood centre or the like; and

it can be immediately unlocked -

(CJ by operating a fail-safe control switch, not contained within a protective enclosure, to actuate a device to unlock the door; or

(D )by hand by a person or persons, specifically nominated by the owner, property instructed as to the duties and responsibilities involved and available at all times when the building is lawfully occupied so that persons in the building or part may immediately escape if there is a fire.

If the above concession is proposed to be utilised, a design statement is to be provided by that states all doorways in a required exit or in a path of travel to required exit will be readily openable at all times without a key from the side that faces a person seeking egress by hand by a person or persons, specifically nominated by the owner, properly instructed as to the duties and responsibilities involved and available at all times when the building is lawfully occupied so that persons in the building or part may immediately escape if there is a fire.

SECTION E: SERVICES AND EQUIPMENT

The visual site inspection did not reveal an internal fire hydrant system or an on-site external fire hydrant system as such is assumed that fire hydrant coverage is provided via the Street fire hydrant systems.

E1.3: Fire hydrants In regard to the above, it is a recommendation of this Report that a detailed hydraulic design review and

DNC,CRA inspection of the Street Fire Hydrant System be undertaken to ensure that it can provide compliant coverage to the building. This should be prepared and certified by a Competent Fire Safety Practitioner registered with the Fire Protection Association of Australia or a Registered Certifier (Hydraulic) registered with NSW Fair Trading and should clearly outline that the Fire Hydrant System provides coverage to all areas of the building in accordance with this clause and AS2419.1-2005.

The floor area of the Building exceeds 500m2 and as such is required to be provided with coverage from a Fire Hose Reel System.

It was noted that the building is provided with a single Fire Hose Reel in the proposed Learning Room 6, however it appears that this single Fire Hose Reel would not provide compliant coverage to the entire building, i.e. Rear Storeroom & Brick Garage. In regards to the above, it is recommendation of this Report that:

b) A detailed hydraulic design review and inspection of the Fire Hose Reel System is undertaken. (i) an enclosed stairway, passageway or ramp serving as a required exit;

It was noted during that inspection that exit signage was generally not provided on, above or adjacent to each required exit.
