5) SEALED BID REQUIREMENT: Each bid must be submitted in a sealed envelope addressed to Dr. Angela D. Pringle, Superintendent of Schools, c/o Mr. Bobby A. Smith, CFO, Richmond County School System, 864 Broad Street, Augusta, Georgia 30901. Each sealed envelope containing a bid must be plainly marked on the outside “UNIFORMS FOR SCHOOL SAFETY AND SECURITY RFQ #19-950” and the envelope must bear on the outside the name and complete address of the vendor. 6) CONTRACT PERIOD: The contract shall be for one (1) full year beginning September 1, 2019 and

ending August 31, 2020. 7) OPTION TO RENEW: The Richmond County School System shall have the option to renew for two

(2) additional one year periods at the same cost, terms, and conditions as the original contract contingent upon the mutual agreement of the vendor and Richmond County School System .

8) BRAND NAME STATEMENT: Any reference to brand names, trade names, model numbers or other descriptions peculiar to specific brand products is made to establish a required level of equality and functional capabilities; it is not intended to exclude other products of that level. Comparable products of other manufactures will be considered if proof of comparability is contained in the bid or with the product at the showing of goods or products. It shall be the responsibility of the bidders, to furnish with their bids such specifications, catalog pages, brochures, of the quality and functional capabilities of the product offered. The Richmond County School System reserves the right to request samples of any bidders prior to bid award. Failure to provide this data or the requested samples may be considered valid justification for the rejection of the bid. Unless so specified, similar products of other reputable manufacturers will be acceptable, provided it is determined to the satisfaction of the Director of School Safety and Security or their designated representative. This determination shall rest solely with the Richmond County School System.

9) STOCK REQUIREMENTS STATEMENT: Part of the bid will require the vendor to maintain a stock of

the listed items to include a variety of sizes that can be delivered to the Richmond County School System, Department of School Safety and Security within 48 hours after requested.

10) WARRANTY: The successful vendor will provide in writing to the Richmond County School System,

marked to the attention of Chief Reginald Wade, Department of School Safety and Security, 864 Broad Street, 1st Floor, Augusta, Georgia 30901, a warranty to replace or repair at no expense to the Richmond County School System any or all items found to be defective in materials, workmanship, or damage in shipment for a period of one (1) year from date of acceptance by the Department of School Safety and Security. If there is a standard warranty for a period of longer than one (1) year, then it will be provided in lieu of the above.

11) PRODUCT LIABILITY INSURANCE: Bidder will show documentation of product liability insurance,

including company name, dollar amount of coverage, and effective date of policy.

12) REJECTION OF PROPOSALS: The Richmond County School System reserves the right to reject, in whole or in part, any and all proposals received, to waive technicalities, or to negotiate any term(s) or provision(s) of such proposals as meet the requirements and specifications of this RFP, such rejection, waiver, or negotiation to be accomplished in any manner necessary to serve the best interests of the Richmond County School System. The Richmond County School System also reserves the right to be the sole judge of the suitability of any and all proposals for use by the Richmond County School System. The Richmond County School System reserves the right to reject or otherwise disregard, in whole or in part, any ambiguous proposal or proposals which are uncertain as to terms or compliance with specifications.

13) RIGHT TO RE-BID: The Richmond County School System reserves the right to reject any and all

bids. The right is reserved to reject any and all quotations, to omit any items called for or to accept the bid deemed best for the Richmond County School System.

14) NON-WITHDRAWAL PERIOD: Bids may not be withdrawn for a period of ten (10) days from the

bid opening. 15) STATE-MANDATED WALK AWAY PROVISION: In the event a contract is awarded for more than

one year:

202-2-506 (b) (1) “Pursuant to O.C.G.A. § 202-2-506, notwithstanding any other provision herein this contract shall terminate absolutely and without further obligation on behalf of the School System at the close of each calendar year in which it was executed and at the close of each successive calendar year for which it may be renewed provided thirty (30) days prior written notice is given by the School System to the vendor prior to the end of such calendar year.

In addition, this contract shall terminate immediately and absolutely at such time that appropriated and otherwise obligated funds are no longer available to satisfy the obligation of the School System under the contract.

This contract shall be deemed to obligate the School System for the sums payable during the calendar year the agreement was executed or in the event of a renewal by the School System for those sums payable at the end of any renewed calendar year.

The contract shall be deemed to have been automatically renewed for each applicable calendar year, not to exceed the initial term of contract, unless positive action is taken by the School System to terminate such contract herein as set forth.”

16) JURISDICTION AND VENUE: “This contract shall be governed and constructed in accordance with

the laws of the State of Georgia, Richmond County. Venue and jurisdiction will be that of a court of competent jurisdiction in Richmond County, Georgia.

17) CANCELLATION: In the event the vendor cannot provide acceptable service, the Richmond County

School System reserves the right to make other arrangements for procuring uniforms for school safety and security.

18) DUTY TO PROTECT: The Contractor (or Vendor) shall not knowingly send any employee, agent or subcontractor personnel who is a registered sex offender or who has been convicted of sexual abuse to any school building or school property when students are attending school or a school-related activity.

The Contractor (or Vendor) shall make periodic criminal history record inquiries as authorized by O.C.G. §35-3-34, as now written, or here-after amended; or allowed by all or any other laws allowing such inquiry, to identify these persons who have been convicted of sexual abuse or any other act which would require such person to be entered into a national or state sexual offender registry. For the purpose of this policy, the term periodic shall mean that the criminal history record inquiries shall be made current upon the awarding of a successful bid on contract and checked no less than annually during the duration of the contract. See ATTACHMENT #1 for Sex Offender Acknowledgement Form.

19) SMOKE FREE ENVIRONMENT: Bidder shall post notice and prohibit employees from using or displaying tobacco products, including smokeless tobacco, while the employee is on duty at the assigned location. There shall be no use of any tobacco products on any property of the Richmond County School System.

20) E-VERIFY: The Contractor agrees to comply with the requirements of A.R.S. § 41-4401.

a. The Contractor warrants compliance with all Federal immigration laws and regulations

relating to employees and warrants its compliance with Section A.R.S. § 23-214, Subsection A. (That subsection reads: “After December 31, 2007, every employer, after hiring an employee, shall verify the employment eligibility of the employee through the E-Verify program.)

b. A breach of a warranty regarding compliance with immigration laws and regulations shall be deemed a material breach of the contract and the Contractor may be subject to penalties up to and including termination of the contract.

c. The Owner retains the legal right to inspect the papers of any employee who works on the contract to ensure that the Contractor or its subcontractor(s) is/are complying with the foregoing warranty under paragraph (a).

See ATTACHMENT #2 for E-Verify Affidavit Form. 21) AWARD METHOD: Contract will be awarded based on lowest responsible and responsive bidder

meeting specifications and overall general value received. The Richmond County School System reserves the right to award complete bid based on the total price of bid, or to award each item individually except when total package awards indicated are required.

If for some reason we are not successful in reaching a mutual agreement with the selected vendor, the Board reserves the right to select the next lowest bidder meeting specifications.

22) TIME OF THE ESSENCE: Failure of the successful vendor to deliver merchandise within the required

time shall constitute a material breach of the contract. If a breach occurs, the vendor may be responsible for any damages the school system incurs and may be removed from the bid list.

23) CONDITIONS ALLOWING FOR REMOVAL FROM BID LIST: Any of the following conditions,

depending on severity, may cause removal from the bid list: a. Failure to meet performance guaranties b. Failure to meet warranty requirements c. Failure to meet time limitations d. Attempt to deliver substitutions e. Failure to make timely deliveries f. Failure to post bid bonds g. Failure to comply with the terms of the contract because of a misquote other than an obvious

typing error or obvious low or high bids 24) BID LIST: The Richmond County School System maintains a bid list for many categories that are let

25) CONDITIONS FOR PAYMENT: All items and terms must be as specified. Vendors cannot vary the terms of the specifications. Additionally, the Board of Education shall be allowed not less than twenty (20) working days to receive, verify delivery, and process payment to all vendors. Payment shall not be made on purchase orders until all items and terms have been verified as meeting bid specifications, in acceptable condition. State your price firm from contract start date, September 1, 2019.

26) TAX EXEMPT: The Richmond County School System is exempt for State sales taxes. Bid prices shall

exclude Federal or State taxes that can be eliminated in sales to public school systems in the state of Georgia.

28) INSPECTION OF PUBLIC RECORDS: All information received from vendors shall be subject to

inspection once the bid is awarded under Georgia Public Records Act.

I. GENERAL INFORMATION:

INSPECTION: Physical inspection of deliveries including condition, quality, and labeling will be made at the point of delivery by the Richmond County School System. Materials and/or equipment damaged in shipment will be replaced at the cost of the vendor. The time period for replacement of non-satisfactory items will not exceed three (3) business days after returned. All items must be of first grade materials. No seconds or irregulars will be accepted.

II. SPECIAL INSTRUCTIONS:

A. A sample of the entire uniform being bid (according to bid specifications) must be

delivered with bid for detailed inspection. The sample uniform should reflect the colors and the general style, and must reflect the tailoring details as would be found in the uniform being proposed, and the uniform which would be furnished if awarded the contract by the buyer. The Richmond County School System reserves the right to open the lining (if applicable) of the sample uniform and audit it against specifications. Said sample may then be returned to the vendor for repair or replacement at their option without cost to the Board. Said repair or replacement subject to Richmond County School System approval as to quality. This determination shall rest solely with the Richmond County School System. Construction of the uniforms shall not commence until a “sample” has been approved in writing.

B. Bidder must agree to provide a representative to handle all details of the initial order and all future orders. It is required that the successful vendor offer custom sizes to fit individual officers as required. All bid applicants must be able to provide seamstress services whether in house or contracted, of the highest quality and standards equal to the specifications for each piece of clothing.

C. The successful vendor will supply recommended cleaning instructions for the uniforms

and all accessory items, specifying precise details on care and cleaning that are to be utilized in future upkeep and maintenance for the items in this bid.

D. Fabrics used in the manufacture of the uniforms must be the exact materials called for in

the specifications and also be first quality. No fabric deviations are acceptable. Mill, Mill-weight and specific shades are found in the uniform specifications and must be first quality with no flaws or imperfections. IMPORTANT: ALL BIDDERS are to submit, along with their bids, a certificate stating that the fabrics used in the manufacture of the uniforms will be exact materials called for in the specifications and will be FIRST QUALITY. An official of the Company must sign this certificate. BIDDERS NOT FURNISHING THIS CERTIFICATE WILL BE DISQUALIFIED. NO FABRIC DEVIATIONS ACCEPTABLE.

E. Each uniform is to be thoroughly inspected before shipment. Imperfections shall be

corrected before uniforms are shipped. In case of damaged shipment, it shall be the responsibility of the receiver to make an appropriate written notice when signing the carrier documents. The receiver shall inventory the damage and advise the uniform manufacturer in detail.

III. DEVIATIONS FROM SPECIFICATIONS:

A. Any deviation from these specifications must be documented on the attached deviation

form. It is the intent of the school board for the uniforms to be manufactured strictly adhering to these construction and design specifications and deviations are not expected. Each bidder shall list on a separate sheet of paper, any variations from, or exceptions to, the conditions and specifications of this bid. This sheet shall be labeled “EXCEPTIONS TO BID CONDITIONS”, and shall be attached to bid. If deviations are not documented fully, the bidder may be disqualified.

B. It is the intention of the Richmond County School System to offer equal opportunity to all bidders. ITEM # DESCRIPTION A1-1 SHIRT, SHORT SLEEVE (MEN) FABRIC: Content: 100% Textured Polyester with Visa System 3 Weight: 7.0 to 7.5 oz. / linear yard

Construction: Collars and flaps are made with conventional construction. Top ply, bottom ply and interlining are first stitched together, then turned right side out and finally topstitched.

Style: To be Flying Cross Model 85R7886. Dress style, top center placket front, full cut

tapered fit, convertible collar, short sleeves, and dress shirttail. Two pleated breast pockets with topstitched scalloped flaps. Topstitched shoulder straps. Full badge reinforcement. Matching inside yoke and banana band of high lustre PolyTwill. Work wear industrial style shirt construction is unacceptable and shall be cause for rejection.

Collar: Convertible collar shall be one piece. Collar points to measure 3-1/8" long with ultrasonically fused-in Mylar stays. Collar to have woven interlining of #250 Dacron. Stays to be 2 1/2” long, 3/8” minimum width, and to be fused to underside of collar interlining. Stays applied directly to collar material itself unacceptable. Collar topstitched 1/4" off the edge. Collar material itself (top or underside) shall have no fusing to Mylar stays or collar interlining.

Front: Each front shall have a facing approximately 3” in width. The left front shall have a top center placket 1-1/2" wide with two rows of stitches 7/8" apart. Stitching on top center is not to be visible on the turn-back facing. The shirt will have 7 buttons and buttonholes on the front; spacing between each will be 3-¾" except the spacing between the neck button and the first button on the front, which will be approximately 2 1/2". Top center placket to have woven interlining of #250 Dacron. Non-woven interlining unacceptable and shall be cause for rejection. The fronts shall be joined to the yoke so that both raw edges of the yoke are turned under, with the front sandwiched between, and then all three are stitched down with a 1/16" raised stitch. Safety stitch joining unacceptable.

Shoulder Straps: Shoulder straps to be two-piece pointed, 1/4" topstitched and to be set on yoke with

leading topstitch conforming with front joining seam. To measure 2" at sleeve tapering to 1-3/8" and set not more than 1/2" from collar set seam. Cross-stitched approximately 2" from sleeve seam. Shoulder strap to have functional buttonhole to attach to sewn button on shoulder of shirt. Edge stitched shoulder strap construction unacceptable

Two-ply sling 1” wide centered over left pocket and stitched to shoulder seam and flap setting stitch. It shall have 2 (two) buttonhole eyelets 1-1/4” from top of pocket flap spaced 1-1/4” apart and centered on sling.

Pocket: Two breast patch pockets with mitered corners and 1-1/2" stitched pleats. Pleats shall be stitched top and bottom and full length of pleat to prevent spreading. Pocket to measure 5-5/8" wide, 6" deep. Left breast pocket to have 1- 1/2" pencil stitch. Each pocket to have hook Velcro, 3/4" long by ½" wide, positioned on both edges of pocket to correspond with outer scalloped flap points as specified. Velcro to be stitched all sides and to be sewn through pocket and shirt for added reinforcement.

Flaps: Two piece deep scalloped design to measure 5-7/8" across and 2-3/4" in depth at center point, 2-1/4" at sides. Secured to shirtfront approximately 3/8” above pocket. Left flap to have invisible pencil opening 1-1/2" to correspond precisely with pencil slot of pocket. (Stop & start stitching for pencil opening unacceptable and shall be cause for rejection.) Flaps to be 1/4" topstitched. Flaps to have woven interlining of #250 Dacron. Creased and edge stitched pocket flap construction unacceptable. Under side of the flap to have looped Velcro 3/4" long by 1/2" wide stitched all sides, positioned on outer points of both pocket flaps to secure with corresponding Velcro strips on shirt pocket. Each flap shall have a button centered on uncut sewn buttonhole.

Short Sleeves: Sleeve are to be straight and whole and to have a ¾” hem and to finish at a minimum

of 9 ½” long from shoulder seam.

Buttons: First grade 20-ligne melamine.

Stitching: Collar, shoulder straps, and pocket flaps to be topstitched 1/4" off the edge. Sleeve inserting and side close felling seams are to be safety stitched.

Thread: All sewing threads to be color fast polyester wrap to match.

front to be centered vertically. Front creases shall not be through pockets and flaps. Spacing for three military creases across shirt back to be proportionate to the size of the shirt.

ITEM # DESCRIPTION A1-2 SHIRT, SHORT SLEEVE (FEMALE) Style: It is the intention of this department to secure a tailored shirt equal in quality of

workmanship and style to the shirt now on display as a sample.

Shirts will be cut on a form-fitting line, and the shape of the pockets and general style will conform to this sample. Shirts to have permanent sewn-in military stitches.

Tailoring: It is imperative that this garment be constructed according to the principles set forth

in the specifications. All stitches must be of the proper tension and size so as to avoid puckering after the shirt has been laundered and to give best durable press performance. All sewing is to match shirt fabric.

The collar and cuffs are to be single stitched 1/4" from edge. The pockets and flaps shall be single stitched on the edge.

Fabric: To insure permanent moisture control, superior breathability, soil resistance, easy

care, wrinkle resistance, color matching, and color retention, the fabric is to be 9.5 to 10 ounce per linear yard, tropical weave with mechanical stretch, 100% texturized polyester. Fabric is enhanced with Industrial Laundry Friendly NANO-DRY technology by Burlington. Style #618.

Creasing: Pockets and pocket flaps to be die creased to give uniform shape and size. Collar: Convertible collar shall be one piece and to measure 3-1/8" long at the points and 1-

5/8" wide at back. There shall be one horizontal buttonhole. The collar is to be constructed of two plies of basic material and one ply of D331 top

fuse lining. The collar stays shall be of good quality Stalar vinyl, 2-1/2" in length and 3/8" wide and be attached to bottom collar.

The collar and inner yoke to be lined with matching 65% Dacron Polyester/35% Cotton, 4.2 ounce per square yard, 106 x 58. The collar lining shall be banana shaped.

Sleeves: To be straight and whole with 1" hem. The finish shall be 9" long from shoulder seam.

The sleeves must be secured to the body of the shirt by means of a merrow stitch with a safety stitch so as to properly strengthen the stitch. The same stitch must be used on the side closing seams as well.

Front: The front shall have a center facing 3" in width extending from neckline to bottom of

stitched and folded so that no raw edges show. The reinforcement strip is to extend from the flap setting stitch to the joining seam at the front of the yoke. To have two small (horizontal) buttonholes, 1-1/4" apart with the bottom buttonhole 1-1/2" above top of left flap.

Shoulder Straps: The shoulder straps shall be pointed at the end toward the neck of the shirt. The other

Design: Shall be a loose fit polo style knit shirt sleeve shirt with gusseted side panels, three

Side Panels: Gusseted side panels for increased comfort and mobility, 2-5/8” wide, made of self-

Design: Trouser shall be manufactured from an up-to-date men’s uniform trouser pattern.

The trouser styling shall be T-1: plain front, two (2) quarter top front pockets, and two (2) hip pockets professionally finished with no visible topstitching. Work wear industrial style construction is unacceptable and shall be cause for rejection.

Lining Material: The pocketing and fly lining material shall be 70% Polyester / 30% Cotton, 2.9 oz. per

square yard (60" width) with a minimum 78 x 48 count. Pocketing must have a durable press finish and the color of the pocketing must be black.

Pocketing: The two (2) front pockets will be quarter top style with a minimum opening of 6" and

a minimum depth of 5-3/4" measured from the bottom of the opening. Front pockets to have firm straight bartacks at top and bottom of pocket openings. Pockets shall be constructed using the stitch, turn, and topstitch method. Front pocket facing and barrier to be made of the basic trouser fabric. Facing shall be a minimum of 1” and barrier shall measure a minimum of 2" (measured to the inside edge of pocket lining).

The two (2) hip pockets shall have a minimum 5-3/8" wide (bartack to bartack) opening and a minimum depth of 5-3/4 " measured from the bottom of the pocket opening. Hip pockets shall be constructed using the double welt method on an automatic welt machine. The welts shall be finished in such a manner that there is no topstitching (topstitched hip pockets shall be cause for rejection). The corners of the hip pocket openings shall have triangular bartacks for reinforcement (use of straight bartacks shall be cause for rejection). Hip pocket facing and barrier are to be made of basic trouser fabric. Facing shall be a minimum of 3/4" and the barrier shall be a minimum of 1-1/2”. The left hip pocket shall have a centered tab made of basic cloth inserted into the top welt with bartacks at the top and bottom of the tab to form an opening for a button. A button shall be located below the bottom welt corresponding in location with the tab, which shall be interlined with non-woven for added durability. There shall be a dart centered above each hip pocket to waistband. Dart shall be approximately 2-3/4” long tapered from 3/8” at waistband and shall be installed with automatic equipment for a clean non-puckered finish.

The watch pocket shall be located on the right front at the waistband. This pocket

shall have a minimum opening of 2-5/8” and a minimum depth of 2-7/8". The front of the pocket shall be made of pocketing fabric and the back of the pocket shall be made of basic fabric and the two pieces are securely stitched together. Each corner of the pocket opening shall have firm straight bartacks.

(CONTINUED) Freedom-Flex Waistband: Trouser shall be made with a special Freedom-Flex Waistband System that will allow

the wearer waist expansion of 2 1/2" to 3". The waistband shall measure a minimum of 1-7/8" wide when finished. The flexible expansion split portion of the waistband shall be to the front of the trouser side seam and there shall be a ¾-inch wide side belt loop positioned to ‘hide” the expansion split of the waistband.

The waistband curtain shall consist of two different styles for maximum waistband expansion to enhance wearer comfort, fit, and appearance. The front of the trouser (to the expansion split) waistband curtain style shall consist of a 2-inch wide elastic section that incorporates Tru-Grip, a ½" surface area composed of thin 55 gauge rubber for maximum comfort and performance. The Tru-Grip acts to help keep shirts tucked in securely. (Use of a single silicone strip or strips instead of ½” wide rubberized surface area shall be cause for rejection.)

The back half of the trouser waistband curtain shall finish a minimum 2-1/8” wide and is to be made of black pocketing material and shall be attached to the top of the trouser with a zigzag stitch. The waistband curtain must also contain Tru-Grip and will line up with the Tru-Grip on the front of the expansion split. (Substitution of a silicone strip or strips in place of Tru-Grip shall not be acceptable and shall be cause for rejection.)

The waistband curtain is composed of a wet laid non-woven canvas weighing 3.3 oz. per square yard. The canvas is covered in the same color and material as the pocketing. The ½” rubberized surface area is positioned 1-¼" up from the bottom of the curtain. The specifications for the rubberized Tru-Grip curtain are as follows:

To complete the Freedom-Flex Waistband System, there shall be a 1-1/4” wide elastic component sewn into the back half of the waistband curtain to allow for the stretch and recovery of the waistband to comfortably fit the wearer’s waist size. There shall be a bartack for strength and durability sewn at the stress point on the waistband where it joins the front elasticized waistband curtain joining stitching (positioned, on the waistband above the front pocket.)

(CONTINUED) The waistband closure shall be accomplished with a single crush proof hook and eye centered on the waistband for wearer comfort. The hook and eye shall be reinforced with a 7/8" non-woven tape that is anchored with topstitching through and through to the top of the waistband (bartacks in place of topstitching shall be cause for rejection). In addition to the stitching of the waistband when it is set onto the trouser, the waistband must also be topstitched below the waistband seam of the trouser to be finished to allow for alterations (with ample fabric and curtain material to allow trouser size to be increased at least one size). The outlet in the seat is to be proportional to the waist outlet so the seat may also be let out. Seat seam must be sewn with a tandem needle machine (double-needle stitch) for maximum stretch.

Fly: Trouser shall have a brass metal zipper with memory lock brass slider secured by

metal stopper at base. There shall be a French Fly tab closure on the inside of the right fly. The tab shall be double ply made of the basic trouser fabric (tabs made of pocketing material or a "grown on" French Fly will be cause for rejection). The right fly shall be lined with the same material and color as the pocketing. The fly lining shall be sewn to the left fly continuing below the zipper into the crotch area in a neat and durable manner. A button shall be located on the left fly corresponding with the French Fly tab to provide a clean and comfortable closure. Topstitching of fly to be installed with automatic “J” stitch equipment eliminating puckering and providing a clean finish. There shall be a firm straight bartack at the bottom of the fly going through the zipper tape for maximum strength. Bartack shall line up with starting point of “J” stitch.

Belt Loops: There shall be a minimum of seven belt loops 3/4" in width of double thickness. Each loop must have a non-woven interlining for added durability. All loops (except back center) must be sewn into the top and bottom of the waistband ("dropped" belt loops that are tacked to the outside of the trouser all around waist shall be cause for rejection). The top of the belt loops (except back center) shall be sewn into the waistband curtain seam with a Rocap machine using a zigzag stitch. The bottom of the center back loop shall be tacked to the trouser and the top of the loop tacked to the outside of the waistband to allow for easier waist alteration.

Seat: Seat must be sewn with a Tandem Needle Machine (double-needle stitch) for

maximum durability. Stitching, Dressing, & Finishing: Trouser must be stitched with matching thread. Trouser must be neatly pressed on

Hothead Presses and properly shaped. Outseams and inseams are edge serged on automatic equipment for uniformity of quality and shall be pressed open for a smooth pucker-free finish with repeated cleaning and pressing. Trouser must be cleaned and finished to eliminate loose threads.

Weave: Gabardine Color: LAPD Navy Blue Style: Trouser shall be manufactured from a men's uniform trouser pattern. The trouser

shall incorporate a plain front, two (2) quarter top front pockets, two (2) patch style hip pockets, and two (2) side utility pockets. Trouser to be straight leg style.

Pockets (Front/ Back): The two (2) front pockets will be quarter top style with a minimum opening of 6" and

a minimum depth of 5¾" measured from the bottom of the pocket opening. Pockets shall be constructed using the stitch, turn, and topstitch method. Pocket facings shall be made of the basic fabric and shall measure a minimum of 3" in width. There shall be two (2) patch style hip pockets with flaps and Velcro® closure. They shall measure 6½" wide x 6½" deep.

There shall be a cargo style accessory pocket on each thigh. The left thigh pocket shall be designed with an inverted pleat and the flap shall have Velcro® Closure. The right thigh pocket shall have a Velcro® closure and be designed with three equipment pockets slotted on the front of the cargo pocket.

Side: There shall be two double entry side pockets sewn to each outside leg seam so that

the pocket flap is centered 10½" inches below the bottom of the waistband. The pocket shall be constructed of shell fabric with the top edge bound with a 100% polyester black binding. The pocket shall measure 7" in width and 8½" in length and feature an inverted center pleat measuring one inch in width.

The pocket flap shall be made of two plies of shell fabric and one ply of interlining. The top edge of the flap shall be sewn across the top of the outer pocket with its sides secured to the pocket with two soft Velcro strips sewn to the inner ply of flap and corresponding hard Velcro strips sewn to the outside of pocket. There shall be a zipper sewn behind the inner pocket and to the trouser leg, positioned one inch below the top of the flap to create a concealed pocket.

Pocketing: The pocketing shall be 70% Polyester / 30% Cotton, 2.9 oz. per square yard (60"

width) with a minimum 78 x 64 count. Pocketing must have a durable press finish and the color of the pocketing must be black. The front pockets shall be double tipped.

the inside of the right fly. The tab shall be double ply made of the basic cloth (tabs made of pocketing material or a "grown on" French Fly will be cause for rejection). The right fly shall be lined with the same fabric as the waistband curtain and pocketing. The fly lining shall be sewn to the left fly below the zipper in a neat and durable manner. A button shall be located on the left fly corresponding with the French Fly tab to provide a clean and comfortable closure. There shall be a firm straight bartack at the bottom of the fly going through the zipper tape. Seat outlet to measure a minimum of 2¾" to allow for alterations. Seat must be sewn with a Tandem Needle machine.

Waistband: The waistband shall be constructed using the "closed method" and shall measure a

minimum of 1-3/4" wide when finished. The waistband curtain shall finish a minimum 2-1/8” wide and is to be made of the same fabric and color as the pocketing material and shall be attached to the top of the trouser with a zigzag stitch. The waistband curtain must contain Tru-Grip, a ½" surface area composed of thin 55 gauge rubber for maximum comfort and performance. The Tru-Grip acts to help keep shirts tucked in securely. (Substitution of a silicone strip or strips in place of Tru-Grip shall not be acceptable and shall be cause for rejection.)

The waistband curtain is composed of a wet laid non-woven canvas weighing 3.3 oz. per square yard. The canvas is covered in the same color and material as the pocketing. The ½” rubberized surface area is positioned 1-¼" up from the bottom of the curtain.

The specifications for the rubberized Tru-Grip curtain are as follows:

The waistband must contain ¾-inch Ban-Rol to prevent roll over at the trouser front. The waistband closure shall be accomplished with a single crush proof hook and eye centered on the waistband for wearer comfort. The hook and eye shall be reinforced with 7/8-inch non-woven stay tape that is anchored with topstitching through and through to the top of the waistband (bartacks in place of topstitching shall be cause for rejection). In addition to the stitching of the waistband when it is set onto the trouser, the waistband must also be topstitched below the waistband seam through the waistband curtain for added strength. The back center seam of the trouser is to be finished to allow for alterations (with ample basic fabric and waistband curtain material to allow trouser size to be increased at least one size). be made of two layers of shell fabric and one of non-woven interlining. Collar measures 3-1/4” at center front and center back. There shall be a 2-3/4” by 3/8” hanger loop attached to the back of the collar and a garment label on the inside collar.

SLEEVES: Sleeves are to be shaped two-piece style. Cuffs shall be constructed with 1-ply shell

fabric self-folded with 1-ply interlining. The cuffs to measure 1-3/4” in width and to fasten with molded PU cuff tab (with loop) for cuff opening adjustment. Cuff opening shall measure 11-1/2” and consist of 1" wide by 5" long crosswalk reflective tape applied to underside portion of cuff (Size M), for night time visibility. There shall be 5/8" wide double ply grosgrain ribbon with snap closure stitched into cuff at underarm seam for optional liner attachment, snap tab to finish 2" long.

FRONTS: Jacket fronts shall be well one-piece, shaped, and symmetrical (balanced) with top

and under stormflies. Stormflies constructed of 2 ply shell fabric and 1 ply interlining. Under stormfly shall have 3/8” fold back to make a rain gutter with 7 bar tacks. Hidden female snaps shall be set to the top stormfly 3/4" from front edge (to center of snap). Male snaps shall be set to bottom stormfly through all layers. Front zipper set to start 1/4" from Top edge of collar to bottom hem edge. Liner zipper stitched with front zipper at joining seam. There shall be a triangle facing covering the top of the liner zipper.

BACK: Back shall be two pieces with back yoke consisting of 1 ply shell with 1/4" double

needle topstitching. There shall be back princess seaming set between yoke and waist seams.

HEM: Back hem shall be a separate shell fabric facing with single needle top-stitching

through all layers, 1-1/2" from bottom hem edge. There shall be a back drawcord with cord-lock stopper/holder at back waist only.

SIDE OPENINGS: There shall be side openings on both sides for access to equipment. The zippered

opening will be 11” long and use a coil #5 zipper opening from bottom to top. There shall be a snap tab with female Prym style snap and cap and Prym style snaps male snaps on each side of the zipper for closure and storage of the snap tab. The tab will hold front and rear portions of the jacket closed around equipment when the zipper is in the up position.

POCKETS AND FLAPS: Front pocket flaps shall be mitered corners with 1-1/2” center pleat. Pockets shall

measure 6” wide, 6-1/2” at center, and 5-1/2” at sides. Flaps shall consist of 2 ply shell and 1 ply interlining, and measures 6-1/4” wide, 2-3/4” high at center of flap, and 2-1/2” at sides. Pocket Flaps secured with horizontal bartacks at top corners, measure minimum of 3/8" (1 cm).

COLLAR: Stand up collar style with zipper closure to top of collar. Back of the collar will have

3/8” hanger loop ribbon folded and pressed flat caught into neck joining seam with outside edges spaced 2-1/4” apart. The collar consists of two layers of self-fabric and two layers of fusible tricot for reinforcement and structural integrity. The inner collar-joining seam will be lined with a protective twill cover tape to cover the seam and protect the wearer’s neck from a rough seam edge. FRONT: The front shall be two-piece and shall have a quarter zip opening at the top. The #5

Vislon molded tooth YKK zipper shall measure 9 inches in length and shall be exposed type with a rounded wide pull. The top yoke shall measure 10 inches from the shoulder/neck seam junction and shall have two vertical besom pockets set between the top and bottom portions of the front. There shall be lower vertical on seam pockets for storage with a 6 inch opening that is tacked top and bottom to prevent tearing. Both pocket bags shall be made from shell fabric. The bottom hem shall be turn up style 1-1/4” with 7/8” washable and dry cleanable elastic set into and clean finished. The bottom hem will stretch no less than 20%.

POCKETS: To have two (2) breast pockets, set in besom style with #3 Vislon YKK zippers with

extended pulls for ease of use. The bags shall be made from a layer of shell fabric and one of the twill trim fabric. The left pocket shall have a 5” wide opening and be 5” deep. The right shall have the same 5” opening and will be 8” deep and will have a ½” by 1” strip of horizontal hook and loop optionally shortening he opening to 5” deep. a specific handgun. It is lined with suede, and incorporates two patented locking mechanisms. This holster combines a high level of handgun security with durability, ease of use and training

Minimum Requirements: The 3-layer holster body is composed of a solid polymer core material laminated to a black leather-look urethane for long lasting good looks and durability. The body of the holster incorporates a hardened steel reinforcement plate to help resist any forced removal of the weapon by an assailant. The body is lined with urethane suede that is permanently bonded to the core. The body is thermoformed to securely fit a specific handgun. The body of the K391 holster is bolted in 7 places to a patented trigger guard locking mechanism. It is both very secure and easy for the wearer to operate. When the gun is inserted in the holster a ½ inch thick locking bolt automatically secures the trigger guard with no further motion required. Release of the lock is by a simple motion of the thumb as the hand tightens its grip on the gun and draws straight up. The jacket-slot belt loop is injection molded of a durable polymer and is anatomically shaped to be comfortable when worn on a duty belt. one (1) inch. Closed length 9 ½ inches, expands to 26 inches. The grip of the baton will be constructed of black foamed vinyl held in place with two concentric bands of double sided adhesive tape. The rear of the grip shall be protected by a treaded retaining cap that is held in place by an O-ring seal. The sections for the baton shall be constructed of seamless thick walled 4140 alloy tubing. The steel shall be heat treated for toughness, shock and break resistance to produce a Rockwell C scale of 48 to 51 with a tensile strength of at least 230,000 PSI. The baton shall weigh approximately 20 ounces with the section locking in place by means of a dead lock taper. NIJ 0101.04 / NIJ 2005 INTERIM REQUIREMENTS Level II

Basic Design: SCOPE - This product specification details the style and quality of concealable soft

body armor vests intended for use by male or female members of this agency. The vests shall be worn comfortably while being concealed under a shirt. All vests shall provide protection against labeled projectile penetration while reducing resultant blunt trauma and vest distortion to acceptable levels. The successful vendor shall be required to supply the individual vests with applicable options and colors as ordered for male or female personnel. The concealable body armor shall be the PACA Body Armor Model RTH2+D for NIJ 0101.04 / NIJ 2005 Interim Requirements, for Threat Level II Bids based on body armor models made by manufacturers other than PACA Body Armor must be clearly identified as such, and bidders must include full product description, a complete bid sample, male and female, drawings and/or photographs, technical specifications. Where the apparent low bidder has proposed an alternate product, that bidder shall demonstrate product equivalency to the satisfaction of the department. Evidence of equivalency shall be presented for each requirement of this specification, and the burden of such equivalency in entirely on the vendor. Any bidder may be required, at any time during the procurement process, to provide documentation proving compliance with any or all the terms of this specification. Only body armor models, which have been tested by the National Institute of Justice (NIJ) National Law Enforcement Technology Center (NLETC), and found to comply with NIJ Standard 0101.04, Ballistic Resistance of Police Body Armor and NIJ 2005 Interim Requirements for Type II armor, shall be submitted under this specification. No exceptions. Bids with multiple models, as alternates will be rejected.

Silence of Specifications:

Commercially accepted practices shall apply to any detail not covered in this specification and to any omission of this specification. Any omission or question of interpretation of the specification which affects the ballistic performance or integrity of the soft body armor being offered shall be addressed in writing and submitted with the bid.

Protest: Any protest based on the selection and performance criteria of this specification will

be disregarded.

Minimum Requirements: Requirements of this specification shall take precedence over the above referenced standards and specifications. Purchase Requirements:

The successful bidder must be a recognized wholesaler/retailer, which maintains a convenient location for measurement, fitting and service during regular business hours Monday through Friday. Any manufacturers, which bid direct, must include a service proposal as to how measuring, re-works, and customer service will be maintained without local distribution. Direct bids from manufacturers, which do not contain a detailed service proposal, will be rejected.

Specific Quantity: The agency has the right to determine quantity, if not otherwise specified in the

procurement document. Of the total quantity purchased, both male and female products will be represented. The department retains the right to adjust the total quantities, while maintaining the accepted bid price, without notification to vendor. The term of the contract, including extensions, and/or escalation clauses, shall be stated in the bid document.

Design Requirements:

The Intended use of the soft body armor detailed herein is intended to be standard issue armor. It is intended for routine daily wear as an undergarment.

NIJ 0101.04 / NIJ 2005 INTERIM REQUIREMENTS (CONTINUED) The soft body armor shall be designed to provide:

1. Light and thin NIJ certified armor in Level II 2. A high degree of concealment and comfort. 3. Minimum restriction of motion or mobility. 4. Optional carriers to allow for laundering and color changes. 5. Provide resistance against the labeled projectiles in accordance with the NIJ

Standard 0101.04. / NIJ 2005 General Design: The ballistic panels of soft body armor meeting this specification shall provide thin,

flexible, lightweight comfort utilizing high performance ballistic materials. The soft body armor shall be designed for regular daily wear as an undergarment. Therefore, vests shall be designed and constructed to provide (1) light and thin NIJ certified armor in Level II, (2) durability, (3) ease of cleaning, (4) minimum restriction of motion or mobility, and (5) the greatest amount of ballistic coverage consistent with comfort and concealment. The general configuration shall be the slipover vest type that covers the majority of the upper torso, including side coverage. The carrier system shall incorporate the 8 point VersaStrap ™ system which includes two removable/replaceable elastic Neoprene® shoulder straps and four removable/ replaceable elastic waist straps with hook and pile fasteners shall provide proper positioning and comfort. The entire vest perimeter shall be curved. No sharp corners or straight edges shall be allowed. The front ballistic panel shall cover the chest approximately up to the collar bone, have a scooped neck sufficient to maintain conceal ability when wearing an open collar shirt, extend downward to the waist but not far enough to "push up into the throat" when the wearer is seated, and extend around the sides to provide side protection. The biceps/chest region shall be cut with sufficient space to minimize irritation and restriction of arm movement during common duties such as the operation of motor vehicles. The outer shell carriers shall include front and rear 5” x 8” / 8” x 10” combination plate pockets designed to accommodate trauma, ballistic or blade inserts. The rear ballistic panel shall cover the back of the torso from just above the shoulder blades down to a position above the waist belt. In addition, unless otherwise stated, the maximum gap at each side shall be two inches.

Female models shall be designed specifically for the female torso and shall have allowances for bust configuration. Panels shall be equipped with an integral shoulder-strap suspension system. The suspension system must provide direct support to the ballistic panels to keep them sagging and creasing at the bottom of the carrier.

Ballistic Panel Materials: All materials shall be new, unused and without flaws that affect appearance,

durability and function. The ballistic panels shall be constructed of a matrix of Polyethylene UD and Aramid fabric. No other ballistic material shall be used. As the department has selected these materials, any bids, which represent products manufactured from other materials, shall be rejected. Accordingly, all bidders shall include a letter from the manufacturer stating that the products being submitted for consideration are manufactured from 100% first quality Polyethylene UD and Aramid fabric.

Panel Construction:

All vests, which are submitted, shall represent armor, which in layer count, is uniform throughout the ballistic panel. Accordingly, any ballistic panel, which is not uniform, in layer count, throughout the entire ballistic package, shall be rejected. It is the intent of the agency to procure the lightest weight, best performing personal armor available in relation to Areal density, therefore, a vest section of 12" x 12" (one square foot), must not exceed 12.64 oz. (.79 lbs.) per square foot for NIJ level II. Sample weights are (+/- 5%).

Ballistic Panel Performance/V50 Performance

Each bidder shall submit V50 test reports for the vest being offered. The V50 test shall be performed in accordance with MILSTD-662F using NIJ Standard 0101.04 test projectiles. The test must be performed by an independent laboratory approved by the National Institute of Justice (NIJ) National Law Enforcement Technology Center (NLETC) for testing in accordance with NIJ Standard 0101.04. The V 50 test shall be against clay backing. V 50 reports, which represent testing without clay backing, shall be rejected. Vendor shall provide written certification that all V 50 testing is accomplished with clay backing; failure to provide certification shall be cause for rejection. Test reports submitted by the bidder shall reflect the following minimum test results for a 12.64 oz. (.79 lbs.) per square foot test sample. Sample weights are (+/- 5%). Blunt trauma reduction is also an important aspect of armor design. Low back face signature (BFS) should result in reduced blunt trauma injury. Bid submissions, which do not meet this requirement, will be rejected.

Ballistic Panel Cover Material:

This department recognizes the importance of protecting the ballistic panel from exposure to environmental elements. Also, the department is aware that high degrees of “Water Vapor Transmission” (WVT) through the ballistic panel cover may allow moisture to migrate into the fibrous structure of the ballistic panel thus causing a reduction in ballistic performance. Therefore, potential bidders who offer ballistic panel covers that claim to “Breathe” or allow high levels of “Water Vapor Transmission” to pass through them will not be considered. This department will only consider armor systems that incorporate a Ballistic Panel Barrier System. The Barrier System must exhibit a high degree of water repellency and resistance to MVT. The Barrier system will have a water repellant treatment on its exposed surface that resists moisture and staining. In addition, the Barrier System will incorporate a Nano-Technology, Anti-Microbial/Anti-Fungal treatment that inhibits the growth of mold and bacteria. The interior of the Barrier System will incorporate an all-weather film laminate technology to further enhance resistance to moisture migration and MVT. ** Each fabric shall be completely submerged in particular fluid for a period of 24 hours and line-dried. Vest Outer Carrier Material Removable Carrier- SVS: The machine washable carrier shall be removable from the ballistic panels for

laundering. The carrier systems body side fabric shall consist of smooth fit SVT micro-fiber with Nano Technology micro-encapsulated phase change temperature regulation and Anti-Microbial bacteria, mold and mildew deterrent. The exterior of the outer-shell will utilize Super-Suede Micro-Fiber with a mid-torso horizontal zipper for improved insertion and removal of the ballistic panel cover. (SSBS). No substitutes will be accepted. Carrier shall be manufactured from a

dimensionally stable first quality material with less than 5% shrinkage. The outer side of the carrier shall be manufactured from first quality Super-Suede Micro-Fiber, and have a Soil Resistant Finish (SRF). All fabrics shall have no visible fabric or color flaws.

Quality Control: The manufacturer must maintain an ANSI/ISO/ASQ Q9001-2000 Certified quality

program. The documented quality control system must be designed to insure the integrity and quality of the manufactured products. The quality control system shall control all manufacturing process and incoming raw materials. The manufacturer must have an in-house ballistic laboratory capable of performing ballistic testing of incoming raw materials and in-process samples. The manufacturer must have the capability of performing testing in accordance with MIL-STD-662F and NIJ Standard 0101.04. Procedures for lot testing of incoming raw materials and in-process samples must be incorporated into the quality control system. All incoming ballistic material shall undergo V50 ballistic lot tests in accordance with MIL-STD-662F with exception of using a clay backing conditioned in accordance with the requirements of NIJ 0101.04. Every vest panel manufactured shall be inspected for material defects, proper ply counts, and for proper ballistic panel stitching. Covers and accessories shall be re-inspected during manufacturing for defects at selected points during manufacturing to assure the absence of hidden defects in the final item. In addition, each vest shall receive a final inspection prior to shipment. This inspection shall include a review of the quality control check sheet and confirm the product against the customer’s order.

Serial Numbers: Each unit of soft body armor delivered shall have an individual serial number. Each

soft body armor vest shall be traceable to its original ballistic material lot number and ballistic material mill roll number. Additionally the soft body armor serial number shall be traceable to an incoming material lot test and ballistic panel lay-up lot test.

Lot Testing: All incoming ballistic material shall undergo V50 ballistic lot test in accordance with

MIL-STD-662F except that the test will be conducted on clay backing which meets the requirements of NIJ Standard 0101.04 for backing material.

Measurements and Fitting: Custom Measuring: Unless otherwise stated, individual measurements will be taken of each user. Each

delivered vest shall fit in accordance with the following guidelines: 1. The side edges of the front and back ballistic panels shall be fit for within a two-

inch (2") gap between panels during the initial custom fitting. 2. The bottom edge of the front ballistic panel shall be within inch (1") of the

highest waist belt (usually the duty belt) measurement when the wearer is in a relaxed seated position.

3. The bottom edge of the back panel shall be within one-inch (1") of the highest waist belt (usually the duty belt) measurement when the wearer is in the standing position. Female sizes are determined based on individual measurements, including bust size.

Fit and Alteration Policy:

The manufacturer shall perform all required alterations of more than one inch within 30 days after original shipment of the product at no charge. Adjustments of an inch or less than an inch can be accomplished by utilizing the adjustable strap feature on the vest.

New Vest Requirements:

For acceptance testing of new, unused vests, the armor should be expected to have a 9mm 124 grain FMJ V-50 average that is above the NIJ Reference test velocity for that class of armor. In addition, the Low Complete (LC) average for the representative sample should not be below the NIJ Reference velocity and within 3σ of the model’s Certification Baseline V50. If a representative sample V-50 or LC average results are below NIJ Reference test velocity, then three additional representative samples sets will be tested to verify the results of the initial testing. For acceptance, the V-50 and LC average results of all three additional representative samples sets must be no lower than the NIJ Reference test velocity for that class of armor.

Product Liability Insurance:

Vest manufacturer shall agree to provide a minimum of $26,000,000 product liability insurance coverage on delivered vests.

Warranty: THIS WARRANTY IS EXPRESSLY IN LIEU OF OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND OTHER WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE OR TRADE. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY, WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, THAT EXTEND BEYOND THE WARRANTY PERIOD SET FORTH HEREIN. The warranty herein shall be void if the product has been altered, abused, or misused, stored improperly or not cleaned in accordance with cleaning instructions. The ballistic or stab elements are warranted to be of the same construction and design as the original N.I.J. certified model listed on the label. The design of the bullet or stab resistant elements of this system have been tested and certified by the National Institute of Justice and passed the compliance requirements of the NIJ Standard for Ballistic or Stab Resistance of Personal Body Armor for the level stated on the label. These bullet or stab resistant elements are warranted for five years from date of purchase to be free from manufacturing defects. Upon timely notice, PACA will repair or replace any vest / plate in which, after examination by PACA, PACA determines there is a manufacturing defect. Should the soft body armor ballistic or stab panel cover be compromised (cut, torn or worn through), it should not be worn and immediately returned to PACA for inspection and repair. If the damage is the result of normal wear and tear, the damage will be repaired free of charge. If however, the damage is the result of improper care, storage or abuse, determined solely by PACA, then PACA will advise the owner of recommended repair or replacement costs. In any event, the owner will be responsible for the cost of returning the vest to the factory. The ballistic or stab resistant elements of this system will reduce the possibility of serious physical injury to the wearer in the areas covered by the ballistic or stab elements. There is NO protection where there is no ballistic or stab resistant element worn, the ballistic or stab element is warranted to be bullet or stab resistant for the life of the warranty under normal wear conditions and proper maintenance. There should be no expectation of bullet or stab resistance in areas not covered by the ballistic or stab element. The ballistic or stab element is not warranted to be bulletproof or stab proof.

This warranty does not cover and is void as to:

• Any ballistic or stab element that has been altered or modified in any way other than PACA authorized factory alterations.

• Any ballistic or stab element not in a PACA outer shell carrier. • Damage as a result of abuse or misuse. • Damage as a result of improper storage or maintenance. • Penetrations as a result of ballistic or stab testing. • The results of any specific ballistic or stab testing. • Injury as a result of bullets or other projectiles or instruments not impacting the

ballistic or stab element. The outer shell carrier is warranted to be free from manufacturing defects for 24 months from the date of purchase. The above warranty is the only warranty in effect on this product, THERE ARE NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, and THAT ARE IN EFFECT.

Packaging: All soft body armor shall be packaged and shipped consistent with good commercial

practices. Shipping Cartons: The soft body armor shall be packed into suitable corrugated cardboard box. The box shall allow for normal shipping without damage to the soft body armor.

Documentation:

The following documents, certifications, test-reports and samples must be included with the vendor’s bid. Where one manufacturer is bidding through multiple vendors, the manufacturer may submit the appropriate paperwork on behalf of all vendors. Failure to submit the following shall be cause for rejection:

1. Models made by manufacturers other than PACA Body Armor must be clearly identified and shall include the following:

a. Full product description. b. Complete bid sample, male and female. c. Drawings and/or photographs. d. Technical specifications.

The Contractor (or Vendor) shall make periodic criminal history record inquiries as authorized by O.C.G.A. §35-3-34, as now written, or here-after amended; or allowed by all or any other laws allowing such inquiry, to identify these persons who have been convicted of sexual abuse or any other act which would require such person to be entered into a national or state sexual offender registry. For the purpose of this policy, the term periodic shall mean that the criminal history record inquiries shall be made current upon the awarding of a successful bid on contract and checked no less than annually during the duration of the contract.
