ANNEX 1

STATISTICS AND PUBLICATIONS

1. Foreign Trade Statistics for Goods and Services: Responsible Agencies.

The Ministry of Macroeconomics and Statistics and State Customs Committee are responsiblefor foreign trade statistics for goods and services. The system of foreign trade statistics in the Ministryof Macroeconomics and Statistics is based on international standards. The compilation of statisticaldata on the foreign trade of the Republic of Uzbekistan is based on monthly reports provided bytrading enterprises. In addition , the State Customs Committee every month compiles data based oncustoms declarations for import and export transactions and, in turn, provides this data to the Ministryof Macroeconomics and Statistics.

2. Publications Related to Statistics

The remainder of this Annex 1 contains 29 tables presenting statistical information part ofwhich is published by the State Department of Statistics under Ministry of Macroeconomics andStatistics in the following special information bulletins:

- Uzbekistan 1991-1995- Main figures of socioeconomic development of the Republic of Uzbekistan in 1996-1997.

3. Statistical Data

The remainder of this Annex 1 contains statistical data about the Republic of Uzbekistan.With the exception of Tables 6,7,13 and 29 , which were prepared by the Ministry of Finance, thesetables were prepared by the Ministry of Macroeconomics and Statistics.

INFORMATION ON IMPORT LICENSING PROCEDURES

I. OUTLINE OF SYSTEM.

Most goods enter the Republic of Uzbekistan without an import license. No quantitativelimitations are imposed on imported goods. However, certain goods which may affect the health ofcitizens or raise environmental or national security concerns require a license to be imported into thecountry.

Annex No. 1 to Presidential Decree No. UP-1871 of 10 October 1997 sets forth a list ofspecific goods, the importation of which must be licensed by the MFER.

II. PURPOSES AND COVERAGE OF LICENSING.

The Republic of Uzbekistan has a unified licensing system. As mentioned above, it applies toarms and military equipment, precious metal alloys and precious stones, radioactive substances, audioand video products , and professional activities carried out by foreign citizens in the Republic ofUzbekistan.

The import licensing system is not intended to restrict the quantity of imported goods. It is toprotect public health and matters of environmental and national security concern.

Import licensing is authorized under Presidential Decree No. UP-1871 of 10 October 1997and Cabinet of Ministers Resolution No. 137 of 31 March 1998.

III. PROCEDURES

Goods imported under import licensing procedures are not subject to restrictions based on thequantity or volume of those imports.

An applicant for a license may submit an application at any time. Licenses normally areissued within ten days from the date of application.

A license is issued for the period necessary to complete the transaction as indicated in thecontractual provisions, but for no more than one year. There is no minimum time-frame between thedate of the issuance of the license and the date by which the importation must occur.

The issuance of a license requires the presentation of an executed import contract.Applications are considered by the Ministry of Foreign Economic Relations after receipt of allnecessary documents.

A decision to refuse to issue a license must have a reasonable basis. The reasons for a refusalmust be provided in writing to the applicant. An applicant may contest a baseless refusal to issue alicense through the judicial system.

IV. ELIGIBILITY OF IMPORTERS TO APPLY FOR LICENSE

Any economic participants, regardless of the type of ownership, have the right to apply for animport license.

VI. CONDITIONS OF LICENSING

Regardless of type of ownership, all economic participants have the right to apply for animport license.

Licenses are issued for the period of time necessary to complete a transaction, but no longerthan for one year. However, based on a well-grounded request by the applicant, a license extensionmay be granted. A license extension must be affirmed in writing by an appropriate note on theoriginal license, signed by an authorized official, and sealed by the stamp of the Ministry of ForeignEconomic Relations.

No penalties are imposed for non-use or partial use of a license.

In cases stipulated by current legislation, the Ministry of Foreign Economic Relations maysuspend or withdraw a previously issued license.

Goods subject to import licensing are not subject to quantitative limits.

VII. OTHER PROCEDURAL REQUIREMENTS

An import license is not required as a condition to obtaining foreign exchange.

There are no other administrative procedures required prior to importation.

ANNEX 4

INFORMATION ON IMPLEMENTATION AND ADMINISTRATIONOF THE CUSTOMS VALUATION AGREEMENT

When performing state regulation of foreign economic activities in the Republic ofUzbekistan, the GATT customs valuation system previously had not been used. In accordance withCabinet of Ministers Resolution No. 219 of 18 July 1996 "On Additional Measures to Liberalize theRegulation of the Export of Goods" and Cabinet of Ministers Resolution No. 342 of 1 October 1996"On Measures to Rationalize the Import of Goods into the Republic of Uzbekistan," all customspayments were levied based upon the contract value of goods.

However, the law "On Customs Tariff" of 29 August 1997 and the Customs Code enforcedfrom January 1, 1998 set forth an expanded treatment of customs value in line with the WTO/GATTvaluation principles and procedures.

Article 17 of the law "On Customs Tariff," sets forth the various bases that may now be usedto determine customs value as follows:

- transaction value of imported goods;

- transaction value of identical goods;

- transaction value of similar goods;

- deductive value;

- computed value; and

- reserve method.

Transaction value of imported goods is the primary basis used to determine customs value.When transaction value of imported goods cannot be used, an appropriate alternate method is chosenfrom the above list in descending order, with the exception of deductive value and computed value,the use of which may be reversed.

1. Questions concerning Article 1 of the Customs Valuation Agreement (CVA) of the WTO:

(a) Sales between related persons:

(i) Are sales between related persons subject to special provisions?

Article 18 of the law "On Customs Tariff" contains a provision for determining sales betweenrelated persons, corresponding the Articles 1 and 15.4 of the Customs Valuation Agreement (CVA) ofthe WTO, which requires the declarant to prove that the relationship did not influence the transactionvalue.

(ii) Is the fact of intercompany prices prima facie considered as grounds for regarding the respective prices as being influenced?

Neither in the previous nor in the new Law is intercompany price considered as prima faciegrounds for regarding the respective prices as being influenced.

(iii) What is the provision for giving the communication of the afore-mentioned grounds in writing if the importer so requests? (Article 1.2(a)).

Under neither the old nor the new legislation is there a specific provision requiring that animporter be informed that the customs authorities consider intercompany prices to be influenced bythe relationship. However, Article 14 of the law "On Customs Tariff" provides that the customsauthorities, at the declarant’s request, must provide a written explanation of their reasons for notaccepting the declared value as the basis for the assessment of customs duties.

(iv) How has Article 1.2(b) been implemented?

Article 1.2(b) of the CVA is not fully implemented in the law "On Customs Tariff." Article 18of that law contains a provision requiring an applicant involved in a related party transaction to provethat the relationship did not affect the price of the transaction. It is supposed that provisions andprocedures, which will be recommended for use pursuant to the Law "On Customs Tariff" willexplain and assure implementation of provisions of the Article 1.2(b).

(b) Price of lost or damaged goods: are there any special provisions or practical arrangements concerning the valuation of lost or damaged goods?

The current practice is that the purchase price or the value of damaged goods is reduced to theextent of the damage, as determined by an ad hoc committee consisting of representatives of thecustoms authorities and the declarant as well as an independent expert. No reduction in duties isgiven for goods that have been declared and included in the invoice but are not found upon customsexamination, unless the importer can satisfy the committee that the goods were lost before importationinto the Republic of Uzbekistan through no fault of the importer.

2. How has the provision of Article 4 to allow the importer an option to reverse the order of application of Articles 5 and 6 been implemented?

Articles 21 and 22 of the Law of the Republic of Uzbekistan "On Customs Tariff" provide theuse of the methods of custom evaluation of WTO, specified in the Articles 5 and 6 of CVA.

Article 17 of the law "On Customs Tariff" provides the use of the methods of customsevaluation specified in the Articles 5 and 6 of the CVA, which may be used in any sequence.

3. How has Article 5.2 been implemented?

Language following Article 5.2 has been incorporated in the law "On Customs Tariff" of theRepublic of Uzbekistan in the last paragraph of Article 21.

4. How has Article 6.2 been implemented?

Article 6.2 of the CVA, prohibiting compulsory production of, or access to, records(documentation) of any person not resident in the Republic of Uzbekistan for the purposes ofdetermining computed value, is not implemented in current or future customs legislation.

However, in practice, customs authorities never require a non-resident of Uzbekistan toproduce these types of records.

5. Questions concerning Article 7:

(a) What provisions have been made for making value determinations pursuant to Article 7?

Article 23 of the law "On Customs Tariff" closely follows the language of Article 7 of theCVA; however, item (d) of paragraph 2 of CVA Article 7 has not been included.

(b) What is the provision for informing the importer of the customs value determined underArticle 7?

Article 14 of the law "On Customs Tariff" provides the customs authorities to give a writtenexplanation for the written inquiry of declarant

(c) Are the prohibitions found in Article 7.2 delineated?

All of the prohibitions in Article 7.2, except for item (d), are delineated in Article 23 of thelaw "On Customs Tariff."

6. How have the options found in Article 8.2 been handled? In the case of f.o.b. application, are ex-factory prices also accepted?

The Republic of Uzbekistan assesses customs duties on the basis of C.I.F. prices, at theborder.

Article 18 of the law "On Customs Tariff" provides for the addition of the costs specified inArticle 8.2 incurred on goods up to the time they cross the customs border of the Republic ofUzbekistan in determining customs value, if such costs are not already included in the transactionprice.

7. Where is the rate of exchange published, as required by Article 9.1?

The Central Bank of Uzbekistan establishes the foreign exchange rates once a week. The ratesof exchange are published once a week in mass media. All major newspapers publish the rates ofexchange. In addition, all customs houses post the rates of exchange by posting the rates on bulletinboards.

8. What steps have been taken to ensure confidentiality, as required by Article 10?

Confidentiality is guaranteed and may not be disclosed to the third persons, including to thestate authorities without special permit of the applicant.

9. Questions concerning Article 11:

(a) What rights of appeal are open to the importer or any other person?

Article 13 of the Law "On Customs Tariff" provides that in case the declarant is not agreedwith decision of the customs authorities with regard to customs valuation, he has the right to appealsuch decision according to the procedures established in legislation of the Republic of Uzbekistan.Normally an appeal is filed first within the administrative body, and upon completion of theadministrative procedures, further appeal can be made to a judicial body.

(b) How is he or any other person to be informed of his right to further appeal?

The current laws do not provide obligations of the customs authorities to inform the importerwith regard to his right to further appeal.

In actual practice, if the importer so requests, the customs authorities verbally or in writingmust inform the declarant of his right to further appeal.

Under the law governing the procedure for drafting laws and other normative acts, all lawsand normative acts of general application must be made available to the general public through massmedia and come into force upon 10 days after their publication, if other term for coming into force isnot fixed during passing of corresponding normative act.

Article 13 of the law "On Customs Tariff" permits importers to receive and use importedgoods under a pledge or guarantee, pending final determination of value.

(b) Have additional explanations been laid down?

No, additional explanations have not been laid down in implementing instructions forArticle 13. Actually, normative documents dealing with such matters are under development by theState Customs Committee.

12. Questions concerning Article 16:

(a) Does the respective Article of national legislation contain a provision requiring customs authorities to give an explanation in writing as to how the customs value was determined?

The law "On Customs Tariff," in Article 14, requires a customs body to provide upon requesta written explanation as to why the declared value cannot be accepted as the basis for the assessmentof customs duties and taxes.

(b) Are there any further regulations concerning an above-mentioned request?

At this point in time, there are no further regulations concerning an above-mentioned request.

13. How have the Interpretative Notes of the Agreement been included?

The Interpretative Notes are not included in the current legislation. The issue is known to theState Customs Committee. However, Regulation No. 390 contains provisions for customs evaluationand includes interpretative notes.

The issue of whether or not to include the Interpretative Notes will be taken into considerationin future deliberations on this question.

14. How have the provision of the Decision of 26 April 1984 on the Treatment of Interest Charges in the Customs Value of Imported Goods (Val/6/Rev.1) been implemented?

The issue of whether or not to include interest payments in customs value has not yet beenconsidered by the Republic of Uzbekistan. The State Customs Committee is familiar with theDecision of 26 April 1984, and will take it into consideration in future deliberations on the matter.

For those countries applying paragraph 2 of the Decision of 24 September 1984 on theValuation of Carrier Media Bearing Software Equipment (Val/8), how have the provisions of thisparagraph been implemented?

The issue of whether or not to include the value of software in the valuation of carrier mediafor data processing equipment has not yet been considered by the Republic of Uzbekistan. However,the State Customs Committee is familiar with the Decision of 24 September 1984, and will take it intoconsideration in future deliberations on the matter.

Law On Standardization of 28 December 1993

According to Article 1 of this law, the main objectives of standardization are:

- to ensure the safety of goods, processes, works, and services for the purpose of protectingthe life, health and property of citizens, and the environment, and for the purpose ofconserving resources;

- to ensure the compatibility and inter-changeability of products;

- to ensure improvement in the quality and competitiveness of goods (works and services), inaccordance with the current level of scientific and technological development, as well aswith the needs of the population and the economy of the Republic;

- to promote the conservation of all types of resources, improvement of technical andeconomic indices of production;

- to carry out social, economic, scientific and technical programs and projects;

- to ensure the safety of buildings and commercial facilities in the event of natural andtechnogenic calamities and other emergencies;

- to ensure that consumers are provided with full and true information on the nomenclatureand quality of products;

- to ensure uniformity in the system of measurement.

The State Center for Standardization, Metrology and Certification under the Cabinet ofMinisters of the Republic of Uzbekistan (Uzgosstandart) oversees the process of standardization.

Uzgosstandart is responsible for: (i) the creation and implementation of state policy in thefield of standardization; (ii) the establishment of general rules governing the conduct of activities onstandardization, as well as the forms and methods by which business entities interact with each otherand with state management bodies; and (iii) the provision of supervision over the observance of rules,norms, and recommendations on standardization, as well as international (regional) standards and thenational standards of other countries.

Currently, Uzbekistan uses its own standards, regional and international standards, and thestandards of other countries.

Uzbekistan has signed the Agreement On Conducting a Coordinated Policy in the Area ofStandardization, Metrology and Certification of 13 March 1992 (the "Standardization Agreement").Uzbekistan is also a member of the Interstate Council of the CIS on Standardization, Metrology andCertification. Development, adoption and registration of the interstate standards of the CIS (eachcalled a "GOST") is carried out in accordance with the Standardization Agreement. Article 1 of theStandardization Agreement provides for the harmonization of requirements of new GOSTs withinternational, regional and leading national standards.

Since 1 January 1994, Uzgosstandart has been a member of the International StandardsOrganization (ISO).

At this time, there are more than 60,000 normative standard-setting documents of differentcategories in effect in the Republic of Uzbekistan, including:

- Standards of the Republic of Uzbekistan, "RST Uz" (450);

- ISO standards (9468);

- IEC standards (455);

- Sectoral standards (406);

- Technical Requirements of the Republic of Uzbekistan, "TU Uz" (2362);

In the Republic of Uzbekistan the following organizations carry out the organization andcoordination of standard-setting activities and the promulgation of standards:

- Standards of general applicability in all sectors of the national economy – the Uzbek StateCenter for Standardization, Metrology and Certification under the Cabinet of Ministers -Uzgosstandart;

- Standards of specific applicability to the construction and building industry, includingstandards applicable to design and engineering activities - Goskomarkhitektstroy (the StateCommittee on Architecture and Construction ("SCAC"));

- Standards directed at the regulation of the use of natural resources and the protection of theenvironment - Goskompriroda (the State Committee on Environmental Protection("SCEP"));

- Standards of specific applicability to the field of medical products, medical equipment, andpharmaceuticals, and with respect to identifying substances harmful to human healthcontained in domestically produced and imported products - the Ministry of Health(Minzdrav).

Uzgosstandart, the SCAC, the SCEP, the Ministry of Health and other authorized state bodiesdevelop, approve and issue standards and technical specifications on matters within their competence.

State registration of all such normative documents is carried out by the departments ofUzgosstandart.

Generally, the actual development, consideration, coordination and preparation of suchnormative documents is carried out by sectoral Technical Committees ("TC’s") on standardization andBasic Sectoral Organizations ("BSO’s") on standardization.

Currently, nine TC’s and eight BSO’s have been registered and function in Uzbekistan.Their membership is comprised of scientists and specialists from research institutes, industrial andtechnological design organizations, and engineering and architectural design organizations dealingwith specific types of products. Members are also drawn from manufacturers, consumers, andspecialists and managers of state bodies, including Uzgosstandart.

Uzgosstandart and other state bodies are entitled to represent the Republic of Uzbekistan ininternational and interstate (regional) organizations conducting standardization activities.

Law On the Certification of Goods and Services of 28 December 1993

In accordance with Article 2 of this law, certification is conducted for the following purposes:

- to control sales of products that pose a danger to the life and health of citizens, the propertyof juridical and natural persons, and the environment;

- to increase the competitiveness of products on the world market;

- to create conditions for the participation of entrepreneurs and local and foreign-owned legalentities in international economic and scientific-technical cooperation and internationaltrade;

- to protect consumers from the products and services of careless manufacturers, sellers orsuppliers; and

- to confirm statements of quality declared by a manufacturer, seller or supplier.

Certification may be of either a mandatory or voluntary character.

In accordance with this law, Uzgosstandart (or other organs having the required accreditationand designated by Uzgosstandart) are authorized to organize and implement activities on mandatorycertification.

The list of products subjected to mandatory certification is firstly established byUzgosstandart on the basis of proposals from other state management bodies and then approved by aresolution of the Cabinet of Ministers of the Republic of Uzbekistan.

The current list was approved by Cabinet of Ministers Resolution No. 409 of 12 August 1994("Resolution No. 409," described below). Pursuant to Resolution No. 409, the Main Customs Boardissued its Order No. 198 of 22 December 1994 entitled "Temporary Instructions On Importing andExporting Goods Subject to Mandatory Certification" ("Order No. 198"). In accordance withResolution No. 409 and Order No. 198, the import and export of goods specified in Annex 1 toResolution No. 409 requires a certificate of conformity from an accredited certification body, a list of

which is maintained in the State Register of Uzgosstandart (including accredited foreign certificationbodies).

The law "On Certification of Goods and Services" states that voluntary certification is to becarried out on the initiative of legal and natural persons according to the terms agreed to between theapplicant and the certification body.

All goods subject to mandatory certification imported into or exported from the Republic ofUzbekistan must be accompanied by a certificate of conformity regardless of the importer's/exporter’snationality or departmental affiliation, including goods imported as humanitarian aid.

The certificate of conformity is to be issued by an accredited certification body. InUzbekistan, the following are the bodies in Uzbekistan that are accredited to issue certificates ofconformity on matters within their competence:

- Ministry of Health, State Sanitary-Epidemiological Inspectorate: Hygiene Certificates;

- Ministry of Agriculture and Water Resources: Phyto-Sanitary Certificates;

- Ministry of Agriculture and Water Resources, State Veterinary Inspectorate: VeterinaryCertificate; and

- State Committee on Environmental Protection: Ecological Certificate.

If imported goods are accompanied by documents issued by the national certification body ofthe country of origin confirming the conformity of the imported goods with the applicable safetyrequirements, then such documents must be examined and accepted by Uzgosstandart. Suchacceptance is conditioned in the first instance on the existence of agreements and arrangements withrespect to the mutual acceptance of results of certification testing. If the examination is positive,Uzgosstandart will accept the certificate of conformity.

In the absence of documents confirming the safety of the goods, an importer or exporter maysubmit an application to the customs authorities and temporarily clear his/her goods, provided thathe/she assumes liability for their safety. However, the importer must also make appropriateapplication for a certificate of conformity.

If a product being imported or exported is found to represent a serious danger to the healthand well-being of the population or the environment, an ad hoc commission is to be set up withrepresentatives from the Ministry of Health, Uzgosstandart, SCEP and the State Customs Committee.The commission is authorized to:

- return the goods to the supplier;

- destroy the goods not meeting the requirements of safety; or

- recommend the re-processing of the goods.

Law On Metrology

This law sets forth the legal bases for a unified measurement system in the Republic ofUzbekistan. The requirements of this law are mandatory for all state and local governmental andadministrative bodies, as well as for all legal and physical persons. This law is intended to protect theinterests of consumers and the state from the consequences of inaccurate measurement.Uzgosstandart is responsible for ensuring adherence to the requirements of the unified system ofmeasurement.

Uzgosstandart represents the Republic of Uzbekistan in international organizations dealingwith issues involving unified measurement. If an international agreement provides for rules, otherthan the ones set forth by the legislation of the Republic of Uzbekistan, on unified measurements, thenthe rules spelled out in the international agreement apply.

Other Laws

The law "On State Sanitary Control" authorizes the Ministry of Health to enforce sanitaryrequirements. Sanitary norms and rules are approved by the Chief State Physician of the Republic ofUzbekistan and are subject to mandatory publication. The State Sanitary and Epidemiological Serviceunder the Ministry of Health is authorized to develop and examine draft standards.

Article XVII of GATT 1994 and the official interpretations thereof define "state tradingenterprises" as follows:

Governmental and non-governmental enterprises, including marketing boards, which havebeen granted exclusive or special rights or privileges, including statutory or constitutionalpowers, in the exercise of which they influence through their purchases or sales the level ordirection of imports or exports.

The Government of the Republic of Uzbekistan maintains certain enterprises, which carry outexport of certain raw materials in order to prevent their sale in the world market at dumping prices.

A certain share of foreign trade in Uzbekistan continues to be carried out throughGovernment channels, through the state order system persisting in a number of sectors and the systemof centralized exports.

However, the state’s share of foreign trade is declining sharply given the changing structureof trade, as enterprises now have the right to sell their output on the world market.

Presidential Decree No. UP-1212 of 14 August 1995 "On the Re-Organization of Self-Financing Departments of the Ministry of Foreign Economic Relations into Open State Joint-StockCompanies," reorganized the following self-financing foreign trade state-enterprises into open joint-stock companies of the same name: "Uzmarkaz-Impex," "Uzprommash-Impex," "Innovatsia,""Uzvneshtrans," the republican self-supporting foreign trade firm "Markazsanoat-Export," as well asthe republican self-supporting foreign economic and transport-forwarding company "Urta OsiyoTrans," all of which are under the Ministry of Foreign Economic Relations.

The share distribution of the above-mentioned joint stock companies is as follows:

- 51 per cent of the shares at par value of these companies was retained by the Ministry ofForeign Economic Relations, which has the right to administer them on behalf of the state;

- 25 per cent was sold to employees of the enterprises, according to their nominal price;and

- 24 per cent was sold to public in the share market, according to their market price.

The above-mentioned companies perform the following functions:

- conducting the sale of exports, including centralized exports, on the basis of contractsconcluded with manufacturers of export production in the Republic of Uzbekistan;

- procuring imported goods for state needs upon the orders of customers in the Republic ofUzbekistan; and

- providing services involving the forwarding and transport of export-import cargoes for thepurpose of executing foreign trade transactions.

Cotton.

The purpose for maintaining a state trading enterprise for the export of cotton fibre is togenerate export earnings for the state budget and to protect the farmers from being taken advantage ofby purchasers offering below market prices.

As described in Section 2.b of Part II of the Memorandum, 30 per cent of cotton grown inUzbekistan in 1997 was subject to the state order system. The balance of the crop was available forsale by the producers through the Commodity and Raw Material Exchange and/or state-owned tradingcompanies. The state joint-stock association on the processing and sale of cotton production"Uzdavpakhtasanoatsotish" handles the procurement of cotton subject to state order, for which it paysthe producers the prevailing market price in sums, according to the official exchange rate of theCentral Bank.

The sale of cotton for export is handled by state-owned joint stock companies under theMFER ("Innovatsia" and "Uzmarkaz-Impex") and the state-owned joint stock association"Uzdavpakhtasanoatsotish."

A private trader may purchase cotton not subject to state order and export it through one ofthe above-mentioned state joint-stock companies under the MFER if such trader has registered hisexport contract with the MFER.

Beginning on 1 November 1997, all export licensing requirements for goods (works andservices), except for the goods specifically listed in Table IV-4 of Part IV of this Memorandum, wereabolished.

Grain

Historically, Uzbekistan has been substantially reliant on imported grain to satisfy domesticdemand. Therefore, Uzbekistan is actively pursuing a policy of increasing domestic grain production.

25 per cent of the domestic grain harvest was subject to the system of state order in 1997. Thebalance of the crop may be disposed of at the discretion of the farmers, who may sell to households orthe State Procurement Agency on a freely negotiated basis.

The export of grain is currently prohibited. Imports of grain are not restricted. Private tradersmay import grain subject to the general import licensing system.

The procurement of the state order share is handled by the state joint-stock corporation forwheat products, "Uzdonmakhsulot." This corporation conducts nearly all flour milling operations inUzbekistan. The grain subject to state order is purchased to ensure the supply of flour on the market."Uzdonmakhsulot" pays the farmers the prevailing market price.

Oil and Natural Gas

Uzbekistan is self-sufficient in natural gas and oil products.

"Uzbekneftegas" (the National Corporation for the Oil and Gas Industry) is engaged in theexploration for and extraction and sale of domestic oil and gas resources.

The purpose for maintaining the state corporation "Uzbekneftegas" is to ensure that the profitsgenerated from the exploitation of the country’s natural energy resources accrue to the central budgetof the country, to make the country self-sufficient in oil, and to save the foreign exchange resourcesof the country from being used to finance the purchase of imported oil.

Uzbekneftegas has the right to import and export oil and gas. Private companies may alsoengage in the purchase and export of oil products and refined oil on the basis of appropriate contractsregistered with the MFER. Beginning on 1 November 1997, export licensing for engaging in theseactivities is not required.

Ferrous Metals

The export of ferrous metals is generally handled by state-owned trading joint stockcompanies (e.g., "Uzmarkaz-Impex") under the MFER.

The purpose for this control is to prevent the plundering of ferrous metal articles and waste.Private companies may also engage in such export activities on the basis of contracts registered withthe MFER. Beginning on 1 November 1997, licensing for engaging in these activities is not required.

Non-Ferrous Metals

The Republic of Uzbekistan has signed a number of bilateral free trade agreements with otherCIS countries, i.e. Azerbaijan, Belarus, Georgia, Kazakstan, Kyrgyz Republic, Moldova, RussianFederation, Tadjikistan, Turkmenistan and Ukraine. These agreements are listed in Section A of thisAnnex 8 at item numbers 1, 3, 4, 6, 9, 11, 13, 15, 17 and 18, and their most significant provisions aresummarized at the corresponding item numbers in Table VII-1 located in Part VII of thisMemorandum.

In addition, both the CIS Agreement on the Creation of an Economic Union and theAgreement on the Creation of a Common Economic Area between the Republic of Uzbekistan, theRepublic of Kazakstan and the Kyrgyz Republic, which are listed in Section D of this Annex 8 atitems 1 and 9 respectively, contain general provisions committing the parties to establish a free tradearea. In partial fulfilment of the CIS Agreement on the Creation of an Economic Union, the Republicof Uzbekistan has executed the CIS Agreement on the Creation of a Free Trade Area (Moscow,15 April 1994).
