1.0 PROJECT OVERVIEW

1 Oro Cemento Industries Corporation (OCIC) intends to put up a cement grinding facility in Barangay Darong, Sta. Cruz, Davao del Sur. The facility will have cement grinding equipment, bulk storage, and other support facilities. It will have a production capacity of 2 million metric tons per year (MMTPY).

2.0 ACTIVITY RATIONALE

2 The Public Hearing was agreed upon during the 1st Technical Review of the Review Committee (REVCOM) last 28th of September 2018. The Notice of Public Hearing was officially posted on https://eia.emb.gov.ph/notice-of-public-hearingconsultation_link/ last 26th of October 2018. Included in the uploaded documents were the latest Environmental Impact Statement (EIS) and EIS Summary for the Public (ESP) written in both Filipino and English.

3 The Notice of Public Hearing was published in Manila Bulletin last 2nd and 9th of November 2018 (SEE: Attachment 1).

4 The distribution of the official invitations from the DENR Environmental Management Bureau (EMB) were conducted on the 5th of November 2018 onwards. The following were invited:

3.0 CONDUCT OF THE PUBLIC HEARING

6 The Public Hearing activity was conducted from 9:00AM to 1:00PM on the 16th of November 2018 (Friday) at the Barangay Darong Covered Court located in Brgy. Darong, Sta. Cruz, Davao del Sur. The composition of the participants is presented in Table 3. The meeting was facilitated by the DENR EMB Central Office Case Handlers and Public Hearing Officer.

4.0 SUMMARY OF ISSUES AND CONCERNS

8 The presentation material that guided the flow of the Public Hearing is provided as Attachment 4 of this report. The pertinent issues, concerns, and suggestions raised by the participants during the open forum and the corresponding responses of the project proponent and EIA consultant are summarized in the matrix below.

How much is the water consumption of project?

Since the project employs dry-process, the project only needs 110 cu. m/day for process cooling, greening and domestic use.

MARINE ASSESSMENT

Can the proponent’s marine assessment be validated with DENR Regional Office’s marine experts? This is so we could avoid duplication of works?

This suggestion is noted by Oro Cemento. All information pertaining to the results of the marine assessment for the EIA is presented in the report.

IMPACTS OF THE PROJECT

Can your product (cement) cause cancer (carcinogens)?


At present, there are no literatures/studies indicating that cement products can cause cancer.

Will your products generate noise during operation? Do you have mitigating measures for it?


The project will definitely produce noise. The project will be constructed far enough (middle of the property) from the neighborhood. Further, the project will have mitigating measures to attenuate noise (walls, mufflers, etc.). We will ensure that the project will follow the set standards from NPCC and avoid any discomfort (noise) in the community.

What will happen if there will be oil spill in the sea?


Vessels calling at the port will not be working on items which might cause oil spill, however if and when such happens, a contingency plan is in place to address it. The EIS report for the project identified oil spill and ensured that proper mitigating measures are applied.

The project will have an MMT. The members of the MMT will be determined after the issuance of the Environmental Compliance Certificate (ECC). The MMT composition will be based on DENR’s new DAO.

INFORMATION, EDUCATION AND COMMUNICATION CAMPAIGN (IEC)

Can we have another meeting to discuss futher the effects of the project to the community?

Representative

This is noted by Oro Cemento, but we should schedule this after the review of the EIS is finished.

BIOSECURITY

Can you verify if it is allowed to plant trees near the feed mill facility? As mentioned in our coordination meeting with SMFI, they discourage tree planting, as it can cause birds to go near the feed mill.

Sta. Cruz LGU Representative

The trees to be planted are non-fruit bearing trees. The facilities to be constructed, like warehouses and offices, are closed. We will also be coordinating with SMFI regarding this.

SITE VISITATION

Is it possible to have a site visit for barangay officials to similar projects (cement/grinding plants) that SMC is currently operating?

We will be coordinating with your office (barangay) for the new schedule of the site visit.

GREENING PROGRAM

May we suggest that the greening program in the peripheries will benefit the public? May we suggest further that fruit-bearing trees be planted?

CENRO Digos City Representative

As mentioned earlier, planting of fruit bearing trees is discouraged by Feedmill management to avoid attracting birds and insects that may contaminate their raw materials for feeds.

PROPOSED SCHOOL LOCATION

What is the update on the promised location of the Darong High School?

Education Sectoral Representative

This is still being discussed with the management. As we are still looking for a location that will benefit the students. Once finalized, we will be coordinating with the barangay. It will be better if the barangay and school representatives will suggest a location for Oro Cemento to consider.

Public Hearing • Is designed to promote dialogue or

communication between and among the project proponent, the DENR and the public for the purpose of exchanging information and views about the proposed project.

Mga Patakaran sa Pagsasagawa ng Public Hearing

1. Ang public hearing ay gagawin sa Tagalog. Gayunpaman, maaari pa ringgamitin ang lengguwahe kung saan kayo mas kumportable.

2. Ang sinumang may gustong sabihin sa open forum ay dapat itaas angkanyang kamay upang mapayagang magsalita ng hearing officer. Ang mgakomento at suhestyon ay maaari ding isulat sa ipapamahaging papel atibigay sa tauhan ng DENR.

3. Gamitin ang mikropono sa pagsasalita sapagkat ang mga pangyayari ayitinatala.

4. Kung magsasalita sa unang pagkakataon, sabihin ang pangalan,opisina/organisasyon na iyong nirerepresenta at ang iyong posisyon.


5. Ang mga magsasalita ay dapat bigyan ng kaukulang pansin ang nakalaang oras

7. Ang mga komento ay dapat gawin bilang kinatawan ng interes ng publiko athindi pansarili ng sa gayon ay nakapokus ang lahat sa isyung pinaguusapan.

8. Makinig sa taong nagsasalita at iwasan ang paggawa ng anumangnakakabulabog. Ano man ang nararamdaman tungkol sa sinasabi ng taongnagsasalita ay dapat itong ipagtimpi at hintayin ang pagkakataongmakapagsalita. Irespeto ang opinion ng iba at ang hindi pagsang-ayon aydapat isatinig ng maayos.

9. Ang hearing officer ay may karapatang palabasin ang indibidwal o grupo napatuloy na nakakagulo sa ginagawang hearing kung hindi pa rin ito tumigilmatapos bigyan ng tatlong babala ng Hearing Officer.

PH OFFICER: At this point, bibigyan po natin kayo ng pagkakataon na

sabihin ang inyong katanungan. Subalit, kailangan munang tandaan ang

mga rules ano po? Iwasan po natin ang mainit na pagtatalo. Yung mga

masasakit po na pananalita, maiinit na argumento, iwasan po natin yun.

Kasi po, makukuha naman po yun sa mahinahon diba? Yung mga katanungan

po nila, dapat po, connected sa proyekto. Wag po tayong magtanong ng

mga bagay na hindi konektado sa pinopropose po ng proponent.

Kung sakali po, nakiki-usap po kami sa inyo, na yung nabanggit nan a

tanong, wag na po nating ulitin, kasi po, masasayang po ang oras po.

Bago po magsalita, sabihin po yung pangalan, barangay, organisasyong

kinabibilangan. Kung nahihiya po kayo, ako po ang lalapit sa inyo.

Kung sakali po, may papel po kami para duon niyo po isulat ang mga

katanungan niyo at babanggitin po naming iyon.

Hinihikayat po naming kayo mga kaibigan na sabihin niyo po yung mga

PUBLIC: Magandang umaga sir/ma’am, isa po akong barangay Tanod. Hindi

ako anti-proyekto, natutuwa kami na malaman na ang mga pangamba ng

mga tao, na hindi makasama sa katawan ang alikabok. Sa nakita namin

kanina, okay ang project niyo. Dahil may pollution control. Kung may

polusyon, merong solusyon. Wala naman pangamba na ang mga tao dito.

Pag may nakita kaming lumilipad na mga alikabok, i-report namin sa

barangay, para aksyon agad. Dun sa facility, klarong klaro naman na

meron kayong solusyon sa mga polusyon mula sa project.

Pwede niyo pong sabihin sa inyong diyalekto, meron po kaming

translator galing sa EMB Region XI.

PUBLIC: Maayong buntag sa tanan! Ako po si <inaudible> ng DENR CENRO

Digos, I’m here to listen and document the presentation of Oro Cement.

Sa report po, sa project proposal list, dapat sana, may visual, dahil

hindi namin alam yung itatayo. Sana yung next, visualize. Kasi, gagawa

tayo ng cement grinding, anong klase yun? Hindi naming alam. Sample

yung image. Sa coastal, yung environment adviser, in your own, sa

company. Para wala tayong duplication, sana mag invite kayo sa DENR

Regional. Para malaman natin kung ano ang masisira. Kasi sa report

niyo, may corals. Sana sa pag-validate, may recommendation sana yung

coastal namin. In the long run, hindi natin ma-iiwasan na may

maapektuhang community, lalo na yung mga mangingisda. Kung may mag-

complain, ofcourse, i-eentertain namin yan. Huwag naman sana tayong

umabot sa punto na yun. Suggest lang po sir, na gagawa kayo sa regional

office, sa coastal management division, para magkaroon ng validation

sa site niyo, kasi may terms and conditions tayo jan. Yung coastal

expert namin sa region, alam nila yung dapat gawin. Yung sa greening,

salamat po sa company, para maminimize natin yung air pollution, kung

may air pollution. Of course, ang suggest ko lang, yung itanim niyo,

in-favor of the community. Kung gusto niyo talagang makatulong sa

community, of course, yung mga high valued crops like manga. For

protection purposes, forest trees like mahogany and narra. Yung sa

solid wastes, gagawa kayo ng solid waste management plan. I-susubmit

niyo sa DENR at MENRO, at least, pag mag-operate kayo, yun yung

susundin namin. That is all. Thank you!

PROPONENT: Sir, regarding po sa mga itatanim sa buffer zone, yung

itatanim namin ay protection. Gagawa kami ng plano para sa mga

appropriate trees. May plano na magtanim ng macopa, sabay sa pag-

construct.

PH OFFICER: Sir, yung ibang suggestion po kanina, noted po lahat yun.

Then yun sa validation po ng mga corals. Another question po?

PUBLIC: Sanitation Inspector, Sta. Cruz, sa diniscuss ni sir kanina,

madami tayong maiingay na equipment na mag-ooperate ng 24 hours. Ano

po ba yung mga mitigating measures, kasi sa pagkakaalam ko, hindi

pwede na throughout the day, yung decibels ay pantay-pantay. Baka

pwede natin i-discuss. Salamat po!

PROPONENT: Yung equipment natin, talagang nag-poproduce ng noise, may

mga iba’t ibang klase ng paraan para mapababa ang noise. No. 1, sa

building palang, kapag nilagyan natin ng pader, naaatenuate na yung

noise. Pangalawa, bukod sa enclosure, ilalayo natin sa bakod. Para

mas malaki ang ibaba sa ingay. Ngayon pa lang, base sa NPCC guidelines,

meron pong standards sa daytime at nighttime, sisiguraduhin natin na

yung sa monitoring nila, kapag nanjan na yung planta, hindi tayo nag-

eexceed sa noise level requirement. Meron tayong mga ganung

pamantayan. We are aware of that, in fact, nasa report yung mga decibel

limits na kelangang i-maintain. During the air sampling, kumuha rin

tayo ng noise levels noon. So, may profile na tayo ng noise sa area.

Kaya nga po nilayo yung mga equipment during the design ng planta.

Syempre, ayaw naman natin na habang natutulog kayo, may naririnig

kayo. Sa totoo nga, yung staff house nila, ilalapit sa community.

PH OFFICER: Salamat sir Joma, sana nasagot yung katanungan nila.

PUBLIC: Isa pa po, yung sa health, municipal health office po, sa dust

naman po, 24 hours operation, and yung mitigating measures natin ay

yung bag-filter at greening. Sir, hindi ba kayo magkakaproblemasa

greening, kasi katabi niyo yung feedmill? When we conducted the

coordination meeting with feedmill last Monday, dinidiscourage nila

yung greening, kasi it will attract birds that might create

biosecurity problem for them. Greening is good for you, pero sa kapit

bahay niyo, magkakaproblema sila. I-protect lang natin yung mga

recipient.

PROPONENT: Yung hopper natin, vacuum sealed, para hindi na maka-eskapo

yung alikabok. We assure you that hindi kami mag-ooperate kapag may

problema ang planta.

PH OFFICER: Sir, yung tanong po niya regarding sa feedmill.

PROPONENT: Tungkol po sa sinasabi sa feedmill at saka sa cement plant,

as much as possible, ang ilalagay pong puno ay hindi namumunga. Yung

lahat ng bodega ng feedmill, nakasarado po yun. Iiwasan din po natin

na pumasok yung mga ibon. Pag-uusapan din po namin ito ng feedmill,

para ma-address yung sinasabi niyong issue.

PUBLIC: Good morning po, Darong high school, we are very happy na

mabigyan na rin ng pansin yung kinakailangan naming lupa para sa high

school. Nakakalungkot lang, kasi it was announced sa scoping, tapos

ngayon, na-mention ulit. May mga tao ng member ng SMC na tinatanong

po namin, nakakalungkot po yung sagot na hindi po naming alam, at wala

daw pong document na will justify na yung community has a request for

the lot for the high school so nalungkot po kami. In fact, yesterday,

nag-hahanap po kami ng document na it will prove na may mga promises

na nangyari. May mga minutes po na nangyari po ang mga pag-uusap for

the Darong high school. Kasi yung sa Darong high school po, we really

need that, at urgent po iyon.

PROPONENT: Totoo po yun, napag-usapan sa mga dating scoping yun. Yung

narecommend po namin na lugar malapit po sa <inaudible>. Kaya ang

advise ng management, look for other areas, as much as possible, huwag

malayo, para sa mga bata. Para hindi tayo magkaproblema. So, ang

suggestion natin, ihanap ng lugar, given yung ibang areas na hindi pa

namin pag-aari. Huwag kayong mag-alala, at tutulungan namin kayo

tungkol dun.

PH OFFICER: Okay po? Sir?

PUBLIC: Thank you po for that, and we are looking forward na mangyari

po ito this year. Okay po, yung concern is yung environmental, yung

mga sampling, ang tanong ko po, saan po ba ma-aaccess ang data na ito.

PROPONENT: Sasabihin ko nga po kanina, yung kabuuan ng report,

accessible po siya sa EMB website. Kasi po, bago tayo nag-conduct ng

public hearing, naka-upload po yung file. Kasi po, may policy si EMB

ngayon, na lahat ng report na i-susubmit sa kanila ay i-uupload. Even

PUBLIC: Good morning, I’m <inaudible> from the planning office. Ang

tanong ko lang sir, nagpresent kayo kung ano yung about sa monitoring

sa air, water at solid waste. Gusto namin malaman yung talagang result,

kasi teknikal yun. Sa level namin, meron na kaming kaunting kaalaman.

Maganda po siguro na meron tayong 1 meeting para ma-coordinate namin

sa mga barangay officials kung ano talaga ang result. Third party ang

kumuha ng data, so parang transparent lang for the community. Para

may interaction sa result. Ang gagawin natin ay baseline, so may

monitoring kayong gagawin every quarter. Kailangan nating malaman yung

mangyayari sa future at commitment sa community. Yung sa zoning

classification niyo sa lupa, nakalagay yan sa agricultural, pero

pwedeng gawing industrial, pero hindi pa siya na-approve. Yun lang

PH OFFICER: Si Sir Jolo (EMB) po muna ang mag-eexplain about sa MMT.

CASE HANDLER: Yugn tungkol po sa multi-partite monitoring team (MMT),

base po sa aming DAO, yung public participation natin for

Environmentally Critical Projects, ay mangangailangan ng MMT. Ang MMT

po ay ma-eestablish kapag na-issuehan na sila ng ECC. Yung mga

representatives po mula sa LGUs, communities, and based na rin po sa

bagong DAO, DENR CENRO at PENRO. Ang MMT po yung monitoring arm ng

EMB. Sila yung katulong sa pagvavalidate dun sa mga kinonduct na

monitoring activities ng proyekto, at kung nag cocomply po sila sa

conditions naka-impose po sa ECC nila. Including yung mga monitoring

plans at kung effective po ba.

PUBLIC: The result of the study should also be presented not only to

the officials but to technical persons in the local government unit.

I am the MPDC. We wish that we can find time to study the EIS. We will

also discuss this with the members of the academe. Our vision for the

next 9 years, that our development should have ecological one. It

should not be about economic development only. It should be

sustainable and have ecological balance. <inaudible>. We can explain

to the people, the process, para kung ano yung mangyayari yung

community. How I wish that the presentation of the process flow. We

have to this presentation. Yung process talaga. Also, we have to sit-

down regarding the road network. Maybe the provincial and municipal

government for the road. That we should know so we could integrate it

in our plans.

PROPONENT: Noted po, maraming salamat po MPDC. Maganda po yung

suggestion niyo about sa pag-disclose, but we have to consult this

with the EMB also, kasi nasa proseso kami ng review. Kung ang i-iissue

samin regarding sa IEC, specifically for the LGU and BLGU to discuss

the information. Nothing will prevent you for asking this to Oro. Yung

process flow and road networks will be discussed with you, so thank

you po.

PH OFFICER: Tuloy-tuloy naman po yung communication nila sa inyo, and

yung lahat ng issues na i-reraise ay noted naman po.

PUBLIC: Member ng Lupon <inaudible>. Facility o planta? Facility yung

tawag? Yung sa FLA, how many years yung lease?

PROPONENT: On-going po yung application for FLA. Yung sa watershed

protection, that will be part of the CSR and also yung greening

program. Yung 110 cu. m., that is the rated po, but the requirement

of the plant is maliit lang, wala pong 30 cu. m., so maliit lang po.

Limitado lang po yung water requirement ng planta, because this is a

dry process. Nakalagay po sa report natin kung ilan po yung tubig na

kekelanganin.

PH OFFICER: Sasagutin din daw po ni sir (CENRO) yung question ni sir.

PUBLIC: Sir, tulong lang po ito sa company, to make it clear, sa FLA,

may application po yung SMC sa CENRO Digos, kung ilang years po yung

foreshore, 25 years po yan – renewable po yan. As long ang ma-meet

nila yung condition sa FLA, bayaran nila, may mga terms and conditions

yan sa contract. And then sa watershed po, mapansin po natin na yung

Oro Cemento Company, wala po sa taas, nasa lowland po siya. Mas dapat

po pagtuunan yung coastal resources. Its up to the company kung

magbibigay sila ng tulong or suporta sa watershed programs. Yung sa

soil sampling, that’s the time po na magkakaroon ng MMT. Titignan

natin yung commitment ng company – magbibigay sila ng data. Gusto ko

lang po ma-claro.

PH OFFICER: Maraming salamat po sa information! May mga tanong pa po

ba?

PUBLIC: Point of clarification, may mga nakausap po kami na yung nag-

pepresent daw is not an employee of Oro Cemento. Kasi hindi po namin

alam yung empleyado ng Oro Cemento.

PROPONENT: Nagpakilala po kami kanina. Kami po yung consultant.

PUBLIC: Hindi daw po kasi valid yung commitments, kasi hindi po kayo

tiga-SMC, yung nag-hahandle ng public scoping ay not from Oro.

ba kami sa pier?

ni Sir.

PROPONENT: Butas po yun no, makakalusot po kayo. Kaya lang po, pag-

uusapan din po natin later, dahil may mga safety procedures po tayo

sa planta, lalo na kapag nanjan yung barko. For safety reasons. More

than us, mas alam niyo po yung condition ng dagat.

PUBLIC: Maayong buntag! Ako po ang Brgy. Captain ng Darong. Direct to

the point sir, gusto lang po naming sa council <inaudible>, gusto sana

namin i-visit namin yung lugar na may katulad nung sa gagawin project.

PUBLIC: Yung sinasabi ni kapitan, that was already presented during

the public scoping. Wherein, they will be going to similar projects

in other places, so they can appreciate the project. Binabalik lang

po ni Kapitan.

PROPONENT: Nag-organize na po ng plant tour sa previous barangay

officials. Nagkataon lang po na napalitan po sila, at ipaparating po

natin ito. Pero, wala pa po yung public scoping natin dati, i-ninitiate

na nung kumpanya yung pagdala sa ating mga officials sa planta.

Siyempre, naiintindihan ko po na bagong set tayo. Kaya po, ipaparating

natin ito sa management.

I-clarify ko lang din po na kami ay consultant, at EIA preparer lang

po kami. So, we actually have a direct connection to the client. So

nakaka-communicate po kami. Wala po kaming power. Ang pwede lang po

naming magawa ay maisulat yung mga recommendations namin.

PH OFFICER: Sir, lahat naman po ng usapan dito ay Documented naman

po.

PUBLIC: Ma’am, kasi ganito ang nangyari jan, so yung President po,

hindi naman tayo against sa project. Ang gusto lang naming mangyari,

Makita yung lugar. Maraming salamat po!

PUBLIC: Maayong buntag sa tanan, salamat po na na-mention ni sir yung

sa environmental. Salamat at may team na mag-momonitor. Sino ba yung

mga representatives ng MMT?

PH OFFICER: Jolo, can you answer the question?

CASE HANDLER: Composition po ng MMT natin ay maximum of 10. Composition

po ng MMT natin ay representatives ng barangay officials, MENRO/CENRO,

RHU, LGUs, representatives ng other government agencies na may mandato

sa kanilang proyekto. By virtue na rin po ng DAO 2018-18 na miyembro

rin po yung MMT yung representatives po ng DENR.

PUBLIC: Saan po yung location talaga ng planta?

PH OFFICER: Sir, sino po yung sasagot? Actually po kanina, pinakita

na po kung saan yung magiging location ng project.

PUBLIC: Good morning, school head po ng Darong high school. Last

scoping po kasi, last July. Yung mga heads po namin, nagbigay sila ng

budget for the new school building. Ngayon po, nagfofollow-up po sila

kung ano daw po yung linya ng oro cemento. Kasi, lalagpas nanaman po

yung budget. I hope you know what I mean.

PROPONENT: Maraming salamat po. Actually sir, may na-identify na kami

na location. Nagkaroon ng deliberation na yung area, hindi dapat duon

yung school. So, naghahanap kami ng lugar, baka may marerekomenda

kayo, titignan namin kung pwede. Kasi sa ngayon, wala kaming area na

pwedeng magamit.

PH OFFICER: Sir, tulungan na lang po. Baka may pwede kayong i-recommend

na area.

PUBLIC: Sa ngayon po, may na-identify kaming lupa na hindi masyadong

malayo sa elementary school. Yun po yung area nila <inaudible>. Tapos,

mga 2 hecatares po yun.

PROPONENT: I-check po natin yung documentation nung area. Tapos, kung

okay po, ipapa-approve naming sa management. Yung area requirement

niyo, gusto lang din naming malinawan, kasi masyadong malaki yung 2

hectares, para sa 3 rooms.

PUBLIC: Yung school na itatayo is for junior and senior high school.

Yung sa amin po, yung lupa namin is around 2.6 hectares.

PROPONENT: Gusto lang din malaman, especially yung data natin.

PUBLIC: So far po, mga 60 students pa lang. Pero mag-dodoble doble po

yun.

PH OFFICER: Sige po, pag-usapan na lang po ito sa ibang araw. Okay

po?

PUBLIC: Concern lang po ako sa dagat, diba mag-gamit kayo ng barko,

pano kung magdulot po yun ng oil spill or marine pollution. Kasi, yung

mga tao jan, duon naliligo.

PROPONENT: Salamat po sir, naka-incorporate po yung oil spill

management at emergency response kung sakaling magkaroon ng oil spill

sa report. Yung plano natin is kausapin din later.

PUBLIC: Sir, tanong ko lang po kung may statistics kayo for the noise?

So sir, anong decibels po ba, meron po ba kayo? Maka-affect po ba?

PROPONENT: Naka indicate po yun sa report, yung statistics about sa

noise.

PUBLIC: Sir, sa data po ng air quality, particulars po, microns po?

So sa air po, can we guarantee that walang carcinogens sa products

ninyo? I just want to clarify this, as the project may cause problems

sa health ng community.

PROPONENT: Wala pong known carcinogens sa semento.

pwede, palitan yung name ng project, magiging Darong po.
