‘authorised’ (except when used in the definition of ‘authorised officer’) means (a) approved by theSenate by resolution, or by the Vice Chancellor in writing, or (b) an otherwise prohibited land use oractivity which is permitted by a parking permit or declaration issued pursuant to theseBy-laws;

By-law 37(1) Delete and substitute in its place the following—The holder of the parking permit shall be deemed to have been the driver or person in charge of thevehicle at the time of any alleged breach of these By-laws involving that vehicle. If that vehicledoes not have a current parking permit, the owner of the vehicle shall be deemed to have been thedriver or person in charge of it at the time of the alleged breach of these By-laws.

burning (whether intended to burn the bush or not), provide a firebreak of not less than 13 metreswide inside the external boundaries of the land so prepared. If you become owner or occupier ofland after the 1st day of November, 1999, the requirements of this notice are varied so as to requireyou to comply with the terms of this notice within 14 days of the date of your becoming owner oroccupier of such land, instead of on or before the 1st day of November, 1999. The firebreaks requiredby this notice are to be maintained clear of flammable materials up to and including the 31st dayof March, 2000.

If it is considered to be impracticable for any reason to clear firebreaks as required by this notice youmay apply to the Council or its duly authorised officer, before the 11th October, 1999, for permission toprovide firebreaks in alternative positions on the land. “TAFE International” means the institution established by the Vocational Education and Training(TAFE International) Order 1997;

Part 2—EstablishmentEstablishment and name4. An institution to be known as WestOne Services is established under section 57 of the Act.

Functions of Institution5. The functions of the Institution are—

(a) to collect, store, maintain and disseminate or diffuse vocational education and trainingintellectual property and related products provided or produced by public training providersor other persons for the State training system or other persons;

(b) to engage in any publishing activity by using any media and other technology for the mattersreferred to in paragraph (a);

(c) to co-ordinate, arrange or provide for the collection, storage, maintenance and disseminationor diffusion of vocational education and training intellectual property and related servicesprovided or produced by public training providers or other persons for the purposes of theState training system.

Management and control6. The management and control of the Institution are vested, in the chief executive but subject to theexercise of the Minister’s powers under section 14 of the Act.

Powers of the chief executive7. The chief executive may do all things necessary or convenient to be done for or in connection with theperformance of the functions of the Institution.

Advisory committee8. The chief executive may appoint a committee for the purposes of advising the chief executive incarrying out the functions of the Institution.

Staff9. For the purposes of assisting the Institution in carrying out its functions—

(a) there may be appointed under and subject to the Public Sector Management Act 1994 suchpublic service officers and other employees as are necessary;and

(b) despite paragraph (a), the chief executive may employ or engage persons otherwise than underthe Public Sector Management Act 1994.

Application of the Financial Administration and Audit Act 198510. For the purposes of the Financial Administration and Audit Act 1985 the Institution is to beregarded as a service of the Department.

Part 3—Consequential ProvisionsConsequential amendments11. The Vocational Education and Training (TAFE International) Order 1997 is amended in clause 5—

(a) by inserting after paragraph (a) the following—“and” ;

(b) by deleting “State;” in paragraph (b) and substituting the following—“State.” ; and

(c) by deleting paragraphs (c) to (e) and “and” after paragraph (d).

Staff12. On the commencement of this order all persons who immediately before that commencement weremembers of the staff of TAFE International for the purposes of carrying out the functions of that
