Buice received 45 years in prison last Mon-day for his role tnthe slaying of bankerPaul Broussard. The sentence was hand-ed down by Judge Brian Rains of the 176thDistrict Court.

Buice, who was charged with first de-gree murder, is the first of ten young mento be sentenced in the case. The otherdefendants are also charged with murder.Broussard and two of his friends were at-tacked by the young men as they walkedto their car in the early morning hours ofJuly 4 last year.

Broussard died from his wounds severalhours later in a hospital. One of his com-panions was hurt but survived his injuries,while the third man escaped unharmed.

Joan Huffman, an assistant district at-torney with the Special Crimes Division ofthe Harris County District Attorney's Of-fice, told TWT NEWS that Buice had beentaken into custody after his bond wasrevoked. Such action is not normally takenunless the court determines that the de-fendant is not abiding by the terms underwhich the bond was issued.

Community leader Ray Hill said thebondsman had decided to surrender thedefendant's bond when it was discovered

that Buice had obtained a passport andapplied for a work visa to Korea.

At a press conference held Mondayafter Buice's sentencing, Nancy Rodriguez,the mother of Paul Broussard, thanked thegay and lesbian community of Houston forthe support she had received since herson's death. She also said she believed theoutcome of the case would send a mes-sage to would-be gay bashers.

"People will be punished for the crimesthey commit ... John Buice is the first to bepunished. We must not let the others gounpunished."

Hill echoed the sentiment, saying, "It's[gay bashing] not fun anymore. The dayof reckoning has come, and the fun hasgone."

Buice will be eligible for parole when hehas served one-fourth of his sentence, or11 years and three months. As a part of hisplea bargain agreement, he made a re-corded statement detailing the events ofthe night he and the other co-defendantsattacked Broussard and his companions.

At press time, trial dates had not beenset for the remaining nine defendants inthe Broussard case.

Under consideration for this outlet willbe Bluett-Flowers, the community-orientedprimary care facility, as well as ProjectEsperanzalAfrican American Coalition, apart of the AIDS Interfaith Network.

"We will try to subcontract with one ofthem to provide facilities on a part-timebasis for our benefits assistance directorto meet with clients in that part of the city.The HSPC realizes it will cost money forthis additional outlet, so we have been toldto revise our budget estimates for the ad-ministrative costs," Thomas said. "Theproblem is that the HSPC's plans are notfiltered through the ideaof what is best forour clients."

Meeting on TCU Campus.FORT WORTH - Many gays and les-

bians have been ostracized by mainstreamreligious denominations, but supportgroups have been formed by gay and les-bian members of these churches to reachout to others in the community. GLAD isthe gay and lesbian support group formembers of the Christian Church (Disci-ples of Christ). The acronym stands forGay & Lesbian & Affirming Disciples.

Fort Worth will host the national con-vention of GLAD July 17-20 at Texas Chris-tian University. Members will come fromall over the United States and Canada, PaulRodgers told TWT NEWS. Rodgers, a Dallasresident, is also a member of the NorthTexas chapter of GLAD.

To STATE'S TwoHIGHEST COURTSSeeksFinding of Error inLower Court Decision.

AUSTIN - Attorney General Dan Mo-rales has filed appeals with the state's twohighest courts, asking them to overturn alower court ruling handed down againstSection 21.06 earlier this year.

Section 21.06 prohibits sexual relationsbetween consenting adults of the samesex. It criminalizes all homosexual con-duct, with potential punishment of a fineup to $500 as well a criminal conviction ofa crime of moral turpitude.

The latest move by the Attorney Generalputs the case before the Texas Supreme

Court, the state's highest civil court, andthe Court of Criminal Appeals, the highestcriminal court. Since Section 21.06, acriminal statute, is often used in civil courtcases as well as in family law matters,either of the state's two highest courtscould have jurisdiction in the case.

In the unanimous decision handeddown earlier this year by the Third DistrictCourt of Appeals, Chief Justice JimmyCarroll stated that there was nothing morefundamentally private and deserving ofprotection than sexual behavior betweenconsenting adults in private.

In its opinion, the Court cited earlierTexas Supreme Court rulings on the rightto privacy as the basis for its decision. TheThird District Court also rejected theState's argument that the 21.06 plaintiffsdid not have standing to challenge the con-stitutionality of a criminal statute in a civilcourt.

THRF Legal Coordinator Patricia Pres-ley defended the Third District Court's rul-ing. "The Appellate decision clearly rec-ognizes an individual's right to be leftalone and free from government intrusioninto his or her private life."

But she added there was a positive sideto the Attorney General's decision to takethe case to the state's two highest courts."A decision issued at this level will leaveno doubt in anyone's mind as to the statusof 21.06."

In legal language, Morales filed what isknown as an application for a writ of error,which means that he is asking the courtsto decide that the appellate court made anerror in its decision.

DALLAS - With the third March onWashington planned for April 25, 1993,over 150 regional and organizational rep-resentatives attended the National Steer-ing Committee meeting held at the Dallas

Gay & Lesbian Alliance Community Centerlast weekend. Agenda items included thediscussion of the platform and the elec-tion of permanent co-chairs to staff the na-tional office, which opens July 1 in Wash-ington, D.C.

Among the goals of the 1993 March arethe repeal of laws prohibiting sodomy;cross-gender expression and non-coercivesexual behavior between consentingadults; an amendment to the Code of Fed-eral Regulations recognizing same-sexrelationships; passage of the Equal RightsAmendment and the Civil Rights Amend-ment Act of 1991.

It is further proposed that a preamble bewritten by the People of Color caucus de-manding an end to institutionalized rac-ism, support for nonracist policies and af-firmative action, repeal of all discrimina-tory immigration laws based on race andHIV status, as well as a call for equal ec-onomic opportunity and an end to poverty.

Further demands call for an end to dis-crimination in education and ROTC pro-grams, health care, reproductive freedom;recognition of domestic partnerships; andcall for ending anti-Semitism, AIDS/HIVdiscrimination and hate crimes.

The first widely known celebrity to comeon board is Madonna's brother, Christo-pher Ciccone, who created the stage forhis sister's 1990 Blonde Ambition tour. Hewi II design the stage for the 1993 Marchon Washington.

The Executive Committee expects be-tween one and three million to attend theMarch and March-related activities. Thenext meeting of the National SteeringCommittee is set for October 3 and 4 in

DALLAS HEALTHDEPT. OPENS AIDS

EDUCATION CENTERSStoresin West,South DallasAreasAimed at Minority Communities.

DALLAS - Dallas has a new "first" thisweek-an AI DS education storefront. Thefirst location, which opened last Wednes-day, is at 3012 Navaro St. while the secondone opened on Friday at 4407 Hatcher.Their hours are 10 a.m.-4 p.m. The DallasCounty Health Department opened thetwo facilities to help educate the publicabout high-risk behaviors.

Funded by grants from the federal Cen-ters for Disease Control, both storefrontswill cost about $326,000 annually to oper-ate, said Anne Freeman, Director of theHealth Department's AIDS programs. Shetold TWT NEWS that the current plan is tokeep the two centers in operation for thenext five years, but the grants must facean annual review based on performance.

Figures released by the Health Depart-ment show that the percentage of His-panic and African-American cases of AIDShas risen from 10 to 30% since 1985. TheWest and South Dallas sites were chosenbecause the need for AIDS education isgreatest in minority communities.

Shirley Stevenson, who works in theSouth Dallas storefront, explained that theidea behind the centers is to get people intheir own community involved in theeducation effort. Volunteers will stop peo-ple on the street and talk about high-riskbehavior and ways of protecting oneself.They will also carry shoulder bags withbrochures, free condoms and bleach kitsfor sterilizing needles.

HIV testing and counseling will even-tually be offered at the storefronts onscheduled days, as well as other simplehealth screenings. May 27 is the first datefor blood-pressure testing. The HealthDepartment also plans to offer supportgroup meetings for drug users, their sex-ual partners and members of other high-risk groups.

Neighborhood volunteers will help toreinforce the message carried by thestorefronts' literature, some of which in-cludes stories written by local residents.Stevenson said that it brings neighborsin the area together to talk about AIDSprevention.

He said he thought the HSPC's decisionto create another assistance outlet wouldlead to a needless duplication of services.

Bethlehem, the south Dallas counter-part to the Oak Lawn Food Pantry, hasbeen allotted $42,000 th is year for its serv-ices, while ARC had proposed a similarprogram for that part of town for just over$15,000. Thomas explained that ARC's ex-pertise and bulk purchasing power en-abled the group to make a lower proposalcost. The difference in the two amounts-about $27,000-would enable Bethlehemto get started.

"If we see a need in the community, wetry to figure out how to fulfill it, whetherthere is government funding or not,"Thomas added, noting that the dentral pro-gram at the Nelson-Tebedo Clinic wasstarted with volunteer dentists, but cannow be expanded beyond its Mondaynight hours because supplemental fundshave been received.

"We have also been working for over ayear to try to provide complete meals forPWAs, which we started through the vol-unteerefforts of our registered dietician,"Thomas added. "We were then able toprepare 300 complete meals last week,which were frozen and then taken to theFood Pantry for distribution. People whoshop the pantry for food to prepare mealscan now also pick up a complete meaL"Thomas said that the additional funds willenable the program to continue.

Other questionable funding recommen-dations by the council include just under$4,000 to the AI DS counseling group Leg-acy. The group had submitted a proposalfor over $29,000, and what they actuallyreceived will cover rent and little more. TheMetropolitan Community Church, whichlast year got funding for its mental healthprogram, received none of the $40,300 itrequested for this year.

Dallas County Commissioner JohnWi ley Price has recently gone on record assaying he believed that the African-Amer-ican community was not receiving its fairshare of the federal and state grant moneybeing set aside for AIDS.

HOUSTON - The Greater HoustonAIDS Alliance [GHAA] hosted an educa-tional breakfast last Thursday morningaimed at increasing awareness of AIDSissues in the Houston business commu-nity. The event brought together city andcounty officials, business people andrepresentatives of community groups.

Highlighting the breakfast was a briefaddress by Mayor Bob Lanier, who spokeof his growing enlightenment on the.AI DSissue and how cooperation would be cru-cial to fighting the disease.

"If there's one thing I've been impressedwith since I became mayor, it's how muchmore effective we can be if the private andpublic sector work together."

"There is nowhere public and privatecoordination will be important than in thisarea [AIDS]."

A video produced by Romeo Cantu, Jr.in conjunction with GHAA and Channel 11and shown to attendees featured inter-views with Houstonians personally af-fected by AIDS.

GHAA board member Maurice "Mo"Jones, speaking from the perspective ofa former busi ness owner who was obi igedby his illness to sell his company, reit-erated how important it is for businessesto develop policies dealing specifically

with AIDS or face the financial conse-quences later.

"A business that doesn't have an AIDSplan and policy in 1992 is a company thatis rudderless .. _ "

Among organizations helping make thebreakfast briefing possible were the Amer-ican Red Cross, Burroughs Wellcome,Caremark Inc. and the NAMES Project.

In a related development, AIDS Founda-tion Houston announced that the Mayorand his wife have accepted the position ofchairpersons for this year's From AllWalks of Life fund-raiser.

AFH Director of Development GinnyGaltney said that the goal for this year'swalk was to double both participation anddonations over last year's event. She add-ed that the Mayor's association with thefund-raiser should help increase corporatesponsorship and participation.

QUEER NATIONPICKETS RANDALL'SRespondingto Grocery Chain'sRemoval of 'Houston Press.'HOUSTON - Last Friday evening, the

local tribe of Queer Nation staged a dem-onstration at the Randall's flagship storeat So. Shepherd and Westheimer. Thegroup was protesting the grocery chain'sremoval of the Houston Press from itsstores because the weekly accepts gayand lesbian personal ads.

The protesters, numbering about 30,entered the store, moving up and downseveral aisles, handing out copies of thePress and chanting slogans like "Eggs andmilk, not shame and guilt!"

They then regrouped outside, marchingback and forth in front of the store fornearly a half hour. Police officers stoodnearby with Randall's officials watchingthe proceedings.

The controversy surrounding the Hous-ton Press is not the first time the grocerychain has been accused of discriminationagainst gays and lesbians. Last fall, Ran-dall's refused to remove the Greensheetfrom its stores after that publication an-nounced it would not accept ads from gaysand lesbians for its personals section.

In 1989, Randall's inserted an antidis-crimination clause in its hiring policiesonly after persistent pressure from gayorganizations. '*'

Body Positive Picnic SuccessDear TWT:

Volunteers of Body Positive/Houstonand the Metropolitan Community Churchof the Resurrection set up and held our1992 Spring Picnic on Sunday, April 26 atthe Lovett Inn. MCCR provided games andlots of volunteers. Body Positive/Houstonprovided volunteers, barbecue chicken andsausage, drinks, plates and utensils. ThePWA Coalition provided briskets.

People who came were asked to bringfood or household goods as a donation toCornerstone House, an AIDS family carecenter, and to FIRM's Pediatric and FamilyAIDS Program. Body Positive/Houstonalso contacted numerous local grocerystores for donations.

Taking the Right ApproachDear TWT:

Magic Johnson and Arthur Ashe arenow known to be among the million or soAmericans infected with HIV. At thispoint, the American public is finallybecoming concerned, if not panicked, bythe AIDS epidemic.

As an education coordinator for AIDSFoundation Houston [AFH), it is my job toreplace misinformation with facts andmake people aware that the spread of HIVcan be easily stopped. But as long aspeople put themselves at risk, theproblem will continue to escalate.

We are more than ten years into thisepidemic. Why are we still toying with ourlives and continuing to take chances outof ignorance? Many people use denial asan excuse to play Russian roulette withtheir lives rather than consider protectingthemselves.

Don't wait until you happen to find outsomeone's HIV status before you becomeconcerned about protection. Just becauseyou think or hope your partner couldn'thave HIV-or other sexually transmitteddisease [STDs) for that matter-you can'tknow for sure without being tested.

Most everyone knows that you canmaximize your protection against thesediseases by using condoms properly. Butit is important that people learn moreabout the wrong ways as well as betterways to use condoms for better spontaneityand pleasure.

As we all know, adolescence is adifficult time for everyone. This isespecially the case for kids who arewrestling with their own sexuality.Outyouth Austin provides these kids asupport network that they otherwise mightgo without. It is no easy task to determinewhat is going on inside of you when thereis no support available. An ad in a highschool newspaper is one way to reachstudents that might otherwise gounnoticed until they are found deadbecause nobody was there to listen and tohave compassion for what they weregoing through.

I stand with many others in the gaycommunity and all people who care insupport of principal Kent Ewing for hiscourage to stand up to those in thecommunity whose strict religious valuesare more important than the welfare ofchildren.

Ultimately, the decisions we adultsmake will have a direct impact on how thenext generation is able to become modelcitizens. They must be our first priority,for they truly are the future. We owe it tothese kids to at least make available thetools and compassion necessary for themto become self-actualized, proud citizens.Our acting on their behalf now will be thegreatest contribution we can make toenrich their lives and the life of society atlarge in the future.

Dear TWT:Accolades to Mr. Wilburn on his

editorial in the 4/30-5/6 edition of theHouston Press: "Randall's Bans the Press,We're Confused ... Are You Confused?" Inthis day and age, when energy andemotions concerning human rights haverecently culminated with disastrousresults, an article in support of theseliberties, in an award-winning publication,is indeed encouraging.

After reading the variety of contradictoryreasons given as the reasons for removalof the Houston Press from Randall'sgrocery store-lack of timely payments,poor maintenance of the racks andeditorial content-I am not confused.However, I do find myself compelled toshare with Mr. Onstead and your readers anumber of things.

I do believe Randall's is a trulyremarkable store. Remarkable in that it isexceptional, extraordinary, incredible anduncommon in its views and actions. Onceagain, the issue of Mr. Onstead'sdiscriminatory practices based on sexualorientation is raised.

I honestly can feel the difference whenI walk through their door. For our holier-than-thou grocer's reference, this feelingis most closely likened to the warmth andcharm with which one is met whenwalking, dripping wet, through the frozenfoods section: cold and undesirable.

In reference to Mr. Onstead's stancebefore his Lord some day, I have only thishope for him: that the Lord that he comesbefore is indeed some mythological godof lying and hypocrisy. For if Randallstands before any deity of honesty andsincerity to be judged, I am most certainand fearful of an unpleasant verdict on hisbehalf. I would like to share with him athought of which I was often remindedwhen I was younger: you can go to hellfor lying as quickly as you can forstealing.

I, too, will concede that Randall Onsteadknows the grocery business. Moreover, Ialso consider Mr. Onstead's commercialsand promotions most effective. Restassured, as their advertising blurbssuggest, I most certainly do tell myfriends about Randall's.

dents had no authority to disallow thestudents and their guests from using theballroom. Bob Binder, president of the stu-dent government, told the planners to goon with the dance as scheduled.

Once more, gay groups and their sup-porters were jubilant. But when they ar-rived to decorate the ballroom, they weremet by the Student Activities' Dean, whotold them the dance and the Student UnionDirector's functions had been canceled by"his superiors." But when questioned, herefused to name the "superiors."

Desperately working against time, thegays once more appealed to the ActingPresident, who now refused to accept theminutes of the Student Union Board ofDirectors.

By this time, some 25 students andguests were already dancing in the ball-room and refused to stop. So the campuspolice were called. When the students stillrefused to leave the ballroom, 30 police-men sealed it off. Arriving dancers tried togain entry by stacking tables one on topof another and crawling through a balconywindow. So, of course, the police removedthe tables. They then told the dancers toleave the ballroom or face arrest. Whenthe dancers asked what they would becharged with, the Dean replied, "Disturb-ing the peace; we will find something."

Aroused by all this commotion, some200 people (about half of them straight)began assembling at the glass wall at thesouth end of the ballroom where theychanted support for the dancers inside.Despite this show of support, and fearingarrest, all but five of the dancers left. Thosewho remained were taken into custody.

The police moved quickly in getting thefirst four out of the Student Union Build-ing and into a squad car. But one youth,a straight supporter of gay rights and alsoa member of a pacifist peace group, wentlimp. By the time the police got him to thesquad car, sympathizers had filled the

"Play by the rules," they are advised. Fine.But have the critics ever noticed that therules are often stacked against us? It'scalled "Catch-22." Consider:

As early as April, 1970, a small group ofpeople attempted to form a "gay lib" groupat the University of Texas at Austin. By thefall of 1971, they had somehow won thesupport of the Student Senate, but Chan-cellor Charles LeMaistre arbitrarily ruledthat "a gay lib group couldn't register asa campus organization." The brouhahathat resulted divided the student body.

With few members and little money, thestruggling group, nonetheless, filed acomplaint in Federal District Court alleg-ing that the administration was abridgingtheir constitutional rights of free speechand assembly. To pay for legal expenses,a big campus-wide dance, sponsored notby the gay activists but by the Student Sen-ate, was planned for February 25, 1972.

Jubilant gays began distributing hand-bills, creating even more publicity and con-troversy. The Dean of Students found ahandbill on his car and decided-aftersome consideration-to remove his sig-nature for the reservation of the mainballroom of the Student Union Building. Inother words, he canceled the dance.

The gay lib group, attempting to play bythe rules, then appealed to the ActingPresident of UT, who felt that the dance" .... would attract only a homosexualcrowd and therefore was not an appropri-ate function in view of the suit against theregents by this group." (In other words:You can't hold the dance unless you sue,and if you sue, you can't hold the dance.)

The Student Union Board of Directors(composed of four students and threefaculty members) voted four to three infavor of the dance. It was to be a "StudentSenate function," thus the Dean of Stu-

driveway and were blocking the exit. To in-timidate the crowd, one policeman begantaking pictures of them. When that didn'twork, he drew a can of mace and threat-ened to use it if the students didn't givehim "breathing room."

Somebody shouted that the dance wouldcontinue on the patio, where university ap-proval was not needed. Eventually, morethan a thousand people filled the patio andsurrounding balconies. Donation bucketswere passed through the crowd.

In the meantime, the five prisoners werecharged with disrupting a campus activity,despite the fact that none was going on atthe time. One of the students, unwilling todocilely comply with the authorities, re-fused to give his name. An officer pulledhim up by his hair and punched him in theface, claiming the youth had spit at him.When confronted by four witnesses, theofficer changed his story: the young manhad tried to spit in his face.

One of those arrested, a gay man, wasstripped of his clothes and placed in a cellwith two other prisoners who were told tobeat him up without leaving any incrim-inating bruises or marks. Somehow, hetalked the other two prisoners out of it.

The men remained in jail for about threehours. All the while, their lawyers were toldthe men could not be seen as they werebeing processed. In truth, the processinghad been completed, and the men werejust sitting in jail.

In time the suit filed by the gay lib groupwas dropped, and eventually a gay and les-bian student support group was recog-nized by campus authorities. But the moralof the story is this: Nothing is ever given.There has to be a "Rosa Parks." Somebodyhas to refuse to sit in the back of the bus.

Learning from history, we know that wemust organize. We must work. We mustvote. We must persuade. We must play bythe rules. And if all that doesn't work,well ... has anyone any suggestions?

Why did this small group of people at-tempt to form a gay lib group on the Uni-versity of Texas campus in the first place?Why did they risk ridicule, arrest and in-jury? Why didn't they just sit quietly in theback of the bus?

Do you suppose they did it for you andme? And for all the gay and lesbian you'sand me's who would follow them until theday arrived when all people (not just gaysand lesbians) would enjoy, not specialprivileges, but the same rights and respon-sibilities as everyone else? ~

Bruce E. Burr peacefully passed away Saturday,May 2,1992,8:45 p.m. at Twelve Oaks Hospital. BornMay 1, 1954,Bruce became an influential part of theBRB family in 1986. Bruce extended his warmth toothers as an honorary member of the Colt 45's.

Bruce leaves his immediate family in Florida, andhis extended family at the BRB, and longtime friendand roommate Steve Cantrell. Bruce will be missedbut fondly remembered by all.

Bruce will once again be with his loved Jay Arm-strong, born May 11, 1958, who preceded Bruce'spassing in March of 1991.

He was a long-time memberof Miss Camp America, a past Diana Showdancer, board trustee of the Montrose ActivityCenter, GLHU's Mr. Baile 1988. Felix also co-chaired the Houston March on Austin '89committee, Baile '89 committee, Team Houston'90 and Houston Lesbian/Gay Pride Week '91.

He is survived by his parents, Severiano andIgnacia Garcia, sisters: Mercedes Jasso,Augustina Caudillo, Aurora Lara, Liria Castillo,Rachel Garcia, Christina Bocatto and DoloresBosquez; brothers: Angel, Marcello, Jose, andSevero Garcia; his daughter, Julie Gail Garcia;48 nieces and nephews, and hundreds of friends.
