Sir,

This is with reference to the aforementioned subject and referred letter, wherein TPIA was asked to submit observation on the request of TKC, M/s NCC Limited for release of 2nd Mobilization Advance i.e., 5% of agreement value in Gorakhpur District. In reference to the above, we have submitted our observations vide letter no.- MTCPL/SWSM/TPI-Cluster 09/2021-22/14829, Date: 04.01.2022 (enclosed), mentioning the status of establishment of site office, labs and mobilization of resources, which reflects that the requisite conditions for release of 2nd installment of Mobilization advance are not yet fulfilled.

In view of the aforementioned, TKC has submitted a letter requesting to release 2nd installment of 5% amount of Mobilization Advance, assuring that all the shortcomings/observations marked in TPIA report with respect to Site offices, Labs & mobilization of Key personnel will be attended by them till 15.02.2022.

In light of the above observations, UPJN may take judicious decision regarding the release of 2nd installment of Mobilization advance.

Sir,

This is with reference to the aforementioned subject and referred letter, wherein, TPIA has been asked to submit observation on the request of TKC, M/s NCC Limited for release of 2nd Mobilization Advance i.e., 5% of agreement value in Gorakhpur District. With reference to above cited subject and references, we have gone through the contract agreement number- 216/ED/2021-22/IV, dated 15.12.2021 for 79 Gram Panchayat having value of 184.23 Cr and O&M cost of 46.32 Cr. (Total value of Agreement 230.55 Cr)

With reference to the minutes of pre-bid meeting dated 22.09.2020 Mobilization advance is to be given in two parts, i.e., Part-1: 5% of agreement value after signing of the multipartite agreements and Part-2: 5% of agreement value after establishment of site office, mobilization of resources. And as we have been informed, that TKC has already been paid 1st Mobilization Advance (5% of agreement value) on account of signing the multipartite agreements & submission of Advance Bank Guarantee of any nationalized bank equivalent to 110%. Second Installment of 5% would be released after establishment of site office and mobilization of resources.

With reference to the above, TPIA had visited site office and verified the Precast/Stocking yard, Manpower deployment at site, Tools & Plants & machineries wherein following observations were noted: -

Site/District Office:

1. As per Special Term and Conditions of the contract 7.1.c (Page no- 80) Site offices as well district offices should be set up immediately on receipt of work order.

2. 1 No of District Office & 2 nos. of site office have been set up.

3. District Office: - Plot No.287 and 412, Rudrapur, Kusmi Bazar, Gorakhpur Pin code: 273002. Validity of this agreement is 01.03.2021 to 28.02.2024.

4. Sahjanwa Site office: - Plot No.337 & 338, Semra (Village), Tahsil- Sahjanwa, Gorakhpur, U.P Pin code: 273209. Validity of this agreement is 01.07.2021 to 30.06.2023

5. Gola Site office: - Plot No.151 & 152, Deidhiha, Tahsil- Gola, Gorakhpur. Pin code: -273409. Validity of this agreement is 20.08.2021 to 19.08.2023.

Precast/Stocking Yard:

1. Precast/Stocking Yard has been set up at Plot No.287 and 412, Rudrapur, Kusmi Bazzar, Gorakhpur Pin code: 273002 and Plot No.151 & 152, Deidhiha, Tahsil- Gola, Gorakhpur. Pin code: -273409.

2. Agreement of the Precast/Stocking Yard is attached for your further perusal. The Agreement is of 36 months, ending on 28.02.2024 and of 24 months, ending on 19.08.2023.

3. The Land demarcation & Boundary works has been completed. 4. Construction work at Stocking Yard is in progress. 5. Labs are not established in blocks.

Tools & Plants & Machinery:

1. 2 Diesel Generator (7.5 KVA Capacity) are available at nearby Stocking Yard. 2. Rig Machine with Compressor unit (In attached List) available. 3. All the required Tool, plants and Machineries are not available,

Manpower Deployment:

1. Manpower Deployment is done at the site however it is not as per RFP. List of Deployment is attached.

2. Date of Joining of Manpower has been provided.
