. Wueraas by section 50 (2) of the Constitution of the former Eastern Nigeria as modified by the Constitu-tion (Basic Provisions) Decree 1975 and the States (Creation and Transitional Provisions) Decree 1976 it is

provided that the Judges of the High Court of each of the States created out of the former Eastern Nigeria’ shall be the Chief Judge of the State and such number of other Judges (not being less than six) as may beprescribed by law : :

ANDWHEREAS bysection 51 (3) of the Constitution of the former Eastern Nigeria modified as aforesaidit is provided that if the office of Chief Judge of the State is vacant or if the person holding the office is forany reason unable to perform the functions of his office, then, until a person has been appointed toand hasassumed the functions of that office or until the person holdingtheoffice has resumed those functions, as thecase may be, those functions shall be performed by such one of théother Judges of the High Court of theState as maybe designated in that behalf by the Supreme Military Council, acting after consultation with theAdvisory Judicial Committee : co, mc .

Now, THEREFORE, THE SUPREME Mititary Councit,acting after consultation with the Advisory JudicialCommittee, do hereby appointMrJustice Oruno Into-'Tartad to act as the Chief Judge ofthe HighCourt ofRivers State with effectfrom24th dayofJuly, 1977,until the substantive holder ofthe post resumesduty.
