SUBJECT: Consider Resolution 2021-03 Retaining Statutory Tort Limits

PURPOSE/ACTION REQUESTED Consider Resolution 2021–03 retaining statutory tort limits for 2021.

SUMMARY The League of Minnesota Cities Insurance Trust (LMCIT) insures the City of Dundas for liability and property damage. Cities obtaining liability coverage from LMCIT must decide whether or not to waive the statutory tort limits to the extent of the coverage purchased. The decision to waive or not waive the statutory limits has the following effects:

• If the City does not waive the statutory tort limits, an individual claimant would be able torecover no more than $500,000 on any claim to which the statutory tort limits apply. Thetotal, which all claimants would be able to recover for a single occurrence to which thestatutory tort limits apply, would be limited to $1,500,000. These statutory tort limits wouldapply regardless of whether or not the city purchases the optional excess liabilitycoverage.

• If the City waives the statutory tort limits and does not purchase excess liability coverage,a single claimant could potentially recover up to $2,000,000 on a single occurrence. Thetotal which all claimants would be able to recover for a single occurrence to which thestatutory limits apply would also be limited to the amount of coverage purchased,regardless of the number of claimants.

• If the City waives the statutory tort limits and purchases excess liability coverage, a singleclaimant could potentially recover an amount up to the limit of the coverage purchased.The total which all claimants would be able to recover for a single occurrence to which thestatutory limits apply would also be limited to the amount of coverage purchased,regardless of the number of claimants.

Only about 18% of LMCIT members have chosen to waive the statutory limits. When the city chooses the “waive” option, the city waives the protection of the statutory limits, up to the amount of coverage the city has. In addition, if the city waives the statutory tort limit, LMCIT will charge approximately 3% more in additional premium for the option.

By retaining (not waiving) statutory tort limits the need for excess liability insurance coverage is

limited to federal civil rights law violations, claims for tort liability assumed by contract, claims for actions in another state, claims based on liquor sales (risk for on-sale liquor sales is greater than off-sale) and claims based on land use regulations. The City of Dundas has $2,000,000 in coverage under our existing insurance.

We are completing the insurance renewal process for 2021 and LMCIT requires action by the City Council.

RECOMMENDATION Staff recommends the Council approve Resolution 2021–03 retaining (not waiving) statutory tort limits for 2021.

A Resolution Retaining Statutory Tort Limits for Fiscal Year 2021

WHEREAS, monetary tort limits are established by Minnesota State Statutes §466.04; and

WHEREAS, the Dundas City Council must decide whether to waive the statutory tort limits; and

WHEREAS, retaining the statutory tort limits as legislated by Minnesota State Statutes §466.04 limits the City’s tort liability to a maximum of $500,000 per claimant and $1,500,000 per occurrence.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL THAT the City of Dundas will retain statutory tort limits for fiscal year 2021.

Introduction

The Contractor for the new Dundas City Hall, Professional Contractors, has completed

work to date as documented on the attached Application and Certificate for Payment, and

is requesting payment. Along with the final payment, we are requesting approval of

Change Order No. 4 for this project.

Background

The contract amount for this project, approved by the City Council on August 26, 2019,

is $1,628,759. A summary of the final contract amount, including Change Order No. 4,

is as follows:

REQUEST FOR COUNCIL ACTION

TO: Mayor and City Council FROM: Jenelle Teppen, City Administrator SUBJECT: Consider Second Amendment to Purchase Agreement for Old City Hall DATE: For the City Council Meeting of January 25, 2021 PURPOSE/ACTION REQUESTED Consider a second amendment to the purchase agreement for the former City Hall. SUMMARY As the Council will recall, the HVAC unit in the former City Hall was found deficient and in of need of replacement. The City Council awarded the contract to replace the HVAC unit to Better Air after receiving two quotes. Due to unforeseen circumstances the replacement of the HVAC unit will likely occur after the sale property is closed. This second amendment to the purchase agreement ensures that the City has an additional 30 days after closing to replace the unit. And secondarily, Dan Irwin has created a Limited Liability company and has assigned his interest in the purchase agreement to that LLC. Resolution 2021-02 reflects that change. RECOMMENDATION Staff recommends that the Council approve the attached second amendment to the purchase agreement and Resolution 2021-02.

SECOND AMENDMENT TO REAL ESTATE

PURCHASE AGREEMENT

THIS AMENDMENT is dated as of January _______ 2021 (the “Second Amendment”) between the City of Dundas, a municipal corporation, (“Seller) and Daniel Irwin ("Buyer"), parties to that certain purchase agreement (“Purchase Agreement”) dated November 23, 2020 and amended January 4, 2021 (the “First Amendment”) (collectively, the “Complete PA”).

In consideration of this Second Amendment, Seller and Buyer agree to amend the

Complete PA as follows:

1. Buyer assigns his interest in the Complete PA to Thank You Enterprises LLC, a limited liability company under the laws of Minnesota.

2. The terms of the Complete PA, (as previously amended by the First Amendment) are amended to allow Seller up to thirty (30) days following the date of closing to replace the HVAC unit.

All other terms and conditions of the Complete PA not otherwise modified herein remain the same.

Meetings DATE: For the City Council Meeting of January 25, 2021 PURPOSE/ACTION REQUESTED Consider Ordinance 2021-01 amending City Code Chapter 30.01 City Council meetings. SUMMARY The City Council recently discussed moving back to meeting on the second and fourth Monday’s of each month for the entire year instead of the current schedule where the meetings occur on the second and third Mondays of December and the fist and third Monday’s in January. The Council can always, by majority vote cancel or postpone a meeting should an occasion arise when it becomes necessary. RECOMMENDATION Staff recommends that the Council approve amending City Code Chapter 30.01 to reflect Regular Council meetings on the second and fourth Monday of each month of the year.

An Ordinance Amending Chapter 30.01: City Council Meetings

THE CITY COUNCIL OF THE CITY OF DUNDAS DOES HEREBY ORDAIN: Section 1. Section 30.01 is amended by adding the underlined language and deleting the language in strikeout to read as follows: (A) Regular meetings. Regular meetings of the City Council, except for the months of January and December, shall be on the second and fourth Monday of each month at 7:00 p.m. The first meeting in January shall be held on the first Monday after the first Saturday and the second meeting in December shall be held on the third Monday. Shall be held on the second and fourth Mondays of each calendar month at 7:00 p.m. A regularly scheduled meeting may be postponed to a later date or time or canceled by motion of a majority present at any prior meeting. A regular meeting falling upon a holiday shall be held on the next following business day at the same time and place. All meetings, including special and adjourned meetings, shall be held in the City Hall unless the City Council decides otherwise at a prior meeting, or meeting in the City Hall is impossible, or not reasonably practical. Billiards and Pool DATE: For the City Council Meeting of January 25, 2021 PURPOSE/ACTION REQUESTED Consider Ordinance 2021-02 amending City Code Chapter 111.01 Bowling, Billiards and Pool. SUMMARY The City has for years annually licensed Bowling, Billiards and Pool at local establishments. According to State Statute Chapter 421.221 – Specific Powers of Council, Subdivision 25 this is discretionary: Subd. 25. Amusements. The council shall have power by ordinance to prevent or license and regulate the exhibition of circuses, theatrical performances, amusements, or shows of any kind, and the keeping of billiard tables and bowling alleys, to prohibit gambling and gambling devices, and to license, regulate or prohibit devices commonly used for gambling purposes. We currently license one jukebox and three pool tables with a license fee of $15 per table/device or $60 in annual revenue. RECOMMENDATION Staff recommends that the Council approve amending City Code Chapter 111.01 eliminating the chapter in its entirety. This would be effective January 1, 2022 since licenses for 2021 have already been issued.

An Ordinance Amending Chapter 111.01: Bowling, Billiards and Pool

THE CITY COUNCIL OF THE CITY OF DUNDAS DOES HEREBY ORDAIN:

Section 1. Section 111.01 is eliminated in its entirety:

Each proprietor of a billiard or pool table or of a bowling alley, or a combination of both, shall pay an annual license fee in an amount established in § 34.01 of this code of ordinances.

Section 2. This Ordinance shall be effective on January 1, 2022, upon its passage and publication in accordance with law.

Amusement Devices DATE: For the City Council Meeting of January 25, 2021 PURPOSE/ACTION REQUESTED Consider Ordinance 2021-03 amending City Code Chapter 111.04 Mechanical Amusement Devices. SUMMARY The City has for years annually licensed Mechanical Amusement Devices at local establishments. According to State Statute Chapter 421.221 – Specific Powers of Council, Subdivision 25 this is discretionary: Subd. 25. Amusements. The council shall have power by ordinance to prevent or license and regulate the exhibition of circuses, theatrical performances, amusements, or shows of any kind, and the keeping of billiard tables and bowling alleys, to prohibit gambling and gambling devices, and to license, regulate or prohibit devices commonly used for gambling purposes. We currently have no licenses for Mechanical Amusement Devices. RECOMMENDATION Staff recommends that the Council approve amending City Code Chapter 111.04 eliminating the chapter in its entirety. This would be effective January 1, 2022 since licenses for 2021 have already been issued.

An Ordinance Amending Chapter 111.04: Mechanical Amusement Devices

THE CITY COUNCIL OF THE CITY OF DUNDAS DOES HEREBY ORDAIN:

Section 1. Section 1111.04 is eliminated in its entirety: § 111.04 MECHANICAL AMUSEMENT DEVICES.

(A) Definition. A MECHANICAL AMUSEMENT DEVICE is hereby defined as a machine which, upon the insertion of a coin, chip or slug, operates or may be operated for use as a game, contest or amusement of any description, or which may be used for any such game, contest or amusement and which contains no automatic pay-off device for the return of money, coins, checks, tokens or merchandise, or which provides for no pay-off by any other means or manner; except that, this provision shall not prohibit the licensing of a machine which returns chips or slugs which may be used only in the machine licensed, and which in itself does not constitute a gambling device. The term shall include so-called pinball machines, music machines, motion picture machines and all other machines which, by the insertion of a coin or token, operate for the entertainment or amusement of the player, except weighing machines.

(B) License required. No person, firm or corporation shall own, operate, maintain or keep for operation within the City any such mechanical amusement device as hereinbefore defined without first having applied for and received a license therefor as hereinafter provided. No license shall be issued for any gambling device.

(C) Applications for license. Applications for licenses required herein may be granted by the City Council, in its discretion, to persons applying to it by personal interview. The applicant shall be prepared to make full disclosure to the Council of all matters relating to persons interested in the device, a general description of the device, the location of the building or premises where the same will be used and by whom. If the applicant is not the owner of the device, he or she shall be prepared to produce the contract, or a duplicate copy thereof, that he or she has for its use and possession, the applicant’s name, age, citizenship, the business in connection with which the proposed license will operate and its location, whether applicant is owner and operator of the business and the devices, how long he or she has been in that business at that place, representations as to the applicant’s character with references as may be required, and such other information as the Council may require from time to time. Each license shall be issued to the applicant only and shall not be transferable to another holder or premises.

(D) License fees. The fee for the license shall be established pursuant to § 34.01 of this code of ordinances for each device which the applicant is licensed to keep upon his or her place of business. The license shall expire on December 31 of each year; provided that, if a license is issued for a period of six months or less, the fee shall be prorated. The license fees shall be paid into the General Fund of the City.

(E) Transfers. The license may not be transferred to another location.

(F) License to be displayed. Every license granted hereunder shall be posted in a conspicuousplace on or near the game so licensed and shall identify the same by number or description.

(G) Prohibited practices and restrictions. No license hereunder shall be issued for any game ofskill within 500 feet of any school building. No person shall use any device licensed under this section as a gambling device and no licensee shall permit any person to use any game licensed hereunder for gambling purposes. The operation of any lottery or gambling device is declared to be contrary to this section.

Section 2. This Ordinance will be effective January 1, 2022, upon its passage and publication in accordance with law.

You, LLC and Second Amendment to Purchase Agreement DATE: For the City Council Meeting of January 25, 2021 PURPOSE/ACTION REQUESTED Consider Resolution 2021 – 02 authorizing the sale of former City Hall to Thank You, LLC and a second amendment to the purchase agreement for the former City Hall. SUMMARY The City Council approved a purchase agreement for the former City Hall on November 23, 2020, and subsequently approved an amendment to the purchase agreement due to the need to replace the HVAC unit. The buyer has assigned his interest to Thank You Enterprises LLC, a limited liability company under the laws of Minnesota. The Resolution that was originally approved and is necessary for the closing that reflects the new LLC has been revised and is attached. A second amendment to the purchase agreement is also attached. This reflects the assignment of the buyers’ interest to the LLC and allows for an additional 30 days following the date of closing for the replacement of the HVAC unit. The repair HVAC unit has been delayed due to a manufacturing issue. By adding language to the amendment now, it provides flexibility that is not tied to the closing date. RECOMMENDATION Staff recommends that the Council approve the Resolution and the second amendment to the Purchase Agreement.

A Resolution Approving Sale of Real Property Located at 216 Railway Street North, Dundas, MN, to Thank You Enterprises, LLC

WHEREAS, the City of Dundas is the owner of real property located at 216 Railway Street North in the City of Dundas, MN (the “Property”), Rice County PID 17.10,4.51.006, and legally described as:

That portion of Lot 2, Block 30, Railroad Addition to Dundas, Rice County, Minnesota, lying northerly of a line drawn parallel to and 30 feet southwesterly of the northerly line of said Lot 2.

WHEREAS, the City of Dundas (the “City”) has the power to sell real estate as its interests

require pursuant to Minn. Stat. §412.211; and WHEREAS, by Resolutions 2020-27, dated November 13, 2020, the Dundas City Council approved of the sale of the Property to Buyer Daniel Irwin; and

WHEREAS, Daniel Irwin subsequently assigned his interest to Thank You Enterprises LLC, a

limited liability company under the laws of Minnesota; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL THAT: 1. The Dundas City Council authorizes the City of Dundas to enter into the transaction for

the sale of the Property to Thank You Enterprises, LLC subject to the terms and conditions of a Commercial Real Estate Purchase Agreement dated November 23, 2020, and as amended by Agreements dated January 4, 2021 and January 25, 2021.

TO: Mayor and City Council FROM: Jenelle Teppen, City Administrator SUBJECT: Consider Draft RFP for Playground Equipment Replacement at Memorial Park DATE: For the City Council Meeting of January 25, 2021 PURPOSE/ACTION REQUESTED Consider a draft RFP for replacement of the playground equipment at Memorial Park. SUMMARY The City has planned to replace the dated and worn playground equipment at Memorial Park in anticipation of the Dundas Dukes hosting the State Tournament in 2022. $53,000 has been identified in the budget for the expense. The Parks and Recreation Advisory Board (PRAB) has reviewed and approved of the drat RFP and recommends that the City Council approve of it. Proposals are due by Friday, March 5 and will be reviewed by the PRAB at their March 9 meeting. The PRAB will forward their recommendation on to the City Council after their review. RECOMMENDATION Staff recommends that the Council approve the attached draft RFP for replacement of the playground equipment at Memorial Park.

REQUEST FOR PROPOSAL MEMORIAL PARK Dundas, MN 55019 FEBRUARY 2021

I. GENERAL INFORMATION A. OBJECTIVE

The purpose of this Request for Proposal is to obtain site plan design to include the purchase of playground equipment, swing set(s) and installation for the playground site at Memorial Park, South 1st Street (200 block). (see attached location map)

B. ISSUING OFFICE The Request for Proposal is issued by the City of Dundas. All correspondence regarding

the Proposal should be addressed to: Jenelle Teppen, City Administrator, PO Box 70 Dundas, MN 55019, 507.645.2852 or [email protected].

C. CONTRACT ADMINISTRATOR All communications concerning the contract should be directed to Jenelle Teppen, City

Administrator, 507.645.2852. D. INCURRING COSTS The City of Dundas is not liable for any cost incurred by the prospective firms prior to the

signing of the contract. E. PROPOSAL To be considered, each firm must submit a complete response to this Request for

Proposal, using the specifications provided in Section II. The proposal must be signed in ink by an official authorized to bind the submitter to its provisions. The proposal must include a statement as to the period during which the bid remains valid. This period must be at least ninety days from the due date for this proposal.

F. ACCEPTANCE OF THE BID CONTENT The contents of this proposal will become contractual obligations if a contract ensues.

Failure of the selected consultant to accept these obligations may result in cancellation of the award.

G. SELECTION CRITERIA Responses to this Request for Proposal will be evaluated based on a staff selection

process. City Staff will review the firm’s response to the Request for Proposal, including either a model of the proposed project, a graphic artist’s rendition of the project or a computerized drawing of the proposed project and determine if the proposal meets all specifications and criteria for consideration, and will award the contract. If necessary, an interview/informational meeting may be requested by staff.

The accompanying table shows a matrix or “point system” which was developed for the Memorial Park Playground. A numerically weighted “decision matrix” will apply mathematical computation to a qualitative analysis and decision-making process. The matrix assigns relative levels of importance to eight different factors in the three categories of aesthetics, durability and play value. During the evaluation-selection process, City staff will use the score sheet to rate the competing bidders and their equipment. Each of the eight factors will be given a score of 1 to 10. A higher number represents a better score. Within each of the three categories, an average for the particular category will be computed. Each of the three categories has been assigned a

particular weight as shown in the matrix. The aesthetics category has been assigned a weight of 25%, the durability category has been assigned a weight of 35% and the play value category has been assigned a weight of 40%. The weighted average of the three categories will then be determined. Those proposals scoring above eight (8) pursuant to the weighted average will then be further considered based on cost. The City will use the following criteria to determine award of the contract:

a) Proposals not meeting specifications will be rejected. b) Proposals above $53,000 will be rejected. c) Proposals not scoring eight (8) or more as a weighted average on the scoring

matrix will be rejected. d) With respect to proposals that score eight (8) or more on the weighted average

matrix and that have not been otherwise rejected, the City will make the award to the responsible proposer that has proposed the lowest cost.

H. PROPOSAL RECEIPT Proposals must arrive at the City of Dundas, PO Box 70, Dundas, MN 55019 on/or before

3pm on March 5, 2021. Attention to: Jenelle Teppen, City Administrator. I. RIGHT TO REJECT PROPOSAL The City of Dundas reserves the right to award the total proposal, to reject any and all

proposals in whole or in part, and to waive any informality or technical defects, in the City’s judgment.

J. COST LIABILITY The City assumes no responsibility or liability for costs incurred by the firms prior to the

signing of this contract. Total liability of the City of Dundas is limited to the terms and conditions of this agreement.

K. OWNER The City of Dundas is designated as Owner. All work shall be on public property. The

Contractor shall confine his/her operation, at all times staying within the limits of the property. Any repairs or restorations required outside the property limits due to the Contractor’s carelessness shall be repaired by the Contractor at their expense. All spoil/excess material shall be hauled away by contractor. The City of Dundas will seed and restore areas outside container.

L. AWARD OF CONTRACT The City of Dundas will award one contract for this entire project to the responsible

vendor submitting the Bid meeting all performance and required criteria as set forth by this set of contract documents, plans and specifications.

M. TAXES The Contractor shall pay all sales, consumer, use and other taxes required to be paid by

them in accordance with the law of the place where the work is to be performed. N. TEMPORARY ENCLOSURE, BARRICADES AND FENCES The Contractor shall provide and maintain all necessary temporary enclosure and

barricades to adequately protect the work and materials from the elements and persons not involved with construction. The Contractor shall remove all temporary enclosures, barricades and fences upon completion of the work.

O. PROTECTION OF EXISTING FACILITIES The Contractor shall provide for and be responsible for protection of existing pavements,

utilities, fencing, etc. Any existing facilities which are affected by the work shall be repaired and restored to original condition.

P. SHIPMENT OF MATERIALS Before making any shipment of materials to the site, Contractor shall ascertain whether

the site is in a condition to receive the shipment. Where this provision is neglected and material is delivered to the site when the latter is not in condition to receive it, such materials shall be properly stored elsewhere at the Contractor’s expense and adequate insurance coverage provided for off-site storage.

Q. STORAGE OF MATERIALS ON OR OFF-SITE

1. Contractor shall provide storage as required to protect and preserve all materials stored at the site. Materials are not to be stored directly on the ground. Storage of materials is to be confined to areas designated by the City. City will not sign for or be responsible for materials delivered to the site.

2. Equipment which is delivered in advance of the installation week can be stored at the Dundas Public Works Garage. Playground equipment supplier will be responsible for equipment and insurance of equipment stored at the Public Works Garage site. Equipment suppler will also be responsible for the unloading and loading of the equipment at the Public Works Garage. In addition, supplier will be responsible for delivery of the equipment to the installation site and clean up of packaging materials/debris from the loading/staging location.

3. Equipment delivered early will not be paid in full. Supplier is welcome to invoice City for up to 50% of playground structure expense if stored on-site at the Public Works Garage. Payment for final 50% of structures, swings, independent play items, and installation will be paid when installation is complete and approved by Public Works Director.

R. WORKING HOURS Working hours shall be from 7:00 a.m. until 6:00 p.m., Monday through Friday unless

approval has been made with Public Works Director, to work otherwise. S. CLEANUP All work areas shall be returned to a condition equal to or better than was in existence at

the beginning of the project. All construction debris, including excavated soil, shall be removed and disposed of in a manner satisfactory to the City.

II. SPECIFICATIONS A. Structure shall meet and comply with all ADA Legislation (Public Law 101-336) and ASTM

F1487. B. A tot and elementary structure will be required. All equipment must meet age related

design criteria suitable for two to five-year olds (tots), and five to twelve-year olds (elementary), and be IPEMA certified.

C. Play area shall include a one-bay, 8-foot high swing set with at least one infant seat, one

strap seat, and one ADA seat. D. Main structure frame can be single pole center staging area or a multi-vinyl coated deck

system structure with a minimum of one canopy deck. Poles shall be a minimum of 5.0 inches in diameter and made of galvanized steel, for the five to twelve-year olds (elementary) structure and 3.0 inches for two to five-year olds structure (tots), and be capped at the top end.

E. Amenities shall include, but not be limited to plastic slides, climbing walls/units, ladders,

play panels, transfer deck, fire pole, spring riders, etc. F. The site for the play structure is to replace an existing play structure in Memorial Park. G. Site shall have signage information appropriate to the structure area. H. All plastic and coating products must be UV and color stabilized to resist fading. I. Supplier must be able to provide a cleaning solution to remove graffiti markings that may

occur on equipment. J. All metal decks must be manufactured from sheet steel conforming to ASTM specification

A-569 and be finished with a vinyl coating. K. All connecting hardware used must be zinc plated steel, free of protrusions, vandal

resistant and have a tamper proof design. Service kit for tamper proof fasteners must also be provided.

III. PROPOSAL A. PROPOSAL FORMAT The firm will be responsible for submitting a written bid listing each piece of equipment

and cost, delivery and installation, using attached bid form.

B. FEE QUOTATIONS The fee bid of NOT TO EXCEED $53,000 for the project will include all costs associated

with the project, including all equipment, structures, delivery, installation, taxes and service charges. Each firm is requested to provide the maximum amount of play activities for that fee.

C. SUBMITTAL REQUIREMENTS Each of the following items shall be considered an integral part of the Contractor’s

proposal and shall be submitted to the City on or before the date and time as stated on the Proposal Form:

1. One copy of a completed and signed Proposal Form. 2. List of all equipment included in the plans, with quantities. 3. One copy of a play area equipment layout drawing to scale showing layout, safety

zones, accessibility, border and outside dimensions. Each firm is responsible to design a plan that follows the equipment list enclosed.

4. One bound notebook or plan size sheet of all components and features specific to the project.

5. One complete copy of all warranty information. 6. The contractor shall indicate all deviations from the specifications. 7. Provide a letter from the manufacturer or an independent consulting firm stating all

equipment meets the current ASTM F1487 standards, and ADA Standards. 8. Installation of play structures, and swing set(s) must be completed by paid

professional staff. Any deviation from the use of paid professional installers must be approved by the City Administrator.

9. Documentation that all equipment proposed is covered by product liability insurance.

D. SITE REVIEW Consultants submitting bids are welcome to visit the site and should contact Duane

Meliza, Public Works Director at 507.645.5082 for directions or questions. E. REGULATORY COMPLIANCE 1. All equipment provided and all areas around and between equipment must comply

with most current Consumer Product Safety Commission (CPSC) guidelines and The American Society for Testing and Materials (ASTM) standards. It is the responsibility of each bidder and manufacturer to be aware of these guidelines. As recommended by CPSC, a project specific maintenance manual shall be provided at the end of the project.

2. Playground structure, independent play items and swing set(s) must meet the current requirements of the Americans with Disabilities Act (Public Law 101-336) and ASTM F1487.

3. All equipment must be IPEMA certified. 4. Once installation is complete on all equipment, supplier must provide a formal

safety audit of the installed equipment. Audit must document that equipment meets all current standards listed above. Final one-half payment for structure and installation will not be processed until after the safety audit inspection and document is completed and delivered from a certified playground inspector.

5. Supplier must invoice City for all payments. F. PROJECT PHASING The City of Dundas is challenging various playground manufacturers to use their

professional expertise and creativity to develop a unique playground at Memorial Park.

G. TIMETABLE 1. Proposal submittal deadline – Friday, March 5, 2021 on or before 3pm. 2. Review by staff by end of third week of March. 3. Notification of contract award by the end of April. 4. Delivery and Installation of playground late Spring/early Summer 5. Installation of playground structure at Memorial Park must be completed by

Public Works Staff Meeting / City Engineer Update 1/21/21

January 20, 2021

Agenda

The City Administrator, Public Works Director, and City Engineer meet at least monthly to plan

and review projects and tasks, and to discuss public works matters of all types. The agendas used

for the most recent Public Works staff meeting forms the basis for the updates that have been

provided to the City Council. Following is the most recent Public Works staff meeting agenda

with notes added.

1. 2019 Storm Pond Maintenance

• Two-year warranty inspection in 2021.

2. 2021 Street Maintenance

• $75,000 budgeted for Road Maintenance (which includes annual road repairs,

patching, crack filling, seal coat, etc.) in 2021.

• Bridge Street/2nd Street repairs will take place in the spring of 2021.

• Staff will solicit quotes to complete an edge mill and full width overlay of Hester

Street, from CSAH 78 to Depot Street for completion in 2021.

• Quotes will be obtained for Hester Street and the Bridge Street/2nd repairs before

the other work.

3. 2021 Sidewalk/Trail Improvements

• $121,900 capital expenditure budgeted in 2021.

• Candidate work areas include:

o ECRT North-south connection along 1st Street North. Likely on west side,

contact property owner about any tree impacts.

o Ped ramps on Bluff Lane at Miller Lane and Granite Way

o Possible trail along the east side of Cannon Road, north of the dome

driveway for school walkers. Low priority, connectivity in Northfield needs

to be reviewed.

o Striping a crossing of Hester Street at 1st Avenue will be pursued with Rice

County.

4. 2023 Street Lighting

• On Railway Street down to West Avenue; the west bridge terminus; and east of the

bridge. Includes lights at each end of the pedestrian bridge over the Cannon

River.

• $120,000 capital levy over three years, 2021-2023, construction will occur in 2023.

Some of the lighting materials may be purchased in advance to avoid price

increases.

5. Bridgewater Township

• Cost sharing for the guardrail repairs on 115th Street has been paid; construction

cost was split 50/50.

• Additional aggregate placement on 115th will occur in the spring of 2021.

6. Cannon Road

• Two-year warranty inspection in 2021.

• Minor modifications to the catch basin near the Dundas Dome driveway may be

made. To be combined with other minor storm sewer work and contracted.

7. City Hall

• 1/25/21 City Council consideration of Procon Pay Voucher 11 (final) and Change

Order No. 4 for the building.

• Parking lot lighting work was approved by the City Council at the 10/12/20

meeting and the light bases have been installed.

• 1/12/21 light poles and heads have been ordered from TSR Lighting and Border

States Electric (BSE).

• 10/12/22 Two Year Maintenance Bond expires on the site work.

8. Comprehensive Plan Update

• The Comprehensive Plan was approved, with minor changes, at the 7/27/20 City

Council meeting. The final document is being prepared by NAC.

• Transportation planning: 115th Street, Decker Avenue A conceptual alignment will

be developed for 115th Street west of Highland Parkway to improve safety long-

term, sight distance at Highland Parkway will be reviewed.

9. CSAH 1/TH 3 Pedestrian Crossing

• Crossing of CSAH 1 connecting the existing trail near the PRV to the sidewalk on

Stafford Road North. The estimated project cost is $137,000 including Accessible

Pedestrian Signals at all corners.

• WSB is proceeding with a more detailed concept development to include concepts

for the pedestrian connections west along CSAH 1 as well; as requested by Rice

County on 11/24/20.

• Frandsen Bank has been contacted about coordination of connections from their

property.

• A portion of the $121,900 capital expenditure budgeted for Sidewalk/Trail in

2021 will be to further design of these crossing concepts.

10. Forest Avenue

• Extensive pavement repair has been included in the CIP for 2022 construction.

• 12/30/20 soil borings were authorized to determine the scope of the repairs; the

estimated cost for the borings and report is $3,200.

• Repairs will likely include installation of a drain tile to drain the pavement

subgrade.

11. Hester Street/TH 3 Intersection

• Consideration of a permanent signal to be identified in MnDOT’s long term

planning.

12. Hester Street Storm Sewer

• On the south side of Hester Street between the Menards and City ponds; the storm

sewer outlet from 3rd Street may be extended, and the pond side slopes flattened in

this area. To be combined with other minor storm sewer work and contracted.

• The City appears to have no drainage and utility easement on the Menards pond.

13. Memorial Park

• 12/16/20 a meeting was held with Mike Ludwig of the Dundas Dukes to review the

process for requesting a permit from the MnDNR to construct a berm around the

stadium and the necessary river flow modeling efforts.

• Based on 11/24/20 meeting with MnDNR floodplain staff; WSB is modeling the

incorporation of berm protection for the stadium area while trying to achieve a “no

rise” condition for the floodplain. This means that there is a rise of less than 0.009’

in the 100-year floodplain elevation. It will be very challenging to achieve a no rise

in this location. Estimated engineering costs for modeling a no rise is $7,000.

• A berm alignment option that encroaches about 6’ onto the warning track in

right field may improve the modeling results; this potential has been brought up

previously with the Dukes, WSB will notify Mike L. that this option is being

considered.

• Play structure to be evaluated for repair/replacement in 2021; RFP has been

drafted; $53,000 capital expenditure budgeted. Potential berm alignment will be

reviewed for impact on the play area.

• Schedule for paving the entry in early 2022; $106,000 capital expenditure budgeted

in 2021 for berm, trail, entrance work.

• Dukes are hosting the State Baseball Tournament in 2022.

14. Mill Town Trail Head

• The estimated cost for full plan development and details is about $7,000.

• WSB is preparing 50% plans and expects to have them ready by the end of January

2021. When available, the 50% plans will be routed to the sculpture area group

to update them on progress.

• The sculpture will be re-set then cleaned in the spring of 2021.

15. Northfield Wastewater Treatment

• Public Works staff will be investigating the new sanitary sewer pressure mains.

• Recent City test results have not shown high BOD or TSS levels.

• The City will provide WSB with invoices from Northfield and testing results for

2020 such that future flow capacity assumptions can be reviewed.

16. Public Works Future Tasks

• In early 2021, the City’s Snowplowing and Ice Control Policy will be reviewed

with the Public Works Committee then the City Council.

• The Rice County Engineer would like to meet with the City Council to discuss

transportation planning sometime in the first quarter of 2021.

• 12/28/20 ROW Permit 2020-09 issued to Metro Fibernet for a fiber optic extension

into Memorial Park.

• PW staff has discussed timeline and equipment specifications for ordering a new

truck for snow plowing and hauling; there is a very long lead time. The total cost is

expected to be about $240,000 before any taxes/fees; this amount is consistent with

budgeting assumptions. The process will be reviewed with the Public Works

Committee.

• A letter has been sent to property owners adjacent to the Stoneridge Hill, Millstone,

and Schilling Park storm ponds reminding them to not place yard waste on City

property. PW staff will install small permanent signs in the spring of 2021 at the

drainage easement/City property limits for future reference. WSB will provide

surveying as needed.

• NE corner of Hester Street W. and Depot Street N.- consider options for storm

sewer structure at east side of culvert under Depot Street. The culvert on the SE

corner of Schilling Drive N. and CSAH 1 will also be reviewed. To be combined

with other minor storm sewer work and contracted.

• Review the code/policy for frozen water services and the basis for reduced charges

when the property owner is encouraged to let the water run.

• Review the code section support for public vs. private service repairs.

• Standard specifications and detail plates.

• Review storm water code, including sump pump connections requirements. The

goal is to simplify the process of determining and administering the fees in an

equitable manner.

• Update record drawings requirement for projects.

• City staff met with the water meter supplier again on 10/22/20 to discuss additional

technical and cost information regarding citywide water meter replacement and

software updates; information is under review.

• A requirement for as-built lot surveys for new houses prior to release of escrows

will be considered.

• A DataLink update meeting will be held in early 2021.

• A pavement management document will be prepared based on past actions and

bituminous pavement conditions.

• WSB will set up a spreadsheet and file for tracking Letters of Credit for new

developments.

17. Regional Storm Water and Wetland

• A study will be needed to quantify the treatment capacity and service area for the

pond located between Hester Street and CSAH 1, east of 3rd Street North.

• This is the next storm water pond cleaning project; mostly clearing volunteer trees

etc. around the edge. The focus for 2021 work at the regional pond will be

clearing trees/brush and removing sediment.

18. Stafford Road

• Two-year warranty inspection in 2021.

19. UPRR/Hester Street sidewalk crossing

• Retaining wall relocation (to reduce right of way encroachment) at 236 Railway

Street to be completed under a separate contract. Project activity is limited to

coordination with UPRR and cost estimating.

20. Water Supply Plan

• Implementation deadlines to be checked quarterly.

21. Water Towers

• Suez agreement to be reviewed/reconsidered but will likely be continued based on

the City’s recent experience.

• At the east tank; some interior repairs may be needed in 2021.

22. Wellhead Protection Plan (WHP)

• MDH has approved Part 2 of the City’s Wellhead Protection Plan.

23. Xcel Energy Feeder Line R/W permit

• Additional turf restoration work is needed.

24. 208 County Road 1 West

• 9/28/20 the City Council approved a CUP for a Day Care Center.

25. A&J Storage

• The owner has been contacted about containing snow storage to their own property.

26. AT&T East tower antenna modification

• 8/24/20 AT&T’s proposed 4th Amendment to the antenna lease was approved by

the City Council.

• 12/3/20 AT&T submitted revised construction drawings for review; on 12/10/20

review comments were provided to AT&T.

27. Bridgewater Heights PUD

• A final punch list for the project will be prepared in 2021.

• 12/8/20 letter sent to 1109 and 1111 Bluff Street making them aware of the water

main easement along their property line.

• Drain tile has been installed by the City along the park slope adjacent to 115th

Street to help stabilize the soils.

28. Bridgewater Heights Area East of Highland Parkway

• 9/17/20 an updated concept for development of lots east of Highland Parkway.

was considered by the Planning Commission.

• A preliminary plat submittal is expected by 1/22/21 for the February Planning

Commission meeting.

29. Cannon River Valley Estates

• Punch list to be prepared after all work has been completed.

• The developer is working on an updated schedule for completion in 2021.

30. Dundas Dome Site

• A request for an extension of the completion date for parking lot work was

approved by the City Council on 10/12/20.

31. Johnson-Reiland Commercial

• Grading/Fill Permit applications were received for 616 Highway 3 S. and 399

Stafford Road N.

• 1/5/21 pre- and post-development drainage calculations received for 399 Stafford

Road N.

32. Menards Gate Expansion

• 5/11/20 the City Council approved a Planned Unit Development Amendment, a

Site and Building plan, and a lot line adjustment for this project. Site alterations

have not yet started.

33. West Avenue Apartments

• 6/8/20 the City Council approved the Comprehensive Plan Amendment,

Preliminary and Final Plat; the PUD Preliminary and Final Plan; Building and Site

Plan; a Planned Unit Overlay District; and the Development Agreement.

• 8/4/20 the developer signed the Development Agreement and the storm water

agreement.

• 12/15/20 substantial tree removal on site has been completed, and many stumps

remain.
