Regulations. 2015
Introduction: In order to promote development of roof top and small solar photovoltaic systems
in the state, Hon'ble BERC has framed BERC (Rooftop Solar Grid Interactive Systems based on
Net Metering) Regulations, 2015 and notified vide Gazette Notification No. 737 dated
07 .07.2015. These regulations permit consumers to install roof top and small solar photovoltaic
systems in his premises with the provision of net metering arrangement under which the
electricity generated by the roof top and small solar photovoltaic systems owned by the
consumer and delivered to the distribution licensee shall be utilized to offset the electricity
supplied by the distribution licensee to the consumer during the applicable billing'period and
adjustment/accounting of extra generation during the "settlement period" as per provisions in the
Regulations.
In order to implement the above Regulations and to avail the above facility, the Board of
Directors of the Company in its 73'd meeting held on 11.12.2017 vide Resolution no.73'12
passed the following resolution for procedure prescribed for the field officers and accordingly
approval for the installation of roof top and small solar photovoltaic systems with net metering
arrangement to the willing consumers shall be accorded.

l '2' Words and expressions used in these Guidelines and not defined herein but defined inthe Electricity Act, 2003 (hereinafter referred to as 'the Act'), as amended from time totime, and in the BERC (Rooftop Solar Grid Interactive Systems based on Net Metering)Regulations,2015 shall have the meaning as assigned to them under the Act andRegulations.
2. Definitions and Interpretations
2.l. rn these regulations, unress the context otherwise requires,
a) "Accuracy Class Index" shall mean the index as specified in Central ElectricityAuthority (lnstallation & operation of Meters) Regulations 2,006 and subsequentamendments thereof;
b) "Act" means the Electricity Act, 2003 (36of 2003) and subsequent amendments thereof;c) "Billing Cycle" or "Billing period" means the period for which electricity bills as
specified in the Bihar Electricity Supply Code, 2007 asamended from time to time, shallbe prepared for different categories of consumers by the Licensee.
d) "Commission" means the Bihar Electricity Regulatory Commission constituted under theAct;
e) "Consumer" means any person who is supplied with electricity for his own use by aLicensee or the Government or by any other person engaged in the business of supplyingelectricity to the public under the Act or any other law for the time being in force and
includes any person whose premises are, for the time being, connected for the purpose ofreceiving electricity with the works of a Distribution Licensee, the Government or such
other person, as the case may be;
0 "Contracted Load" or "Contract demand" means the maximum demand in kW, kVA orBHP, agreed to be supplied by the licensee and indicated in the agreement executed
between the licensee and the consumer;
g) "Distribution Licensee" or "Licensee" means a person granted a license under Section
l4 of the Act authorizing him to operate and maintain a distribution system for supplying
electricity to the consumers in his area of supply;

i) 'Eligible consumer' nleans a consurner ol'r-'lectricitl, in the area of supply,of the

j) "Financial Year" or "Year" means the period beginning from first of April in an English
calendar year and ending with the thirty first of the March of the next year;
k) "Inter-Connection Agreement" means the agreement entered into for connecting
rooftop Solar PV system to the distribution system;
l) "Interconnection Point" means the interface point of the Solar PV power generation
facility with the distribution system of the Licensee. The interface point shall be the
appropriate meter as per CEA (lnstallation and Operation of Meters), Regulations, 2006
and subsequent amendments thereof, installed at consumer's premises or distribution
substation;
m) "Invoice" means either a Monthly Bill / Supplementary Bill or a Monthly Invoice/
Supplementary Invoice raiserJ by the Distribution Licenseeo'k\ilp" means kilo Watt peak;
"Net metering" means an alTangement for measurement of energy in a system under
which rooftop solar PV system installed at eligible consumer premises delivers surplus
electricity, if any, to the Distribution Licensee after off-setting the electricity supplied by
Distribution Licensee during the applicabfe billing period.
"Net Meter" means an appropriate energy meter capable of recording both import and
export of electricity or a pair of meters one each for recording the import and export ofelectricity as the case may be; which shall be an integral part of the net metering system;
"Obligated entity" means the entity mandated under clause (e) of subsection (l) ofsection 86 of the Act to fulfil the renewable purchase obligation and identified under
BERC (RPO its Compliance and REC Framework Implementation) Regulations, 2010
and subsequent amendments thereof;
"Premises" means rooftops or/and elevated areas on the land, building or infrastructure
or part or combination thereof in respect of which a separate meter or metering
arangements have been made by the Licensee for supply of electricity;

"Renenable Energy Certificate (REC)" means thc ccrtillcate issued in accordance rvith
the procedures approved by the Central Electricity Regtrlatory Commission;
"Solar Meter" means a unidirectional energy meter installed as an integral part of the net
metering system , at the point at which the electricity generated by solar energy system is
delivered to the main panel of the eligible consumer;
o'settlernent Period" means the period beginning from first of April in an English
calendar year and ending with the thirty first of the March of the next year;
"Tariff Order" in respect of a Licensee means the most recent order issued by the
Commission for that Licensee indicating the rates to be charged by the Licensee from
various categories of consumers for supply of electrical energy and services and its
validity has not expired;
All other words and expressions used in these Regulations although not specifically
defined herein above, but defined in the Act, shall have the meaning assigned to them in
the Act. The other words and expressions used herein but not specifically defined in the
Regulations or in the Act but defined under any law passed by the Parliament applicable
to the electricity industry in the State shall have the meaning assigned to them in such
law.
3. Scope and Application:
3.1. The eligible consumers of electricity in the area of supply of the distribution licensee can
participate in the solar rooftop net metering arrangement in pursuant to BERC (Rooftop
Solar Grid Interactive Systems based on Net Metering) Regulations, 2015 as notified by
Hon'ble Commission on 7'h July,2015.
3.2. The manimum rooftop solar system capacity to be installed at any eligible consumer
premises shall be governed by the eligibility of interconnection with the grid for that
eligible consumer. The maximum capacity of an individual rooftop PV system would be
equal to the sanctioned load of the consumer subject to minimum capacity of I KWp.

4. Procedure for application:
For LT Consumer:
4.1. The Eligible Consumer who proposes to install a solar energy system in his premises
shall submit application to the Revenue collection counter in the office of the AEE,
Electric Supply Sub-division in the prescribed Application form (Annexure -ll), which
can be downloaded from the website of DISTRIBUTION LICENSEE/BSPHCL or
which can be obtained from the concerned Electric Supply Sub-division/Division office
of DISTRIBUTION LICENSEE and deposit the same in concerned Subdivision office
along with the application fee as specified in (Annexure -VIII). The eligible consumer
who intends to install grid connected rooftop solar system, in the supply area ofdistribution licensee shall be treated on first come first serve basis. The priority for such
application shall be maintained at Subdivision office for which a separate register shall
be maintained.
Within Seven (7) working days of receipt of Eligible Consumer's application, Assistant
Electrical Engineer of concerned Electric Supply Subdivision shall perform general
screening and register the application with an acknowledgement (Attached in
Application Form) to the applicant that it has received all documents required as per the
standard interconnection agreement and requisite application fee.
Feasibility for the connection of roof top shall be done by Assistant Electrical Engineer
of concerned Electric Supply Subdivision within fifteen (15) working days from the
receipt of completed application.
The. Applicant at his liberty to select a reputed system, installer, to gather technical
information of RTSPV system and furnish the technical details of PV modules, lnverters
and other equipments of the RTSPV system.
lf any discrepancies in application form or during inspection of premises is found then
AEE, Supply will inform in writing to the applicant within next seven (7) days.

4.7. -l'lru'sanction order should contain supervision chargc. securily deposit amount and meter
installation charge to be deposited by the eli-tible consumer as deflned under Arrnexure
VIII. The applicant will deposit the charges within seven working days of sanction order.
4.8. The applicant will execute an inter connection agreement with the concerned AEE,
Electric Supply Sub-division.
4.9. The applicant will provide declaration regarding work completion of installation of Solar
. Photovoltaic Roof Top Power Ptant with document of solar modules having ISI mark.
After receipt of declaration towards work completion from applicant, testing,
commissioning and synchronization of RTSPV system along with metering arrangement
for net metering connection will be done under supervision of concerned AEE/JEE,
Electric Supply Division within next seven (7) working days.The meters will be tested at
MRT test lab.
4.10. AEE, Electric Supply Sub-division will send service connection report to the billing
office within 7 days.
For HT Consumer:-
4.1l. The Eligible Consumer who proposes to install a solar energy system in his premises
shall submit application to the Revenue collection counter in the office of the AEE,

can be downloaded from the website of DISTRIBUTION LICENSEE/BSPHCL or
which can be obtained from the concerned Electric Supply Sub-division/Division offtce
of DISTRIBUTION LICENSEE and deposit the same in concemed Subdivision offrce
along with the application fee as specified in (Annexure -VI[j. The eligible consumer
who intends to install grid connected rooftop solar systemo in the supply area of
distribution licensee shall be treated on first come first serve basis. The priority for such
application shall be maintained at Subdivision offrce for which a separate register shall
be maintained.
4.12. Within Seven (7) working days of receipt of Eligible Consumer's application, Assistant
Electrical Engineer of concerned Electric Supply Subdivision shall perform general

4.13. Feasibility tbr the connection of roof top shall be done b5, AEE Supply, AEE/EEE. MRT
rvithin flfteen (15) u,orking days from the receipt of completed application which will be
approved by EEE Supply. In case of 33 KV and above consumer EEE/ESD will do
inspection for the feasibility and it will be approved by ESE.
4.14. The applicant will have liberty to select a reputed system, installer, to gather technical
information of RTSPV system and furnish the technical details of PV modules, Inverters
and other equipments of the RTSPV system..
4.15. If any discrepancies in application form or during inspection of premises is found then
EEE, Supply will inform in writing to the applicant within next 7 working days.
4.16. If connection feasibility report is satisfactory and no further documents are required then
concerned EEE, Supply (in case of I I KV consumers/ESE, Supply (in case of 33 KVconsumers) will sanction/give approval of the proposal of the rooftop solar system
within 7 working days.
4.17. The sanction order should contain supervision charge, security deposit amount and meter
installation charge to be deposited by the eligible consumer as defined under Annexure
VIII. The applicant will deposit the charges within seven working days of sanction order.
4.18. The applicant will execute an inter connection agreement with the concerned EEE,
Supply (in case of I I KV consumer/ESE, Supply (in case of 33 KV consumer).
4.19. The applicant will provide declaration regarding work completion of installation of Solar
Photovoltaic Roof Top Power Plant with document of solar modules having ISI mark.
After receipt of declaration towards work completion from applicant, testing,
commissioning and synchronization of RTSPV system along with metering arrangement
for net metering connection will be done by concernedEEE/AEE, MRT Electric Supply
Division within next 7 working days after submission of clearance for Electrical
Inspection by the applicant consumer.
4.20. AEE, Electric Supply Sub-division will send service connection report to the billingoffice within 7 days.
5. Other Conditions:

i. Provided further that the Consumer is eligible to install the Grid connected
Rooftop PV Solar power Plants of the rated Capacity as specified in para 3.
. ii. Provided also that the interconnection of such system with the grid is undertaken
as specified as above ahd in compliance of Central Electricity Authority
(Technical Standard for Connectivity of the Distributed Generation Resources)
Regulation, 2013.
iii. In case the applicant consumer does not install the rooftop solar system as per
approval given within 90 days of its approval, the application will be cancelled.
He will have to apply afresh application if he so desires.
6. Capacity Targets for Distribution Licensee:
6.1. The DISTRIBUTION LICENSEE shall provide net metering arrangement to eligible
consumers as long as the total capacity ln MW)dOeS nOt exceed the target capacity
determined by the Commission;
Provided a maxirnum cumulative capacity of 10MW shaH be anowed to eligible
consumers under net metering, on yearly basis, in the area of supply of the
DISTRIBUTION LICENSEE or as per the BERC(Rooftop solar Grid lnteractive
Systems Based on Net¨ Metering)Regulations,2015 and its amendment notined by the
Commission from time to time;
PЮvided that the cumulative capacity to be a1lowed at a particular distribution
transfollller shan not exceed 150/O of the capacity of the distribution transforlner;as per
the BERC(Roo■op solar Grid lnteractive Systems Based on Net… MeterinD Regulations,
2015 and its amendment notifled by the Commission from time to time.
The DISTRIBUTION LICENSEE shall update distribution transfoニ ュller level capacity
available for connecting rooftOp solar systems under net metering arrangement on yearly
basis and shall provide the infomation on its website as well as to the Commission.

Interactive Systems Based on Net-Metering) Regulations.20l5 and in the follorving
Regulations and codes as amended from time to time:
i. Central Electricity Authority (Technical Standards for connectivity of the
D i stributed Generatin g Resources) Regu lation, 20 I 3.
ii. Central Electricity Authority (lnstallation and Operation of Meters) Regulation,
2006.
iii. Central Electricity Authority(Measures related to Safety and Electric Supply)
Regulations,20l0
7.2. The equipments of Solar PV Roof top shall be pre tested by the supplier and a test
Certificate for the concemed equipment shall be provided to the consumer and shall be
furnished to DISTRIBUTION LICENSEE after receipt of connection feasibility Report
from the DISTRIBUTION LICENSEE office. The consumer shall get the equipment
installed at his/her premises by representative of the supplier to confirm satisfactory
working.
8. Interconnection with the Grid
8.1. The interconnection of the rooftop solar system with the network of the DISTRIBUTION
LICENSEE shall conform to the technical specifications, standards and provisions as
provided in the Central Electricity Authority (technical Standards for connectivity of the
Distributed Generation resources) Regulations, 2Ol3 & Central Electricity
Authority(Measures related to Safety and Electric Supply) Regulations, 2010 as amended
from time to time.
8.2. The Net'meter and solar meter installed should conform to the standards, specifications
and accuracy class as provided in the Central Electricity Authority (Installation and
operation of Meters) Regulations, 2006, as amended from time to time and are installed
in such a way that they are accessible for reading.

The connectivity level at which the rooftop PV Solar Power Plant shall be connected with
the Grid are as specified below or it may be decided to give connection as per level
specified in Electricity Supply Code.:
8.4.

8.5.
8.6.
The Solar power producer shall be responsible for safe operation, maintenance and
rectification of any defect of the solar Energy System up to the point of Net Meter
beyond which the responsibility of safe operation & maintenance shall rest with the
DISTRIBUTION LICENSEE.
The consumer shall be solely responsible for any accident to human being/ animals
whatsoever (fatal/non-fatal/ departmental/non-departmental) that may occur due to back
feeding from the Solar Power generator plant when the Grid supply is off. The
distribution licensee reseryes the right to disconnect the consumer's installation at any
time to the event of such exigencies to prevent accident or damage to man and material.
In case of any accident, which can be attributable solely or partly to the act of
negligence of consumer, the consumer shall be liable to compensate the damages
incurred in terms of compensation if any to be paid to deceased/victims and to the
Distribution licensee as decided by any CGRF/court/state Govt./ other statutory
bodies . The consumer will ensure the proper functioning of islanding system of
solar modules 24*7 for the entire period of its operation and its connecting to
licensee system through net metering.
The DISTRIBUTION LICENSEE reserves the right to disoonnect the Solar Energy
System atany time in the following condition:

iii. Hazardous condition existing on the DISTRIBUTION LICENSEE sysrem due to
Operation of Solar Energy Generator or protective equipment as determined by
the DISTRIBUTION LICENSEE / BSPTCL / SLDC / etc. .
iv. Adverse Electrical Effects such as power quality problems on the electrical
equipment of the other consumer of DISTRIBUTION LICENSEE caused by the
solar energy generator as determined by the DISTRIBUTION LICENSEE.
8.8. The DISTRIBUTION LICENSEE will have the liberty to conduct test on the RTSPV and
its associated systems as per relative standard & as per DISTRIBUTION LICENSEE
standard to ensure the quality of power generated from the solar PV system.
8.9. Any alternate source of supply shall be restricted to the consumer network and THE
consumer shall be responsible to take adequate safety measures to prevent battery power/
diesel generator power/ backup power extending to DISTRIBUTION LICENSEE LT
Grid on failure of Grid supply.
8.10. The rooftop PV Solar power plant should be capable of detecting an unintended islanding
condition. These systems must have anti - islanding protection to prevent any
unfavourable conditions including failure ofsupply. IEC- 62116 shall be followed to test
islanding prevention measure for Grid connected PV Inverters.
8.1l. Every Rooftop PV Solar Power Plant shall be equipped with automatic synchronization
device either with separate device or the same is inherently built into the inverter.
8.12. The Rooftop PV solar power plant operating in parallel with the electricity system shall
be equipped with the following protective functio4 to sense abnormal conditions on
electricity system and cause the rooftop PV Solar Power plant to be automatically
disconnected from the electricity system inappropriately:
i. Over and under voltage trip functions if voltage reaches above ll0% or below 807o
of normal connected voltage respectively with a clearing time up to two second,
however DISTRIBUTION LICENSEE may prescribe a narrow range of Voltage for
the purpose.

connected in case of an1' fault in this circuit.
iii. A voltage and frequency sensing and time delay function to prevent the Rooftop PV
Solar Power Plant from energizing a de- energized circuit and to prevent the
Rooftop PV Solar Power plant from reconnecting with electricity system unless
voltage and frequency is within the prescribed limits and are stable for at least Sixty
second; and
iv. A function to prevent the Rooftop PV Solar Power Plant from contributing to the
formation of an unintended island, and cease to energize the electricity system
within TWO seconds of the formation of an unintended island.
8.13. The equipment of the Rooftop PV Solar Power shall meet following requirements,
namely:
i. Circuit Breakers or other interrupting equipments shall be suitable for their
intended application with the capability of interrupting the maximum available
fault current expected at their location.
ii. . The Rooftop PV Solar Power Plant and associated equipment shall be designed so
that the failure of any single device or component shall not potentially compromise
the safety and reliability of the electricity system.
iii. Paralleling device of the Rooftop PV Solar Power Plant shall be capable of
withstanding22O% of the normal voltage at the interconnection point.
8.14. Every time the Rooftop PV Solar Power Plant of the Eligible Consumer is Synchronized
to the Electricity System, it shall not Cause Voltage fluctuation greater than *5%o at the
point of inter connection.
8.15. Prior to synchronization of the Rooftop PV Solar Power Plant for the first time with
electricity system, the applicant and the appropriate licensee shall agree.on the protection
features and control diagrams.
8.16. The power conditioning unit shall have the features of filtering out harmonics and other
distortions before injecting the energy into the system of the DISTRIBUTION
LICENSEE. The technical standards, power quality standards and inverter standards shall

g. Metering Arrangement, Energy, Accounting & Settlement:

9.1. The metering system shall be as per the provisions of CEA (lnstallation & operation ofmeters) Regulations, 2006, CEA (Measures relating to Safety and electricity supply)
Regulations, 2010 and CEA(technical standards for Connectivity of the distributed
generation resources), Regulations,20l3 as amended from time to time and in compliance
with the norrns fixed by BERC/CERC from time to time.
g.2. The DISTRIBUTION LICENSEE shall provide meters as per provision in Bihar
Electricity Supply Code, 2007 as amended from time to time. The Net Meter shall be
installed at the interconnection point of the eligible consume with the network ofDISTRIBUTION LICENSEE.
9.3.

A Separate solar meter shall be installed at the delivery point of the solar energy system
to measure the quantum of solar energy generated by the Eligible Consumer.
Check meters shall be mandatory for rooftop solar systems having capacity more than 20
kW. For installations size of less than and equal to 20 kW, the solar Check meters would
be optional
The cost of meter(s) (Net Meter, Solar Meter, Check Meter), Installatiori / Replacement
(if any) shall be borne by the eligible consumer under the provisions of Bihar Electricity
Supply Code, 2007 and its amendment issued from time to time.
9.6. The Meter shall be tested, installed and sealed in accordance with the provisions of CEA
(Installation and operation of Meters) Regulations, 2006 and provisions under Bihar
Electricity Supply Code, 2007 as amended from time to time. It shall be jointly inspected
and sealed by the licensee on behalf of both the parties. It shall be tested by the licensee
and installed in presence of consumer and the licensee with due acknowledgement.
Provided that the eligible consumer shall follow the metering specifications,.provisions
for placement of meter as developed by the distribution licensee from time to time and as
per the Bihar Electricity Supply Code, 2007 and its amendments issued from time to
time; Provided further that in case the eligible consumer is under the ambit of time of day

Energy Accountinq and Settlerrent:
9.15. For each billing period, the licensee shall show the quantum of injected electricity by
eligible consumer in the billing period, supplied electricity by distribution licensee in the
billing period, net billed electricity for payment by the consumer for that billing period
and net carried over electricity to the next billing period separatery;
Provided that in the event the electricity injected exceeds the electricity supplied
during the billing period, such excess injected electricity shall be carried forward to next
billing period as electricity credit and may be utilized to net electricity injected or
consumed in future billing periods;
Provided further that in the event the electricity supplied by the distribution
licensee during any billing period exceeds the electricity generated by the eligible
consumer's rooftop solar system, the distribution licensee shall raise invoice for the net
electricity consumption after taking into account any electricity credit balance remaining
from previous billing periods; The net energy imported has to be billed by the distribution
licensee as per tariffin force applicable to that category of consumers.
' Provided, in case the eligible customer is under the ambit of time of day tariff, as
determined by the Commission from time to time, the electricity consumption in any time
block (e.g., peak hours, off-peak hours, etc.) shall be first compensated with the
electricity generation in the same time block. Any cumulated excess generation over
consumption in any other time block in a billing cycle shall be accounted as if the excess
generation occurred during the off-peak time block.
Provided also that the excess electricity measured in kilo-watt hour may only be
utilized to offset the consumption measured in kilo-watt hour (kWh) and may not be
utilized to compensate any other fee and charges imposed by the distribution licensee as
per the instructions of Bihar Electricity Regulatory Commission
Provided also that the distribution licensee in addition to consumer tariff shall be
eligible to raise invoice for any other charges as allowed by the Bihar Electricity
Regulatory Commission.

Provided tlrat such injection of the above mcntioned eligible consutner shall be
settled only as per net metering arrangement at the end of each settlernent period;
Provided further that in the event the electricity generated exceeds 90% of the
electricity consumed at the end of the settlement period, no payment shall be made by the
distribution licensee and shall not be carried forward to next settlement period and the
same shall be treated as unwanted/ inadvertent injection. Provided also that at the
beginning of each settlement period, cumulative carried over injected electricity will be
reset to zero.
However, if net electricity injected in the month of March remains unadjusted, it
may be allowed acarry forward for the next billing month.
9.17. lncase of defective net meter/ bi-directional meter, the methodology for average billing
or assessment as described in Bihar Electricity Supply Code, 2007 and its amendment
issued from time to time shall be followed to bill the consumer. During net meter
defective period, the injection to the grid is to be assessed as per available meter reading
records for that corresponding period in previous year or subsequent year (in case meter
becomes defective within one year of its installation).
9.18. In case of any dispute in billing it would be settled by the Consumer Grievance Redressal
Forum (CGRF) and if issue still remains unresolved shall be settled by the Bihar
Electricity Regulatory Commission following appropriate procedure.
9.19. For proper energy accounting and billing records, the energy input at the interconnection
point through the Net Meter by the eligible consumer is to be recorded as power purchase
whereas the quantum of energy supplied by distribution licensee is to be recorded as sale
of electricity to the consumer. Energy accounting record is to be maintained by every
Electric Supply Sections, Every Electric Supply Sub-divisions and every Electric Supply
Divisions, and a column may also be added in statement no. -l for proper record of Net
Metering.

11. Permission from Electrical Inspector:
ll.l. Safety and installation certificates for the installation of Solar PV should be obtained
from the Electrical Inspector, Govt. of Bihar for all HT/LTIS and commercial
Connection. Other LT Domestic consumer will have to produce Green Card from
licensed Electrical Contractor. Regarding installations and wiring following provisions
of clauses and the amendments issued from time to time with regard to Bihar Electricity
Supply Code,2007 is to be adhered:-
"6.1 The work of wiring in the consumer's premises shall be canied out by oLicensed Electrical Contractor and should conform to the Indian ElectricityRules, 1956 until rules/regulation are framed under section 53 of the Act as wellos the rules of the Fire Insurance Company in terms of which the building is
insured. The materials usedfor wiring shall confurm to the relevant specifications
of the Bureau of Indian Standards or its equivalent. V[/herever applicable the
materials used shall bear ISI or IEC mark As soon as the consumer's installation
is completed in all respects and tested by the consumer's contractor, the
consumer should submit, the contractor's test report to the licensee. The test
report form (Annexure-3).fo, this purpose shall be submitted to the local ffice ofthe licensee.
6.2 As required by rule 45 of the Indian Electricity Rules, 1956, no electricalinstallationwork, including addition, alteration, repair and adiustment to existing
installation - except the replacement of lamps, fons, fuses, switches and other
component parts of the installations - which in no way alter the capacity orcharacter of the installation, shall be caruied out in the premises on behalf of any
consumer or owner for the purPose of supply of energt to such consumer orowner, except by an electrical contractor licensed by the State Government in this
behalf and under the direct supervision of a person holding a certiJicate ofcompetency or by a person holding a permit issued or recognized by the State
Government.
6.3 Any person committing breach of rule 45 shall render himself liable to
punishment under rule 139 of the Indian Electricity Rules, 1956.
6.4 Provisions of rule 32 of the Indian Electricity Rules, 1956 should be compliedwith in respect of consumer's installation. No cut-out, link or switch other than a
linlred switch arranged to operate the earthed and live conductors simultoneously,

modify, amend or repeal any provisions of these Regulations.
I 1.5. The Mandatory checks before and after connecting solar roof-top PV power plants is
available at Annexure-VlI.
12. Applicability of Solar Renewable Purchase Obligation & Renewable EnergyCertificates
The quantum of electricity generated by the rooftop solar system of eligible consumer,
who is not defined as obligated entity, from the rooftop solar system under net metering
arangement shall qualify towards compliance of Solar Renewable Purchase Obligation(Solar RPO) for the DISTRIBUTION LICENSEE. The quantum of power generated by
the rooftop solar system will be measured as per the meter reading of the solar meter.
13. Applicability of Other Charges
The rooftop solar system under net metering arrangement, whether self-owned or thirdparty owned installed on eligible consumer premises, shall be exempted from banking
and wheeling charges and cross subsidy surcharge. Eligible consumer availing net
metering facility cannot avail banking facility.
Provided that banking shall be as per the BERC (Terms and conditions for determinationof rarifffor solar energy sources) (3rd amendment) Regulation s,2014.

Regulatory Commission, Both the parties hereby agree to as fbllows :
l. Eligibilityl.l Eligibility for net-metering has been specified in the relevant order of the Bihar
Electricity Regulatory Commission. Eligible Consumer has to meet the standards and
conditions for being integrated into grid/distribution system.
1.2 The maximum capacity of an individual rooftop PV system would be equal to
the sanctioned load of the consumer.
1.3 Consumers having dues of Electricity will not be allowed for Net Metering
Scheme
2. Technical and Interconnection Requirements
2.1 The Eligible Consumer agrees that his solar generation plant and net metering system
will conform to the.standards and requirements specified in BERC( Rooftop Solar
Grid Interactive System Based on Net Metering)Regulations,2015 and in the
following Regulations and codes as amended from time to time.
(i) CEA's (Technical Standards for connectivity of the Distributed Generating
Resource) Regulations, 20 I 3.
(ii) Central Electricity Authority (Installation and Operation of Meters) Regulation
2006.
(iii) Bihar Electricity Supply Code 2007
2.2 Eligible consumer agrees that he has installed or will install, prior to connection of
photovoltaic system to Discom's distribution system, an isolation device (both
automatic and inbuilt within inverter and external manual relays) and agrees for the
Discom to have access to and operation of this, if required and for repair &
maintenance of the distribution system.
2.3 Eligible consumer agrees that in case of a power outage on Discom's system,
photovoltaic system will disconnect/isolate automatically and his plant will not inject
power into Licensee's distribution system.
2.4 All the equipment connected to distribution system shall be compliant with relevant
International (IEEE/IEC) or tndian Standards (BIS) and installation of electrical
equipment must comply with Central Electricity Authority (Measures of Safety and
Electricity Supply) Regulations, 201 0.

2.7 Due to Discorn's obligation to maintain a safe and reliable distribution s)'stem-
Eligible Consumer agrees that if it is determined by the Discom that EligibleConsumer's photovoltaic system either causes damage to and/or produces adverse
effects affecting other consumers or Discom's assets, Eligible Consumer will have todisconnect photovoltaic system immediately from the distribution system upon
direction from the Discom and correct the problem at this own expense prior to areconnection.
2.8 The consumer shall be solely responsible for any accident to human being/animalswhatsoever (fatal/non-fatal/depanmental/non-departmental) that may occur due toback feeding from the SPG plant when the grid supply is off. The distribution
licensee reserves the right to disconnect the consumer's installation at any time to the
event of such exigencies to prevent accident or damage to man and material.
In case of any accident , consumer will be solely responsible for anycompensation if any to be paid to deceased/victims as decided by any court/stateGovt./other statutory bodies . So consumer will ensure the functioning ofislanding system of solar modules 24*7
3. Clearances and Approvals3.1 The Eligible Consumer shall obtain

4.1 Eligible Consumer will generate solar power for self-consumption and feed excess
power into the grid of DISCOM.
4.2[n the premises of Eligible Consumer, a meter will be installed by DISCOM having
the feature of recording both the import and export values, besides complying withother parameters notified in CEA metering regulations and DISCOMs procedures forarriving net energy for the billing period.
Access and Disconnection
5.1 Discom shall have access to metering equipment and disconnecting means of the
solar photovoltaic system, both automatic and manual, at all times.
5.2In emergency or outage situation, where there is no access to the disconnecting
means, both automatic and manual, such as a switch or breaker, Discom may
disconnected service to the premises of the Eligible Consumer.

6.3 Discorn shaH not be liable for delivery or realization by Eligible Consumer for any

6.4 The E)iscorn may consider the quantum of electricity generation from the roo■ op
solar PV system under net metering arrangement towards RPO。 (Applicable only in
case ofEligiЫe Consumer who is not deflned as an Obligated Entity)。
6。5 The proceeds from CDM benents shaH be retained by thel〕 iscom.
7. Commercial Settlement
7.l All the commercial settlement under this agreement shaH follow the Net Metering
Regulations,2015 and its amendments from time to time issued by the BERC.
8. Connection(Costs
8.l The Eligible Consumer shan bear aH costs related to setting up of photovoltaic
systenn including metering and interconnection costs.The Eligible Consumer agrees
to pay the actual cost of modiflcations and upgrade to the service line required to
connect photovoltaic system to the grid in case it is required.
9. Interruption or Reduction of delivery
9。 l The DISCOM shali not be OЫ igated to accept and may require Eligible Consumerto
intelTupt or reduce deliveries when necessary in order to construct, instan, repair,
replace,remove,investigate,or inspect any of its equipment or part of its systern;or
if it reasonably deterrnines that curtailrnent, interruption, or reduction is necessary
because of emergencies, forced outages or compliance with prudent electrical
practiceso Whenever possible, the DISCOM shan give the Eligible Consumer
reasonable notice ofthe possibility that interruption or reduction of deliveries inay be
requlred.
10。 Theft ofelectricity Or unauthorised use ofelectricity
10。 l Eligible Consumer,found indulging in theft of electricity or unauthorized use of
electricity shan pay the pena1/additional charges as may be levied by the E)IS(〕 OMbesides disconnection of supply as per the provisions of IE Act 2003, Bihar
Electricity Supply Code 2007 along with its amendments and General Terrns and
Conditions of supply.

(c) Lighting Arrestor also to be provided for SPV.
(d) Manual isolator switch at an easily accessible location with locking facility shall be
provided.
(e) Caution Stickers shall be used with the green background and the text "Solar PVSystems" written in white letters. The size of these stickers shall be l0 CM (width) X7 CM (height) with the text clearly printed in the centre of the sticker.
(f) All SPV consumers should have a mandatory sign board fitted near the existing meter
reading terminal stating that 'This service is fitted with an LT grid connected SPVplant'. The Solar PV System Caution Stickers shall be fixed under the supervision ofthe AEE (ESSD) in the following locations.
a. On or near to meter of service with grid connected Solar PV System.
b. On the Consumer main switch, of a service connection with a grid connectedSolar PV System.
c. On LT poles with grid connected Solar PV System at height of about 1.50 meterfrom the ground.
d. On LT feeder pillars with grid connected Solar PV System on the street - facingdoor of the feeder pillar.
e. On each of the LT take offpoles of a Distribution Transformer to which Solar PVSystem are connected.
f. On substation end of HT feeder having Solar PV system.g. A list of service connections with grid connected Solar PV Systems shall be
available at the AEE (ESSD) office and the 33/l I KV pSS.
h. A record may be maintained at the AEE (ESSD) office of each SPV plantcommissioning date and other details.
i. The SPV connection details of pole/pillar box/DT/SS feeder endwise may bemaintained at AEE (ESSD) office.
(g) During planned/forced maintenance work on Discom network, before taking up thework in hand besides ensuring all other provisions such as line earthing, de-energisation of the line section where the work is to be carried out as per prevailingnorrns further it should be ensured that supply from such small solar roof-top PVpower plants are not back fed and supply should also be disconnected by manualisolating switch with locking facility installed in the premises of such consumers andensuring proper earthing.
