Minister of Environment;

Pursuant to the Constitution of the Republic

of Rwanda of 2003 revised in 2015,

especially in Articles 121, 122 and 176;

Pursuant the Law n° 27/2021 of 10/06/2021

governing land, especially in Article 6;

Having reviewed the Ministerial Order n°

009/16.01 of 23/08/2011 determining the

procedure to obtain a freehold land title as

amended to date;

After consideration and adoption by the

Cabinet in its meeting of 14/12/2021;

Ministre de l’Environnement ;

Vu la Constitution de la République du Rwanda

de 2003 révisée en 2015, spécialement en ses

articles, 121, 122 et 176 ;

Vu la Loi no 27/2021 du 10/06/2021 portant

régime foncier, spécialement en son article 6 ;

Revu l’Arrêté Ministériel n° 009/16.01 du

23/08/2011 déterminant les modalités

d’acquisition des certificats d’enregistrement de

la propriété foncière tel que modifié à ce jour ;

Après examen et adoption par le Conseil des

Ministres, en sa séance du 14/12/2021 ;

ARRÊTE :

Ingingo ya 2: Ibyiciro by’ubutaka

butangirwa inkondabutaka

Ubutaka butangirwa inkondabutaka buri mu

byiciro bikurikira:

1° ubutaka bw’umuntu butuganyijwe

hakurikijwe igishushanyo mbonera

cy’aho ubwo butaka buherereye

kandi bwagenewe ibikorwa byo

gutura, iby’inganda, iby’ubucuruzi,

cyangwa iby’imibereho rusange;

2° ubutaka bwa Leta.

Article one: Purpose of the Order

This order determines –

1° categories of land subject to freehold;

2° modalities of acquisition of freehold;

3° requirements for granting freehold;

and

4° compliance requirements for the

freehold holder.

Article 2: Categories of land subject to

freehold

Categories of land subject to freehold are the

following:

1° private owned land developed in

accordance with the master plan of

the land location and planned for

residential, industrial, commercial or

social public activities;

2° State land.


Le présent arrêté détermine –

1° les catégories des terres soumises à la

pleine propriété foncière ;

2° les modalités d’acquisition de la pleine

propriété foncière ;

3° les conditions d’octroi de la pleine

propriété foncière ; et

4° les exigences de conformité au titulaire

de la pleine propriété foncière.

Article 2 : Catégories des terres soumises à la

pleine propriété foncière

Les catégories des terres soumises à la pleine

propriété foncière sont les suivantes :

1° les terres privées aménagées

conformément au schéma directeur du

lieu de cette terre et prévues pour les

activités résidentielles, industrielles,

commerciales et les activités publiques

sociales ;

2° les terres de l’État.

Umuntu usaba inkondabutaka yuzuza ifishi

imicungire n’imikoreshereze by’ubutaka mu

nshingano.

Ingingo ya 4: Ibisabwa umuntu usaba

inkondabutaka

Umuntu usaba inkondabutaka agaragaza ibi

bikurikira:

1° amasezerano y’ubukode burambye;

2° icyemezo cy’iyandikisha ry’ubutaka;

3° uruhushya rwo gukoresha inyubako;

4° icyemezo cy’iyandikisha iyo usaba

ari isosiyeti y’ubucuruzi;

5° icyemezo cy’ubuzima gatozi iyo

usaba ari koperative, umuryango

nyarwanda utari uwa Leta,

umuryango ushingiye ku myemerere;

Article 3: Application for freehold

The application for freehold is addressed to

the Registrar of land Titles of the zone in

which land is located.

A person who applies for freehold fills the

appropriate form established by the

institution in charge of land management and

use.

Article 4: Requirements for an applicant

for freehold

An applicant for freehold presents the

following:

1° emphyteutic land lease;

2° certificate of land registration;

3° occupancy permit;

4° certificate of registration for a

company;

5° certificate of legal personality for a

cooperative, a national non-

governmental organisation, a faith-

based organisation;

Article 3 : Demande de la pleine propriété

foncière

La demande de la pleine propriété foncière est

adressée au Conservateur des Titres Fonciers de

la zone dans laquelle la terre se situe.

Une personne qui demande la pleine propriété

foncière remplit le formulaire approprié établi

par l’institution ayant la gestion et de

l’utilisation des terres dans ses attributions.

Article 4 : Conditions requises d’un

demandeur de la pleine propriété foncière

Le demandeur de la pleine propriété foncière

présente ce qui suit:

1° le bail emphytéotique ;

2° le certificat d’enregistrement foncier ;

3° le permis d’occupation;

4° le certificat d’enregistrement pour une

société commerciale ;

5° le certificat de personnalité juridique

pour une coopérative, une organisation

non gouvernementale nationale, une

organisation fondée sur la foi;

7° kopi y’Iteka rya Minisitiri ryemeza

itangwa ry’inkondabutaka, iyo

ubutaka burenze hegitari ebyiri.

Ingingo ya 5: Gusuzuma ubusabe

Umubitsi w’Inyandikompamo z’Ubutaka

asuzuma ubusabe yashyikirijwe.

Iyo Umubitsi w’Inyandikompamo z’ubutaka

asanze uwasabye inkondabutaka yujuje

ibisabwa, ashyira umukono ku masezerano

yo kwegurirwa ubutaka asabira

inkondabutaka.

Imiterere n’ibikubiye mu masezerano yo

kwegurirwa ubutaka bigenwa n’ikigo gifite

imicungire n’imikoreshereze by’ubutaka mu

nshingano.

Ingingo ya 6: Igihe cyo gutanga

inkondabutaka

Umubitsi w’Inyandikompamo z’Ubutaka

atanga inkondabutaka n’icyemezo

cy’iyandikishwa ry’inkondabutaka mu gihe

kitarenze iminsi cumi n’ine (14) y’akazi

6° a copy of Presidential Order

approving grant of freehold for a

foreigner;

7° a copy of Ministerial Order

approving grant of freehold for land

exceeding two hectares.

Article 5: Assessment of the application

The Registrar of Land Titles assesses the

received application.

When the Registrar of Land Titles finds that

the applicant fulfils the requirements, he or

she signs the contract for freehold.

The characteristics and content of the

contract for freehold land title are determined

by the institution in charge of land

management and land use.

Article 6: Period for issuance of freehold

The Registrar of Land Titles issues a

freehold and a certificate of registration of

freehold within a period not exceeding

fourteen (14) working days from the date of

Article 5 : Evaluation de la demande

Le Conservateur des Titres Fonciers évalue la

demande reçue.

Lorsque le Conservateur des Titres Fonciers

constate que le demandeur remplit les

conditions requises, il signe le contrat de la

pleine propriété foncière.

Les caractéristiques et le contenu du contrat du

titre de pleine propriété foncière sont

déterminés par l’institution ayant la gestion et

de l’utilisation des terres dans ses attributions.

Article 6: Délai de délivrance de la pleine

propriété foncière

Le Conservateur des Titres Fonciers délivre la

pleine propriété foncière et le certificat

d’enregistrement de la pleine propriété foncière

endéans quatorze (14) jours ouvrables à partir

freehold or freehold land title, the Registrar

of Land Titles, in writing, communicates it to

the applicant.

Article 7: Compliance requirements for

the freehold holder

A freehold land title holder complies with

relevant laws.

Article 8: Repealing an order

Ministerial Order n° 009/16.01 of

23/08/2011 determining the procedure to

obtain a freehold land title is repealed.


This Order comes into force on the date of its

publication in the Official Gazette of the

Republic of Rwanda.

foncière, le Conservateur des Titres Fonciers,

par écrit, le communique au demandeur.

Article 7: Exigences de conformité au

titulaire de la pleine propriété foncière

Un titulaire du titre de la pleine propriété

foncière se conforme à la législation en la

matière.

Article 8: Abrogation d’un arrêté

L’Arrêté Ministériel n° 009/16.01 du

23/08/2011 déterminant les modalités

d’acquisition des certificats d’enregistrement de

la propriété foncière est abrogé.

Article 9: Entrée en vigueur

Le présent arrêté entre en vigueur le jour de sa

publication au Journal Officiel de la République

du Rwanda.

In this Order, the following terms have the

Article 7: Responsibilities of the Committee

The Committee has the following

responsibilities:

1° to examine the applicant’s personal

interest before carrying out an

investigation on the dispute;

2° to carry out investigation on the

received dispute, with intention to

collect evidence on the dispute;

3° to analyse the nature of the dispute;

4° to hear parties to the dispute;

5° to mediate parties to the dispute;

6° to submit to the appointing authority a

report on investigations carried out,

analysis of the nature of the dispute,

evidence, and a recommendation,

within ten (10) days from the date of

establishment of the Committee.

Article 8: Functioning of the Committee

The committee carries out its responsibilities

independently and in accordance with

If a member of the Committee has an interest

in the dispute being examined, he or she

informs in writing the appointing authority for

replacement.

The Committee may request the appointing

authority to designate an expert to assist in

analysing the nature of dispute.

CHAPTER III: PROCEDURE FOR


Article 9: Application for dispute resolution

A person, who intends to apply for a dispute

resolution, submits on hard copy or

electronically to the Mayor of the District with

legal personality or the Mayor of the City of

Kigali, where the land is located, or to the Head

of Authority, an application file for dispute

resolution.

Article 10: Content of an application file for

dispute resolution

An application file for dispute resolution

contains the following:

Lorsqu’un membre du Comité a un intérêt dans

le litige en cours d’examen, il en informe

l’autorité de nomination pour le remplacement.

Le Comité peut demander à l’autorité de

CHAPITRE III : PROCÉDURES DE


Article 9 : Demande de résolution d’un litige

Une personne qui a l’intention de demander la

résolution d’un litige, soumet sur papier

imprimé ou par voie électronique un dossier de

demande de résolution d’un litige auprès du

Maire du District doté de la pesonnalité

juridique, auprès du Maire de la Ville de

Kigali, où les terres se trouvent, ou auprès du

Responsable de l’Office.

Article 10 : Contenu d’un dossier de

demande de résolution d’un litige

Le dossier de demande de résolution d’un litige

contient ce qui suit :

sector and district of residence, his

or her email and telephone number;

b) details of the dispute;

c) unique land indentification

number;

d) the applicant’s request;

2° a document indicating the decision

taken by the Sector authority against

the dispute;

3° a document indicating the decision

taken by the Mayor of District with

legal personality or the Mayor of the

City of Kigali against the dispute, in

case of appeal; or

litige ;

3° un document qui indique la décision

prise sur ce litige, par le Maire du

District doté de la personnalité

juridique ou le Maire de la Ville de

Kigali, en cas d’appel ; ou

amakimbirane

Umuyobozi w’Akarere gafite ubuzima gatozi,

uw’Umujyi wa Kigali, cyangwa uw’Ikigo

batumira, mu nyandiko, abafitanye

amakimbirane hagamijwe kubumva cyangwa

kubumvikanisha.

Ubutumire bugaragaza amazina y’utumiwe,

impamvu y’ubutumire, umunsi, isaha n’aho

kumva cyangwa kumvikanisha bizabera.

4° the proof indicating that the period of

thirty (30) days has been elapsed

without the applicant being notified of

the decision on the dispute, in case of

appeal;

5° geographic coordinates of the land, if

any;

6° documents related to the dispute;

7° other evidence certifying the

applicant’s rights on land, if any.

Article 11: Invitation of parties to the

dispute

The Mayor of District with legal personality,

the Mayor of City of Kigali or the Head of the

Authority invites, in writing, the parties to the

dispute for hearing or mediation.

The invitation indicates the names of the

invitee, the reason of invitation, the date, time

and place for hearing or mediation.

Le Maire du District doté de la pesonnalité

juridique, le Maire de la Ville de Kigali ou le

Responsable de l’Office invite, à l’écrit, les

parties au litige pour l’audition ou la

médiation.

L’invitation indique les noms de l’invité, le

motif de l’invitation, le jour, l’heure et le lieu

pour l’audition ou la médiation.

Icyakora, iyo umwe mu bafitanye

amakimbirane atitabye ubutumire nta mpamvu

yatanze cyangwa impamvu yatanze itemejwe

n’Akanama, amakimbirane asuzumwa mu mizi

kandi agakemurwa nk’aho utitabye ubutumire

yari ahari.

Article 12: Invitation of witnesses


the Mayor City of Kigali or the Head of the

Authority may invite a witness who can

provide information or evidence necessary for

dispute resolution.

Article 13: Procedure for hearing parties to

the dispute

The Committee hears first the applicant for

dispute resolution.

If one of the parties to the dispute does not

appear having provided a valid reason

approved by the Committee, the hearing is

adjourned. The adjournment cannot occur

more than once for each party.

However, if one of the parties to the dispute

does not appear without any reason or the

provided reason was not approved by the

Committee, the dispute is examined on merits

and resolved as if the absentee was present.

The Committee hears witnesses of each party

to the dispute, if they are invited.

Article 12 : Invitation des témoins

Responsable de l’Office peut inviter un témoin

qui peut fournir des informations ou des

preuves nécessaires à la résolution du litige.

Article 13 : Procédure d’audition des

résolution du litige.

Lorsque l’une des parties au litige ne comparaît

pas ayant donné un motif valable et approuvé

par le Comité, l’audition est ajournée.

L’ajournement ne se fait pas au-delà d’une

seule fois pour chaque partie.

Toutefois, lorsque l’une des parties au litige ne

comparaît pas sans motif ou le motif avancé

n’est pas approuvé par le Comité, le litige est

examiné au fond et résolu comme si l’absent

était présent.

Le Comité entend les témoins de chaque partie

au litige, lorqu’ils sont invités.

The Committee may hear the parties to the

dispute or witnesses by means of technology.

Article 14: Suspension of application for

dispute resolution

An applicant for dispute resolution may

request to suspend his or her application as

long as the decision has not been made yet.

However, the applicant who suspended his or

her application may no longer apply for dispute

resolution to the authorities referred to in this

Order for the same dispute while the parties to

the dispute are still the same.

Article 15: Deciding on a dipute


the Mayor of the City of Kigali, or the Head of

the Authority takes a decision on the dispute in

writing based on the report of the Committee,

within a period prescribed by the Law

governing land.

Le Comité peut entendre les parties au litige ou

les témoins par moyen de la technologie.

Article 14 : Suspension de la demande de

résolution d’un litige

Un requérant de la résolution d’un litige peut

demander de suspendre sa demande tant que la

décision n’a pas été prise.

Toutefois, le requérant qui a suspendu sa

demande ne peut plus demander la résolution

d’un litige aux autorités visées dans le présent

arrêté pour le même litige tant que les parties

au litige sont toujours les mêmes.

Article 15 : Décider sur un litige

Le Maire du District doté de la personnalité

juridique, le Maire de la Ville de Kigali, ou le

Responsable de l’Office statue par écrit sur le

litige, sur base du rapport du Comité, endéans

le délai prescrit par la loi portant régime

foncier.

dispute

The decision on a dispute contains, at least, of

the following:

1° a file number of the dispute;

2° the place of decision and the date on

which it was taken;

3° names of parties to the dispute, their

identity card numbers, village, cell,

sector and district of residence, their

emails and telephone numbers;

4° the nature of the dispute;

5° the basis on which the decision was

made;

6° the decision taken;

7° names and signature of the Mayor of

District with legal personality, the

Mayor of the City of Kigali, or the

Head of the Authority who takes a

decision on a dispute.

Article 16 : Contenu de la décision sur un

La décision sur un litige comprend, au moins,

Le Ministre de l’Environnement ;

Vu la Constitution de la République du Rwanda

de 2003 révisée en 2015, spécialement en ses

articles 121, 122 et 176 ;

Vu la Loi nº 27/2021 du 10/06/2021 portant

régime foncier, spécialement en son article 63 ;



ARRÊTE :


Le présent arrêté détermine les modalités de

changement de l’utilisation des terres.

Article 2: Change of land use

The change of land use is made for the purpose

of –

1° complying with the requirements of the

master plan of land use and development

of the place where the land is located; or

2° changing land use as determined by

master plan of land use and development

for the purpose of strategic investment

or public interests.

Article 3: Request for change of land use

A person requesting for the change of land use

submits, in writing, a request to the institution

in charge of land use.

However, the institution in charge of land use,

on its own initiative, may change the land use

in order to comply with the land use plan or

rectify defects identified. Prior to rectifying

effectué dans le but de –

Article 3 : Demande de changement de

l’utilisation des terres

Une personne demandant le changement

de l’utilisation des terres soumet, par écrit, la

demande à l’institution ayant l’utilisation des

terres dans ses attributions.

Toutefois, l’institution ayant l’utilisation des

terres dans ses attributions, de sa propre

initiative, peut modifier l’utilisation des terres

its own initiative, changes the land use, it

informs the land owner about the change

within a period not exceeding sixty (60) days

from the date of the change of land use.

development includes at least the following:

1 º applicant identification;

terres dans ses attributions, de sa propre

initiative, change l’utilisation des terres, elle en

informe le propriétaire des terres endéans

soixante (60) jours de la date du changement de

l’utilisation des terres.

The request for change of land use aiming to

modify the master plan of land use and

development for strategic investment purpose

or in public interest includes at least the

following:

1 º an application letter indicating the

existing activities carried out on the land

which is subject to request for change of

land use and planned activities to be done

on that land;

2 º applicant identification;

3 º a copy of the land title of the land for

which the change of land use is requested

or deed plan indicating the concerned

land;

concernées ;

4 º a non-objection letter issued by the

District or City of Kigali in which the

land is located confirming that the

intended land use change is relevant to

the development of the District or City of

Kigali and does not interfere with the

District or City of Kigali land use plan

implementation;

5 º the project study for strategic investment

or public interests approved by the organ

in charge of activities underlined in that

project.

The project study for strategic investment or

public interests shows –

1° how the new proposed land use is more

valuable and beneficial than the

existing land use; and

2° how the project implementation

complies with the directives of national

land use and development master plan

and is not harmful to the environment.

5° l’étude du projet d’investissement

stratégique ou d’intérêt public approuvée

par l'organe ayant les activités spécifiées

dans ce projet dans ses attributions.

L’étude du projet d’investissement stratégique

ou d’intérêt public démontre –

1° en quoi la nouvelle utilisation proposée

des terres a une plus grande valeur et est

plus bénéfique que l’utilisation existante

des terres ; et

2° comment la mise en œuvre du projet est

conforme aux directives du schéma

directeur national d’utilisation et

d’aménagement des terres et qu’elle

n’est pas nuisible à l’environnement.

Article 6: Analysis and approval of change

of land use

When analysing the request for change of land

use for the purpose of changing the land use as

determined by the master plan of land use and

development for the purpose of strategic

investment or public interest, the institution in

charge of land use consults the Ministry in

charge of economic planning and the Ministry

in charge of land, before making a decision. It

may also consult other relevant institutions.

If the institution in charge of land use finds that

the requested is relevant, it approves it and

changes the land use in the land register and

master plan.

The response to the applicant is issued within a

period not exceeding thirty (30) days from the

date on which the application was received.

Article 6 : Analyse et approbation du

changement de l’utilisation des terres

Lors de l’analyse de la demande de changement

de l’utilisation des terres en vue de changer

l’utilisation des terres tel que déterminé par le

schéma directeur d’utilisation et

d’aménagement des terres aux fins

d’investissement stratégique ou d’intérêt

public, l’institution ayant l’utilisation des terres

dans ses attributions consulte le Ministère ayant

la planification économique dans ses

attributions et le Ministère ayant les terres dans

ses attributions, avant de prendre une décision.

Elle peut également consulter d’autres

institutions concernées.

Lorsque l’institution ayant l’utilisation des

terres dans ses attributions constate que la

demande est pertinente, elle approuve ce

changement et modifie l’utilisation des terres

dans le registre foncier et dans le schéma

directeur.

La réponse au demandeur est délivrée endéans

trente (30) jours de la date à laquelle la demande

a été reçue.
