The premises have recently undergone a significant refurbishment and have a completely different concept to that which was previously in place when the premises were trading as the Red Lion with a different clientele now attracted to the premises and it is running as a bar/restaurant. The premises have a strong focus on providing a quality food offering with a menu that includes Nepalese dishes. The premises are also committed to delivering the highest operational standards when trading and the Designated Premises Supervisor, Maneera Thapa, is committed to working in partnership with the authorities to ensure she operates a safe and legally compliant premises.

Given the changes proposed, we have carefully considered the application, the effect on the licensing objectives and the Council's Licensing Policy. The purpose for seeking later hours for the sale of alcohol would allow our customers to continue their night in a safe and comfortable environment, rather than leave and go to other premises and allow more flexibility around trading. The application also seeks to extend the start time for the sale of alcohol and regulated entertainment to 10:00 hours on Sunday in line with the rest of the week.

We are seeking to add the provision of films to allow the premises on occasions to show pre-recorded films to customers. The new non-standard timings as detailed above would allow the premises more flexibility around trading. The additional hour to the standard and non-standard times on the day when British Summertime commences would allow the premises to remain open and to trade legally when the clocks change automatically from 01 :00 hours on the Sunday morning to 02:00 hours and therefore we do not consider that any further steps will be necessary to promote the licensing objectives should these non­ standard timings be granted.

The Premises Licence Holder has consulted with the relevant Police Licensing Officer on the proposals. The variation application has also been submitted to update the Premises Licence conditions to ensure that they are suitable for the style of operation at the premises. We have taken the opportunity to replace the existing operating schedule, which is outdated in parts, and offer an updated bespoke operating schedule to the hours proposed which has been carefully drafted following pre-consultation with the Police. The new conditions are offered to bolster the operating schedule ensuring it is clear, appropriate and enforceable. Furthermore, the majority of conditions proposed in the operating schedule are already in place and bein@c0mpliedwithonavoluntarybasisbytheDPSat the premises.-

We have also used a number of Temporary Event Notices to trade to the proposed permitted hours which have demonstrated the perceived retention of customers and allowed for a safe and controlled environment for our customers to enjoy with no detriment to the licensing objectives.

Considering the above, we believe that the variation would not have an adverse impact on the licensing objectives and we believe that the measures proposed will ensure the premises continue to promote the licensing objectives and that these measures are adequate.

b) The prevention of crime and disorder 1. The premises will be an active member of any local Pubwatch scheme, where such

a scheme exists 2. The Premises Licence Holder/DPS will risk assess the need for door supervisors at

the premises and/or deploy such supervisors at such time and in such numbers as deemed necessary by the risk assessment and/or at any other times upon agreement with the Metropolitan Police.

3. The CCTV system shall be maintained in good working order and shall be operational at all times when licensable activities are taking place. The system will cover all of the licensed area and shall incorporate a method of recoding date and time of the recording. Images shall be of evidential quality and will be retained for 31 days. They will be made available on request of officers of the Licensing Authority and Police.

4. A staff member from the premises who is conversant with the operation of the CClV system shall be on the premises at all times when the premises are open. This staff member must be able to provide a Police or authorised council officer copies of recent CCTV images or date with the absolute minimum of delay when requested.

5. A record shall be kept detailing all refused sales of alcohol. The record should include the date and time of the refused sale and the name of the member of staff who refused the sale. The record shall be made available for inspection at the premises by the Police at all times whilst the premises are open.

6. An incident/accident log (which may be in an electronic format) is to be maintained and kept on the premises detailing all incidents of personal injury, damage and disorder. The log is to be made available for inspection by the responsible authorities and other authorised persons on request.

c) Public safety Please see box a) above. We understand our obligations under existing legislation and take our responsibilities seriously.

d) The prevention of public nuisance 7. Prominent, clear and legible notices shall be displayed at all public exits from the

premises requesting customers to respect the needs of local residents and leave the premises and area quietly.

8. No noise shall emanate from the premises nor vibration be transmitted through the structure of the premises which gives rise to a nuisance.

9. The Premises Licence Holder/Designated Premises Supervisor shall operate a written dispersal policy which ensures the safe and gradual dispersal of customers from the premises. The Premises Licence Holder/Designated Premises Supervisor shall ensure that staff receive training on the Policy.

e) The protection of children from harm 10. Children under the age of 18 years must be accompanied by an adult at all times

whilst on the premises and must be off the premises by 21 :00 hours, unless having a table meal or attending a private function in which case they must be off the premises by midnight

11. Full training shall be provided to all staff on commencement of employment relating to all age restricted products sold and any system or procedures they are expected to follow in the course of dealing with these goods. Refresher training shall be provided at regular intervals - at least every 12 months. All records detailing the training provided must be written and kept on the premises for a minimum of 12 months and for production upon request of a Police Officer or authorised person.

12. A Challenge 25 proof of age scheme shall be operated at the premises where the only acceptable forms of identification are recognised photographic identification cards, such as a driving licence, passport or proof of age card with the PASS Hologram.

13. Clear, prominent and unobstructed signage informing customers of the proof of age scheme in operation shall be displayed at all entry points to the premises.

Notes for Guiâance

This application cannot be used to vary the licence so as to extend the period for which the licence has effect or to vary substantially the premises to which it relates. If you wish to make that type of change to the premises licence, you should make a new premises licence application under section 17 of the Licensing Act 2003.

1. You do not have to pay a fee if the only purpose of the variation for which you are applying is to avoid becoming liable for the late night levy

2. Describe the premises. For example, the type of premises, its general situation and layout and any other information which could be relevant to the licensing objectives. Where your application includes off-supplies of alcohol and you intend to provide a place of consumption of these off-supplies of alcohol, you must include a description of where the place will be and its proximity to the premises.

3. In terms of specific regulated entertainments please note that: • Plays: no licence is required for performances between 08.00 and 23.00 on

any day, provided that the audience does not exceed 500. • Films: no licence is required for 'not-for-profit' film exhibition held in

community premises between 08.00 and 23.00 on any day provided that the audience does not exceed 500 and the organiser (a) gets consent to the screening from a person who is responsible for the premises; and (b) ensures that each such screening abides by age classification ratings.

• Indoor sporting events: no licence is required for performances between 08.00 and 23.00 on any day, provided that the audience does not exceed 1000.

• Boxing or Wrestling Entertainment: no licence is required for a contest, exhibition or display of Greco-Roman wrestling, or freestyle wrestling between 08.00 and 23.00 on any day, provided that the audience does not exceed 1000. Combined fighting sports - defined as a contest, exhibition or display which combines boxing or wrestling with one or more martial arts - are licensable as a boxing or wrestling entertainment rather than an indoor sporting event.

• Live music: no licence permission is required for: o a performance of unamplified live music between 08.00 and 23.00 on

any day, on any premises. o a performance of amplified live music between 08.00 and 23.00 on

any day on premises authorised to sell alcohol for consumption on those premises, provided that the audience does not exceed 500.

o a performance of amplified live music between 08.00 and 23.00 on any day, in a workplace that is not licensed to sell alcohol on those premises, provided that the audience does not exceed 500.

o a performance of amplified live music between 08.00 and 23.00 on any day, in a church hall, village hall, community hall, or other similar community premises, that is not licensed by a premises licence to sell alcohol, provided that (a) the audience does not exceed 500, and (b) the organiser gets consent for the performance from a person who is responsible for the premises.

o a performance of amplified live music between 08.00 and 23.00 on any day, at the non-residential premises of (i) a local authority, or (ii) a school, or (iii) a hospital, provided that (a) the audience does not exceed 500, and (b) the organiser gets consent for the performance on the relevant premises from: (i) the local authority concerned, or (ii) the school or (iii) the health care provider for the hospital.

• Recorded Music: no licence permission is required for: o any playing of recorded music between 08.00 and 23.00 on any day

on premises authorised to sell alcohol for consumption on those premises, provided that the audience does not exceed 500.

o any playing of recorded music between 08.00 and 23.00 on any day, in a church hall, village hall, community hall, or other similar

community premises, that is not licensed by a premises licence to sell alcohol, provided that (a) the audience does not exceed 500, and (b) the organiser gets consent for the performance from a person who is responsible for the premises.

o any playing of recorded music between 08.00 and 23.00 on any day, at the non-residential premises of (i) a local authority, or (ii) a school, or (iii) a hospital, provided that (a) the audience does not exceed 500, and (b) the organiser gets consent for the performance on the relevant premises from: (i) the local authority concerned, or (ii) the school proprietor or (iii) the health care provider for the hospital.

• Dance: no licence is required for performances between 08.00 and 23.00 on any day, provided that the audience does not exceed 500. However, a performance which amounts to adult entertainment remains licensable.

• Cross activity exemptions: no licence is required between 08.00 and 23.00 on any day, with no limit on audience size for:

o any entertainment taking place on the premises of the local authority where the entertainment is provided by or on behalf of the local authority;

o any entertainment taking place on the hospital premises of the health care provider where the entertainment is provided by or on behalf of the health care provider;

o any entertainment taking place on the premises of the school where the entertainment is provided by or on behalf of the school proprietor; and

o any entertainment (excluding films and a boxing or wrestling entertainment) taking place at a travelling circus, provided that (a) it takes place within a moveable structure that accommodates the audience, and (b) that the travelling circus has not been located on the same site for more than 28 consecutive days.

4. Where taking place in a building or other structure please tick as appropriate (indoors may include a tent).

5. For example state type of activity to be authorised, if not already stated, and give relevant further details, for example (but not exclusively) whether or not music will be amplified or unamplified.

6. For example (but not exclusively), where the activity will occur on additional days during the summer months.

7. For example (but not exclusively), where you wish the activity to go on longer on a particular day e.g. Christmas Eve.

8. Please give timings in 24 hour clock (e.g. 16.00) and only give details for the days of the week when you intend the premises to be used for the activity.

Notice is hereby given that KTM Rox Limited intends to apply for a variation of a Premises Licence in respect of premises known as the KTM ROX, 49 High Street, Feltham, TW13 4AB
