MLC Compliance CheckMercantile Marine Office (MMO),1. carries out the MLC compliance check, mainly on the

employment, welfare of seafarers (routine & random).2. conducts investigation into complaint incident of

seafarers matters.3. conducts investigation / inquiry into disciplinary incident

(in 2021, 2 warning letters issued and 3 notificationletters issued to seafarers’ Administration).

4. renders assistance to seafarers with respect to welfare,wages, working conditions...

MLC deficiency related PSC detention cases

In 2020 and up to August 2021, 11 cases related to MLC compliancedeficiency (https://www.mardep.gov.hk/en/faq/pscinfo.html)

2 cases: working/rest hours 1 case: medical fitness 8 cases: Seafarers Employment Agreement (SEA)/expired,

repatriation(over 11 months), payment not according to SEA[Belgium (3), Australian (2), Canada(1), Japan(1), Panama(1)]

SEA: shall be valid total service not over 11 months (repatriation) payment and monthly account (match SEA, monthly interval)

Disciplinary incident One company reported MARPOL breaching incident

by ship’s engineers, warning letters were issued tothe related engineers, and notification letter wasissued to seafarers’ Administration.

One seafarer refused to return ship without normaltermination of SEA, a notification letter was issuedthe seafarer’s Administration

Consular assistance in foreign portMD liaisons with Chinese Consulate in foreign countries toassist our seafarers if in need. Good conclusion has beenreached after Consulate’s assistance:

COVID-19 infection cases (quarantine, medical care toinfected crew, Chili, Malaysia)

Legal cases (ship arrested/detained due to commercialdispute: Indonesia)

Marine accident cases (detained after collision/deceasedcase, Philippines, PNG)

Injured crew (medical care ashore, Malaysia, Gibraltar)30

Successful assistance to seafarers encountered problems A ship was stranded in a shipyard due to legal

proceedings. The crew on board encountered problemsof living condition (food, water, cooking), wages, etc.

MD kept monitoring and sought the financial securityprovider (insurer) to follow up.

The insurer provides effective assistance to the crew(e.g. maintenance, salary, repatriation, quarantinerequirement, etc)

Circular letter for the revised Standard Clause for Hongregistered ships to include the 2018 amendment of MLC2006 (SEA continue to have effect during capture perioddue to piracy and or robbery action).

Circular letter for Extension of Seafarers EmploymentAgreement (SEA) and Repatriation plan under COVID-19.

Circular letter to draw attention of ships calling Australianports, after 28 February 2021, AMSA will resumerequirement of MLC for the maximum continuous seaservice to be not more than 11 months.

Circular Letter to give the guidance on the preventionand control of COVID-19 on board ships

Circular Letter to the industry for the revision of e-submission of crew agreement and list of crew. [to easythe documentation workload of ship’s crew, thesubmission of hard copy crew agreement is notnecessary, all submission of crew articles shall be via e-mail]

MD gives no objection letter to the seafarers, whosemedical certificate expired, to continue service on boardHK ships, in accordance with MLC provision and HongKong legislation. 33

Handling of seafarers complaints

MMO handles complaint incidents and assistance requestcases from seafarers and company, such as: delayedrepatriation, and payment problem (investigation, follow up,solution).

Some cases of complaint are relayed by IMO, union orforeign Administration without firstly reported to MD.

Company may reiterate the on board complaintprocedure, it shall encourage the seafarers refer thecomplaints as normal route to company and FlagAdministration firstly, instead of reporting to IMO, ITF,ILO, Port State, other Unions / Associations.

Maintain good communication between Master and theresponsible personnel for the stowing and securingarrangement during cargo operation.

Improve the maintenance of cargo securing device andalways check for adequate spares available on board.

2 PSC officers with 3 non PSC officers went on boardfor PSCI.

The Master refused the 3 non PSC officers on board. PSCOs detained ships without inspection performed. One day later, the PSCI was performed and the ship

was released with 11 deficiencies issued.

IMO Procedures for PSC, Resolution A.1138(31)

1.8.4 A PSCO should carry a personal document in theform of an identity card issued by the port State andindicating that the PSCO is authorized to carry out thecontrol.

1.8.2 When the required professional expertise cannot beprovided by the PSCO, the PSCO may be assisted by anyperson with the required expertises, as acceptable to theport State.

• Jointly organized by Tokyo MOU and Paris MOU

• Held from 1 Sep – 30 Nov, 2021

Purpose – CIC 2021• To raise the awareness of importance in the

actual ship’s stability condition during cargooperations and on all stages of the voyage

• To ensure ship staff’s capability in theassessment of actual ship’s stability condition

• AIM: To confirm the ship complies with IMOstability requirements

How is CIC 2021 conducted?• During 1 Sep – 30 Nov 2021, ship that is subject

to CIC 2021 will be conducted in conjunction withPSC inspection.

• A copy of PSC inspection report AND thecompleted CIC questionnaire should be kept onboard for record purpose.
