Rukibai filed WP against to Railways directly before Hon'ble HC to sanction
exgratia pension as she is widow of Late Heeraman Chandu High Skilled
Fitter/S&T/KZJ retired on 06.09.1969 and expired on 25.05.1984. by enclosing
a xerox copy of Service Certificate issued on 13.10.1969. The xeroxcopy is a
fictious document and she was unable to produce original service certificate
of deceased employee.
Petitioner not availed or exhausted the alternative remedy by approaching
the CAT.
She was not able to produce any original documentary evidence, she was not
sanctioned the exgratia pension. She is the 2nd wife of the deceased and not
considered as it is not valid.
Pray in WP: The applicant filed WP against Railways to issue a writ of
mandamus directing the respondent authorities to sanction the exgratia
pension to the petitioner with retrospective date alongwith 18% rate of
interest per annum and consequently direct the respondents to sanction the
exgratia pension payment to the petitioner with interest 18% p.a.,

Brief facts of the case: The Applicant joined as ASM in 1989 and on
completion of training posted at Guntakal Division in the scale of Rs.1200/-.
Based on the seniority he was promoted to the scale Rs.1400/- on 13.01.1992.
The said promotion is not in substantive pay and he was worked in the
officiating pay. He had applied for request transfer to Secunderabad Division
and accepted his request under bottom seniority in the scale of Rs.1200/- His

19.03.1973 and regularised on 02.07.1981 At the time of transfer on
promotion as Carpenter from SCto CTYL he was in occupation of Rly Quarter
No: 548/14 Type-I at Chilkalguda. He never applied for retention of Quarters
and continued from 10.08.1994 and vacated on 10.07.2002.The whole
periodfrom 10.08.1994 to 10.07.2002 treated as unauthorised occupation of
Rly. Qtrs. and damage rent hasbeen worked out to Rs.1,52,019/- and DCRG
Rs. 85,163/- adjusted towards damage rent and Rs.66,856/-to be recovered.

for delayed payments such as PF, DCRG, EOL etc.,
Grounds by Railways: As per S.C.NO: 70/1991 interest is payable only on
delayed payment of Retirement Gratuity when it is delayedbeyond 6 months
from the date of retirement. The employee retired on 31.01.2001 and he has
executed pension papers on 20.04.2001. Settlement done within 6months
fromthe date of execution of papers. Accordingly rejected his request.
