1. That the S.D.O. Kandi intiated a proceeding on the basis of

the complaint against the issuance of "OBC" Certificate in favour

of Rehena Khatun C Rehena Bibi and on 19411.2014 and 10,12.2014

hearing was done before the S.E.O. Yandi but till date the S.D.U.

Kandi did not take any final decision by passing an order.

2. Whether the S.D.O. Yandi can withheld his decision for an

unlimited period in respect of a complaint against issuance of

residence, the address of which is mentioned in the Cause Title of

this application.

petitioner alongwith other villrgems of Village-rumrai under Burwan

Police Station uithin 'Candi Sub-rivision cane to know that one

Rehena Khntun @ them,. Bibi ohtined 90PCI Certificate from the

Office of Subt Divisienal officer, Verdi, though said Pehena Khatun

Rehena Bibi is not a nOBC" Candidate. After coming to know about

the said certificate, petitioner collected school certificnte of

Rehena Kbetoon wherefrom transpired that her father name is Abdul

Rashid i4irza of Village-Yumrai• The Pradhen, Kuli Gram Panchaynt

also issued a Genealogy of Behnena Ytatun @ Baena Bibi on

31.10,2014 whercfrom found that Abdul Rashid Mirzn is a father

of Yehcna Khatun end. one Abdul Mirzn is a grandfather of

said Eche= Khatun. Baena Yhatun married with one Murshed Rawer

Sbtsaish of Villnge-Kumrai, P.O. Bodua, P.S.Burwan and Tier name

appeard as Sl.No.21, Part no,43 of 67, Bum= (SC) Assembly Consti-

tuency in the Voter List published in the year 2011,

issued a notice dated 3.11.2014 being Memo Ne.3007(15) whereby fixing

the date on 1901.2014 at 2 p.m. for appeerance and for producing

necessary documents before the S.D.O. Kandi in connection with the

compleint ngninst the issuance of "OBC" Certificate in favour of

Rehena Khntun e Pehene Bible C3py of the srid notice wis served to

all the nppliennt alongwith Pehena nntun .Gehenn. Bibi and others.

6. Your petitioner states that in terms of the notice dated

3.11.2014, ennexare t* "P3" herein, petitioner alongwith others

appeared before the Office of the rub-Divisional Officer, Kandi on

19.11.2014 at 2 P.M. and produced the necessary documents wherefrom

trrnspirrd 'Mint Rehena Khntun Rchenn Bibi does not belong to "OBC"

category but on 1901.2014 Myna hearing eould not be (tenanted

7. Your petitioner states that On 3002.2014, petitioner made

an application before the Sub-Divisional Officer, Kandi under

RTI Act and prayed for supply of copy of OM Certificate issued

in favcur of Fehena Dibi. After receiving the application of the

petitioner dated 30.12.2014, on 22.5.20I5 State Public information

Officer, Yandi, supplied cony of "OBC" Certificate issued in favour

of Pehena BIM Sekh. The said certificate was issued on 30.1.2013

in favour of Rehona Eeikh.

Xerox conies of the npelictition of the petitioner dated

30.12.2014 and the "OBC" Certificate issued in favour of Rehena Bibi

Sekh are annexed herewith ns annexure "124" Collectively.

Your netitioner states that it appears from the "OBC" Certi-

ficate issued in favour of Pehena D ibi Sekh on 30.1.2013 food name

of her father is Namit Feith and she belongs to Seikh" community

which is recognized as a "Backward Class". It appears from the

School leaving certificate of said Pehann Yhetun, her father name

is Abdul Rashid Mirzn and she belongs to Mirza community but know-

ing fully well and by practicing fraud and misrepresentation obtained

"OBC" Certificate from the concerned authority ass Mirzn Community

is not under the "OBC" category.

9. Your petitioner states that Famit rah is not actual father

of said Behena BTh1, Respondent no.4 herein nor she belongs to

to Sekh Community. It appears from the School leaving certificate

of Rehena Khatun Rehena Bibi as well as the list of Genealogy of

Rehena Bibi issued by the Prodhan of Kuli Cram Panchaynt found one

Abdul Rashid Mirza is father of said Rehena Khatun @ Rehena Bibi and

she belongs to Mirza Community and the Mirza Conmunity does not ft

fall under "CRC" Category. Therefore the Certificate issued on

30.1.2013 in favour of the respondent noskas "OM" Candidate should

be cancelled.

10. Your petitioner states that on 10.12.2014 hearing was

comnieted before the S.D.O., Kandi in respect of compLaint against

the issuance of OBC Certificate in favour of lichens Khatun @ Rehena

Bibi. But till date the S.L.C. Kandi did not take any final decision

by an order ettextk although the pctitionsr made a remainder applica-

tion on 6.11.2015 before the S.D.O., Kandi about the instant matter,

as such, the act of the concerned authority is arbitrary and malafide.

11. Your petitioner submits that the respondent no.3 is the

appropriate authority under the provision of law for taking final

decision in connection with the application dated 3.11.2014 made by

the petitioners alongwith others, but till date the Respondent no.3

did not pass any order in connection with the said application though

the hearing was completed on 10.12.2014, as such, the act of the

Respondent no.3 in arbitrary, malefide and violated the principle of

natural justice.

12. That being aggrieved by and dissatisfied with the arbitrary

and malafide act of the concerned respondent as aforesaid, your peti-

tioner begs to move this application before this R&M* Court on the

following amongst others •

GROUNDSI

I. For that the Respondent nos3 received the complaint

of the petitioner against the issuance of "OBC" Certificate

in favour of Roberti Khatun @ Rehm' Bibi Wife of Murshid

Nevar Sly" Respondent no.4 herein and initiated a proceeding

fixing the date for hearing on 19th November, 20I4 thereafter

on 10.12.2014 hearing was completed but till date the respon•

dent no•3 herein did not pass any order in the said proceeding

although the petitioner made a remainder by an application

6.11.2015, as such, the net of the Respondent no.3 is arbitra•

rye malafide and violated the principle of natural justic

11. For that the Respondent no.3 being the appropriate

authority to take a final decision on the basis of the complaint

dated 301.2014, annexure "P2" herein but till date no order has

been passed by the Respondent no.3 b in connection with the said

complaint dated 3.11.2014 although the hearing was completed on

10.12.2014 in connection with the said complaint, as such, the

act of the Respondent concerned is whimsical and bad in law.

III. For that the Respondent authorities particularly the

Respondent no.3 herein, withholding his decision in connection

with the complaint made by the petitioner alongwith other on

3.11.2014 annexure "P2" herein without assigning any reason, have

caused failure of justice and bad resulted in gross violation of

the principle of natural justice.

IV, For that the concerned respondent is under obligation

to act within the tour corner of the provision of law but in the

instant Case concerned respondent has acted arbitrary, malafide

and violated the principle of natural justice.

For that MI in the Meta and circumstances of this Case,

the act of the Respondent authorities is arbitrary, malefide and

violated the principle of natural justice.

13. Your, petitioner submits that there is no other alternative,

legal, efficacious, speedy remedy than to move an application under

Article 226 of the Constitution of India and seek appropriate relief,

the relief sought for herein, if grnnted would afford full, adequate

and complete remedy.

144 Your petitioner submits that unless the respondent no.3 is die

rected to take final decision by passing an order, in connection with

the complaint made by the petitioner on 3.11,2014, annexure "P2" herein,

your petitioner will suffer irreparable loss and injury.

15. That all the records of the instant Case are lying with the

respondents and their office are situated outside the original side

jurisdiction of this Hoeble Court.

16. That no other application on the selfsame cause of action was

moved or filed before any Court of law.
