21.02.2014 The petitioner has been serving as a District

Child Protection Officer, Cooch Behar.

09.04.2015 District Child Protection Society had send a

satisfactory performance appraisal report in

respect of the petitioner for the financial year

2014-2015.

14.05.2015 Additional District Magistrate (Development),

Cooch Behar had taken a decision on suo

moto holding that the performance of the

petitioner as the District Child Protection

Officer

15.07.2014 Notification issued by the Director, Social

Welfare, Government of West Bengal.

21.05.2015, : Petitioner along with his ailing wife had made

12.08.2015 and several representations dated praying before

19.08.2015 the concerned authorities for continuation of

his service as the District Child Protection

Officer.

18.12.2015 The Deputy Secretary, Government of West

Bengal of the concerned department had

written a letter to the District Magistrate,

Cooch Behar seeking information pursuant to

the representation of the petitioner

POINTS OF LAW INVOLVED

I. Whether the concerned respondent authorities should have

extended the service of the petitioner as per the relevant

rules and norms prevailing pursuant to the notification

dated 18.06.2015?

II. Whether the concerned respondent authorities should not

have taken such a drastic step in casting aspersion on the

working of the petitioner as the District Child Protection

Officer when the Member Secretary of the District Child

Protection Society being the competent authority had given a

satisfactory nod to the performance appraisal report of the

petitioner?

III. Whether the concerned respondent authorities should have

acted in a fair manner in handling the said issue of the

petitioner?

IV. Whether the concerned respondent authorities erred in law

by depriving the petitioner from his legitimate right

enshrined under Article 14, 16 and 21 of the Constitution of

India?

V. Whether the respondent authorities should have kept in

mind the past record of the petitioner in the field of social

justice prior to casting stigmatic remark on the working of

the petitioner?

VI. Whether the action of the concerned respondent authorities

is highly illegal, unconstitutional arbitrary and violation of

all principal of natural justice and fair play?

VII. Whether the petitioner has been performing his job as the

District Child Protection Officer till date but has been

Child Protection Officer without any remuneration since

April, 2015 and is still continuing to do so by discharging

his duties from the said office regularly?

VIII. Whether the rules laid down is that the extension of service

of the District Child Protection Officer would be based

particularly on the said performance appraisal report. The

said report dated 13.08.2015 is a concocted and fabricated

one as the performance appraisal report for the financial

year of 2014-2015 had already been sent by the Member

Secretary, District Child Protection Society way back on

09.04.2015 and being the competent authority to do so but,

the present report dated 13.08.2015 has not been prepared

in consonance to the rules prevailing thereto. The action of

the respondent authorities in disrespecting a veteran in the

field of social justice by way of casting a stigma on his

personality is nothing but some personal grudge that the

said authorities are trying to meet?

the petitioner abovenamed —

Most Respectfully Sheweth :

1. Your petitioner states that the petitioner is a law abiding and

peace loving citizen of India and resides at the address as

mentioned in the cause title of the instant application.

2. Your petitioner states that the petitioner is a social worker

and had dedicated his life to the betterment of the society.

The petitioner has a diploma in social welfare and a Master in

social work and soon after the completion of the said degrees

the petitioner had made himself available as a program

coordinator of GANA PARISHAD, a national level Non

Government Organization working in the field of Human

resource Development, community organization, rural

development, women and child development and several other

activities. His association with the said parishad dates back

to 1990 and existed till 2001 for a long 11 (eleven) years.

3. Your petitioner states that thereafter the petitioner had joined

MARUGANJ ERA PROGRESSIVE STUDY AND CULTURAL

ASSOCIATION (MEPSCA) as a Director. The said association

catered all the welfare and rural development activities with

support of the panchayat and rural development department,

Government of West Bengal and had worked for the skill

upgradation of the members of the self help groups catering

to almost 300 such groups.

4. Your petitioner states that thereafter since 2002 to 2011 the

petitioner had joined the FAMILY COUNCELLING CENTRE, in

the district of Malda as a Counselor and was posted at Malda.

The said counseling centre is a Central Government aided

social welfare board where all types of family disputes were

solved through proper counseling out of Court. The petitioner

had also served as a regular Member Judge of LOK ADALAT

BENCH conducted by the District Legal Service Authority,

Malda and was also a Member Judge of the Historic LOK

ADALAT BENCH constituted regarding erosion of land and

flood affected people of Manickchak Police Station held on

30.03.2008.

5. Your petitioner states that the petitioner thereafter had

successfully served as a member of the Juvenile Justice

Board in the District of Cooch Behar since 2011 to 2014 with

utmost satisfaction of the concerned authorities. The

petitioner has been a person of utmost dedication towards his

service rendered at all places concerning social welfare and

upliftment of society.

6. Your petitioner states that since 21st February 2014 the

petitioner has been serving as a District Child Protection

Officer, Cooch Behar pursuant to a selection process

involving written examination and personality test on a

contractual basis for a initial period of one year.

7. Your petitioner states that the District Administration of

Cooch Behar had been very pleased with the performance of

the petitioner as the District Child Protection Officer and as

such had send a satisfactory performance appraisal report to

that effect to the concerned Secretary and had sought for

extension of the tenure of the petitioner for a further one year

which is the norms and rules present thereto. 4P\

8. Your petitioner states that the petitioner has been rendering

his service as the District Child Protection Officer with utmost

conviction and satisfaction of the administration which could

well be reflected from the fact that for the second consecutive

year the member secretary of the District Child Protection

Society had send a satisfactory performance appraisal report

dated 09.04.2015 in respect of the petitioner for the financial

year 2014-2015.

with the letter " P/3".

9. Your petitioner states that with utmost shock and surprise

the petitioner had come to learn from the member secretary of

the District Child Protection Society that although the said

member secretary had send a satisfactory performance

appraisal report, the Additional District Magistrate

(Development), Cooch Behar had taken a decision on

14.05.2015 suo moto holding that the performance of the

petitioner as the District Child Protection Officer is not at all

satisfactory and as such his contract may not be renewed and

the department may be informed accordingly.

herewith and marked with the letter "P/4".

10. Your petitioner states that in the said noticed dated

14.05.2015, the District Magistrate had asked the District

Social Welfare Officer to meat the said authority on

27.07.2015 along with the District Child Protections Officer

being the petitioner, when the said authority had a detailed

discussion on the concerned issue in question and had

assured the petitioner to look into the matter and resolve the

said issue as early as possible which had not been done till

date.

11. Your petitioner states that the rule that prevails for the

appointment and termination of the District Child Protection

Officers in the state of West Bengal is that every personnel

shall have a contract of 3 (three) years, extendable by 2 (two)

years on the basis of performance appraisal reports. It may

not be out of place to mention here that the performance

appraisal report send by the competent authority being the

member secretary, District Child Protection Society, Cooch

Behar was a satisfactory one and was recommended to be

accepted and as per the notification dated 15.07.2014 issued

by the Director, Social Welfare, Government of West Bengal,

the petitioner was entitled for such an extension which has

been denied by the Additional District Magistrate

(Development) who does not even have the authority to

prepare a performance appraisal report.

herewith and marked with the letter " P/5".

12. Your petitioner states that no sooner did the petitioner had

received the information about the fact that the service of the

petitioner was not renewed by an order dated 14.05.2015

passed by the Additional District Magistrate (Development)

casting several allegations pertaining to the performance of

the petitioner as the District Child Protection Officer than the

petitioner had answered the charges leveled against the

petitioner. The charges leveled against the petitioner is not

worthy of being established since all of them has been

rebutted back in a manner which is not as stigmatic as the

note sheet dated 14.05.2015 reflects. By the said reply the

petitioner had tried to put through his case before the

Chairperson being the respondent No.2 and director being the

respondent No.3 who had not even asked the petitioner to

show cause on the aspersion made on a person of a good

repute and thereby have infringed the right of natural justice

and fair flay enshrined under the Constitution of India and

thereby acting contrary to Article 14 of the said Constitution.

13. Your petitioner states that the illegal and unconstitutional

activities of the respondent authorities in not renewing the

service of the petitioner as the District Child Protection Officer

had made the Director, Child Rights and Trafficking,

Government of West Bengal to right a letter 20.07.2015 to the

District Magistrate stating that since no information has been

received for renewal of the District Child Protection Officer, so

the term was not extended, but all others were extended for a

period of one more year. It may not be out of place to mention

here that till date the respondent authorities have not found

fit to inform the petitioner in writing that the service of the

petitioner has not been renewed and as such the tenure

would not be extended.

14. Your petitioner states that the respondent authorities had

taken up their task to humiliate the petitioner who has been

rendering his service to the society for last 26 years by

sending a separate performance appraisal report dated

13.08.2015 to the Director, Child Rights and Trafficking,

Government of West Bengal since, the rules laid down is that

the extension of service of the District Child Protection Officer

would be based particularly on the said performance

appraisal report. The said report dated 13.08.2015 is a

concocted and fabricated one as the performance appraisal

report for the financial year of 2014-2015 had already been

sent by the Member Secretary, District Child Protection

Society way back on 09.04.2015 and being the competent

authority to do so but, the present report dated 13.08.2015

has not been prepared in consonance to the rules prevailing

thereto. The action of the respondent authorities in

disrespecting a veteran in the field of social justice by way of

casting a stigma on his personality is nothing but some

personal grudge that the said authorities are trying to meet.

15. Your petitioner states that the office of the District Magistrate

had not stopped their barbarian activities to pester the

petitioner which continued even on 08.12.2015 when the

Director, Child Rights and Trafficking, Government of West

Bengal was written to by the Additional District Magistrate

(LR), Cooch Behar about the fate of their memo dated

13.08.2015 which was the manufactured performance

appraisal report. It is heartening to understand that a state

authority is taking recourse to an action which is de hors the

provisions of the Constitution of India and when the

petitioner had not been officially informed about his tenure of

service till this day.

16. Your petitioner states that the petitioner along with his

ailing wife had made several representations dated

21.05.2015, 12.08.2015 and 19.08.2015 praying before the

concerned authorities for continuation of his service as the

District Child Protection Officer, as the petitioner had come

to the fage end of his carrier and had no other job to

maintain his family as such, the petitioner had sought for

extension of his service but all such prayers had fallen into

the deaf ears of the said respondent authorities.

17. Your petitioner states that the action of the respondent

authority is highly detrimental and malafide to say the least as

the petitioner has not yet been informed about his fate as the

District Child Protection Officer. The petitioner has been

performing his job as the District Child Protection Officer till date but

has been debarred from putting his biometric impression at

the office since August, 2015. The petitioner is acting as

remuneration since April, 2015 and is still continuing to do

so by discharging his duties from the said office regularly.

The Deputy Secretary, Government of West Bengal of the

concerned department had written a letter dated 18.12.2015

to the District Magistrate, Cooch Behar seeking information

pursuant to the representation of the petitioner as to

whether there is any vacancy that exist in relation of a

District Child Protection Officer in DCPU and other in Cooch

Behar, but the same has not been replied till date.

18. Your petitioner states that upon careful completion of the

matter of contractual appointment his excellency the

Governor of West Bengal has been pleased to decide Revision

of Benefits for the contractual appointment pursuant to

notification dated 25.02.2016 being Memo No.1107-F (P),

whereby it has been decided that such appointees on

contractual basis shall continue to be in enjoyment upto the

age of sixty (60) years and shall not be terminated prior to

such age. The remuneration of such contractual appointees

shall be enhanced 3% in every year and shall be entitle to

terminal benefits amounting to rupees 2 lakhs. Therefore,

pursuant to the said notification the petitioner is entitle to

avail said benefits which is the sum and substance of the

intention percolated through the said Memorandum.

19. Your petitioner being aggrieved and dissatisfied with the

action on the part of the respondents concerned the

petitioner begs to move the instant application under Article

226 of the Constitution of India on the following amongst

other:-

GROUNDS

For that the concerned respondent authorities should have

extended the service of the petitioner as per the relevant

rules and norms prevailing pursuant to the notification

dated 18.06.2015.

H. For that the concerned respondent authorities should not

have taken such a drastic step in casting aspersion on the

working of the petitioner as the District Child Protection

Officer when the Member Secretary of the District Child

Protection Society being the competent authority had given a

satisfactory nod to the performance appraisal report of the

petitioner.

HI. For that the concerned respondent authorities should have

acted in a fair manner in handling the said issue of the

petitioner.

IV. For that the concerned respondent authorities erred in law

by depriving the petitioner from his legitimate right

enshrined under Article 14, 16 and 21 of the Constitution of

India.

V. For that the respondent authorities should have kept in

VI. For that the action of the concerned respondent authorities

said authorities are trying to meet.

20. Your petitioner states that the competent authority time and

again assured your petitioner that necessary steps is being

taken to resolve the issue in question and requested your

petitioner not to disclose the facts as stated in proceedings

paragraphs of the petition to any one and also further

requested the petitioner not to initiated any legal proceeding

against the authority in respect of his grievances. On good

faith your petitioner was awaiting for the decision of the

authority but till date the said authorities are sitting tight

and playing a role of silent spectator. On one hand they are

not taking any steps as regards the grievances of your

petitioner on the other hand the said authorities are going to

advertised the said post which the petitioner is holding till

date. It goes without saying that till date the competent

authority has not terminated the service of the petitioner.

Now it appears that from the acts arid deeds of the said

competent authority that very soon they may fill up the post

of the petitioner through advertisement and as such your

petitioner has no options but to initiate appropriate legal

proceeding against the competent authority before this

Hon'ble court in order to refers the legitimate grievance of

the petitioner.

21. Your petitioner states that the records of the instant case are

lying outside the ordinary original jurisdiction of the Hon'ble

Court.

22. Your petitioner humbly submits that there is no other

remedy available to it and the prayers as made herein, if

allowed shall redress the petitioner's grievances effectively.

23. Your petitioner submits that the petitioner made due

representations and therefore the question of filing a

demand for justice would be an empty formality.

24. Your Petitioner states that due to paucity of time some facts

may not have been incorporated and your petitioner craves

leave to file supplementary affidavit and your petitioner

further crave leave to produce and refer to relevant papers/

documents at the time of hearing by way of filing a

supplementary affidavit.

25. That this application is made bona fide and in the interest of

justice.

(2) Sri Krishnendu Chosh, Assistant cum Data Entry Operator Performance is satisfactoryj

3) Sri Makhan Chandra Roy, DCPO: In terms of order of appointment of District Magistrate, Cooch

Behar vide memo no SW/113/1-209 dated 20.02.2014 (Flan AlSri Malthan Chandra Roy has joined

as District Child Protection Officer(DCP0) on 21.02.2014(Flac B). The contract of appointment in

terms of aforesaid order of District Magistrate as up to 20.02.2014. Later Director of Social Welfare,

vide his office memo no 2903/SWD dated 04.08.2014F-1a° C) had communicated to DSWO

regarding extension of contract period of DCPS staff up to 31.03.2015. The letter was however not

brought to my notice or to the notice of District Magistrate.

The file-was put up by DCPO/DSWO on 09.04.2015 i.e after contract period of DCPO was

over. It is however learnt that DCPO- has been attending office from 01.04.2015 without permission

of the authority.

Duties assigned to DCPO in terms of letter of eneagement may kirdly be seen at (Fla° & till date

performance of DCPO is noted hereinunder.

1) Under ICPS guideline DCPO is the Chairman of the Home Management Committees. However

till 31.03.2015 only 6 Home Management Committees out of 14 Homes formed. No further

meeting of committees held so far.

2) In terms of Section 34(3) of the Juvenile Justice(Cue & Protection of Children) Act, 2000 & in

compliance of the order of Honourable Supreme Court of India in writ petition (CH) No 102 of 2007 all Child Care Institutions are mandatorily to be registered under the Act. But till date no action has been taken by the DCPO to get the institutions regiutted.

3) The DCPO was supposed to conduct month!) review meeting with all the stakeholders under ICPS guideline including representatives of communities & local bodies as well as Media at the district level. But till 31.03.2015 not a single meeting was convened by him.

4) No programme for sensitization & capacity building of stakeholders has not been done during

the entire period.

5) No advocacy awareness camps for community awareness done during the period. In Rats Mela

6) No cases of Sponsorship done during the period. At :ay direction Protection Officer, NIC has enquired in to 44 applications out of which 21 cast's were sanctioned & fund transferred to the

account of the beneficiaries'in April,2015

7) All the Block Level Child Protection Committees & Municipality Level Child Protection Committees formed but no further meetings were held.. And out of 128 Village Level Child

Sri, goy is in the habit of taking decisions on his own without informing the appropriate

authority. He bas sent Project Implementation Plan(PIP) to the State without approval of

DCPC. He has, on several occasions taken decisions on his own, in financial matters also without

approval of district authority. (has printed awareness materials, has hired vehicles without

approval). Sri Roy has never bothered to inform the authority about discussions held in state level

meetings/workshops & decisions taken thereof,( which he had attended officially ), regarding

implementation of child protection schemes at district level

On 09.012015 at 06.30 P.M I, along with BDO, Cooch Behar II had visited Patlakhawa

Bhagini Nibedita Manasik Pratibandhi Abasik Vidyalaya, a redential school for mentally

retarded boys & girls. During visit we came to know from the inmates that a Mentally

Retarded(MR) boy, admitted in the Institution by the order of CWC, Cooch Behar on

20.022014 went missing from the Institution three days back The matter was informed by

the Institution authority to the DCPO on that very day. But DCPO had neither informed the police nor the district authority. Finally on my instruction the Institution authority had lodged a general diary at the Kotwali P.S. on 10.01.2015 i.e after 3 days the child went missing. This shows callous & negligent attitude of the DCPO regarding child protection.

From above stated facts it can be said that the performance of Sri Makhan Chandra

Roy as DCPO is not at all satisfactory & his contract may not be renewed & Department may

be informed accordingly.

It may be mentioned here that there were several complaints against Sri Makhan Chandra

Roy when he was a member of Juvenile iusti,:e Board. Cooch Behar. Report of

Sub: Prayer for continuation of service as DCPO, Cooch Behar.

Respected Sir,

1, Sri Makhan Ch. Roy, District Child Protection Officer (DCPO) who was joined on 21.02.2014 in DCPS, Cooch Behar set forth the following facts in support of my prayer that:

i) • From the beginning I have not get proper importance as DCPO from the present ADM (D), Cooch Behar.

ii) Regarding implementation of ICPS matter she used to take decisions from her end only, she did not discuss anything with me.

iii) Most of the Note Sheets for smooth running of the DCPS had been rejected or kept pending by the ADM (0) which had been prepared by DCPO and submitted through the DSWO. All the proposals as per ICPS uuideline which are necessary for proper functioning of DCPS were very much neglected from her side. She rejected proposals for functioning of Cradle baby Points at all PHCs, Block, Sub-Division and District Hospitals and all Nursing Homes within the District. Besides, a survey work regarding Situational Analysis and Mapping of the District also very vital work but she rejected the proposal which was submitted by DCPO through the DWO. It is mentioned that a fund of Rs. 3,00,000/- was received from SCPS-West Bengal which is still in hand.

iv) As per resolution taken in the meeting of District Child Protection Committee, Cooch Behar held on 11-07-2014. a School Let el Campaigning on ICPS ()tight to be organized at 30 Schools in this District but the ADM (D) rejected the Note Sheet prepared for this purpose by DCPO.

v) Approved T.A of DCPO was not released intentionally. No T.A for official tour of DCPO at Kolkata has yet been sanctioned.

vi) As per ICPS Guideline different type of Committees were formed, like i) District Child Protection Committee (DCPC). ii) Block Level Child Protection Committee (BLCPC) [12 Blocks in Cooch Behar District], iii) Municipality Level Child Protection Committee (MLCPC) [6 Municipalities in Cooch Behar District], h) Village Level Child Protection Committee (VLCPC) [28 G.Ps formed out of 128 G.Ps in Cooch Behar District], v) Ward Level Child Protection Committee (WLCPC). [Under Process], vi) Home Management Committees (HMC) [6 HMC formed], Home Inspection Committee (HIC) formed, viii) Sponsorship & Foster Careljt; Approval Committee (SFCAC), ix) Adoption Committee for SAA, x) District '; ' Placement Committee for Pre-Adoption, xi) ICPS Stakeholder Monthly Review Committee etc.

vii) After approval of the ADM (0). Cooch Behar regarding Constitution of Homeilbstel Management Committee for different Home/Hostels under other departments in respect of DCPS, Cooch Behar the DCPO has to make visit at each Institution run by various Departments of the Got i. and NGO/Private Institutions (Total=46 nos.) in. this

District, but she rejected the Note Sheet to avail vehicle. As a result, the CCI registration and Home Management Committee formation work which is mandatory for, all Child. Care Institution (CCI) as per Section-34 (3) of JJ Act. 2000 are hampere44.,t•

viii) 'Due to neii'ipproval of vehicle, no follow up activity regarding BLCPC/MLCPC/ • waciwinc could be done by DCPO.

ix) The funds of DCPS are being utilized without knowledge of DCPO. Major portion of "• Contingencies/Advocacy expanses are being spent for meeting expanses other than

DCPS matter. x) A computer set was allowed to DDRC, Cooch Behar from DCPS Contingencies fund

where as DCPS has no computer set till today. xi) After one year from the date of joining of DCPO a small size (7x7 tit) chamber was

approved by the ADM (D) and which is being used by DCPO for 2 months only. But after visit to Social Welfare Section on 15.05-2015 in absence of the DSWQ/DCP0 she ordered to abolish the chamber of DCPO.

xii) Till today DCPS, Cooch Behar is being functioned with 3 personnel (DCPO, PO (MC) and ADEO) out of 14 staff sanctioned.

xiii) The ADM (D) did not give permission to participate in any awareness programme on ICPS even' organized by CHILDLINE.

xiv) I have been working as DCPO with full satisfaction of the authority since my joining without getting any show-cause.

xv) . My Appraisal Report in prescribed Format had been submitted to the ADM (D), Cooch Behar through the DSWO on 07-04-2015 for renewal of my service; but after one and a half months she directed me verbally through the DSWO on 19-05-2015 morning not to continue my office.
