I. Whether an examiner is duty bound to apply his mind while
correcting an answer script of a candidate , Therefore the failure to
perform the duty on the part of the Respondent authorities has
resulted in gross violation to the Petitioner's Right to a good service
carrier as well as Right to Life , enshrined under Article 21 of the
Constitution of India .
II. Whether the Rule of fair play demand that a candidate is
awarded appropriate marks deserving his performance . In the
instant case , the Petitioner upon receipt of the copy of the answer
scripts has verified the same with authorities on the subject such
as books , texts , etc , wherefrom it is evident that he was not given
marks matching and /or deserving his performance due to non
application of mind on the part of the Examiner , resulting in gross
violation to the Petitioner's Right to be appointed in a better post of
a Headmaster .
III. Whether the answer scripts have been tallied by the
Petitioner with authorities on the subject such as books , texts
,commentaries , wherefrom it is evident that the answers referred to
above are cent percent correct which would leave no other option
for the examiner than to award much more marks than has been
awarded to him .

of the Petitioner above named

SHEWETH:
1. The Petitioner is a law-abiding citizen of India
and is permanently residing in the address given in
the cause title hereinabove.
2. By an advertisement the West Bengal School Service
Commission announced the 12th Regional Level Selection Test
2012, for the post of head master in all recognized added non
Government Higher Secondary Schools in West Bengal. The

applied for the said examination. Copy of the said
advertisement is annexed hereto and is marked as Annexure
S

3. In the said advertisement at paragraph no. 9 it was
stated that letters of personality test would be issued to the
selected candidates on the basis of academic professional
qualification and teaching experience and also marks
obtained in Paper-I and Paper-II.
4. The Petitioner states that 25 marks was allotted for
professional qualification. The evaluation of academic
qualification or professional qualification for selection to the
post of head master/head mistress in school had been laid
down in table 2 at the website of the Respondent Authorities.
5. As per the said advertisement, the written examination
consisted of Part-I and Part-II. In Part-I there is three parts-
Part-A, Part-B 8v Part-C each consisting of 15 marks. Part-II
was of 10 marks consisting of 20 multiple choice objective
questions.
6. The Petitioner accordingly appeared in the said written
examination under Roll No.- 312021200822, Registration
No.- 31202120000822 and was highly optimistic that he
would score good marks in the said written examination.

Copy of the said admit card is annexed hereto and is marked
as Annexure "P-2".
7. Finally by a letter bearing memo No.764 (406/RSSC
(SR) dated December 26, 2013, the respondent authorities
directed the petitioner to appear for the personality test. Copy
of the said letter is annexed hereto and is marked as
Annexure "P-3".
8. Ultimately the respondent authorities published the
final result and on the basis of the addition of marks
obtained in the Personality Test, Academic Qualification and
written test, the petitioner's name did not even appear in the
waiting list . Thus the Petitioner was not even called for
counselling
9. Since the Petitioner was along confident that he had
actually obtained much more marks than that was awarded
him, the Petitioner applied for the answer scripts of Paper I,
consisting of all total 45 marks pursuant to such application,
the Respondent authorities supplied a copy of the answer
scripts. Copy of the said answers script is annexed hereto
and is marked as Annexure "P-4".

I la. The Petitioner states that he was shocked to see that
though he had given correct answer in Question 1(a) , in Part
A ,Paper I , yet no mark was awarded to him . Again in
Question 3 in Part A ,Paper I , though the question was
correctly answered , yet out of total 1 1/2 mark only 1/2
mark has been given to the Petitioner . In Question no 1 in
Part B ,Paper I though the Petitioner answered the question
correctly , yet only one marks was awarded out of total 3
marks . In Question no 2 in Part B ,Paper I , the Petitioner
was asked the staff pattern in a school . The Petitioner had
answered the question on the basis of the standard pattern
laid down in law , by the head master manual , yet only 1 '/2
mark was awarded to the Petitioner . Further in Question 3
in Part B ,Paper though the Petitioner according to subjective
standard ought to have been given more marks in the letter
written by him. yet the examiner had arbitrarily awarded him
3 marks out of total seven marks . Finally in Question no 1
in Part C ,Paper I , wherein the Petitioner was asked to write
a complaint , though in subjective standard , the Petitioner
ought to have been given more marks , yet he has been given
only 2 marks out of total seven marks .

11b. The Petitioner categorically states and asserts that a
bare perusal of the text , which is considered an authority in
the subject would reveal that the Petitioner ought to have
been awarded more marks than has been awarded to him .
In the instant case the marks awarded by the examiner is far
less than what the Petitioner deserves . Hence the Petitioner
has a prima facie case of non application of mind by the
examiner ,which has resulted in gross violation of his right to
a good carrier . Thus in the instant case where the
Petitioner's carrier is at is at stake , if not interfered by an
interim order of appointment of an independent Examiner for
the purpose of evaluating the said answer script , the
Petitioner shall suffer irrepairable loss and injury . Copy of
such text is annexed hereto and is marked as annexure P5 .
12. The Petitioner states that in reply to the Petitioner's
query under the Right to Information Act , 2005 , the
Respondent authorities have informed the last candidate who
was called for counseling had received 18 marks in Paper I
and 6.83 in personality test , whereas the marks awarded to
him in Paper I is 16 and 6.5 in the personality test . The
Petitioner thus asserts that if the aggregate of the marks

obtained by him in personality test, academic qualification
and Paper I which is evaluated by an independent examiner
is taken into account then his marks would certainly be more
than the last candidate who was called for counseling . Copy
of the reply is annexed hereto and is marked as Annexure PG.
13. The Petitioner states that an examiner is duty bound
to apply his mind while correcting an answer script of a
candidate , Therefore the failure to perform the duty on the
part of the Respondent authorities has resulted in gross
violation to the Petitioner's Right to a good service carrier as
well as Right to Life , enshrined under Article 21 of the
Constitution of India .

16. Being aggrieved by and/or dissatisfied with Arbitrary and
illegal award of marks to the Petitioner (Roll No.-
312021200822, Registration No.- 31202120000822 )- in Paper-I in12)11 Regional Level Selection Test 2012, for the post
of head master in all recognized added non Government
Higher Secondary Schools in West Bengal , the Petitioner
begs to move the following amongst other;
GROUNDS
I. For that that an examiner is duty bound to apply his mind
while correcting an answer script of a candidate , Therefore
the failure to perform the duty on the part of the Respondent
authorities has resulted in gross violation to the Petitioner's

Right to a good service carrier as well as Right to Life ,
enshrined under Article 21 of the Constitution of India .

17, Your Petitioners state that the records of the case are
lying in the office of the Respondent authorities all within the
appellate side jurisdiction of this Hon'ble Court.
18. Your Petitioners state that there is no other adequate
efficacious alternative remedy available to your petitioners
and the reliefs sought for herein, if granted, would offer
complete remedy.
19. Your Petitioners state that your petitioner has not moved
any other or similar application in respect of the self-same
facts or cause-of-action earlier before any Court.
20. The Petitioner states that if an independent examiner is
not directed to evaluate the answer scripts being annexure P4
to the instant application , and the marks given to him his
added to the marks obtained by the Petitioner in academic
qualification and personality test , is not considered for his
selection in the 12th Regional Level Selection Test 2012, for
the post of head master in all recognized added non
Government Higher Secondary Schools in West Bengal , he
shall suffer irreparable loss and injury .

RULES FOR SELECTION TO THE POST OF TEACHERS

Rule - 5.Additional Essential qualification of candidate. - A candidate willing to be selected as a Teacher in any school, having Bengali or English or Hindi or Nepali or Oriya or Telegu or Santhali or Urdu as the medium of instruction, must have Bengali or English or Hindi or Nepali or Oriya or Telegu or Santhali or Urdu, as the case may be, as first or second or third language at any of the Secondary or Higher Secondary or Graduation level-
(a) at secondary level of the Board or equivalent, or (b) at higher secondary level of the Council or equivalent, or lc) at any subsequent higher level of education in that language paper.
Rule - I A. Bar on recommendation.- Notwithstanding anything contained in these rules, a Regional Commission shall not recommend the name of a person under rule 17,-
(a) who, at the time of submission of application or after submission of application, is appointed
to the post of a Teacher in a School on the basis of recommendation made by the West Bengal Regional School Service Commission of any region and continues his service as such Teacher, but has not completed continuous three years' approved service in the said post ;
(b) who, while in-service, having obtained required degree for being considered for the post
applied for fails to submit before the Regional Commission the requisite document of his approved study leave, or any kind of leave for the purpose of relevant higher studies, or permission from the appropriate authority for prosecuting the studies for the said degree.

I. Paper — I question paper is divided into 3 Parts — Parts A, B.& C. This question-cum-answer. booklet consists of Part-C only.
2. Answers are to be written in the space provided under each question, and-nowhere else.
3. At the end of the examination, hand over this booklet to the Invigilator.
4. Entire examination of the Candidate will be cancelled if anything is written in the space other than meant for the candidate.
5. No Candidate shall be allowed to leave his/her seat or the examination hall/room till the end of the examination without permission of the Invigilator.
6. Before beginning to answer the paper, the Candidate should write ftis/her Name, Roll No. and Regn. No. in the space provided in the Question-cum-Answer Booklet and nowhere else.
The Candidate should read carefully the instructions appearing on the cover pages of the Question-cum-Answer booklet and check that the booklet supplied. to him/her-is not defective and if so, may procure another copy from the Invigilator in lieu of the first one. The Question-cum-Answer booklet should be checked with reference to page number, serial number of the questions, serial number of the booklet.
If a Candidate writes his/her name or puts any special mark at any place in- the-Question-cum-Answer booklet which may disclose, in any way, the identity of the Candidate, he/she will render himself/ herself liable to disqualification.

9. Any Candidate found guilty of using unfair means of any nature in the examination hall/room shall be liable to be disqualified.
