THIS AGREEMENT made and entered into on this day of 20th

April, 2O2l between Telangana State Mineral Development Corpora-

tion Limited., a Company Registered under Companies Act, 2013 and

having its Registered Office at Rear Block, 3'd Floor, HMWSSB

Premises, Khairtabad, Hyderabad-500004, represented by its General

Manager (CLA) Smt G. Deepti, hereinafter referred to as *TSMDC" and

authorized vide TSMDC/GM(S&M) / SAND/EXC/Alipur / 2021 /33, note

file Nos.15 & 16 n.f., (which expression shall, unless excluded or

repugnant to the context or the meaning thereof, be deemed to include

sand from Block Alipur / Kurumurthy over an extent of T.T4 Ha atProposed check Dam Sites at Alipur / Kurumurthy village of c. c.Kunta Mandal, Mahabubnagar District and transport the samequantity of sand to nearby Stocrryard ( Bidder has to identify stockyard near to motorable road ) and again loading of sand into theLorries at stoclryard at Alipur / Kurumurthy village of c. c. KuntaMandal, Mahabubnagar District of relangana State for a period ofTwelve ( L2 ) months from the date of agreement of this contract.

All terms & conditions, all clauses of tender document and allother conditions as mentioned in the above documents havebeen agreed to by the parties and the same are binding on boththe parties.

Conditions of contract :

i) scope of the work : The contractor shal excavate sand1,08,000 CBM from Block Alipur / Kurumurthy over anextent of 7.74 Ha at proposed check Dam sites at Alipur /Kurumurthy Village of C. C. Kunta Mandal, MahabubnagarDistrict and transport the same quantity of sand to nearbystockyard ( Bidder has to identify Stock yard near tomotorable road ) and again loading of sand into the Lorries atStockyard at Alipur / Kurumurthy Village of C. C. KuntaMandal, Mahabubnagar District. The contractor shallextract the sand within the assigned Geo-coordinates asspecified in the tender document. The contractor shall notencroach upon in adjacent areas other than assigned areas.If specified geo-coordinates are violated by the contr actor fbidder his agreement will be cancelled without any notice,and the penalty w,l be revied as deemed fit by the TSMDC.

requirements as stated therein prescribed by raw, or asffi&y' from time to time be prescribed by the project oflicerto the need that proper work sharl be done and that thesafety and health of the employees and of the localcommunicates may be safeguarded by the contractor. Incase such regulations and orders are not observed by thecontractor, they may be enforced by the VC&MD / projectOfficer at the contractor,s expenses the same may berecovered from his payable amount by TSMDC.

b' The contractor shall issue Identity card / Gate passes toall his / their employees ( having their photographs ).Further, the drivers, once deployed on Heavy Earth

Moving Machinery will not be changed without priorpermission. only those drivers shall be all0wed who havevalid driving license.

c' The contractor shalr be responsibre for imparting requiredVocationar Training and the contractor shall beresponsible for the safety of his / their employees in allphases of work and shall provide and enforce the use ofsuch safeguards, safety boots, shine guards, gloves,respirator, safety belts, helmets, goggles and other safetydevices as may be required by the regulations for the timebeing in force. The contractor shall promptly reportserious accidents to any of his / their employees to thevc&MD / project officer and shall make himselfarrangements to render all possible assistance to suchemployees.

All portions of the work sha, be maintained in a neat,clean and sanitary condition at all times. Toilet fac,itiesshall be provided by the contractor for use of employeeson the work.

The contractor shall 0btain all necessar5r licences, permits,approvals, etc., before the commencement of work asrequired under Telangana state sand Mining Rules, 20L5,for the execution of the work and of anything required to bedone to execute the work.

ix) Laying of Roads :

It is the sole responsibility of the contractor to ray / formrequired road from stockyard to nearby connectivity road forplying of Lorries / vehicles, any incidentar expenditure

submit his rate to the vc&MD prior to commencement ofsuch item of work for consideration and sanction byTSMDC. If the contractor sha, commence such item ofwork or incur any expenditure in connection therewithbefore the rate therefore shall have been determined asherein before mentioned the contractor sha, be entitred tobe paid in respect of the work carried out or theexpenditure incurred by him prior to the date ofdetermination of the rate as aforesaid only on the basis ofsuch rate as may be fixed by TSMDC. If the nature oramount of any change or variation shall be such that inthe opinion of the VC&MD the rate of any item in theschedure of quantities and rates is rendered unreasonableor inapplicable, the vc&MD shalr fix such other rate ashe may be in the circumstances, consider reasonable andthe contractor shall have no claim for any compensationon account of any profit or advantage that might haveoccurred to him from execution of the work in furl and /or without change or variation as aforesaid.

,' The contractor strictly prohibited from over loading sandagainst the loading capacity of the vehicle. Any vehiclefound with over l0ading ( 20 ) times penalty will levied onthe contractor on the sand cost, which was overloaded. Ifsecond time any lorry found with over loading theagreement shall be cancelled without any notice.

e' A, Marpractices are prohibited in the sand reach /stoclryard any Marpractices noticed in the stockyard readsto imposition of penalty at the discretion of rsMDC, andcancelation of agreement with contractor.

be closely monitored. T'MDC reserves the right to forfeitthe Performance security Deposit in case of excavation isless than the half of the target ( . SO% ) quantities ofrespective month and the agreement is liable totermination without any further notice.

b' The TsMDc reserves the right to set off all the lossesincurred by it against the security Deposit and runningbills, if necessary.

c. The TSMDC reserves the right to suspend / interrupt /terminate the work at any time due to rabour unrest and/ or due to unforeseen circumstances when operauonsare compelled to be stopped and in such cases thecontractor will be paid no compensation or damages oridle charges by TSMDC.

d' The TSMDC authorities sha, have the right to terminatethe contract on account of any violation of t,.e terms andconditions, breach of terms of the contract and in suchevent' the contractor shalr be responsible for alr damages,which accrue due to such termination.

e' The TSMDC reserves the right to terminate the contractby giving ( 01 ) one month notice in writing in the event ofany change in the policy in respect of sand mining projectfrom Block Alipur / Kurumurthy over an extent of Z.Z4Ha at proposed check Dam sites at Aripur / Kurumurthyvilrage of c' c. Kunta Mandal, Mahabubnagar Districtand transport the same quantity of sand to nearbystoclryard ( Bidder has to identify stock yard near tomotorable road ) and again loading of sand into theLorries at Stoclryard at Alipur / Kurumurthy Village of C.C. Kunta Mandal, Mahabubnagar District and / or
