1. The sitting commenced at 9.10 a.m.

2. Having noted that 48 Members of Parliament were present, the Speaker suspended the sitting at 9.12 a.m in order that the Honorable Members meet the Head of State.

3. The sitting resumed at 9.50 a.m.

4. The Hon. Ps. Allen NAFUKI, Member for Other Southern Islands, said the prayer.

5. The Hon. Speaker informed the Hon. Members that after the Leader of Government’s reply and that of the Leader of the Opposition to the Presidential address, the House would decide on how to observe the recent death of two former MPs. He then invited His Excellency Fr. John Bani to present his opening address.

6. The Head of State, His Excellency Fr. John Bani gave his opening address (text appended).

7. The President of the Republic declared that First Ordinary Session of Parliament open.

8. The sitting was suspended from 10.10 a.m to 10.35 a.m.

9. The Donald KALPOKAS, Prime Minister, in reply to the President’s Speech declared that he agreed with the President’s idea that 1999 was the last year before embarking into the next millennium and that ideas had to be changed before that. He agreed with the Head of State who reminded the house of the principles of morality to be adhered to as stated in the Preamble of the Constitution and which reflected the principles of Christianity. Referring to CRP, the Head of Government felt that changes were needed in the way to look at things even if this was not easy but that it was the only way to progress in our society nowadays. He added that the system of businesses should be reviewed especially regarding cooperatives, which are factors for development and improvement of life in the rural areas and reminded that, with education and youth, there were equal chances for Francophones and Anglophones. Concerning the recent tragedies experienced by Vanuatu in the last month, he replied that the house should wait for the results of the Commission of Inquiry.

10. The. Leader of the Opposition, Hon. Morkin STEVENS, responded to the President’s Speech saying that Vanuatu was independent and that it should not depend on decisions made by other countries as it had been done during colonial times. He added that the economy of the country was not bright and that unemployment rate was high. He said that actually there was an economic crisis in Vanuatu.

11. The Hon. larris NAUNUN, Member for Tanna, raised a point of order and emphasised that the Leader of the Opposition should answer the President’s Speech instead of making a statement.

12. The Hon. Leader of the Opposition stated that the Comprehensive Reform Program completely paralyzed Education, Health and other government services and added that the Commissioner of Enquiry mentioned by the Prime Minister. Referring to Vanair aircraft and MV Latua disasters he said that the Commission would not solve the existing problems.

13. The Hon. Prime Minister moved that the sitting be suspended for an hour to pay tribute to the recently deceased MPs Walter H. LINI, Joel ANTAS, J. CALO and Josiah BAHAVUS.

14. The Leader of the Opposition, Hon. Morkin STEVENS, supported the Prime Minster’s motion.

15. The Hon. Maxime CARLOT, Member for Port Vila, felt that the Secretariat of Parliament should provide MPs a complete list deceased MPs as there were others also who had passed away before the sitting was suspended for half an hour tribute.

16. The motion to suspend the sitting as tribute to the deceased MPs was approved unanimously.

17. After a minute of silence, the sitting was suspended at 11.00 a.m and resumed at 2.10 p.m.

18. The Hon. Iarris NAUNUN, Member for Tanna, raised a point of clarification as to why the Opposition side did not attend Monday’s sitting. He wondered if the Opposition side had provided the Chair with good reason to justify their absence.

19. The Hon. Speaker explained that Members had the right to attend sittings as they wished. He said that the Speaker did not have to insist on a justified reason.

20. The Hon. Jacques SESE, Leader of Government Business, presented the order of bills to be presented.

BILL FOR THE FOREIGN INVESTMENT (AMENDMENT) ACT NO. OF 1999

FIRST READING

21. The Hon. Willie JIMMY, Deputy Prime Minister and Minister of Trade, Tourism and Business Development, introduced the Bill and moved that it be read a first time.

22. The Hon. Morkin STEVENS, Leader of the Opposition, declared that the Opposition would abstain because some of the amendments were not in line with the idea of protecting Ni-Vanuatu’s rights to invest in reserved sectors.

23. The Hon. James BULE, Member for Ambae, agreed that the Principle Act had the unanimous support of the House of the House but stated that parts of the Bill were not clear. He said that it was important to establish the long-awaited Ni-Vanuatu Business Development Centre so as to enable Ni-Vanuatu’ access to capitals to start business ventures prior to opening door to joint ventures.

24. The Hon. Willie JIMMY, Deputy Prime Minister and Minister of Trades, clarified that the Bill concerned foreign investments. He explained that the purpose of the Bill was to fill in some loop holes in the Principle Act. He added that a classic example saw a recent court ruling in favour of a foreigner who sold his business in the international market after his failed attempts to sell it locally as provided in the Principal Act.

25. The Hon. Sato Kilman, Deputy Leader of the Opposition and Member for Malekula, was of the view that the new section governing the six months period for environment impact assessment would hinder investment.

26. The Hon. Maxime CARLOT, Member for Port Vila, agreed that the Government should cover loopholes in the Principal Act but objected to the Government’s

decision to introduce the Bill merely because of foreigner won his court case. He also expressed concern that the Government was amending laws that were introduced by the previous government a year ago. He concluded by asking the Minister to provide figures on how many foreign investors have registered and how many had commenced operation.

27. The Hon. Jimmy N1CKLAM, Member for Tanna, supported the principles of the Bill since it would cover loopholes in the Principal Act. He said that Vanuatu had to remain competitive against other Pacific nations in attracting more foreign investors.

28. The Hon. Willie JIMMY, Minister of Trades and Deputy Prime Minister, responded that figures requested by Hon. Maxime CARLOT would be provided later and explained that the six month period required for an environment impact assessment fall within the time-frame the investor is required to commence operation as of the date of issue of an approval certificate. He clarified that the purpose of the Bill was to allow joint venture companies between Ni-Vanuatu and foreign investors in reserved sectors. He pointed out that a classic example was the kava industry where foreigners were providing financial backing to Ni- Vanuatu illegally.

29. The motion that the Bill be read a first time was agreed with 26 votes in favour and 21 abstentions.

COMMITTEE STAGE

Section 1 “INSERTION OF NEW SECTION 1A”

30. The Hon. Barak T. SOPE, Prime Minister and Member for Efate, expressed concerns about the way this Bill would permit foreign investors to enter into joint ventures or partnerships with Ni-Vanuatu and companies incorporated in Vanuatu in reserved investments.

31. The sitting was suspended at 3.00 p.m resumed at 3.20.p.m.

32. The Hon. Barak T, SOPE, Member for Efate, questioned whether citizens of Vanuatu would be allowed to enter into joint ventures with foreign investors in reserved areas of investment.

33. The Hon. Willie JIMMY, Minister of Trades and Deputy Prime Minister, responded by stating that the Amendment Bill would permit negotiations between citizens of Vanuatu and foreign investors to enter into joint ventures or partnerships in both reserved and non-reserved areas of investment.

34. The Hon. Maxime CARLOT, Member for Port Vila, expressed doubts about the right for foreign investors to enter into joint ventures in reserved areas of investment.

35. The Hon. Willie JIMMY, Deputy Prime Minister and Minister of Trades, declared that foreigners and every right to set up businesses n non-reserved areas of investment without any obligation to enter into joint ventures with Ni-Vanuatu.

36. The Hon. Maxime CARLOT, Member for Port Vila, maintained his stand by stressing that foreign investors should not be allowed at all to enter into joint ventures or partnerships with citizens of Vanuatu or companies incorporated in Vanuatu in reserved areas of investment.

37. The Hon. Morkin STEVENS, Leader of the Opposition, asked whether the Act on Foreign Investment would also apply to provinces as none of the laws covered foreign investment.

38. The Hon. Willie JIMMY, Deputy Prime Minister and Minister of Trades, replied that this law would be applicable throughout Vanuatu and that any foreign investor who wished to invest within a Province was obliged to abide by this law.

40. Section 2, “AMENDMENT OF SECTION 2”. was approved on division.

Section 8 “AMENDMENT OF SECTION 10"

46. The Hon. Barak T. SOPE, Member for Efate, felt that the Foreign Investment Board would take on the responsibility of issuing land leases to foreign investors whereas this was the responsibility of the Ministry of Lands and asked for the reasons as to why the Ministry of Lands was deprived of this responsibility.

47. The Hon. Willie JIMMY, Deputy Prime Minister and Minister of Trades, felt that the comments made by Hon. SOPE were out of context of the bill and explained that the F.I.B. would not issue and leases but that the investor had to obtain a land

lease on which he waned to invest in order to avoid conflicts after the investment project had started. He added that the investor would be issue a land lease on which he wanted to invest in order to avoid conflicts after the investment project had started. He added that the investor would be issued a land lease according to the provisions of the Land Leases Act of 1983 and the Land Reform Act of 1981.

48. The Hon. Barak. T. SOPE, Member for Efate, expressed the opinion that the custom landowners were no longer protected because of Section 8 as the foreign investors would not only invest but also take land from custom owners.

49. The Hon. Vincent BOULEKONE, Minister of Internal Affairs, felt that Hon. SOPE was only expressing his personal concerns and assured that the Ministry of Lands would remain the issuing authority of land leases.

50. The Hon. Willie JIMMY, Deputy Prime Minister and Minister of Trades, stated that all would depend on the Government in power and its interpretation of the provisions of this Section 8 concerning the issue of leases and its responsibility to issue land leases.

51. The Hon. Maxime CARLOT, Member of Port Vila, said that the provisions of Section 8 might leave room for deprivation of custom owners of their land rights.

52. Section 8 was approved on division.

53. Section 9, “AMENDMENT OF SECTION 12”. was approved on division.

Section 10 “AMENDMENT OF SECTION 15”

54. The Hon. Barak T. SOPE, Member for Efate, asked what kind of technical advice the Director of Lands Department would provide.

55. The Hon. Speaker asked whether the house could continue with discussions of bill up to 4.30 p.m.

6. The Hon. Barak. T. SOPE, Member for Efate, felt that a review by the Board on the financial viability of a project would contradict the notion of a no- stop shop as provided for in the Principle Act. He asked the Government to explain why the assistance of a qualified financial specialist was required. He wondered if there has been any consultation with local chiefs and customs landowners on land issues.

7. The Hon. Willie JIMMY, Deputy Prime Minister and Minister of Trades, answered that the assistance of a qualified financial specialist would prevent possible scam. He said that the inclusion of the Director of Lands in the Board would ensure that land laws had been complied with and that he could provide information on a particular land to the Board.

8. The Hon. Morkin STEVENS, Leader of Opposition, wanted to know why two boards had been added to the existing boards. He felt that the representative of the Reserve Bank of Vanuatu should be allowed into the Board.

9. The Hon. Minister of Foreign Affairs, Clement LEO, pointed out that the Principle Act mentioned 6 board members but not 6 boards as stated by the Leader of Opposition. Seconded by the Hon. NAUNUN, he moved that the questioned be put.

10. The motion that the question be put was carried with 26 votes in favour and 2 J abstentions.

Section 11, "AMENDMENT OF SECTION 19”

12. The Hon. Barak. T. SOPE, Member for Efate, asked why the time frame of two weeks had been amended to one for the board to undertake its business.

13. The Hon. Willie JIMMY, Deputy Prime Minister and Minister for Trades, explained that this would allow the board to receive more applications prior to their meetings.

Section 12, “AMENDMENT OF SECTION 20”

15. The Hon. Serge VOHOR, Member for Santo, wondered if this Section would apply to business institutions already established.

16. The Hon. Willie JIMMY, Deputy Prime Minister and Minister for Trades, confirmed that it would apply to new companies but not existing ones.

17. The Hon. James BULE, Member for Ambae, was unsure if the 14 days given to the Department to provide advice was enough.

18. The Hon. Willie JIMMY, Deputy Prime Minister and Minister for Trades, agreed that it was enough and within the 30 days time frame in which the board should meet to decide on the approval certificate.

19. The Hon. Maxim CARLOT, Member for Efate, felt that the Section would only encourage bureaucracy, which was contrary to the Principles of the CRP.

20. The Hon. Willie JIMMY, Deputy Prime Minister and Minister for Trades, pointed out that this Section would encourage transparency and would speed up development workshops.

21. The Hon. Jimmy NICKLAM, Member for Tanna, also felt that the 14 days was within the 30 days the board was required to meet and that the board would have enough time to search and collect information on the background of potential investors. He moved, and seconded by Hon. laris NAUNUN, that the question be put.

22. The motion that the question be put was carried with 26 votes in favour and 21 abstentions.

23. Section 12 was approved on division.

Section 13, “AMENDMENT OF SECTION 21”

24. The Hon. Sato KILMAN, Member for Malekula and Deputy Leader of Opposition, raised a point of order by stating his disappointment that the Government side was speeding up debate without allowing the Opposition Side the chance to express their opinion.

25. The Hon. laris NAUNUN, Member for Tanna, also raised a point of order that the Opposition was repeating comments raised earlier.

26. The Hon. Barak. T. SOPE, Member for Efate, questioned the purpose of the Selection Committee.

27. The Hon. Willie JIMMY, Deputy Prime Minister and Minister of Trades, responded that previously the Selection Committee was responsible for the appointment of the Chief Executive Officer but the new amendment would delegate that the responsibility to the Board Members.

28. The Hon. James BULE, Member for Ambae, expressed concern that there would be far more chances of a biased decision by the Board Members as compared to a decision by the Selection Committee.

29. The Hon. Willie JIMMY, Deputy Prime Minister and Minister for Trades, was confident the highly respected Directors who were members of the Board would make decisions that were fair and not biased with regard to the appointment of the Chief Executive Officer.

30. The Hon. Serge VOHOR, Member for Santo, wanted to know if both locals and expatriates were allowed to apply for the post of the Chief Executive Officer.

31. The Hon. Minister of Trades explained that the current Chief Executive Officer was Ni-Vanuatu whose duties and responsibilities were clearly spelled out in the Principle Act.

32. The Hon. Maxime CARLOT, Member for Port Vila, wanted to know why the responsibility of appointing a Chief Executive Officer had been handed over to the Board Members.

33. The Hon. Minister of Trades stated that it was standard practice and that the Chief Executive Officer was only an ex-officio Member.

34. Section 13 was approved on division.

35. Section 14, “INSERTION OF NEW SECTION”, was approved on division.

Section 15. “AMENDMENT OF SCHEDULE 1”

36. The Hon. Jean Alain MAHE, Member for Santo, felt that foreigners should not be authorized to invest in but kava industry.

37. The Hon. Minister of Trades acknowledges the Honorable Members concern but said that Ni-Vanuatu kava growers disparately needed the expertise of foreign investors to market their products. He continued that foreign investors would be allowed only to transport, transform and market kava internationally.

38. The Hon. Silas HAKWA, Member for Ambae, declared his interest in the local business sector and wanted to know what was involved in the transportation and

transformation of kava. He said that only copra and cocoa were prescribed commodities.

39. The Hon. Minister for Trades declared that a foreigner would be permitted to enter into the kava industry if he was to invest not less than 5 million vatu in that industry. He added that foreigners would be involved in the technical side of kava transportation and transformation.

40. The Hon. Sato KILMAN, Member for Malekula and Deputy Leader of Opposition, declared his interest in the logging and said that the Government should impose tighter control on logging activities. He felt that the new amendment would allow all foreigners to swamp into Vanuatu with their walkabout sawmills.

41. The. Deputy Prime Minister and Minister of Trades, Hon. Willy JIMMY, pointed out that the logging companies should have Code of Logging Practices. He said the amendments came about after wide consultation with regional representatives and chiefs.

42. The Hon. Jean Alain MAHE, Member for Santo, declared that the PRV Company on Santo had planted approximately 40 hectares of kava. He was concerned that Ni-Vanuatu smallholders would suffer because of the competition with foreign investors.

43. The Hon. Willie JIMMY, Minister of Trades and Deputy Prime Minister, responded that PRV was a corporate company and the biggest kava grower in Vanuatu and this Bill would open the door for them to export their products.

44. The Hon. Maxime CARLOT, Member for Port Vila, thought that the Government should give the right to export only to Ni-Vanuatu and not to expatriates. He added that Ni-Vanuatu should build the economy of the Country on their own for the good of the Nation.

45. The Hon. Vincent BOULEKONE, Minister of Internal Affairs, express the fact that there were other products like Tamanu with better prices than Kava but that there was a problem or marketing.

46. The Hon. Maxime CARLOT, Member for Port Vila, made a point of order that Tamanu was actually ucNambakura”.

47. The Hon. Vincent BOULEKONE, Minister of Internal Affairs, insisted that marketing was very important but that it needed substantial funds and moved that the House vote on Section 15.

48. The Hon. Barak. T. SOPE, Member for Efate, stated that Section 13 also concerned kava with good marketing value and that the Opposition had the right to have their say.

49. The motion that the question be put was carried with 26 votes in favour and 19 against.

50. Section 15 was approved on division.

Section 16, “AMENDMENT OF SCHEDULE 2”

51. The Hon. Barak. T. SOPE, Member for Efate, stressed that the provisions of Section 16 removed many of the occupations, which could be taken up by the Ni- Vanuatu. He queried about the responsibility of the Ministry of Ni-Vanuatu Business Development, which help Ni-Vanuatu to start their business.

52. The Hon. Willie JIMMY, Minister of Trades and Deputy Prime Minister, said that since, after 19 years of protection economy, the country could not come out of it and that the country needed a liberal economy where Joint ventures could be established.

53. The Hon. Sela MOLISA, Minister of Finance, felt that the occupations were not removed from Ni-Vanuatu but that the order was changed according to the alphabet. He added that the Maritime Transport industry could be managed by foreigners in order to provide better service to remote islands. He also stated that Vanuatu should practice an open economy according to the wishes of Ni-Vanuatu express during a consultation session, which took place in Club Vanuatu.

54. The Hon. Maxime CARLOT, Member for Port Vila, made a point of order that Hon. MOLISA was out of context.

55. The Hon. Minister Sela MOLISA replied that it was important to talk about economy and it was appropriate to discuss actual problems affecting the country’s economy today.

56. The Hon. Maxime CARLOT, Member for Port Vila, stated that Ni-Vanuatu could not need funds from expatriates to export Kava.

57. The. Minister of Trades, Hon. Willie JIMMY, stressed that the comment from Hon. CARLOT was irrelevant.

61. The Hon. Willie JIMMY, Minister of Trades and Deputy Prime Minister, thanked the Members for their contribution and moved that the Bill be read a Second time.

62. The motion for the Bill for the Foreign Investment (Amendment) Act No. of 1999 be read a second time and do pass was carried with 26 votes in favour and 20 abstentions.

63. The. Leader of Government Business, Hon. Jacques SESE announced that the next Bill to be discussed was the Bill for the Ports (Amendment) Act No.. Of 1999.

64. The sitting was suspended at 10.35 a.m and resumed at 2.10 p.m.

ORAL QUESTION

65. The Hon. Jean Alain MAKE, Member for Santo, wanted to know which agency would be funding the Fanafo Water supply project.

66. The Hon. John Morrison WILLIE, Minister of Lands, replied that negotiation were still underway but confirmed that the Banks/Torres Water Supply Project would be funded by New Zealand Government while that of Walarano would come under Japanese Aid.

67. The Hon. Amos TITONGOA, Member for Emae, asked if the PWD Mobile Unit repairing roads on Emae would be repairing feeder roads on Emae.

68. The Hon. Donald KALPOKAS, Prime Minister, answered that the Government would ensure that road leading to Sangava, Marae and Saseke Village were also repaired.

69. The Hon. Barnabas TABI, Member for Pentecost, wondered if the Government was considering reviewing Vanuatu Minimum Wage and when the Government would start on repairing roads on Pentecost.

70. The Hon. Vincent BOULEKONE, Minister of Internal Affairs, agreed that it was high time a Minimum Wage Board was appointed to review Vanuatu’s minimum wage. He felt that each employment sector should have its own minimum wage.

71 The Hon. Donald KALPOKAS, Prime Minister, stated that the delay was due mainly to the heavy rain currently affecting the whole of Vanuatu also due to shortage of material and equipment.

72. The Hon. Foster RAKOM, Member for Efate, enquired about the possibility of relocating Vanuatu International Airport seeing that the present one post a threat to the people of Mele Village.

73. The Hon. Prime Minister pointed out that past Governments had considered relocating the Airport but have not initiated the project because it was too costly.

74. The Hon. Esmon SAEMON, Member for Malekula, wanted to know if the South West Bay Airport on Malekula would be upgraded and also when the current price of Kava at 500VT per kilo would be increased to its original price of I000VT per Kilo.

75. The Hon. Prime Minister hoped that the South West Bay Airport was included in the list of Public Infrastructures to be repaired using funding front the European Union.

76. With regards to Kava prices, Minister Willie JIMMY said that it was a matter to be negotiated between the supplier and buyer. With reference to Hon. Maxime CARLOT’s questioned concerning new projects approved by the FIB, he stated that 48 projects had been approved costing approximately 5 million and 85 million vatu and creating 679 new jobs. He listed:

5 Agricultural projects totaling Vt 2 billion 362 million.1 Forestry project totaling Vt 6 million.4 Fisheries projects totaling Vt 6 million.6 Tourism projects totaling Vt 257 million.5 Manufacturing projects totaling Vt 465 million.27 other totaling Vt 1 billion 169 million.

He said that this figures were available in the FIB annual report gazette by the State Law Office.

77. The Hon. Maxime CARLOT, Member for Port Vila, specified that he be after the number of projects already in operation and their Ni-Vanuatu workforce.

78 The Hon. Willie JIMMY, Minister of Trades and Deputy Prime Minister, replied that so far 35 projects were operational.

79. The Hon. Jimmy NICKLAM, Member for Tanna, wondered why prices on basic consumer items were expensive such as rice on Aneityum costing 4,OOOVT a bag of 25kg. He also asked if shortfalls in business license fees collected by provincial

council as a result of reductions legislated by Parliament would be covered by an increase in grants by the central Government.

80. The Hon. Sela MOLISA, Minister of Finance, stated that he was aware of some astronomical prices on Aneityum but this may be due to increase in freight and transport costs. He regretted the current shortage of Staff in the VAT Office but assured the House that after appropriate training they should be well equipped to go out to the rural areas to ensure that business institutions comply with VAT legislation. He appealed to Ship Owners not to abuse VAT by increasing transport costs and freight. He concluded that apart from the usual grants, the Government would not make up for the shortfalls in business license fees.

81. The Hon. Vincent BOULEKONE, Minister of Internal Affairs, responded that the Government would consider fairer and appropriate distribution of grants to provincial governments.

82. The Hon. Jimmy IMBERT, Member for Santo, said that the Government had announced last year that a grant of Vt 72 million had been secured for the Big Bay road on Santo but no work had commenced up until today.

83. The Hon. Prime Minister confirmed that the bridge along the Big Bay road would be repaired with funds from Asian Development Bank.

84. The Hon. Wilson. R. ARU, Member for Port Vila, enquired about the actual amount of revenues collected through the VAT Office and what steps the Government had taken to solve the VMF Stand down issues.

85. The Hon. Sela MOLISA, Minister of Finance, replied that so far 6 million vatu had been collected through VAT and he was optimistic they would achieve this year’s target.

86. The Hon. Vincent BOULEKONE, Minister of Internal Affairs, informed the House that negotiations were underway for the possible re-recruitment of some of the members of the Stand Down Group but warned that the case was still pending in court.

87. The Hon. James BULE, Member for Ambae, demanded clarifications on the outstanding payments of fishermen by SPFC.

88. The Hon. Prime Minister explained the company was in liquidation and the liquidator must sell off company‘s assets so as to pay off its debts.

89. The Hon. Paul R. TARI, Member for Maewo, made a statement concerning compensation payments owed by the Government to Police and Army Officers who assisted in fighting the rebels during the 1980 rebellion.

90. The Hon. Jean Alain MAHE, Member for Santo, issued a statement regarding delays by the Government to resolve the issues of Vanuatu Fishermen’s compensation by SPFC.

4. M. Allen NAFUKI, Depute des Autres Iles du Sud, dit la priere.

5. Le President declare qu’il laissera la Chambre decider comment faire part des doleances relatives a la disposition de deux anciens puis invite le President de la Republique a prononcer son discours.

6. Le President de la Republique prononce son allocution (Voir Annexe).

7. Le President de la Republique declare ofliciellement ouverte la premiere session ordinaire de 1999.

9. M. Donald KALPOKAS, Premier Ministre, r&pond a I’allocution presidentiellc declarant qu’il est d’accord avec l’idee du President de la Republique selon laquelle 1’annee 1999 est la demiere annce avant le prochain millenaire et qu’on

doit changer de vision avant de Pentamer. Il estime juste que le Chef de PEtat ait rappele les principes de moralite a respecter du fail qu’ils figurent dans le preambule de la Constitution nationale et refletent egalement les principes du christi an ismc. Concemant le PRG, le Chef du gouvemement repond qu’on doit changer noire fat; on de voir les choses meme si cela n’est pas facile mais que c’est le seul moyen de progresser dans noire societe d’aujourd’huj. II ajoutc qu’on doit revoir notre systeme de commerce qui est la creation des cooperatives qui sont les facteurs de developpement et d’amelioration du niveau de vie dans les zones rurales, et rappelle concemant la jeunesse et l’cducation qu’il existe une egalitd de chances aussi bicn pour les francophones que les anglophones. Quant aux catastrophes qu’a connues le Vanuatu le mois dernier, il repond qu’on doit seulement atlendre les resultats de la Commission d’enquete.

10. M. Morking STEVEN, Chef de POpposition, prcsentc ses propres commentaires declarant que le Vanuatu est un pays independant et qu’il ne doit pas se soumettre aux decisions des autres comme au temps du colonialisme. Il ajoute que P economic du pays n’est pas du tout prospere, qu’il existe un taux de chomage eleve et qu’il y a actuellement une crise financiere et economique a Vanuatu.

11. M. Iarris NAUNUN, Depute de Tanna, fait appel au Reglement Interieur, et dit que le Chef de POpposition devrait repondre a l’allocution president! elle au lieu de faire une declaration.

12. M. Iatika Morking STEVEN, Chef de POpposition, declares que le PRG a completement paralyse 1’education, la sante et d’autres services de PEtat et ajoute que la Commission d’enquete mentionnee par le Premier Ministre concemant la disposition de Pappareil de la Compagnie a6rienne Vanair et le navire Latua que celle-ci ne resoudra pas les problemes qui existent.

13. M. Donald KALPOKAS, Premier Ministre, propose que la seance soit suspendue d’une demi-heure en memoire des deputes Walter Lini, Joely Antas, J. Calo et de Josiah Bahavus decedes recemment.

14. M. Iatika Morking STEVEN, Chef de POpposition, appuie la motion du Premier Ministre.

15. M. Maxime CARLOT, Depute de Port-Vila, estime que le Secretariat du parlement d evrait foumir u ne 1 iste c omplete d es d eputes d ecedes, car i I y en a d’autres qui sont deced£s, avant que la seance ne soit suspendue pour une demi- heure en leur memoire.

20. M. Jacques SESE, Depute de Ambae, lit la liste des Projets de loi a etudier durant cette session.

PROJET DE LOI DE 1999 SUR LES 1NVESTISSEMENTS DE L’ETRANGER (MODIFICATION)

PREMIERE LECTURE.

21. M. Willie JIMMY, Ministre du Commerce, presente le Projet de loi et en expose les motifs.

22. M. Iatika Morking STEVEN, Chef de 1’Opposition, precise que 1’opposition ne rejette pas les principes du Projet de loi mais elle ne fera que s’abstenir. Il craint que cette modification ne defavorise les Vanuatuans au profit des grosses societes.

23. M. James BULE, Depute de Ambae, reconnait que la loi cadre a ete approuvee par toute la chambre. La modification ne fera qu’ouvrir plus grande la porte aux gros investisseurs que ne peuvent concurrencer les Vanuatuans car ils n’ont pas de moyens pour constitue des capitaux sociaux significatifs. Il fallait d’abord creer le centre des Affaires Vanuatuans afin de donner les moyens aux Vanuatuans de constituer des societes capables de concurrencer les societes etrangeres.

24. M. Willie JIMMY, Ministre du Commerce, remercie les intervenants precedents, mais rappelle que ce Projet de loi porte sur les investisseurs de l’etranger et permet de prevoir des cas non prevus par la loi cadre. Il y a trois semaines une societe a obtenu la faveur de tribunal pour vendre son affaire sur le marche international. Ainsi ce Projet de loi permet de prevoir ces cas.

25. M. Sato KILMAN, Depute de Mallicolo, constate qu’autrefois on s’appuie sur les pretextes concemant Penvironnement pour retarder de six mois des reponses aux demandes. Il faut arreter ces pretextes pour promouvoir le developpement.

26. M. Maxime CARLOT, Depute de Port-Vila, apprecie cette modification car elle lui donne raison quant a ses arguments sur le fait de trop se presser durant le debat sur la loi cadre. A son avis, il faut aller lentement mais surement. Il ne faut pas modifier les lois suite aux decisions du tribunal. Il faut creer des lois selon des logiques bien etudiees et conformes aux realites du pays. Le fait de modifier sans cesse des lois risque d’engendrer de Finstabilite. Il demande combien d’etrangers ont deja investi ou pensent investir a Vanuatu.

27. M. Jimmy NICKLAM, Depute de Tanna, soutient ce Projet de loi qui permet de couvrir des cas non prevus dans la loi cadre. Il se demande si 1’office central a ete consulte. A son avis, la chambre a soutenu la loi cadre, elle doit appuyer les modifications. 11 ajoute que Vanuatu doit etre competitif face aux pays du Pacifique.

28. M. Willie JIMMY, Ministre du Commerce, indique que le conseil a six mois pour approuver toute demande d’investissement. Il ne fait pas d’excuses sur Fenvironnement pour retarder Finvestissement. Le pays n’a pas de legislation appropriee sur Fenvironnement. Il reconnait avoir dit que la loi cadre a des problemes d’application. La loi cadre ne prevoyait pas de coentreprises et de partenariat. Ce Projet de loi permet de legaliser certaines pratiques de partenariat surtout d ans des ecteur du k ava. Il i ndique qu’il r epondra a M axime C arlot au moment des questions orales.

29. Le Projet de loi est approuve en lecture par 26 voix et 21 abstentions.

EXAMEN EN COMMISSION,

ARTICLE 1, ‘INSERTION DU NOUVEL ARTICLE 1 A*.

30. M. Barak T. SOPE, Depute d’Efate, estime que tout Vanuatuan le droit de s’associer a quiconque. Il se demande pourquoi faut il legiferer sur cette question. Seuls les etrangers ne peuvent pas s’engager dans des affaires reservees aux Vanuatuans. Il demande au ministre de donner des precisions.

32. M. Barak T. SOPE, Depute d’Efate, repete son intervention et demande des precisions.

33. M. Willie JIMMY, Ministre du Commerce, invite les deputes a lire Particle 1 de la loi principale pour mieux comprendre ce Projet de loi. La modification permet aux Vanuatuans de s’associer avec des etrangers dans les projets plus importants afin d’obtenir des etrangers de l’expertise qu’ils n’ont pas.

34. M. Maxime CARLOT, Depute de Port-Vila, estime que les etrangers ne doivent pas s’associer avec les Vanuatuans dans des affaires reservees aux Vanuatuans.

35. M. Willie JIMMY, Ministre du Commerce, precise que les etrangers ne sont pas obliges par cette loi de s’associer aux Vanuatuans. Ce Projet de loi ne fait que permettre aux etrangers de s’engager dans des affaires reservees aux Vanuatuans.

36. M. Maxime CARLOT, Depute de Port-Vila, repete que les etrangers ne doivent pas s’engager dans des affaires reservees aux Vanuatuans.

37. M. Iatika Morking STEVEN, Chef de F Opposition, demande si la loi sur les Investissements de l’etranger sera aussi applicable au niveau des provinces lorsque aucun texte provincial ne regit pas Finvestissement etranger.

38. M. Willie JIMMY, Ministre du Commerce, repond que cette loi sera applicable dans tout Farchipel de Vanuatu et que tout investisseur etranger qui souhaite investir dans une province devra aussi se conformer a cette loi.

39. L’article 1, « insertion du nouvel article 1a », est approuve au vote.

40. L’article 2, « modification de l’article 2 », est approuve au vote.

41. L’article 3, « modification de l’article 3 », est approuve au vote.

ARTICLE 8, ‘MODIFICATION DE L’ARTICLE 10\

46. M. Barak T. SOPE, Depute d’Efate, estime que le Conseil d’Investissements Etrangers aura le pouvoir d’accord er des beaux fonciers aux investisseurs etrangers alors qu’il est de la competence du mini stere des Terres et demande les raisons pour lesquelles le ministere des Terres se voit prive de ce pouvoir.

47. M. Willie JIMMY, Ministre du Commerce, estime que les propos du depute Sope sont totalement hors du contexte du Projet de loi explique que le C.I.E. n’accordera pas des baux fonciers mais que l’investisseur doit obligatoirement obtenir un bail de terres sur lesquelles il compte investir pour eviter des conflits une fois que le projet d’investissement est deja en cours de realisation. Il ajoute que l’investisseur doit obtenir le bail foncier conformement aux dispositions de la loi No. 4 de 1983 sur les Baux fonciers et de la loi No. 6 de 1981 sur la Reforme fonciere.

48. M. Barak T. SOPE, Depute d’Efate, estime que les proprietaires coutumiers ne sont plus proteges a cause de cet article 8 parce que les investisseurs etrangers n’auront pas seulement a investir mais ils s’approprieront egalement les terres des proprietaires coutumiers.

49. M. Vincent BOULEKONE, Ministre de Tlnterieur, dit que le depute Sope ne fait qu’exprimer son inquietude personnelle et rassure ce dernier disant que le

ministere des Terres restera toujours 1’autorite compStente en ce qui conceme l’octroi des baux fonciers.

50. M. Willie JIMMY, Ministre du Commerce, declare que tout d6pendra du gouvemement qui sera au pouvoir et de l’interptetation qu’il fera des dispositions de cet article 8 en ce qui conceme l’octroi des baux et insiste que l’article 8 ne prive pas le ministere des Terres de son pouvoir d’octroyer les baux fonciers.

51. M. Maxime CARLOT, Depute de Port-Vila, dit que les dispositions de l’article 8 risquent de faire leser les proprietaries coutumiers de leurs droits en matiere fonci&e.

52. L’article 8, « MODIFICATION DE L’ARTICLE 10 », est approuve au vote.

53. L’article 9,« modification de l’article 12 ». est approuve au vote.

ARTICLE 10, ‘MODIFICATION DE L’ARTICLE 15’.

54. M. Barak T. SOPE, Depute d’Efate, se demande en quoi le Driecteur du Services des terres apportera des conseils techniques.

6. M. Barak T. SOPE, Depute d’Efate, constate que cette modification permet d’ajouter des membres au Conseil et de recruter des experts. A son avis 1’office n’est plus un bureau Central. Il se demande pourquoi recruter des experts pour etudier la viabilite d’un investissement prive ou l’Etat n’a rien a y faire. Il se demande pourquoi le Directeur des Terres est aussi membre du Conseil.

7. M. Willie JIMMY, Ministre du Commerce, apprecie 1’intervention de M. Sope, est lui demande de se reporter a Particle 4 (et 15). L’expert est indispensable pour permettre a l’Etat de faciliter l’investissement. L’Etat doit etudier sa viabilite. Il cite Pexemple de P. Swanson. Le Directeur des Terres ne fait que foumir des informations pertinentes relatives aux affaires foncieres.

ARTICLE 15, MODIFICATION DE L’ANNEXE F

36. M. Jean Alain MAHE, Depute de Santo, estime que les etrangers ne doivent pas s’engager dans les affaires du kava. On risque de dominer le marche et l’industrie de ce produit.

37. M. W illie JIMMY, M inistre d u C ommerce, p rend e n c ompte ces craintes m ais precise que 1’interdiction aux etrangers a fait perdre des recettes publiques. Les locaux ont toujours besoins du savoir faire des etrangers. Les etrangers ne peuvent planter du kava.

38. M. Silas HAKWA, Depute de Ambae, declare ses interets puis demande comment les etrangers s’engagent dans l’industrie du transport et la transformation et la commercialisation du kava. A son avis seuls le coprah et cacao sont qualifies pour 1’exportation.

39. M. Willie JIMMY, Ministre du Commerce, precise que l’etranger doit investir au moins 5 millions de vatu pour entrer dans les affaires du kava. Quant aux transport, transformation et commercialisation, les etrangers s’engagent dans les domaines techniques.

40. M. Sato KILMAN, Depute de Mallicolo, declare ses interets. Quant & Sexploitation du bois, l’Etat a interdit de grands investissements au profit de petits exploitants. Mais les petits exploitants de scieries mobiles sont tres nombreux. On risque d’ouvrir et aggraver l’exploitation du bois au lieu de proteger cette industrie.

41. M. Willie JIMMY, Ministre du Commerce, precise que tout exploitant doit avoir des terrains, respecter le code de deontologie d’abattage forestier et avoir du bois exploitable. Cette modification est un suivi d’un sommet des representants provinciaux a ces sujets.

42. M. Jean Alain MAHE, Depute de Santo, indique que la societe PRV a plante environ 40 ha de kava. On risque de trouver des pretextes pour sauvegarder les interets de grosses societes au detriment des Vanuatuans.

43. M. Willie JIMMY, Ministre du Commerce, rappelle que la PRV est une grosse societe Vanuatuanne qui pourra exporter du Kava grace a cette loi. Alors qu’auparavant elle ne le pouvait pas avec la loi cadre.

44. M. Maxime CARLOT, Depute de Port-Vila, estime que le gouvemement devrait accorder le droit exclusif d’exportation du kava aux Vanuatuans et eviter de Faccorder aux etrangers. Il ajoute que les Vanuatuans devraient eux-memes construire Feconomie du pays, et cela dans Finteret de la Nation.

45. M. Vincent BOULEKONE, Ministre de FInterieur, estime qu’il existe d’autres produits de base tels que le bois de 'tamanu’ dont le prix est aussi bon que celui du kava mais qu’il existe un probleme de marketing.

46. M. Maxime CARLOT, Depute de Port-Vila, fait appel au R.I. et rappelle que le bois de 'tamanu' dont parle M. Vincent Boulekone est le bois de l’arbre habituellement nomme 'Nambangura

47. M. Vincent BOULEKONE, Ministre de FInterieur, insiste que le marketing est un domaine important qu’il faut considerer mais qui demande beaucoup de fonds. 11 propose de passer au vote.

48. M. Barak T. SOPE, Depute d’Efate, estime que Particle 15 conceme le kava qui est un produit de base tres pris6 a Vanuatu et que Fopposition a le droit d’exprimer son avis concemant le marche dudit produit.

ARTICLE 16, ‘MODIFICATION DE L’ANNEXE 2’

51. M. Barak T. SOPE, Depute d’Efate, declare que les dispositions de Particle 16 suppriment trop d’occupations reservees aux Vanuatuans et demande a quoi sert le ministere du Developpement de Entreprises Vanuatuanes qui est censS aider les Vanuatuans & se lancer dans les affaires.

52. M. Willie JIMMY, Ministre du Commerce, dit qu’aprds 19 ans d’economie protectionniste le pays ne peut pas s’en sortir et que maintenant il nous faut une economie liberate d’ou Finteret de creer des entreprises en participation (Joint Venture).

53. M. Sela MOLISA, Ministre des Finances, estime que les occupations reservees ne sont pas supprimees mais qu’elles sont justes classees par ordre alphabetique. Il ajoute que seule l’industrie des transport maritimes peut etre ouverts aux etrangers dans le but de mieux desservir les lies eloignees de l’archipel. 11 declare egalement que le Vanuatu doit pratiquer une economie ouverte conformement au

souhait des Vanuatuans qui a ete exprime lors d’une consultation faite au Club Vanuatu.

54. M. Maxime CARLOT, Depute de Port-Vila, fait appel au Reglement Interieur et dit que le ministre des Finances s’eloigne trop du contexte de l’article 16.

55. M. Sela MOLISA, Ministre des Finances, repond qu’on parle de 1’economie et estime qu’il est important de traiter ou de cemer les problemes reels qui affectent 1’economie du pays aujourd’hui.

56. M. Maxime CARLOT, Depute de Port-Vila, declare que les Vanuatuans n’ont pas besoin d’argent d’etranger pour exporter du kava.

57. M. Willie JIMMY, Ministre du Commerce, dit que les propos de Maxime Carlot sont hors du contexte de l’article 16.

61. M. Willie JIMMY, Ministre du Commerce, et d’Industrie remercie les deputes pour leurs commentaires et propose que le Projet de loi soit lu une deuxieme fois et approuve.

62. La motion portant approbation finale du Projet de la loi est adoptee par 26 voix et 20 abstentions.

63. M. Jacques SESE, Chef du Groupe majoritaire, annonce le prochain Projet de loi a debattre qui est le Projet de loi No. de 1999 relative aux Ports (Modification).

65. M. Jean Alain MAHE, Depute de Santo, demande si le gouvemement a trouve un bailleur fonds pour entreprendre 1’adduction d’eau de Fanafo.

66. M. John Morrison WILLIE, Ministre des Ressources Naturelie, repond qu’il faut du temps trouver des fonds et bailleurs. Le gouvemement en a trouve pour des projets hydrauliques de Torba, Mallicolo qui seront finances par le Japon. Il n’en a pas encore trouve pour le projet de Fanafo.

67. M. Amos TITONGOA, Depute de Emae, demande si le gouvemement prevoit de reparer les routes de toute File d’Emae, routes nationales provinciates.

68. M. Donald KALPOKAS, Premier Ministre, repond que les routes nationales sont constitutes et entretenues par FEtat. Certaines routes relevent des provinces et municipales. Le cas d’Emae est complique car la route principale touche tous les villages.

69. M. Jonas TABIKURAN, Depute de Pentecote, d emande si le gouvemement va augmenter le SMIG. Il demande en outre ou en est 1’etape de reparation des routes a Pentecote.

70. M. Vincent BOULEKONE, Depute de Pentecote, Ministre de l’Interieur, repond que le SMIG n’a pas change depuis longtemps. Il reconnait qu’il faut reviser son niveau. Le gouvemement prevoit de nommer un Conseil qui doit recommander au gouvemement les decisions a prendre. Il pense qu’il est bon de fixer le SMIG en fonction des metiers et de la nature de metiers.

71. M. Donald KALPOKAS, Premier Ministre, repond concemant les routes de Pentecote, qu’il pleut sans arret et l’etat des routes se deteriore gravement. Le TP entreprendront les reparations. Le gouvemement va lancer des appels d’offre pour que Fentretien des routes soit confie aux societes privees.

72. M. Foster RAKOM, Depute d’Efate, demande quand le gouvemement va resoudre le probleme du survol du village de Mele par des avions atterrissant a Bauerfield. Les risques d’accidents sont enormes. Il demande si le gouvemement prevoit de reparer la route conduisant a Mele.

73. M. Donald KALPOKAS, Premier Ministre, repond que le gouvemement a etudie les questions du developpement de F aeroport et un nouvel aSroport coutera trop cher (environ a 100 millions de dollars). On ameliorera les conditions de securite de F aeroport existant tout en etudiant les solutions alternatives de transfert.

74. M. Esmon SAIMON, Depute de Mallicolo, demande si F aeroport de South West Bay sera effectivement renove par la BAD. 11 demande en outre si le prix du kava va remonter a 1 000 ou 2 OOOvt par kilo.

75. M. Donald KALPOKAS, Premier Ministre, repond que des bailleurs de fonds dont 1’Union europeenne et de la BAD desirent renover des aeroports mais il ignore si South West Bay est pris en compte. On ameliorera les adroports de Tanna Santo, Norsup pour recevoir le Dash 8. Il ne peut pas affirmer si South West Bay sera inclus.

76. M. Willie JIMMY, Ministre du Commerce, repond en outre que le Projet de loi sur la modification permet justement de negocier le prix. Il affimie que 48 projets ont ete prevus dont l’Australie financera 18, la France 6, les USA 2, l’Italie 3, la

N.Caledonie 1, le Taiwan 2, la Chine 8, la Grande Bretagne 3,1’Allemagne 2, le Japon 1 et la Polynesie frantpaise 2. Par province et region, il mentionne Port-Vila, Shefa, Penama, Luganville.

Jimmy NICKLAM, Depute Tanna, rappelle que durant l*£tude du projet de loi sur le TVA, le gouvemement a assure les deputes que le prix du riz n’augmenterait pas, mais malheureusement le prix d’un sac de 25kg atteint 4 000 vt & Anatom. Il aimerait connaitre les raisons justifiant ce prix eleve. 11 demande si vu la baisse des taxes indirectes et patentes reduisant les recettes des provinces, le gouvemement veuille combler le manque a gagner.

80 M. Sela MOLISA, Ministre des Finances, reconnait que le prix de riz a Anatom est de 4 000 vt. Il ne peut dire pourquoi le prix y est si eleve. Le Bureau de la TVA n’a pas assez de personnel bien form6 pour aller faire des verifications dans des lies. A son avis, les proprietaries des navires profitent de la situation de la TVA pour augmenter leur profit.
