2022-APHIS-02999-F Webster, Casey Lewis & Clark Law School I am requesting a copy of all written communications, electronic or physical, including attachments, between the USDA, APHIS, CVB, and Medgene Labs (Medgene) regarding Medgene's rabbit hemorrhagic disease virus serotype 2 (RHDV2) vaccine and the granting of an Emergency Use Authorization for Medgene Lab's RHDV2 vaccine from September 19, 2018 to April 4, 2022 (from the first reported RHDV2 case in the U.S. to today). My goal is to understand what information was provided to the USDA et. al., by Medgene and vice-versa, what interactions Medgene had with the USDA et. al., under what criteria the emergency use authorization was granted, and how the authorization was reported to Medgene. I understand trade secrets and other commercial sensitive information may be redacted. I am requesting a fee waiver as a law student writing about the regulatory process of obtaining foreign and domestic animal vaccines, specifically related to the U.S. RHDV2 outbreak. Disclosure of the documents is in the public interest, especially anyone with domestic animals susceptible to emerging viral diseases. Disclosure of the documents is likely to contribute significantly to public understanding of the operations and activities of the USDA, APHIS, and CVB. I have no commercial interest in the documents. For reference, please see below excerpts from Medgene's website describing communications with the USDA and CVB and receipt of an emergency use authorization. Medgene Labs, a vaccine and immunological services provider based in Brookings, SD, has received emergency use authorization for their experimental Rabbit Hemorrhagic Disease Virus 2 (RHDV2) vaccine from the USDA Center for Veterinary Biologics (CVB). Medgene Labs has been working closely with the USDA to provide a U.S.-based vaccine option, given vaccines imported from other countries require infecting rabbits in the manufacturing process. As part of the emergency use authorization process, efficacy has been demonstrated and safety studies are underway. The results of these studies supported USDA's decision to grant Emergency Use Authorization for the vaccine while further work is ongoing for a full product license. We are excited to extend the use of our platform technology and achieve emergency use authorization for our RHDV2 vaccine from the USDA. We have worked closely with their team since the major outbreak to reach this milestone. In other words, provide proof that the H5N1 Bird Flu "virus" was separated (isolated) to be all by itself such that it exists as a single, stand-alone thing. 2) Show the H5N1 Bird Flu "virus" was isolated (as described in #1 above) from a bird/human/poultry/animal sample and applied/infected into a healthy, living individual and that healthy, living individual then fell ill, thus demonstrating a contagious nature. This isolation > infection attempt > confirmed infection (with symptoms of illness) should ideally be repeated to confirm a contagious nature.
