Dear Members

It gives me immense pleasure to put forth our first Annual Information Report. June 23, 2011 marked a watershed in the foundation of the Staffing Industry in India. The day marked the launch of the Indian Staffing Federation. This wouldn’t have been possible without inspiration from you and other industry players.

In this report, we have tried to encapsulate all what we wanted to accomplish, and did accomplish since the Federation’s inception in June 2011.

The Federation seeks to professionalize the Indian employment landscape and take up issues that are critical to this industry. It has set upon itself objectives that are crucial for all of us.

What we achieved this year is of great important to us. We have made progress with various stake holder groups including government. Several policy making bodies invite ISF to contribute to several discussions.

We have created awareness not only among member companies, but also among our client companies, on the relevance and importance of compliances. We have established our presence and built a working relationship with various industry bodies like CII, ILO, PHD, EFI, etc., to join hands with us in our mission, going forward.

I would like to personally also thank the trustees, the board, and committee chairs, for their untiring work and efforts in helping us raise ISF’s profile both nationally and internationally.

Given the gigantic task we have earmarked for ourselves at ISF, we look forward to your continued support in helping us contribute as an Industry, to creating a better future for the youth of our country.

Executive Board Since April 2012 (2 year term) The Executive Board is the functioning body of Indian Staffing Federation. The current Executive Board came into existence after a General Body Election conducted in the first half of May 2012, and the results for the same was declared on May 14

th 2012 in the Annual General Body Meeting. The elections held for the positions

ISF’s Journey Indian Staffing Federation was the brain child of construed efforts from a few Corporate Members with support from the International Confederation of Private Employment Services Agencies (CIETT) headquartered in Brussels, Belgium. Several meetings and discussions ensured the birth of ISF.

Pre-Launch Meet New Delhi, 3 Feb 2011

Ms. Saksena from Randstad India Ltd, reached out to the other 4 Corporate members of the Ciett (International Confederation of Private Employment Agencies) – the umbrella body of Staffing Industry worldwide – Adecco, Kelly, Manpower and GI Group to meet and deliberate on the formation of a staffing association in India which could represent the issues of the staffing industry in particular. A meeting was organized at in Delhi and was attended by Namr Kishore and Soumen Basu from Manpower, Kush Bhargava (Adecco), Kamal Karanth (Kelly), Vipul Prakash (GI Group), Raja Sekhar Reddy (Global Innovsource), as well as K Pandia Rajan and Rachna Saksena (Randstad). It was decided to formalize the voice of the staffing industry by forming an association and inviting members from other staffing companies to ensure the association represented the collective voice of the Indian staffing industry.

Capacity Building Workshop New Delhi, 22-23 Feb 2011

Ms. Annemarie Muntz, Director-Public Affairs- Randstad Holding and President –EuroCiett, visited India and conducted a two day capacity building program with the objective of assisting the Staffing companies in India to set up a staffing federation. Some key members from staffing companies participated in the two day module designed by Ms.Muntz and Denis Pennel – MD- CIETT assisted in the setup. Antonio Bonardo from the GI Group, Italy also supported this program.

The capacity building workshop aimed at acquainting the existing members and new members planning to join the association on the work and modalities of forming an association. Ms. Muntz shared the CIETT experiences, structure and objectives and then facilitated an objective setting exercise among the members from India. Ms. Muntz and Mr. Bonardo also shared details of the agency work regulations and clarified doubts on the regulatory set up therein.

Pre-Launch Meet New Delhi, 24 March 2011

The Second pre-launch meet focused on setting up of the “Trust” and the formalities associated with the same. A three member media committee was formed represented by Namr Kishore – Manpower group, Rachna Saksena –Randstad India and Rituparna Chakraborty - Teamlease to explore, invite proposals, select and appoint a PR agency that could take on the task of building the media connect after the launch and respond to queries effectively and in a structured manner. The attendees also deliberated upon the appointment of a Managing Director for the federation and the rollout of the official website. In the absence of a full-fledged working executive, responsibilities were shared among the members themselves who had agreed to come together to form the Trust. The Trust forming formalities and related legal and paperwork was taken on by Vipul Prakash of the GI Group, the website preparatory work along with keeping financial records of expenditure was owned up by Raja Sekhar Reddy of Global Innov, while the task of putting together the Code of Conduct and the Constitution was done by Rachna Saksena of Randstad India. Alongside, Kamal Karanth of Kelly Services took charge of putting together the job specs as well as the search plan and process for appointing an Executive /Managing Director for the newly formed Secretariat.

Pre-Launch Meet New Delhi, 26 April 2011

The meet focused on, finalizing the Managing Director and the team for the federation, and planning for the launch event. It was unanimously agreed that Mr. Pandia Rajan would be the President, Vipul Prakash of GI Group the Vice President, Rachna Saksena of Randstad India the General Secretary and Raja Sekhar Reddy, the Treasurer of the newly registered Indian Staffing Federation (ISF). Few candidatures were also discussed for the post of MD/ED of the ISF. The members then focused on the activities to be undertaken to plan and execute the launch of the Federation. A Tentative fee structure was proposed for the members and the budget for the launch event was also finalized.

Pre-Launch Meet New Delhi, 11 May 2011

The Pre-launch meeting took place at Manpower’s Gurgaon office. The members discussed the next steps post the registration of the Federation as Trust. The meeting majorly focused on detailing the execution for the ISF Launch event proposed for 23 June 2011. The media committee confirmed the selection of DMA as the PR agency that would take on the media interface for ISF. The trustees also deliberated on the names of chief guest for the event and finalized the 5 member organizing committee that would work together for the launch event of 23

rd June. This included Namr Kishore from Manpower, Rachna Saksena from Randstad India,

Rituparna Chakraborty from Team lease and Raja Sekhar Reddy from Global Innov and Vipul Prakash from GI group. The other trustee members too offered to extend support wherever required especially during the launch program. It was also decided

Pre-Launch Meet New Delhi, 9 Jun 2011

The meeting took place at Randstad’s Gurgaon office. It was a follow-up meeting to fine tune the event flow and to finalise the invitee list. The trustees also deliberated upon other key administrative issues needed to be closed before the official launch. All members agreed to meet a day before the launch for a dry run of the launch activity and program flow.

Launch New Delhi, 23 Jun 2011 June 23, 2011 marked a watershed in the development of the Staffing Industry in India. The day marked the launch of the Indian Staffing Federation. The Federation was formally launched setting upon itself several objectives including professionalizing the Indian employment landscape and take up issues that are critical to this industry.

Mr. Arun Maira, Member of the Planning Commission, graced the occasion as the chief guest. The event was well attended by the key stake holders including the decision makers of staffing industry, government, industry associations, academia, etc.

From a Media Report:

Eight leading HR firms, have come together to form an industry body aiming to make the country's fast growing staffing sector more organised. The members of the apex body -- the Indian Staffing Federation (ISF) -- includes eight HR majors: Adecco, Allegis, GI Group, Global Innov, Kelly, Ma Foi Randstad, Manpower and Teamlease, which together represent close to 50% of the Indian organised staffing market.

Announcing the launch of ISF, its President Pandia Rajan said the association will work with the government(s) to facilitate a suitable, legal and regulatory environment that is positive and supportive for the development of employment (in India) at large and the staffing industry specifically. Planning Commission member Arun Maira welcomed such a move and complemented the founding members for this initiative. He invited ISF to be part of the working group on labour laws in the 12th plan.

In India the employment landscape is mainly dominated by the unorganised sector which constitutes nearly 90%. The federation would work towards bringing more people to the organised sector and empowering them with social securities and other job-related benefits. The Federation said that the staffing agencies will have to create "employability" for fast growing industries like ICT, healthcare, hospitality, real estate, retail, media and entertainment, banking and manufacturing. According to industry predictions around 1.6 million new jobs will be created in 2011. But Indian companies are increasingly finding it difficult to find the right talent for the right job. As many as 67% of employers are struggling to meet their critical-level hiring targets.

The Federation is allied to International Confederation of Private Employment Agencies (CIETT), which promotes better regulatory policies, flexibility in the global staffing market and legislation.

Objectives Champion sustainable growth of the Staffing Industry/ Private Employment Services

Staffing Industry covers a meager 2% penetration of the possible employable size in India. Of the 400m employable in India, about 10% are employed in the organised sector, and while about 250m are self-employed. This leaves almost 110m who are employed by the temp/ flexi-staffing and the unorganised sector. ISF is working towards growing this market.

Facilitate a suitable, legal and regulatory environment that is positive and supportive for the Staffing Industry/ Private Employment Services

Some of the laws and regulations haven't taken Staffing industry / Private Employment Services into cognizance. The ISF expects to interact with law making authorities to recognize Staffing industry / Private Employment Services and create adequate and appropriate laws to manage it.

Be the authoritative voice of the Staffing / Private Employment Services Industry

ISF is the apex body representing the Staffing industry / Private Employment Services that is authorised to discuss with government agencies and other trade bodies on behalf of the staffing industry/ private employment services. This will help easier inputs and suggestions in law making and related legislations.

Establish quality standards for the Staffing Industry / Private Employment services at large & a code of conduct for ISF members

The ISF will have several members and it is important that the member companies follow a code of conduct so that both the customer and the workforce is provided with quality services, and is adequately informed. The ISF will therefore mandate a code of conduct and quality standards for the Industry.

Increase visibility and enhance the image of the Staffing industry / Private Employment Services & strengthen its representation

Several companies today, are still not aware of Staffing / private employment services as a mechanism to staff their requirements. The ISF will work towards making the public/ government and the market at large aware of Staffing / private employment services as a means to effectively achieve their objectives.

Promote Staffing / private employment services as an effective enabler of socio-economic growth

Staffing / private employment services is an enabler to provide social security and long term medical, and retirement benefit to temp / flexi-staff. Promoting staffing / private employment services therefore will address various issues of employment benefits being provided to employees.

Develop Staffing Industry / private employment services as a choice of employment

A temp /flexi job is still sometimes considered as a taboo or not looked up favourably by our society in India. The type of the job and the temporary nature is considered equivalent to a transitive state as compared to western societies where private employment services are a way of life. Changing this orientation and promoting staffing / private employment services as a choice of employment will be an additional objective of the ISF.

Membership Drives As a first step after the launch, ISF started reaching out to companies providing Temporary/Flexi staff around the country. The federation organized membership drives in the major cities like New Delhi, Mumbai, Bangalore, Channai, Kolkata, Hyderabad, Ahmedabad and Pune.

Delhi Drive New Delhi, 24 Aug 2011

The First membership drive took place on 24 August 2011 at Hotel Hyatt, New Delhi. The event saw participation from staffing companies from the National Capital Region. The members from the Delhi drive Working Group included Vipul Prakash (Vice President, ISF), Rituparna Chakaborty (Teamlease) and the 2 member secretariat-represented by Basudev Mukherjee and Vikas Kamboj appraised the attendees through the presentations on the federation and its objectives.

Key Points/Suggestions:

The session largely hovered over the perception of Contract staffing, and an urgent need to work on enhancing the image of the same. Most of the participants agreed on it.

Some participants also wanted to understand how ISF can help in tackling the issue of getting trained workforce. It was communicated that ISF will be working closely with the government and other stakeholders in the days to come.

It was also discussed that the regulatory framework for the industry needs to be strengthened.

A uniform code of conduct for the members of ISF was also discussed. And it was agreed that the same needs to implemented and acted upon.

Another issue that was discussed was the lack of interest in candidates to work as a Temp. Federation shared its commitment of promoting the industry as a Choice of Employment.

In conclusion, most the companies present expressed interest in joining the federation

Mumbai Drive Mumbai, 26 Aug 2011

The Mumbai drive followed immediately after the Delhi event. The drive was organized on 26 August, 2011 at Hotel Leela Kempinski. Staffing companies from Mumbai and Thane participated in the event. The Working Group for the Mumbai drive included Rachna Saksena (General Secretary), RajaSekhar Reddy (Treasurer) and Soumen Basu (Executive Director-Manpower Group) who along with the Executive Director-Basudev Mukherjee took the participants through the need and objective of the federation.

Key Points/Suggestions:

The discussions featured the issues with new guidelines for Service Tax & its impact on the staffing industry and the ambiguity surrounding the section t be applied by the clients while deducting TDS.

CLRA needs to be enforced more strictly.

Staffing companies sometimes work as a sub-contractor and provide services to a main contractor. In such cases, such companies face problems in getting licenses.

Need to harmonize the leave policies under different acts.

Several laws are not consistent across different states and for different sizes of the companies and there is a need to harmonize them.

Need for clarity on what constitutes minimum wages. Is it basic + DA or the full package?

There is a lack of awareness of labour laws esp. amongst clients with respect to staffing. It was suggested that ISF should look at creating a repository of legal advice to help improve awareness? Also, ISF should provide members with access to lawyers / legal advice.

There are many grey areas in the laws that a staffing company need to comply with. Leads to various inspectors visiting your offices. Need to address this issue.

Bangalore Drive Bangalore, 22 Sep 2011

The Bangalore Drive was conducted on 22 September, 2011 at Randstad’s office in Kodihalli. The drive was targeted at the CEOs of the staffing companies in Bangalore. The event saw a good turnout. The working group in Bangalore consisted of Kamal Karanth (Kelly), Kush Bhargava (Adecco) and Satish Venkatachaliah (Allegis) along with Basudev Mukherjee. Mr. Pandia Rajan (President, ISF) presented the credentials and objectives of the federation to the participants.

Key Points/Suggestions:

Participants shared that a lot of the “unorganized” sector operates in the staffing segment i.e. small companies who do not always play by the rules and undercut our business. ISF shared that it will really only cover the companies who are in the organized sector and have agreed to adhere to the code of conduct. The idea is to grow the pie for the organized sector.

On a query of whether ISF will include companies that are into perm recruitment; it was shared that if the company is only into perm recruitment then that company cannot be a member of ISF. The company may have multiple lines of business. However, staffing – in whatever shape and form – must be one of those lines for the company to qualify for membership.

It was shared that ISF is working on the service tax issue, and is one of the prime issues that has been taken up in the issues paper that the federation are putting together.

On a query about how will ISF get the smaller companies to follow the code of conduct; it was shared that the federation is trying to educate and then enroll members, conducting these outreach session for this reason, due diligence conducted on each member, members must comply with all the key laws of the land.

In conclusion, all the companies present expressed interest in joining the federation.

Chennai Drive Chennai, 28 Nov 2011

The Chennai Drive was conducted on 28 November, 2011 at Randstad India’s office at Cathedral Road. The drive was steered by the president of ISF - Mr. Pandia Rajan along with the other members of the working group. The Bangalore and Chennai event was organized by the same working group i.e. Kamal Karanth (Kelly), Kush Bhargava (Adecco) and Satish Venkatachaliah (Allegis) along with Basudev Mukherjee-Executive Director of ISF. The president took the participants through the presentation on the Mission, Vision and Objectives of the federation.

Key Points/Suggestions:

It was suggested that ISF should work with smaller players in the industry closely, and guide them on statutory issues. It was stressed that this is clearly a pressing need as other associations like CII, ERA and NASSCOM do not do so.

It was shared that ISF is working on a white paper and is compiling the issues related to this sector.

The discussion also featured the need to address issues related to social security.

The need to get data points from the industry was also highlighted. It was shared that for the purpose, ISF is working on and will be coming out with some surveys shortly.

It was also shared that ISF is mandated to: Addressing issues coming in the way of profitability. Attempt is to grow the pie for all. Experience sharing Bring in credibility to this sector through the code of conduct.

Advocacy ISF has taken up several tasks over the last two years. Some of them are enumerated below:

Contract Labour Act Redraft

Indian Staffing Federation met the department for Contract Labour in the Labour Ministry. The department requested ISF to redraft the Contract Labour Act (CLRA) and present it to the ministry for consideration. The Legal and Regulatory Committee of ISF has been working on the redraft.

CBDT Representation

In order to address the ambiguity about whether the payments made to member companies fall within the definition of “work” as envisaged in section 194C or professional services as provided in section 194J of the ITA. [the rate of TDS u/s 194C is 2% (for payment to companies) while under 194J it is 10%]; the federation had made a presentation to CBDT.

Now the federation has decided to take up services of professional agencies to make a strong representation to:

Address the ambiguity on applicability of TDS provision by way of amendment, clarification or Notification;

Seek a confirmation that the services are covered under section 194C of the Income Tax Act.

Stipulate a lower rate for staffing industry under section 194C as is done for advertising agencies;

To issue an instruction to the Tax officers to issue tax withholding certificates within timeframe of filing to avoid delays;

To issue a general low deduction certificate without restricting it to the specific clients;

Attempt to extend the validity of certificates from current 1 year to 3 -5 years.

CBEC Representation

As per the provisions of the Union Budget 2011, the Point of Taxation Rules (POTR) changed with regard to the levy of Service Tax from a collection basis to an accrual basis. ISF also made a representation to the Central Board of Excise & Customs (CBEC) relating to hardship faced by the staffing companies due to the same.

Work with Planning Commission

ISF representatives met with Mr. Arun Maira of the Planning Commission and updated him with the federation’s activities. The ISF issue paper was also shared with him. Mr. Maira assured of his support to the federation and said that his office will try and get us involved in the various committees in the Planning Commission relating to Industry and Labour. They also represented ISF in a Planning Commission activity to compile a list of skills in demand by the staffing industry.

Planning Commission invited ISF for a meeting to examine changes in Labour rules & regulations to help spur growth in manufacturing sector.

Efforts for ratification to ILO Convention 181

ISF also took the lead in opening a dialogue with the ILO South Asia specialists on the challenges and need to actively pursue the process of adoption of ILO convention 181 in India. ISF President and Office bearers also met up with Mr. Paul Comyn, Mr. Coen Kompier and Mr. Gota Dassanayake in June 2011 to convey the seriousness of intent of ISF to pursue the adoption of C181 and recommendation 188 in the Indian context. In the meetings that followed, they conveyed ISF’s

agreement to use the C 181 framework for working out changes in the contract labour regulation and thereafter the ISF secretariat has been in regular contact with the ILO office in India and the ministry officials. The ILO representative- Mr. Gota Dassanayake has also participated in the two annual events organized by ISF to present the ILO views. ISF also participated in an ILO Workshop on Contract Labour organized in Mumbai in August, 2011.

ISF representatives also met the Ministry of Labour and made a case for the adoption of ILO Convention 181. The ministry convened a preliminary tripartite meeting to capture the views and thereafter asked V.V.Giri Institute to do a feasibility study on the adoption. ILO to convene a tripartite meeting after the feasibility report is out. The report is expected in May 2013.

Work on addressing Labour laws issues

ISF was nominated on a Tripartite Labour Committee set up by Kavita Gupta, Secretary, Department of Labour, Government of Maharashtra in August 2011 to provide its inputs to the group on labour laws and its implementation issues faced by the staffing industry. These committees were headed by the Labour Commissioner, Sanjay Deshmukh, Govt. of Maharashtra.

ISF has been in touch with leading labour lawyers like Michael Dias to solicit their support for the Federation and its activities. Mr. Dias has been actively involved with various ISF events.

ISF trustees also participated in the 44th Indian Labour Conference in February, 2012. The two day conference was attended by State Labour Ministers, Trade Union Leaders from all the recognised Trade Unions, Representatives of all India Employer’s Organisations, Officials from Central Ministries, State Governments and PSUs. The Conference focused on 3 key issues: Minimum Wages, Social Security and Employment and Employability.

Associating with major industry bodies

ISF has also initiated contacts with Employers Federation of India, All India Organisation of Employers and the Confederation of Indian Industry. ISF has recently taken the Affiliate membership of Confederation of Indian Industry to represent staffing industry and to increase its visibility at various fora.

ISF was invited by the CII committee on Industrial Relations and the ISF Committee Chairperson - Legal & Regulatory along with ISF Secretariat attended these meetings. Post the meeting, CII committed to work with ISF in promoting professional staffing among its members.

ISF was invited to the 3rd meeting of the Working Group on Labour Laws for Service Sector convened by FICCI. ISF secretariat presented issues faced by the staffing industry.

ISF also met the National Skill Development Corporation (NSDC) to explore various levels of partnership both can engage in together. ISF will be working with NSDC on the need of Skills required by various industries and will also help NSDC with aggregating demand for various profiles.

ISF was invited to a meeting by PHD Chambers on Impact on Economic Sustainability and National Growth – Issues and Challenges in March-2013. The basic discussion revolved around some of the ill effects of bandhs in India and some preventive steps that could be taken. Several members from Trade Unions such as BMS and AITUC were present along with some PSUs and corporates like Airports Authority, Maruti, Escorts and IFFCO. Also present were lawyers, consultants, representative from Trade and Industry cell of the BJP and the ex-Labour Commissioner of Delhi.

International footprint

Indian Staffing Federation also participated in the Global Dialogue Forum (GDF) convened by the International Labour Organisation (ILO) in Geneva on 18th and 19th of October 2011. The agenda for the tripartite GDF was to discuss the Role of Private Employment Agencies (Temporary Staffing Agencies) in Promoting Decent Work and Improving the Functioning of Labour Markets in Private Services Sector.

Research & Publications Indian Staffing Federation has a special focus on conducting industry specific research and bringing out publications that can help in keeping the members abreast with the happenings in the staffing industry in India and abroad.

Temporary Staffing in India – Issues and Recommendations

ISF produced its first ever report “Temporary Staffing in India: Issues and Recommendations”. This report highlights the key regulatory changes that the Indian Staffing industry requires to grow. The report has been widely circulated to the key policy-makers in India. It took up short and long term issues relating to: Provident Fund, Employees State Insurance, Industrial Disputes Act, 1947, Employees Compensation Act, 1923, Payment of Gratuity Act, 1972, Factories Act, 1948, Shops and Establishment Act, The Employees State Insurance Act, 1948, The Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959, Contract Labour Act and Service Tax.

This report is the first documented record in India which tries to define the staffing business and chalk out issues relating to the same. The report provides for: the definition of Staffing Company, Mandatory features and practices of the same, including Best practices, The Global Experience of staffing, Indian Experience of Staffing, Temp Staffing in India: The pending reforms agenda. Indian Staffing Industry Research 2012 – Turning Available Work into Jobs

ISF produced the first-of-its-kind report on Flexi Staffing industry in India: ‘Turning available work into jobs’; with Indicus Analytics. Indian Staffing Scape – ISF’s official voice

In order to keep the members and key stakeholders abreast with key trends and updates from staffing world, ISF launched its monthly newsletter “Indian Staffing Scape” in December 2011. The newsletter is circulated to ISF members, government officials, employer organisations and the media. The newsletter captures key updates from regulatory sphere, recent staffing industry research reports, global trends in staffing, and activities done by the federation. It also carries the thoughts of industry leaders.

About 14 issues of the Indian Staffing Scape have been released through email to key stake holders so far.

Indian Staffing Conclave 2012 New Delhi, 10 Oct 2012

The First Indian Staffing Conclave by Indian Staffing Federation held on October 10, 2012 saw a strong turnout from Business leaders, Educationists, Government, Researchers, NGOs and Students. The delegates thronged the venue with full gusto, which set the tone for the conference. Mr. Mallikarjun Kharge, Hon’ble Minister of Labour and Employment, Govt. of India lit the lamp to set the conference in motion. Mr. Kharge also unveiled a research report, Turning Available Work into Jobs, by Indian Staffing Federation. The report, a one-of-its-kind compilation of insights into the Indian Flexi Staffing Industry, was very well received.

Management of Contract Labour & Outsourcing: Contemporary Challenges & Remedies Kolkata, 18 Jan 2013

Indian Staffing Federation jointly with Indian Society for Training & Development held a workshop, ‘Management of Contract Labour & Outsourcing – Contemporary Challenges & Remedies’ in Hotel Golden Parkk, Kolkata on January 18, 2013. The event saw saw huge participation and response from city’s HR fraternity. The workshop was an initiative to provide practical solutions to the much debated topic and the inevitable part of HR today – Contract Labour. The audience was taken on a multifaceted journey into the intricacies and issues around Contract Labour, and provided with the ways and means to effectively manage it. Mr. Raman Pandey, Working President INTUC, West Bengal, delivered a special address on the occasion on Labour Laws in Current Scenario. He touched upon various peculiarities and provided interesting insights into the world of work. He emphasized on moving towards industrial harmony, while eradicating industrial dispute.

Labour Market Reforms: Cornerstone for inclusive growth in Employment and Social Cohesion Mumbai, 6 Feb 2013

The Western Chapter of Indian Staffing Federation organized its first ever National Conclave on “Labour Market Reforms: Cornerstone for inclusive growth in Employment and Social Cohesion” at Hotel Four Seasons, Mumbai. Mr. Ronald Sequeira, Executive Director of GlaxoSmithKline graced the occasion as the chief guest. The Conclave was well attended by senior members of the government and bureaucracy, industry and academia. Principal Secretary – Labour, Jt. Commissioner – Labour, Jt. Commissioner – PF, Jt.Director – ESIC were amongst people from Industry and Academia who graced the occasion. It also saw participation from Business leaders, Educationists, Government and Researchers.

India on the World Map - An International Colloquium: Staffing Industry New Delhi, 6 March 2013

The Indian Staffing Federation (ISF) in collaboration with CIETT, the International Confederation of Private Employment Agencies, organised a high profile colloquium to set the agenda for growing and strengthening the staffing industry in India in the next 5 years. Hon’ble Union Minister of Coal, Mr. Sriprakash Jaisawal graced the occasion as the chief guest. He said that the colloquium was topical since it was taking place at a time when jobs and skills are high in India’s consciousness and it is believed that a good job is the best form of social inclusion. The event was well attended by key stakeholders such as senior members of the government, ILO, members of the planning commission, trade union leaders, and trade bodies, among other delegates.

Session 1: India on the World map - A comparative of Staffing around the Globe

The session of the day provided the audience a perspective on the staffing and flexi-work scenario in Europe, South Africa, Australia and Japan. The speakers presented their views on the contract labour scenario in China and India and what India needed to do to create a robust labour market through urgent changes in labour laws and its practices in the immediate future.

Session 2: Next 5 year horizon for Staffing landscape in India The session provided the audience with the views of staffing companies, industry, academia, think tanks and labour unions on contract staffing. The staffing companies stressed on the importance of flexi staffing in India and the need for a contract labour regulatory framework. The labour unions, admitting that they were not against contract employment per se, but highlighted reservations about certain aspect of it such as issues of minimum wages, equal pay, etc.; and agreed that a code of ethics was mandatory and that self-regulation for the industry was imperative.

Media Coverage ISF is in regular touch with Indian and foreign media to ensure that the voice of the Indian staffing industry is heard. ISF is meeting journalists one on one and highlighting the issues being faced by the staffing industry.

ISF is getting featured in Business and Mainline Newspapers, Business Magazines, TV channels and on the web regularly.

CIETT – ISF Interface Ciett, The International Confederation of Private Employment Agencies, played the prime role in setting up Indian Staffing Federation. Ciett brought together major Industry players in India and helped start a dialogue in early 2011. ISF is the member of Ciett and represents India. Since then, Ciett and ISF has been working together to elevate the Indian Staffing Industry to be among the best in the world.

Ciett connected ISF with other Staffing federations across the globe. ISF released Ciett’s global research report on Staffing, ‘Adapting to change’, in India. Ciett and ISF are also working together to capture key data points of staffing industry in Inda,

1. Decided on touching base small players in the industry to get the trends and insights to have a

better view of the industry.

2. Agreed to work on a mechanism to answer all the media queries in time; and also to scout for a PR

Agency.

3. Agreed on adding a new category for of Associate Member for startup firms.

4. Agreed on compiling an exhaustive database of staffing companies nationally; and reaching out to

target members in Bangalore, Chennai and Hyderabad; (one-to-one wherever necessary.)

5. Agreed to work on an array of activities to be offered to new players on a chargeable basis.

6. Decided to include 6 months challans and ESIC challans with Annexures, from companies applying

for membership for Due Diligence purposes.

7. Agreed on adding a clause to the membership pre-requisites, asking if the companies have any

pending criminal cases and terrorist links either directly or indirectly.

1. Rituparna Chakraborty (Trustee member-ISF) debriefed the board on the discussion that took place

at the GDF held in Geneva on 18th and 19th October 2011 where she represented ISF.

2. Decided that the Executive Director will be the spokesperson of the federation, and will be

supported by the Board with stats and insights.

3. Decided that the annual event should be rescheduled for the first week of April, 2012. It was felt

that by that time, ISF should have more members in place and the event would carry much more

4. Decided to reach out to sponsors for the Annual Event. Also decided that member companies can

also sponsor in case there is a problem in getting third party sponsors. Pooling in equal sums from

or by trustee companies was also discussed.

5. Communicated that Indicus Analytics was finalized to conduct the research for ISF after discussing

and exploring couple of research firms for the mandate.

6. Agreed that the research (total cost Rs.15 lacs) will be funded by the trustee companies with an

equal one-time payment of Rs. 2 lacs.

7. It was proposed that ISF should look at re-structuring the board to make it more work oriented and

that the working committee/ Board would consist of the existing office bearers and a few more

members who could be elected or else nominated by the President.

8. It was collectively decided that the practice followed by other federations and agencies like CII

would be studied and post that, to take an informed decision.

9. Shared that the data collected on Skills in Demand has been shared with the Planning Commission;

and that Planning Commission officials and the Planning Commission is expected to convene a

meeting of the key stakeholders on February 23, 2012.

10. Shared that in order to participate in Indian Labour Conference, the federation needs to be a

recognized employer federation. It was suggested that ISF try and participate through one of the

recognized bodies. As ISF is not a member of any of these bodies at the moment, members were

requested to try and participate in the Labour Conference through their individual memberships of

the employer federations. Also, agreed that ISF should apply for a membership to CII.

11. Decided that members will share their temping numbers with the secretariat on a quarterly basis.

While individual company numbers would be kept confidential, the aggregate would be a useful

indicator of the state of the industry.

12. Decided that concurrently interaction at a state level is important. Meeting with the Labour

department officials esp. Labour secretary and commissioner and representation on the labour

committee’s was focussed.

Board Meeting 7, 21 Mar 2012

Key Issues Addressed

1. Membership of 7 companies was decided upon.

2. Decided to share Code of Conduct with all the members.

3. Decided to keep the membership-cycle based on the financial year from April onwards.

4. PR agency was advised to keep a tab on various events happening around and to try and get

speakership opportunities in the same especially those with high bureaucratic participation.

7. Shared that the total collections for FY 2011-12 was Rs. 64.7 Lacs. Rs 10 Lacs were earmarked for

9. Shared that ISF Participated in IHRB / Verité workshop on “Migrant workers: responsible

recruitment & fair hiring to combat human trafficking in South Asia” on March 13. It was pointed

out that the conference was a good platform to promote ISF as a symbol of ethical and compliant

practices in the recruitment and private employment Space.

10. Agreed in principal to hire legal counsels to help ISF members out with different legal issues.

11. Decided to touch base with all the government agencies and PSUs who have high demand for Temp

workers and apprise them about ISF existence and request them to share tendering process and to

keep ISF in the loop for all future tenders.

2. Decided that the Committees should work on bringing in the members and forming a team. And

that all the members should be brought in to actively participate in the committees.

3. Agreed that Committee Chairs should chalk out the agenda for themselves and come up with what

they can do to realize them.

1. Decided on the goals against 5 priorities chalked out in the earlier Executive Board meeting.

Key Issues Addressed

1. Executive Board discussed the progress of the study and provided with views on the same.

2. Keeping in mind the delay in the finalization of the report as also a potential clash with an ILO

Conference, it was decided to move the conference to October 4th

.

3. Audited accounts of the federation presented to the Executive Board, which were approved.

4. PR partner (PR Hub) interacted with the board and suggested views on the strategy.

Key Issues Addressed

1. Board welcomed the new CEO (Ms. Rufina Fernandes).

2. Decided to conduct research cum advocacy report on Outsourcing in Public Sector and Government

units. And, to use the same for educating Public sector influencers.

3. Decided to use a professional agency to make a representation before Central Board of Direct Taxes

(CBDT) with respect to the ambiguity around the deduction of taxes under section 194C & 194J.

4. The Financial target for the next financial year was pegged at INR 70 lacs.

5. Decided to prepare and present pre-budget memo to the Finance Ministry by January 31st , with

specific recommendations on:

a. Bidding and Tendering Process

b. Service Tax, and

c. TDS

6. Developments on Joint event by ISF & ISTD shared with the board.

7. Decided to renew the contract of the PR Agency.

8. Developments on the CIETT – ISF event shared with the Executive Board.

9. Update on the meeting between ISF and V V Giri National Labour Institute, to discuss the data

points in the ISF research report, was shared.

Executive Board Meeting 14, 6 March 2013

Key Issues Addressed

1. Ciett is organizing World Employment Conference from 15th to 17th May 2013 in Toronto. Decided

that ISF will support 2 delegates ($1500) where the supported will pay for his/her own travel and

accommodation.

2. Shared that the federation will close financial year with the corpus of Rs.8 lacs.

3. Decided to transfer excess funds (Rs.8 lacs) to a fixed deposit. And, to target the corpus of more

than Rs.8 lacs for the next year.

4. Agreed to work on getting more participation from Non-Member staffing companies.

5. Decided on E&Y after considering 2 other options for making the representation to CBDT.

6. Decided on conducting research on ‘Staffing in PSU’s and Government’ – which will look into

bidding processes and the key players’ active in the space among other areas. Agreed to scout for a

research partner.

7. Agreed to hold re-elections for the 2 seats that got vacant due to the elected members moving out

of their respective companies.

8. Decided on organizing an event in Bangalore in May end.

Western Region Committee

1. A 4 member regional committee was set up in July'12

2. Held the Western region ISF annual summit on 6th Feb'13. Titiled " Labour market reforms & Skill development: Cornerstone for inclusive growth in Employment." Western Committee members met Sanjay Dina Patil M.P and Shri Sachin Mohan Ahir, Minister of state for Housing & Urban Development to be Chief Guests for the event.

3. 'Single point of Contact' for CIETT secretariat of the Board visit incl. Organising a day's joint event of ISF-CIETT - an international colloquium that was held on 6th March in New Delhi. Involvement was focussed on the program structure, speaker-participants, Chief Guest, invitees as well as moderator. Coordinated roll out and run up to the event with the secretariat. Immensely successful in raising the credibility and stature of ISF among stakeholders. Chief Guest - Sriprakash Jaiswal- Cabinet rank minister graced the occasion. 4. Reached out to Mushirul Hassan - Minister of labour, Milind Deora- MoS - IT & communication and Mr. Munde - Principal Secretary, Labour; to be the chief guest at the ISF Conclave Mumbai. Also reached out to Medha Katti - Dy. Labour Commissioner, Dr. Krishnamurthy -labour law specialist, Dr. Brinda Jagirdar-SBI-Chief economist; for participation as speakers in ISF Conclave Mumbai.

5. Meetings held so far: Mr. Rajeev Dubey - President, EFI, Brent Wilton - Secr General,IOE; Ms. Tine Staermose-Director-ILO-DWT-India, Sharad Patil- Secr-Gen, EFI;

6. Social Dialogue: connected with Dr. Sanjeeva’s office to get an idea of where and who to begin with. Reached out to Mr. Gotabaya Dasanayaka at ILO to know players in touch with ILO so as to make a beginning. Mr. Dasanayaka offerred to help connect with TU members connected to them. ILO also Invited ISF to attend ILO submission of study on contract labour and discussion on employer position on 26th Feb'13.

Connected with Mr. Dada Samant and Mr. Bhai Jagtap through the Add. Labour Commissioner for attending ISF Mumbai conclave. R. Dada Samant attended the ISF Mumbai event and shared interest in having a dialogue/discussion.

7. Met up with the TDS Commissioner to check back on the timing and procedure of making representations to the TDS committee set up pre budget; and understood the process and time frame. Thereafter, on behalf of the Board checked back with 2 other Consultants - E&Y and Grant Thornton for their work and credentials in taking up advocacy on tax matters and representing associations.

8. In regular touch with current members and connecting with prospective members on a regular basis.

North & Eastern Region Committee

1. Connected with Indian Society for training and Development (ISTD) to conduct a joint seminar on Contract Labour in Kolkata.

2. Arranged contact lists from ISTD, NIPM, NHRD and CII to be included in ISF database.

3. Conducted a joint seminar on the subject "Management of Contract Labour & Outsourcing -The Contemporary Challenges and Remedies'' was organised at Kolkata on 18th of January 2013 at Hotel Golden Park. Around 130 people, including all the stakeholders like people from PF, ESI Department, State Government officials, people from Labour Department as well as corporates attended the seminar.

4. Contacted: Shri Purnendu Basu -Hon'ble Minister-in-Charge Dept. of Labour & ESI, Govt. of West Bengal to be the chief guest at Kolkata event.

2. Decided to re-draft Contract Labour Regulation & Abolition Act (CLRA) as requested by the labour department. Discussion underway on various chapters.

3. Committee met Dr. Montek Singh Ahluwalia and shared ISF research ‘Turning Available Work into Jobs’ with him. Dr. Ahluwalia asked ISF to submit a pre-recommendation and he will look at it for the next 5 Year plan.

3. Met Labor Commissioner at Gujarat and introduced ISF. To meet Labor Commissioner at MP. Also need to have another round of meeting with government officials and ISF representative in charge of Government Affairs

4. The committee got sponsorship of Rs.3 lacs for National Conclave held in Mumbai; and an agreement in principal for more such sponsorships for future regional events.

Events, Marketing & PR Committee

1. Committee worked on ISF Annual event, ‘Indian Staffing Conclave’ held on October 10, 2012 at India Habitat Centre, New Delhi. The committee with the help of other Executive Board Members got Hon’ble Union Minister of Labour & Employment, Mr. Mallikarjun Kharge as the Chief guest at the event.

2. Committee assisted the Regional Chairs in organising events in Mumbai and Kolkata.

3. Edited and re-written (wherever necessary) the ISF research report; Turning Available Work into Jobs’ for better understanding and connect.

4. Worked on the ISF-Ciett International Colloquium held on March 6, 2013 at Hotel Taj Mahal. Assisted the organising committee in coordinating the event.

About ISF

Established in 2011, Indian Staffing Federation, ISF has been created by leading staffing companies in the country with one common goal - Staffing India's Growth.

Staffing, an established form of outsourcing globally, is yet to be recognised and adopted as an effective means of running a businesses in India. The Staffing Industry provides a platform for recognised employment, work choice, even compensation, annual benefits and health benefits for the temporary workforce that constitutes around 40% of India’s total workforce. Staffing creates jobs that would not otherwise exist, enhancing competitiveness and workers employability, thereby promoting a labour market that corresponds better to peoples – and companies – needs and aspirations.

The purpose of ISF is to enhance long-term growth of the staffing industry and to ensure its continued ability to make positive contributions to the economy and society. The principal focus of the Federation's activities is to strengthen triangular employment relationships, in which the staffing company is the employer of the temporary worker, who works under the supervision of the user company.

ISF today comprises of 30 members companies who collectively provide employment to over 3.5 lakh people throughout the country.
