in special session at 8:00 a.m. on the 20th day of April 2021. Present were: Directors Michael

Manager Michelle Reimers and Executive Secretary to the Board Tami Wallenburg. Absent was:
Director Rob Santos.

OF THE TURLOCK IRRIGATION DISTRICT

The meeting of the Board of Directors of the Turlock Irrigation District was called to order
at 9:00 a.m. in regular session on the 20th day of April 2021. Present (via Zoom) were: Directors
Michael Frantz (Vice-President), Ron Macedo (Secretary), Charles Fernandes and Joe Alamo,
General Manager Michelle Reimers and Executive Secretary to the Board Tami Wallenburg.
Absent was: Director Rob Santos.
Board Vice-President Michael Frantz read the following statement:

PUBLIC COMMENT PERIOD
Customer Milt Treiwieler commented on climate change matters and the need for more
solar and other clean energy options.

WEEKLY UPDATES
Trading and Scheduling Department Manager Bill Bacca reviewed power operations for
the month of March. The Balancing Authority Area daily estimated system peaks averaged 352
megawatts for the month. The load was met with Thermal at 43 percent, ACS Specified at 21.6
percent, Wind and Solar at 6.1 percent and Wind Exchange at 16.9 percent. The Tuolumne Wind
Project (TWP) generated 35,320 MWh’s during the month of March at the Willis Substation,
averaging at 35 percent of capacity. Natural gas prices at Pacific Gas & Electric Company’s
Citygate averaged out at $3.59/mmBTU. Thermal generation and implied heat rates for March show
Walnut Energy Center at 75,164 MWh and Almond 2 Power Plant at 13,089 MWh. Mr. Bacca also
reviewed EIM average market selling prices, Almond Unit 2 and Unit 3 market dispatches and load,
Powerdex pricing for the month using the hour-ahead market index and CAISO’s day-ahead and
hour-ahead market selling prices. Electric operations for this period show half of Walnut Energy
Center ran through March 8 for economics, full WEC March 9-16 for economics, with all of WEC
forced out of service on March 17; WEC remained out of service March 25-31 for spring
maintenance; Almond ran for 24 days for economics; EIM had a go-live date of March 25; and
Rosamond Solar was reduced to 78 percent capacity.
Utility Analyst/Hydrology Olivia Cramer reported on current water conditions.
Accumulated precipitation measured at the three mountain stations in the Tuolumne River
watershed from September 1, 2020 to present total 17.27 inches, or 53.1 percent of normal to date
(Note: The precipitation water year begins on September 1 each year). Forecasted precipitation for
the 8-Day forecast on both the US and Euro model is on average to wet conditions with the 16-
Day showing the Euro model slightly higher, between average and wet for the first eight days with
slight precipitation on Sunday followed by a smaller precipitation event on Monday. The 9-day
forecast is showing temperatures increasing over the next three days then leveling off at an average
of 77 degrees for the remainder of the week. Lows are averaging in the low-50s. San Francisco
reservoirs contain 433,060 acre-feet and the Water Bank is at 492,576 acre-feet of credit. CCSF
releases for the past 7-days averaged at 1,057 cfs with 381 cfs in diversions. Don Pedro contains
1,382,210, acre-feet and is currently at 772.4 elevation. Average combined releases were 1,964
cubic feet per second with 548 cfs to TID canals, 465 cfs to Modesto Irrigation District and the
remaining 951 cfs going to the Tuolumne River. Computed natural flow for the current water-year
is averaging 3,075 cfs, and computed natural flow to date is 254,493 af or 27 percent of average.
Turlock Lake contains 19,259 acre-feet of water. The updated weekly watershed report shows Don
Pedro elevation decreased a little over half a foot when compared to the previous week.
Water Distribution Department Manager Mike Kavarian presented an update on irrigation
activity for the week of April 12-18. Daily releases from Turlock Lake averaged 639 cfs, or 117
cfs below projections. Water orders received during this period totaled 1,313, with an additional
254 orders the previous day. Of the orders received, 63 percent are flood irrigation and 37 percent
micro-drip. Flows ranged between 735 to 510 cfs. Mr. Kavarian also noted that almonds, oats,
alfalfa and pasture were the top parcel types for irrigation. Approximately 73 pumps are available
for use, with an additional 75 pump contracts still out and currently being checked by the pump
department. Spills are at six percent. Mr. Kavarian also noted the forecast tool presented by Water
Operations Manager Seth Aldrich at the previous meeting will go live this afternoon. The Board
Secretary stated there was a member of the public wishing to speak via Zoom, with the Vice-

President stating the public comment period had concluded and they are welcome to email their
comments to staff.
PUBLIC HEARING REGARDING THE PROPOSED INCLUSION INTO
IMPROVEMENT DISTRICT NO. 80020, KNOWN AS MILLER MICRO-SPRINKLER
A public hearing was opened at 9:28 a.m. to receive comments from the public regarding
the proposed inclusion into ID No. 80020, known as the Miller Micro-Sprinkler. Customer Milt
Treiwieler commented via Zoom stating the meeting is public and members of the public should
be allowed to speak. Hearing no further comments from the public, the hearing was closed at 9:29
a.m. with the following action taken:
RESOLUTION NO. 2021 - 26
RESOLUTION OF FINAL ORDER OF THE BOARD OF DIRECTORS OF THE
TURLOCK IRRIGATION DISTRICT APPROVING INCLUSION OF ADDITIONAL
LAND INTO IMPROVEMENT DISTRICT NO. 80020, KNOWN AS THE
MILLER MICRO-SPRINKLER
WHEREAS, the Board of Directors of the Turlock Irrigation District on April 20, 2021 at
9:00 a.m., held a public hearing on the petition for inclusion of additional land into Improvement
District No. 80020, known as Miller Micro-Sprinkler, under the provisions of Part 7, Division 11,
of the California Water Code. Based upon the evidence presented at the public hearing, the Board finds: 1. All of the landowners of the parcel described in attached Exhibit A to be included have
signed a petition for inclusion and have properly filed the petition with the Board. The petition is
incorporated herein by reference. 2. The District's Water Resources Administration, in accordance with a Board resolution,
has properly prepared a Report of Survey of the proposed inclusion, an Estimate of the Cost of the
Inclusion, and the Statement of Proposed Charge for inclusion into the improvement district. 3. Proper and timely notice of the public hearing was given in accordance with California
Water Code Section 23646 and/or the California Constitution. 4. The land, which the Board finds should be included, is described in the attached Exhibit
A and incorporated herein by reference. 5. The land to be included within the improvement district will be benefited by the
improvement district facilities. 6. Fourteen Thousand, Seven Hundred Eighty and 12/100 dollars ($14,780.12) is a just
charge, which the landowner must pay as a prerequisite for the land being included into the
improvement district, and that land title holder will deposit that amount of money with the
Executive Secretary of the Board for payment of that charge before recordation of the Final Order. 7. The Board tabulated the ballots submitted and determined no majority protest exists. 8. The landowners have agreed to pay all future assessments levied upon the land by the
Turlock Irrigation District for the maintenance and operation of the improvement district.

9. It will be in the best interests of the Turlock Irrigation District and the improvement
district to allow the land described in Exhibit A to be included in the improvement district.
NOW, THEREFORE BE IT HEREBY ORDERED AND DECREED by the Board of
Directors of the Turlock Irrigation District that the petition for the inclusion of additional land into
Improvement District No. 80020 is hereby approved, and that the lands described in Exhibit A is
hereby included within the improvement district. Moved by Director Alamo, seconded by Director Fernandes, that the foregoing resolution
be adopted.
Upon roll call the following vote was had:

Noes: Directors - None
Absent: Director Santos

RESOLUTION NO. 2021 - 27
RESOLUTION CALLING FOR A PUBLIC HEARING ON THE PETITION
FOR THE INCLUSION OF LAND INTO IMPROVEMENT DISTRICT
NO. 13480, KNOWN AS FULKERTH PUMP,
AND FOR THE LEVYING OF AN ASSESSMENT ON THE INCLUDED LAND
WHEREAS, a petition for the inclusion of additional land into Improvement District No.
13480, has been properly filed with the Executive Secretary of the Turlock Irrigation District, and
WHEREAS, the required data on said inclusion has been prepared by the Water Resources
Administration of the Turlock Irrigation District in accordance with California Water Code
Sections 23626 and 23877 and said data has been properly filed with the Executive Secretary.
NOW, THEREFORE, BE IT HEREBY RESOLVED ORDERED that a public hearing on
said petition shall be held at 9:00 a.m. on May 18, 2021, in the office of the Board of Directors of
the Turlock Irrigation District, 333 East Canal Drive, Turlock, Stanislaus County, California, and
that proper and timely notice of said public hearing shall be given in accordance with California
Water Code Section 23646 and California Constitution Articles XIII.C and XIII.D.
Moved by Director Fernandes, seconded by Director Macedo, that the foregoing resolution
be adopted.

MOTION APPROVING TREASURER’S REPORT
ON TURLOCK IRRIGATION DISTRICT’S
INVESTMENT PORTFOLIO AND SUMMARY OF INVESTMENT ACTIVITY
Moved by Macedo, seconded by Fernandes, that the Investment Portfolio dated March 31,
2021 which was prepared by Public Financial Management, Inc. for the Turlock Irrigation District
(District) and reviewed by the Board of Directors be hereby accepted, and that the Board of
Directors hereby acknowledges the opinion of Treasurer Brian Stubbert, confirming the
Investment Portfolio is in compliance with the District’s Investment Policy and verifying the
District has the ability to meet budgeted expenditures for the next six months.
All voted in favor with none opposed (Director Santos was absent). The Vice-President
declared the motion carried.
MOTION APPROVING 2020 CONSULTING ENGINEER’S REPORT
Moved by Alamo, seconded by Macedo, that the Consulting Engineer’s Report prepared
by Leidos, pursuant to Section 714.4 of Resolution No. 86-164, containing comments on the
operation of Turlock Irrigation District’s irrigation and electric systems during fiscal year 2020,
and recommendations for future operations that may be deemed necessary or appropriate is hereby
approved.
All voted in favor with none opposed (Director Santos was absent). The Vice-President
declared the motion carried.
PRESENTATION OF AUDITED FINANCIAL STATEMENTS FOR YEARS ENDING
2020 AND 2019
Accounting & Finance Department Manager Jesse Kirschner and Moss Adams Partner and
Engagement Reviewer Julie Desimone presented the District’s Financial Statements for years
ending 2020 and 2019. Ms. Desimone stated the audit progressed on time and in an orderly fashion
with all requested schedules and draft financial statements received on a timely basis. She noted
all personnel across many departments within the District were courteous, responsive and fulfilled
all of the auditor’s requests. Ms. Desimone wished to thank CFO/AGM Financial Services Brian
Stubbert, Mr. Kirschner and other pertinent staff for the excellent facilitation of the audit process.
Mr. Kirschner also wished to thank accounting staff for their assistance throughout the audit.
MOTION APPROVING AND ORDERING
PUBLICATION OF FINANCIAL CONDITION
Moved by Director Alamo, seconded by Director Macedo, that pursuant to Water Code
Section 24272, the financial statements for the twelve months ending December 31, 2020
disclosing the financial condition of the Turlock Irrigation Distract for that period, and to direct
that the notice required by the Water Code Section be published in the Turlock Journal is hereby
approved.

MOTION CANCELING THE TURLOCK IRRIGATION DISTRICT
REGULAR BOARD MEETING OF APRIL 27, 2021
Moved by Director Alamo, seconded by Director Macedo, that the regular meeting of the
Board of Directors of the Turlock Irrigation District scheduled for April 27, 2021, be canceled.
All voted in favor with none opposed (Director Santos was absent).The Vice-President
declared the motion carried.
GENERAL MANAGER’S UPDATE
General Manager Michelle Reimers responded to the public comment made earlier in the
meeting on climate change. She emphasized the District has taken a leadership role on this matter
and the topic is included in many discussions with staff while also noting climate change questions
are included in customer surveys. Ms. Reimers stated affordability is a concern with the 14
communities served by the District and TID continues to strive in meeting the state’s climate goals.
Director Macedo thanked the General Manager for clarifying the District’s position on climate
change.

Action Requested
Board approval during the meeting of May 4, 2021, of Agreements to Abandon Use of
Improvement District Facilities from 4 improvement districts.
Discussion
Owners of the parcels listed below have requested abandonment from the listed improvement
districts since they no longer use these improvement district facilities. Easements have been
obtained where improvement district facilities exist on or adjacent to an abandoning parcel. Fees
for qualifying parcels have been waived in accordance with Turlock Irrigation District (TID)
Improvement District Rules, Section 5.1.3.1. All remaining parcels have paid prior year
assessments, construction assessments, and water charges as a condition of abandonment.
These abandonments, representing 7.08 acres, to be acted upon by the Board. Section 5.2 of the
TID Improvement District Rules allows parcels to abandon from improvement districts under the
following circumstances:
Parcels greater than one acre that are developing or are completely developed
Non-urban parcels less than or equal to one acre
Urban parcels five acres or less
Agricultural parcels that receive District surface water through privately owned facilities
or through the facilities of another improvement district.
Parcels may abandon from pump improvement districts when it has been determined
that the abandonment will not have an adverse effect on the remaining ID parcels.
One abandonment is for a parcel of land that is required to abandon or qualifies to abandon under
TID Improvement District Rules for developing parcels. Where required, the developer is
constructing improvements to development standards on the improvement district facilities.

in improvement districts within the Turlock Irrigation District and have signed Agreement to
Abandon Use of Improvement District Facility, which agreement is incorporated into this resolution
by reference; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Turlock
Irrigation District, acting as trustees for Improvement District No. 01611, known as the Lower
McHenry, and Improvement District No. 06110, known as the Lower Henry Lazar Br., do hereby
approve the Agreement to Abandon Use of Improvement District Facility signed by the holders of
land is hereby approved.
BE IT FURTHER RESOLVED that the Executive Secretary or Deputy Secretary of the
board of directors is authorized and directed to sign the agreements on behalf of the district and to
record said agreements with the appropriate County Recorder.

AGREEMENT TO ABANDON USE OF IMPROVEMENT DISTRICT FACILITY
WHEREAS, Improvement District No. 01611, known as the Lower McHenry, and Improvement
District No. 06110, known as the Lower Henry Lazar Br. are improvement districts organized and
existing under an Act of the Legislature of the State of California, known and designated as the
"Irrigation District Improvement Act," which improvement districts are within the boundary of the
Turlock Irrigation District; and
WHEREAS, Turlock RV Lot, LP, the owner of the following described real property situated in
the County of Stanislaus, State of California: See Attached Exhibit "A" APN: 045-062-001 7.76 Acres of which 6.53 Acres is requesting abandonment
AND WHEREAS, in the matter of Improvement District No. 01611, known as the Lower
McHenry and Improvement District No. 06110, known as the Lower Henry Lazar Br. within the
boundary of the Turlock Irrigation District, the said land was included within the boundary of the
said Improvement District Nos. 01611 and 06110, the owner now desires to withdraw the same.
NOW THEREFORE, in consideration of the Board of Directors of the Turlock Irrigation District
permitting the withdrawal of the said land from the said Improvement District Nos. 01611 and
06110, the owner herein above named, Turlock RV Lot, LP, does hereby forever relinquish and
abandon to Improvement District No. 01611, known as the Lower McHenry and Improvement
District No. 06110, known as the Lower Henry Lazar Br., and existing within the boundary of the
Turlock Irrigation District, any right to use the facility or improvements of the said Improvement
District Nos. 01611 and 06110, for the purpose of irrigating or draining any of the above described
property.
This agreement is to apply to and bind the successors in interest and the assigns of the parties
hereto.

Receipt of Petition and adoption of Resolution during the meeting of May 4, 2021, to dissolve
Improvement District (ID) No. 13650, known as the Wigt Pump, setting a public hearing for June 1,
2021 at 9:00 a.m. to dissolve said improvement district.
Discussion
The Wigt Pump is an improvement district that was formed on September 19, 1977, for the
construction, maintenance, and operation of an irrigation pup. The improvement district has a current
membership consisting of four (4) parcels of agricultural land, including: Stanislaus County
Assessor’s Parcel 017-059-002, owned by Edward A. Amador Jr., and Carlene Amador and containing
a total 49.25 acres, APN 017-059-004, owned by Sanders Family Almond Ranch LLC and containing
80.02 acres, APN 017-059-005, owned by Esther Wigt, Et al and containing 79.97 acres, and APN
017-059-006, owned by Candido A. Borges, Trustee and containing 78.11 acres. In total, 287.35 acres
currently utilize this improvement district facility.
The landowners have requested this improvement district to be dissolved. All indebtedness of the
improvement district will be paid within 30 days of the Board approving the dissolution. If the
dissolution is approved, the Turlock Irrigation District shall terminate the existing agreement,
completely relinquish its interest in the improvement district facilities and the pump will be converted
to a private facility that will be maintained at the expense of the landowners. The original
improvement district boundary is shown on the attached map.

WHEREAS, a petition for the Dissolution of Improvement District No. 13650, has been properly
filed with the Executive Secretary of the Turlock Irrigation District, and
WHEREAS, it is recommended that a public hearing be held on whether or not to dissolve said
improvement district pursuant to California Water Code Section 24100.
NOW, THEREFORE, BE IT HEREBY ORDERED that a public hearing on said Petition shall

PETITION FOR THE DISSOLUTION OF
IMPROVEMENT DISTRICT NO. 13650
KNOWN AS THE WIGT PUMP
TO THE HONORABLE BOARD OF DIRECTORS OF THE TURLOCK IRRIGATION DISTRICT:
1. We, the undersigned, hereby petition for the dissolution of an improvement district within the
Turlock Irrigation District (hereinafter referred to as “District”), to discontinue the levying of an
assessment on the lands within the improvement district, and to provide for the return of the
existing irrigation works to the members using those facilities. We certify that we represent the
landowners of two-thirds (2/3) or more in number of the acres of all the tracts of land situated
within the boundaries of the existing improvement district.
2. The result of the proposed improvement district dissolution will be to transfer to the landowners
within the improvement district presently existing improvements as described in Exhibit A at the
location indicated on the attached Exhibit C map. The landowners agree to assume control and
responsibility for the operation and maintenance of the improvement district improvements and the
costs thereof.
3. The undersigned acknowledge the Board of Directors of the District will be released from their
trustee duties over Improvement District No. 13650 if this petition is approved. In addition,
approval of this petition will void all Board approved agreements allowing parcels to utilize the
improvement district facilities.
4. All irrigation easements secured by the District by grant, by estoppel or by prescription for the
improvement district are no longer required by the District for present or prospective irrigation
purposes and the District shall abandon and relinquish all rights in that portion of the improvement
district easement. This release does not apply to drainage easements, public utility easements
and/or electrical easements within the improvement district.
5. The names of the owners of all the land within the boundaries of Improvement District No. 13650,
together with their last known addresses and a description of the parcel or parcels of land owned by
each such owner within the boundaries of the improvement district, according to the next preceding
equalized assessment book of the District, are contained in the attached Exhibit B. The list of the
parcel descriptions contained in Exhibit B constitutes a description of all the land within
Improvement District No. 13650.
6. The attached map, Exhibit C, shows the land within the boundaries of Improvement District 13650
and each parcel of land within the improvement district to be dissolved is designated on the map by
the respective parcel number used in Exhibit B.
7. The undersigned declare that Improvement District No. 13650 is not indebted to the District. The
facilities have been paid for and there are no outstanding fees or assessments.
8. The landowners accept the facilities in their existing condition “AS IS” and assume all liability for
such facilities. The District does not warrant the facilities and shall not be liable for any claims,
costs, damages or attorney fees arising from or related to the condition, operation, use, repair
and/or maintenance of the irrigation facilities, including but not limited to property or crop damage
or personal injury. The landowners acknowledge the “community ditch” rules of Water Code
Section 7000 et seq will apply to the use of the facilities.
9. All of the attached Exhibits are incorporated herein by reference.

The description of the Pump Irrigation Improvement District No. 13650 is as follows:
A pump irrigation system consisting of one V.H.S. motor 1,800 RPM, part wind pumping plant
panel 460 Volt, 3 stage bowl assembly, 10” x 10’ suction pipe, 10” galvanized cone type
strainer, 1-7/16 x 2-1/2” x 10” x 10’ column pipe, discharge head, related electrical service, and
miscellaneous equipment.
Upon dissolution of the improvement district the control of and responsibility for the maintenance and
operation of the existing facilities will be the responsibility of the landowners utilizing the facility.
The pump facility is noted on the attached map (Exhibit C).

Consider approving a motion to resume the disconnection process for all customers with delinquent
accounts in accordance with TID’s standard business practices.
Discussion
On March 4, 2020 in response to COVID-19, Governor Newsom declared a State of Emergency in
California. As the COVID-19 case rates increased a statewide shelter-in-place order directing
Californians to remain in their homes except to meet essential needs were issued along with a
moratorium on electric and gas service disconnection for non-payment. Although this moratorium
didn’t require TID to comply, we followed suit because it was in the best interest of our customers
given the circumstances of the pandemic.
TID ceased disconnecting service for non-payment in March 2020 and we suspended our standard
business practices of assessing late payment charges and issuing delinquent and disconnect notices for
non-payment on April 1, 2020.
Throughout the pandemic, TID Customer Service Representatives have proactively reached out to
customers with past due balances to let them know about financial resources available and to offer
payment plans and arrangements specific to their individual needs.
As our past due balances grew, it was decided in November 2020 to resume the late payment charges.
Notification that the late payment charge was resuming was mailed to all customers with a past due
balance. As of December 21, 2020 accounts with a past due balances received a late payment charge.
In an effort to address some customers with very large outstanding balances, on January 18, 2021 we
began the collections/severance process for customers with past due balances greater than $10,000.
On February 23rd the threshold was lowered to $7,500 and on April 7th it was lowered again to $5,000.
To date, only 3 accounts reached the point at which they were disconnected for non-pay. Only 1 non-
residential account remains disconnected for non-payment.
While the pandemic continues, our communities have moved into a less restrictive tier. We are seeing
a reduction in case rates and vaccines are now widely available. Governor Newsom has set a marker
of June 15th for the state to fully open if these trends continue pointing toward a return to normalcy in
early summer. With this information, Staff is seeking the Board’s concurrence by approval of a motion
to resume the disconnection process for all customers with delinquent accounts in accordance with
TID’s standard business practices.
